i heard he wrestled it from a guard, another sailor. >> i can't speculate on that right now. >> they are talking about the weapon that was allegedly used. that base is the largest naval installation in the entire world. it was put on lockdown for about 45 minutes after that shooting as a precaution. new information coming in thisç morning. we'll keep watching it. let's head out to washington state where the devastating toll from that mudslide continues to grow. we are learning at least 14 people are dead and 176 residents remain unaccounted for in this area. this morning the 911 calls, some of them, are being released. listen here. >> houses are gone! >> are there any injuries? are we basically saying remember those military cuts that were proposed and making headlines recently with the pay increases not happening and the increased expenses for housing and at the commissaries and how critics are saying this is going to hurt recruitment processes for getting more men and women who want to be in aoufrpbl. come andç get us. >> the united states military is getting smaller when the russian military is getting bigger. putin increased military spending 79% in the past decade, spending 4.5% of their g.d.p., according to the world bank, they upgraded their soviet era transport jets and military aircraft and everything in the military. and what are we doing? this is one of the first studies we're seeing that it can actually affect them. the good thing is 87% of the couples were able to have children and give birth, but 13% had a problem. they also counted for cigarette smoking, alcohol and coffee. >> a lot of times with more stress we turn to something and for a lot of times it is cigarettes or alcohol. what do we need to do to stay away from that if we're trying to get pregnant? >> you have to rule out mechanical issues, obstructions of the tubes and ovaries. number one for infertility isç age. if you rule out everything else, the message of the study is try to stay away from cigarette smoking, alcohol. try to involve in yoga and rest. that is important. the other thing is what is the effect of men. >> it is not just the bird or just the bees. which ones? you're talking part-time workers. charles payne for the fox business network joins us. the numbers are huge and this statement is tremendous. >> it is huge. we periodically see these kind of stories and we're all taken aback and what the heck, something has to be done. as you delve deeper, it becomes more astonishing, the so-called double dipping. we know most of these public-sector workers make subsubstantially more than private sector counterparts, benefitsç more lavish. you got all these things going and add in pension spiking, the last year when you work a lot of overtime and the pay for the rest of your life is 20% higher than it was. then you add it on with how about i go back to the trough and get more of the action? we talked about it a lot when the economy was melting down and some of these cities and municipalities were filing for bankruptcy and it became absurd we the taxpayer would be spending money on this sort of abuse. >> you want to put names and figures? a school executive madeç $150,000 last year as a special services employee. she also will collect a $73,765 annual pension from new jersey. what is special services? and how can i get that job? >> i don't know. you wonder why there is this huge fight to keep the school systems as they are, to protect this for -- fortress of ineptitude. in new york city the idea that we would close down charter schools to protect teachers, not students, it's $1 billion of abuse across the country. >> the private sector never worked because people have to have a bottom line. if they don't have a bottom line, they go out of business. francis bork, $120,000 salary, $58,000 in pension. she is aç part-time worker. >> it is absolutely astonishing. these are public servants. >> great benefits, not a great pay, but you go into these public -- these municipality jobs and state jobs in order to get those benefits and security. >> that was always the way it was sold and pitched. in the 1980's we saw a divergence where public sector workers started to outdistance private sector counterparts. that gap has grown wider. it is crazy when you think how many people living paycheck to paycheck are actually paying taxes into a system where there's this much abuse. the income inequalityç argument, what is someone making on a local level? because i heard he wrestled it from a guard, another sailor. >> i can't speculate on that right now. still investigating. >> the base was put on lockdown for 45 minutes after the shooting as precaution. this is the largest naval installation in the entire world with about 46,000 members of the military and 21,000 civilian employees working there. we'll keep watching this as it develops. in washington state, that devastating death toll from the mud slide in washington continues to grow this morning. at least 14 people have now confirmed dead and 176 still remain unaccounted for at this hour. we're now getting 911 calls for the first time. take a listen here. >> everything is gone! the houses are gone! >> are there any injuries? >> people are yelling for help! >> we are also getting these dramatic