And david perdue in a state where they have not they will flip the senate blue and gain control of congress. A republican victory by contrast will impede president elect joe bidens ability to make headway on his agenda. All this Political Drama reaching a climax as a joint session of congress meets later today for the final count of Electoral College votes, the last step in officially confirming joe biden as an expresident of the United States. But Many Republican lawmakers are planning to block his certification while outside the capital Trump Supporters rally in protest, calling for an urgent request of the national guard, the outcome remains in limbo at this hour but its clear for now that the battle for power will continue far beyond the peach state in the coming days. Lets get right to it for the latest updates in the ground in atlanta, we turned out fox news correspondent Charles Watson. Charles . Good morning, john. In atlanta where the absentee ballots are being tabulated for Fulton County. You can see behind me election workers are still here and they continue counting ballots, the election counter tells fox news that all 100 plus thousand absentee ballots received will be counted tonight. We are told that the number was originally expected to be 108,000 ballots, but in just the last hour or two, they received an additional 4,000 ballots. Thats what you see the election workers working on right now. This operation could extend until at least 2 00 in the morning. There were some complaints from poll watchers in regards of not being able to see the counting of the absentee ballots. That issue was taken up in an emergency order, judge ruled that observers needed to be allowed within 10 feet of the counting of all times so they were rearranged as the counting was happening as they were pushed closer to those election workers as they could monitor the counting ring and see what was going on. There were also issues over blue folders that were being raised up at some tables where ballots were coming in, a judge ruled that the folders had to be removed as well be other places around the state, we are told that counting has just about stopped for the evening and will resume at some point later today. In the case of chapman county, election workers they are counting about everything they got with the exception of absentee ballots that came in today by mail. Just a few moments ago, we heard from senator Kelly Loeffler who said this race is not over. Take a look at what she had to say. You guys are awesome. Thank you so much. It took everything the person in this room to get where we are right now. I thank you from the bottom of my heart. We have some work to do here. This is a game of inches. We are going to win this election. We also heard from her challenger Rafael Warnock a few moments ago who said that this race isnt over. They are going to continue fighting and obviously the counting operation will no doubt continue until wednesday. But the secretary of state said we should be able to figure out where we are at in this race at some point possibly by noon wednesday. John . So no full count until later today. That being wednesday, charles . Exactly. No full count. There are still some outstanding votes in several counties, many of them democratic strongholds. Election workers have packed it up. They will continue counting later today probably until the morning and we should know about where we are at later today. Charles watson reporting live from atlanta. Thank you. Lawmakers are anxiously awaiting the results. Party leaders going to see who will control the senate when joe biden is sworn in as president s just a couple of weeks from now. All of this as dozens of republicans plan formally reject the provincial Election Results at todays joint session of congress. Lucas tomlinson with the reaction tonight. What is the reaction right now . If you are republican, the mood is gloomy, the prospect of pushing forward president elect joe bidens agenda. The certification begins in 12 hours at 1 00 p. M. Eastern. Electoral votes will be brought in mahogany boxes. The Vice President will read aloud the boats from each state in a medical order but the process is not going to be expected to run smoothly. They say they will challenge joe bidens victory. One of them spoke to Shannon Bream tonight. The 12 of us who have come together to call for a commission, that would be a ten day audit of what has transpired in this election. Look at these disputed states and look at the allegations that are there on election fraud, voter fraud. Earlier today the president tweeted the Vice President has the power to reject fraudulent electors. Tonight, the New York Times is reporting that Vice President pence told the president that he did not have the power to block congressional certification. The president released a statement saying that the New York Times report regarding comments that Vice President pence made to me today was fake news. He never said that for the Vice President and i are in total agreement of the Vice President has the power to act. But not all republicans agreed that the president should be challenging results of the election. I think hes on very o on the sound constitutional guards down mike rounds. I fear a day where the democrats control the congress and begin throwing out republican electoral wars and points to this president that we will be establishing tomorrow as their justification. One of the president s biggest senators on capitol hill agrees, they trust the election to the people acting through the Electoral College, not congress. And the trust of any adjudication in courts, not congress. Congress power is limited to counting electoral votes submitted by the states. Brad, you had an interesting quote. You said that if you are joe biden, you would be praying for a republican electoral victory in georgia. Why . I think it keeps his crazies at bay. Look, joe is a creature of the senate. He knows his senators quite well, has a great