Neil you know, i never know what happens, though, larry if the other guy says i dont know where you got that information, i didnt do it. Its sometimes when i talk to my teenage sons about something, theyll deny until the cows come home, i had nothing to do with it and i know very well. And at least on two prior meetings, i dont know what the russian thing is about, i dont know, its nonsense and the president relays that. This time weve got more information. What do you do . Well, i think what you do is, you present the evidence you have. Remember, during the cuban missile crisis, ambassador stevens, he took the photos that we had from spy planes and proved that the cubans and russians were lying and they were lying through their teeth. They were install those missiles in cuba. You present the evidence, present it to putin and say, mr. Putin, not only am i giving you this, im going to present the evidence or endorse the evidence thats been presented to me once i leave our meeting. I mean, there are ways of doing it. Neil i agree with you. Youre exactly right, but that would be proving Vladimir Putin a liar and to the whole world, everyone that suspects, you know, that, yeah, he and his country were very much involved in our election, but if he were to admit to that or he would be exposing himself to be a liar. Yes, and i think thats probably an accurate description, but lets say he denies everything. You would still, or the president would still get across the point that we know what you did and if you do it again in 2018 and 2020, im going to levy real sanctionings. Youve got sanctions you want revealed and released and im going to levy more sanctions and then trump gets ahead testify and putin is on notice for 2018 and 2020 without admitting what hell never admit. Youre absolutely correct. He knew nothing about it. Those enough to remember hogans heroes and sergeant schultz, i know nothing, nothing, and thats going to be putins answer. Neil i expected more from you than a reference from hogans heroes. [laughter] the benchmark, whether its john f. Well, it could as long as President Trump is tough with president putin. Let me give you a counterexample. You dont remember this, but you studied it. When president kennedy a few months after taking office had a vienna summit with president khrunichev, it was a disaster. Neil it was a disaster. Khrunichev went in thinking i can maneuver this guy and manipulate this guy. President kennedy thought im going to overwhelm him with facts and truth and be nice. You cant be nice in the circumstances, so you can end up causing more problems and clearly that led to the cuban missile crisis because khrunichev was convinced he could take advantage and outsmart this young president. Its better to confront putin and make sure that he understands that you cant be outmaneuvered, you cant be manipulated and that youre on notice. Neil wellput. I was born 30 years after that, as you probably know, but i heard about it. I know that. Well, i remember it in person and thats why you have me on the show is because im old. Thank you for coming in. Oh, my pleasure, neil, thank you. Neil when you worked with Brett Kavanaugh, what capacity . What was he doing . He was a young lawyer. I had recruited him to my law firm, neil, and we won, kirkland and elliss, my law firm at the time won the Brett Kavanaugh derby. He was one of the most sought after lawyers after clerking. And lightning struck, brett, come help me and terrific lawyer. Neil and with that association depends on your point of view, as in most things in life, but, neil, the key is, he was a great lawyer and i think everybody now knows that, so the battle, which well get into, is going to be over philosophy and ideology, he should win that battle, but here is an opening point. For him to be praised by one of the most liberal constitutional law professors in the United States, very thoughtful. Akhil amare of the jail law school who said in the oped, new york times. Neil i read that piece. Im glad you had him on, im sorry i missed it. And a wonderful professor at yale law school, these are liberal yale law professors, but theyre people of principle and they see that Brett Kavanaugh is truly an outstanding candidate who deserves confirmation overwhelmingly. Neil maybe you can help me get clear his views on president ial misconduct then because they seem to have evolved, veered or he has pivoted somewhat on the issue of certainly about bill clintons transgressions and how aggressively a prosecutor can go. Could you enlighten me . Well, i think what brett experienced, im sorry i call him by his first name, but what judge kavanaugh experienced during the whitewater investigation and especially the lewinsky phase, is the downside of these investigations. That is, theyre very disruptive to the presidency and therefore, to the orderly operations of the government. And what he did in his law review piece, as i read it, is to say, congress should take a look at this issue and congress should consider, should the president , in light of our history, irancontra with president reagan, and just go down the list of modern day presidencies, and most have been affected in some significant way by an investigation. So, what hes suggesting is Congress Take a look at this and consider whether to essentially have had a postponement or a timeout. Its a perfectly reasonable position, but hes speaking as a thoughtful observer and not as a judge. S going to go by the law as a judge and as a justice. Neil was he talking about prosecutorial zeal there. Some interpreted the president , even picking him in the first place, is that he would have a sympathetic vote on the Supreme Court in case this were ever pushed it a crisis. No, i think the country should have confidence that Brett Kavanaugh is going to set aside whatever his policy views are, and to say, what does the constitution call for. And the Supreme Court of the United States spoke unanimously in the Paula