In this case according to police the alleged gunman, john earnest is an antisemite and selfavowed white supremacist. Where was the gunman. Why did he stop . Now we know. A longtim member of the congregation, 51 years old. Veteran, he heard the shots, saw the burst of gunfire. Yelled and bolted help shooter immediately. Who was carrying an assault style rifle with a sling over his shoulder, attack vest with several magazines. The gun jammed. But with stewart closing the gap the gunman didnt have a chance to reload and ran into the parking lot. When i yelled at him he dropped the weapon and started to run. He looked at me in awe, dropped his weapon and ran. There were 100 members inside the sanctuary. Had the gunman gotten inside the rabbi said it would have been a bloodbath. One dead, three injured. Stewart was joined by off duty Border Patrol agent Jonathan Morales firing five shots from a gun that was set aside for Law Enforcement members of the synagogue. Still the gunman was able to get off several rounds. He took the life of a close friend of the rabbi, friend lori kaye. She died in her husbands arms. Her dear husband, dr. From top to bottom stewart told me the time of the shooting took about two minutes. 16 minutes from the time the gun was fired until captured by san diego police. Therefore, members of congress should be the ones doing the question. He remains happy to engage with members on their questions regarding the Mueller Report. David, democrats are running the house now and democrats have decided they want their staffs, including lawyers, to ask questions of the attorney general. He appears not to like that idea. Look, im not surprised. I think its a good move by democrats to try to get their lawyers and expert staff to question the attorney general because you are likely to elicit more information with pointed questions by professionals rather than the usual grandstanding you get in these sorts of hearing from a member of congress. A lot of them arent going to be legal minds or expert in this. The questions are not going to be as sharp, not as knowledgeable, and for all of those reasons i understand why the attorney general wouldnt want to submit to these new guidelines. Because its going to look much better for him and he will have the upper hand much more likely i would say if he is the one controlling how the question and answer session runs. And given his deep experience he served as attorney general before this, his legal experience and understanding of everything, he will end up coming off better if he is dealing with a lot of lawmakers that have all sorts of agends. Its ultimately a political question. Jon these things are nailed down well in advance. Are the democrats changing the rules . Sure. So what . Thats what they do and thats what republicans do when the shoe is on the other foot. When there is an adversarial relationship will often try to gain the upper hand by changing the rules. Catching the people appearing before them off balance to try to gain a political upper hand and to try to gain an advantage in terms of getting information. Whether you are republican or democrat one of the most common refrains i hear when i talk to voters, they think a lot of these Committee Hearings are jokes, nobody is really trying to get information thats relevant. That everybody has a political point to score. In some ways changing the rules to have staff ask pointed questions is a way to avoid a lawmaker that doesnt know what he or she is doing. On the other hand i understand completely where the attorney general is coming from. Thats not what he is looking for. He is in a much better position politically saying theyre not interested in information or what is in the Mueller Report. They want to get the president and theyre coming after me as a proxy. He will resist being talked to by staff and lawyers and democrats are going to push for this. Ultimately it will be resolved but they are probably trying to see how far they can get with this. Jon jerry nadler over the weekend said the witness is not going to tell the committee how to conduct its hearing period. But if the witness decides not to show up nadler is threatening to subpoena him. How would that go over . Well, i think you would see the reaction along partisan lines. Republicans would say they were going overboard. Democrats would say theyre doing whats necessary in order to get a key member of the administration on this topic before the house. And look, House Democrats are right in one regard, you might say, and that is its their committee and their majority. They can run it any way they see fit. Up to voters to decide if theyre being unreasonable. I think this is the sort of adversarial and aggressive oversight a lot of voters would like to see more often from congress with a president. It usually depends on who is in office. So if youre a democrat this is exactly what you want to see. What it tells you is we dont have a pure frontrunner in the past where Hillary Clinton was 65 . What we have now is a very diverse field. Name recognition at inception means a lot. Joe and bernie have the best name recognition. One poll came out. President trump said joe is weak. Vice president 6 points up on President Trump. So i think thats considered weak, well take that in 2020. Sandra how they compare when it comes to the president. Looking at the primary choice in the polling interesting when