The idea is if he is hoping to claim 8 billion, maybe 4 or 4 1 2 billion doesnt get challenged it would give him a good start. I think youve heard a number of lawmakers suggest that this has to be fleshed out but also important to point this out. But above all else how many president ial executive orders have been overturned by the courts and then sustained by the Supreme Court . Thats what the white house is banking on here. Based on what were hearing, do you approve . Support the border wall, something thats needed. In the area of operations. We have 170 miles of border and 0 border walls. We dont understand. We know the conferees met for three weeks. Why they came up with this decision we dont understand. They did not listen to the Border Security experts on the wall or immigration. You run across the border in texas we have very Dangerous Drug Cartel that conducts human and drug smuggling to include human trafficking. We only have two miles of river roads in that area out of the 170 miles of border that we have in laredo only. If you get what youre looking for, what would it take to accomplish the mission. This one does have funding but we were coming to the table and the president threw his hands up because it didnt have full funding for his wall and whenever you dont get what you want you dont just declare a National Emergency and run off to the golf course. And so i think that the American People will need to decide and were excited to showcase these candidates. Dividing the field over two nights if necessary. And requiring candidates to meet either a fundraising or a polling threshold to participate. I think that what is happening right now is we could have up to 20 candidates in the race but we want to make sure were providing a level Playing Field so that every candidate and their supporters feel like they got a fair shot. You know, we believe that starting the process in june, having 12 debates, 6 in 2019 and 6 in 2020 will be ample time and discussion to talk about the issues. We want these debates to focus on policy issues. We dont want them to focus on hand size like the republican debates did last time around. Police identifying two brothers from nigeria in persons of interest for the attack on the empire actor Jesse Smollett. Where are we now . Police are not confirming this flood of information that came out yesterday dramatically stating the attack on actor Jesse Smollett was staged and with his cooperation. On the same day he went on Good Morning America to say he was very upset with people who werent believing his story. Chicago police picked up the two men who appeared in that grainy security video. They were only persons of interest. No charges, not yet. Multiple outlets reporting that at least one of them was an extra from the show empire and these men staged the attack in cooperation with smollett. Also reporting the persons of interest were picked up at the ohare airport. The police threw cold water on that. A statement came from chicago p. D. Saying we havent found any video documenting the alleged attack, there is also no evidence to state this is a hoax. The alleged victim is being cooperative at this time and continues to be treated as a victim, not a suspect. Now the persons of interest are lawyered up. So weve had testimony here on capitol hill from two other witnesses that would suggest what andy mccabe is talking about actually is true. Here is what we also know. Theyre talking about the president being a russian spy . Well, they were saying that when andy mccabe was trying to get a promotion. When bob mueller was trying to become the f. B. I. Director. So if they thought he was a russian spy, why were they trying to get a job with him and a promotion with him . It doesnt add up, bill. We need to get to the bottom of it and hold people accountable. The American People. Your viewers want some people to be held accountable. I for one am not going to yield and give up on this. When you look at the president having to take these kinds of measures, it is because congress has failed this president and the American People. But for nancy pelosi to suggest that this is setting a precedent, weve had National Emergencies declared prior to this president. If she wants to do away with it ill be glad to work in a bipartisan way. But until then the law of the land allows this president to do what he is about to do. I support him fully. Here is a sample of what were picking up. First of all you have to look at what the president s Main Objective is, to keep america safe. Not just a Campaign Promise. Current law blocks the president from building wall in the area. This agreement will remove those limitations but not as much as the president or i would like to see. There are other areas the president can go. The president is running around congress and the power of the purse. Youve heard me say over and over again. Article 1, the legislative branch. Many other powers listed in the constitution and of course the responsibility to have oversight. So the president is doing an end run around that. Bill nancy pelosi there. Now we have reaction across the board. Chris wallace in washington Andy Mccarthy with the legal analysis with john roberts begins this hour from the north lawn. Where are we now . Good morning. Good morning. Things a little bit delayed in the rose garden. We expect the event will start soon. What the president will announce he is signing the appropriation bill that they received late last night and in addition to that he is going to declare a National Emergency. This morning the white house laid out the pots of money that the president will be putting toward border wall constructions. Put it on the screen to follow along. The 1. 375 billion from the dhs appropriation. In addition to that, the president has found some buckets of money elsewhere in the administration. Elsewhere in the government that he can use. 600 million from the treasury. As much as 2. 2 billion rerammed from other areas of the department of defense that section 284 and then this is the one that he needs the Emergency Declaration for. It is section 2808, the military construction budget. The president plans to take 3. 5 to 3. 6 billion from that. Each one of these pots of money comes with a certain amount of risk and there is escalating risk on top of that. The 600 million from treasury is the easy one. They can use it for anything they want. Easy to get money from the drug interdiction program. Moving some of that money may catch the eye of some folks in congress and may invite a legal challenge. Then they absolutely believe that the Emergency Declaration and tapping into the military construction budget will invite a legal challenge and howls of protest from members of congress who want to see that money go to construction on military bases in their district. One thing that the white house is not going to touch. Democrats made a big deal of this over the last few weeks saying the president would tap into Disaster Relief money. They arent touching a dime of Disaster Relief money. They do believe they will end up in court on at least some of this. They think between the dhs appropriation, money thats free and clear theyll end up with 4. 6 billion. They want to get the entire eight. Theyre prepared to go to court to fight this. Bill stand by from the north lawn. Chris wallace, the anchor of fox news sunday. This is something the president has been talking about for three years now from a policy perspective, how does it look today . Well, there is no policy if he cant make it happen. Thats going to be the big question. First of all there will be a fight in congress because under the National Emergencies act of 1976, congress has 15 days to pass a resolution of disapproval. That will almost certainly happen. Simple majority in the house. They will disapprove the president s declaring a National Emergency. Then it will go to the senate. Thats pretty interesting. The senate there are 53 republicans. If all the democrats were to vote for the resolution of disapproval plus just the republicans who are on the record now, about 4 or 5 saying theyre very concerned about this as a potential violation of article 1 of the constitution, which gives congress the power of the purse, you can get a resolution of disapproval on the president s desk. The president can veto that and there is almost no chance that congress would be able to override it. But this would be the first veto by the president since he took office in 2017 on a question of declaring a National Emergency and according to some members of Congress Going around the will of congress. Then there is the whole constitutional and court issue because you know a variety of people. House democrats after he vetoes a resolution of disapproval whether its local officials, private property owners, they will take this to court. As we saw with the travel ban and with the dreamers, usually you can get a Federal District court at least to say that this is unconstitutional. The president is stepping over his powers. Now, in the case of the travel ban the court Supreme Court ended up siding with him 54. This could be tied up in the courts for a long period of time. Sandra well talk more to Andy Mccarthy about that in a moment. Chris, the reaction continues to pour in from capitol hill both sides of the aisle. Democrats firmly against this move or potential move. We havent heard him announce it yet for declaring a National Emergency. Republicans mainly supporting the president but have heard some on the right speaking out against it. Marco rubio has put out a statement. John cornyn has expressed his displeasure with this move by the president. Susan collins, rand paul. There are some on the right who say that they dont want to see this happen. Well, thats right. And i think there are two reasons. First of all, the constitutional issue. Article 1 of the constitution which specifically gives congress the power of the purse and does not say that the president can sit and take any money that congress has approved and repurpose it. If he wants to repurpose some of the amounts john roberts was talking about, he is supposed to go to the chairman and the ranking opposition member of the House Appropriations and Senate Appropriations committee. So first of all the president would be doing this without their approval. In the case of the house they would certainly disapprove that. So youve got that aspect of it. Also there is the question of precedent. Nancy pelosi the House Speaker brought that up yesterday said look, someday there will be a democratic president. What happens if that president says we have a National Emergency with gun violence or Climate Change that republicans will howl about that. You are exactly right. At least five republicans on record. Not saying they would vote for a resolution of disapproval but dont approve what the president is doing. If they go with the democrats, then that will pass the senate as well as the house. Bill what you are describing is a series of variables we dont know how it will play out, chris. Look at it from a political standpoint then. Youll come quickly into an election season and what would be the message from the president as to how he sells the best effort that he could possibly get out of congress on this . Well look, you can be cynical and say that the president fully understands. Supposedly the White House Counsels Office said that this is to declare a National Emergency a high litigation risk which seems to be something of an underat the same time. Clearly this will go to the courts. You could argue what the president figures, even if they block me from the National Emergency, i get whatever money im able to get and at least the 1. 