relationship with Mitch Mcconnell. Very professional. I think there is Nothing Better than joe biden would like is to be a dealer and to negotiate deals with the republican rather than to cave to the most progressive of democrats both in the house and in the senate. So i think joe biden is a oneterm president at best. Hes looking for a legacy as president. What better way to get things done then kennedy done and they can only be done with joe biden then with a Republican Senate. Talk about relationships, in these waning days of the Trump Administration hes getting brickbats from the white house. How would you like to be Mitch Mcconnell right now . I think Mitch Mcconnell is probably just as uncomfortable as Vice President mike pence at this moment whom the president has also asked to ignore his constitutional responsibility and to do the dishonorable thing. Look, whats happening tomorrow, or today, is not going to change the outcome of this election. Everyone knows it. But it is going to delay the process and put the put the republicans in an impossible situation. Its so ironic to me that President Trump on his way out is actually sabotaging his own Vice President by asking him to ignore the constitution. And Mitch Mcconnell, both of those who have been faithful lapdogs to mr. Trump. But loyalty in the Trump Administration only seemed to work one way and that is everyone has to be loyal to trump. This is an irresponsible request that donald trump has made. At least a dozen senators have agreed to step up and ignore the constitution, ignore the absence of evidence of voter fraud. But i think in the end, we all know how this plays out. Ultimately the senators of congress, they are going to have to do their duty and recognize political reality. Joe biden has won. Donald trump eventually will have to accept this too. I want to read part of that statement from President Trump. Lucas tomlinson read part of it earlier in his report and i wanted to add this, the last paragraph in that statement from the president reads, our Vice President has several options under the u. S. Constitution. He can decertify the results or send them back to the states for change and certification. He can also decertify the illegal and corrupt results and send them to the house of representatives for the one vote, one state tabulation. Sean, what do you think about the president s reasoning there . I dont think thats going to work. What you are going to see is the house and the senate come of the republicans object to certain states, six of them including wisconsin, pennsylvania, michigan, and others, they are going to have a debate. Contrary to what judy just said, its constitutional that the results of the states go to the congress and they actually get a chance to vote on them and debate them. I do not think its unreasonable to say that we want to have a commission which Marsha Blackburn talked about earlier in the program to say that we should have an Electoral Commission to make sure elections are official you have tens of millions of americans who dont believe this election was fair and if you are job you joe biden who wants to bring the nation together, i feel confident that i won, there were no shenanigans. So take a look. Im still going to be the winner and all you republicans should feel good about it. By the way, ive lost races but we lost control of the house when i was in congress. When you lose, you go, thats the way the voters, you know, wanted the congress to be. But here, there is so many anomalies that republicans are concerned about. I think its fair to go back and take a look so can feel good moving forward. So youd be in favor of this Electoral Commission that ted cruz and others are pushing . Absolutely. I have real concerns about what happened here. I think that would be the right approach and if you want to unify america, youve got to feel confident that the Election Results was fair and honest. But you have Joe Biden Taking Office on january 20th. You dont have a lot of time to put together a commission and go around to the various states that are in question here and try to, you know, study what happened, do an autopsy on the vote. Thats very true in washington, sean knows is about procedure and those who make the rules and follow the rules and its one of numbers. Do you have the votes in order to accomplish what youre seeking to do. Look, the procedure we are going to see today is basically ceremonial. Its an act of congress. You can take that further by using the procedure to your benefit to shed light on the irregularities in this state. Thats fine. But to think theres going to be a commission . Its not going to happen. Doesnt mean that you cant seek that that happens. But at the end of the day, joe biden and Kamala Harris are going to be inaugurated on genuine 20th at noon. Thats the way its going to be. But they are making a record and its important that a record be made of these grievances. The question is what will come from this . Is there going to be a National Reform when it comes to the election procedure . Its up to congress. If weve learned and the lesson, that needs to be done as well as Campaign Finance reform. Do you see the appetite in congress . I guess it depends on who wins these two senate seats in georgia but the uc eagerness for some kind of national overhaul of state and local voting systems . I dont see that now but it depends on what president elect and soon to be President Biden will wants to do. This is a mess and the fact that 73 million americans voted for donald trump and feel aggrieved, i understand. There were Many Democrats who felt aggrieved in 2016. But i agree with brad to come of this race is over. There is no evidence of massive voter fraud that could change the outcome. What sean is proposing is just more delay. Well be listening to the elect doors and the vote count thatll ultimately determine the next president. It does seem, congressman, weve lived through another election, we dont have the results yet. But a