And to be clear from the tweets to the reaction to his speech, the wet weather notwithstanding i think its fair to say the president was pleased with how the salute to america worked out yesterday. It was quite an event and something to see for danl people. Not everybody in the crowd was there for the event itself. A lot of folks wanted to see the fireworks. No matter for being in the Nations Capital yesterday it was memorable as the president paid tribute to those who forged history and those who preserve it and preserve the peace. President trump as long as we stay true to our course. As long as we remember our great history. As long as we never, ever stop fighting for a better future, then there will be nothing that america cannot do. [cheering and applause] a rousing reaction to the president s comments yesterday. Aside from the music and speeches and salutes to the heroes here and in the past there were a number of flyovers, jon. Mostly of military aircraft which really seemed to thrill the crowd despite all the heat and humidity and rain. It was a lot of fun to watch those fly over. The evening culminated with an incredible fireworks display dampened by intermittent rainshowers but not enough to dampen the spirits of those along the mall and those watching all around the Nations Capital. It was quite a scene here in washington, jon. Jon the president may have been happy with it. There are a lot of protests over this event, right . Right on the money. Protests are common at the white house. We see them every day in some variety or another. Yesterday they took a bit of a dangerous turn for a while. At least one demonstration got so out of hand that protestors burned an American Flag only to be confronted by other americans. That led to a bit of a dust up between competing groups. It resulted in an injury to at least one secret service officer. A couple of people were arrested following that incident but that is something we have come to expect here in the Nations Capital from time to time. Although you dont usually see it get so out of hand on pennsylvania avenue. Democratic president ial candidates were critical of this particular event by the president saying he was trying to make the holiday all about himself. If you listen to the comments in the speech, it looked like he steered clear mostly of all that. Jon, back to you. We expect to hear from the president as he makes his way to new jersey. A whole lot of worry, a lot of criticism before the thing started. The president stuck to the script. Has there ever been a bigger contrast between the commentary and predictions before an event and then the event itself . Before the event, we had some of the president s opponents saying that it would be a dangerous mill tarization of the fourth of july ordaining rouse politicalization of the fourth of july. One said he saw signs of another Tiananmen Square when the chinese killed a lot of people. Others prayed for rain to ruin the event. When the event actually happened, it was really unremarkable. The president paid tribute to the u. S. Military services, each branch of the services, and paid tribute to lots of other americans and basically steered clear of politics. Alicia five different flyovers from all the different branches of the military. There was rain. As we know it didnt ruin anything. However, there are a lot of democrats running for president and they had a lot to say. A lot of criticism. This all happened prior to the event. Take a listen. Donald trump i believe is incapable of celebrating what makes america great. I dont think he gets it. Not about my brothers and sisters who lost their lives in service to this country. He is having a praise for himself putting tanks out there for himself. I think we need money to go into rebuilding our infrastructure. I am not sure we need to put tanks in downtown washington, d. C. Alicia i want to put up something on the screen here. This is from Washington Post headline marc thaoesen made his opponents look small. You wouldnt expect any democratic hopefuls to praise the president. You heard a couple of references to tanks in washington which raised a lot of concerns before the event that the president was going to have tanks rolling down the street and perhaps declare martial law or something. If fact, there have been tanks at a number of ceremonies in washington, d. C. In the past. In 1957, 1961, 1991 for various occasions not just the gulf war victory parade but for inaugurations as well. It wasnt as unusual as some of the critics said. And i think in the end the tanks didnt play a very big role in the whole thing. As you mentioned, the real star of the show were those flyovers, especially the Stealth Bomber flyover which seemed to get a lot of admirers. Alicia does the president need to answer for any of these concerns that were brought up, National Parks picking up part of the tab. Anything like that . Does he need to respond to any of that . Well, a president usually takes care of his donors. There is no doubt about that. But in terms of why spend public money for a celebration like this . Im sure the president s supporters would say it was good thing. The government spends money for all sorts of things and critics, you heard Bernie Sanders say its a waste of money. The president could perhaps solicit private donations for part of this. He could actually address these concerns. He did before by saying the participants in the parade are a lot of people who already work for the u. S. Government. But it did cost a lot of money. There is no doubt he could try to raise some money to pay for those costs. Alicia were hoping to hear from the president a little later in the hour as he heads to new jersey. I was like did i just was that an earthquake . I texted my husband and i was like i just saw my chair rocking. He said yeah, there is an earthquake. Jon the strongest earthquake in 20 years rattleling Southern California on the fourth of july holiday. Leaving several people injured. Two homes caught fire as a result. Store shelves were left in disarray. The 6. 2 quake hit a remote area in the desert 150 miles northeast of los angeles but felt as far away as las vegas and sacramento. Jeff paul is near the epicenter of that quake. Many of the folks who live in ridge crest are still rattled but thankful damage from this powerful quake wasnt more widespread. Unfortunately the man who owns this home one of just a handful of folks impacted directly by this magnitude 6. 4 earthquake. His house now boarded up after it caught fire shortly after this area started to shake. This is some video that shows that moment as flames got out of control. The owner says he was out getting a cup of tea when the earthquake started. He returned home and found broken windows. When he checked on his classic cars in his garage and he opened the door to a fire. What a fourth of july. I quickly forgot what it was together. A bad day when both an earthquake and a house fire that destroyed the house. Fire Officials Say there were other fires, ruptured gas lines and reports of some mobile homes damaged and knocked off their foundation. So far only reports of minor injuries but some patients at a local hospital were evacuated as a precaution after the structure showed signs of damage. The concern now is what could happen next. Some reports indicate close to 200 aftershocks have happened since that earthquake started yesterday local time at 10 33. Officials are warning to expect more in the coming days. He tweeted yesterday so important for our country that the very simple and basic are you a citizen of the United States question be allowed to be asked in a 2020 census. Department of commerce and the department of justice are working very hard on this even on the fourth of july. Lets bring in steven mulroy, former federal prosecutor, law professor at the university of memphis and an author. Mr. Mulroy, thank you very much for being here. Really