365 that congress has approved and i have certainly demonstrated to my base ive done everything i could possibly do, including declaring a National Emergency, going up against congress, going into the courts, to fight to keep my promise of 2016, which was to build a wall. So it certainly would play well to his base including some members of his base who have come out and said if he signs just the bill that was approved by congress yesterday, that that would be terrible. So he can at least say to them ive done everything i could to get the money for the wall. Sandra want to get nancy pelosi in here ahead of the president s announcement. Here she is. We wont review our options. Well be prepared to respond appropriately to it. Some republicans have unease about it no matter what they say. If the president can declare an emergency on something that he has created as an emergency, an illusion he wants to convey, just think of what a president with different values can present to the American People. Sandra the president is a few minutes away from making that announcement. She is saying its an illusion. If you look at the statistics four times as many people were coming over the border in the year 2000. 1. 6 Million People were apprehended coming across the border in 2000. Last year it was less than 400,000. So the argument could be yes, there certainly is a problem and yes people are coming over the border but it is only a fraction, 25 of how many people were coming over in the year 2000. So what National Emergency . Of course, the president will say its a different group. A lot more families, they are coming from Central America. Under the rules a law passed in 2007 or 8 i believe they arent allowed if theyre from Central America as opposed to mexico to return them right away. The president will make the case its a National Emergency but you can be sure there will be plenty of people on the other side who will say it isnt. Sandra Chris Wallace, thank you. Thank you. Joining us now is Andy Mccarthy former u. S. Attorney and tell us whats next if the president declares a National Emergency. Well, as chris said, whats next is two things. Probably some action in congress but as well as immediately they will be in court. The interesting thing about the resolution of disapproval that chris was just describing is when the National Emergencies act was passed in 1976, the idea was not that congress would do this resolution and then it would go back to the president to determine whether to veto it or not. It was actually initially passed as a legislative veto. That is, the president wasnt supposed to have this unchecked power. The legislature or the congress kept for itself the ability to basically cancel the National Emergency if the president declared it. Now, the Supreme Court in an unrelated matter a few years later invalidated the legislative veto as a matter of constitutional law. But i do think a court looking at this would say number one, when Congress Gave the president this power, it intended for there to be a check. And if the congress were to come back and do the resolution of disapproval, even if the president were to veto it, i think it would be a very powerful element that the court would evaluate in deciding whether to uphold what the president has done or not. Bill john roberts and others working on this. The breakdown of possible funding sources. What is it, 600 million from the Treasury Departments drug for tour program. 2 1 2 billion Defense Department. 3. 5 billion Defense Department military construction budget. If you look at that, some of that money, andy, is considered easy money as they say in washington might blow peoples mind but some of it is more difficult to get to. If you look at john roberts reporting here. If the president wanted 5. 7 billion for Border Security in the southwest, the easy money could total up to 4 1 2 million. That gets you very close. And he could frame it that way while the remainder of the funds remain locked up in litigation. There is a lot right now that you could access apparently according to our reporting so far. Yeah. When john was going through that, bill, the thing that occurred to me was i was thinking about when president obama, as part of the iran deal, made the payment to iran that resulted in the release of the hostages and i cant remember how many, i think it was two or three billion were involved. They managed to find it. I think it was the Judgment Fund which is kind of a slush fund of money that is available for various things that they are able to tap. It just occurred to me as he was running through these different pots of money you just talked about how much easier it is to do this when you go about it quietly. And i think part of the reason that President Trump is going to have much more trouble accessing what would otherwise be easy money is the fact that he so raised the attention of everybody to this with respect to the wall and the funding for it that every penny is going to be looked at here in a more exacting way than it might be if you went about this a little bit more quietly. Sandra i want to run this by you because some of the lawmakers have put out statements about where they stand on the president taking this action. Marco rubio said this, we have a crisis at our southern border he agrees. Todays National Emergency Border Security. A future president may use this same tactic to impose the green new deal. Ill wait to see what statutory or constitutional power the president relies on to justify such a declaration before making any definitive statement but i am skeptical it will be something i can support. He is talking about the precedent that this sets. But that last second to the last sentence stuck with me. Ill wait to see what statutory or constitutional power the president relies on to justify this. So what will you be looking for specifically from the president here in the wording of his statement when he begins a few moments from now . I think senator rubio is right about that. In fact, i was pleased, although not terribly convinced i was waiting to come on. Any time you hear nancy pelosi sound like James Madison is a good day. I think rubio is correct to say here is the problem. The president really shouldnt have this power. This is legislative authority that he is really executing in nature here. But lets wait to see exactly what he does and what the precedent is for how the courts have handled the different provisions he may try to access in order to gather this money together. I think as a matter of general principle, the president shouldnt be allowed to legislate. I dont think the president , other than in dire emergencies like an attack or natural catastrophe, the president shouldnt have this ability to just declare an emergency and start to legislate and move money around. Thats what congress is supposed to do in the system. But when you ultimately make a decision and you are dealing with a concrete set of facts, you have to look at exactly what statutes the president relies on and what the precedents are in interpreting those statutes. Bill hang with us for the next hour or so. What i hear you saying you can characterize it as a split decision. Fair . Well, i guess so. But again we have to see exactly what he does and how. I think this is really weve been talking about this for weeks. I think he is kicking this to the court and everybody will retreat to their corner with their political issue. The democrats will be able to tell their base. He will be able to tell his he tried as hard as he could. Bill some of the funding for the border will go forward so you can make the case that you are getting a more fortified border as you work your way through the courts. Senior Administration Official telling him the president will move a billion in currently appropriated what is considered available funds toward construction of a wall. But there are a lot of variables in play after the president makes his decision. But given the move on behalf of the spending bill yesterday in congress that overwhelmingly passed the senate and in the house after a 35day shutdown that started more than a month ago, it has come to today. This announcement has gotten delayed since the top of the hour, john. Its likely to happen soon. Yeah, we did get a twominute warning 3 1 2 minutes ago here in washington they tend to be more of a suggestion than anything. We expect the president will be coming out very soon. He will announce that he has signed the bill. I dont see a table up there. He wont sign it in front of us and then he will declare a National Emergency. In terms of the money that bill was talking about a second ago, there is only a certain portion of it that requires the declaration of a National Emergency for him to tap into, that is the military construction budget. Section 2808 portion of this money. Thats about 3. 5 billion. They also plan on taking money seized by drug lords among them in the Treasury Department for tour Program Totaling 601 million and the section 284 program drug interdiction run by the department of defense. Other money that will be reprogrammed about 2. 2 billion worth they should get to a total of 2. 