you look at the generational divide and the choice of Younger Voters for joe biden versus Bernie Sanders, there is the 17th versus the 11th for all who were asked the question we referenced. Then you divide it by age. 18 to 29 years old they choose Bernie Sanders 133 for biden. Ages 30 to 49 you still have that difference. Then you get up to the 50 and older category and the choice is clearly joe biden. I think that you cannot discount the incredible populous move that Bernie Sanders has really created in the party. Now, thats not where i am but there is no question there is a whole movement there. Could be 25, 30 of the vote is going into that lane and today divided up between Bernie Sanders as Elizabeth Warren into the primary season. That being said all the candidates, sandra, are checking the boxes off on Climate Change, healthcare, immigration, gun reform and i dont think you need more than that. You have to say that you are for progressive key issues but we are going to have a vote on who can beat President Trump. The wall street journal cites faa and industry officials that pilots and airlines did not know for more than a year after the max 8 was introduced in 2017 that boeing had deactivated the cockpit light that warned of an angle of attack disagree alert. Reported frequently they made the light an added cost feature. A decision rescinded in the aftermath of the crashes. The two recent crashes of max 8 planes have been linked to faulty angle of attack vao ens, the sensor on the left side of the plane was broken off either by a bird strike or debris. It would have triggered a warning light had one been installed in the plane. According to faa emails one faa official said six weeks after the crash of the lion airplane it would be irresponsible to have max airport operating with angle of attack disagree Warning System inoperative. That said the story is mostly old news im told by former ntsb board member. The existence of a warning light would have been helpful at High Altitude when the pilots arent scanning the Instrument Panel but adds on takeoff when one of the pilots is dedicated to monitoring all of the instruments, the warning light would not add an additional substantial improvement because they are already monitoring all the instruments. As all max planes remained grounded faa and boeing are having a software tweak, the automated pitch control system to pitch the planes nose down for the tendency to pitch up of the full power. Sandra the president sounding off on what he calls a broken immigration system slamming the courts for a massive backlog of immigration cases due to the surge of migrants at our southern border. Lets bring in tom dupree former assistant attorney general. The president is criticizing the Immigration Courts for that backlog. This is the apprehensions at the border if we want to start there first. You look at what is happening now. 53,000, more than that in the month of march. Compare that to just january and then, of course, look back a year ago at those numbers and you are seeing a surge of family unit apprehensions at the border. Here is the Immigration Court backlog that the president was referencing there. Nearly 900,000 cases back logged in the courts. Thats at the end of march this year, tom. Thats a problem. It is absolutely a problem. Frankly, its stunning to me that were seeing these numbers and that there still does not seem to be a consensus in congress how to fix this system. This is intolerable what we have here right now. The border is in a state of chaos and disorder. There are people in washington who are focused on a solution saying it cant continue. We have to do something to manage this system. But it is very frustrating. Those numbers the problem is not going away. Sandra address the apprehensions of family units at the border as well. The president is certainly using this in his argument and his description as to why it is a crisis at our border. For sure. Look, the fact is when you have people showing up with children in tow, for one thing it means theyve already endured what in all likelihood has been a very dangerous trip from wherever they began to the United States border. So we as the United States dont want to be in the situation of creating incentives to put children in jep or dee. The Border Patrol has a difficult decision whether you keep Families Together or separate them. The administration tried a policy of separation, that has been put aside. Now they keep family units together. No question it would create an incentive if you know there is no separation to travel as a family, which puts these children in danger. Sandra what can congress do right now . The president made the case several times in the interview the laws need to be fixed. Congress needs to act. He was very critical of congress for not acting and what are the next steps . There is certainly criticism of the Trump Administration as well for not putting out specific policy proposals to fix the problem. Absolutely. I think first it starts with increasing resources. Right now you alluded earlier the fact the Immigration Courts are overwhelmed. There is a massive years long backlog in deciding these cases. The problem is that many times you have people who come to the United States and they remain in the United States while their cases are being adjudicated. We arent processing these things quickly. Not fair and efficient