new images coming in. this is a rescue crew who had managed to rescue a four-year-old little boy that they say had been drowning in mud. they managed to save him and another happy story to bring you. there was a little baby who was pulled from the debris. the crews were told it was too dangerous to try to save him, but they did it anyway. today some tough news to bring you. more rains are expected and that's part of what brought this mud slide to begin with. more rain expected and those conditions expected to be dangerous again today. we'll keep watching this. and the search for the missing malaysia plane is on hold today because of bad weather in the area. when the crews resume tomorrow, they will be focused on the indian ocean and that's believed where the jet crashed. earlier officials in australia comparing the mission to finding a needle in a hay stack. >> we're not searching for a needle in a hay stack. we're trying to define where the hay stack is. that's just to put it in context. >> we talked a lot about how deep the indian ocean is. the average depth, more than 11,000 feet and to put that in context, the world's tallest building does not come even close, at 2700 feet. it also dwarfs america's tallest building, including the empire state. another insult coming in to the family of those victims. the family members of the passengers, you can see them here crying and screaming. they received a text from the malaysian airlines that their loved ones had died. that's how learned about this confirmation, through a text. the ceo of that company defending the decision to notify relatives, saying he wanted them to hear the tragic news before the entire world did. what do you think of that? take a look at this crazy video coming out of new york here. a dare devil illegally base jumping from the top of one world trade center in new york city. the guy and three of his buddies are facing felony charges. james brady, andrew rossirk g and another man sneaked into the building in september. there was a fourth guy who was on the ground as a lookout. all four turned themselves in yesterday. they were charged with third degree burglary. one of the guys helped build the tower and police think that that is how they were able to get inside. that building not completely built yet. so perhaps that played a role. hillary clinton getting some support from an unlikely source, sarah palin. during an interview with the tv show "extra" about her new show, mario lopez asking how she felt about hillary clinton. palin replied, quote, i would like to see women run for higher office. i think america is ready for more women at the upper echelon. those are your headlines. very gracious. >> maybe she was talk being herself? >> could be. >> thank you, heather. let's talk a little bit about this. our president is over in europe, of course, yesterday he was at that emergency summit to try to figure out what the heck to do with putin and russia. essentially what he continues to say is they're on the wrong side of history. they're breaking international law, blah, blah, blah. none of that stuff is working. extraordinarily at a time when he should remind the world that we are the lone super power left, what our president did was instead he reminded russia, hey, you know what? we're not spending so much on military anymore. don't worry about us. >> yeah. he did an interview with the dutch newspaper and he said, as we have told our european allies many times, we want to see more european nations meeting their commitments when it comes to defense spending. we're moving toward a leaner military. the question is, is this a now thing, our military weakness to the world? it's a huge problem, especially to vladimir putin. hey, you want to take crimea? who is going to stop you? you want the rest of the ukraine? >> go get estonia. >> you want to be a bully? who is going to stop you. >> john kerry saying this is not authoress, we're just mentioning we shouldn't invade another country. not personal. canada cut their defense spending almost 8%. slovenia, 10%. the fact is, the president's got a point is that all these european nations expect us to bail them out and stick up for them in all these fights when they don't put any of their dollars into -- they put their dollars into their economy and we have to put our dollars into their defense. i would hope they step up. it's not the correct time to mention that when you're supposed to be flexing your muscles muscles and showing a unity of force with the russians having 70,000 troops welled up on the ukrainian border. >> exactly. that's the reason the president should not have said with 80,000 troops right there, by the way, we're shrinking. we should point out that putin in the last ten years has grown the military of russia by 79%. >> we're going to switch gears now and talk about obamacare celebrating its fourth birthday over the weekend. anybody bake a cake for it? with six days to go before the obamacare deadline, the study that they wish didn't happen. a lot of families and business, you have to do a cost-benefit analysis. new study out that basically says the costs outweigh the benefit. >> in a gigantic way, take a look at this. the american action forum estimates that the regulatory cost to