is he going to say he's officially never running for president? is he going to say he's actually running for president or is he going to endorse somebody today? >> well, according to people in the trump camp, the major announcement as it has been characterized "will pertain to the presidential race." now, politico says that apparently trump is going to endorse newt but right now on the drudge home page, it says trump doubles down on mitt, with a question mark so there's some question about who, if anybody, he's going to say yep, that's the guy who is my guy. >> our own reporters on the ground have found this much out. they say suddenly mitt romney has changed. he's amended his schedule for today. he has an event in reno 4:30 but an open part of his schedule at 12:30. so does newt gingrich. what does that mean? let's keep in mind this -- remember when donald trump was going to do that debate during that christmas break time and it never happened because many of the candidates said they would not participate. the first person to say they would participate was newt gingrich. just saying. have no idea if that factors into any of this or not. >> second one was rick santorum. and he felt as though it wasn't enough because at that time, rick santorum was an after thought to go ahead with the debate but i have a hunch after studying donald trump over the last few years, even if he wanted to endorse newt, i could be wrong here, even if he wanted to endorse newt, he has this habit of always wanting to be with winners. why at this point would he take a risk of endorsing the wrong guy that even if he believes in him that could eventually not get the nomination and have to come back and support somebody else being that he's put a line in the sand saying anybody but president obama. >> and the thing with -- donald trump is a great producer of a tv show where it is a cliffhanger so you don't know until the last minute who is going to get fired or in this case, perhaps, who is going to get hired. it would be really spectacular if at around the noon o'clock hour out there at his vegas hotel if both, you got newt and mitt in a board room and he says to one of them, you're hired. >> i don't think -- >> or rick santorum walks out of like a secret elevator. here's rick santorum. >> if donald trump is concerned about getting jobs back to the united states which is his number one issue, he should be endorsing me and not newt gingrich. >> the rumor was it's going to be newt. keep in mind that he just switched out of the republican party to become an independent. donald trump. so to somebody, if you do embrace donald trump's endorsement it might be good. upon further review, you might be saying didn't you just leave your party? >> one endorsement we know from nevada is sharon engle, she ran for senate. she's endorsing rick santorum and the other news out of that great state out there is the fact that ppp, the polling outfit has come up and in the wake of what happened in florida, mitt romney currently leads newt gingrich by 15 to 20 points after the first night of polling. >> ok. let's talk about florida, though, we're going to go back in time because guess what? late yesterday afternoon, fox had a news alert saying that newt gingrich was going to challenge what went on in florida. now, it's a little complicated but remember, florida used to have their primary at a later time and then they wanted to move it up. but in order to do that, they had to be penalized so they used to have 99 delegates and then went down to 50 but it's winner take all of those 50. well, now newt gingrich's camp and others claiming that it really shouldn't be winner take all because it never was before so actually those delegates should be divided up as they were in south carolina. will that actually happen now? here's the republican national committee chair reince priebus. >> when a state violates the timing rule of the rnc, there's a certain amount of penalties that the rnc can level against the states that violate the timing rules so we've leveled every single penalty that we can level against florida and if there's a further -- if there's a further complaint, the rnc has a committee called the committee on contest. there are very few standing committees at the rnc but there's a committee on contest that's sole purpose is to hear complaints of delegates. >> and they're going to get a call. >> apparently, they're not very happy about it, though, they claim it should be the chairman who should make this decision. >> well, if you remember, the same thing happened back in 2008 on the democrats side and it was when things were hot and heavy between barack obama and hillary clinton, the florida delegation was penalized and at the last minute as could be the case here just before the convention, the entire delegation may be seated. >> let it go. bill mccullum is trying to make points with newt gingrich. everybody has moved on including the candidates. it's been 50 delegates going in. it's not like they changed going out. meanwhile, an important story coming up after your important stories that you're going to read. >> are we going to hear from bill mccullum? no, let's go to the headlines. major developments in the fast & furious scandal. attorney general eric holder back in the hot seat this morning. he will get grilled by a house committee about the government's botched gun tracking program. and the family of u.s. border patrol agent brian terry who was killed by a fast & furious gun filing a $25 million wrongful death claim against the government. terry's family says he was killed because atf investigators allowed those guns into the hands of mexican drug gangsters who killed him in the arizona desert. a missionary couple originally from amarillo, texas, murdered in mexico and family members think they were the victims of drug violence. john and wanda ran a church together. he was a baptist minister. they were found dead inside their home in santiago. electronics and a safe were stolen from their home. this is the second murder involving american missionaries in the region in less than a year. a nuclear power plant shut down at this hour because of a leak. crews working there right now trying to fix that leaking steam tube and a steam generator at the nuclear power plant