race and election that was all about President Trump. It certainly seems hes been the outside Political Force at work in these candidates moving forward. Certainly on the republican side. Does it seem like to you . It has. Thats not surprising. No one expected the president would go softly into the night. Hes a bigger than life figure. But as we saw tonight, although it is a razor close, there was a difference between the two republican senators and how they performed. Almost 1 as of now. Obviously cant tell for sure sure, but it look like purdue might pull off this win and keep the republicans with a one seat majority. That remains to be seen. But the one thing it is for sure is this was an election like no other in georgia. More money, more outsiders, more people telling georgians how the vote and perhaps that distorted the race, at least a little. While we are waiting for the final result, can you talk to us about the trump stimulus factor . As you know he made a play earlier this week to get the hill to cut checks for americans for 2,000, which is 1400 more than the 600 at the house and senate agreed to. How do you get a sense that pushed by the president factored in here and not with the candidates but with voters . I think its important any time that an elected official says that he wants something that it appears to be consistent and with strength. The fact that he didnt get it, he didnt get it on a bipartisan basis but did put both of these senators in a pretty tough position where being fiscal conservatives thinking 600 was enough versus 2,000, they really couldnt win. So that was difficult. Lets remember that most of these votes were not voted today, they were already counted in the days and weeks ahead. So a lot has to do with where where the voters and what were they thinking about, a matter of several weeks ago, and the fact is that advertising, much of it disingenuous as it is on both sides influenced a lot of voters. I think the one story here is there are more voters and different voters who were brought in, people who turned of age and so on and unlike most races, both sides were competing for these firsttime voters and that may be the story of why this race could come down to 1,000 votes. I want to make sure i ask you looking ahead to tomorrow or later today, excuse me. We are expecting a number of your colleagues, dozens of them, to object to the certification of the Electoral College votes. I think we are looking at states like pennsylvania and arizona and georgia and a couple of others potentially. The president has been weighing in about the unique role of the Vice President has to play here. Take a listen to President Trump and his rally in the dalton last night. I hope mike pence comes through for us. I have to tell you. Of course if he doesnt come through, i wont like him quite as much. Definitely some goading from the commander in chief there. If you had to place a bet, do you think the Vice President is going to take the bait . Do you think hes going to make a move tomorrow . What is your sense of him . Mike pence and i came into congress 20 years ago. Hes a straight shooter. Hes going to play it by the book. Fa house member and senator jointly object, hes going to announce that. We will go into recess, two hours of debate. There will be votes and ultimately come back together. That may happen not once but several times statebystate. He is going to over that. What quite candidly, joe biden will tell you that he has seen this before just as i have in 2005, Barbara Boxer and congresswoman tubb jones agreed to do just exactly that when it came to the question of ohio. A lot of people are acting like this has never happened before, its happened three times in my 20 years so this will be the fourth time. What is different this time as there will be multiple states and its not just one senator but a dozen senators who believe that this issue should be teed up, talked about, and whether they think its going to change the outcome or not, they could really think it should be something where we fix some of the parts they perceive as broken going forward, particularly the idea that the constitution was ignored and other legislatures decided on changes as to the time, place, manner of the race. Pretty important item when its written to the constitution and then ignored. Congressman, thanks for pulling an all nighter for us. Got about half of that back today. Investors are said to be nervous about the outcome in georgia as well as the coronavirus continuing to rage on. How prevalent is that economic thinking when it comes to capitol hill . I think its real because when you raise taxes, when you have more regulation, you can impose the green new deal, open borders, soft on china, those are all policies that are bad for the American Economy and if its bad for the American Economy its bad for the stock market. I find it interesting though, john, that wall street are the biggest funders of democrats, of the joe biden campaign. I think by the end they are hoping theyll have a divided government and with a divided government, they believe that republicans will stop all the crazy things they actually helped fund with her campaign contributions. I think its a real risk that well have a downturn in the economy because of bad policy moving away from the trump era. How do you see it . We still dont have an answer until we know later in the day with the balance of power is going to be but there is apparently some nervousness on wall street. Of course. Wall street is always nervous about the prospect of higher taxes. But i think when you look at the Biden Economic agenda, john, it is a fairly moderate agenda and certainly his choice of cabinet has been very, very moderate. These people are experienced but they are not radicals. What joe bidens emphasis has been is on restoring the middle class, bringing back those 11 million jobs and have been lost due to the pandemic and all of the revenue that has been lost. Hes going to have a very, very