5 billion. The president will be coming out in a second. What you are seeing here, i believe, behind me is some of the angel moms that this white house has highlighted many times. People who had loved ones killed by Illegal Immigrants. Back to the money again. The president and the white house believe that the money from the Treasury Department wont invite much of a challenge, if any at all. They think its pretty easy money. The money in the 284 program theyll get pretty easily they believe. As they start to move money award it gets diceier and they believe that tapping into the military construction budget, though the white house is telling us that none of the money they have earmarked is for Critical Infrastructure Construction Projects and it would be much more tailored toward the wall. It will likely involve a Court Challenge. The white house has lawyered this thing in and out for months and they believe they have a very strong stance to make should they go into court. And you can bet they probably will be taken into court in california within the jurisdiction of the ninth Circuit Court of appeals. Up until last week when they got a favorable ruling has been unfavorable to the president. Bill a moment ago we saw william barr. He was confirmed as attorney general just yesterday. Talking to Chris Wallace and Andrew Mccarthy about this resolution that could pass in congress and the president could override it. There are some republicans who will disagree with the move. I dont know how strong the opposition is. From your sources at the white house and talking with those in the west wing how do they characterize today as a victory, which is what is anticipated from this announcement . How do they characterize it as a victory, which is what is anticipated here . Sandra how do they characterize the 1. 37 billion bill the Border Security and immigration fight itself. How will they frame it . Now ive got you. The argument theyre using is were in an era of divided government. Democrats controlling the house of representatives. Republicans controlling the senate. And in divided government, you cannot get everything that you are looking for. The president is highlighting as a victory the fact that he got 23 billion in overall Border Security. Though he didnt get what he wanted for the wall. There are also some restrictions within the bill such as where they can and cannot build a wall. The National Butterfly center west of mcallen, texas, for example, they cant characterize as a win and they need to engage in extensive negotiations with local officials in five different areas in texas right on the border there. They cant characterize that as a victory. Ultimately theyll be able to build a wall. We got what we could. Were trying to backfill this as much as we can with the other and lets try to change things around in the 2020 election. Sandra anybodys guess how strong the opposition to this declaration will be when it comes to the house and senate. We have the twominute warning and were waiting on the president. That was five minutes ago. Sandra we await the president here. What about the reaction that we have had so far . There has been a lot of it from capitol hill overnight and into the morning, john. Well, clearly democrats dont like the idea that the president is going to declare an emergency one bit. And organizations like the American Civil Liberties union and others are already sharpening their pencils preparing for the Court Challenge the moment the president comes up here. And announces that he is declaring a National Emergency. There are some republicans who dont believe the president at least the president did not win in terms of getting the money that he wanted for a border wall. The president believes the republicans didnt negotiate hard enough. But it continues this fight. What youll see today is aimed at the president s base to say he is doing everything he can to make good on his central Campaign Promise. Dont forget he is not going to get all this money all at once. The money from the for tour hell get very soon. The money from the 284 program hell get soon but the military construction budget will take time. They needed to request all this money now because it all needs to be authorized in the current fiscal year which ends on september 30th. And then when we hit september 30th they can start this process all over again. So this could be just the very beginning of the president s Battle Royale with congress over moving money around within the government to fund his border wall. Bill i believe the shot we have here it is Mick Mulvaney in the west wing in the oval office there. The measure does include a lot of things that democrats like. The measure for improved for surveillance equipment, more customs agents. Humanitarian aid for detained immigrants. There is a lot in it they can say okay. A lot in the bill they can say the president agrees with democrats that you need more technology, you need to harden up screenings at ports of entry, which is 700 million was allocated for noninvasive screening equipment but he says it only works if you have the border barrier and why he is digging in his heels here and he is demanding money for a border wall. If he cant get the money from congress he will get it some other way. Throughout this bill. I talked to a couple of Administration Officials, there are little handcuffs that are put on much of the appropriations say it cant be used for this or that. No money used for this or that. And i dont know if its an inordinate number compared to other bills. More than 350 times in the bill there is specific instructions that money cannot be moved from this to some other program which is again why the president is going for this money outside of the dhs appropriation. Sandra all right, john roberts. We have await the president at the white house. We are still waiting. He should step out at any moment now. Andy mccarthy you are standing by. If you could weigh in on the moment as we await the president. Well, i think one of the things that i would be interested in how a court will take is the kind of cognitive dissonance thats involved in both signing the Emergency Declaration and signing the spending bill which actually has provisions in it that cut away from our ability to deal with certain aspects of illegal immigration. I think it is very tough for the president to say on the one hand i had to do this because it was an emergency and on the other hand sign a piece of legislation that not only gives him a lot less funding than he wanted but actually cuts down on our ability to detain people who are illegally in the country and actually gives some immunity to people who are in the country illegally who might be in a position to sponsor the incoming Family Members, particularly the minors who are a large part of the reason why we have the crisis the president is citing in the first place. Bill can you take us through the law here and help us understand this . Presently there are 30 National Emergencies in effect. Thats as of the first of february 2019. One which goes back to november 14th, 1979 on behalf of president jimmy carter that blocked iranian Government Property. You go through this list and it is through president clinton and president s bush and it deals with sudan, the balkans, zimbabwe. There are so many more here. The republic of congo. Whats the big deal in declaring a National Emergency when you have so many of these that are still in effect today . Give us the distinction for how we should understand what the beef is this time . Well, the beef this time is political. What you are citing is a big problem that we have in the structure of our government and in constitutional law. The two problems that you have, bill, are number one, congress is very good at declaring emergencies or finding the situations that they think rise to the level of emergencies. Theyre not really good at saying okay, thats over now so lets go back to normal legislation. So you have the law really littered with these emergencies that may have been emergencies at the time but certainly arent 10, 20, 30 years down the road. And then the other problem that you have is a problem that really comes up in various iterations throughout the government, which is that congress is very happy to delegate its authority to legislature whether its the president or the federal bureaucracies, in some instances the kick difficult issues to the courts and let them resolve it. These are all things that congress itself, what we elect them for is to actually wrestle with these things and make decisions. And what you find again and again and again are these means by which they kick their own responsibilities to different components of government. Bill you talk about spending and appropriations. Thats the rub here, the beef as we say. Stand by on that. Sandra thank you, andy. We want to bring in our ateam to americas newsroom, juan williams, fox news political analyst joins us, cheryl casoney and matt gorman from the National Republican congressional committee. Anybodys guess when the president steps out to deliver the address. The white house confirmed matt that he intends to sign the massive border deal and declare a National Emergency. Your thoughts . In the short term it will get messy. In the long term a bit scary. Short term it will get challenged by the courts. Democrats will force a resolution disproving of this. Make its way through the senate. Divide republicans. In the long term it will be scary. I think nancy pelosi alluded to the fact that a democratic president could use it on guns, green new deal, medicare for all. So i think in the long term that could be a bad proposition for republicans. Sandra you are saying scary because of the precedent that it sets. Yes, because of the precedent. Sandra another twominute warning. Cheryl, your thoughts. On the Fox Business Network throughout the morning talking about the money angle of all this and digging into the numbers here. Sure, 8 billion. How that money will be spent is certainly something that investors will want to see. From a market standpoint a lot of this has been kind of noise. The good news is the shutdown was averted and the markets are celebrating that. We needed to get more news out of the u. S. china trade deal and it will pick up next week in washington at the end of the day is taxpayer money going to be spent correctly and go to border cities where you get the most inflow of immigrants . What does it mean for the Healthcare System . E. R. S and hospitals overrun with illegal imgranlts in the rio grande valley, phoenix, tucson. The broader side bar issues, an 8 billion potential barrier being put up between the u. S. And mexico will it save us