Police in riot gear, they are not stopping protesters from continuing violent clashes in ferguson, missouri, more than a week after a cop fatally shot an unarmed black man. Police firing tear gas, smoke bombs, rubber bullets, all of that trying to disperse protesters. You in the front line up there . In the front line, yes, and they just start shooting. Heres the thing. They are demanding answers the protesters after the death of 18yearold Michael Brown. Police are set to meet with browns family later today for the first time. Two reporters covering the protest, they were arrested at a mcdonalds after a swat team swarmed in and told everyone to leave. They were told they were, quote, trespassing and were later released without being charged. The Police Officer who shot brown was injured in the incident and had to be treated in the hospital for swelling on the side of his face. His name has not been released and the decision to withhold the name from the public has only further tensions. Missouris governor has canceled everything on his schedule to make a visit to ferguson, were told, later today. Thank you for that. Ferguson is breaking out into ultimate chaos as we see. As you look into the background of that area, there seems to be a long line of problem between the constituents of ferguson and Law Enforcement there. They did a study at the university of los angeles in california and say we have issues. The police chief did something i think is relatively controversial. He said i am not releasing the name of the officer involved. We knew here in new york city right after the incident unfoldd with eric garner and the choke hold incident. We had the video. It was still mysterious. You couldnt see a face. He said im not giving out the name yet because there have been Death Threats. We heard from police chief thomas jackson. Last night he spoke with sean hannity about that. We originally believed we had an obligation to release that information to the public and to the press, but what happened is another officers name was released as being the officer involved in the shooting. He was not, but his picture was put up on the internet, his Facebook Page was hacked and Death Threats started coming in. Thats when we weighed the benefit of releasing the information right now versus the safety to the officer, his family and his neighbors and the rest of the Police Department. Some of the other officers involved have been told take vacation, get out of town until this blows over basically. A lot of questions as to the violence unfolding there, people going into stores and Looting Stores. Is that helping . Al sharpton shows up. Is that helping . He doesnt go to chicago to talk about the 26 People Killed there but he shows up here and says stop the violence. One man goes on an epic rant, goes viral i dont know if you saw this basically telling his fellow men and women in that community stop it, weve got to make a change. Watch this rant that is going viral. It is not helping. Change is not going to come until we change it. And i hate to say this but im going to tell you what you need to hear as opposed to what you want to hear. All we know how to do is blame the police and white folks for our actions. There was criticism before on the Trayvon Martin case on the left saying wheres the president in this. They were slow, dragging that are feet on it. There was the acquittal of the George Zimmerman trial. Now the Justice Department saying theyre doing a separate investigation in ferguson, separate from what the state and local police have to do. Eric holder getting involved right now and a lot of people wondering as the summer unfolds, we pick up the newspapers, there is violence across the globe right now. Where is the president s leadership as he is there in Marthas Vineyard. Maybe to give reason behind the angst that Many Americans even outside of missouri are feeling right now. Special forces Assessment Team that went to mount sinjar to try to figure out if an evacuation is necessary. If so, how to do it. Team is getting eyeballs on the situation there going on for awhile now. Video from the mountain shows a dramatic scene of men, women and children attempting to survive on a rugged mountaintop after running for their hives from isis terrorists after they had been surrounded. Shows of force of police in riot gear arent stopping protesters in ferguson, missouri, more than a week after a cop fatally shot an unarmed black man. Heather childers has been following this story. Whats the very latest overnight . Those images, the st. Louis suburb look as you saw, like a war zone overnight. Police firing tear gas, smoke bombs, rubber bullets, all of that trying to disperse the protesters. You in the front line up there in the front line, yes they started shooting they are demanding answers after the death of 18yearold Michael Brown. Police are set to meet with browns family later today. Thats for the first time. Two reporters covering the protest were arrested at a mcdonalds after a swat team stormed in, told everyone to leave. They were told they were, quote, trespassing and were detained after they were recording the scene. They were later released without being charged. And were learning that the Police Officer who shot brown was in fact injured in the incident and had to be treated at the hospital for swelling on the side of his face. His name