difficult economic road ahead and hes going to need buy in from moderate republicans and from the left of his party. So unless there is a change in the senate, its unlikely that he is going to be able to take any radical steps. I think you can look forward to biden focusing on covid, on the pandemic, and on bringing back the economy and preventing the kind of decline that sean just spoke about. His own Vice PresidentKamala Harris endorse the green new deal. Shes a big advocate of that and for republicans, that is, well, an economy killer. There is no doubt about it and thats why its so important for wall street and america to have restraint on the democratic agenda and that can only happen if we have a majority of republicans controlling the senate. Even by one. Because you control committees, you control agenda, and thats the stopgaps. I think wall street is hoping that republicans keep control of the senate. It puts the brakes on the democrats, theres nothing that they are like better than stalemate. They dont react well to change, especially radical change. Joe biden has told us, hes warned us that he will raise taxes. The spending alone even on a more progressive and radical agenda is unsustainable. Look what we had to spend on covid. All borrowed money. This economy cannot be restored until america gets back to work and its us putting money back in the government instead of spending money we dont have. Joe biden has said that he would like to see a tax increase that is likely not to go over well on wall street given the other economic challenges that the nation faces, especially brought about by the pandemic. Do you see a tax increase in the works here . Is that going to depend on the Georgia Senate results . He has told us thats what he wants for the Economic Future but i think it does depend on the results in georgia, theres not going to be a tax increase. If its democrat senate, democrats will control all numbers are government and i think youll see that happen but its important to note that the middle class has never done better than with donald trump. Rising wages, low unemployment. There were more jobs across the country than we had people to fill those jobs, it was really remarkable. What brad said, its important to note the 28 trillion debt, add trillions more onto it, right now as we speak bitcoin is at 30,400 because people are concerned of all the printing going on and they want a safe haven for their money. The u. S. Currency has not given a safe haven. They see fit coin or crypto giving them security, that speaks volumes to how much debt we have and how much longer thats going to last. Judy, again, we dont know whos going to take control of the senate because of these two races that are still undecided and they are razor close. But if democrats do take control, if they win both of these Georgia Senate seats, there has been talk about joe biden trying to increase the numbers of Supreme Court justices and so forth. How radical would the change be you, do you think, under a Biden Administration if democrats control both houses of congress . I just dont see anything in joe bidens path or even his campaign statements that would suggest that we are going to get a radical agenda out of joe biden. This is the ultimate middle of the road player. This is a guy who knows how congress works, he knows whats possible, he knows what is clinically possible, i think you are going to see a real concentration on the most urgent problems affecting the country and that is covid, bringing back the 11 billion jobs, getting people back to work and, yes, eventually tackling the huge inequality through some kind of tax that has plagued america and the American Economy. I do not see any radical initiatives coming out of this administration or out of the u. S. Congress. They are waiting as we all are, to see how these two georgia races turn out and we been told that may be noon tomorrow east coast time. Im still trying to remember that it is wednesday. So the key for republicans was to drive voters to the polls on election day. The National RepublicanSenatorial Committee has been pouring resources into these races but the party relied heavily on President Trump to rally his base and deliver a victory. Is it fair, we dont have the results yet, but is it fair to say that republican turnout on the election day was perhaps not as high as republicans had hoped it might be . Without a doubt. If republicans wind up losing one or both of these, the problem will be that they failed to get people to turn out. Look, this was a Record Number millions of dollars spent on this, the amount of media attention, if you add up the amount of Media Coverage the past 23 weeks first of all, the Silver Lining is the good folks of georgia can now turn their tv back on and not be bombarded with endless political ads. We should at least focus on that for a minute. But no one in georgia i didnt have their mind made up. Everybody knew what they thought of these candidates and knew where they stood and who would they would vote for. The only question was whether or not those people would be got to the polls, and so if republicans end up coming up short in one or both of them, itll be because they failed to get those people out. Obviously there was a tremendous ground game there for all candidates to get everybody out to the polls. I think it still obviously in the case of the purdue race, it appears we dont really we cant say for certain what that outcome of that is but we shall see. So there is this Campaign Fatigue factor that not a lot of people are talking about. But you know this. If you talk to a campaign strategist, every single one of them down the line will tell you that timing is everything. Right . There is a reason these races are time to peak november 3rd which was two months ago. You mentioned the half billion dollars in ads, the poor citizens of georgia could not turn on their tv last months without being bombarded without walltowall add coverage with these candidates. Is