money long term. Thats a question for everybody. Bill what is it about your guess in chapter 2, what happens next . Hopefully he comes out. Nba game last two minutes. It goes on for a while. The next step is that youll, one, have the challenges on a legal basis to this act. You were talking earlier, bill, about the fact that we have 30 existing National Emergencies but weve never had one involving appropriations, not one is about the president taking the spending powers that authorize for congress away from the congress. Thats what makes this very different. In addition, i think the big news here politically is something matt was talking about. That if you have a resolution of disapproval, that you will split republicans. So you are going to get people who are trying, like senator Lindsey Graham of South Carolina to support the president. Yesterday senator Mitch Mcconnell the majority leader repeated calls to the president. He thought he had a deal with the president in which it would be limited to signing this bipartisan deal without the emergency. Then he calls back and its times have changed. The president s temper has changed. So you get this deal. But for the members of the republican members of the senate in specific they were feeling look, we got the president to sign the border deal. We can move from there. Well deal with the emergency later. It is almost as if the president had a tantrum and fellow republicans are coping with him at this moment. Sandra did democrats do enough to work with the president . Oh my gosh, look, i dont think there was much doubt that republicans felt that one, they had a deal in december. The deal they had in december had more money for barriers, fencing, whatever you want to call it than what theyve got now. Secondly democrats felt they had given up eptionly with regard to the number of beds available to ice for detention. That they had given money for 55 miles of barrier fencing. Sandra lets hear from matt. This is the best deal theyll get at the time. Nancy pelosi said i wont give you a dollar for a wall. Thats not true right now. They said they wanted to cap the number of beds. Tie the hands of ice. That didnt come to fruition. I think this is the best deal they are going to get right now. Look, this could happen. This will only last until september. We can talk and see how this plays out at the border then. We might need to make a change then. Bill cheryl, in a moment here well find out what he has to say clearly. And then all these variables that weve been talking about for the past two hours will play out in their own time. What is your suggestion when you listen to john roberts, you could go ahead and get a lot of this money right now, which means the process goes forward while some of it could be delayed for two years. Thats the noise i was referencing earlier. Nancy pelosi said they are looking at a challenge. It could end up in the courts. That prolongs the issue. This could be again a speed bump. Thats the side bar, the noise i was talking about earlier. As far as the spending itself. I grew up in the middle of all of this. Ever since i was a child illegal immigration has been an issue. So glad to see its a National Story at the forefront now absolutely. But it has to be smart border control. Not just money being thrown. Look at the rio grande valley. Even john cornyn said that this is a dangerous step that President Trump is taking right now. Bill all three of you thank you and stand by. Here we go in the rose garden and the president. President trump thank you very much, everybody. Before we begin, i would like to say we have a large team of very talented people in china weve had a negotiation going on for about two days. It is going extremely well. Who knows what that means because it only matters if we get it done but we are very much working very closely with china and president xi, who i respect a lot. Very Good Relationship that we have. And we are a lot closer than we ever were in this country with having a real trade deal. Were covering everything. All of the points that people have been talking about for years that said couldnt be done whether it was theft or anything, anything. The unfairness. Weve been losing on average 375 billion a year with china. A lot of people think its 506 billion. Some people think its much more than that. Well be leveling the Playing Field. The tariffs are hurting china very badly. They dont want them and frankly if we can make the deal it would be my honor to remove them. Otherwise we have many billions of dollars pouring into our treasury. Weve never had that before with china. It has been a oneway street. Thats happening. The relationship with china is very good but i think they finally respect our country. They havent respected us for a long time. Not for a long time. The u. K. And the u. S. As you probably have been seeing and hearing, were agreeing to go forward and preserve our trade agreement. You know all of the situation with respect to brexit and the complexity and the problems but we have a very good trading relationship with u. K. And it has just been strengthened further. So with the u. K. Were continuing our trade and we are going to actually be increasing it very substantially as time goes by. We expect the u. K. Will be very, very substantially increased as it relates to trade with the United States. The relationship there also is very good. We have a lot of great announcements having to do with syria and our success with the eradication of the caliphate and that will be announced over the next 24 hours. And many other things. A lot of positive things are going on. Were working on a summit. You know all about the summit. It will be in vietnam, hanoi, and we will be meeting in hanoi. A lot of you will be going, i suspect. I hope we had the same good luck as we had in the first summit. A lot was done in the first summit. No more rockets or missiles going up. No more testing of nuclear. Get back our remains, the remains of our great heroes from the korean war. And we got back our hostages. But we hope we will be very much equally as successful. Im in no rush for speed. We just dont want testing. The sanctions as you know remain. Everything is remaining. China has been helping us and russia has been helping us. And south korea, i think you can say weve been working very closely with south korea, with japan. But china, russia on the border have really been at least partially living up to what they are supposed to be doing and thats okay as per the united nations. So we will have a meeting on the 27th and 28th of february. And i think that will be a very successful and i look forward to seeing chairman kim. We have also established a very Good Relationship, which has never happened between him or his family and the United States. They have really taken advantage of the United States, billions of dollars have been paid to them and we wont let that happen but we think that north korea and chairman kim have a tremendous potential as an economic power. Their location between south korea and russia and china right smack in the middle is phenomenal. And we think they have a great chance for tremendous Economic Prosperity in the future. I look forward to seeing chairman kim in vietnam. Today im announcing several critical actions that my administration is taking to confront a problem that we have right here at home. We fight wars that are 6,000 miles away. Wars we should have never been in in many cases but we dont control our own border. So we are going to confront the National Security crisis on our southern border and we are going to do it one way or the other. We have to do it not because it was a Campaign Promise, which it is. It was one of many, by the way. Not my only one. Were rebuilding the military. Our economy is thriving like never before. You look at other economies, they are doing terribly and were doing great. The market is up tremendously today. Not that thats anything. I will go back in and theyll say the market just went down. But the market is getting close to the new highs that we created. We have all the records. We have every record but we are getting close to that point again where well create new records. Our country is doing very well economically and weve done a lot. One of the things i said i have to do and i want to do is Border Security because we have tremendous amounts of drugs flowing into our country. Much of it coming from the southern border. When you look and when you listen to politicians, in particular certain democrats, they say it all comes through the port of entry, thats wrong. Thats wrong. Thats just a lie. It is all a lie. They say walls dont work. Walls work 100 . Whether its el paso. I really was smiling because the other night i was in el paso. We had a tremendous crowd. And i asked the people, many of whom were from el paso but they came from all over texas. And i asked them i said let me ask you as a crowd, when the wall went up, was it better . You were there, some of you. It was not only better, it was like 100 better. You know what they did . Thats only one example. There are so many examples. In el paso they have close to 2,000 murders right on the other side of the wall. And they had 23 murders. Thats a lot of murders but its not 2,000 murders on the other side of the wall in mexico. Everyone knows walls work. There are better examples from el paso. You take a look almost everywhere. Take a look at israel. They are building another wall. Their wall is 99. 9 effective they tell me. 99. 9 . Thats what it would be with us, too. The only weakness is they go to a wall and then they go around the wall. They go around the wall and in. Okay . Thats what it is, very simple. A big majority of the big drugs, the big drug loads dont go through ports of entry. They cant go through ports of entry. You cant take big loads because we have the Border Patrol, Law Enforcement looking. You cant take human traffic, women and girls. You cant take them through ports of entry. You cant have them tied up in the back seat of a car or truck or a van. They open the door, they look. They cant see three women with tape in their mouth or three women whose hands are tied. They go through areas where you have no wall. Everybody knows that. Nancy knows it, chuck knows it. They all know it. Its all a big lie. A big con game. You dont have to be very smart to know you put up a barrier, the people come in, and thats it, they cant do anything unless they walk left or right and they find an area where there is no barrier and they come into the United States, welcome. Weve detained more people, our Border Agents are doing such incredible work, our military has been incredible. We put up barbed wire. We loaded up with barbed wire. It is very successful. I want to thank our military. Theyve been fantastic. And it is very necessary. Weve broken up two caravans on their way that are just breaking. In the process of breaking up. We have another one that we havent been able to break up yet. Weve been working with mexico much better than ever before. I want to thank the president. I want to thank mexico. They have their own problems. They have the largest number of murders that theyve ever had in their history, almost 40,000 murders. 