appreciate it. Before we get started i would like to put up a quote from a former federal judge on this idea of executive action and we can discuss. He says he told axios if the president of the United States were to issue an executive order supported by his full article 2 powers directing the Citizenship Question be included in the 2020 census i believe the Supreme Court would affirm the constitutional power of the president to include the Citizenship Question. What do you think about that . Well, one problem that i and a lot of other election law people have with that is that the census is actually mentioned in article 1 of the constitution which talks about the powers of congress. In fact, the exact language gives the power of regulating the census to congress. It shall be done in such manner as congress by law shall direct. There already are congressional statutes on the books governing the census process. It seems a pretty hard stretch to say the president would be able to invoke his article 2 executive powers and simply ignore and bypass those congressional statutes. I think an executive order going in a different direction on the census at the last minute would not be viewed favorably by the courts. Alicia how would that look . Another lawsuit that would delay everything . Its already in the works. The printing has begun. Youre exactly right. Were up against the clock here. So if the president were to issue that kind of executive order it would be immediately challenged, possibly in the same census case that the Supreme Court just dealt with. It would go right back into the lower courts on that with probably expedited review. But the time is not on the administrations side here. They would need to get the courts to bless this addition of the census Citizenship Question within the next couple of months because the administration has already said that the forms had to be printing in the process of being printed right now this month, july 1st. They might be able to extend that by a few months but after that there is a drop dead deadline and they need to start printing the forms. The census is supposed to take place in april. Alicia one of the sources they talked to pointed out a lot of this could be about politics. Frees up the president if he is able to put the blame on the Supreme Court rather than his own office. I read that and that may very well be a political consideration on the part of the administration to be able to say to its base look, we tried, we did everything possible, we pushed it right up to the limit but that darn pesky Supreme Court Justice Roberts wouldnt let us do the right thing. It may make sense from a political perspective. It doesnt hold a lot of sway in terms of a straight legal analysis. Alicia since were talking about the politics of it. Mayor Pete Buttigieg had this to say. Take a lins. This is the time when we should be as welcoming as possible. The Citizenship Question is motivated biracial and partisan reasons. It has no business in something that is supposed to be neutral like the census but so important for the way resources are shared and the way democracy is enacted in our country. Alicia im running out of time, this does come down to politics. So mayor buttigieg is correct the political stakes are great here. A lot riding on the census and what results we get. Ill mention quickly his notion that there was racial or political motivations behind this isnt entirely unsupported. There was some latebreaking evidence from a key redistricting consultant that suggested that those kinds of political motivations really the true motivation behind adding that Citizenship Question. I do think the base is definitely moved far to the left since the 2008 election. Think the Vice President has a clear lane. Over half of democratic primary voters are conservative or moderate. I will say this election will be won through the industrial midwest. States he does very well in. If he maintains that lane of the center left he does have a pretty strong chance to pull through in this election. Jon you are suggesting that his banking to the left if thats what you want to call it is still keeping him in the middle of the democratic field . I think overall his positions really are in the middle of the democratic field. He has not embraced some of the more liberal positions on healthcare or even on some of the Income Redistribution proposals proposed by some of his colleagues. He has had a more traditional approach on healthcare and wages that play pretty well in a number of early contests and general election. Jon lauren, if thats the case why do his numbers seem to be shrinking in the polls . Joe biden is doubling down on this general Election Strategy because he is center left he will be the best one to win the general election. The problem is he is ignoring the fact he has to get through a primary right now. What he is good at and where his base of support is with africanamericans and also blue collar democratic voters that are on the more moderate realm. The problem is all the primary voters for the most part he is great with people over 50 in those two blocks but he is not great with younger voters. Younger voters are highly energized and very active in the primary now and split among the other democratic forerunners. So as people become more aware of the alternatives to joe biden, he came in with great name i. D. And lots of Fuzzy Feelings because of his role in the Obama Administration at Vice President. But as people get to know what the other alternatives are they look at them and think joe biden is great but here is somebody over here i think i might like a little better. Theyre doing a pro con list with him and theyre looking the other way. Jon lauren, the most recent fox news polling suggested that were it a twoman race donald trump versus joe biden, that biden would win. Do you think that he is the biggest threat to the sitting president . I think its too early to tell. I think part of that is because of name i. D. And part is because people are trying to figure out where they stand on President Trump at the given moment. When you look at the averages of the polling thats not necessarily the case in every instance. Jon listen to how joe biden handles the suggestion that maybe he should embrace more liberal positions. Here he is talking about congresswoman alexandria ocasiocortez. I think ocasiocortez is a brilliant, bright woman but she that general election fight, who won . Mainstream democrats very progressive on social issues and very strong on education, healthcare. Look, center left is where i am. Where its not is way left. Now look, thats what we can find out. Jon how did he handle that answer . I think he is right. I think what plays in brooklyn doesnt necessarily play in philly or michigan or other locations key to the general election. Still the numbers are down about 100 points right now. 224,000 jobs added in june. That was a bigger number than expected. Unemployment edging up, though, to 3. 7 . It is still close to a 50year low. Edward lawrence, live at the white house with more. Edward. A very big number but it shows the economy remains strong. That number the Unemployment Rate 3. 7 did kick up but due to a good reason. Because the size of the workforce increased. More people coming in off the sidelines looking for work. The economy averaged about 173,000 jobs per month over the past year. Now, here is where the jobs are. In construction, they created about 21,000 jobs. Manufacturing jobs are up related to that. The private Service Providing created 154,000, including professional Services Like architects, computer Design Services and scientific research. Weaker than the speed of the job growth from last year but still very, very strong. Anyone who wants to find a job could find a job in this economy. Now, other key number the Federal Reserve is watching is that one right there, 3. 