Even more so now that theres this internal memo from the fbi that warns not only bill, just of protests across the country but armed protests across the country. All 50 state capitols. Capitol buildings like olympia washington. Authorities are showing up to say that things are under control. The events leading up to the inauguration is a National Special security event putting all hands hahn deck. Now, today, not next week as is traditional before an inauguration. It would be an incredible unlikelihood to see what is described in those threats that take place. That doesnt mean there wont be issues at some state capitols. While the secret service is leaving the security planning for the inauguration, the fbi doing the same for nationwide protests. I speak with a veteran of the bureau today about fbi planning. Listen here. The biggest thing is command and control. Setting up an operation center, deciding who will be in charge and have the responsibility to make the call on certain decisions. What are the rules of engagement. And the big Washington Post story that said the anybody in norfolk warned officials in washington d. C. Of online threads that talked about war, talked about dangerous, dangerous activities going on. Last week the Fbi Field Office said they didnt have any advanced knowledge of this information. That is just the way they operate under chris wray. They wont pass information to the public. They pass information to Law Enforcement agencies and the people that need it. Under chris wray,you dont see a lot of wreak leakage. This information is for Law Enforcement. Bill okay. Capitol hill police were briefed a week ago. Why is there a lack of information . With regard to the online posts, at what point does it trigger Law Enforcement to act or to prepare for the posting that theyre reporting . Bill, for a time before 911, the fbi couldnt go on social media and the internet and surf around and look for thread information. That changed after 911. They have a new category called threat assessment, which gives them the ability to go on the internet and go into social media sites and mine out threatrelated information. Also depending on reports and tips from the general public and the carriers. So i would venture to say that a huge portion of their intelligence and threat information comes digitally off of social media and other modes of communication like that. The old days, it would have been human sources and technical coverage, frankly, and investigations. Thats not so much the case now. Bill leave the fbi to the side here and talk about the Police Department on capitol hill. You must be asking yourself the same questions we were. Why not have a stronger presence there last week . I dont think they took it seriously. Im baffled the sergeant of arms didnt take it seriously. Over the last 18 months, crowd control in general and the tactics that have been proven in the past and the equipment and training they used in the past has not come in to play. Police have been a bit handsoff and i saw that reflected last wednesday when they didnt have enough people. The planning was poor. They didnt plan for bad things to happen, which they should. They should plan for everything to go wrong. They didnt have the right training and the right tactics. They got caught flatfooted. Thats why youre not hearing from them. Theyre looking at that and doing soulsearching and trying to get things straight. They dont want to implicate themselves and talk about their own failures. Bill at some point we need an explanation. Yeah, i think is i worked at the white house, worked on the hill, chris worked on the hill. Theres protests in these areas a lot and a lot of bad people try to descend on the capitol. Maybe not as horrific as the other day. Seems like the safeguards that would normally be there werent there. I dont know why because its so clear that the passions in this country on both sides are on full tilt. I think weve all been on social media watching videos that are troubling, including videos of capitol hill cops that are like one cop trying to hold back everybody. I spent a lot of time Walking Around the corners of the hill. Theres a lot of capitol hill cops at work at any one time. So im not blaming. I dont have enough information but id like to learn more. Nothing that excuses the crimes that were committed but there was bill maybe well get answers in a moment. Chris, what is you take . Im dumbfounded that we havent had a briefing from anyone in Law Enforcement to tell us what went wrong, why they didnt listen to the warnings. Theyre afraid of the questions that they might get. They really took the black lives matter seriously. They didnt take this protest as seriously and theyll have to answer for that and theyll get the answers today. A lot of them will be fired. A lot of changes will be made. Clearly theyll be prepared for the inauguration and the events and the weeks to come. It was clearly a breakdown. I for one, you know, watched that in horror knowing that my former boss and my friends that still work on the hill were in grave danger that day as was our entire republic because of a failure of Law Enforcement to take this seriously. Including the president and enablers that allow these to ferment. Bill it seems the summer was in a different posture there it was portland or washington d. C. Or new york city on minneapolis. That is one point. The other thing is that the capitol hill police, their primary duty is to make sure that the public doesnt cause problems for lawmakers. That is their job. Make sure nothing gets in or out that is nefarious. Theres not been a tour in the capitol since going back to late march. Wondering what the posture was for the police, how many people were staying home, had a vacation. Just go ahead and give me the view there. Were seeing videosanecdotal. It seemed like there