40,000. They have to straighten that out. I think they will. I just want to thank the president because he has been helping us with these monstrous caravans that have been coming up. We had one that was up to over 15,000 people. It has largely broken up. Others have gotten through. And in tijuana. You have a lot of people staying. If they we didnt have the wall they would have walked through through. One of the things we would save tremendous amount on would be sending the military. If we had a wall we dont need the military. We would have a wall. So im going to be signing a National Emergency and it has been signed many times before. It has been signed by other president s from 1977 or so it gave the president s the power. There has rarely been a problem. They sign it, nobody cares. I guess they werent very exciting. But nobody cares, they sign it for far less important things in some cases, in many cases. Were talking about an invasion of our country with drugs, with human traffickers, with all types of criminals and gangs. We have some of the greatest people i know who have been with me from the beginning of my campaign. The angel moms. Unfortunately we have new angel moms. One incredible woman just showed me her daughter who were talking about got killed in the year of 18. I said i havent seen you before. She said im new. I said thats too bad. Its too bad. It is so sad. Stand up just for a second and show how beautiful your girl was. Thank you. I have such respect for these people. Angel moms, angel dads, angel families. I have Great Respect for these people. These are great people. These are great people. Theyre fighting for their children have that been killed by people illegally in this country. And the press doesnt cover them. They dont want to incredibly. And they arent treated the way they should be. Theyre fighting for other people because they dont want what happened to their children or husband or anybody. We have one young lady whose husband, please, stand up. Your husband was just killed in maryland. Incredible man just killed. Beautiful children wont be seeing their father again. These are brave people. These are people that dont have to be here. They dont have to be doing this. They are doing it for other people. I just want to thank all of you for being here, i really do. I want to thank you incredible people. Last year 70,000 americans were killed at least. I think the number is ridiculously low, by drugs, including meth and heroin and cocaine, fentanyl. One of the things that i did with president xi in china when i met him in argentina at a summit, before i even started talking about the trade. It was a trade meeting. It went very well but before i talked about trade, i talked about something more important. I said listen, we have tremendous amounts of fentanyl coming into our country. Kills tens of thousands of people. I think far more than anybody registers. And i would love you to declare it a lethal drug and put it on your criminal list. Their criminal list is much tougher than ours. Their criminal list a drug dealer gets a thing called the Death Penalty. Our criminal drug dealer gets a thing called how about a fine . When i asked president xi, i said you have a drug problem . No, no, no. I said you have 1. 4 billion people. What do you mean you have no drug problem . No, we dont have a drug problem. I said why . Death penalty. We give Death Penalty to people that sell drugs. End of problem. What do we do . We set up a blue ribbon committees, lovely men and women. They sit around a table and have lunch and eat and they dine and they waste a lot of time. So if we want to get smart, we can get smart. You can end the drug problem. You can end it a lot faster than you think. President xi has agreed to put fentanyl on his list of deadly, deadly drugs. It is a criminal penalty and the penalty is death. So thats frankly one of the things im most excited about in our trade deal if you want to know the truth. Maybe there is no more important point. Well make billions of dollars with the trade deal and it will be great for our country and great for china, i hope. Their market is down close to 40 . Our market is way up. Weve picked up since my election trillions of dollars of worth, trillions, many trillions, and china has lost trillions of dollars. But i want it to be good for china and the United States. Well see what happens. China is coming here next week, by the way. Theyre coming home, the traders, then china is coming here next week and ill be meeting with president xi at some point after that to maybe for some remaining deals well make them directly oneonone ourselves. So were going to be signing today and registering National Emergency and its a great thing to do because we have an invasion of drugs, invasion of gangs, invasion of people and it is unacceptable. By signing the National Emergency, something signed many times by other president s, many, many times, president obama. In fact, we may be using one of the National Emergencies that he signed having to do with cartels, criminal cartels. Its a very good emergency he signed and well use parts of it in our dealings on cartels. So that would be a second National Emergency but in that case its already in place. What we really want to do is simple. It is not like its complicated. It is very simple. We want to stop drugs from coming into our country. We want to stop criminals and gangs from coming into our country. Nobody has done the job that weve ever done. Nobody has done the job weve done on the border. And in a way, what i did by creating such a great economy and if the opposing party got in this economy would be down the tubes. I hear a lot of people say oh, well, but maybe the Previous Administration. Let me tell you, the Previous Administration, it was heading south and it was going fast. We would have been down the tubes. The regulations were strangling our country. Unnecessary regulations. By creating such a Strong Economy you just look at your televisions and see whats going on today its through the roof. What happens is more people want to come. So we have far more people trying to get into our country today than probably weve ever had before. And weve done an incredible job in stopping them but it is a massive number of people. If we had the wall it would be very easy. We would make up for the cost of the wall just in the cost of the fact that i would be able to have fewer people we wouldnt need all of this incredible talent, some of whom are sitting in the first row, you wouldnt need all of this incredible talent. We would get thousands of Law Enforcement people, including Border Patrol, you put them in different areas, have them doing Different Things. Law enforcement and Border Patrol. I want to thank Law Enforcement and i want to thank Border Patrol and ice. Ice is abused by the press and by the democrats. By the way, we are going to be taking care of ice. We talk about the new bill. Well be taking care of ice. They wanted to get rid of ice. And the bill is just the opposite of that. A lot of good things happened. So thats the story. We want to have a safe country. I ran on a very simple slogan, make America Great again. If you are going to have drugs pouring across the border, if you are going to have human traffickers pouring across the border in areas where we have no protection, in areas where we dont have a barrier, then very hard to make America Great again. But weve done a fantastic job. But we havent been given the equipment. We havent been given the walls. And in the bill, by the way, they didnt even fight us on most of the stuff. Ports of entry. We have so much money we dont know what to do with it. I dont know what to do with all the money they are giving us. It is crazy. The only place they dont want to give us much money, 1 billion 375 million sounds like a look but not so much although were putting it to much better use than it used to be. A lot of the past administrations it was easy to get and they didnt build or do what they could have done. It would have been great. It would have been great to have done it earlier. I was a little new to the job, a little new to the profession and we had a little disappointment for the first year and a half. People that should have stepped up did not step up. They didnt step up and they should have. It would have been easy. Not that easy, but it would have been a lot easier. But some people didnt step up. But were stepping up now. So we have a chance of getting close to 8 billion, whether its 8 billion or 2 billion or 1 1 2 billion it will build a lot of wall. Were right now in construction with wall in some of the most important areas and we have renovated a tremendous amount of wall making it just as good as new. Thats where a lot of the money has been spent on renovation. We were restricted to renovating, which is okay, but we will run out of areas we can renovate pretty soon. We need new wall. So i want to thank everybody for being here and i want to thank in particular the angel moms and dads for being here. Thank you very much. We have Great Respect for you. The real country, our real country, the people that really love our country, they love you. So i just want you to know that. I know how hard you fight and i know how hard a fight you are having. I also want to thank all of the Law Enforcement for the job you do. Believe me, our country loves you and respect you greatly and were giving you a lot of surplus, were giving you surplus military equipment, which a lot of people didnt like giving previous to this administration. But hundreds of millions of dollars of surplus equipment and as we get it, as you know we send it down and you have much better protection. But i really appreciate you being here. So the order is signed and i will sign the final papers as soon as i get into the oval office and we