1 . Thats how much wages are going up over the past year. That number is small enough where there is no or little inflation pressures going forward. The stuff you buy wont be more expensive. The Federal Reserve would like to say inflation at 2 . It is coming in under that. Signaling more pressure on the Federal Reserve to cut rates at the end of the month. That number again is low enough to where there are not that inflation pressures and the stuff we all buy is not getting more expensive. Jon thank you. As you might imagine, we talked about before, weve been preparing for these fourth of july festivities for some time. That was chicago mayor Lori Lightfoot has the city is on edge this july 4th weekend. Four People Killed, 33 others injured in shootings across chicago since the start of the holiday. Also this, a fight breaking out at the fourth of July Fireworks show last night. Three people were stabbed and more than a dozen others injured in a stampede. Steve rogers is a former member of the f. B. I. Joint Terrorism Task force and retired detective for the new Jersey Police department. Really appreciate it. Whats going on . Chicago . Forever weve been talking about the violence in chicago. There are is multifaceted support to solve the problem. The courts have to get tough. Some are repeat offenders and need to be put away for a long time. Secondly saturation policing. Directed patrols. You have to saturate the areas where the violence is. You have to give the police the tools they need to do their job. Alicia Holiday Weekends we see a lot of activity in a lot of different cities. Chicago in particular seems to have been pretty tough. Just this weekend lets look at some numbers, chicago july 4th weekend violence here. We have 33 people shot at least 4 killed. Last year it was 7 people were wounded in multiple shootings across the city. 2017, 101 people shot. So the numbers fluctuate a bit but still shows a scary trend when you are talking about a Holiday Weekend in chicago. It sure does. Compare that to the city of new york. Relatively safe. No violence here like you have in chicago because the policing methodology here are quite different. The difference is what i articulated earlier. The saturation of police in areas that there would be a propensity for high crime. The courts have ruled against issues like stop and frisk in chicago. There is something not right with a person in the spot. Years ago you could ask questions. You cant do that today. You know what . The result is what were seeing happen in chicago. Alicia is there a political will to fix this . I dont believe so. If there was it would have been fixed a long time ago. I believe the people are going to have to cry out and get their politicians to do whats right to protect them or get them out of office. It is all about leadership. You get tough leaders like you do in some cities around the country youll have safe neighborhoods. Alicia the Chicago Police department will point to the numbers im going to show you. For them its improved news. The first half of 2019 murders, 238 since the beginning of the year, down 7 from the same period last year and shooting incidents theyve had 980 since january, down 11 . But is it just me or does it still seem like those numbers are high . If you lived in a neighborhood where you had hundreds of shootings. Those numbers are very high. The fact of the matter is to solve the problem you need that multifaceted approach. The judges need to send bad people to prison for a long time. You need the Police Presence heavily in areas for at least a year in these areas where there is violence and give the police the tools they need to do their job. The cops do a great job but they need the leadership to tell them to go out and do what you must do at all costs. Do what you must do to keep the people safe. Alicia Chicago Police are in a spotlight quite a bit. Not always for the right reasons. Right now a tremendous amount of criticism about Law Enforcement and the Jussie Smollett case. Do they have the capacity to handle this . That has nothing to do with the street cops. Those are the foot soldiers out there. This was a prosecutor that went awrier. This is politics. It is all politics. The cops out on the street in chicago are probably some of the best in the country. I feel for them. I know they want to protect the people. I think overall the speech and celebration yesterday was really beautiful. It probably went above and beyond most expectations and did a great job celebrating our militarys history. For one, you dont have independence without a military. Likewise you dont have a military without fighting for independence. Anyone who says military shouldnt be part of an independence celebration they dont understand the impact a standing con described army has in our history when it comes to independence. When you take someone out to dinner and want to put it on your company card you talk about business right before you leave. By President Trump putting in there joining the military he justifies the military spending for that day. I think it would be clever in that sense. I do give him props for that. Jon you arent one of those complaining about the expense of the parade and Everything Else that included the president s speech yesterday. Listen, President Trump got the cost of the f35, the billion dollar plane down by 25 . Unless they spent 250 million yesterday i think he can throw a party to celebrate our country and independence and im okay with it. Jon lets look at the armys recruiting numbers. They had a goal of 76,500 new recruits. They got about 70,000. When you compare that to the other services, the army is the only one that didnt meet numbers. The navy in 2018 reached 100 of its numbers, marine corps, which you are partial to, of course, also did and air force came in at 103 of its stated goal. Generally the country is doing pretty well when it comes to matching recruits to the services, would you say . We are. It wasnt that long ago we were turning people away. It wasnt that long before that we were letting everyone who wanted to join in. It is a sliding scale. A constantly moving target. Depends whats going on economically in the country and whats going on with our military overseas. When were actively fighting a war people not unlike myself are running to the recruiters office trying to be part of it. If were actively fighting were growing our numbers which means we want everyone we can get. The standards get a little more lax. You find jobs for people. When you make your numbers smaller and the war and headlines arent reflecting the military all the time people arent as eager. When the economy is booming there are other opportunities. One thing i will tell you at least in the last 20 years the perspective has gone from the military is your last chance to a competitive market where you have to come in not having a bad record, not having not being overweight and things like that. You have to compete against others. Thats a great thing. I think that the army numbers will be your biggest numbers, half a million size force, the marine corps 170,000. Easier for the marine corps to make a much smaller number. As far as comparing the services it would make sense the army is the only one who didnt meet their numbers. As far as all that goes the department of defense, military, social narrative is it becomes a life long commitment to one another now. Not the case until this war. They had tried to get into the census from nearly the beginning of the administration. What the Supreme Court ruled said john roberts is the man that needs to be persuaded to either let this go on or not. You have 44 on each side. His view was the argument they used for the Voting Rights act because the d. O. J. Requested it was a pretext. So basically he left the door open if there was a legitimate argument for this that he didnt think was a pretext for Something Else that he might rule in their favor but the only problem