in california. the nuclear regulatory commission says the small amount of radiation may have gotten into the air. however, the plant's owner maintains it did not. tests done last night show no increased levels of radiation. isn't that the second event? "the wall street journal" puts it at about $28 billion. >> and he's 27, 28 years old. >> he's 28 in may, i believe. he's a young lad. there's a lot of focus on can a man who wears t-shirts and jeans and shall we say socially awkward, can he become a ceo of $100 billion company? >> defense secretary leon panetta surprising the world by announcing the -- that u.s. troops will be out of afghanistan a lot sooner than expected. he said "our goal is to complete all of that transition in 2013 and then hopefully by mid to the latter part of 2013, we'll be able to make a transition from a combat role to a training advisor and assist role." really? originally, panetta wasn't supposed to make that announcement until may of this year. did he jump the gun? is he playing politics? we're joined right now by a former navy seal who served three tours in iraq earning his silver star, two bronze stars and a purple heart and he's part of the fox news family. he made a great move and married jenna lee. thank you for coming. >> thanks for having me. >> when that news came out from the secretary of defense, what was your reaction? what's the reaction for the guys fighting the taliban on a day-to-day basis who thought they were fighting the war in 2013? >> the reaction is absolute frustration. no question about it. i think this is a political timetable. it's not driven by the military, by our military mission there. and i think it's absolutely the wrong move. you know, there are a lot of people that think that the american public is tired of the war in afghanistan after 10 years. i disagree with that. i think the american public is tired of not winning the war in afghanistan. and they want to see us win. bring troops home. if you ask combatted troops, that's what they want to do. >> what about needing to fight in order to stablize and train against the taliban, how can you possibly get informants and win over the hearts and minds if you told them we're ready to go? >> that's exactly it. we can't and that's really the big issue here. if you have -- you're a counter insurgency environment and the strongest side wins and the local populous looks at the strongest side. if we've already announced our timetable that we can't fight, then -- and we're pulling out, the taliban is the strongest side they're going to turn to. >> i want to get your reaction to this. there's a report out that we're looking to move five taliban leaders out of gitmo that we house the worst of the worst in some type of prisoner swap. they're talking about that now pulling that off. what does that say to people like you fighting to capture those guys before they killed you? >> it's infuriating. the taliban is absolutely the enemy. regardless of what has been said and that -- the policy we're pursuing right now looks like vietnamization to me. we are announcing timetables, withdrawal and we're negotiating with a very untrust worthy enemy. >> you're a navy seal and wrote an editorial on "the wall street journal" at which time you think all the so-called publicity the navy seals are getting are detrimental to the mission in the future and in the past. you do not like what's happening here and that is from the bin laden raid to the other raid that happened two weeks ago. >> well, the problem is that is our classified secrets need to remain secret. when we release that information out to the public, our enemies have that information. it puts the guys who -- the brave warriors who go out and conduct these missions in greater harm's way. it risks future successes and it seriously damages our collection capability. >> you quote admiral mccraven, your top special operations commander and he says operation security, maintaining secrecy is paramount and he goes on to say, too, that what about the informants that help you out? that pakistani doctor that got behind the bin laden walls and able to get the d.n.a. that guy is now under arrest because details in the american government came out about the bin laden raid. >> that's a perfect example of how serious damage to our intelligence collections network that can set us back decades have resulted from these information leaks. and that, you know, that individual's life is in danger as well as so many other folks that were arrested immediately by pakistan for allegedly providing information to the c.i.a. and that's absolutely critical. pakistan certainly knows that. they want to prevent us from being able to collect intelligence and conduct those types of raids with similar success. so the whole reason they arrested those folks and it's atrocious. >> all right. and to use a quote, too, robert gates finally. when he left the situation room after the bin laden was taken down, they all agreed in the situation room to keep their mouths shut and by the next day, all the operation details were out and about and for your -- for your money, you'd just like to see it stop. >> exactly. >> thanks so much for coming by and thanks for your service. great to meet you. >> i know your second favorite fox show. 28 minutes after the hour. vanderbilt university trying to force prayer groups to let atheists be in charge. how you can voice your concerns coming up. what would an atheist pray about? there is a group that's active right now in those efforts because they say so many people in this nation are fat and they're blaming sugar. >> where was it written? in our weekly issue hand delivered to us from "nature" magazine comes every week and right open up to this, they say sugar acts in the same areas of the brain as alcohol and tobacco and encourages subsequent intake which means once you have a little bit of sugar, you want a little bit more. it's toxic because research shows the sugar increases disease and other factors that add calories such -- that disrupts your metabolism. so it's a strong argument. the question is can we make any of our own decisions anymore? >> no, absolutely not. we should point out that the sugar association disputes the science that is quoted in this particular commentary. >> you