the united states since the affordable care act was signed is $27 billion. what that boils down to, the annual regulatory cost, $6.8 billion, which it looks like the annual benefit cost regulations 6.8 billion. the benefits, 2.6 billion. so in other words, as you can see right there, the regulations cost a lot more than the benefits. we should point out these gigantic costs are largely paperwork. that 20,000-page stack of regulations and things people have got to follow? it has generated a gigantic amount of paper. >> and you remember the debauchle of the rollout of the web site, a lot of times people were signing up and then having to resign up and resign up and nothing was working. they said let's go back to the old-fashioned way. let's get out the stone and tablet. >> abacus. >> yeah. proving to be a problem. >> i thought we were heading toward electronic medical records and that was the controversy. instead we're talking about paper and it's costing too much money. health department says it's 90 million work hours going into it. still, that's with all the suspensions and waivers. can you imagine once we get all the other elements into this how much more unwieldy this program will be. either way, it will decide who will control the senate and the house in about nine months. >> in the meantime, as we launch toward the end of this month when the sign-up ends, the affordable care act is costing us close to at least $52 million the government is spending on advertising since january. they're targeting the young people. they're trying to get them to sign up before it's too late, which is the end of the month. what's interesting is apparently we're spending $150,000 for advertising on the onion, which if -- >> mock newspaper. >> everything on it is fake. so if you see banner across the top about obamacare and you're reading it, don't you think you're going to think it's a joke? it happens more often than you think and the law is not on the parent's side. joining me, two victims of this loophole, tyler blackwell and his mother, rebecca. good morning to both of you. thanks for being with us. >> good morning. thank you for the opportunity. >> rebecca, tyler's father was a donor. set up your story and explain exactly what the problem is. >> i used a donor and when tyler was 15, i was able to use the small clues i got from the sperm bank to track him down, as it were. and his sister told me a year later that the donor had an aortic dissection and that the family, the mother and the two brothers, had also had aortic aneurysms. so i took my son to johns hopkins at 16 and they said he already had an aneurysm growing. and this this is a dominant trait and half of the children will inherit this. >> and he also had open heart surgery at the age of 17. tyler, when you hear that your father had this and your mother wasn't alerted ahead of time, how does that make you feel? >> well, i don't really blame the donor, so to speak, because he didn't know when he donated. i'm not angry or hold ill will towards anyone for this. i'm just grateful i found out and was able to get the problem fixed. >> absolutely. rebecca, the f.d.a. currently requires that communicable diseases be tested for, but not any genetic problems. do you think something needs to change? >> they do test for what they can, but not religiously. for instance, they will say they tested for cyst tick fibrosis when they really haven't. this is not something they could have tested for. but there is no laws that say that a donor has to report medical issues as they occur. the donor did not report this until i informed his doctor that he had been a donor. >> and did the donor have anything else, tyler, that you have that you inherited that you wouldn't have known about? >> yes. he also had asburger's syndrome, which i inherited. that was a mild case. >> it's a form of autism. >> but if you had known ahead of time, then maybe i imagine you had some sorts of problems or challenges in school and perhaps they could have been addressed sooner, tyler? >> well, yeah. >> there was no way to test for that either. >> right. but about half of them, i believe, are believed to be inherited, anyway, from my notes here from our producers. rebecca, do you feel like in any way if sperm donors were forced to go through more rigorous testing that it would discourage them from donating? >> i think there is a lot of testing going on now 'cause only a very small portion of donors actually qualify to become donors. it's like one or 2%. it's very low. but what i'm concerned about is the lack of information that's passed on to the children. there is no law that says they have to report medical issues and even if they do, sometimes the sperm bank will hold on to those issues until they hear of more people suffering from the same issue before they will let the children know. >> thank you so much for speak out, both of you. and tyler, we're just happy that you're doing well and that you're healthy this morning. >> thank you. >> can i mention one more thing? look at that. there goes john deere. >> he thought it was branches. it turned out it was a deer. so we have another one who survived. >> we have plenty at our house. >> let's go over to heather to find out what's happening. >> steve, you