i thought it was really cool that he said i kind of screwed up last year. i played with an anger about me. he said i feel like i grew up in a year. i did this one thing in between games that made himself relax, read. >> yeah. >> so he would stay away from sports. and i think that people of cleveland might be a little bit easier with the fact that he won this year. >> then again, a lot of people in northeast are complaining about the heat. but that's the actual heat. >> and the actual -- and that team as well who eliminated the knicks. >> let's talk a little bit about this. jay carney got up in front of a skeptical white house press corps yesterday and was trying to defend the white house and this administration's use of executive privilege to say that they didn't have to turn over thousands of documents to the committee looking into the fast & furious debacle. at one point, mr. carney was talking about how, look, this was an operation started during the bush years and the front row reporters hooted him down and said nope, it did not start during the bush years and then eventually he got to the point where ok, it was a tactic started during the bush years. because there was similar operations also didn't work out very well called operation wide receiver. completely different, though, than operation fast & furious. >> on many different levels. meanwhile, carney had a chance to -- the press secretary had a chance to sit in front and take some questions yesterday and when it came to talking about the border agents whose name who was slain at the border, we're going to be talking to a colleague of his in about 10 minutes, he forgot brian terry's name, i think. >> we absolutely agree with the need to find out the truth about why fast & furious happened. why the tactic that again was employed in the previous administration and different operations and was stopped by this attorney general. why it came about. and that's why the attorney general referred it to inspector general. that is why we have provided congress every document that pertains to the operation itself that is at issue here when you talk about the family that you referred to. and -- >> terry family. >> the terry family. >> the family you referred to. the family that had the son who was killed with one of the guns from operation fast & furious. >> obviously, americans want justice for this and so do the parents. brian terry's parents speaking out on sean hannity's show last night. let's take a listen. >> i think they're lying and they're hiding, they're passing the buck. i know they're hiding something big. i think something happened out there. >> eric holder has been before congress so many times and the first couple of times, you can tell there's something being hid with something not being said and after a while, when you feel like throwing the tv through the front window, it says you get tired of hearing the constantly lies that you know they are doing. and i think that they're bringing all this up because they want to put fast and furio on the back burner until the election is over. >> one of our colleagues will be joining us shortly and he'll be talking about the impact and his reaction to the fact there's been nothing close to closure for brian terry but i'm simply amazed at the theme that is again weaving through this investigation suddenly and that is it wasn't our operation. we just picked up where the bush administration left off. that was called operation wide receiver. 250 guns. all had tracking devices on them and the next thing government knew about it and it was up to the mexican government to make the arrests and track the guns. this operation fast & furious had about a handful of tracking devices on them. they were brought literally from radio shack. nobody tracked them and the mexican government didn't know about it, let alone did they know how to enforce this or follow up and make this a criminal operation. >> and put into the hands of known killers and kidnappers and drug dealers who ultimately killed this man and this poor family is still upset this morning. >> they want some answers. after the jay carney press briefing, charles grassley, the senator from iowa had to issue a correction of sorts to mr. carney that said the carney statements that the administration provided congress every document that pertains to the operation itself is, according to mr. grassley, hogwash. plus he asked the white house for them to explain exactly why the president is claiming executive privilege. and here's a snippet from the letter he had sent to the white house anna? >> well, at the last minute, before the white house committee proceedings began this mornrnin i received notice that you were claiming executive privilege. after 18 months of investigation and interaction with justice department officials on this matter, this was the first indication that anyone at the department or the white house believed the documents being sought were subject to executive privilege claims. all happening there at the last hour, too. >> meanwhile, let's talk a little bit about this. it looks like the supreme court is going to rule on so-called obamacare monday, maybe thursday. >> we thought yesterday. we also thought this monday. >> it looked like it. what's interesting, though, there's a couple of items in "the wall street journal" over the last day or two and it talks about a company that david axelrod started in 1985 called akpd. earned millions of dollars when barack obama was running for president. when axelrod went to the white house, he agreed to sell the particular company. he's taking it for, i think, $2 million. extraordinarily, though, the ethics committee went along with the idea that, you know what? it doesn't sound like they got all the money. why don't we do it in installments even though mr. axelrod would still be working at the white house and his son would be working