five taliban detainees may soon be let go from guantanamo bay. republican congressman mike rogers, chair of the house intelligence committee says the obama administration is taking operational steps to move the terrorists to a third country in order to advance peace talks with the afghan taliban. republican presidential hopeful mitt romney blasting that proposed move. >> the president is apparently intent on releasing five prisoners from guantanamo as a sign of good faith to the taliban. >> boo! >> my reaction exactly. >> it's not known exactly when or where those prisoners will be moved. today, president obama will announce a plan to put 20,000 veterans back to work. the billion dollar jobs corps program will put veterans to work rebuilding trails, roads and levees on public land. the program will also offer incentives to hire those who served our country. the plan is geared to veterans who served after the attack on september 11th, a group experiencing an unemployment rate of 13.1%. she made a joke out of our national anthem. >> ♪ o'er the land of the free ♪ >> ouch! >> i thought i had forgotten that but no joke here, folks. roseanne barr thinks she can be the next president of the united states! she's seeking the green party's nod for 2012. she claims both the democrats and the republicans are not serving the american people. she might have a point somewhat on that a little bit based on the approval rating of congress. not sure how far she'll get with the green party, though. >> good luck, roseanne. meanwhile, let's talk a little bit with brian and all you folks in tvland about what's going on in the news. yesterday, the national prayer breakfast got started our program at the hilton there in washington. for 60 years, u.s. presidents have gone to it. for 60 years, presidents and politicians generally have checked their political agenda at the door. yesterday, it sure sounded like the president was doing his political stump speech. here's a little snippet of the president getting biblical. >> for me as a christian, it also coincides with jesus' teaching that "for unto whom much is given, much shall be required." >> all right, what does that mean exactly, brian? i guess a lot of republicans were offended by talking politics when you're at a bipartisan religious event and by the way, it's a rare injection of politics at this event. congressman steve king from iowa had this to say in his mind speaking of obama, god is a leftist. he just can't give a nonpolitical speech. he tried but he can't help himself. if you hang a pork chop in front of a dog, you know what he's going to do. he'll snap at it. ouch! >> well, yeah, i think that's -- i think that could this be president obama trying to get across that his policies are not only democratic doctrine but also in line with the bible? that's a huge leap for either side number one or is this on overcompensation for his anti-catholic unexempt move that he put forth earlier in the week that could devastate him with the christian community which is basically 27% of the electorate. >> well, clearly, what his message was last night, what would jesus do, he would tax the rich. rick santorum was in nevada last night campaigning, the caucuses are tomorrow. here's his reaction of the president at the prayer breakfast. >> make a claim that his policies of taxing the rich is authorized by the bible. that he has the -- he is doing what is biblically there by taxing the rich by having the government tax the rich. now, i've read the bible. and i must admit that -- this is an administration who attacks religion and then tries to focus itself in religion in order to take your money. >> yeah, i think people when they go to that prayer breakfast, i think that they don't really want to hear political speech. i mean, i think that it's a time or at least in the past, it used to be a time where it came together and you left politics out of the occasion but not yesterday. and you got to wonder how that, as you brought up, brian, how that corresponds with what's going on with the catholic church right now and part of obama health care which is basically forcing these institutions to do things that are against the tenets of their faith. >> you know, it's just unbelievable. the more you think about it, it's an unforced error by the president. of biblical proportions if you think about what he did earlier this week, the president, of course, just to review and we've done a few segments on this has signed off on the health and human services ruling that says under obama care catholic institutions including charities, hospitals and schools will be required by law for the first time ever to provide insurance that covers contraceptive and abortion inducing drugs. this is just to put a shock wave throughout the catholic community in this country and all the way back to the vatican and you wonder why the president did this as a pure political calculation? there's no up side. it's totally unnecessary. and he could pay a steep price and it brings me to wondering what about the vice president who i believe is catholic. >> not only is he catholic, he's the highest ranking catholic in the administration right now. our own ed henry asked the administration, you know, the administration has made it very clear, this is going to be what's going to happen. we're going to go ahead and have this mandate so ed henry asked the white house, what about joe biden? and they gave ed a