think they have -- do you think they have -- >> they really do have a sugar horse or a horse taking a sugar pill. listen, i just got to say thank you to these people who have come up with this idea because, you know, so many of us, we just don't know what we should eat or what we should think or we should buy so it's really good that these folks should come out and say, we really need to start taxing sugar or putting an age restriction on it so only certain people eat stuff that people have eaten for thousands of years. >> and the reason that we've come to this point is because there's some facts in this whole story is that america is fatter. america is fatter. >> the world is fatter. >> yes, the world is. >> but should -- should it be personal responsibility to know how much sugar intake you have on a daily basis or should the government step in and make it like a drug? and make it like it's regulated? that to me is at the heart of the issue here. it's personal responsibility in my mind. >> you start with sugar and next thing you know, you'll need i.d. to buy butter. there's going to be an armed guard at the dairy queen. some people would say this is a good argument why you should vote for ron paul. >> because you'd have the freedom to have sugar and be fat and that would be fantastic. >> none whatsoever. not that i know of. >> 36 minutes past the hour. let's take a look. chaos breaks out in egypt at a soccer match between two long time rivals and the video is outrageous. fans storming the field seconds after the home team beat the league's best club. amazingly more than 70 people were killed and hundreds more injured. fights broke out all over. some fans tried to take cover under bleachers and in locker rooms. fans at another stadium. this one in cairo setting bleachers on fire angry that the league stopped all games for the day. protesters now rallying in the streets. many believe the police were too slow to intervene. have you ever seen anything like that? >> i'm doing fantastic, thank you. i know you've been following the segments on "fox & friends" and you were alarmed at what is going on at your former college. correct? >> yes. yes. it's very disturbing. i think this is political correctness on steroids. i mean, they're usi nondiscrimination polies and in this case, they've come up with something they call an all comers policy which seems to be broader in which you have this absurd idea that a christian or jewish religious organization has to take an atheist, for instance, someone who is antithetical to their beliefs and have them even be able to run for leadership positions and according to what i've read and found out from studying this issue, they even have provisions in there, the university is determining this as that student groups cannot vote to decide against electing someone who is, for instance, an atheist based upon their nonbelief. which this just is -- >> on the face, it sounds crazy. it just sounds crazy and i know what you're saying is that back in the 70's when you were at school, this would have never have happened. what's changed? >> it's -- it's the war on religion by the left. i mean, we are -- as they want to root out, i think, religion from our society and they're doing it at colleges and universities and i think alumni in not only vanderbilt but at all colleges across the nation, and parents of perspective students need to look at each college's policies and see what they're doing and make their decisions about sending their students there. i have a very good friend who is thinking of sending her son to vanderbilt and after seeing the segment yesterday, she told me that there's no way. >> interesting. i want to read the statement from vanderbilt. they're sticking to their story. the university does not seek to limit anyone's freedom to practice his or her religion. we do, however, require all registered student organizations to observe our nondiscrimination policy. it seems to me, though, that in our society today, we're sort of confusing discrimination with differences in opinion and differences in the way we live our lives and differences -- i mean, even just differences between men and women, will we come to a point in society where everybody gets into anything? >> well, i think he views paul ryan has an ideological foe and this was al levy's moment to stick it to paul ryan and so when i saw this video, i thought to myself, you know, it takes a special type of person to be this -- to be a jerk in public like this. and i thought there's got to be more to this. and so i started looking and i just found example after example where al levy talks about organizing students for political purposes, turning students into change agents, all of those sorts of things. and so this is a perfect example of where an activist teacher is using his position and influencing his students with a personal political agenda that needs to frankly be rooted out of our schools. >> you know, and we talk about the trouble with schools all the time, kyle and the last thing we want in front of our kids is a teacher with a political agenda. we don't want him teaching from the left. we don't want him teaching them from the right. we want them to give the kids the facts. but as you've detailed, this is a guy who in the past has had an agenda and it is strictly been to convert these kids into democrats. >> that's right. in 2004, he held a get out the vote effort which was an official school function. he billed it as nonpartisan. but as it turned out, the event actually was partisan for obviously one side. the school district canceled it. and when the school district canceled it, his response was -- he said that it's a shame that we are not teaching good values because it can be canceled simply because of partisan reasons. and so my thinking is that what type of values are we teaching when we're using partisan politics to push an agenda? >> i've only heard him, donald trump say one time he was a little mad at mitt when mitt didn't show up. besides that, he has been very positive about mitt saying that he found him -- thought his debate performance on monday was very strong and he's always been a fan of newt and he was really appreciative of newt when he stood up for the trump debates. >> i'll go out on a limb and i'm going