have lots of deer. >> we have deer, bear, possum. >> it is always new jersey you hear that. >> good morning. hope everyone is off to a good day. got some news. this one coming out of the state of georgia. now approving a historic gun law allowing gun owners who have permits to carry weapons in public areas such as restaurants, churches and airports. the bill also authorizes school districts to appoint staff to carry guns at school and also under the law, people with a weapons permit may carry a loaded gun into a bar as long as they don't drink alcohol. the legislation now goes to the governor. nathan deal, a republican, for his signature of the we'll watch that story for you. prisoners are now packing their bags and they could soon get cash and a cell phone for the road. it's part of a new proposal from the department of justice to make it easier for inmates heading to halfway houses. attorney general eric holder claims a little money and a cell phone might help them secure a job after their time is served. the proposal is part of a bigger initiative that also includes cutting down mandatory minimum sentences and restoring voting rights for ex-cons. are we in the middle of a school lunch revolution? ♪ ♪ >> we all remember that story, right? now a group of kansas students making this video to protest the first lady's federal program which casts school lunches to 600 calories. the kids say they're hungry. now a school district of wisconsin is dropping that program all together. waterford school officials say the lunch sign-ups dropped 2 to 3% last year. kids are either skipping lunch or bringing their own. they say too many kids are tossing pricey fruits and vegetables and aren't eating them. so this school district is going to handle it their own way. this morning the dog in indiana is being hailed a hero for saving his owner from a gas leak. erin kramer was walk her dog when he suddenly dragged her into the back of the house and up the stairs to her water heater. that's when she says she was hit with the smell of gas. the heater had sprung a leak and started to spark. >> they said it probably would have ignited the gas fume and taken out not only this house, but several around me. if it wasn't for him coming into our lives, we probably wouldn't be here right now. >> nice dog. kramer says that she was actually suffering from a cold which is why she couldn't smell the gas on her own. thank goodness for the dog. and those are your headlines, steve. >> all right. thank you very much. imagine an unemployment rate of 2.9%. that would be great, right? well, it is great right now where the folks in midland, texas. nearly everybody who wants a job has a job. if you hop in your car and head west, things only get worse. the unemployment rate in houma, arizona is 26.1%. talk about a tale of two cities. what gives and who better to ask than the governor of the great state of texas, rick perry. good morning to you. >> good morning. >> midland, texas, famous for oil production and shale as well. houma, arizona, has the largest solar plants in america. that makes it an interesting comparison. >> yeah. i think there may be more to it than just that. in texas, we have kind of an all of the above energy policy. we're the number one wind energy producing state in the nation. >> yeah. >> we do. that's basically how we have addressed this. obviously the george mitchell and the fracking phenomena that has been going on for four or five years has been exceptionally good fort state of texas and helped places like pennsylvania, up in the dakotas. it could help in new york. it could help in california. but those folks have made the decision to not do that type of work in their states. and that's their right. but the fact is, it's one of those things that the citizens are going to have to decide themselves, if they want to see that type of economic assistance from the oil and gas industry. >> what you're talking about is success leaves clues, texas has some clues to offer, right? an all of the above strategy, recruiting of business, zero tax in the state attracts people who want to be part of the economy. >> we've been doing this now fo. it's not theory anymore. there were folks who said, well, if you pass that tort reform law, this is going to happen. you're going to lose the ability for people to get good health care. well, just the opposite happened in the state of texas. it's a decade ago we passed sweeping tort reform, over 30,000 doctors licensed to practice medicine, a lot of access to health care in the state of texas, our tax structure, regulatory climate that's fair and predictable, legal system that doesn't allow -- >> what are you doing for your uninsured? during the debates issues that's what the other republicans were going after you for. >> listen, the health care is about access. it's not about -- in texas, we think it's good for people to have access to health care. we don't think it's right for government to force you to buy insurance whether you want it or not. and that's what this issue really boils down to. texas medical center in houston, more doctors, nurses, physicians, scientist goes to work there every day than any other place in the world. we've got fabulous health care across the state of