at that particular company. >> and, you know, this is a big no-no even in what we do. you don't bring somebody on the show just because they're your buddy and try to get advertisements for them for free. >> like when we see arthur, he's not paying to get on. he happens to be our friend. >> yeah. >> so anyway, he was supposed to sever all ties between his old company and what he was doing at the white house. then as it turns out according to "the wall street journal" when they were trying to pass obamacare in 2009 an outfit called healthy economy now or h.e.n. supplied ads supporting the health care reform and then it was apparently then hired axelrod's firm to run the ads promoting obamacare. it does look like there is some sort of a problem there. a series of recent incidents have come to the attention of 66 u.s. congressmen and just yesterday, the lawmakers jointly fired after a letter to defense secretary leon panetta looking for answers. virginia congressman randy forbes is the co-chair of the congressional prayer caucus, is among those who signed the letter and joins us live here in new york. good morning to you. >> good morning, steve. >> what is the air force doing that you've had a number of constituents contact you and complain about? >> steve, it's egregious where they're going now. as you know, the navy not too long ago banned bibles from being brought in hospitals even if it was a minister bringing in there. air force has come out and ruled that the word god can't be used in the air force even if it doesn't have a religious context. they have said that their officers can't inform their people that are serving under them of programs that the chaplains might have even if they're approved programs, they don't let them inform them of them. they've indicated they can't have any ethics programs, they've banned any ethics programs that have any reference to religion there. they've stopped their cadets from trying to encourage people from programs that help with that component. the big thing is having a chilling effect across the air force because these are people fighting for our rights every day and we need to be standing up for their religious freedoms and liberties. >> you know why they're doing it, they don't want to offend anybody. it's the p.c. police, they're cracking down on the military. >> they're doing that but they're offending a lot of people. we have over 2,000 chaplains in an alliance supporting what we're doing just to start getting some answers and say wait a minute, enough is enough. we have to make sure we're eninsuring religious freedoms that are fighting to defend us. >> you've written -- you and 65 other congressmen have written a letter saying come on, give us some answers. what do you expect to happen? >> the important thing is it's not just 66 members of congress, it's 6 out of 7 chaien of the armed services committee. we want to make sure we get a little more balance brought into this whole situation. >> what about the suggestion that you don't want to offend some people who might not, you know, might not read the bible. >> steve, when we wrote, you know, the bill of rights, we didn't say that you couldn't do things that you had a right to do if it offended people. what we said is that you had the right to do that. and that's what we want to protect, their rights to be able to have religious freedom and religious liberty. >> out of curiousity, what's your message to the members of the armed forces watching right now to pick up this fight? >> i would say hold on, there are people that believe in you. we know you're fighting for us and we hope to get this pushed back because, you know, the military has had a huge component of people that are very strong in their faith that leads them to do what they're doing. we want to make sure they continue and have the right to do that. >> what's the expression, there's never an atheist in a foxhole? >> in florida. >> listen. >> don't forget, going after eric holder because he's supporting measures to overturn the voter initiatives in the state. this is no accident. it is no coincidence. it is a plan on the part of republicans. >> the intent there dau-- i ki of mangled that up a little bit. it's not eric holder suppressing the vote but the state of florida to keep them from voting in the upcoming election. >> she wants to make sure they're actually people voting and they're actually residents of this country. the governor brought that up and the attorney general's office is filing suit but that is one of the craziest theories i have ever heard her say and she's had a lot of crazy theories. is she out of her mind? i mean, to say -- to say that they're going after eric holder on fast & furious because of voter suppression? can she prove that linkage? >> don't ask me. let's listen to congressman gowdy last night with greta. >> it's really beneath the office of a member of congress to say something that outrageous and the fact that she was once the speaker is mind numbing. honestly, and i've heard a lot in my 16 years as a prosecutor, i couldn't believe the words coming out of her mouth but keep in mind, this is the same woman who said she could have arrested karl rove any day she wanted so i don't know what was wrong with her yesterday or today or whenever she said that, but i would schedule an appointment with my doctor if she thinks that we are doing this to suppress votes this fall. that is mind numbingly stupid. >> and -- >> not mincing words. >> chuck grassley also came out and said look, it's not political and he detailed for reporters the times that he voted against the bush administration. when it came to the department of justice. so, you know, the republicans say it's not political. >> and november is right around the corner. it's a big elephant in the room. everything is political at this point. a lot that's going on with fast & furious, people are