will have a National Emergency and we will then be sued and they will sue us in the ninth circuit even though it shouldnt be there. We will possibly get a bad ruling. Another bad ruling and end up in the Supreme Court and hopefully well get a fair shake and win in the Supreme Court. Just like the band, they sued us in the ninth circuit and we lost and lost in the appel yat and lost. We went to the Supreme Court and won. Yesterday they were talking about the ban. It is very helpful, madam secretary. Without the ban we would have a bigger problem. We have a ban on certain areas, certain countries depending on whats going on in the world. And we won but somebody said President Trump lost on the ban. He didnt say we ultimately won at the United States Supreme Court. They dont want to say that or go that far. They were saying how i lost the person sitting right up here. Donald trump lost on the ban. Yeah, i did, and then i lost a second time. You should have said that, too. Then i went to the Supreme Court and i won. Didnt want the take it that far. We won on the ban and other things, too. The probably easiest one to win is on declaring a National Emergency because we are declaring it for virtual invasion purposes, drugs, traffickers, and gangs. One of the things just to finish, we have removed thousands of ms13 gang monsters, thousands. They are out of this country. We take them out by the thousands. And they are monsters. Okay, do you have any questions . John, go ahead. You were prepared. Mr. President , a lot of the money you are saying i was prepared . Prepared for questions. Bill you were prepared for questions. A lot of the money that goes to count toward your 8 billion is money thats being reprogrammed in the d. O. D. Budget. How can you guarantee to military families and to our men and women of the military that none of the money that would be reprogrammed forto a wall will take away from other technology, other renovations, construction that is desperately needed in our military. President trump we have certain funds being used at the discretion of generals, at the discretion of the military. Some havent been allocated yet. Some of the generals think this is more important. I was speaking to a couple of them and they think it is more important than what they were going to use it for. I wont go into details. Didnt sound too important to me. Plus if you think ive gotten 700 billion for the military in year one. And then last year 716 billion. And were rebuilding our military. But we have a lot and under the Previous Administration our military was depleted. Badly depleted and they werent spending they had a much smaller amount of money. So when i got 700 billion and then 716 billion and this year it will be pretty big, too, because there are few things more important than our military. Im a big deficit believer and all that but before we start focusing on certain things we have to build up our military. It was very badly depleted. Were buying all new jet fighters, missiles, defensive equipment. Well soon have a military like weve never had before but when you think about the kind of numbers you are talking about, so you have 700 billion, 716 billion. When i need 2 billion or 3 billion out of that for a wall, which is a very important instrument, very important for the military because the drugs that pour on. As you know, we have specific rules and regulations where they have drugs and what you can do in order to stop drugs. Thats part of it, too. Were taking a lot of money from that realm also. But when you have that kind of money going into the military this is a very, very small amount that were asking for. Go ahead. Abc. I like abc a little more, not much. Abc, pretty close. What do you say to those including some of your republican allies who say you are violating the constitution with this move and setting a bad precedent that will be abused by possibly democratic president s in the future. Marco rubio mentioned that. President trump not too many people have said that. The courts will determine that. I expect to be sued. I shouldnt be. Very rarely do you get sued when you do a National Emergency. Other people say if you use it for this. What are we using it for . We have to get rid of drugs and gangs and people. Its an invasion. We have an invasion of drugs and criminals coming into our country but its hard to stop. With a wall it would be very easy. I think that we will be very successful in court. I think its clear. And the people that say we create precedent, well, what do you have, 56 many of those are far less important than having a border. You dont have a border, you dont have a country. You know before i got here we fight all over the world to create borders for countries but we dont create a border for our own country. So i think what will happen is sadly well be sued and sadly it will go through a process and happily well win i think. Go ahead. Lets hear it nbc. In the past when president obama tried to use executive action with related to immigration you said it is not the way the country is supposed to be run by executive order. You are supposed to go through congress and make a deal. You concede you were unable to make the deal you promised in the past and the deal you end up now with congress is less than what you could have had before the 35day shut down. President trump i went through congress. I made a deal. I got almost 1. 4 billion when i wasnt supposed to get 1. Not 1. I got 1. 4 billion but im not happy with it. I also got billions of dollars for other things, port of entries, lots of Different Things. The purchase of drug equipment. More than we were even requesting. In fact, the primary fight was on the wall. Everything else we have so much. As i said, i dont know what to do with it we have so much money. But on the wall they skimped. So i was successful in that sense but i want to do it faster. I could do the wall over a longer period of time. I didnt need to do this but i would rather do it much faster. I dont have to do it for the election. Ive already done a lot of wall for the election in 2020. The only reason were up here talking about this is because of the election. They want to try to win an election and this is one of the ways they think they can win is by obstruction and a lot of other nonsense. And i think that i just want to get it done faster, thats all. Okay. Yes, maam, go ahead. Thank you, mr. President. Im from reuters. I wanted to ask about china. Do you feel that enough progress has been made in the talks to head off the increase in tariffs scheduled for march 1 . Well, you are talking to the wrong person. I happen to like tariffs. Were taking in billions of dollars in tariffs from china and our Steel Industry is an example. We taxed dumped steel. Much of it comes from china, at 25 . Our Steel Industry are building plants all over the United States. A beautiful thing. From a defensive standpoint you need steel. You can do without certain industries. Our country cannot do without steel. So i love tariffs but i also love them to negotiate and right now china is paying us billions of dollars a year in tariffs and i havent even started. Here is the thing. If we make a deal, they wont have to pay. It will be a whole different story. They wont be paying that but well have a fair deal. There wont be intellectual property theft, there wont be so many things that have gone on. No other president has done this. We didnt have a deal with china. We had the wto, one of the worst trade deals ever made. Maybe worse than nafta. I think that was just a disaster. Ist was a total disaster for our country. And now we made the usmca which will be a great deal. By the way, the usmca from mexico, the United States, mexico, canadien, thats where the money is coming from indirectly for the wall. And nobody wants to talk about that. Because were saving billions and billions of dollars a year if Congress Approves that deal. Now, they might not want to approve a deal because theyll say one of the things im thinking of doing, this has never been done before. No matter how good a deal i make with china, if they sell me beijing for 1, if they give me 50 of their land and every ship that theyve built over the last two years, which is a lot, and they give them to me free, the democrats will say what a lousy deal. Thats a terrible deal. Like zte i got more than a billion penalty in a short period of time and the democrats said oh, should have got more. When i made that deal i said this is incredible. I got over a billion penalty plus they had to change their board of directors, they had to change their top management. But they had to pay over a billion dollars. I said what a deal. Took like a week. And the democrats didnt even know there was a problem with zt. Im the one that fined them and settled it. Over a billion dollar. President xi called me. It would be important to him if they could get a deal. And in a short period of time. The democrats went out and said oh, they should have done better. So what im thinking of doing is getting Chuck Schumer, getting nancy pelosi, having them bring two or three of their brilliant representatives and well all go down together and what well do is well negotiate, ill put them in the room and let them speak up because any deal i make the china. It will be better than any deal that anybody ever dreamt possible or i wont have a deal. Very simple. But any deal i make with china schumer will stand up and say oh, it should have been better. It should have been better. And you know what . Thats not acceptable to me. So im thinking about doing something very different. I dont think its ever been done. I dont want to be second guessed. Its politics. Sadly i would probably do the same thing to them, okay . But any deal i make toward the end ill bring schumer at least offer him and pelosi. Ill say please join me on the deal and by the way, i just see our new attorney general is sitting in the front row. Please stand up, bill. Such an easy job hes got. In your remarks you said you were too new to politics earlier in your administration when you would have preferred this be done. Is that an admission of how you might be changing on the job and President Trump i am learning. Dont forget not like ive done this for senator came into my office and said ive been running for office 30 years. Ive won seven out of seven. I did lose a couple when i was younger. In the meantime, i built a lot of wall. I have a lot of money and i built a lot of wall but it would have been nice to have gotten done. I would