texas. people have access to it. that's the real issue. there are doctors along the rio grande valley today giving health care to pregnant females where they were having to drive, the females were having to drive miles to another county to get that type of health care prior to our tort reform. so the issue from my perspective -- and i think it's the right one for the people of the state of texas. if you want to force all of the sidss in your state to have insurance, that's your call. but don't one size fits all from washington, d.c., everybody is going to act this way. everybody is going to accept these programs. let the 50 states be laboratories of innovation and people will pick and choose what they're doing. they're voting with their feet today and coming to texas. >> what takes you away from the great state of texas and brings you to new york? >> you fish where the fish are, as i have to say and there is lots of fish here from the standpoint of individuals who are overtaxed, overregulated, and overlitigated and we're just saying hey, if you'd like to live in a different environment, keep more of what you work for, state of texas is available. >> are you sure you want new new yorkers to move to texas? >> you know what? there is some great new yorkers. when you think about -- >> i'm being funny. >> hannity, he's always talking about he's going to come to texas. i gave him that shot one more time yesterday. >> we won't let him leave long island. sorry. >> after new york, you're going to new hampshire and south carolina. wait a minute. >> actually i'm going to washington, d.c. tomorrow. >> that's the nation's capitol. what about those other places where they start the caucuses and the primaries? >> we spend a good bit of time in iowa in particular. my focus is on 2014, helping these governors who are doing a great job in red states, putting red state policies in. rick scott, i've been to florida a number of times for rick who is doing a fabulous job getting that economy back on track. we'll be helping governors in those states that have competition and obviously in the united states senate races as well. >> what about two years from now, will we see your hat in the ring? >> you'll see me around somewhere. i don't know in what role. >> with boots and without the boots and with glasses, those are two things that changed. >> i have a lot of changes. enjoy your youth. >> governor, did running last time make you want to run more again or less? >> and wisconsin governor scott walker tweeting a bible verse that gets him through the day. one group says it is a threat and they want it taken down. your e-mails are pouring in. every study has revealed that mornings are better with friends. watch this animation. we have a lot to discuss. what if we don't get in? will hemmer and mccallum give us an extra hour? >> we have a whole hour. >> heather nauert will be in the news here in about ten seconds as soon as she makes her way over. >> run! >> laura ingraham is actually in the wings right now and i cannot wait to see her tee off on some of the big items happening, including what's happening in the ukraine and the class photo we just saw. >> we're going to start things out, with the big news in norfolk. >> sorry about that. i was getting an update of what's going on in norfolk, virginia. this happened overnight. we start with a fox news alert. at this hour, the ussmahan is a crime scene. a navy sailor shot and killed on the ship at the naval station in norfolk, virginia. security forces responded, shooting and killing the male suspect. it happened around 11:20 p.m. last night. a navy spokesperson says the two killed were both men, but wouldn't describe the circumstances behind that shooting. it's worth noting that to get on base, civilians have to be escorted or have a pass, which officials at the base say that the suspect did have. that base was put on lockdown for 45 minutes after the shooting as a precaution. it is the largest naval installation in the entire world with about 46,000 military and 21,000 civilian employees. we'll keep watching this story. then in washington state, the death toll from the mud slide in washington continues to grow this morning. at least 14 people have been confirmed dead so far and 176 are still unaccounted for at this hour. crews are continuing to search today through the mud that's really more like quicksand, they say. in some spots it's about 15 feet deep and the conditions are considered extremely dangerous. now we're hearing some of the 911 calls for the first time. >> the houses are gone! >> are there any injuries? >> yes! there is people yelling for help! >> new images are now more thanking and take a look at this. the rescuer saves the life of a four-year-old boy. the crews say that this little boy was drowning in the mud. they were able to get him out. and then there was a crying baby who was pulled to safety from debris even after the crews were warned it was too dangerous to go after that little boy. in that rescuer's arms. thank goodness for that. and today torrential rains expected to hammer the area and that is expected to hamper the efforts to find more survivors. we'll keep following this story. the search for the missing malaysia plane on hold today once again because