to guess that he is going to make the announcement that he's not going to endorse anyone. that's what i think he might do. not going to endorse anybody. because last night, he was still saying that he might run for president. and let's face it, if he endorses somebody today, then how does he turn that around? because his whole argument has been, i may run as an independent after my show ends in may if i'm not satisfied with who the republican nominee is. and if this thing could go all the way past super tuesday and maybe even to the convention, then maybe we wouldn't know exactly who the nominee is. i'm going to say that he's not going to endorse, he's going to make the announcement he's not going to endorse anybody. >> that's going to be the biggest letdown since the bob newhart did a flashback to the previous show. >> what's he doing in bed with him? >> i will add this, there was a report that when he land at the airport and he was talking about -- telling them about china and how he's very disappointed in our leadership, some woman yelled to him, donald, why don't you run for president? i want you to run! and his answer was i might make you -- you might be very happy -- you might be a very happy person tomorrow meaning today. >> ok. you know, let's remember that when he was going to have that debate on december 27th, it got canceled because nobody decided to participate except for the first person who said yes was newt gingrich. the second person was rick santorum. is that what donald is remembering in his mind? i don't know. i just find it interesting that he would pick today to finally make his endorsement after all this time? why would it be today unless he's really not going to say anything about an endorsement? >> because nevada is coming up. they're going to do some caucusing out there. >> nevada is much smaller than any of the other big states. i'm not trying to offend nevada people but it hasn't gotten the hype. >> there is a lot of hype regarding what's going on out there. sharon angle has just endorsed rick santorum and a poll came out and we just saw it flash across -- >> james dobson got santorum in colorado. >> if you're curious, in nevada right now, it sounds like mitt romney is ahead 45-25, newt is in second place. meanwhile, in florida, you know, that was one of those situations where they were penalized because they moved their primary before april 1st so they lost half of their delegates. well, as it turns out, part of the small print said that it's got to be proportional. and now, what newt gingrich is apparently going to do later today, one of his campaign members down in florida is going to ask the rnc to give him a proportion of the votes he says he wants. >> so the person who might be in charge of that is the head of the rnc, although he says that there's actually a committee that will look into it. here's reince priebus. >> when a state violates the timing rule of the rnc, there's a certain amount of penalties that the rnc can level against all the states that violate the timing rules. and so we've leveled every single penalty that we can level against florida and if there's a further -- if there's a further complaint, the rnc has a committee that's called the committee on contest. there are very few standing committees at the rnc but there's a committee on contests whose sole purpose is to hear complaints of delegates. >> so look forward to just before the convention, most probably if the past is prologue, there's a real good possibility that half of those delegates that were ditched will be receded before the convention, it happened in 2006 on the democrats side. what's interesting and curious as well is with this small print out there, why didn't newt gingrich mention this before the primary? >> i don't know. the interesting thing is he has the former attorney general in florida bill mccullum, i guess, making his fight for him. he was on greta's show last night and he had this to say. >> it's a rule, it says up front that's what happens and i have reason to believe just talking anecdotally as to various national committee men and women, there were quite a few of them on that committee who are very, very unhappy that the chairman isn't choosing to enforce this rule. >> like a he said/she said. >> proportional ruling got mitt romney two delegates in south carolina and it's about the same distance between them. you're probably debating something that's not worthy of our time. >> if florida holds with the number of delegates they've got right now, romney would have 23, newt would have 16. but if they restored them, you know, because they've sanctioned them once and if they go back and they install everybody as well, it looks like mitt could get 46 and newt could get 32. stand by. >> if close at the end, it might matter. let's do headlines for your thursday. major developments in the fast & furious scandal. attorney general eric holder back in the hot seat this morning. he'll get grilled by the house committee about the government's botched gun tracking program and the family of u.s. border patrol agent brian terry who was killed by a fast & furious gun filing a $25 million wrongful death claim against the government now. terry's family says he was killed because atf investigators allowed guns into the hands of mexican drug gangsters who killed him in the arizona desert. a nuclear power plant shut down at this hour because of a leak. crews working right now to fix a leaking steam tube in a steam generator at a nuclear plant in california. the nuclear regulatory commission says a small amount of radiation may have gotten into the air. the plant's owner maintains it didn't. tests done last night show no increased levels of radiation. here's a story that will fire you up. four new york city schoolteachers are making a combined total of $365,000 a year but not even in the classroom. all of them currently doing administrative work after being banned from teaching because of inappropriate touching or comments made to students. in alan rosenfeld's case, the department of education couldn't come up with enough evidence to fire him. he's been answering phones and handling paperwork for 10 years and still bringing home his $100,000 salary plus benefits. to top it off, he's running a real estate office on