justice. At a minimum we need resources in the legal system to insure everyone who comes here is treated fairly under the laws of the United States and money into border security. If you dont have a secure border if people are disrespecting our border. Sandra ask you about whats happening this week. Bring it home here with attorney general william barr set to testify before the senate Judiciary Committee on wednesday. Thursday house judiciary. It really is setting up to be quite a battle with House Democrats and william barr with him not liking the fact that they want counsel to be able to ask Committee Counsel to be able to ask questions of william barr, not just members of congress. What kind of fight are we about to see happen here . Well, i think were going to see a real battle here. You put your finger on it. The issue now is whether the staff attorneys on the House Committee will be allowed to question the attorney general or whether the questions will be conducted only by the Congress Person themselves. It is somewhat ironic. The House Democrats are acknowledging they arent capable of going toetotoe with the attorney general and they want to bring in professional Staff Members to do the questioning. I think its reasonable the attorney general is pushing back. He said im here to testify before congress not their staff. My suspicion they may reach an accommodation to either say fine, the question will be carried out only by the congressman. You allow for a limited window to be questioned by staff. At the end of the day there is strong incentives on boekt sides to try to work this out rather than have the battle get funneled to the courts. An Organization Called peach is distributing this antivaccine booklet calling the vaccination safety handbook littered with false information to convince parents that vaccinations are more harmful than disease claiming vaccines are dangerous because they have pig and monkey cells and robocalls and has a hotline for parents to listen to antivaccine propaganda. The organization compares vaccinations to nazi experiments during the holocaust. The nazis argued there their experiments for the greater good of the whole. Here is the Rockland County Health Commissioner talking about this. It is very frustrating. It is misinformation. The concern with this group is that they are affecting a population where a lot of what is decided by moms is by word of mouth. Rabbis are urging parents to vaccinate noting there is nothing in the jewish religion that prevents unvaccinated children are banned from schools in Rockland County and more than a dozen orthodox jew i shall nurses and physicians have formed the Vaccination Task force distributing a booklet of their own that debunks all the antivaccination propaganda and entering homes and Holding Private meetings with mothers to try to tell them that vaccinations are vital and important. General keane, the north koreans are claiming that they are owed they got the 2 million for warmbiers release. The National Security advisor says it didnt happen. Which side do you believe . Well, ill take that at face value. Bolton speaking for the United States government we didnt pay it. That would be consistent with the 22 other hostages detainees that the administration is able to get released from captivity. Weve never paid any money for any of that. Certainly it had a remarkable success with just over two years in the administration. I really think this is pretty despicable on the part of the north koreans. The treatment of otto directly contributed to his death and prior to that his hospitalization. Then to turn around and ask us to foot the hospital bill is it underscores how outrageous this regime really is. I think releasing this information now, john, has much to do with the failure of the hanoi summit for kim jongun. He came home emptyhanded without the sanction relief that everyone in his country at least believed he was going to get. Since then he fired his chief negotiator. I think he has been trying to leverage the administration here in terms of getting back to some kind of negotiation, as well as trying to convince his people in his country that he still is moving forward and has momentum on his side. One assumes it was just kind of thrust on him at the last minute and, you know, he felt he had to sign something. Sign anything just to get the poor guy home. I would imagine thats the case. I also suspect he probably did that in coordination with government officials. I suspect he had some kind of communication with our government and they authorized him to do that, to get otto out of there nothing full well they never intended to honor that commitment because we never do pay money to get our detainees, hostages out. It is shameful that whole incident in terms of what the north koreans did here. Jon i want to turn to iran and what the Iranian Foreign minister said to Chris Wallace of the Trump Administration and its relationship to the iranian government. So you think its israel, bolton saudi arabia, united arab emirates. Trying to exercise regime change . At least. At least. They want they have all shown an interest in dragging the United States into a conflict. I do not believe that President Trump wants to do that. In june 2018 last year when republicans ran the white house, the house and senate, there were two bipartisan bills to address immigration. That would have tackled every