was an understaffing problem. I think, you know i learned this 911. Everyone that works in the bubble at the white house, you assume that secret service is there to take care of everyone. You realize when a moment like there strikes, theyre there to take care of the president and the Vice President. The capitol hill cops and the Vice President being there maybe security personnel were worried about the line of succession and the people in the government, not so much the building and the grounds. Somehow something was missed. As far as the black lives matter comparison is a concern. But its not a perfect example. I would say this. What i have seen on the black lives matter, a lot of people were scared to call out the violence. There was scores of dead cops by the time we got done with the violent protests. Not everybody at the rallies were bad people and not everybody at the protests were bad people. There was violence going on on people that meant to foment violence. Politicians didnt call it out because it involves race. But my view the politicians that are honest and the politicians that say left wing violence is not acceptable. Violence from the right is not acceptable. We cant do our politics this way. Bill gentlemen, hang on a second. I have to i apologize. I got a twominute warning. I want to squeeze in dan kilde. This was a failure of our security apparatus. Theres no reason that we should have been placed at such risk. That does not excuse anybody that was involved in organizing or whipping this up, doesnt excuse the president s actions. But this is a serious question as to how we could be so left unguarded and the consequences obviously. Now, for me personally, i was stuck in the gallery in a dangerous situation for our country. The consequences are enormous. Bill what about the point we just discussed about no tours. Did that matter . Sorry. No tours in the capitol the past ten months. Did that matter . Did that change the posture of police there . I dont think it changed much in terms of the line officers. I talk to these folks every day. They protect us. We saw many of them act valiantly. This was a leadership failure. The failure to observe, prepare and plan. If there were warnings, the failure to translate those warnings into a sturdier defense is just beyond my comprehension. Its also frustrating that were waiting until just now before theres any opportunity to receive information let alone ask tough questions, which i know we all want to do. A quick update on the fbis activities since the violence and destruction at the capitol last week. The fbi is familiar with large scale complex and fastmoving investigations. Were up to the challenge. As director wray says, the fbi does not do easy. To be clear, the brutality the American People watched, with shock and disbelief on the 6th would not be tolerated by the fbi. The men and women of the fbi will leave no stone unturned in this investigation. Since these events, the fbi has worked hand and hand with the United StatesAttorneys Office and Law Enforcement partners here in d. C. And across the country to arrest and charge multiple individuals who took part in the destruction. In six days we have opened over 160 case files and thats just the tip of the iceberg. The significance of this investigation is not lost on us. This is a 24 7 full bore extensive operation into what happened that day. We cannot do our job without the help of the American People. Since our call, video and pictures, weve received more than 100,000 pieces of digital media, which is absolutely fantastic. We are scouring every one for intelligence leads. We continue to ask for more. If you have information, contact 1800fbi or send photos and videos to fbi. Gov uscapitol. Agents and our partners are on the streets investigating leads here in d. C. But across the country and the 56 field offices. So even like i said before, so even if you left d. C. , agents from our local field offices will be knocking on your door. This is your opportunity to come forward as several individuals were involved in wednesdays riots have done to volunteer about their participation. In the weeks leading up to january 6 rally, the fbi worked internally with every Fbi Field Office to ensure that were looking that we were looking for any intelligence that may have developed over potential violence during the rally on january 6. We developed some intelligence that a number of individuals were planning to travel to the d. C. Area with intentions to cause violence. We immediately shared that information and action was taken as demonstrated by the arrests the night before the rally. Other individuals were identified in other parts of the country in their travel subsequently disrupted. The fbi receives enormous amounts of information and intelligence. Our job is to determine the credibility and viability of it. Under the laws and policies that govern fbi investigation. We have to separate the aspirational from the intentional and saying which individuals saying despicable things on the internet are practicing keyboard bravado or have intent to do harm. We work to identify them and prevent them from doing so. As offensive as a statement can be, the fbi cannot open an investigation without a threat of violence or alleged criminal activity. However, when that language does turn to a call of violence, the fbi is able to undertake ininvestigative action. In this case, we had no indication information was linked to any specific person, this is a matter of a online discussion. This information was immediately disseminated through a product and briefed through our postoper raises to all levels of Law Enforcement. Part and parcel is the fact that we continue to gather intelligence that will aid in our ability to disrupt possible future violent activity. Suffice it to say, were leveraging our relationships with