like to see major Immigration Reform and maybe thats something we can all work on, bill, where we all get together and do major Immigration Reform. Not just for a wall, for a barrier, for port of entry, for other things. We have a real problem. We have catch and release. You catch a criminal and you have to release him. We have so many other things. You have chain migration. Where a bad person comes in, brings 22 or 23 or 35 of his Family Members because he has his mother, his grandmother, sister, cousin, uncle. They are all in. You know what happened on the west side highway. That young wise guy drove over and killed eight people and horribly injured nobody talks about that, horribly like loss of legs and arms. Going 60 miles an hour he made a right turn into a park on the west side highway along the hudson river in new york. He had many people brought in because he was in the United States. Its called chain migration. Then you have the lottery. Its a horror show because when countries put people into the lottery, they arent putting you in, they are putting some very bad people in the lottery. It is common sense. If i ran a country and a lottery system of people going into the United States. Im not going to put in my stars, ill put in people i dont want. The lottery system is a disaster. So the crazy thing is, i just had, as you know, rasmussen 52 in the polls, my highest poll number and people get what were doing. They get it. They really get it. And im honored by it. I wonder if you could comment on this disconnect that we seem to have in this country where you are presenting information about what is happening at the border calling it an invasion talking about women with duct tape over their mouths and so on and yet there is a lot of reporting out there and crime data out there, a lot of department of Homeland Security data out there that shows border crossings at a near record low. Thats because of us. Excuse me. President trump there is still massive numbers. It shows undocumented immigrants committing crime at lower levels than nativeborn americans. What do you say to your critics who say that you are creating a National Emergency . I get my numbers from a lot of sources like Homeland Security, primarily. And the numbers that i have from Homeland Security are a sis disaster. Billions of dollars and it is unnecessary. Your own government stats are wrong are you saying . President trump i use many states. You have states that are far worse than the ones i use. The other day you gave the possibility that maybe this could slide. Are you eyeing a possible extension 30 days maybe 60 days, where does the march 1 deadline . President trump its a very big deal. It must be the biggest deal ever made if you think trade with china. How big does that get . Although if you look the usmca is right up there. But its very complicated. There are many, many points were bringing up that nobody ever brought up or thought to bring up but theyre very important. We were on the wrong side of every one of them. There is a possibility that i will extend the date. If i do that, if i see were close to a deal or the deal is going in the right direction, i would do that at the same tariffs. I wouldnt increase them. The debt has gone from a shade under 20 trillion and now its over 22 trillion. What are your plans to reverse it . Its all about growth. Before i focus on that. You have to remember president obama put on more debt on this country than every president in the history of our country combined. When i took over we had one man that put on more debt than every other president combined. Combine them all. So you cant be talking about that but i talk about it because i consider it very important. But first i have to straighten out the military. The military was depleted. If we dont have a Strong Military hopefully we wont have to use it because its strong. If we dont str a Strong Military. You dont have to worry about debt. You have bigger problems. Thats why i did the 700 and 716 billion. Growth will straighten it out. You saw last month the trade deficit went way down. Everybody said what happened. What is happening is growth. Before i can focus too much on that a very big expense is military and we have no choice but to straighten out our military. Is growth the only answer . President trump yes maam, go ahead. On north korea, back on the last summit you came out with a general agreement. I was wondering what you thought has been accomplished since the last summit and are we going to be seeing any concrete denuclearization. President trump a lot has been accomplished. When i came into office i met right there in the oval office with president obama. And i sat in those beautiful chairs and we talked. It was supposed to be 15 minutes. It ended up being many times longer than that. I said whats the biggest problem . He said by far north korea. And i dont want to speak for him but i believe he would have gone to war with north korea. I think he was ready to go to war. He told me he was so close to starting a big war with north korea. Where are we now . No missiles, no rockets, no nuclear testing. Weve learned a lot. But much more importantly than all of it. Much more important, much, much more important than that is we have a great relationship. I have a very Good Relationship with kim jongun. I have done the job. Prime minister abe of japan gave me the most beautiful copy of a letter that he sent to the people who give out a thing called the nobel prize. He said i have nominated you respectfully on behalf of japan. I am asking them to give you the nobel peace prize. I said thank you. Many other people feel that way, too. Ill probably never get it. Russia and iran and syria were going to go in and perhaps destroy three Million People in order to get 45,000 terrorists. I heard about it from a woman who had her parents and brothers living there and she said please, please. I thought i said no, it cant happen. What are you talking about . I come home and i read a certain paper where the story was there that they were forming to go into and really do big destruction. I put out a statement that you better not do it. And in all fairness to russia and iran and syria, they didnt attack or they are doing it surgically at least. Saved a lot of people. We do a lot of good work. This administration does a tremendous job and we dont get credit for it. I think the people understand what we do. So Prime Minister abe. It was a fivepage letter. Nobel prize. He sent it to them. You know why . Because he had rocket ships and he had missiles flying over japan and they had alarms going off. You know that. Now all of a sudden they feel good. They feel safe. I did that. Bill as we continue on cable 11 30 here in new york we had a clock of about 50 plus minutes for what has been a tour deforce for the president selling his policies from china, north korea, economy. Critical at this moment is the National Emergency. He said a lot protecting on behalf of ice operations, he was happy about that. Mentioned the dollar figure repeatedly. One time saying whether its 8 billion, 2 billion, it will build a lot of wall. Ultimately he came back to where a lot of our guests have gone a court battle. He referred to the Supreme Court where he believes he will win. Sandra he ended up taking questions for quite some time in the rose garden. Some contentious exchanges. Asked about military funding and how it will affect some of that. He answered that certain military funds were not allocated yet. He spoken to some generals about this and they think this is the more important move that is how he definded that criticism of this move. Bill he talked a lot about the historical nature of National Emergencies. There were at least 30 that are still in place going back to the days of jimmy carter in 1979. The distinction with a lot of those National Emergencies is they didnt reappropriate money, which is the job of congress. Thats where the rub comes in now on the legal fight. Nancy pelosi, Chuck Schumer, already responding. Some of the statements were flying when the president was talking. The congress will defend using every remedy available. The president s emerging declaration, if unchecked would fundamentally alter the balance of powers. Thats what were hearing from leading democrats in congress. Sandra they finished that statement by saying the president is not above the law. So lots of criticism as expected. Lets bring in Chris Wallace. Welcome back. You just heard from the president making strongly his case talking about drugs, human trafficking, gangs flowing across our border. You dont have a border, you dont have a country. Were getting it done. What did you think . He is a strong, forceful advocate for his position and you heard him challenged when it was suggested you are making up this crisis and he pointed to the angel moms and dads who have lost loved ones and said tell them that im making this up. So he is making a strong and emotional case and there are millions of americans who will agree with him. On the other hand there are people who one question whether or not its a National Emergency and two, even if they think it is question the idea of whether this is a constitutional overreach. Whether the president has the power to spend money that hasnt been appropriated by congress. The big difference between this and the other declarations of emergency as bill pointed out. Those were specific cases where the president was freezing the funds of somebody or swine flu for 9 11. A debate about building a wall or not for years. Congress either in its wisdom or lack of wisdom didnt give him anything more than this 1. 