single thing, every item trump complained about in the interview he complained about. Trump decided not to sign the bill. Why . It wouldnt allow him to separate families. Now here we are a year later, the border situation is 100 times worse and separating families was supposed to be the thing that stopped the immigration problem and instead it failed. So what everyone should do is go back to the table and do the bipartisan funny we want to go back to last year instead of talking about what democrats in the house could do this year. There are things that could happen right now. The problem is growing. Everybody sees it but you are getting complete nonaction out of House Democrats exactly to bills point because they dont want to hand the president a victory. Why not head off in the and do something on asylum saying well provide more resources so we can do asylum properly and deal with this problem. Democrats arent even interested in doing something. Everybody agrees on. They could head off the president by doing that. They wont. You could fix the whole problem. He is a republican. He said stop the problem before it gets here. Instead donald trump has cut all the funding to those countries that would have helped stop it that is no way it would have stopped the problem. Sandra well move on to topic two. Jon a showdown is brewing in washington the attorney general william barr is threatening to cancel one of two hearings he is scheduled to attend this week on capitol hill all over a dispute about the format of that hearing. Thats something that right now they are arguing over with the Attorney Generals Office about. This is something that is just part of what weve seen on capitol hill. The democrats who control the house of representatives have been arguing with the white house over a number of different issues, whether its documents, questioning witnesses and it is also something the white house addressed earlier today. They are just acting really childish. It is almost embarrassing. Attorney general barr will go there and testify tomorrow in an open hearing and you see the counter side to that is the house wanting to have staff and others interview attorney general barr. It really is outrageous the way theyre behaving. Jerry nadler said the attorney general wont tell the committee how to conduct the committee. If the attorney general doesnt show the committee will subpoena him. He is scheduled on wednesday before the senate Judiciary Committee and thursday before the House Committee. You have a number of Senate Republicans are looking into what were the origins of the Mueller Report and the investigation of the special counsel. I think barr is totally right here. Its disrespectful to his position and an abdication of duty by the people elected to do that thing. Like they did with kavanaugh on the supreme court, the whole time like they did to nixon and clinton and done to everybody else. He is the attorney general of the United States. Frankly so far he has been acting like an accomplice. He wont provide an unredacted. Jon thats pretty strong. He misrepresented the Mueller Report and held onto it. I dont think he did. He is not providing an unredacted copy to congress which they are entitled to have. Sandra i want to give equal part on the panel. A lot of the things you said there mary anne are not true. Theyre not fact. By asserting them on television doesnt make them a fact. I think the report showed there was no collusion and bill barr explained why there are no obstruction charges. A series of debates a couple months away. When it starts to happen well see where this thing breaks out. You have joe biden first elected to the senate in 1973. First ran for president in 1988. And then you have at the other end of the spectrum Pete Buttigieg who was nine years after biden first got elected to the sentence before he would be born. You have a pretty big swath of individuals agewise running. The two folks at the top of the sphere now Bernie Sanders and joe biden are over 70 years old. You have a lot of younger folks in the Democratic Party as well. Well see where this breaks out, though. Youll see a lot of ups and downs before this nomination is clinched. Jon President Trump does not seem particularly perturbed by joe bidens joining the race. Here is what he told Maria Bartiromo on sunday morning futures. Jon a lot of democrats think joe biden is the guy who can beat President Trump, sean . I think a lot of democrats just want anyone who can beat trump. You look back at the president s accomplishments. We saw gdp numbers come in higher than expected. Job creation continuing to do well. This president has done what he said he was going to do and run on a record of accomplishment. He won 306 electoral votes. The gop hadnt put some of those states in their column since 1988. The biggest problem for the Democratic Party is that these elections will come down to a big choice, a contrast. The democrats all 20 of them are continuing to run to the far left socialism extreme. Drawing a huge connection between a president that has accomplishments and a Democratic Party that has crept further and further to the extreme. Sandra not all of them are touting socialism. Some are. Here is the latest polling abc, Washington Post poll on 2020 choice for democrats. So far joe biden as weve been discussing leading the pack early on at 17 to Bernie Sanders 11 . The generational divide