the side. mayor michael bloomberg had a suggestion for him. >> use him in the city to help us with our real estate. he's a city employee, after all, and he's getting paid. >> adding insult to injury, rosenfeld doesn't need the money. he's reportedly worth a jaw dropping $10 million. and those are your headlines this morning. >> union rules. all right. straight ahead on this thursday, terrifying moments for two police officers arriving at a car fire realizing hey, somebody is inside that thing. >> is anybody in there? joining us right now, fox news contributor and co-host of "the five" juan williams and fox news political analyst angela mcgowan. was this taken out of context in your estimation? >> no, that's what he said. i think your point, brian, is there's a larger context in which he goes on about wanting to focus on the middle class. but the fact that he says he doesn't care about the poor really doesn't help him because it plays to all the stereotypes about him being a rich guy out of touch and, of course, it comes on the heels of the other comments he's made about liking to fire people or corporations or people, it just doesn't help him. >> right, but those almost all are taken out of context and angela, you know what i meant. he's looking out for the middle class because they have welfare, food stamps and other things down low and up top, they don't really need it. >> that's the rub. what you just said, you know what he meant to say. as a candidate, you have to be clear on your message and you cannot leave it open for interpretation or ewing going to have blogers. internet took this thing and went wild for it saying mitt romney the rich ceo is not concerned with the poor and took his statement out of context. the winner here is newt gingrich who said i'm concerned about all americans and i'm tired of politicians trying to divide america. >> here's mitt romney in the follow-up to fully clarify what he said many times before on the stump. >> i'm in this race because i care about americans. i'm not concerned about the very poor. we have a safety net there. if it needs repair, i'll fix it. i'm not concerned about the very rich, they're doing just fine. i'm concerned about the very heart of america, the 90%, 95% of americans who right now are struggling and i'll continue to take that message across the nation. >> i know i said last question, you just said i'm not concerned about the very poor because they have a safety net and i think there are lots of very poor americans who are struggling who would say that sounds odd. can you explain that? >> of course not! number one, he is not liberal so the liberal mainstream media would not give him a fair shake. that's why, brian, he needs to be precise his message. i agree with juan earlier, by romney saying he sees corporations as people. by making a $10,000 bet with r perry, you can't do that much the liberal mainstream media wants to make him out to be the rich ceo that can't relate to common folk. >> the other people a -- thing that a lot of people are pointing to, we don't like what you're saying. that safety net flies in the thought of conservative thought that welfare is not to prop people up but keep people down. that's the conservative thought in many ways, don't you agree? >> you know, i mean, the whole notion of a compassionate conservative, brian, is someone who understands that the middle class especially coming through this recession may have fallen into the ranks of the poor and what you're trying to do is get people back up so the idea is to give people enough support so they can get back on their feet. it's not keep to them down. i mean, but historically i think this is a critical point. if we take this debate seriously and not just about the politics of it, charles murray has a very important book out in which he talks about the lack of industrious, total family breakdown we're seeing across america and across all kinds of racial and ethnic lines and i think you got to care about that issue if you expect the american people to rebound from this recession in some serious way. so on a serious level, that's tone deaf. >> i believe that he cares about this issue but when you have charles krauthammer and rush limbaugh going against you as the frontrunner as you will in the republican party, that's the problem. and i wrote a book "bamboozled" that talks about welfare being the new plantation for poor people. so the bottom line is this, what mitt romney needs to do now is talk about the solutions and not do the division in america. >> and juan, newt was making -- go ahead, finish your point. >> i was going to say what angela just said, it's not just liberals and people who are opposed to mitt romney or democrats who are criticizing, it's coming from people like rush limbaugh and others. >> newt gingrich capitalized on it, saying i want to be a candidate for all people. everything is fair game and everything shifts in nevada. we saw the excitement of punxsutawney phil, we were able to experience that together. have a debate and come back to the debate. i believe we made tv history. >> i think it was wonderful. >> keep that liner in your jacket for another six weeks because winter is going to be a little bit longer. >> if only phil did politics. >> i wish he did. >> yeah, but i got a feeling we're going to see six more months of political debate. >> i think so, too. >> all right. thanks a lot, guys. >> bye. >> you're welcome. >> ok. should i acknowledge people on the couch or -- >> keep going. >> all right, good. all right, people who aren't here, get ready for this, the economy -- will you back up, please? >> well, let me update you because the hype is continuing. they're calling it the most viewed and possibly the most watched super bowl in history. new york needs to get ready for a parade on tuesday. that's the guarantee and this is always a mistake from defensive tackle chris cante as the giants prepare for sunday's big matchup at 6:01 eastern time and, of course, on super bowl sunday. he said giants should plan for a parade down the canyon of heroes. his tough talk making it sound like he feels the ring is only days away. we'll be heading out to the super bowl in indianapolis friday morning. amongst our guest, we'll have howie long. steven tyler, we'll have