nonanswer. they said, we're going to check. even though they should know, remember, this went on the books on january 20th. but in the past, you know, from his own personal history, joe biden has said he is for abortion! so is he for this particular mandate that jams all that stuff brian just mentioned down the catholic institution's throat or is he going to part with his boss, the president in staying with the church. >> nancy pelosi is also catholic and she says she agrees with this part of obama care. in the meantime, there was big news yesterday happening out in las vegas. donald trump finally decided to endorse somebody. i guess this means that he will no longer be seeking his own independent bid because he wouldn't go up against somebody that he doen,s and brian, hats off to you. you called this yesterday. you said that donald trump does not -- wouldn't want to go with anyone that he doesn't tedeem t be a winner. all the rumors were he was going to go with newt gingrich. and i do think he liked both men very much and then ultimately he may have sided with your philosophy. >> right. absolutely. and you saw mitt romney sitting there with his wife and then donald trump giving a great speech and officially endorsing mitt romney. mitt romney accepting it. and there's a lot of excitement. people want to minimize what donald trump's endorsement actually does but keep in mind, he's one of the well known personalities in the country. in a day in which the economy matters most, people are wondering why he's doing so well when times are so tough and he might know a thing or two about the american people and their psyche and as rich as he is, he's got that every man appeal and i think he mentioned that last night on greta's show. here he went into why he did what he did. > >> so i called him a couple of times last night on the number that i had and there was no response on that number. i wanted to call him. i did call him. i like him. i respect him and he's a terrific guy. >> yeah, so there is donald trump saying that before he made the endorsement, he called newt to say hey, newt, i'm going to endorse mitt. interestingly enough, according to the las vegas paper this morning, apparently, newt gingrich, according to g.o.p. sources, tried to call donald trump a couple of times the night before to talk him out of endorsing mitt romney. nonetheless, he did just that. >> all right. let's go back out to brian in indianapolis because you have some very special guests, brian? joining is bonnie schneider. i love this book, it's what people need. you need a plan. there is so much extreme weather out there. let's start with the ice and the snow storms like what we're seeing in colorado. >> so far this winter in new york we've had a little bit of snow. it came early in october. >> it knocked my power out for five days! >> it's been mild but it's not over yet. you have to be prepared for winter storms and unfortunately, when it comes to winter storms, most of the accidents occur when people are driving. 70% of people are impacted when they're driving with snow and ice and it causes injuries. >> what about floods? what should we do when eventually the stuff is going to melt and there could be some floods? >> flooding, you really want to make sure that you're ready if you have to leave your house. so you want to plan ahead an evacuation route and, of course, avoid travel. most people that are caught in their car really find a problem happening very quickly. it takes six inches of water to dislodge your car. never try to walk through or drive through water. you don't know how deep it is. >> yeah and that's the problem because you don't know -- it could be an inch deep. it could be 10 feet deep. >> right. right. and once you're stuck, you're really stuck. >> you are stuck and you're stuck if you don't listen to the experts when they say get off the island because a hurricane is coming. we lost power five days as well just outside of new york city when hurricane irene went through. >> hurricane irene was very, very damaging and, you know, with hurricanes you have that double threat of strong winds and flooding rains so if you're in an area susceptible to a hurricane or traveling to one, know your evacuation route and make your plans in advance and know how to get out if you have to and everyone should have a noaa weather radio. it's so important because that radio has an alarm feature so if you go to bed and there's a warning, it will wake you up. >> that's cool. >> that will help you get out in time. make sure you secure your windows and move around from them. anything in a hurricane or tornado can become -- the debris can become a missile and knock your windows out. simplest thing in your backyard, things should be tied down and secured just in case. >> indeed, the patio furniture, you figure it's not going anywhere. it could go right through your window. >> absolutely. my wife bought me one of those special radios. it's very nice and it comes with batteries but once the batteries are dead, it's got a crank. >> yeah. that's so important! >> it is. keep it going because you'll need it for all types of storms. >> listen, you need a plan. check it all out in bonnie's great book. it's available everywhere. >> thank you so much. nice to see you. >> straight ahead on this friday morning, a convicted sex offender found working at a daycare center? >> it's really strong. the directors try to incorporate a lot of the