federal, state, local Law Enforcement partners, using our tools at our disposal to find and bring everyone involved in last weeks criminal activity to justice. Im going to turn it over to acting u. S. Attorney, michael sherman. All right. Thank you, steve. I think i mentioned this before a few days ago that just to begin, i think the scope and scale of this investigation in these cases are really unprecedented not only in fbi history but probably doj history in which essentially the Capitol Grounds and inside are a crime scene. And scale in which we have literally thousands of witnesses and a scenario in which were going to have, i believe, hundreds of criminal cases both filed with our local courts and through the federal court systems. So just to frame things, the enormity of this investigation will take work. Its not going to be solved overnight or in the coming weeks or coming months. This is a longterm investigation. Rest assured the bureau, the department of justice, all of the u. S. Attorneys across the United States assists in the investigations, everyone is in it for the long haul. So that being said, lets turn to the numbers that steve referenced. The numbers are going to geometrically increase. So as we sit here now, literally days after this event happened, we have already opened 170 more than 170 subject files meaning these individuals have been identified as potential persons that committed crimes on the Capitol Grounds, inside and outside. So of those 170 cases that have already been opened and i anticipate that that will grow to the hundreds in the next coming weeks, we charged over 70 cases. Again, that number i suspect will grow into the hundreds. So what are the types of cases that we charged . Theres misconceptions. Given the enormity of the actors inside and outside the capitol, the range of criminal conduct is i think, again, unmatched in any type of scenario that we see with the fbi or the dodge. Were looking at everything from simple trespass to theft of mail to theft of digital devices within inside the capitol to assault on local officers, federal officers both outside and inside the capitol to the theft of potential National Security information or National Defense information to felony murder and even civil rights Excessive Force investigations. So just the gamut of cases and criminal conduct of what were looking at is mindblowing. That has really put an enormous amount of work on the plate of the fbi and throughout the entire United States. So lets look at those initial cases. Again, i want to clarify some misconceptions. When criminal conduct occurs, we try to obviously charge people as soon as possible. So the way looking just at the federal system, well try to do that via criminal complaint. So when these actors left the capitol, these individuals, these defendants, obviously the marching orders by federal Law Enforcement is find and charge them as fast as possible. So the prosecutors from the d. C. U. S. Attorneys office, we lookle for the most simple change we could file as quick as possible. A lot of them were misdemeanors. Trespass cases. However, those cases were open on those initial charges. We also have several firearms charges and felony charges that were open with assault and battery. Illegal felonious possessions of weapons. This is only the beginning. So after these criminal charges are filed via criminal complaints, that allows us and Law Enforcement across the United States to arrest people from dallas, to arkansas, nashville, cleveland, to jacksonville. That is what has happened the past several days. Its quite incredible. Now after those charges are filed, then we have the ability to indict these individuals on more significant charges. That is exactly what has happened. For example, yesterday again, only days after this event happened, we had the grand jury in the district of columbia up. It was booked throughout the entire day and for several hour upon hour, prosecutors in our office presented felony cases, significant felony cases related to civil disorder, related to the possession of destructive devices, related to the possession of semiautomatic weapons that are illegal in the direct. This is all the beginning. This isnt the end. So what about downstream here . In terms of what were looking at, the initial charges everyone is familiar. The zip tie guys, the brocks that were arrested on the house floor with the zip ties, rifling through the house floor. People are familiar with online, they see the barnetts and johnsons that were rifling through pelosis office and stealing items, stealing mail and sometimes personal momentos. Those are the cases the public is familiar with. Theyre familiar with those cases because of social media. What the public isnt familiar with is that the fbi working with the u. S. Attorneys offices across the country and the crux of those being in d. C. , were looking at significant felony cases tied to sedition andconspiracy. Just our office a organized a strike force of very senior National Security prosecutors and public corruption prosecutors. Their only marching orders are to build seditious related to the most heinous acts that occurred in the capitol. They have felonies with prison terms up to 20 years. In addition to that, were looking and taking a priority with cases in which weapons were involved and cases in which destructive devices were involved. As people know through news reports, there were pipe bombs outside the capitol, the atf is working on that to find those individual or individuals that planted thoseices so in addition to the rope cases that were looking at, well focus on the most significant charges. If it was just a trespass or a pipe bomb, youll be charged and found. In addition, we focused on an emphasis on assault and batteries on police officers, both federal officers and local and p. D. Officers that