frank calliendo, carrie underwood, perhaps, and indiana governor mitch daniels live. we'll be there all weekend. is he staying or leaving? the future of the colts quarterback peyton manning continuing to overshadow the super bowl as the clock ticks down to sunday's big game. they have the owner saying he'll meet with manning next week but any decision on the quarterback's future won't be made until march. really? as you know, the quarterback is due to make $28 million in a bonus if they don't pay it, he becomes a free agent. he could be released as early as next tuesday. manning says his recovery is going well and he will be back to play somewhere next season. his brother is starting for the giants. steve? >> monday evening. >> monday night, you get this call that there's a car on fire. right? and you arrive and what did you see? >> we came around the corner and immediately see this car fully engulfed in flames and that. we were a little surprised. it's parked in the driveway and very close to a house. >> as it turns out, officer, there was somebody inside it, right? >> correct. >> who and what were they doing? >> the owner of the vehicle was at his house. apparently from what we understand, he arrived home and backed the vehicle in his driveway and from what we understand, we believe he fell asleep with his foot on the gas. >> and some of the neighbors said he does that often and sits in his driveway and listens to music. apparently, he was revving up the engine and it got too hot and burst into flames. now, when you first got there, you probably figured it's just a car fire. nobody is in there, right? >> exactly. that's what we assumed, he was already out of the car. we were going to approach the house and knock on the door. as we were getting to the house, the neighbors started yelling he's in the car. and he's definitely in the car. >> he was out, right? >> yes. >> he was completely -- you figured overcome by fumes or passed out or, perhaps, dead. >> right, we were screaming -- we needed to get him out of the car and we needed his help and we were trying to, you know, wake him. >> sure and that didn't work, you tried to get open the door. it did not work. you went to get a punch, correct? >> right. i ran back to the car thinking if the doors are locked, we have to punch the window open. by the time i went back there, he unlocked the door and the officer ripped him out of the car. >> so you were -- while he was getting the punch, doing exactly what he had to do, you just realized ok, the guy popped open the door. i'll drag him out. >> we had yelled to him to unlock the door. as mike was going to get the life hammer, i went to the driver's side and at that point was able to get it open and he was awake but he wasn't really coherent and he didn't seem to understand that the car was on fire and we were yelling at him to get out of the car. and he's not going to do it on his own. we reached in and grabbed him. >> maybe i've seen too many episodes of matlock or kojak or something else, my main worry would be so close to a car on fire. it's gonna blow! >> we do know that tires blow on cars like that and all kinds of, you know, bad things can happen and we didn't want to be there any longer than we had to be. the key was to get him out as fast as possible and get him on his feet and away from that car. >> how long did it take you, officer, to drag him out of the car? >> it felt like a lot longer. when i saw the video, it seemed like everything went really quick. got him to his feet and able to pull away from it. it felt like it took a few minutes. >> you saved his life. you are alive today because of your quick thinking. >> good timing. thank you very much. >> how is he? we have to say, are you catholic? we don't do that. >> politically, this could be a problem for the president in the november election, even though about appealing support from catholics, about three quarters of catholic women differ with the church on its policy on contraception because of the perception that the health care reform law is an overreach. florida senator marco rubio has introduced legislation that would basically exempt catholic institutions from this policy. brian, steve, gretchen. >> steve: thank you very much. wendell goler, now let's go out to colorado spring where is michelle malkin is joining us live. i see on your web site right now your lead story is first they came for the catholics. that's the title of it. wendell just perfectly framed it, you've got the administration telling catholic hospitals and what not they've got to pay for contraceptives, sterilization, things for the employees that the church stands against. >> yeah. that's right. i think what a lot of people are realizing and why there is such a growing backlash now since the policy was announced a couple of weeks ago is that people realize this isn't just about catholics. this is about another layer of unconstitutionality of the obama care mandate and the same way that you have a number of states that have risen up against the forced individual man it is date, you now have a lot of vocal religious health care providers, not just catholic, but protestant, jewish, evangelical, all banding together and objecting to the way in which this is forcing health providers across the country to violate their own consciences and the teachings of their churches. the white house's official response earlier this week was somehow that there were no constitutional issues involved. but in fact, there are several lawsuits right now that have been filed by the nonprofit beckett fund to challenge this mandate and other related rulings by the obama eeoc that discriminate against employers, social service providers, and schools that refuse to compromise their own religious principles on this. this is -- it is, to use an overused word, fundamentally a usurpation of religious freedom. >> gretchen: that story is it far from over. off big announcement of your open because you have endorsed somebody. you have endorsed rick santorum. why? >> i did. and i laid out the case very carefully in a blog post on monday. i think i'm like a lot of grassroot movement conservatives who have weighed all of the flaws and all of the pluses and minuses of all these candidates carefully. i think it's very important