saying that's part of why the executive privilege was being used so that can be on the back burner and it's not going to be in the forefront come november. >> meanwhile, and earlier this week, bit way, nancy pelosi in the news deflecting the criticism of eric holder by saying she could have locked up karl rove on any given day. that caught our attention so we sent peter doocy to find out if that is indeed true in that historic building. hey, peter. >> hey, brian. that's right. it's been two days since the house minority leader nancy pelosi said when democrats controlled the house, they could have locked up karl rove any time they wanted. she said "i could have arrested karl rove on any given day, i'm not kidding. there's a prison here in the capitol and we've been told she was joking around when she said that. but when she said that, we wanted to go and find that prison in the capitol. but we couldn't because there is no prison in the capitol. at least not how you'd think now. beneath the capitol, half way between the house and the senate, there is a dark tunnel that leads to a small room with steel bars and a padlock on the outside. you're looking at what it looks like with the gate open. but this just looks like a prison. it's not actually a prison. it's really the room that was originally designed to be president george washington's tomb but when the plan to lay him to arrest there was scrapped, he ended up at mount vernon and minority leader pelosi was right in that congress does have the right to power -- rather, they do have the power to arrest and jail anybody that they charge with contempt of congress but they usually just send cases like that over to the justice department and according to the senate historian don richie, they haven't detained anyone since the 1930's. that was when an assistant secretary of commerce refused to testify but his jail cell was a room at the nearby willard hotel and another well known example of someone being detained here at the capitol of some 1848, that's when a new york herald reporter published a top secret treaty ending the war with mexico which was leaked out, very timely. that writer, john nugent was held for a month during the day in a committee room here at the capitol but at night, he spent time at the sergeant-at-arms' house. now the real holding cell used by congress is actually on d street inside the headquarters of the capital police department nearby some of the senate office buildings. it's not quite the crypt that some might imagine including many might imagine that work here at the capitol but a lot of people are able to avoid spending time in the capital police headquarters holding cell by negotiating their way out. back to you in new york. >> now we know there is no jail. no prison in the capitol building. but there is a tomb. thank you, peter. >> wow. meanwhile, on this show, imagine this, you go to the grocery store and your house is fine. and you come home and it is gone. what the heck happened? you have an aneurysm. what do we do? they gave me two options. operation obviously but go through my groin or through my head and obviously, that's why i have this lovely scar here and knock on wood, everything is good. >> what did you find out after you got your aneurysm healed and you had a stroke of luck going there. what did you find out about that whole issue? >> you know, it's a disease that a lot of people aren't aware of. and most of the time when people have aneurysms and they pop, you usually die. so -- >> you're lucky you had the water in your ear. >> i was so fortunate, i would never have had my head checked out. >> i had a girlfriend in high school who lost her mother that way. it's so devastating because you often don't see the symptoms. what is it that you're recommending people do exactly? >> i would recommend people to go get a scan. you're able to go do that and then it tells you, you know, technology has gotten so much bigger and more detailed that you can go get scanned. and find out if your family has a history of it. >> so you got this thing where almost all your clients are rich, powerful, famous people. so what you're doing is saying, hey, guys, i got you insurance and i'm setting you up for life. come down and set my cause. what's going to be taking place on monday? [beep]. >> unless you have something nice to say, don't say anything at all. >> just breaks your heart. so what is wrong with these kids? is it that kids are just nasty or is it something even deeper? let's ask dr. susan lipman, psychologist and author of the book "preventing hazing". good morning to you. thanks for being with us here. >> thanks for having me. >> so it seems like bullying in this instance, you know, you wonder if a lot of kids, it's not just one person doing it, so is it that group think that makes it even worse? >> well, yes and what we're looking at is a whole group of kids on a bus and you would have imagined that somebody would have intervened or reported it to the authorities. we were expecting bystanders to stop them but they never did. >> or you would expect her to even report it, right? but we heard yesterday she was on "fox & friends" and she said she was worried about losing her job just like kids are typically worried about being pushed even further outside of the group? >> that's really unfortunate because the reason we have monitors is to stop bullying so that the school should be training her how to prevent and intervene and how to stop the bullying for herself or for anybody else. >> well, you bring up an interesting point about how it seems like bullies used to be kind of the bad seed. but now that it's almost -- it could be honor students, it could be somebody else who has been bullied in their past. where do you think this rise is coming from or this perceived rise anyway? >> i think we see it in reality shows, you know, that we're learning how to bully, that