is what gets very interesting when you break the polling down by age, sean. Those age 1829 years old go for Bernie Sanders. And those over 50 largely go for joe biden. Look at that 27 to Bernie Sanders 6 . The funny thing ive found this fascinating. Bernie had this same kind of issue last cycle which is here is this older gentleman that believes in socialism thats really attractive to young people. I have had the opportunity over the last year to visit several College Campuses and i ask students who do you want . They are still by and large want bernie. It is an interesting contrast they get younger, new generation hipper candidates and still want to go with the old white guy. Jon Pete Buttigieg is doing surprisingly well for a lot of people. The mayor of south bend isnt a nationally known figure but generally number three in the polls. He is the guy that one would think the young vote would be flocking to. This is where i think a lot of folks continue at least from an analysis standpoint they look at the different demographics and try to assume based on that thats where they are going. When i talk to young people its because of the issues that bernie champions that theyre in support of. I think that too often weve tried to look at the democratic race through the lens of what demographic do they fit, what gender are they . What color are they and their ethnic background as opposed to what are their big issues . Thats where you see a lot of energy in the Democratic Party focused on people championing the big issues. Climate change. Jon what is it that bernie espouses that young people love so much . This idea of equality and socialism that he has embraced, medicare for all, free student aid, all of that stuff sounds very attractive to young people and its where there is a lot of energy. Bernie has gone around talking about this for decades. I think for a lot of these students they think its a great idea. Sandra as for how President Trumps campaign for 2020 plans to run against that here is brad parscal. Jon were bigger and bader than 2016. We arent there trying to prove we can do something. The president has. Now we have to deliver what he has done. Sandra bigger, better, bader than they were in 2016. What does it look like to you . It means these elections will come to getting out your folks data and ground game will be more important than ever before. The combination of this Trump Campaign, this message, this candidate with the Republican National committees ground game and data operation have only grown stronger since 2016 and i think are going to give an insurmountable edge when it comes down to it in these days. We won michigan by 10,000 votes. Pennsylvania 40,000 votes. That kind of operation is what gives you the edge in the battleground states and it will put us over the top again this cycle. He told Border Patrol agent Jonathan Morales who on saturday retrieved that weapon, chased and fired at the gunman five times forcing him to flee from the parking lot. It was too late for goldsteins friend, lori kaye. Who took a bullet intended for the rabbi who had been hit in the hand by the alleged gunman who entered the lobby wearing sunglasses, a tactical vest and loaded with ammunition. Here is a young man standing with a rifle pointing right at me. And i looked at him. He had sunglasses on. I couldnt see his eyes. I couldnt see his soul. The rifle apparently jammed with another member charging him, the alleged begunman, jonathan earnest, fled before entering the jampacked sanctuary during passover. From the time of the first 911 call of shots fired to capture by police, the incident took only 16 minutes. This is what it sounded like on police radio. The alleged gunman is a Nursing Student at nearby call state san his father is a high school teacher. They didnt know about his thoughts or plans and going through his social media. Good morning. The white house staff is expected next week to deliver a proposal to the president for a meritbased immigration system for the United States. The president , of course, has been calling for a meritbased immigration system since the campaign. Both of which draw fierce opposition from democrats but the president is saying, as you mentioned at the top. William barr may be a no show on capitol hill when it comes to the house hearing thursday threatening to cancel scheduled testimony before the House Judiciary Committee on the Mueller Report. At issue is a dispute over the format of that hearing and who will be allowed to ask the questions. Lets bring in john bussey, associated editor of the wall street journal and fox news contributor. He said he agreed to answer questions before congress and now jerry nadler says we want to bring in staff to ask the questions. What happens . Nadler wants it to be deep. Not just the members of congress to be able to ask questions but wants to have lawyers on hand to ask questions as well. Sandra is that a fair request . Usually its the members that are asking questions. On the other hand you can do lots of different ways of handling a hearing in congress. Barr has a bit of a credibility problem with the democrats at this point feeling they way put too positive a spin on the Mueller Report. They want to get deeply into his thinking about the report and much more deeply into the report. Sandra you know how the department of justice is responding saying william barr wasnt asked to appear