to send a message to people who think that this race is somehow between only two people, mitt romney and newt gingrich, that there is an alternative. i don't agree with rick santorum on everything. i'm not a purist by any means. i think it's kind of funny because i've been tagged as such the there are a lot of votes that he took during the bush administration that i disagreed with. but i think that for people who want to feel proud and comfortable of a candidate that they feel represents a basic amount of decency, integrity, and social and fiscal conservatism, rick santorum is that alternative. >> brian: here is newt gingrich. he feels differently about this two-man race. listen. >> sure does. >> i think florida did something very important coming on top of south carolina. it is now clear that this will be a two-person race between the conservative leader, newt gingrich, and the massachusetts moderate. [ cheers and applause ] >> brian: get out, rick. that's basically what he's saying. but meanwhile, head to head with president obama, michelle, rick santorum actually does better. >> that's right. and the ppp poll results that have come out in the last couple of days point to that, that in places like here in colorado, missouri, and ohio, mitt romney does far worse when put head to head with rick santorum, which begs the question, who is the spoiler here and who should get out? i think rick santorum has done a good job of pushing back on that. i think it's ridiculous for newt gingrich to be calling for rick santorum to get out when newt gingrich certainly didn't do that when he placed badly in iowa and santorum won! >> gretchen: real quickly before we go to a different topic. donald trump going to make an endorsement, or maybe he's -- i think he's going to say he won't endorse anybody because he wants to stay -- keep his name alive possibly as an independent. what do you think will happen? >> i think people need to look at donald trump's record of so-called conservatism. look at his record of campaign contributions and judge for themselves how important or relevant anything he has to say about the gop 2012 races. i've been vocal about my own opinions about his eminent domain abuse over the years and whether or not he's just basically exploiting the gop 2012 campaign for his own pr purposes. >> steve: i got a feeling you will not be invited to be on the apprentice. >> exactly. >> steve: let's talk a little bit about this. general motors touted as an american success story, but interestingly enough, they have apparently awarded their media buying account business, $3 billion worth of business to a united kingdom firm. we bailed these guys out and now they're turning around to say thank you by sending the money to england. >> that's right. they put our hands in our pocket for $50 billion bailout and then poked taxpayers in the eye with a very significant -- i mean, this is not a piddly amount of money, $3 billion to this u.k. ad firm. it's interesting that the white house has chosen this battle to fight for the campaign. somehow continuing to tout the gm government motor's bailout as one of their biggest success stories. the point isn't whether there has been any profit turned on this. the point is the government should have no business in the first place bailing out companies that probably should have failed. and if you want to ask about the success of this company, ask the workers that work for parts firms like defy who were screwed over in this deal. >> gretchen: yes. here is a quote from vice president joe biden. the best way to sum up the job the president has done if you need a real shorthand, osama bin laden is dead and general motors is alive. i don't know what the relevant is for the comparison, but that's what he said. >> they're going to plug those things together, knit it into any narrative they can. >> steve: yeah. they're alive thanks to the generosity of the people of the united states with that gigantic bailout. i think we've lost tens of billions of dollars on that bailout. still kind of hurts when they send the money over there. michelle, thank you very much. thank you for joining us from colorado springs as you do every thursday. >> take care. >> brian: thanks. the president unveiling a new plan for the housing crisis. will this one actually help you? bob massi is here answering your questions. >> gretchen: vietnam vet declared dead four times. the only problem is, there he is, he's alive. now the government wants him to pay for his burial. huh? >> steve: don't do it! >> yeah. are you paying attention? >> gretchen: sorry. there was some huge movement outside the window and the guy is washing the window right now! i'm sorry! i love you, but suddenly i saw what looked like a big weapon! >> brian: clearly he's not jobless. >> gretchen: so he factors in. >> 130,000 jobs tomorrow, unemployment likely the rate will likely tick up to 8.6, especially if anyone comes back into the work force. >> steve: we saw the tease you had -- this is your symbol for the price of gas and electric cars and stuff like that. >> yeah. want to talk about it? >> gretchen: why do you have the gas mobile? >> gm called me up about two weeks ago and said you've been very hard on the green energy, you're hard on the volt. you don't like it and i outlined all the reason, taxpayer bailouts, $7,500 taxpayer credit if you buy the car. a lot of money went into the car. i still didn't like it. they said, you need to understand the car better. i said, let me drive it for a week. they gave me the car. first two nights in a row, i charged it fully, it's a ten-hour charge. i charged it for 12 hours, got in the car in the morning, the battery light was all the way to the top. i live 18.8 miles away from here. i stopped for a coffee at dunkin' donuts works nights a row, the car lost its charge, ran -- drained the battery in the lincoln tunnel -- it goes over to gas. it's a smooth transition, yet it's only 25 miles. take a look. here is me videotaping. go to that. that's me videotaping the changeover from power, from electric to gasoline. >> brian: can you get a brighter jacket? >> i don't have one. there it is. watch on the left side of your screen. there is the empty battery that goes to gasoline. smooth transition, but only 20 miles away from home. 