there a sentence either among the campaign or voters, do you think its, like, this has been played out for quite some time now, hard to muster up the energy and reserve it takes to go to the polls and vote yet again in just two months after this was supposed to be done . Especially for so many voters in georgia who were so disappointed in the outcome of the november election. Who were very suspicious about all of the questions that have been raised about the november election. Its really, really tough to get those people to get to the polls again. I think also, jillian, years from now well look back at this and perhaps one of the biggest mistakes was that the purdue campaign, the purdue campaign should put this away in novemb november. Thats the way ideally they should of worked. Obviously loeffler had a taller order. There were some 20 people in her race so it was going to be a whole lot tougher for her to do that. But purdue shouldve probably put this away in november and that wouldve at least spared of course that wouldve changed the entire dynamic because if purdue had won, he wouldnt have spent the last two months talking about how the entire future of the republic hinges on one of these two races. Quick last question for you, charlie. The candidates would have you believe that the gulf between a provoking victory here and a democrat victory is so wide that america will never be the same again. Do you buy that or is it like, well, weve heard this a million of times before . I get tired of hearing about how this election is the most important election. But i have to say that this is one of these rare instances where i actually do believe that it is all on the line largely because of how unusual the campaign was. Joe bidens campaign, there were a lot of the questions that he refused to answer during the campaign. Theres a lot of campaigning he simply didnt do. And so there is sort of a very limited mandate the democrats actually have from voters. But if they wind up with no mandate and all of the levers of power in washington, thats a pretty dangerous time if you are talking about a bunch of politicians. Whether its republicans or democrats. We dont yet know who is going to win and we dont know therefore who is going to control the senate but lets just imagine the democrats pull off a double victory. Again, im talking hypothetically here. We dont know the numbers. But Chuck Schumer would become majority leader. He famously said, first we win georgia can we change georgia, and we change the nation. What would a majority leader Chuck Schumer do in the u. S. Senate . By all accounts as majority leader, Chuck Schumer would follow through on his word. I think they are going to move forward incredibly quickly. Whats interesting about this is that while this would be a blessing for the Biden Administration, it would also potentially put the president elect at a slightly untenable situation. Remember, he ran as a moderate but he would lead a party that would walk more aggressive change when democrats are in control of both branches of government. He might have run as a moderate but he chose as his Vice President ial candidate the most liberal member of the senate. How do you equate those two . Something we tried to figure out in november and i think its something thats going t to to find that his first 100 days of office but the first couple of years of his administration. Senator harris, she knows the senate very well. She has colleagues there, i think she would be a voice to biden to go big whereas if republicans were to maintain control of the senate, then it would be much more negotiations between biden and majority leader mcconnell. Instead, i think democrats are going to be lobbying the incoming president saying that this is the time to go big and there are a number of things on the wish list at this point. A dual republican victory on the other and matt could impact president elect Joe Bidens Administration from day one. Yet more Political Drama is on the immediate horizon. A joint session of congress will convene later today to officially confirm joe biden as an expresident of the United States but there is observatio dozens of republican lawmakers are blocking the certification of vote. Outside, the president supporters are protesting results insisting the election was rigged. We are joined by Charles Watson with breaking developments on the result. Good morning, gillian. Vote counting operation here slowly but shortly wrapping up, you can hear the sounds on the operation systems over here, shortly wrapping up right now. You can see a lot of the election workers that were here today have packed it up and started going home. We were told by the director of elections here that about 7500 ballots at about 112,000 absentee ballots remain to be counted. Election workers will return here at about 8 30 later this morning to continue the count. Elsewhere in the state we are told by georgie Election Officials that there is still outstanding and 15 counties leaning heavily democratic. Election officials also tell fox news based on the large numbers of absentee ballots that were received in fulton and the called county it is possible well get a result some time this morning. But right now that is not likely at this point. Throughout the day weve heard from both parties, democrats and republicans voiced confidence about the voters they were able to turn out. But right now this race is very close. We just heard from senator Kelly Loeffler and her opponent Raphael Warnock not too long ago. Heres what they had to say. We are going to fight for this president so im asking for every single georgian, every single american, stay in the fight with us. We are going to keep fighting for you. Election workers will return here to the Georgia World Congress center about 8 30 this morning to finish counting about 75,000 absentee ballots that are outstanding here in Fulton County. Thank you. Listen, i think the authority is really in the senators themselves