for the white house is that time is running out. In fact, theyve already started having to print the census since the Supreme Court ruling without the Citizenship Question. If they will have an alternative to try to get the court to rule in their favor they have to act rather quickly. Jon where do you think the president stands with regard to his power to invoke an executive action to put it on the ballot . He is the head of the administration, the administration of u. S. Government. Why could the president not put that on . The argument for the president right now is propounded by people who teach constitutional law, if he made an executive order and presented a new reason, then they could petition the Supreme Court to examine the new reason through executive order. You can get a quick hearing in front of the Supreme Court and perhaps that is there best and maybe only avenue to try to get this census question on the census. Citizenship question on the census. People counter that saying the constitution is pretty clear on this. Its an article 1 power. Congress is given the power of the census. Even executive order wouldnt probably persuade Justice Roberts to then side with the administration. So its really somewhat of a hail mary but the president has that option. He is supposedly weighing the option of issuing an executive order. Time is of the essence here. They told the courts that they needed this settled by the end of june. Were now in july and the census is already being printed. Jon a lot of people think this is something that hasnt been done before but it is my understanding and weve got sort of a graphic that describes this, the 2010 census under the Obama Administration was the first one in 200 years that did not ask a question about whether the person filling out the census form was actually a citizen of the United States. Yes. It has been done before and used to be common before 1950. I think this case would be that all the questions i think in the Obama Administration case it was a portion of them would have the Citizenship Question on it. President trump knows politics very well. To most americans it would make perfect sense to ask are you a citizen or not, or even to try to find out who is a legal immigrant and who is not a legal immigrant. The other side would suggest if you are an illegal immigrant in the United States you are not going to put that on and answer that question correctly. And in fact if you are in a household where you might be a citizen but someone who might not be here legally, you might not answer the question all together. So that argument is that you will get an undercount of the exact population of the United States that would benefit republicans. That is really what the argument on the other side is. That this is a political move to benefit republicans. Jon republicans say this is all about being fair, i guess. I use the example yesterday in this discussion california has an estimated 2. 8 million illegal immigrants. If each of them is counted in the census, that amounts to four congressional seats and then a whole lot of federal dollars that without a congressional vote federal dollars that flow to california as a result of the census numbers. So states like california have a vested interest in counting everybody whether theyre a legal american or not. President trump should blame the commerce department. It seems clear from the ruling that had they presented that argument something that was straight forward and honest, that john roberts probably would have allowed this census question to be put on the census. Instead he said that he cant avert his eyes to the evidence there. The reason that they wanted was a pretext for Something Else. So if they were open and honest and gave that answer perhaps we wouldnt the administration wouldnt be in this position. Because they gave what john roberts thought they were not being honest with the court, they are where they are. Jon all of the states that have lost congressional seats to states like california ought to pay close attention to what happens with regard to this Citizenship Question. Jamie weinstein, thank you. The motion to change venue can be moved prior to jury selection. Thats where the judge is going to say we have a system in place to ferret out taint and abuse. Theyve been taken to areas hospitals with nonlife threatening injuries. Most of the injuries were people tramped in the stampede. One person was impaled in the leg when he ran into a table and three people were stabbed in the area. Just outside of navy pier teenagers were flashing gang signs and started a fight. One purpose was stabbed in the armpit and another in the arm and rib and third person who was not involved in the fight was stabbed in the face. Now the new mayor and the Police Superintendent got out in front of the violence this weekend. 1400 extra officers. Police executed a roundup ahead of the Holiday Weekend knabing 38 illegal hundreds of thousands of dollars of narcotics off the street. There were 17 shootings in the city of chicago. When it comes to the Energy Policies were seeing, i think the working class and americans in general want us to have policies that are reasonable. What were seeing from so many of the Democratic Candidates are extremely extreme. You saw one congresswoman alexandria ocasiocortez first came out with her Green New Deal. A lot of democrats mocked it. Yet so many of the candidates are now implementing some of those policies within their own plan. The average american looks at that and says look, i want us to have an environment thats clean. There are small steps we can take. I think innovation leads to cleaner energies that we have out there. But they also know this means their jobs going away. When you take a look at the fracking industry or offshore drilling. So many jobs have been created as President Trump has rolled back so many of the regulations that president obama put forth. So it seems that so many of these Democratic Candidates seem out of touch with the working class, which is a voting block theyll need if they will defeat donald trump. Alicia all democrats arent unaware of this issue that democrats have. A lot of longtime dems have raised this concern. Kimberly strassel points to it. Democrats are aware this is toxic for the working class voters they need to win back. Thats why most lead with patronizing promises to invest millions to retrain whole communities. Theyre signaling to donald trump trying to say to him in the upcoming negotiations what they want. They want sanctions relief. There are other signs coming out of north korea as well. That are positive. They recently put out a 60 minute documentary you can find it on youtube that shows President Trump walking into north korea and this was shown so all of the north Korean People on their state news broadcasts and shows ivanka trump shaking hands with kim jongun. I think we have to look at the negative side but Something Like that to show america in a positive light on north korean state tv . Ive been looking at north korea for over a decade and never seen anything like that. The president s approach is working and he deserves a lot of credit. Jon if they want sanctions relief, cant they take more positive steps to end their Nuclear Program or end their Ballistic Missile program . Absolutely. I think what will happen here is well have a tough round of working level negotiations. What the North Koreans are desperate four is sanctions relief for coal exports and textile exports. It gives them billions of dollars of revenue to do everything they need to do to power their economy and hopefully feed their people. The president needs to stand firm here and make sure that they give us Something Big in return, which one thing would be the nuclear facility. If they do that i think we could suspend those two sanctions for a year and see if the North Koreans keep their word. Jon the president says he is