old traditions and different things that we participate in also so it's really great. >> how great is it as a senior to know you don't have to go to school after this. we got you out of school, technically, am i correct? >> you did. you did. and it's really fun to be a part of something, you know, that's going to go down in history. >> and the dedication it takes can't be understated. you have all these championships. what are we going to play? >> we are going to play "devil with a blue dress." >> i'm going to listen. there it is, the ben davis high school marching band and "devil with the blue dress" a special homage to charlie daniels. >> all right. great job. good job. >> they have a -- we can't reveal the details, we can't reveal the details but they will be at the super bowl. am i right? watch this. >> now, you said that you were notified probably within 24 hours of agent terry's death, is that what i heard you say? sir? >> i'm sorry. >> you were notified -- >> fortress holder. that was kind of interesting. >> i can get a copy of that for you. >> that's not my house, by the way. >> as you know, the justice department accused of trying to cover up details about its gunrunning operation that let illegally purchased weapons be smuggled across the mexican border to drug cartels. the head of the susan g. komen breast cancer foundation defending her organization's decision to stop giving grant money to planned parenthood for breast cancer screening. the group denies it made that call because of pressure from pro life groups. >> the accusations being hurled at this organization are profounded hurtful to so many of us that have put our hearts, souls and lives into this organization and more importantly they are a dangerous distraction from the work that still needs to be done. >> the foundation has a new policy refusing to give grants to groups being investigated and congress is now trying to determine if planned parenthood used federal funding for abortion services which is not permitted. komen says its donations are up 100% this week. planned parenthood also reporting an increase in donations. cases of orange juice containing an illegal fungicide now found in samples taken from manufacturers in florida. the juice is reportedly mixed with products from brazil. the f.d.a. has been holding and testing imported juice since trace amounts of the banned fungicide was found in brazilian products. the f.d.a. says this new batch of juice is still safe to drink and won't be recalled because the levels of that fungicide are extremely low. how did this slip through the cracks? a convicted sex offender working at a daycare center, our fox station in chicago got a tip that he was working in the kitchen of the little greentree house. he was convicted of sexually abusing a 14-year-old girl. when confronted by the reporter, he claims he didn't hide a thing. >> did they check your background? >> i worked through a temp service and i told them what happened in my background. >> you told the temp service that? >> yes, everybody know that. >> did the temp service tell these people? >> i told these people. >> the managers of the daycare appeared to be shocked when they heard his criminal history. they claim the temp agency does background checks on all the employees but something went wrong with his check. the temp agency refusing to talk about it. he was kicked out of the daycare center and right after he headed for his car, another problem, he hadn't had a driver's license since 1996. hey, steve, i know you're outside with the patriots guys and they gave me this beautiful hat and scarf. thanks very much for those guys. can you tell them thank you in case i don't see them? >> this program is about getting kids active for at least 60 minutes and committing to that each and every day throughout the year. it's a program to learn about being healthy and to learn about exercise. >> right. learn about exercise and it's a official thing where you have log books and everything. here's michael, how long are you been doing this? >> about a month. >> what do you have to do besides work out? >> you have to make sure that you exercise about 60 minutes a day and then you have a logbook where you write down what you did and for how many minutes and then at the end of the -- at the end of the event, you have to turn in the logbook and then the class that had the most minutes that they exercised, they won the event. >> right. and it's pretty cool? >> yes, it is. >> in what respect? >> it's very cool because we get to do a lot of things so it was really fun. >> it's fun running through this stuff, getting exercise. if you're not in a formal sport, this is a great way plus it's cold around here. you need something to do, correct? >> exactly. >> these kids are going to be here all day long and they've been kids streaming here all day long. there's plenty for them to do. also fascinating to see, what happens when you bring a few hundred military guys together and they have some free time? they have set up their own scrimmage and are using one of the fields, one of the kids' fields to play some pickup football. so we have created some fun and they're doing their own play 60 moment although they're pretty much playing 24 hours a day and always in shape. so that's the latest down here. the big news i have to say in indianapolis, believe it or not, still peyton manning. today it comes out two doctors have cleared him to play and