the judges are often being harassed, harassing and demeaning to the contestants and the contestants themselves feel like victims so we're really giving kids a model of how to bully. and unfortunately, parents actually watch these shows with their kids and they're not pointing out hey, this is not the kind of behavior that we want. schools are trying to have a climate of respect and kindness and they're not able to do that as the social media and, you know, the general society is going against them. >> would you say a piece of advice for parents is don't watch these types of shows with your kids because it almost seems like you're endorsing the behavior? >> no, they can watch them but teach them and say this is not the way you should behave and this is not the way you treat people. we need to educate parents as well as students and the teachers and the entire faculty from the school bus driver to the custodian to the superintendent. >> we've got to go but lastly, how is social media affected it? >> i think social media has allowed it to come up even louder as we see that they posted this on you tube, that they had no concept that this was not empathetic, inappropriate and the kind of behavior that they should be engaged in. >> thank you so much for your time today. 6:56 is the time now. next on the rundown, the white house touting the importance of separation of powers but didn't the president just ram through that immigration law? we report, you decide, then we know it's hot, hot, hot outside but something tells me it's not this hot! well, that came from operation wide receiver with the bush administration which they're wholeheartedly different and we'll go over that at a different time. main thing is, anna, there's somebody dead because of these guns and because of this operation. we know that for sure. >> yeah, mom and dad want justice like the rest of america does but brian terry's parents speaking out on sean hannity's show last night after being silent for months. let's take a listen. >> i think they're lying and they're hiding it, they're passing the buck and i know they're hiding something big. i think something happened out there. >> eric holder has been before congress so many times and the first couple of times, you can tell, there's something being hidden and there's something not being said and after a while, when you feel like throwing the tv through the front window because you get tired of hearing the constantly lies that you know they are doing. and i think that they're bringing all this up because they want to put fast & furious on the back burner until the election is over. >> i do, too. i agree. >> and so yesterday, the press secretary to the president of the united states, jay carney had a briefing and he was inundated with questions about fast & furious and at one point, he insisted that the reason that they were claiming executive privilege was all about the principle of the thing and there was an enormous burst of laughter in the briefing room because if you think about principle, there must have been a different principle than just last friday when the president bypassed the law to change the immigration rules by executive order. here is mr. carney defending the executive privilege maneuver. >> in terms of the assertion of privilege, it is, as i said, i think, on a number of occasions already today, absolutely about the principle. it is not something that the president takes lightly. he does it because it is his responsibility as steward of the executive branch to retain the capacity of this administration and every administration going forward to function appropriately and independently. >> i'm rather touched by what jay carney had said about the need to hold the documents back because of a respect for the separation of powers. this comes 10 days after the administration has just rewritten unilaterally the immigration laws and the way that obama himself has repeatedly as i said a gross attack on the separation of powers itself. so you got a lot of stuff happening here as well as intimating that the attorney general had stopped a program which by his own words he never heard about. all of this is rather curious. >> overall, there's certain times in your career where you think to yourself, i should have used a sick day. that was one day where i was watching jay carney yesterday and i kept thinking to myself, does he wish he was anywhere else but beside the podium? he has some things that are tough to defend. i felt bad for him yesterday. >> he was spinning as best as he could when he was trying to convince the white house press corps, saying this operation got started in the bush years and he said, the press corps responded. no it didn't. operation wide receiver was back during the bush days. it was completely different than fast & furious and then mr. carney changed it to ok, the same tactics used in fast & furious started during the bush years. >> right. and just one thing with the wide receiver, when they closed it, they wrote did an official, "never again" because it was a failure. the wide receiver was a failure and they wanted to stop it so anyone who says we're building on that -- >> not to mention the use of executive privilege by president bush was criticized by president obama only a few years ago when he was then a senator. we need to get straight to your headlines, though, on a friday morning, an assault by the taliban on a lakeside hotel near kabul ending overnight leaving at least 18 people dead. >> security forces and gunmen armed with rockets exchanging fire after dozens of people taken hostage. the stand-off lasting over 12 hours. the victims include 14 civilians, three hotel guards and a police officer. the five taliban militants also now, that includes three homicide bombers. trial begins today in the case of former texas college student accused of having bomb making materials in