Corbin Jones case, brought by president clinton to the effect to the Supreme Court saying grant me immunity from civil litigation, and the Supreme Court unanimously said no, and that included two of president clintons own appointees. Thats the law of the land, that no one is above the law. Thats the way, im confident, judge kavanaugh, if he becomes a justice, would rule. That a subpoena is a subpoena. A subpoena to testify in whatever. Now, thats probably going to be litigated, but i think that he will follow the traditions of the law that i think is pretty clear that the president can, in fact, be subject to this kind of subpoena process. Thomas jefferson, john marshall, going back a century, Thomas Jefferson didnt like it that he got subpoenaed. That was just to produce documents, but he obeyed. Im sure Richard Nixon didnt enjoy the fact that he was getting a subpoena for the famous and now infamous white house tapes, but he obeyed and thats the rule of law in our country. Neil but it was the threat of subpoena from your office, not the implementation of one, that ultimately got bill clinton to talk to you, right . No, we actually subpoenaed him, but then we negotiated the withdrawal of the subpoena. Neil so. Which was fine, out of respect for the presidency. Neil thank you for clarifying. Ken, do you know whether he would argue that breath kavanaugh would argue that if a prosecutor wants to talk to the president of the United States, he can force the issue . Well, were in a different situation now, neil, as you know, because bob mueller is an officer of the Justice Department. In those days we were talking about an independent counsel, right, and the independent counsel had his or her own authority. So its going to be a different set of issues in terms of separation of powers because Robert Mueller is an officer of the Justice Department. He enjoyed certain independence, but he, nonetheless, reports to the Deputy Attorney general Rod Rosenstein in this instance because of Jeff Sessions recusal. There are some instances im not going to predict how Justin Kavanaugh would come out on that. Neil nor should you. I was just trying to see if you were going to slip up. I frequently do. Neil no, i try, but you dont give. One thing i want a handle on, in this Ongoing Investigation, not to get in the weeds with this with you nor do i intend to. Do you know whether the judge shares reservations about prosecutorial zeal in general, that they can go far from their original mission, for example, as did yours. Its not your fault, but the investigation that ensued led into other areas, other avenues. There was the linda tripp thing that led to your discovery of the relationship with the intern. That these things by their natural course, go on add infini infinitem. Do you know what he thinks about . I know from his impressive body of work as a judge, neil, and i think that everybody is sitting back and saying this is an impressive record, is he believes in the principle of accountability. We see that in his work with the administrative agencies. He does believe that under your constitutional system, under our rule of law, every person needs to be accountable and so i would say, yes, that would include prosecutors as well. Where is the accountability here . I think he would ask that question and would then probe fairmindedly and open mindedly into the specifics. He doesnt say this is how i feel as a matter of philosophy. And elaine kagan, would recruit him to teach at harvard law school. And accountable is one of those principles. Every person who holds power should be accountable. Neil do you ever look back on the whole bill clinton experience, the investigation and et cetera, with any regrets . That what started as, you know, one focus in the investigation, veered of course . Because thats the route that the present investigation has. Right, right, well, the biggest reservation or concern that i have then and now is, i wanted to go to Pepperdine Law School and then this n new dimension which becomes the lewinsky phase comes to us and we go to attorney general janet reno. I wish she would have said im going to amary rowe or john doe to take on this investigation. But we were vindicated in court time after time after time. There were 14 criminal convictions, there wasnt just a failed land deal in arkansas where people lost money, there was a lot of fraud, violations of federal law. 14 criminal convictions including the sitting governor of the state of arkansas. Neil finally, do you think the kavanaugh upcoming process means that the president should go slow on anything they have to say about this Ongoing Investigation because at the very least it would damage mr. Kavanaugh . No, those judgments have to be made. Its a separate track. Bret kavanaugh has not been involved in any dimension of this. Here is Rudy Guiliani coming on stage and making a lot of statements and doing a very aggressive job. Brett is in the monastery as we were told as new judges. Thats what i was told as new judges, youve been through the monastery, he will steel himself, he, judge kavanaugh, from that. Well see what the senators raise. They have the freedom to raise anything that they want to and i think well probably end up having a lot of discussion about this, but what i think the american people, and hopefully, a heavy majority of the senators, will be assured of, here is great, able, honorable person who meets all of the traditional criteria of a Supreme Court justice and meets them with flying colors. But he also stands in this great tradition of great judges, great justices from holmes on who will take these cases one at a time and he will do a great job and an honorable job as a justice. Neil finally, you mentioneded monastery. His catholocism has raised hackles that he might be biased by affiliations to the church. Hes a devout catholic. Maybe its the old john kennedy thing again. I dont know what it is, but its a disproportionate amount of attention