it also seems as though the owner says he's not cleared to play from a colts physical and if anyone does not know, he may be the greatest quarterback of all time that made this franchise super bowl champions and now they may be turning the page. >> we'll wait and see what's going to happen with peyton manning. he could be able to go to a different team if, in fact, he can play next season. brian, great job out there with all the kids. we'll check back in with you in a moment. >> ok. >> now your other headlines starting with a breaking story out of egypt this morning. two american tourists, both women, abducted in egypt's sinai peninsula. they were taken by a group of masked gunmen believed to be tribesmen. the women were on a tour bus traveling from st. catherine's monastery to a resort on the red sea. their identities are not known at this time. the hostage takers said to be demanding the release of relatives being held in egyptian jails. we'll keep you updated on this story as we get new information into fox. and a severe weather alert. a major snowstorm hitting colorado and shaping up to be the season's biggest. the state is expecting six inches of snow and up to two feet before it's over. it's possible the eastern plains could see blizzardlike conditions as well. airlines have canceled 200 flights into denver international airport right now. people are being urged to drive cautiously, of course, and stay off the roads, if possible. the snow is not expected to stop falling until tomorrow morning. a public peep show for library goers in seattle as a man watches adult entertainment on one of the computers in the library? and get this, he was still allowed to keep watching after people complained. one woman was furious saying her 10-year-old daughter could see the graphic images but library officials say they aren't in the business to censor content. they say the computers are equipped with privacy screens to both protect the user and passerby. seems a little weird, doesn't it? >> actually, you know, it's kind of a mix. we have a lot of people in the stories but we're featuring predominantly women for these first three. we'll see. sometimes in life the greatest moments come when you think one more step is not possible. the stories that we're bringing you are all about what we know to be true about our great nation, that anything is possible if you just believe and don't give up. during this black history month, fox news in conjunction with the ails apprentice program is showcasing some dynamic people, reminders of what we all can do. this month, every friday morning at this time i'll be here with the "fox & friends" team and here's some of what you'll see. barbara smith conrad will be up first. she was born in center point, texas, in the segregated south. her home was filled with hope and music. in the 1950's, barbara decided she wanted to do what was unthinkable then! attend the university of texas in austin, study music and get this, she wanted to be a world renowned opera singer. she was just a kid and the south was going through growing pains. it was 1956. the supreme court had just stepped in to force colleges to integrate. u.t. had more than 18,000 students on campus. and just a few african-americans, 110 of them to be exact were the first to attend under that court order. it was a tumultuous time, she told me, and what happened to barbara there was frightening. a tragedy most people might not have ever recovered from. it made national headlines. but it would not be the end. just the beginning of an amazing journey. isn't she beautiful? it propelled her to become one of the most noted american opera singers in the world. and then there's leslie hiner, not married. no kids. working hard. and in her spare time, she enjoys riding horses. one day, she felt the need to respond to something she said she couldn't take watching anymore. leslie grew up in philadelphia, away from but very well aware of some of the toughest neighborhoods in the nation, west and north philly. with crime rates and murder rates off the charts still today. leslie decided to do more than just feel bad for the kids on the other side of the track. she met with some of them and made them a deal. she told them if they helped take care of the one things she loved, her horses, she would teach them to ride and wouldn't you know it, she did something mind blowing. she went on to form the first african-american polo team and just wait until you see what these kids are doing today. it's a story that's actually still unfolding because it means the future for all kids just burst wide open. and this month of february, we'll also see another great american hero, barbara hillary. a two time cancer survivor. she had late breast cancer -- late stage breast cancer at age 25. she battled back from that. then years later, doctors diagnosed her with lung cancer as she was retiring at age 67. the long battle she fought and again, years later, still kicking. this time with a vengeance. doctors told her she couldn't even have lung capacity to climb more than a flight of stairs. barbara said ok, then i better make this count. barbara hillary decided at 75 she would become an adventurer looking up arctic maps and explorers she could join. not as a tourist, she did things most healthy people wouldn't even try. in fact, she went to places no other african-american woman has ever gone before. you'll see why she's among those ordinary