before this committee. He volunteered to do so. He didnt have to make the Mueller Report public. He did that. Theyre making the case its all political. Youll hear it from both sides at this point. Its probably important to realize the Mueller Investigation is ongoing. The Mueller Report was received, it did not reach a conclusion on obstruction. It did not make a recommendation on obstruction. Thats what the democrats want to get to the bottom of. Did just the internal rules of the department of justice hold mueller back . Should congress be interpreting those rules differently and finding obstruction on the part of the president . This investigation process is ongoing and getting in the way of other types of legislation that needs to get done. Sandra tom dupree joined us earlier and made this observation. Somewhat ironic, the House Democrats are acknowledging they arent capable of going toetotoe with the attorney general and asking him questions so they want to bring in their professional Staff Members to do the questioning. Its reasonable that the attorney general is pushing back. Sandra he is there to testify on the process of the Mueller Report. He is making a very simple observation, congress has been put in place by the American People to ask the right questions, cant they . Congress can bring in lawyers if they want to. I think its a political spin on a controversy at this point. Interesting to see whether barr holds fast and decides not to appear because congress can then subpoena him to come in and answer their questions. Sandra you think they would go that far . They probably would. Nadler wants to pursue these issues. Very difficult situation for the Democratic Leadership in congress. They dont want to push it too far to seem theyre making it the only issue going into the election of 2020. Sandra what do they think theyre going to get from william barr this week . He is in front of the Senate Committee on wednesday, house on thursday possibly. Well see what happens. They get a benchmark on his thinking and his Decision Making on the Mueller Report to compare to what mueller is going to say when he comes and testifies and when others come and testify. The president is keeping this in the news. He is now saying he never asked mcgahn to fire mueller. He is contesting elements of the report. This is contributing to the body of discussion around the report going into the 2020 election. Democrats dont want to seem to be singularly focused on this issue. First of all, every biden speech is a slip of the tongue speech but yeah, he wants to be a progressive democrat while pretending that he can hold on to the blue collar base. Those things dont go together. The blue collar base is not progressive. The blue collar base is the modernday version of the Ronald Reagan blue collar democrats. But these charges were focusing on today are on about avenattis work for other clients. Cases in which he won millions of dollars on their behalf but then, according to prosecutors, pocketed much of the money for himself. Sometimes giving the client small advances to put off suspicion that he was stealing from them according to prosecutors. He faces 36 charges in all including wire and bank fraud and if found guilty could go to prison for the rest of his life. Avenatti also faces separate charges in new york where he is alleged to have demanded millions of dollars to stay quiet about claims nike was paying high school athletes. Now, avenatti you might remember once considered challenging President Trump in 2020. If he is found guilty on any of the charges he is likely to be otherwise occupied next year. The state of illinois has an interesting procedure whereby any adult citizen who suspects that a prosecutor has a conflict of interest can file a petition with a judge. The presiding judge of the county in which the prosecutor works and ask the presiding judge to appoint a special prosecutor to investigate the one you think has the conflict. So back to cook county, illinois. Where kim foxx has an obvious conflict. She has friends of friends with people who spoke to her and said this is jussie, our guy, can you do something for him . So a retired Illinois State appellate judge in her private capacity filed a petition with the presiding judge in cook county saying would you please appoint a special prosecutor to investigate kim foxx and would you authorize that prosecutor to subpoena her so she has to answer under oath. Did you or did you not recuse himself. Why did you give him a sweetheart deal and not give something up in order to get the sweetheart deal. I think the petition will be granted. I think the cook county judge will appoint a special prosecutor and that person will decide who he wants to subpoena and what he wants to ask. Jon does this all mean that Jussie Smollett could face state charges once again . No theyve been dismissed and gone forever. The only charge that there could be against him would be a federal charge such as postal fraud, what we used to call mail fraud because emailed the theory of the case now, not saying i personally know he did this. Emailed a letter to himself, a threatening letter to himself at address fox chicago. That would be putting a fraudulent instrument into the mail. Its up to the feds whether or not they want to prosecute him. However he got the charges dismissed theyre gone forever and why the police are so animated about it.