of bad weather. when the crews resume tomorrow, they'll focus on the southern indian ocean are and that's where it's believed the jet crashed. officials in australia compared the mission to finding a needle in a hay stack. >> we're not searching for a needle in a hay stack. we're still trying o define where the hay stack is. that's just to put it in context. >> take a look at how deep the indian ocean is. the average depth, more than 11,000 feet. to put that in perspective, the world's tallest building doesn't even come close. the tallest building in the world, 2700 feet in dubai. of course, it's completely dwarfs america's tallest buildings like the empire state building. still so hard to see these images. family members of the passengers seen here crying and screaming after they received a text from malaysian airlines officials that their loved ones had died. the ceo of the airline later defending his decision to notify relatives that way, saying he wanted them to hear the tragic news before the world did. wisconsin governor scott walker is taking heat for this tweet. look at this right here. it cites a bible verse and it reads: i can do all things through christ who strengthens me. atheist groups lashing out at the governor, telling him to take down the tweet, saying it's promoting religion over nonreligion. he refused, saying it inspires him. so your responses are pouring in on facebook. also e-mail and twitter. what are people saying? >> thanks. i'll tell what you rick says. finally someone stands up to the atheist bullies. good job. it's his page anyway. >> dale says, stand your ground, governor walker. it's difficult being the good guy, but you can do it. you've already shown your strength and perseverance. and mike says, atheists want freedom, too. they should recognize the right of the governor to have that freedom, too. thanks, everybody, who weighed in on this. we're going to bring in our laura ingraham to get her to weigh in on this. what do you think? he just posted philippians 4 : 13. he didn't even write the word. >> first of all, even mentioning the bible today, you know, as a public official will get new trouble with the right people. scott walker is a terrific governor. he's done a great job for the people of wisconsin. again, it sort of shows the dividing line that exists in our country today, the secularists versus more traditional americans, faithful americans. i think he'll be just fine. i don't think this is going to have much of an effect on anything. >> we'll see how he perseveres. the "new york times" has a reporter, james, who wrote a story how he believes that this administration is the greatest enemy of the press' freedom in a generation. do you buy that? >> gosh, so he left out putin and president gee of china? that's quite a statement. and that's coming from the "new york times" which i think we can all conclude has been fairly favorable toward the president in its coverage. look, we've talked about this before, what they did to james rosen, what the administration countenanced when it came to dealing with tea party and patriot groups at the irs. that was a targeting based on political views. the failure of this president to hold press conferences as so many members of the press believe is important to hold given the fact that we have so many major crises facing the country. and the lack of transparency, just on a whole host of issues. so look, i'm glad he kind of came along to this viewpoint, but a lot of us have been saying this for 4 1/2 years. >> it's interesting, in addition to james who has an action to grind with the administration, because he's been up against them for a while, "new york times" editor called the obama white house the most secretive she's ever dealt with. one other thing he said was any one journalist who exceed those parameters regarding national security reporting will be punished. >> right. look at what the dealings with this news channel and the white house has been. o'reilley has been able to get a couple interviews and bret baier did that one interview. but the derision and the dismisssiveness with which president obama -- i would say personally exhibits towards fox news. well, you people are obsessed with these issues -- i'm paraphrasing. we've had hearings on these issues. i know this makes for good ratings and you all like me -- he's always having these sarcastic digs. the fact of the matter is, there are really important questions out there about what is facing our country in terms of the middle class, foreign policy, the nsa, across the board. he is the leader of this nation and should answer basic questions without sneering and complaining about the fact that he has to answer the questions. i find it to be so predictable, yet quite depressing. >> instead, we get his bracket. >> right. >> and president obama being in europe and talking with the dutch newspaper and essentially reminding everyone, reminding the world that we've cut our military. as we have told our european allies many times, we want to see more european nations meeting their commitments when it comes to defense spending. in the united states, we are moving toward a leaner military. you say this isn't necessarily a call to action as far as everything with putin goes. but