americans doing extraordinary things all month long. >> wow. >> it's been a wonderful thing you're doing to promote and give attention to these wonderful people. >> it's a fun story, we don't want anybody to miss this part of -- it's an incredible journey that we actually all share. we call it black history month but it's our american history. >> absolutely. it's sponsored by the ails apprentice program here at fox news which was started by our chairman, roger ails who founded things about 15 years ago. and we're going to see it all month long, right? [ chuckles ] yes. yes, it does. ♪ call 1-800-steemer and the chefs at lean cuisine are loving tangy lemon, peppery poblano, sweet butternut. we're roasting, and grilling to create must-have meals with no preservatives. lean cuisine. be culinary chic. >> the answer to the question of the day, bob griese. congratulations. this next story is all about a victory for the little guy. heather peters took on honda motor company after her hybrid car didn't deliver on the mileage she was promised and she won. and she joins me now live from los angeles. good morning to you, heather. >> good morning! how are you? >> i'm doing fantastic. thanks for joining us so bright and early. tell us what happened after you bought your honda. what did it promise you and what did it not do? >> it promised 50 miles per gallon and save the planet and it was going to be great. it never really got more than 40 on its very best day. i wasn't going to sue over that. average mileage may vary and you expect that. but what happened was the battery started deteriorating and honda figured i'm going to save my money by reprogramming everyone's car to use the battery less. and after that software update, i get 28 or 29 at best, according to honda's own mileage gauge on the car. >> ok. so you could have joined a class action lawsuit, thousands of people did. but why did you decide to take this on in small claims court yourself? >> you know, the class actions are great if somebody sticks $0.20 on your phone bill and, you know, god bless them. that's what they're there for. but when you're out of pocket $10,000 as this judge found i was, you're not going to take $200 and a coupon to settle. and so i started don't settle with honda.org to let everyone know they can go to small claims court on my own and i'll share my evidence with them. so they can do it on their own. >> so you actually did just that and you said that you had lost out $10,000 because of the extra gas that you had to buy. and the judge agreed with you and you received the $10,000. have you gotten it yet? >> oh, god, no. honda immediately, the first words out of their mouth was they're going to appeal and last night, they issued a statement saying this is a radical decision. and i agree with them. it's a radical decision. this is the first time i know of that consumers have come together and said hey, we're not going to take it anymore. we're going to do this ourselves. >> here's our statement from the honda spokesperson. american honda intends to appeal the decision in peters vs. american honda. due to the substantial factual and legal errors reflected in the written decision. now, what was their argument against you? >> they're argument was the e.p.a. makes us do it. we can't do anything but what the e.p.a. tells us. and the e.p.a. has come out and said they were wrong. but commented on the case and said no, you have the ability to advertise lower mileage if you know it's going to be lower. this is just to cap the number they put on the sticker. everybody uses the cap but they don't have to. >> we know you were a lawyer but haven't practiced in years. you want to help other people so you reactivated your license again. >> yeah, you know, i haven't been inside the courtroom since the turn of the century. but this was just, you know, one of those moments where people were calling, writing, i had over 500 honda owners contact me before i even won. and after i won, the first night we got 6,000 hits on the web site and yesterday, we got 10,000 hits. and it crashed. so a lot of people who don't have the confidence necessarily to go out on their own or are looking for help and i'm willing to do that for just $50. i used to charge $200 an hour but i want to go into the class action lawsuit on their behalf and say, $200 and a coupon is just not good enough. everyone deserves better. >> all right, heather peters with her story about how one person can actually take the fight and win. thanks for joining us this morning. >> thank you so much! bye-bye. >> coming up on our show, catholics accuse the president of waging a holy war against the church. why is the highest ranking catholic in the country, vice president joe biden, been silent on the controversy? and do we really want her to be president? >> ♪ o'er the land of the free ♪ >> ear plugs, please! we wish we were kidding but roseanne barr is running for president of the united states! details straight ahead. per who . five taliban detainees may soon be let go from guantanamo bay. republican congressman mike rogers, chair of the house intelligence committee, says the obama administration is already taking operational steps to move the terror suspects to a third country in order to advance peace talks with the afghan taliban. republican presidential hopeful mitt romney blasting that proposed move. >> the president is apparently intent on releasing five prisoners from guantanamo