and the house members and they are the ones theyd have to object, make the arguments and theyd have to vote. I think that spot on. Its not retribution. In my state we have voter i. D. Laws. Liberal counties used covid to what we are going to do is absently set aside the voter i. D. And used covid to say that everyone cant show up so well go with people can mail in ballots. Thats not the way our legislatures wrote the law. There is real concern. This isnt retribution, this is to take a look. The vote might not change in the house and senate but we can have good evidence to say what are the best reforms we need to again have evidence in our elections which we dont right now. Look, i think the race, and well know later after we have a chance to interview georgia voters, but it seems to me that the president really undermined republicans in georgia, he republicaundermined to the two s by putting them in a very difficult position, his call to the georgia elections officials, 18 calls before the election official finally responded. If youve listened at all in that tape, it was kind of shocking in an almost mafia don like fashion, no pun intended, to get the votes that were not there for republican candidates. I think that voters were turned off by this, despite the huge amount of money that was spent on this election in political advertising. Lets talk about the balance of power, brad. Now with this addition of i guess senator elect robin warnock, weve got 49 seats to the democrats, 50 seats to the republicans, that outstanding race, the ossofpurdue race still unknown. Does that shipped anything around, even right now in the immediate . I dont think so. I think all eyes are on purdues race. If we keep an eye on the majority, the majority it keeps an eye on the senate, the chairmanships. Even the one seat majority is a majority and a tremendous amount of power and leverage that goes along with that. Of course, if we lose that, there is still a 5050 senate with Kamala Harris coming in to break a tie. I do not think joe biden is in any better shape with one then he would with two. There is still a break, if you will on the power and restraint that the senate will have over the administration. Sean, i know this was not the news you are hoping for in the first race, but talk to me about now that we can kind of start doing the postmortem especially in this one race, talk to me what you think some of the logjams were. A lot of republicans, voters and lawmakers, really thought that President Trump rallying in dalton monday night was going to help carry both these candidates across the finish line. People at that rally where pumped up. I remember a Steve Harrigan reporting live from the rally as it was going on saying he has never seen Trump Supporters angrier, more fired up, more ready to come out and vote. What happened . I think democrats obviously had a good night. When we do the postmortem, you are going to see that there was a massive africanamerican voter turnout which was huge for reverend warnock. If my numbers were right, its a 30 increase from the november election. That margin, i think democrats had about 90 turnout and republicans mightve been slightly less than that and thats going to be the story that is written here and i think President Trump did a great job. You needed his voters to come out and support his two Senate Candidates and obviously they did. But in the warnock race, they didnt come out in the numbers that were needed. I would just note that republicans normally do very well in these runoffs. Itll be interesting to see how the purdue name goes. The purdue name is the Gold Standard in georgia. Now secretary of agriculture, a lot of democrats like him. He has a little bit of wind to his back compared to Kelly Loeffler. I know it is tight. Will check back with you again later in the hour. President trump even calling on Governor Kemp to leave office, to be removed from office. All that criticism the president has directed at the republican elected officials, did that affect the outcome in these races, do you think . Listen, i dont think it was helpful. Every candidate, every politician has their constituency and no doubt the governor does. Those voters of the governor were angry with the president s harsh tone with him. I think it had a little bit of play. I do not know if that was the main factor. Half a billion dollars were spent in this race. There were ads all over georgia and spent all around georgia. Everyone around the state i think they were voting on the facts and the records on each of the candidates in the fight between the president and the state and elected officials i do not think were in the forefront of peoples minds. From the standpoint of republicans, brad, you have a state that hasnt voted for a democratic president since 1992. Now georgia voted in joe biden and has voted in at least one democrat u. S. Senator. Whats going on . Republicans, i think at the end of the day will be the ones who lost this election for themselves. Just days before this election, the Republican Senate refused to deliver further covid relief. I think that had a serious effect on the Election Results. In addition, republicans are seeking now to overturn the certification of a president ial election in georgia. I dont think thats helpful. There are a lot of things that republicans did that were selfinflicted wounds, if you will, that at the end of the day people are shaking their heads and wonder why this was done at such a critical moment when the Senate Majority was in the balance . On that point, President Trump was the one beating the drum for the 2,000 stimulus checks that Mitch Mcconnell and some other senators have been opposing, both of the republican Senate Candidates have come out in favor of the bigger numbers, but that 600 figure was negotiated in part by steven mnuchin, President Trumps own secretary of the treasury. Talk about the lefthand not knowing what the right hand is doing there. Its reflective of the payoff that has