were assaulted. As the days go on, people will recognize that in some instances npd and Capitol Police were in openhanded combat with some of these persons in the capitol where tear gas was used on the Capitol Police and federal officers and also used against some of these rioters. The picture will build. A lot of misconceptions about what happened and it will come in to laser focus the next week and days. People will be shocked with the egregious contact that happened in the capitol. The third area of emphasis that were also focusing on, we set up a strike force to focus on assaults on the media. Some people are not familiar that some of those rioters targeted members of the media. We a signed specific prosecutors to focus on those cases as well. Im naming these different Strike Forces to just emphasize, regardless of who the victim was or who the perpetrator was, were treating all the cases equally. Thanks very much. Can you clarify for us what intelligence did the fbi gather before the assault on the capitol about the potential for violence and how did it and did it share it to the Capitol Police . We received a lot of intelligence information throughout all different means, be it social media or through chs sources and then we have a sharing mechanism with jtts. We have joint Terrorism Task forces. In d. C. , we have robust jttf. In that, we have Capitol Police, park police, npd and the federal enforcement officers. We share through the jttf model and the command post structure and other means of they have access to our information readily available because they have access to our systems. So all of that information was shared with our partners and then we went from there. The next question is from evan from cnn. Please go ahead. Wondering if you could tell us perhaps if you found any indication so far to indicate a level of planning and coordination for these people to go into the capitol and carry out this attack rather than just a spontaneous mob that got out of control. Secondly, if you could, senator schumer has talked about the possibility that some people might be put on the no fly list. Of these 170 subject case files that you opened, can you tell us whether you added any of these people to a nofly list as a result of what happened . Were looking at all different avenues here. My office and across the country theyre scrubbing video, talking to witnesses, talking to individuals that we arrest and were gathering that picture, that intelligence, if you will, to understand what happened on the 6th, that day in the capitol, outside the capitol. We talk to Law Enforcement partners. Its not just the fbi. Its all Law Enforcement working in conjunction with mike sherwins office and the local office here as well. So sharing that intelligence amongst each other, putting into the intelligence a cycle that the fbi has to try to ascertain the true picture of what happens that day. As for the no fly list, we look at all tools and techniques that we can use within the fbi. Thats something that were actively looking at. The next Catherine Herridge from cbs news. Thanks for holding in event, the two pipe bombs, does this cross the threshold to domestic terrorism because theyre political targets and you think this was designed to pull other First Responders away or an effort to name lawmakers as they evacuated . So ill try to address that question for you the best i can. So yes, the two pipe bombs that were found were found outside the rnc and the dnc offices near the Capitol Grounds. Look, to begin, they were real devices. They had explosive igniters. They had timers. We dont know obviously why they didnt go off. They were disabled and destroyed by Capitol Police and the atf. That is all obviously being vetted and investigated. What was the purpose for them to be planted. Was it a diversion type of tactic being used by the rioters or some other type of the purpose. Thats what the atf and fbi are looking at as we speak right now. And looking for the persons that planted those devices. In terms of the conduct replated to planting the pipe bombs, the mentioned of domestic terrorism. I dont like this tyranny of label saying this act of domestic terrorism. We have plenty of federal resources at our disposal, plenty of federal charges to address this conduct from full any murder related to the use of destructive devices under the federal code that has significant penalties. As mentioned with this strike force established to focus on sedition charges, were looking and treating this like a Significant InternationalCounter Terrorism operation. Were looking at money, travel records, looking at disposition, movement, communication records. So no resource related to the fbi or the u. S. Attorneys office will be unchecked in terms of trying to determine exactly if there was a command and control, how it operated and how it executed these activities. So i want to talk about the prior question first just because i want to emphasize that we have a 50,000 reward out for the information and any information and identification of the individual or individuals that left the pipe bombs. I want to make that clear. Were looking at all angles in that. Every tool, every rock is being unturned because we have to bring those people to justice. So can you repeat the question, please . By looking at the possibility, did some of these suspects that breac were lookin possibility of taking members of congress or others hostage . Like i answered the last couple questions before, were looking at all angles here. Were interviewing everyone, interviewing witnesses and subjects as they get arrested around the country and within the district as well to ascertain the true purpose of some of these individuals in the capitol that day. Number up with, senator cassidy has tweeted on a photo that he said was an individual that authorities wanted to