bay as a sign of good faith to the taliban. my reaction exactly. >> gretchen: it's not known exactly when or where they will be moved. she made a joke out of our national anthem. remember this? what has some republicans upset is the fact that at the national prayer breakfast, he invoked the name of jesus and the bible and asked the question what, would jesus do? he would tax the rich, like what obama wants to do himself. listen. >> for me as a christian, it also coincides with jesus' teach ing that from to whom much is given, much shall be required. >> gretchen: this was a rare injection of politics at this national prayer breakfast. if you go back in time and look, it's not often that the president will talk about politics. maybe about faith, but not talking about politics. that's why i think some people suddenly stood up and listened and thought, wow. did he just say that? >> steve: it was like a stump speech. >> gretchen: yeah. some of the criticism has been harsh. iowa congressman steve king said he just can't give a nonpolitical speech. he tried, but he can't help himself. other people are weighing in as well. >> brian: absolutely. one of them is rick santorum. he was in nevada last night. >> he claims that his policies of taxing the rich is authorized by the bible, that he is doing what is biblically called for by taxing the rich, that the government tax the rich. i've read the bible. and i must admit -- this is an administration who attacks religion and then tries to cloak itself in religion in order to take your money. >> gretchen: i guess the question this morning for me is, is wealthy people paying more taxes rooted in christian values? >> steve: the president thinks so. >> gretchen: that's a question for our viewers, too. let me know what you think. >> brian: yeah. definitely go to twitter.com at "fox & friends" or us individually. i also thought it was interesting that this is happening again. the national prayer breakfast, the president has a chance possibly to make up for some of the catholics he may have lost with his latest piece of doctrine to come out of his add m. it has millions of catholics around this country up in arms, from the vatican in new york city where the archbishop called on catholics to stand up and fight back about what president obama wants to do that affects every christian here. >> steve: that's right. and we know that the administration has said that this is going to be a reform that's going to stand where they're going to force catholic institutions like schools and hospitals to provide contraceptive services. we wondered what the stance was of joe biden. he is the highest ranking catholic in the administration. our own ed henry asked the administration how does joe biden feel about this? is he with the president on it or does he stand with the catholic church? and the white house said, we'll get back to you, which is kind of a nonanswer because this thing happened on january 20. they've a couple of weeks to figure out what joe biden thinks. >> gretchen: moving on to another political story which was a big thing in las vegas yesterday. donald trump made the announcement of who he would endorse on the republican side and he chose -- drum roll. mitt romney. even though the rumors had come out during the day before and leading up to the time that he was going to support newt gingrich. but he says he loves romney's stance on china. here is a further explanation. >> i called him a couple of times last night on a number that i have and there was no response on that number. so i wanted to call him. i did call him. i like him. i respect him. and he's a terrific guy. >> steve: so that is donald trump explaining why, before he made the announcement with mitt, he tried to call newt, brian. >> brian: well, i tell you what, newt doesn't like to use the phone. he doesn't call mitt romney when he wins and doesn't pick it up when donald trump endorses other people. are lot of people are saying, what's the big deal? a billionaire endorse ago millionaire? i think it is because donald trump is like a rock star. he's one of the few guys can make a million dollars and seem like a blue car person, with the way he talks and delivers himself and interacts with people and i think he could be quite valuable. i'm not saying as valuable as governor christie. i can say on the stage with some introduction, with not only financial support, but i think being there gives him additional push. plus donald trump doesn't hook up with losers. mitt romney more of a sense that he is going to be -- except for us -- gives him more of a sense that mitt romney is the inevitable candidate. >> gretchen: i think every candidate was looking for that endorsement, although some of the polls do show that the average american people say that that would affect them in no way as to who donald trump endorses or maybe in a negative way. it's certainly true that every candidate was probably seeking his endorsement. >> steve: out there in nevada where they're going to have the caucuses tomorrow, right now according to the local paper out there, romney is ahead by 20. a new gallup poll has come out where romney is leading newt gingrich. >> brian: not a surprise. >> steve: not at all. we're moving on. >> gretchen: coming up on our show a convicted sex offender working at a daycare center. how could that happen? [ male announcer ] 1, 2, 3 percent cash back for the things you buy most. the bankamericard