really characterized the goingson in washington ever since the election. President trump has really been missing in action and when he has been in action, he has undermined his own candidates and the Republican Party. Its almost as if hes brought a wrecking ball to the georgia elections so that the democrats could win, endorsing a bigger check, forcing republicans who are normally endorsing fiscal restraint to endorse a larger check. Nancy pelosi was totally in favor of Donald Trumps proposal to expand the stimulus checks from 600 to 2,000. Unfortunately a lot of republicans were not an Donald TrumpsElection Night, preElection Night calls to Election Officials, that tape that was leaked with the conversations in which basically the president asked, bagged the republic in election official to deliver votes that werent there for him, all of this went down i think terribly badly with independents. Stacey abrams burst on the scene a couple of years ago. It was a signal that georgia was perhaps not the republican stronghold it had reliably and spin for upwards of two decades . Early into these morning hours, brad, judith, sean, lets talk about the Stacey Abrams factor here. Sean, ill come to you first. As we all know, there was historic early voter turnouts. 1 Million People in person before tuesday. Does Stacey Abrams get all the credit here . There was huge early voting and the organization took place to get the votes out was impressive and Stacey Abrams was the driving force behind that. Republicans had to have a huge turnout yesterday to overcome the early votes and in the warnock race, doesnt sound like they had the early voter turnout and i look at Stacey Abrams, i disagree with her on policies. Shes promoting radical socialist ideas, but on the organization front, she totally delivered for democrats yesterday. So, judy, two major hurdles for republicans. They needed somewhere between 800,000 and a million voters to show up today in order to erase those gains by democrats that we just talked about, whatever percentage of those early votes belong to them. They also needed their voters to overcome their beliefs prevalent by Republican Voters or at least president Trump Supporters that the election was rigged, there was no point to go out to vote anyway. I think you are right, gillian. Stacey abrams deserves a lot of credit for undermining that republican argument about the fraudulent nature of the election. She made this turnout an issue of faith in the election and a vote for economic progress and she concentrated again and again to her organization a fair fight on the 600 stimulus checks, the fact that democrats have consistently supported larger amounts of money for working people. Its the economy, its the economy, and her own race helped because she helped motivate other black voters to turn out which in georgia was absolutely crucial. Brad, Something Else abrams is getting credit for is really delivering on the black vote in georgia. So far tonight we know the turnout has been tremendous. Africanamerican boats have so far exceeded what they were in round numbers and in percentages back in november. There is no doubt that Stacey Abrams is a force to be reckoned with in georgia but beyond georgia shes a National Figure now. Shes going to seek to replicate this around the country and in other races. Its going to be interesting to see what her next move will be. There is no doubt that she has had tremendous success in her organizational ability to micr microtarget, to understand who needs to be motivated, to get them out to vote, and they did. Also to her credit, i understand she was microtargeting youth, some of which were not even of age when they were targeted but knowing they would come of age for this vote. They were very smart in their targeting and it seems to work in their benefit. We dont know whether ossof or purdue gets the race tonight but lets play the hypothetical game just for a moment and talk about what a democrat led senate and the new congress is likely to look like. I want to pull up for you on the screen which democrats are likely to take the key choice chairmanships in the new congress if the democrats sweep this thing. Senate intel chair will likely go to mark warner, Foreign Relations likely to robert menendez, and Bernie Sanders of course will run the budget committee. Talk to us about what that looks like for republicans. Isnt all doom and gloom . Is there any chance of pushing any part of the republican platform forward in the new congress if this is the case . Let me throw you a curveball, gillian. The one list i didnt see was joe manchin. I bet you tonight that Mitch Mcconnell this morning is going to be having big conversations to get him to change partisans. Hes talked about that 2 three years ago. I bet that pressure is on right now because joe manchin will be in a tough place with the Progressive Liberal Movement coming out of the house and senate, doesnt fit the values of west virginia. The rebel can the party is a better home for him. With that said, if you look at the house, 329, its a tough majority that nancy pelosi has. You have a lot of democrats who come from republican leading states, going to have tough races in the first off election of a new president and they do not want to be as radical as aoc and nancy pelosi. I think republicans have the ability to peel off a few of the democrats in the house but also with a 50 50 split with Kamala Harris per siding as the deciding vote, its going to be tough to get much done in the senate as well. Again, i cant tell you but i think its going to be tough because the margins are now so tight. Even if the dems provide the tiebreaking vote in the senate, theyll still need to get the 60 votes to overcome the filibust filibuster, thats one thing republicans have going for them. Is there an appetite, concern among republicans that mail in voting and some of the changes that came with the covid epidemic have permanently hurt the partys chances . I think what they believe