you say it's more of a lack of caring about foreign policy. >> well, i think from the beginning the president was fairly clear in his intentions for the country, right? we were going to have the global community was going to have to step forward. we were going to step back. that as a result, there wouldn't be all this tension between a strong america and an america that was too assertive, too adventure ous militarily and things would probably become more stable. well, that has completely gone down the toilet. the rest of the world has become more unstable. america has entered a period of decline. and we owe a whole bunch of money to a lot of people and a lot of the people in the country are saying, wait a second. loan guarantees to ukraine? i hope the ukrainian people are okay, but we're not okay. so europe has to step up. so i agree to some extent what the president is saying, that european leaders, they have to step up. this is aggression occurring in their own backyard and the american people, meaning us, taxpayers, have been paying for europe's protection for decades and decades and decades without their commitment financially to their own military. >> they have to keep a certain threshold of defense spending, they're not doing it. they say, well, i can't really get on board with sanctions 'cause my people need home heat. >> right. >> so they have an opportunity to buy from us now and we should be going in that direction. get some loyal customers. >> i think a the american people, republicans and democrats, would be very happy if that were the development because i think people are very wary about the u.s. spending a lot more money in a country or part of the world where it's very murky. we don't exactly know what we'll get out of it. people are concerned about spreading our money and maybe down the road our military even more thinly than they've been spread over the last ten-plus years. >> she joins us once a week and today is the day. laura, thank you very much for joining us from a gloomy day in washington. >> yeah. snow is coming. >> we enjoy seeing your smile. coming up, a view from one world trade center that you've never seen before. this view got the photographers arrested. was it worth it? does that make every side happy? senator rand paul has been an outspoken of the spying scandal and joins us now. senator, you going to be happy if they let the phone companies keep the meta data? >> i don't want to take all the credit for ending this, but i think our lawsuit had something to do with bringing the president to the table. some of it depends on what actually happens. the interesting thing is he unilaterally instituted this program without congressional authority. now he's saying he has to wait for congressional authority to undo it. he could stop it if he were serious. but i don't like the idea of collecting the data. if it's left in the phone company's hands and you have to have a warrant with an individual's name on it, then that i think meets the law, the constitution. but we'll have to see what happens. the president sometimes says one thing and does another. so the devil is in the details here. >> have you talked to the c.i.a.? do they feel they need this program? >> well, the interesting thing is i'm not sure whether to believe them or not. we have the c.i.a. now illegally searching congressional computers, giving access and then removing access and i really think that there needs to be an overall investigation of the intelligence community. i favor a select committee like they had in the 1970s, the church committee, to look into all of these. there is a certain amount of arrogance that needs to be checked. >> you see arrogance coming out of the c.i.a. and the white house? >> yeah. i think is something that really should be discussed in our country. most of us, whether you're republican or democrat, believe in freedom of speech. we also believe in free exercise of your religion. but if they're telling you that your tax dollars have to go to something you find morally represencible, i think that's not free exercise of religion. >> i'm not sure how you celebrated four years since the passage of obamacare, but here we are at the end of this month will be the time to get that threshold of 7 million. the democrats are pushing to get that enrollment figure up in the final lap. what do republicans have to say about that? i'm joined by psychiatrist and fox news contributor dr. keith ablow and fox news legal analyst arthur aidala. good morning to you. >> good morning. >> it seems like the lack of regulation in this just is unbelievable. >> i couldn't agree more. i do a lot of research last night on this. not only regarding the law, but i spoke to people who have used sperm donors and egg donors and if you look at a piece of pork, a pig, like the regulation that we go through before we're allowed to have this bite of bacon, how many people have to inspect it and look at it and what the pig eat and where to go and you compare it to an egg donor, it's nothing. there is nothing. there is so little regulation in a state by state basis. i believe this needs to be a federal, a federal law that has to do with children having access to their records. the first thing a doctor asks you when you go