I think its going to sink in next week or the week after or months from now. Bill here is what we know so far. Statewide 44 are dead. 7,000 structures have been destroyed. The fire scorchinging 325 square miles with more than 8,000 firefighters working around the clock to contain the flames. In Southern California investigators have not discovered what sparked the deadly woolsey fire. John Jonathan Hunt is live in malibu. What are you seeing from your position . Its a pretty bleak vision as the sun rises in malibu. Thousands of families remain evacuated from this area. With winds expected to pick up later today, they are expected to remain held out from their homes for at least another 24 hours. When they do get back in, this is the kind of devastating scene hundreds of families are going to be faced with. Essentially everything theyve lived and worked for, built their entire lives destroyed quite literally gone up in flames. As you look at this, bill, it is very easy, i think, for people not from here to think of malibu as an area of millionaires and mansions. It is not. The street were on right now is a street i used to live on about a decade ago. It is really just single level, low ranch homes. Ordinary hard working americans live in this neighborhood. Ordinary hard working americans have lost their homes. And when you just look around here, bill, on this street alone around a dozen homes completely destroyed. It is a scene were seeing repeated across Southern California all around the l. A. Area right now and it is just heartbreaking to see. The thought of a family coming along this driveway in the next 24 to 36 hours pulling up here, having hoped against hope that they might find their home still standing, what they will go through when they pull up here is just beyond imagination, bill. Bill tough to see there. The news from up north seems to get worse by the day, the camp fire. What do you know on that . Yeah, it is even worse up north. It is outside chico north of sacramento. The camp fire as you were mentioning the officially the deadliest in california state history. 42 people dead and well more than 100, bill, still unaccounted for. It was a terrifying scene up there. The problem with that fire in particular was the flames moved so quickly. People had so little time to get out. Listen now to a couple of those who were caught up in it. Listen here. Just seeing things blow up and it was pretty scary. We, you know, had to stay calm so we knew we didnt crash into anybody or anything like that. If you can picture a snow blizzard it is an ember blizzard. They were pelting homes and the ground. President trump has now issued an expedited major disaster declaration for california and frankly, bill, it is much needed. California and its firefighters need all the help they can get right now. Sandra the election drama continues to unfold across the nation in the Arizona Senate race republican congresswoman Martha Mcsally conceded to her democratic opponent kristin sinman after a very close battle there. Its a big win for democrats who hold at least 48 senate seats. Republicans stand at 52 with a few races still up in the air. Sinema reacting to her big victory last night. This campaign was about leo and michelle and ann and all the other everyday arizonians who are sick and tired of the dysfunction in washington and who want leaders to put aside party labels and just focus on getting things done. As your senator, thats exactly what ill do. Sandra were live from phoenix where the state has their first ever female senator. Good morning, sandra, yes. Kyrsten sinema did turn the red seat blue. You heard her call for unity. She also said this. Arizona rejected what has become far too common in our country, name calling, petty personal attacks, and doing and saying whatever it takes just to get elected. Its dangerous and it lessens who we are as a country. The votes are still being counted here but the Associated Press called the race not long after the secretary of States Office updated the count last night showing sinema with a lead of 38,000. Soon after Martha Mcsally tweeted congratulations and a concession. I wish her all success as she represents arizona in the senate. And i also want to say thank you to everybody who supported me in this campaign. My staff, volunteers, everybody who voted for me. Im so grateful for you, my wing men and women in the journey. She wish we could have had a different result but im so thankful for you. Both women head back to washington this week. They both have votes in congress to attend to. Sandra the senate seat politics are not over for that state. There is another vacancy coming. Tell us about that. Thats right. Youll remember after the passing of senator john mccain, Arizona Governor republican doug doocy named retired senator jon kyl to the seat. He only agreed to do it on a temporary basis. He is planning to leave in january. So doocy once again will need to name a success or to fill out the last two years of the term. There have been suggestions in arizona he name mcsally to the seat. So far she has received a million votes in the race against sinema. He is not talking about it right now. Sandra very interesting. Thank you. My goal is to make sure that this is done properly. Thats why ive asked them to come in and do an investigation. The attorney general demanded that happen. Ive asked the sheriffs to be vigilant. We want to make sure we have a free and fair election. Bill rick scott last night as florida is trying to meet the deadline for the machine recount. Charlie hurt in d. C. Good morning to you in washington i just want to show our viewers where we stand in the senate race. The difference between nelson and scott is 12,536 votes. You see on the map in the southeast corner where all the democrat its a heavy democratic vote here, miamidade, nelson beat scott by 169,000. Broward the number is 260,000 and then up in Palm Beach County about 99,000. Were focusing on these two counties here. Broward has had efficiency problems, charlie. That much is clear. Yeah. At the very least