patient. The earthquake centered 150 miles northeast of los angeles near the town of ridge crest, california. The quake was felt more than 100 miles away making it Southern Californias strongest earth cake in 20 years as experts warn an even bigger one could hit in coming days. There is about a 1 in 20 chance that this location will be having an even bigger earthquake within the next few days that we have not yet seen the biggest earthquake of the sequence. It is certain that this area is going to be shaken a lot today and some of those aftershocks will probably exceed magnitude 5 which means theyll become damaging. Jon jeff paul is live in ridge crest, california with the latest. An ominous sound bite there from the earthquake experts. We just spoke with the police chief here in ridge crest and he tells us he truly feels like this community dodged a bullet not only in terms of the amount of damages that they are seeing, very few, but also in terms of the weather. That impacts things like fires and as you take a look at this video right here, you can see how the flames got out of control at one house. This fire started a few minutes after this earthquake hit the area of ridge crest magnitude 6. 4 and reports of other spot fires and vegetation fires and mobile homes were damaged. So far only reports of very minor injuries. So the main concern moving forward is what could happen next. Its that unknown that is putting not only the Emergency Responders here but the community on edge. We dont know if there will be any more after shocks. There have been 87 after shocks as we talked. Is there a High Percentage of a big after shock . Thats unknown. Unlike a fire or flood, we can predict that stuff. Earthquakes we cannot predict. Throughout the night we did feel several aftershocks and while we were setting up today earlier this morning to get ready to report on this earthquake there was another pretty powerful earthquake, 5. 4. President trump our nation has always mon ored the heroes who served our communities, firefighters, sheriffs, ice, Border Patrol and the brave men and women of Law Enforcement. Jon joining us now david mark Deputy News Editor for the Washington Examiner. When you heard ice and Border Patrol being included in the list of public heroes, thats not something that is often done in a president ial speech, david. Right. This is an expansion of what we would often hearsay in a normal fourth of july event. It is not unusual to praise the military and police officers. But ice and Border Patrol agents were part of the coalition and they endorsed President Trump back in 2016. The first time the union has ever done that. Jon the president obviously still wants to get that wall built along the southern border. He has been frustrated in efforts to do so by congress. He thought he had a workaround in sort of redesignating military pentagon money to build the wall. Now he has taken a beating in the courts. The court is saying he cannot do that. What is the president supposed to do . Well, the most recent hit to the president s plan to build that border wall came from the ninth circuit on the west coast which traditionally hasnt been all that friendly to the Trump Administration. This is a tough legal case for the Trump Administration. After all, congress has the power of the purse. They can direct very specifically where money is supposed to go. But this is not over by any means. This is likely almost certainly going to be appealed all the way up to the Supreme Court. They may have the final say on whether that money can go toward a border wall or not. Jon it doesnt surprise you that the president was not allowed to redesignate those pentagon monies. Not particularly. Again, congress can appropriate money very specifically. Courts have traditionally been rather there are other aspects. Moving on to private land and other issues that had to do with that court decision. Jon so when americans see the conditions that the migrants are being held in at the border and its obviously overcrowded and awful but is that the fault of the american Border Patrol system or is it the fault of the Economic Conditions in central and south america . Certainly Border Patrol agents are doing the job they were hired to do. They are given instructions. They have lots of rules and regulations that they have to follow. They are doing what they are commanded to do like any military or pair a military official. It is broader policymakers in washington, d. C. And then if you want to go further out, it is the Economic Conditions that drive these people to walk hundreds of miles through mexico. Whose fault is that . We could go on for hours about that. The Border Patrol agents are doing their job. Jon in the meantime Border Patrol is taking some heat because of not one, but now two private facebook groups apparently that have turned up in which Border Patrol agents are sort of disparaging of the migrants who are coming across the border and some of the legislators who have been critical of the work that they do. Yeah, probably not the smartest move to put those kind of images and statements on a Facebook Page. Weve all learned that privacy on facebook posts dont really mean that much. Having said that, its a relatively a very small group compared to the overall number of border agents. And in any organization you are going to find bad apples and some problems. Jon i imagine that there are huge frustrations in that job. Ive never been a Border Patrol agent but the video weve seen of the work they do, they are putting not only their lives on the line, but working in some pretty unpleasant circumstances sometimes trying to keep the u. S. Border safe. Absolutely. Theyre truly on the front lines trying to keep this country safe, doing what they are told. Taking orders, often rapidly shifting and changing orders at the same time that come down from washington, d. C. , that come down from the nine sectors on the border. So theyre in a tough spot and i think theyre doing it as reasonably well as they can. Jon every job has its frustrations but theirs especially. David mark, thank you. Thank you. You knock on doors of houses, check houses, you go through all this detail and youre not allowed to ask whether or not somebody is a citizen . Alicia President Trump sounding off on the Supreme Courts decision to block his effort to add a Citizenship Question to the 2020 census as the administration tries to find a legal path to get the question included. The Justice Department has a deadline of 2 00 p. M. Eastern this afternoon to tell a judge whether or not they will pursue the matter further. Joining me now is fox news legal analyst mercedes cowan. Nice to see you. Lets talk about this. What do you think well see. The Justice Department as a matter of hours now. There is a little reverse engineering. The u. S. Supreme court stepped in to say we need to see a different reason behind this question. We feel the question is contrived. We know it was a very close call. It was a 54 decision so you know there are four justices that believe that question is permissible under the constitution. Five say we want to see further information and see another reason. It doesnt sound contrived. It gave that deadline and why the d. O. J. Said all right, i guess we wont go back. To step back and give another reasoning gets a little sticky as you can imagine. These are all lawyers who carefully crafted their arguments. By the time it got to the u. S. Supreme court there was so much information already before the court to go back and say well start from step one and decide what really is the rationale . Its sticky for them and why initially they said we wont do this. Alicia we do have a quote from a d. O. J. Lawyer on this and it is saying we at the department of justice have been instructed to examine whether there is a path forward consistent with the Supreme Court decision that would allow us to include the Citizenship