his apartment. the 22-year-old allegedly had targets across the united states in his sights including the home of former president george w. bush. he has pleaded not guilty. he faces life in prison, if convicted. >> all right, the nba crowning a new champion late last night! >> the miami heat are once again nba champions. lebron james captures that elusive title he so desperately coveted. >> and it wasn't even close really. the heat beating the thunder 121-106 to win the title in just five games. they did it at home, as you can see, lebron james named m.v.p. and averaged 28.6 points per game. a bunch of rebounds. two triple-doubles and first time in history that's been done and the third time in the finals for him. clearly the third time was the charm for lebron james. and that was exciting -- it was a great abbreviated year in -- good abbreviated year in basketball. >> and this story will definitely inspire you on a friday morning. spencer west truly scaling new heights and showing anything and everything is possible. he just climbed 20,000 steps to the top of mount kilimajaro, africa's tallest mountain despite both of his legs were amputated when he was 5 years old. his parents gave him a strong sense of confidence and he's hoping the journey will help them redefine their own possibilities. i love it. those are the headlines for this friday. >> that's true. meanwhile, a fox business alert right now, we're watching how the markets are going to react this morning after moody's has downgraded 15 major banks. so how will it impact your wallet if you are one of those banks? >> stuart varney, what's your take on this? the markets certainly didn't like it. >> it's not going to affect your wallet or bank account immediately, it's not. but it tells you an awful lot about the state of our financial world. i think this is a period of maximum danger because the big banks are clearly in trouble. they're clearly a greater risk. think about it. they're now subject to this onerous regulation called dodd-frank. they've got regulators all over them. it's costing j.p. morgan chase a billion dollars a year to go with these regulations, to comply with all of this. europe is still in chaos ch. we don't know the full exposure of our banks to the chaos over there. that's kind of hidden and the whole economy all around the world including america is slowing down. if something gets worse in all of those areas, these banks are in trouble and a lot of people are reminded of 2008. >> absolutely. i'm looking at the materials about what you're talking about today and the first thing on the top line is you say this is a time of maximum danger. >> yes, it is. we have no political leadership in washington. the president and government and his administration clearly in disarray. here we have the banks downgraded. they are much more risky. the world economy is slowing down. that's a period of danger. as i said, something goes wrong. something happens. what do the banks do? they can't make much money. they're going to have a -- i'm not going to say a run on the banks but they're really under pressure all over again. odds are ben bernanke is going to start printing a whole lot more money and that's what almost certainly is going to happen. >> also, how is this going to affect small businesses or start-up businesses trying to get some cash? are the banks going to free any up? >> exactly, are you going to get a loan from a big bank when the big banks are in trouble and facing serious risk? you're a small business and you ask for a loan. are you going to get it? odds are you are not. >> now they've been downgraded, too, so they'll be under stricter regulation and cost them to get money. i was surprised to see two banks on that list, goldman-sachs and morgan stanley. >> top five biggest banks in america all downgraded along with 10 others from overseas. how about that? miles miller is a dow jones white house correspondent and sasha burns is a democratic strategist. sasha, i imagine that you agree with jay carney? >> absolutely not. i'm totally on the other side. just throw things out there. absolutely. look, congressional oversight and presidential privilege are legitimate in how to maintain checks and balances. that assumes that you are dealing with reasonable authorization and investigation which is not where the house oversight committee is. the problem is they've already gotten thousands and thousands of documents. the documents that they're looking for here are not about the program, not about agent brian, they are about the -- i'm sorry, agent terry. >> they're about the interaction after the investigation. >> right. >> they want to find out how much they knew, angela. >> sometimes the bottom line is this -- not the actual act. it's the cover-up. for jay carney to say this is politically motivated when we're over a year away when we started this process and it's about the false february 4th letter. 2011, and for barack obama in 2007 to say that bush was hiding behind executive privilege, he has the right to call executive privilege here unless he knew about fast & furious before brian terry's death and unless he authorized the operation. why are we doing this here? >> the president did factor himself in when he came up with that executive privilege order. >> he had to. executive privilege doesn't just extend itself to the obama administration's the white house. it extends to all the agencies within it. the justice department is definitely an agency within it. and the -- this makes sense because it's all -- this talk and what has happened on capitol hill this week is all about internal documents between the white house and between the justice department's staff after the fact. after this investigation had already taken place. the i.g.'s office and the justice department already has these documents so they would have undercover -- they would have uncovered