to his catholocism. What do you think about it . I think its a secularization of the american society. Happily the text of the constitution addresses it and rebuts issues to faith. It says specifically no religious test shall be imposed for any office under the United States. So to even ask about someones faith is, to me, an anti they have to they have the right to do it, but its an action against the constitution. Its a Pluralistic Society and lets respect the dignity of all persons in all favorites. Neil thank you for being here on a saturday. We appreciate it. My pleasure. Thank you, neil. Neil all right. And ken and i were chatting, a lot of emails, texts and et cetera and our panel is going to be talking about what we just talked about right after this. All right. Reaction to ken starr, his association with Brett Kavanaugh, the president s Supreme Court pick, and things that can veer out of control and those on the left and right say thats the natural order of thing whether we like it or not. Maybe its the process. Ive got lee carter, fox news contractor, kat. What do you think of what ken starr is saying. Yeah, my own investigation did veer affair of the clintons and ultimately as we know and two other matters, but thats the way the stuff goes. It is the way that this stuff goes. I think its okay to be upset about it. I think that this one has gotten a little more intense than other ones have in the past, but i also think its an important investigation. I think that its important, we have to remember that what it really is supposed to be about is finding out about how the russians attempted to interfere or did interfere in our elections and how to top it from happening in the future. The real important issue here is protecting the integrity of our election system and everyone in america should stand behind that goal. Neil the association with ken starr could be either pro or con for Brett Kavanaugh. Is this going to add to the issues that theyre going to get into in that confirmation process, right . Look, i think that the democrats are going to have an issue with Brett Kavanaugh regardless of anything because theyre in fear of roe v. Wade being turned over and i think what people have to keep in mind when were having a discussion about abortion, in order for the Supreme Court to overturn anything, they first have to have a case. Its not going to be kavanaugh going into his office and writing void on top of roe v. Wade. He actually, first of all, the Supreme Court, like i said, they have to have a case. Are they even going to take that case or send it back to the state and i think that what a lot of democrats fail to realize is if roe v. Wade is overturned, its going to be the state lawmakers that are determining the reproductive rights of women. Neil so, switch to the catholocism argument that ken starr raised i raised, i should say. He said our forefathers shouldnt make it an issue, didnt with john kennedy and it is what it is. I think that ken starr made a good point. Were in a country of religious freedom. We are supposed to accept all sorts of backgrounds, everyones. Thats what our country was founded on for crying out loud. To significant that its an issue that he was a catholic, its preposterous. If he was a muslim, the left would be outraged. Neil and one thing noted, a judge, a former professor, that she was considered so right to life that it actually hurt her . Look, i think you can make the case that someone can put their personal beliefs aside and say my job here is to look at the constitution. My job isnt necessarily to be guided by my faith. Now, there are some people who say that my faith is what guides my work and so you have to look at that. If you think its going to influence, you know, bleed over. But the job of the justice, the Supreme Court justice is to follow the letter of the constitution. And i think that kavanaugh has proven that he can do that and i think if you look back and you see some of the things that he some of the rulings that hes had. If you look at what he made a decision that actually allowed somebody to have an abortion. So you can see that he is clearly able to separate both his faith from what the letter of the law says and so, i think the fact that people are outraged or this hysteria that everything is going to go back to 1850 i think is what Hillary Clinton said, is i think its extremist. Now that said, that kind of rhetoric does energize people, it adds fuel to the debate. So i think that kind of stuff has to happen. I think that people needs to pay attention. If thats what it takes for people to get out there and say this is what i feel and this is important to me, im all for it. We dont have half of americans voting in the midterms. Lets have them engage in the issues, and not just the surface and say hes down to the day we had judges approved 90plus to whatever, those days are gone. If they guy gets through, its by the skin of his teeth. Everything is hyper partisan. Its not that theyre trying to Work Together to achieve the common good of the country. Both side are trying to further what they want to do and take down the other side. Its so political and it doesnt make room for a lot of americans, particularly a lot of young people, a lot of us are independents, and dont have particular allegiance to one party or the other and thats why the reason why people arent going out and voting because they dont see themselves represented. I think that thats frustrating and i can definitely agree with kat on that. Theres no middle ground. Youre left or right and nowhere in the middle. I think when were talking about kavanaugh, honestly, people have to educate themselves on the process and on the history of the Supreme Court. Neil ladies, thank you very, very much. I know we switched gear, but i thought there were a lot of interesting comments in the ken starr interview that warranted this. So my interview now with parkland shooting victim meadow pollocks dad, andrew