cash rewards card. apply online or at a bank of america near you. >> brian: indiana has become the 23rd right to work state in the nation, leaving many union workers fuming mad. the law bars unions from imposing mandatory fees of members. get this, they can actually make their own decisions. joining us now is indiana governor mitch daniels, one of the most successful governors in the country. this is your last year. on wednesday, big news. the senate passed the right to work legislation. first time in ten years the state has done so, governor. what does it mean? >> it means more jobs in this state, brian, at least that's the sole intention. indiana has one of the best business climates in america. we found out over the years we were missing out by a third of the opportunities out there because we didn't provide this particular protection to our workers. so we thought we better add it to the tool box. >> brian: the reaction? thousands of people, some protesting and chance of stop the super bowl. >> i don't think you'll see that. folks exercise your right. but there is a big majority in this state for the reform. there was a national survey last week. 74% think it's a fair to let the worker make the decision about paying dues or not. but folks had their say and they did it in generally an appropriate way. i don't think -- anything is going to get in the way of the best super bowl there has ever been. it would only set their cause back, i think. >> brian: right, if they did do something. in the big picture, you saw what happened with governor kasich. he passed legislation to rein in unions. you saw what happened in wisconsin. what's going to stop indiana from having that? >> again, it's a different situation. we're not talk being public employees here. >> brian: you've already gotten rid of theirs. >> only at the state level. but again, we'll see. the election is the appropriate place to resume the debate if somebody wants to. there is a big majority who feels it's the right thing to do and folks understand this is only aimed at people who don't have jobs. nobody is going to lose a nickel of rights or benefits. >> brian: you have a triple a rating as a state and the lowest property tax in the country. >> you've been doing your homework. >> brian: it's easy to study your record. i'm going to keep rolling. last year we walked around in dallas and you said, next year you better come out to indianapolis. we are here. economically, what's the super bowl xlvi mean to indianapolis? >> big boost. absolutely. i'm not sure anybody will ever tab it all the way up. but then there is the intangible people of people around the world learning about probably the most livable, vibrant community in the country ask certainly the best venue for an event like this. >> brian: you have from great teams and great weather. dallas had two great teams, but not too great weather. this super bowl in particular, some vips will be coming, including governor christie. you going to have to make sure he has a good time. >> chris christie and i always have a good time. it's not hard to entertain him. he's an entertaining guy himself. i have to tell but the weather. i had to go to las vegas. i said, i have to go back tinned wind it's warm. >> brian: really quick, who are you endorsing for president on the gop side? >> i'm for all of them. i'm rooting for them all to do a good job and continue a spirited competition. i don't think anybody will care too who i was for. >> brian: are you kidding? you're one of the most successful governors in the country and everybody wanted you to run. they want your endorsement. >> now that donald trump has spoken, i guess it's over anyway. >> brian: right. it's always great to have donald, but great to have you. the first person we said when we come to indianapolis, let's find out the governor's schedule. >> we are proud to have you. have a good time. >> brian: if anything happens with the law, i can use your name? you know what i'm saying? >> you got license. >> brian: good. thanks. listen, coming up next, this guy named frank caliendo. i like to describe him, but he has so many personalities, i fall short. i believe he might be john madden, george bush. >> hey, man. i want to say this. i wanted to say this. i'm endorsing mitch daniels as governor of indiana. >> brian: that was donald trump and george bush. back in a moment. >> there it is what's this? it's progresso's loaded potato with bacon. it's good. honey, i love you... oh my gosh, oh my gosh.. look at these big pieces of potato. ♪ what's that? big piece of potato. >> i don't think that anyone in that room bought that. what you've got is an investigation where darryl issa, who is chairman of the oversight committee hearing, said look, we have subpoenaed all of these documents. we've asked for 80,000 documents. we've gotten something like 8% of them. two-thirds of the subpoenas have gone unanswered and at the end of the day, you're denying knowing about fast and furious. you deny that your senior justice department officials knew about it when the e-mails contradict the very testimony that you're giving us. and so what you've got now is a very contentious hearing, the most contentious hearing so far. and issa claiming that he knew nothing when the facts seem to contradict that. >> gretchen: issa wants these 80,000 documents that so far eric holder and the department of justice have not turned over. can he be held in contempt, in