Question on the census. We think there may be a legally available path under the Supreme Courts decision. Were examining that looking at nearterm options to see whether its viable and possible. Here is the argument floated around they may hang their hats on. Section 2 of the 14th amendment allows for the gathering of information regarding citizenship. It is a twopart process. The constitution says you can do this. Where weve got the rub is that the decision by the u. S. Supreme court didnt focus on section 2 of the 14th amendment which allows you to gather the citizenship information. It asked for the reasoning behind gathering this information. So im not sure the d. O. J. They step forward and say constitutionally were permitted. The u. S. Supreme court may turn to them and say what is your reasoning . I get it that the constitution allows you to do it but what is your reasoning for gathering that information. If you look at the purpose behind the census it is to get how much funding and education and healthcare is needed. If you look at the infrastructure that the Census Bureau use the information for its the infrastructure the government will fund. Alicia thank you so much. We have the president departing the white house today. He and the first lady are traveling to bedminster, new jersey. We have that tape. President trump last night it was a fantastic evening for our country. Well have a lot of people being recruited based on that. A lot of people joining our military. We really needed that. Our job numbers are so good that the military has a hard time getting people and i think really that a lot of people [inaudible]. I think we showed that last night. We had great numbers this morning. I think 224,000 jobs. Those are unexpectedly good. And our country continues to do really well, really, really well. So were very happy about it. I think we are going to be breaking records. If we had a fed that would lower Interest Rates we would be like a rocket ship. Were paying a lot of interest and it is unnecessary. We dont have a fed that knows what theyre doing. It is one of those little things. If we had a fed that would lower rates, you would have a rocket ship. When president obama was here he played close to zero interest. Im paying real interest. Yet our economy is much better than its ever been. From election day were over 50 increase and weve made trillions and trillions of dollars. Were doing very well. Last night was spectacular. Yes. [inaudible question] are you willing to bring democrats back to the table and in particular when it comes to [inaudible] President Trump i would love rural broadband. We are working on it. I would love to have the democrats come back and talk about infrastructure and drug pricing. Well be announcing something very shortly. A favored nations clause. For years and years other nations paid less for drugs than we do. Sometimes by 60 to 70 . Were going to be and were working on it right now. Were working on a favored nation clause where we pay whatever the lowest nations price is. Why should other nations like canada, why should other nations pay much less than us . Theyve taken advantage of this system for a long time, pharma. Were working on now a favored nations clause so that whatever the lowest nation is anywhere in the world or company, but the lowest nation or company, then what happens is we will pay that amount and thats being worked on right now. Well do it in the form of an executive order. Its one of the ways. We have four or five ways to do it. One of the ways were thinking about do it. Were doing well on the census. He made a statement. He wrote something out. The judge didnt like it. I have a lot of respect for Justice Roberts but he didnt like it but he did say come back. Essentially he said come back. Thats what he was saying. So well see what happens. We can also add an addition on so we can start the printing now and maybe do an addendum after we get a positive decision. Were working on a lot of things including an executive order. [inaudible question]. President trump i dont think im a bully at all. I dont like being taken advantage of by other countries, by pharmaceutical companies, by all the people that have taken advantage of this country. You look at what joe biden has done with china. We have lost our shirts with china. Now china is dying to make a deal. So were taking, by the way, billions and billions of dollars in tariffs are coming in and china is paying for it, not our people. So if you look at what weve done and if you look at what weve straightened out, i call it the obama biden mess. Were straightening it out whether its north korea, you would end up in a north korea as sure as youre standing there. Now the relationship is good. Well see what happens. As sure as you are there, you would end up in a war with north korea. [inaudible question] President Trump i dont call them raids. I say they came in illegally and were bringing them out legally. These are people where we have the papers, weve gone through the court system. They will be starting fairly soon. I dont call them raids. Were removing people that have come in, all of these people over the years that have come in illegally, we are removing them and bringing them back to their country. [inaudible question] President Trump i dont think of it in terms of that. Were just celebrating our country. There is nobody stronger or nobody that has a military anywhere close to ours. We spent 700 billion. When i took over the military it was absolutely depleted. We had old planes, we had old jets. We had bad stuff that was tired. Now we have the finest jets in the world, the f35, the f18, the new ones. We have military equipment the likes of which weve never had. Building submarines, building aircraft carriers, all made in the usa. Its a double. Its all made now. Im all about jobs. We had great job numbers today. When it comes to the military it is not about jobs. We have the greatest in the world. Nobody that comes close. Our military now is just about the top, just about the best its ever been. There is nobody that comes close to the power we have in our military. What we have in fact, if you look, our nuclear now is in great shape. Weve renovated and fixed and were buying some new. Never want to use it. We never want to use it. But we have to be in a position that we have to be in a position. But our nuclear is in great shape. Our military now is in great shape. [inaudible question] President Trump i can tell you those people that you see, a lot of people in front of the white house, every one of them loved it. [inaudible question] President Trump trust me, after 500 witnesses, 2,500 subpoenas, every Single Person i know practically was called in one form or another, nothing. And ill tell you what, even with you people. You are honest people. None of you could have with stood that. They would have found something. If there was a comma put in the wrong place, if there was a period in the wrong location, they would have grabbed it. No collusion, no obstruction. After that its almost its amazing. You know what it does . It shows im a very honest guy. [inaudible question] President Trump china. Well see what happens. They are talking to us. They want to make a deal. But we had a deal and they broke it. They broke the deal. They shouldnt have broken it. I think if they had it to do again they wouldnt. Right now we put big tariffs on and have a lot more to put on if we wants. China broke a deal. We are talking to them. Well see what happens. [inaudible question]. Well see what happens with iran. Iran needs to be very, very careful. [inaudible question] why did the Vice President cancel his trip to New Hampshire . President trump youll know in two weeks. An interesting problem that they had in New Hampshire that i cant tell you about. Had nothing to do with white house. There was a problem up there. And i wont go into what the problem was. Youll see in