has not been released and the decision to withhold the name from the public has only further escalated tensions. Missouris governor has canceled everything on his schedule to make a visit to ferguson today. You guys have been following this on twitter and within every second there is an update. The unrest in many black leaders calling for protesters to take a page from Martin Luther king, junior and use peaceful protesting. Yep. One man so frustrated, he went on an epic rant on line. All we know how to do is blame the police and white folks for our actions all we know how to do is march and riot and loot. Hes echoed the sentiments of many black conservatives because this type of thing is uncalled for. Whats interesting to me is when sharpton came in and im standing on the very Hallowed Ground that he was on yesterday, when he comes in, nobody is really talking about the problems that get created by this. So much criticism has been leveled against al sharpton and others, black leaders who havent gone into cities like chicago where bringing the light of the camera into those neighborhoods to talk about all of the violence thats unfolding there, then he shows, al sharpton shows up yesterday. They say its a political opportunity to roll into a city like this. What do you say . There is no question. Whats funny is the people protesting were here to begin with and sharpton didnt bring out any new protesters. And he said all the right things because he wants to appear to be the true black leader that he falsely represents. But the fact of the matter is, he, barak obama, and eric holder really should have been talking about the bigger issue, which is i think Law Enforcement and how this all occurred and the type of decay, the moral decay thats occurring in neighborhoods like this. So you think the big pick is not so much the incident that needs to be examined. Its whats going wrong in the inner city. One quote from a member from somebody who lives in the area. He says police here are angry and people here are angry and frustrated. There needs to be justice. If you find a Single Person in the community who trusts the police, that is like finding a four leaf clover. What do you do in a community where the feeling is like that . Well, this is absolute nonsense. People do trust the police. There are many, many more instances of the police doing great things and not only the black community, but across the nation and you get an incident like this where we dont even know all the facts and everybody is automatically jumping to the conclusion that the police have done something wrong. I dont know whether thats the case or not. What i can tell you is i would ask the folks in black neighborhoods, would you rather the cops not be here or would you rather they be here to protect you . Do you think it matters in terms of the police force staff being reflective of the community there, community where twothirds of it is black right now as the numbers show, but only three officers are black. Does it matter how many officers actually look like the people in their community . Its a great point, elisabeth. I think there is 53 cops on the force here and three of them happen to be black. If you were to use that logic, you would think that there would be no black people in fergu is t type of a ratio. The fact of the matter is, if the police are here to protect you and theyre doing a good job, who cares what color they are. But the bigger point there is a lot of the police who are black have left the Ferguson Police department for better and easier jobs. You also say the role models, you say its too bad its not Clarence Thomas and too bad it is snoop dogg. Right. My point there is that weve got to a point in the black community where were idolizing the wrong people. Here again, here is a neighborhood that says kill the police. I happen to live in a black neighborhood here in st. Louis, we need the police protection. So were doing things opposite because quite frankly, i think liberalism has sort of led us to this opposite way of thinking. You should be exalting people like Clarence Thomas and many others that are out there fighting the good fight, but instead, we do tend to idolize people that dont live the types of lives and we wouldnt want for our kids. Were going to go through some sound and opinion here, the Political Leadership as it relates to iraq and lets listen to them the evaluation from the American People. This is president obama sharing americans that she will not be dragged into another war in iraq. I know that many of you are rightly concerned about any American Military action in iraq. Even limited strikes like these. I understand that. I ran for this office in part to end our war in iraq and welcome our troops home. Thats what weve done. As commander in chief, i will not allow the United States to be drug into another war fight not guilty iraq. What do you see . What we saw is a low of 49, high of 71. Overall i think he did a really good job of bringing people along. I give him an a on that. He gets an a for that messaging, at least the response was positive coming out. The response was positive because it was really important that he put a distinction there and say this isnt going to be another war. If he was going to go out with this humanitarian effort language that wasnt very credible, he had to distance himself from the past. He did