something already. >> if there's nothing to hide, again, as brian said earlier, why not just turn these documents over and it's so sad it's a travesty that we might have a vote to hold the attorney general -- >> that's right. call your congressmen, and call them up. i'll tell you why, there's no basis in law. once the president has -- has put forth an executive order, executive privilege, there is -- there is no cause for a vote for contempt. so the vote in the committee was completely null and void. the vote that they may have on the house floor is. and what it's about -- >> how completely null and void? >> because there's no basis. >> he still has -->> he doesn't have to. once he exerts executive privilege, there's no basis in law that says -- >> traditionally, judges won't rule on executive order because on -- on executive privilege because of the detail and this would set precedent. never before has a committee asked for documents that are internal -- >> i would say this, by the president doing that, for those who said let's turn the page, he opened up a whole new book. >> he did. and in the bush administration, there were executive privileges and some were overturned. >> let's talk about something less controversial, immigration. the political panel sticks around for mitt romney saying if elected, he'll replace president obama's immigration plan but with what? i'm back with our political panel and hopefully they want to comment. angela, miles and sasha. first off, yesterday, he addressed immigration directly to latino leaders. he's trailing by about 30 points among hispanic voters. was he effective in what he outlined? >> he's starting to be effective. the bottom line is this -- what i love about his plan is you have a lot of businesses who are employing undocumented workers and paying them cash under the table. romney is going to hold these folks accountable. he's going to increase temporary work visas for low skill workers and if you're in this country, you give an advanced degree, he's going to make it easier for you to get your citizenship so i think it's a start. but obama gave a quick fix, brian, because he promised hispanic federation, he promised the hispanic caucus that he would do something about the illegal immigration issue and he has to do something. >> he has a lot of ground to make up, miles, doesn't he? >> i think it's interesting, all of the things that he outlined yesterday sound a lot like the dream act which is -- which is, you know, something that he said he wouldn't go for, but this is not -- >> did talk about military, if you serve in the military. >> yeah. >> absolutely. >> did he say illegal or are you talking about if you have -- >> he said in the military. which i think is very possible. > >> what president obama has done, though, is just a quick fix. it's not sustainable. >> make no mistake about it. this is not an executive order. this was an ordinance to local law enforcement to say -- from homeland security, this is not an executive order. this is not the president, you know, superseding congress. this was an order to law enforcement to say people under the age of 30 who are not committing crimes, no need for deportation. >> still a quick fix and a political thing instead of a policy thing. >> you know, president obama tried to do comprehensive immigration when he first came in in 2009 which you'll never hear from republicans. but he couldn't get anywhere with -- he couldn't get any republican votes. he had already seen what happened when bush tried. what he did say is i'm going to focus on border patrol first and since then what he's done has been the most effective and aggressive deportation policy that we've ever had. >> yeah. that's why he had to do something about this because the hispanic federation that he would give long term -- >> people on both sides. >> he supported more hispanics -- >> romney said he'd be able to work with both parties, has he seen washington? has he seen congress? congress ain't going to work with anybody let alone work with -- if he was to be -- >> i don't think that you can think that i'm going to become president and have the same -- the temperature being the same temperature in the room as it is right now. >> because of who gets control of congress. >> right. >> and that has a lot to do with -- you know what? we go through ebbs and flows through our history. maybe we'll go through a time that people will say let's get something done. >> i think in the swing states, what romney has done could bring more hispanics to the table. >> he sure hopes so. he said when i make a promise, i'm going to keep it. that would mean he'd veto the dream act, that he's pro gay marriage, that he's pro choice. >> deportation. >> that he supports a national mandate. so to think if latinos think that any -- >> can they agree that they learn from what they do? so that's why i think you now become a gotcha situation. remember, one man's cover-up is another man's witch hunt and it is impossible, and i'm very sorry to say this, not to view this as a partisan activity. this is -- all republicans on one side. all democrats on the other. >> steve: chuck grassley said -- he saw jay carney yesterday and there was this suggestion that it was political and grassley said, if it was politics, he would not have voted to subpoena records from alberto gonzalez and department officials. >> i hate they went after him because he's a friend of mine. >> steve: there were officials going after bush -- >> they never tried to cite them for contempt of congress. this is a first. it's never been done before. there was absolutely allegations of stonecalling and if you recall, craft and gonzalez, it was all democrats attack the republican attorneys general. it was exactly the same situation. they perceived the top law enforcement federal of this country as a political operator of someone who has the president's