your legal opinion? >> certainly issa laid the foundation for eric holder to be held in contempt. the issue is whether they want to go that far. what you've got is atf whistle blowers who made it very clear that the department of justice knew and as a judge and d.a. myself, in order to get a wire tap, justice in washington has to approve it. who did the affidavits for the wire taps? who monitored the wire taps? the denial is just not credible. that's why there was so much energy yesterday targeted at holder, saying look, why are you stonewalling us here? they actually had a diagram called fortress holder, where they show the denials. now you got the brian terry family, a year later who was suing for $25 million because it was a gun that was issued by the atf that ended up killing the border patrol agent. >> gretchen: i was going to bring that up, that this whole thing comes back to this young man who was killed by one of these guns that was part of fast and furious and that family says they still need the answers of what happened to their child. >> they're entitled to it. the shame of this is that to say that the inspector general is handling this is really to deny the fact that even the people who shot brian terry have not been sent to trial. it's not gone to trial. the case has been sealed. why would that case be sealed? a convicted sex offender working at a daycare center, our fox center got a tip that he was working in the kitchen of little green tree house. ellis was convicted of sexually abuse ago 14-year-old girl. when won fronted by the reporter, he claims he didn't hide a thing. >> i told them what happened in my background. >> you told the temp service that? >> yes. everybody know that. >> did the temp service tell these people? >> i told these people. >> gretchen: the managers of the daycare appearing to be shocked when they heard his criminal history. they claim the temp agency does background checks on all the employees, but something went wrong with ellis' check. the temp agency refusing to talk about it. ellis was kicked out of the daycare center and right after, he headed for his car. but he had another problem there because he hasn't had a driver's license since 1996. >> steve: oh, man. meanwhile, steven tyler is defending his singing skills. the front man has been blasted for his rendition of the star spangled banner at the afc championship game. remember? >> well, first of all, you know we got to keep first things first. it's really good news for the country when you've got millions of people who have been unemployed for years to start to see the economy picking up and people going back to work. that's great news. politically, it's good news for barak obama. no question about it. i think the number of people have been expecting is 150,000. 243 begins to get us in the number if it stays steady and that's an if. with you if it stays steady where you really begin to cut into that unemployment number, politically, obama is going to be able to go out and say the recovery is starting to take hold. people are going back to work and unemployment number -- look, it's still going to end up being historically high for a president seeking reelection, but if it gets down below 8%, that's a lot lower than people thought it was going to be. >> brian: also the big news, chris, this week was it's coming out that secretary of defense thinks we'll end the fighting season a little early, maybe a whole year earlier. then we find out that as many as five taliban leaders are going to be released from gitmo. they're going to be moved out in what many people believe is a swap, perhaps, for maybe an american that's being held or some others as part of the peace process. this is a disaster! how do you think this is going to play, or is america going to ignore this? >> it's interesting. i think there is troubling aspects to this because they're talk being five taliban leaders, gitmo, who are now in guantanamo bay, who were judged to be too dangerous to move and really what they would do is they would be sent to qatar, a country in the persian gulf, as part of an effort the u.s. is trying to engage the taliban in peace talks. the idea is that this is a confidence building measure. it hasn't been firmly decided yet, but does seem to be headed in that direction. the interesting thing is this country -- i can understand the reasons a loft people are very concerned about it, but a lot of people were very concerned or expressed concerns when we announced we were pulling all of our troops out of iraq. it seems to be working on the president's behalf. his political favor. >> brian: really? >> i wonder if this is the same, the country is so war weary that people are willing to say, just let's get out of that part of the world. not necessarily the best move, but it might be politically smart for the president. >> steve: chris, who do you have on your program this weekend? >> we'll be talking obviously -- you don't have to stay up late and watch the nevada caucuses saturday night. we'll have the results sunday morning. top supporters for gingrich and romney. some of the candidates. and all the political implications. it's been quite a week. florida, now nevada. it looks, and i repeat it, it looks, like things are going mitt romney's way at this point. >> steve: it does. look down so you can revive brian's dream of being on "the brady bunch." >> i'm taking the giants, $15. >> who are you betting with?