pollock on what he thought. Im on a mission to make the school safer and im seeing it come full circle. The fruit of my work is im seeing whats happening and the kids in florida are going to be a lot safer come the start of the school year and in other parts of the country. Neil now, this Guardian Program, i guess, that started in volusia county, youve had a lot of interest in that, i think, for some 30 positions, originally over 180 applicants. How is this working . What does it involve . Well, it started with the bill that we got passed, that senate bill 7026. That was a bill that we got passed right after the murder. It was probably its historic because we got a bill passed in a short amount of time and in that bill, part of the bill was named after the hero coach that went into douglas. His name was aaron feis. So we named it that and ive been a part of Program Since the beginning and now were putting men to work, veterans and retired Law Enforcement in polk county. This is the First Academy in the state of florida to go through this Guardian Program and im very proud to be a part of this and my hats off to sheriff grady to getting it done and to the polk county deputies. Neil im thinking of the law for the person who was armed and didnt go into the school, and since he said chaos in communication rather than afraid to going in and said i never would have sat there and let my kids get slaughtered. That was that parkland officer Scott Peterson who was forced to retire and i know you have a lawsuit going against him for the time being. What do you think of all that. Let me tell you something different, the difference between Broward County and polk county. I was here the first day the guardians came to work in the academy and we all addressed them. And im never going to forget what sheriff grady told these new cadets. He told them and addressed them in the classroom. He said when youre at work and you see someone coming into that school and theyre ready to hurt or kill one of our kids or teachers, i want you to shoot them graveyard dead. If you cant shoot them graveyard dead then we dont want you in this program and the door is over there and this job is not for you, so when you heard what Scott Peterson said, do you not believe it, dont accept it . The fact that he said im sorry, this was never meant to be an about being afraid to go in, he thought the shots were from outside, et cetera. What do you think . Neil, thats all him just trying to cover up. He knew where to go. The guy drove him on the golf cart right to the building. He actually heard the shots when he was at the door that killed aaron feis and then he retreated back behind the wall and thats him trying to cover up. Neil it doesnt do us a lot of good or bring your beautiful daughter back. No,s he just a coward. Neil and shed be getting ready for college. What does go through your mind when you go through the Guardian Program to prevent what happened to your daughter and others, how little it would have taken to avoid it . Well, neil, this Program Means so much to me because in polk county and other counties now, other counties are following polk county with this same program. So it means a lot to me because all these kids are going to be safer at the start of the school year and were getting the proper training in polk county. They get its 140 hours of training, so, its not like theyre just going to go for the weekend and then theyre going to get a certificate. This is over a month long class. Already from june, 35 have dropped out, so its not an easy class to pass. Neil no, i imagine. Do you ever worry though that you get if you go the or way, youve got a trigger happy citizen whos been, you know, deputized, so to speak and create havoc. They go through so much training, put them through a simulator, they put them in a room called the match house, where theyre actually shot back at and its no joke. They really take their training serious. I think if someone is here to do a job theyre going to do it and theyre going to wash out if theyre not prepared by the end of the course. Neil where is the money coming from for this . Andrew, was in from what the governor initiated . Is this something separate or what . Yeah, this is the training is paid for by that bill 7026. So, it was its Pretty Amazing because i live in broward, three hours south of polk county. Neil sure. And i came up here to work with a sheriff and a superintendent of schools that put their kids first and their citizens and their teachers. In broward, it took them theyre three months behind now trying to catch up and theyre not going to be ready come the start of the school year, but up here in polk county, its a deterrent. Neil im sorry i jumped on you there. A part of this new procedure. No problem. Neil is that there are going to be more Law Enforcement officials available, sheriffs, deputies, whatever you want to say, and obviously this is in addition to that, for every one thousand in the school. If we had this in place at the time of the shooting in parkland, do you think it would have been prevented . It would have made a difference because peterson was there by himself and anybody, you cant swear on any one person that theyre going to stand up when that happens. So, if you would have had in that school they would have had three. So, the chances of all three being cowards would be very slim, so i think it definitely would have made a difference for that third floor or the first floor, or even to have a guardian trained at the gate. We had a monitor in Broward County that just watched the shooter walk in off the street with a rifle bag and didnt even attempt to stop him. So one of these guardians are at that gate, its not going to end good for the guy walking in with the gun bag. Neil andrew, how are your sons doing . My sons are good. Were actually up in polk county. Im with my daughters boyfriend brandon and were going to go on our way to d. C. And were going to do some camping.