back. so they don't go after the president directly. they go after the attorney general. it stunk when they did it to the bush administration official and it stinks now. >> brian: why do you believe the networks, broadcast networks have basically avoided this story? what's the president covering up by getting involved in the fast and furious investigation which he said he knew nothing about? we were wondering about the dichotomy between what the president said when he was a senator, also what he's doing as president. >> steve: that's right. and remember, so he's talking about jay carney saying, it's the principle of the thing. wait a minute. last friday, didn't the president of the united states use executive fiat to change the way we're going to be looking at some illegals in this country? yes. did he do that on principle or was it politics? you be the judge on that. but there was mr. carney yesterday defending executive privilege on the principle. >> in terms of the assertion of privilege, it is as i said, i think on a number of occasions already today, absolutely about the principle. it is not something that the president takes lightly. he does it because it is his responsibility as steward of the executive branch to retain the capacity of this administration and every administration going forward; to function appropriately and independently. >> steve: all right. >> brian: this whole executive privilege thing has a history. it dates back to -- if you think about it in modern presidency, you think of executive privilege, you think of richard nixon. >> anna: james rosen has a look at that for us. >> steve, brian and anna, good morning from washington where this constitutional showdown over justice department documents relating to fast and furious is just the latest in a long line of such disputes in a sharply polarized setting. on capitol hill. >> there is no cover-up here. there is no 20 minutes of a tape that's been wiped out. >> and at the white house. >> you say there is no cover-up? >> absolutely. >> the debate over president obama's assertion of executive privilege in fast and furious carries echos of watergate, when republican president richard nixon clashed with the democrat controlled congress. nixon first invoked executive privilege in march, 1973, to reject lawmakers' demands for testimony by then white house counsel john dean, a key figure in the watergate cover-up. democrats sam irvin of north carolina, chairman of the senate watergate committee, threatened to send the sergeant at arms to arrest dean. jeff shepherd was a young lawyer on nixon's legal team. >> there is the same bitter, divisive partisan atmosphere in washington that existed in watergate. >> i can't put myself in the president's mind. >> before long, dean turned state's evidence and became the hearing star witness, leaving nixon and congress to clash again over access to the president's secret tapes. >> the white house tapes were conversations of the president in the oval office. they had a far higher level of confidentiality that was assumed than the attorney general's internal documents today. >> in july 1974, the supreme court ruled executive privilege did exist, but that investigators need to hear the tapes, outweighed nixon's need for confidentiality. he turned them over and resigned days later. some see president obama's assertion of executive privilege as part of a pattern in his presidency, of a peace with his maintenance of a kill list. >> neither bush nor even nixon himself achieved this dream of an imperial presidency to the degree that barak obama has. >> the current congress and president actually share an interest in compromising on the fast and furious documents. to avoid a binding ruling like the tapes case which could limit the powers of one of the branches for generations. now back to you, steve, brian and anna in new york. >> steve: we're out of time. thank you, james. historical perspective. >> anna: can you imagine you're walking down the street and sitting on the walk, a polar bear and a seal? how did you come upon this seal in the road? >> i had gotten off of work. i visited a friend real quick and was heading home. lots of roads were blocked off. i had to take different routes to get to grand avenue. as i was approaching the zoo area, i had seen a car coming towards me and watch -- i had seen them turn their hazard lights on, so i started slowing down, thinking they were possibly stuck in a puddle or something. as i approached, i had seen something flopping, bouncing up and down in front of their car. at first i thought it was an eagle or something. as i got closer, it was a seal. >> brian: was the seal in pain? >> no. it looked tired. it looked frightened. when i had gotten up, it just kind of sat there with its eyes closed. i immediately put my vehicle at a slight angle and turned my hazards on so between me and this other vehicle, kind of blocked the seal in to keep it safe. >> brian: did you take out your camera phone or did off camera with you? >> i had called 911 and as i was talking to the dispatcher, the fire crew happened to pull up. they were on their way to another call. >> brian: and did you take out your camera and take this picture? i've looked at this law. i know the consequences: delayed care and worse yet -- denied care. studies show the president's health care law is projected to add hundreds of billions of dollars to our deficit -- and increase spending by more than a trillion dollars. and the truth is -- we still don't know how much this law will eventually cost. i don't want anything to come between my patients and me -- especially washington bureaucrats. we need real reform that improves care, and the president's health care law just isn't it. it just isn't worth it. this is where health care decisions should be made. not in washington. woman: what do you mean, homeowners insurance doesn't cover floods?