375 billion and he is saying no, i want more. And that makes it very different. He is going over and above and against the express will of congress. That is going to create a big fight within congress as i mentioned before. Resolution of disapproval and also create a big fight in the courts. Bill make America Great again came back to that theme, chris. His address on that was we have not been given the equipment referring directly to the amount of equipment on the wall to get that funding. My sense is, as i mentioned probably two hours ago, sandra, is that you can declare a split decision on this in the following sense. A lot of the money he is talking about is readily available. A lot of the other will be locked up for some time. You can continue to process to build and that he can sell to those who voted for him on this issue. In that sense its a split decision politically. Right. A split decision in another sense. He made a very good point when he talked about all the money that was appropriated as part of this congressional deal. Forget about a nation until emergency for ice and customs and Border Patrol and he said its more money than i know what to do with. More money than they had even asked for. You can certainly declare victory on that and say we didnt get the money for the wall but in terms of the personnel and of course there have been some democrats on the left wing talked about abolishing ice. For ice and customs and Border Patrol i got more money than i asked for. Sandra some of the initial sound from the president on taking action. First one, guys. President trump today im announcing several critical actions that my administration is taking to confront a problem that we have right here at home. We fight wars that are 6,000 miles away, wars we should have never been in in many cases, but we dont control our own border. So were going to confront the National Security crisis on our southern border and were going to do it one way or the other. We have to do it. Not because it was a Campaign Promise, which it is. It was one of many, by the way. Sandra that was the president right up at the beginning of this News Conference saying he is going to get this done one way or another. Well, he certainly is going to try and he certainly is keeping faith with his supporters in saying i have done everything i could. Gotten as much many as i could out of congress and now do it through other means. He is not the only voice in this as ive said. Congress is going to have a voice in this and also the courts are going to have a voice in this. I also wonder about a couple of comments he made whether his lawyers are going to shake their head. At one point he said i could have done it without this money but i want to do it faster. And i wonder whether that will be used against him that even the president is saying that i didnt need this money right away. The whole 8 billion he is going for. This isnt the end of this. I dont have to tell you. This is just the beginning of all this. Bill chris, there is a saying on wall street, you want to have a meeting and work toward the endgame in your meeting to try to get the deal. He strikes me as a man who is always selling and you think about the opening remarks about china and north korea and the economy and on and on he listed and he loves the verbal sparring with reporters there. As you rightly point out having these angel moms turn around and hold up the pictures of their dead children is a powerful moment. He is always on offense when it comes to his ideas. And again we saw it again today. Quick last comment on that and then well roll. Absolutely. It was interesting. I wondered here declaring a National Emergency, why do you talk about these other things . Youre right. He doesnt know how long the networks are going the stay on and cover it and he is able to sell his policy on north korea, his policy on china, his policy on the economy and now ill get to the wall. You know, we spent the last two months going through a pretty painful process of trying to come to a bipartisan agreement on how well fund Border Security and other aspects of the government. We did. President may not like it. There are aspects of it that i dont like. But that does not give the president the authority to essentially ignore article 1 of the constitution and say okay, ill take what Congress Gives me but im going to reach into the federal bank account and take money that they have not appropriated for purposes that he decides are important. Look, we can have a legitimate debate about Border Security but i dont think we can debate whether or not the constitution is intended to give congress the right to make appropriations. That is pretty clear. Sandra so the leadership, Chuck Schumer and nancy pelosi of your party have already put out a statement. In that statement they call upon our republican colleagues to join us to defend the constitution. They say the president is not above the law. Congress cannot let the president shred the constitution. This is the reaction were seeing from democrats in the wake of the president s announcement. How do you want to see things proceed now . Well, i think clearly democrats are reacting to this. If we look at the comments made by some pretty Senior Republicans in the last few days they share this concern. I think we do have to take a look at what the options might be and defend our prerogatives under the constitution. What form that may take im not sure yet. That will be a real conversation going forward. This is a really clear moment the president decided to reach beyond his authority. I think republicans understand that if this precedent is allowed to stand they should be cautious about what that might mean in the future. For a president who doesnt get his or her way can ignore the law as passed by congress and make decisions not granted to the president under the constitution. It is a pretty dangerous moment for us. Bill in the pending bill they passed in congress, house and senate, there is a lot in there that republicans like. Probably a lot in there that democrats like. I think you agree on that. His challenge on the legal side saying well go to the Supreme Court. I have think the quote was well be sued and we will lose. We will be sued again and lose and take it to the Supreme Court like the travel ban well be victorious. Do you think this is where its headed . I think its likely. The courts were designed for this very purpose to resolve disputes over president ial or Congressional Authority among many other things the courts are intended to do. That may have to be where this decision is made. Bill you agree the immigration issue needs to be addressed, correct . I have been supportive of the efforts to strengthen our border. I have maybe some disagreements with the president how we do that but i supported the budget agreement not just because it avoids a shutdown but i support some of those investments that we agreed to make on the border. What i cant bill such as the barriers. What is the issue sticking for you then. Some on the left are suggesting perhaps some of the wall thats already constructed should be taken down. Youve heard some of that reporting. My view is to defer to the people with expertise on these matters. I understand the president has his view, we have our views. Those views have to be informed by people who really understand Border Security. Even they may disagree but we ought to think about what the experts say. I have heard and heeded some of the concerns by people with really deep expertise that there are parts of our border that clearly will need some barrier, some fencing. But i also want to take advantage of the advanced Technology Available to us and fix the problem. Thats why i think this agreement actually is a good deal. I support it not just because we avoid a shutdown. I think it takes us in the right direction. But i have to admit im really concerned no matter what the issue is when a president decides that they can spend money that congress has not appropriated for them. Thats unprecedented in some ways and i think its really a moment that we ought to stop and pause and think carefully about. Sandra he referenced Chuck Schumer and nancy pelosi in this statement in the rose garden saying that they are playing a con game, congressman. They said you put up a barrier and thats it. They cant do anything unless they walk left or right and come into the United States. This is only the beginning as we were just talking about with Chris Wallace. From my point of view, i would have defended the emergency if congress had never gotten anything done. An appropriate action. Congress did do its work, they compromised. Not necessarily a good compromise but enough in there. I think he would have been better off reprogramming the funds. Not declaring and emergency. Focus next on whats on the border. The president could have gotten so much good pr out of going to the factories where the technology to catch drugs will be made. Swearing in ceremony for the new judges. Going to the first mile of new wall. The 10th mile and 25th mile of new wall. I would have preferred him to focus on that rather than declare an emergency. Then legally reprogram funds with whatever the law allowed. An emergency once Congress Acts went too far. Sandra what does the challenge look like . The other discussion of the precedent it sets. That seems to be what democrats want to talk about. Well, there is merit to that and one of the reasons i think if congress had failed to do anything i would have declared the emergency and supported the president. Congress did do something. And so the precedent argument is a legitimate argument. I dont want the democrats to call precedent and fund billions of dollars for a Green Initiative thats a waste of money. Im a constitutionalist. I think he could have accomplished what he wanted legally without throwing down the gauntlet and calling it an emergency. From a Communications Point of view. Focus on what he has accomplished rather than go to court. Bill he could still do that. He can make a trip down there be it arizona and california, texas. He can and the swearing in of the judges is a very important. Increase in detention beds very important. He can do all that. He still is going to also be marked now by loss in court here and there and you know as well as i do the press will pay more attention to the losses than the wins. He could have had just wins. Bill when he mention ed winning with the Supreme Court. Do you think he is right . He walked everybody through how it is going to go. Let me say a word about the overall News Conference. Fascinating to watch the whole thing. It encapsulates everything that people love or hate about President Trump. That was such an interesting performance. Antipoliticians performance. He lets it rip. He speaks plain english. He is authentic. I think there is something entertaining and informative and reminder how much people hate politicians and one of the reasons people are drawn to President Trump. Other side of it is he is repetitive, he the loopy. Loves to get into fights with people especially reporters. And this is why he is having a harder time attracting people in the middle because he pushes those norms. It is everything his presidency is. For the people who love him he gave them more to love today. For the people with question marks they continue to have them. This was the Trump Presidency in action.