25 miles on a full charge. >> gretchen: how long is it supposed to go on a full charge? >> they sell it as a 40-mile range on power. now it kicks into gasoline, but look, if you do the math on it, it's a full tank of gas, ten gallons. a full charge is about 25. for me it was 25 miles. so you're getting about 300 miles per every ten gallons, plus a charge. that's 30 miles to a gallon. there are a lot of other cars -- by the way, that car is $46,500. that's the list price on the car they gave me. >> steve: that could be why they're not selling many. >> i own gm stock. i have nothing against g. it's not their fault they took the money. the obama administration spent so much time and money. but i got to tell you, let the private sector develop -- it's clearly the problem is the battery. the battery runs all the way up and down the middlele of the console of the car. you need orgeat a better battery. let the private sector go out and spend, i don't know, billions of dollars develop ago battery that keeps a charge longer than that because frankly, plugging that thing in every day and every morning, pain in the... i was charging this vehicle one day in the rain. i wasn't sure if i'm going to get electrocuted. >> brian: you didn't. here is the problem, i get it all the time because every time my car needs maintenance, they want to you take the volt. so i take the volt all the time. and you never feel the transition from gas to -- you see what you're doing now? that's what i hate. going into the trunk every night and plugging it in. you plug it in at the end and then in the morning, at 2:00 o'clock in the morning for us, i'm wrapping it up. >> if this car had a 200 or 250-mile range on one charge, you start to make -- it starts to make sense to me. but for 25 miles, i got to plug the thing in every single night -- i'll try again. you come back with a better battery, i'll do it again. >> gretchen: sounds like it works better for suburbia driving. >> you literally have to do this whole contraption thing every time for 25 miles. >> steve: because it runs on -- >> it runs on coal. >> gretchen: let's talk about this, the former governor of new jersey, jon corzine, ran nf global and we've been reporting that it lost a billion dollars of customers' money and didn't know where it was. the other day they said they came up with where the money is. in the meantime, we're finding out at the same time he's been a big bundler for president obama. i guess we shouldn't be surprised that he supports obama. he's also a democrat. >> the other issue with corzine is that he was joe biden and president obama, came out and they were on the podium saying, we're going to tap our smartest people we know to help us develop the stimulus program. they brought jon corzine on and so he's one of the smartest guys to help us with stimulus. turns out 2 1/2 years down the road, they're still looking for it. they may have found it, but they're still looking for what he did with a billion point 2 of depositors' money at mf global. another guy we find out is a big bundler for obama, steve spinner, you know about solyndra. he was involved in acquiring the solyndra $535 million loan. steve spinner's wife was an attorney who signed off on the loan documents for solyndra and now that's another bundler. there is a lot of transparency issues and a lot of -- >> brian: gas is up 30 cents a gallon. >> i got to say, guys, gas is going to have to go a heck of a lot higher before that car makes sense. >> gretchen: i'm going to look directly at you for sure the next time you're on this couch. i will never take my eyes off you. >> steve: we're going to be watching you today on "the five" right here on the fox news channel. >> gretchen: good thing i'm going to kick often the headlines right now. let's tell but this story. the u.s. military's ten-year long combat mission in afghanistan could be ending sooner than expected. defense secretary leon panetta announcing the u.s. and its nato partners plan to wrap up their combat role there by late next year. but current and former members of the u.s. military say it's a bad idea to tell your enemy when is you plan to stop fighting. earlier, we hard from former navy seal. >> the reaction is absolute frustration. no question about it. i think -- it's a political timetable. it's not driven by the military, by our military mission there. i think it's absolutely the wrong move. >> gretchen: he knows what he's talking about. he served three tours in iraq, earning a silver star, two bronze medals and a purple heart. brian? >> no question. the last ten days have been as brutal as anything i've ever seen. they need to tone it down. >> gretchen: today there will be a big announcement reportedly from donald trump in las vegas. you think he's going to endorse anybody? what's going to happen? >> who know what is donald trump? he may change his mind. he wants to be a player in this game. i would not be surprised if he endorsed gingrich and if gingrich didn't make it, gives him his excuse to basically go out and run as an independent or play with the game. i think what it does is can damage romney. he's a businessman, which is a legitimate credential, starts criticizing romney's business record, doesn't do anybody any good. >> gretchen: what about the florida fight, after the fact when the primary is over, now newt gingrich is looking at that committee and saying, look, really this should not be a winner take allstate with the delegates. where do you fall? >> the national committee sets the rules. the rules clearly said any race before april 1 had to be proportional. florida said excuse me, you already penalized by taking away half our delegates. we're going to make it proportional winner take all. they're wrong in the sense that the rules committee set by the national committee, i don't know whether they win or lose in this debate. should probably have been argued out before. but at the end of the day, if romme is a big win, it won't matter. if all of a sudden those 40 votes matter going into the convention, it will be a knock down drag out rules fight. >> gretchen: always great to pick your brain. you've been in the business a long time of the always interesting to hear your thoughts. >> thank you. >> gretchen: bueller is back from the super bowl?