about a week or two. [inaudible question] President Trump the southern border is being policed very well by mexico. Mexico is doing far more than the democrats. We all know it because of tariffs. Theyve been great. They put 6,000 people. They have many of them there on the southern border, their southern border. On our southern border which is the main border that you think of, they are going to have anywhere between 16,000 and 21,000 troops. It has had a big effect. Theyve only been there for a week where they had the troops. It has had a tremendous impact. And you will see the numbers starting to come in very well. Guatemala is going to be signing a state third agreement. Were talking to mexico. Mexico is really doing a good job, i have to say. Very big. Here is the thing. When people come in illegally and then it is crowded. Ive seen some of those places and theyre run beautifully. They are clean, they are good, they do a great job. They do a great job. They are crowded because the democrats will not give us any relief from these loopholes. We have loopholes that are so bad we have asylum that is so bad. So these places are many of them, not all of them, but many of them are incredible. Really well run. I said it yesterday. Border patrol did not train to be doctors and nurses and janitors. Thats not what they are trained to be. They are trained to be Border Patrol. Thats what theyre doing. Theyre doing a phenomenal job. Because of the country, because were doing so well as a country, we never weve never done this well. Two days ago we hit the highest stock market number weve ever had in the history of our country. Our country is doing great. Unemployment is very low. We just came out with 224,000 new jobs, the numbers are unbelievable. And thats bringing people up like theyve never come up. Border patrol and ice have done a great job. Now people are being removed from the country. Were removing them. We are starting with the ms13. Weve taken out thousands. Weve never had an onslaught. The reason they come up is because the country is doing well, they want jobs. [inaudible question] a report says the facilities are overcrowded and dirty and widespread problem. President trump i think they do a great sdwrob with those facilities. You know how it could be taken care of . Number one, tell them not to come because its illegal. Very unfair to people that have been waiting in line for seven or eight years and theyre about to be admitted and theyve studied and know the country and the history and everything. And then a person comes in, walks in and all of a sudden they become a citizen or they are allowed to stay . So thousands and thousands of people will be legally removed from the country and that process has started. We have been doing it for a long time. [inaudible question] President Trump that i dont know. I dont run it. I would say this. Probably every club in the United States has that because it seems to be from what i understand a way that people did business. But we have a very strict rule. Those rules are very strict. Every club practically in the United States thats the way they did business. [inaudible question] i havent seen it. I will say this, i think the Border Patrol has been treated very badly by certain members of congress, very, very badly. For the most part theyre very respected by congress. Certain members of congress say very bad things and lies and exaggerate and Border Patrol people are tough people. They arent happy about it. [inaudible question] will you President Trump we have a number of different avenues. We can use all of them or one. Were doing very well on that issue. Were spending 15 to 20 billion on a census. Were doing everything. Were finding out everything about everybody. Think of it. 15 to 20 billion dollars and you arent allowed to ask them are you a citizen . By the way, if you look at the history of our country, it has almost always been asked. Were fighting very hard against the system thats a very difficult system. Well make a decision. The attorney general is working on that right now. Whats the reason for trying to put a Citizenship Question. President trump you need it for many reasons. You need it for congress redistricting. For resources. How many people are there . You need it for many reasons. [inaudible question] President Trump i thought ivanka was amazing at the g20. Foreign leaders think she is great. She is very smart and done a great job. She has sacrificed a lot. Ivanka and jared work very hard and sacrificed a lot to be doing this. They want to do it. Ivanka has worked on almost 10 million jobs training and going to companies and getting them to hire people. But the people, the foreign leaders really like her a lot. [inaudible question] President Trump im not grooming her for office. As you know, president obama had separation. President obama in 2014 built the cells that you always show on television. They were built by president obama. But he had separation. The one thing he didnt have is a good economy. He didnt have the kind of onslaught were having. We have a tremendous onslaught of people. Who can blame them . They want to get in and take advantage of the economy. They have to come in legally and through merit. I think Border Patrol has done an incredible job and mexico has been doing an incredible job. [inaudible question] President Trump a lot of people thought his answer was fine. I didnt see the answer yet. They thought it was fine. It can be expanded. There are many reasons you do it. We were surprised by that decision. Citizenship has been on that thing most of the time for many, many years, its shocking after spending 15 billion it is not on. [inaudible question] President Trump tell biden that nato has taken total advantage of him and president obama. We were paying for almost all of nato. We are protecting countries. Those countries have to protect themselves with us. They have to make a contribution. In my first year i raised over 100 billion from those countries. Biden didnt know what the hell he was doing and neither did president obama. Nato was taking advantage of them. They still owe us a lot of money. Biden doesnt know about that. He thinks stupidly we do. Nato is fine. But they have to pay their way. The United States is not going to get killed on trade with europe. Europe kills us on trade, which were changing and europe then kills us because we defend europe and we lose a tremendous amount of money. So we lose on trade and the military. President obama and Vice President biden didnt have a clue. They got taken advantage of by china, by nato, by every country they did business with. [inaudible question] President Trump i dont know ill be able to. I hope they do well. I hope they win. [inaudible question] President Trump kim jongun on numerous occasions to me, president obama wanted to meet with kim jongun and kim jongun said no. Numerous occasions he called and right now we have a very nice relationship. Weve done a lot and weve gotten our hostages back, were getting the remains back. A lot of good things are happening and there has been no nuclear testing. During president obama, there were nuclear testing, they were sending missiles. Right now everything is nice and quiet. Alicia the president departing the white house heading to bedminster, new jersey and taking quite a few questions from the press hitting on a number of topics including Border Security and pressing that executive order to ask the Citizenship Question on the upcoming census. He also talked a little bit about that celebration last night and ended on north korea. And joining me now is gordon chang asia analyst and author of losing south korea. He said a lot of good things are happening now between the u. S. And north korea. What do you think that means . I think President Trump is talking about his Good Relationship with kim jongun the north korean leader. He knows that the working level talks are going to