a pretty good job there with it. Interesting. So Hillary Clinton says we can learn from the problems that weve had in the middle east in the past. This is a piece of what she said. If youre looking at what we could have done that would have been more effective, would have been more accepted by the egyptians on the political front, what could we have done that would have been more effective in libya where they did their elections really well under incredibly difficult circumstances, but they looked around and they had no levers to pull because they had these militias out there. My passion is lets do after action reviews. Lets learn these lessons and figure out how were going to have different and better responses going forward. Sounds measured. What do the American People think . There was a low there of about 50. A high of 73. We saw a drop when she was backwards looking. We saw a positive as she started to say lets learn. I think whats interesting here is that its really difficult to distance herself from ebola ebola. What she did she said were going to do a review. Lets learn from this. And so it wasnt a total slam, but it was saying im different and im curious that Something Different will happen. Overall i give her a b. So the response is a b on this. So far the messaging thats moving forward from these leaders is working. It is working. Okay. Dick durbin says the conflict in iran has no chance of escalating into a war. Take a listen. Well, i can tell you this, escalating it is not in the cards. Either the American People or congress are in the business of wanting to escalate this conflict beyond where it is today. I think the president made it clear this is a limited strike. He has, i believe, most congressional support for that at this moment. To go beyond is going to be a challenge. So here we had a low of 50, a high of 65. I think hes like the solid b student. You werent really excited about him, but he wasnt defensive. He answered the question and showed he had congressional support. That was really important to the people. Despite violence increasing and crieses globally, this messaging seems to be calm and measured. So is it working despite the reality . I think messaging hits you first in your gut and then hits you in the head. So i think first people have gut reactions saying this is pretty good. This as we learn that the cop who shot brown had to be treated at the hospital for swelling of his face. The citys police chief talked to sean hannity last night, explaining why they have not released the officers name yet. Listen. We weighed the benefit of releasing the information right now versus the safety to the officer, his family, and his neighbors and the rest of the Police Department. That decision to withhold his name from the public has further escalated tensions there. While you were sleeping, north korea firing a shot across the bow at the pope . The atheist country that doesnt recognize western religion firing three rockets as pope francis landed in south korea, a country that is increasingly embracing christianity. Thats the problem. He didnt understand that. Even here in milwaukee, wisconsin, Milwaukee County. So once again, not understanding the Political Climate was a huge risk and of course im in his crosshairs because he needs a high value, high visible prize catch that he can march around with as an example of what might happen to others. But thats not working in Milwaukee County and i doubt thats going to work anywhere else. Whats going to be effective to revitalize the inner cities . Well, first of all, two things have to happen. We have to have more effective Law Enforcement. However, in the city of milwaukee, the largest city here, the mayor here fails to put forth a vision to help people escape poverty. He has failed to put forth a plan to deal with the high level of black unemployment in milwaukee, at 32 when its about half of that nationally. We have a broken school system, a system of not giving kids a chance to be able to read and write, add, subtract, multiply, divide at grade level. We have some horrible scores coming out in those areas. Its not giving kids a chance to compete for the jobs of the 21st sentry. I want to show you some video of whats been unfolding overnight because it looks like a war zone in ferguson, missouri. Unbelievable images there as police are out in riot gear trying to calm the crowds as theyre taking to the streets, Looting Stores all in response to the killing of the unarmed teenager, Michael Brown. What should police be doing . There is some criticism this morning that they have not released the name of the Police Officer, of course, who was involved in the shooting. Death threats being leveled. How would you handle it . I wouldnt let it get to this point. I say shame on the mayor. I heard 70 of that suburb is black, yet the Police Department is mainly white. The police chief is white. Im not playing the race card, but im saying that city it appears to me, does not, or the Police Department does not reflect the makeup of that city. The mayor should have known that. Apparently he didnt have his finger on the pulse of the community and understand that the tension was rising between his Police Department and the minority community. I think they ought to reconsider this decision not to release that officers name. Being a Law Enforcement officer myself for 37 years and