into their office, do you have a history of heart disease in your family? what does that kid say? i don't know. do you have a history of colon cancer in your family? i don't know. how do they treat these people? they're really at a disadvantage. >> they certainly are. but dr. ablow, is this going to discourage people from donating sperm or eggs because they want to remain anonymous? >> well, it truly is legal insanity. arthur is absolutely right. people have a right to their medical records and to procure this genetic material. when you don't know if it's conveying a communicable illness, it's a real problem. here is something else, the blackwells, who took anonymous sperm as a donation, they aren't wearing white hats here because i think all anonymous donation of sperm or ova is wrong. it's wrong across the board because you're depriving kids of the knowledge of who their biological parents are. this isn't just a medical issue. this is a spiritual issue. you need to know your dad and your mom, be able to look them in the eyes, barring a tragedy like death. and the fact that the blackwells did this and are then complaining, well, we didn't get the right sperm, or it should have been disclosed to us earlier. you shouldn't have done it at all. >> they're not saying that. what they're saying is just that the f.d.a. right now is requiring screening for communicable diseases, so you're not going to have measles, mumps or hiv, but not for genetic problems. >> interestingly enough, they had no problem depriving their kid of the knowledge of who his dad was. >> i want everybody at home to take a listen to rebecca and tyler. we had them on earlier. >> the donor an aortic dissection and the family, the mother and the two brothers had also had aortic aneurysms. so i took my son to johns hopkins at 16 and they said he already had an aneurysm growing. this is a dominant trait and have of the donors' 34 children will inherit this. >> he also had hasburger's syndrome that i inherited. though it's mild case. >> what would have to happen to make regulations? >> the legislature has to get involved. i'm the last guy to be advocating for more laws. but since the creation of life. if we're not going to get involved in how human beings are produced, then what are we going to get involved in? what goes into bacon? so we need to have our congress people actually do their jobs and speak to their constituents and see what we want. do we want what dr. keith says, there should be no donors whatsoever? >> a middle school in springfield, illinois, the workbook says this amendment states that people have the right to certain weapons providing that they register them and they have not been in prison. so the father of one of these kids gets outraged about this and posts it on facebook anonymously 'cause he's scared there is going to be some sort of backlash in that state, and he actually talked to the teacher, talks to the head of the history program. they said, you know what? i agree with you, something needs to change. but the school district superintendent says this, he's doubling down. >> what happens with the right to bear arms. in the context of 20141 the right to bear arms in reality, not as written in the constitution, but in reality is in any way abudged? and the answer is yes, in some places by the need to register guns or register gun owners and so on. >> he's not making that up. they have changed the second amendment and they're teaching that as a fact. here is why they should not use that part of the book. because it's wrong. >> because you can't rewrite the constitution. >> it's just flat out wrong. we should also point out, no plans to remove it from the workbook and this guy went on to say, micromanaging teachers by reviewing all material they want to teach would be insulting to educators. how funny is that? >> reporter: it's now day four of the search and rescue operation. officials say the chances of finding anyone alive at this point are slim at best. but some officials are still holding out hope that they are going to find more survivors. we are going to be updated with a press conference here at 9:00 o'clock this morning. the official death toll now stands at 14. reports of the missing or unaccounted for has jumped from 108 to 176. officials are quick to say they expect that number to go down. some people might have been counted twice. today crews face new challenges, more rain, which could cause the cliff to crumble even more. more help is on the way. president obama signed a disaster allowance, allowing fema to tap into every resource they need. the national guard and urban search and rescue team is expected to arrive to aid in the search. governor insley says dot crews are working hard to clear snow from a mountain loop highway and that could open as early as tomorrow. conditions for the search crews have been absolutely awful. the mud slide hit saturday shortly before 11 a.m crews were dealing with mud sometimes 20 feet deep. stability of the mud hampered efforts. but still, officials are hopeful there are still survivors. >> i'm a man of faith and i believe in miracles. you've all reported on incidents world wide where these things can turn on a dime and somebody can be found. so does that mean we give up?