start very soon with steve, his envoy on north korea and they may be looking for a small deal. A stepbystep approach. Thats something that President Trump said he would not do. Matter of fact he walked out of the summit in vietnam in february because he wanted the big deal. But maybe there is a new way forward for the president. Alicia can you explain what that small deal is and how we got to this point where it may become more acceptable to this administration . Its something short of the complete disarmament of north korea. All of its missiles and nukes. You know, weve had big small deals and small small deals. The agreed framework of president clinton 1994 was a big one. President obamas deal in february 2012 was a small one. None of the small deals worked. The North Koreans always renege. What we have to do is what i think trump talked about before. That is the North Koreans give up everything and then they get everything. In other words, its a selfenforcing deal. Alicia on the democrats he talks a little bit about biden and obama but i want to go to the sound bite here from Vice President biden on trump and north korea. Take a listen. He gave kim everything that he wanted. Legitimacy. He ended our relationship with south korea and japan as a united front and let china off the hook. He said i love the man. He hadnt done a thing. Kim jongun, what have we done . Suspended exercises. Alicia that was this morning. The president completely disagrees with the way the Obama Administration handled north korea but does the Vice President have a point here . He has some points and wrong on others, for instance, kim jongun hasnt done a thing thats true. He has ramped up production, upgraded facilities and also when you look at what kim jongun has been doing, he did get legitimization from the handshake and walk into north korea. On the other hand china is now pushed to the sidelines because of President Trumps diplomacy. Thats very important because china over the course of two decades has been a malign influence on denuclearization talks. President trump can claim that as a victory. He is dealing directly with the North Koreans. The chinese arent in the room. This is a process and if it works out all the criticisms from Vice President biden and others will fall away. If it doesnt work out, President Trump will be in a very difficult position. But this is going to be a long, long process. The North Koreans arent going to be helping. Alicia it seems like a forever game. There are a few steps forward, a couple steps back. Everybody goes sideways sometimes. Should americans think it is actually going anywhere . I actually think it is. If you look the middle of may of last year President Trump had the most successful north korea policy of any president. The North Koreans were making all the concessions and we werent making any. After the middle of may we started making concessions and the North Koreans werent. He said i will give kim a onetime shot to disarm. Theyve had a little more than that now. President trump can go back to the policies that made him effective. Those policies were the vigorous enforcement of sanctions that put the North Koreans in a place where they had to deal with President Trump. Jon new tensions are iran as their president says iran will take the next step in increasing its uranium enrichment closer to weapons grade levels on sunday after the British Military seizes an iranian tanker in gibraltar. What do you think about the iranian threats to amplify its uranium enrichment . Theyve always said their uranium was for peaceful purposes . Iran is between a rock and hard spot. Its like theyre in a box and bouncing against the walls looking for a way to get out. So one of the strategies here is to breach the agreement and essentially hoping that the europeans would be so fretful about this that they would do something to either ease the economic pressure on the iranians or somehow push the United States to do something. Instead it looks like in the end the europeans are likely to put sanctions on iran and ironically in a way to try to save the deal to show they are still committed to the deal by insisting iran comply with the deal. I dont think the iranian strategy will work well. Jon it doesnt seem like it gets them anywhere. They wont win any concessions from the United States and doesnt sound like the europeans either are inclined to relax the sanctions on iran because they are threatening to ramp up uranium production. It actually shows the deep flaws in the iran deal. It wasnt a break, just the push button. If the iranians at the flip of a switch proceed back on a Nuclear Enrichment program and back on the path to the bomb, what were the benefits of the iran deal with begin with . Jon the president seems to be not in a mood to accept a lot of iranian aggression and they have been acting up lately. Listen. President trump well see what happens with iran. Iran has to be very, very careful. Jon he postponed or called off what was intended to be a response against iran after they shot down one of our drones. I imagine there is still plenty of Iranian Military hardware in the crosshairs of the u. S. Military right now. Right. The u. S. Policies is in a good place. He put pressure on the iranians and the iranians helped them by making them look for dangerous and more pressure on the europeans. The Oil Sanctions have been very effective to the point that iranians are almost afraid their economy will shut down. I think what the administration has to do on the one hand people will say you need to back off because the iranians will do something dangerous. Indeed, there are forces in iran that want to do whacky things and they might try something. What the United States has to keep the pressure on. It has them right where they want them. At some point the iranians will want to come back to the table. On the other hand somebody in iran may do something stupid and the United States has to be disciplined and showing it wont mess with that but not escalate. They need to stay right where they are. Jon talk about that term proportional. That was a 40 Million Drone they shot out of the sky and all the oil tankers that we have pretty clear evidence were sabotaged by Iranian Forces in small boats. Why not aim a drone at one of the small boats. Would that be disproportional . Thats an act of selfdefense. Honestly, kind of the drone thing is on us. We should not have left our drone that vulnerable. We should have certainly considered that kind of iranian response. So i really wonder if that was our finest hour there. But i think that well protect our assets and weve made that very clear to the iranians. And were talking about living human beings. If they go something with a live human being on it and threatens to hurt or till them that asset will get taken out. Iranians know that and thats proportional. Nobody in the world would take us to task for that. Jon the iranians are threatening again to ramp up their uranium production. They dont need it for power plants. The only purpose that could be served by this highly concentrated uranium is weapons, right . Look, they didnt need enrichment at all. Under the npt they shouldnt have had enrichment. One of the ultimate sins of the iran deal was we let them have enrichment. When you can enrich you can make the stuff for a bomb at some point. If we had taken that off the table. If they let them keep the Nuclear Power plants but given up the capacity to enrich uranium we wouldnt be where we are today. The original sin was obama got us to this point. We put the Pressure Campaign in place. Iranians came to the table and then he basically let them do whatever they wanted them to. Were back where we started. We cant repeat the sins of the past. Look, weve also got to realize at some point the iranians have to come back to the table. They know that. Theyre looking for a facesaving way to do it. Jon thank you very much, james.