a Law Enforcement executive, i understand the concern of the safety of the officer and his family. Put the family and the officer in protective custody. Put a plant in his neighborhood to watch the home. And meet these folks halfway in terms of releasing the officers name. When the officer is on duty i have my name on my shirt. The public has a right to know who its Public Officials are and actually we have a rule that you have to give your name when asked for. Now all of a sudden the officer gets involved in a situation. Im not judging the shooting cause i dont know the facts. But now all of a sudden he gets involved in a shooting situation and were going to not release his name. I just think they ought to reconsider. Meet them halfway. If his name is released, what changes . Nothing really. Thats why i said and im concerned about the officers safety. Nothing would change but the officers safety, sheriff. Put him in protective custody. Put his family in protective custody. Give these folks down there on the ground some indication that you at least have a sense of their frustration and anger and youre willing to meet them halfway and willing to work with them. So as much as theyre in love and building their future and they have great jobs and all these things, living together does cause and can have legal problems if in fact they split up. So thats something they should surely look to. Who gets the dog. Question number two, what is the most common error made that becomes regrettable in the absence of one of these agreements . All the time in and its when one owns the house. They move in together. Theyre in love and they put the other partys name on the house, so now theyre coowners. Sometimes joint tenants, sometimes tenants in common, things of that nature, which are legal terms. Now something goes wrong. All of a sudden what was love ends up to be emotional extortion for money because the person that owned the home originally who is on the mortgage, clayton, who put the other partys name on the home, the other party on the home is not responsible for the debt, but now they have leverage because theyre on title. While everyone is talking about the riots, what about the actual facts of the case . Joining us now, fox news legal analyst, peter johnson, jr. Passion and politics have overcome what the facts are and the facts are in dispute. Lets look at what we know already and what is undisputed. It occurred on camp field drive in ferguson, missouri, slightly after 12. There we have a pullout of that. There are two different versions of whats going on. Yes. One is from one witness, doran johnson. This is his take of how the events went down. He said get the f on the sidewalk. He just reached his gun out the window and grabbed my friend around his neck and was trying to as he was trying to choke my friend. And he was trying to get away and the officer then reached out and grabbed his arms and pulled him into the car. His weapon was drawn and he said, ill shoot you or im gonna shoot, and the same moment, the first shot went off. His weapon was already drawn when he got out of the car. He shot again and he turned around and put his hands in the car and started to get down, but the officer still approached with his weapon drawn and he fired a couple more shots. Break down this time line for us. Sure. Lets talk about what hes talking about and his friend, Michael Brown, the fellow who got killed, 18 years old, 6 4. He says dorran says the officer told the two men to get on the sidewalk. The officer then tried to exit his vehicle, but couldnt open the door because the two men were so close. According to dorran johnson, the officer grabbed Michael Brown by the neck and tried to pull him inside the car. Then according to johnson, the officer pulled out his weapon and fired one shot striking brown. Then the two men, johnson and brown, started running. The officer pursued them. Finally the officer shot again. Brown allegedly put his hands in the air, started to get on the ground. Brown allegedly yelled, i dont have a gun. Stop hoot shooting, unquote. Then according to dorran johnson, the officer stood over brown and fired several more shots. Okay. The Police Version is a sharp contrast to that. This is st. Louis Police Officer john bellmar and his version. As the officer was exiting his police car, allegedly pushed the Police Officer back into the car where he physically assaulted the Police Officer. There was at least one shot fired within the car. After that the officer came back out of the car. He exited his vehicle and there was a shooting that occurred where the officer in fact shot the subject and the subject, they were fatal injuries. So lets talk about what the chief is saying as to what occurred in the Police Version. He says the officer exited the car, and Michael Brown pushed him back into the vehicle. That person allegedly assaulted the officer inside the car. Then there was a struggle for the officers weapon, which occurred inside the car and the shot was fired. Then the officer exited the vehicle and then the fatal shots occurred there after. More than a few, according to the chief of the officers shell casings at the crime scene. The officer was injured and needed medical treatment thereafter as a result of what happened. Two stark versions to what occurred on that day in ferguson. The politics and the pressure continues.