get in contact with in connection possibly with the killing of Capitol Police officer sicknick. Can you give us any type of update on that situation . Number 2, i know you talked about intelligence leading up to the day before or leading up to the day of the riots. There are some specific reports out that theres at least one report out of fbi norfolk that painted a pretty grim picture. Can you confirm that and were authorities on the hill really ready for what was coming at them . So the investigation to officer sicknicks passing is an ongoing investigation. Were looking at everything that we possibly can. It cuts to the core that one of our Law Enforcement brethren passed away. So its an ongoing investigation. A lot of toolses that were conducting. A whole host of video out there. Were reviewing that information. As for the information that is being presented out there right now about norfolk, that was a thread on a message board that was not attributable being attributing to an individual person. Like i said, we deal in specifics and facts. That information, when my office and the Washington Field office received that information, we briefed that within 40 minutes to Law Enforcement partners that we had at our command post, got put in the jttf system and shared with Law Enforcement through that process that we had. Want to get your initial reaction to all the information that they just delivered there, trey. Find them all, charge them all. Investigations are hard. You have are to one up them in court. Being in politics is easy. You have to allege it. Being in court is hard. You have to prove it. Let me finish by saying this. The Republican Party has always positioned itself as the party of law and order. Great. If you have information about any up with that is part of the siege of the capitol, you have an obligation to share it or else stop calling yourself part of the law and order party. If you have information, share it with the cops. Bill back to the online threats. They said toward the beginning, were not sure if it was key bravado or intent to harm. This is the question. How do investigators determine that . How tricky could that be . Should Capitol Police have been not just notified but make sure that they received the message on the other end . In other words, you cant just send a text or email. You have to make sure it was received and read. Yeah, the bureau has had an issue with this in the past. Remember the School Shooting in responsibility for passing the information on. It was the least welle a big group of people coming to washington last wednesday and they were being fed misinformation by members of the house, the senate and others and the election being stolen. So its predictable and a fall and probable consequence of all of that that it was going to be a problem on capitol hill. When i was there, the cops were great, bill. They were everywhere. You couldnt go anywhere without bumping in to Capitol Police or d. C. Police. So how in the world they were shocked by a big crowd coming to the capitol . Im going to need to hear them explain that. Bill heres the theory now. Ill share this with you and you can react. Capitol police primarily, you know, they make sure people go in and out and theres nothing on them and make sure everything is safe and clean. Basically they make sure the visiting public is safe from the lawmakers and vice versa. Is it possible that with the closure of public tours going back to late martha they were caught flatfooted . They had not been operating the way they were for the past ten months. Its possible. You have threats all the time on capitol hill. You have high profile folks on both sides. So i mean, im going to be schrocked if cops let their guard down. Keep in mind, even when things were pre pandemic, sometimes congress was in sometimes, sometimes not. It dedetect any decrease in security profile when members werent there. So i need to know how far out does the jurisdiction extend and when does the metro d. C. Police extend. That doesnt have anything to do with federal Law Enforcement. They can also be there. Got forbid the president or the mayor call additional help. You need and overwhelming display of force when you suspect something bad is going to happen. Bill so you say theres no excuse. With tens of thousands of people, theres no excuse. What did you take away from the briefing and what is next . Yeah, that was one of the most detailed and candid briefings ive seen from the fbi in a long time about whatter that doing right now. Theyre looking for command and control and broad conspiracy, who the leaders were, what type of planning took place. They set up a task force with a goal toward forming up conspiracy to commit sedition, which is very unusual. You dont see that charge very often. That goes back to world war ii. So that is unusual. You know, theyre looking at conspiratorial activity, violence, weapons of mass destruction, all of that. Looks like the fbi and other Law Enforcement partners have all hands on deck. They have a lot to do. Bill i agree with that. Youre right. That is a clear takeaway from that, a lot of work to do as a result of this. 100,000 pieces of digital media. How does that change their job . Has it made it easier or do you have more to fish through . Lex. Digital evidence is not every agent on the street can go through, analyze that volume of data. It has to be done systematically by machines and use key word searches. Video is hard to match up. People think facial recognition is ready for prime time. Its not. Its problematic. Its cyber gum shoe work that not every agent can do. Theres bottle necks there. Theyre breaking them in big cases. They can break through the bottle necks but it will take away from other cases that are going on. Seems to me that the fbi is focused on this as the number 1 priority of the fbi right now.