is when you have mail in ballots, without voter i. D. , its right for fraud, which is concerning for all of them. They want to make sure if you are going to vote early you should do that in person and you should show an i. D. Thats just common sense. Donald trump was remarkable for so many americans. These results were remarkable and unified the Republican Party around a set of ideas. The problem we have in the country is democrats have become so radical. He was helped by tiktok influencers who reached out to their own followers, a group of tiktok influencers who held a rally for the democratic ticket for getting out the vote and they reached out to an audience of about 5 million followers so that seem to have a big influence. That platform has really exploded in popularity among people ages 1622 and that is a demographic that traditionally has been very difficult for campaigns to infiltrate. Its estimated that between 90,120,000 voters who did not vote in the november 3rd general election voted in these runoffs and that group skewed root young and skewed nonwhite. So i think the story that we are seeing play out here tonight is that its not so much trump hurting republicans as its the democrats ability to motivate voters in a special election, and run off after the general election, something they have not been very good at turned out to be quite effective. Pursuant to better than the normal roles of congress the most the role mike pence has is to preside over the joint session which is designed to certify the final president ial the. In that role he can will on procedural objections, he can decide which objections are proper and can go to debate and which arent but other than that he has largely a ceremonial role. That is one legal theory that might have some validity and you might see that gain more ground in future elections, there are four Supreme Court justices that buy into this notion that you cant have state courts or state executive officials changing election procedures in the middle of the game because they usurp the Plenary Authority state legislatures have over president ial elections under article 2 of the constitution. However that year he has been advanced in multiple courts in multiple states and at least as it applies to this election has been rejected by all judges including federal judges that are republican and trump appointees, really theyre just doesnt appear to be enough evidence to suggest these changes to the president ial election procedures that are at issue changed enough votes to change the outcome in even one of the swing states, to change the overall president ial election. The certification of this Electoral College vote is a perfunctory affair, sounds like tomorrows is going to be very drawn out in part because of the challenges to some of the states electors late submitted, a challenge being led by senator ted cruz of texas and a dozen or so other senators allied with him, do you expect they are going to be able to get any of these votes tossed out or get that Election Commission established which they say they would like to have . It seems unlikely. Because they have house of representatives members and senators they will be able to raise the objection the floor debate in each of the chambers. They will be able to bring their concerns forward. But under the electoral challenge act in order for it to change the certified result in any one particular state you would need a vote of both the u. S. Senate and the u. S. House, both of them and since the house is controlled by democrats it seems extremely unlikely that this is going anywhere. One other procedural point i will mention that hasnt gotten enough attention is under the electoral challenge act congress has to accept as conclusive the results certified by any state if they got there certification in by the socalled safe harbor deadline which this year was december 8th. Allstate met that deadline except wisconsin so the exception of wisconsin is a pretty reasonable argument this objection is not procedurally sound but putting that aside even if that objection goes forward you need the house on board with donald trump as well as the senate and given the democrats control the house it doesnt seem likely. I think the odds of their being a legal challenges almost 100 regardless of who wins or loses and theres two reasons why you see lawsuits a legal dispute after virtually all american elections now and that is because these elections are very close so theres a good chance that if you have litigation legal challenge theres a chance it could affect the outcome. In 2008 republican norm coleman ran for the senate and was winning on Election Night but after a series of legal battles democratic senator how franken won that race. Sometimes lawsuits and Legal Proceedings in these elections can change the outcome but beyond that keep in mind these lawsuits can also give rise to future reform of the election system if you go back to 2018 in georgia, stacy abrams ran for governor and lost but after that race there was a series of lawsuits, legal and political debates about whether or not that election was run the right way and there were changes between 2018 and today and these elections today. One wonders if there was a change that occurred that actually materially affected the outcome of the Senate Runoff seats. Democrats have been saying for months Donald Trumps legal challenges to the 2020 president ial election are harmful, dangerous, undercutting democracy, unconstitutional, but you just hit on an interesting point which is sometimes legal action affects lasting, worthwhile change which is what the republican senators who are part of this group that will challenge the results tomorrow by asking for a 10 day reassessment of the vote are saying they are trying to do. That is right. Legal challenges and lawsuits dont just have the effect of trying to impact the parties involved. Often you bring Public Interest lawsuits with the goal of changing things politically.