efficiency problems. In the past more than just efficiency problems. Which i think is probably animating a lot of the concerns you see among at least on the republican side about the validity of some of the votes there and not only that but also the finding of ballots, the recount and things like that. As you pointed out, it is 12,500 votes which triggers the automatic recount at. 15 difference. You know, its possible, i guess, in some scenario where bill nelson could make up that 12,000 votes. But if he were to do that in florida, that would be the biggest claw back of anybody in recent florida history. Bill whats not clear to me, charlie, is how many votes how many ballots are in Broward County. Its at least 700,000, is it 715, 725 . That makes a big difference. A huge difference and thats the problem from the beginning. I think a big reason why a lot of republicans are concerned about it is that the most simple question that Election Officials ought to be able to answer on election day is how many people did you have vote . And once you know how many people voted, you can sort of work within the confines of that number. The problem is, how many people did you have vote . That changed by almost nearly 100,000 votes over the course of 24 hours after the election. And while i probably agree with people who say we need to calm down, do the recount, see what the numbers look like at the end of the day, i do understand why people are getting hinkey about this stuff because of the past questions and because, as you point out, this sort of sudden appearance, miraculous appearance of new ballots. The miami herald has a good story. I want to show the governors race here. Gillum trails ron desantis by 33,000 votes. Up in georgia, this is still somewhat of a battle. Brian kemp has 58,000 vote lead on Stacey Abrams in georgia. Not sure that will flip very much and one more here in arizona we just talked about it a moment ago. Martha mcsally lost her bid to win the u. S. Senate race. What do you think is happening in arizona that are you picking up on based on the vote . In arizona they have a history of taking a longer time to count ballots. Their deadline is farther out. The reason we have deadlines is because you need a deadline because the more time that passes, there is more time for shenanigans to go on in terms of finding ballot or whatever. The georgia race is interesting. She is not even trying to get to the point of trying to overcome her deficit. She is just trying to get him below 50 so they can have a runoff. I think the idea that she would be able to overcome that deficit at this point even with a recount is pretty its a pretty tall order, i think. Bill thank you for the analysis. Onward we go. Nice to see you, good morning and thank you for coming back. Does the president have the right to appoint the person he wants in that position . Yes within certain limits. He has a right to put in attorn qualifies under as Mercedes Schlapp said the vacancy reform act. Matt whitaker fits that description. However, the question is whether he also qualifies under the constitution. Thats a much closer call. Bill what is the constitutional question there . The question there is under the constitution the president can appoint whats called a principal officer. That is the case. A principal officer who has to be subject to the advice and consent of the senate. The president can fill certain vacancies only with the advice and consent. The question is whether somebody acting as attorney general would have to be somebody confirmed. There are people available who have been confirmed. Rod rosenstein is one of them. He has a lot of conflicts and be an unwise choice. Francisco would be fine. Bill youre saying there are others right now. Why not serve in this role for a couple weeks as acting and then go for Senate Approval in two months in the new year. You have the votes in the senate to do that. He cant nominate the person acting under the statute. You cant do that. But the point of somebody serving you can serve as an acting attorney general if you havent been confirmed in that position. The question is whether youve been confirmed in another position. And whether you are considered a principal officer. And the problem here is that if it turns out that an acting attorney general is a principal officer and Matt Whitaker has not been confirmed by the senate in any position, then anything he does that could be done only by a confirmed attorney general is void. There are some things that can be done by that can be delegated to somebody else. Those things would be perfectly valid. Bill everything youre saying suggests he has a problem here. Yes. Bill adam schiff and the state of maryland is going to sue to challenge whitaker. Well see where that goes. Schiff writes this. If he does not recuse himself whitaker, from all matters russia, he could seek access to the special counsels evidence and would be in a position not just to funnel information to trump and his team but use his authority to crip will the investigation and attempt evidence from reaching congress and the public or stop a special counsel from subpoenaing important testimony including from trump himself. He could also go out and strangle his grandmother. Please, thats ridiculous. Bill do you see this position Going Forward with whitaker or with someone else . I would hope with someone else for safetys sake. So far as conflicts, he has no conflict. There is no reason for him to recuse himself. There is reason to be hesitant about his authority but not necessary to recuse himself because of statements he made earlier. Bill is he a good choice for this job . He is a fine lawyer. A judge ordering Election Officials to examine each provisional ballot in a governors race. Republican brian kemp leading Stacey Abrams by a narrow margin. If his share falls below 50 the election heads to a runoff. Jonathan serrie has more on this. What does the court order do . The state of georgia has until november 20th to certify Election Results. What the court order does is it says those results can be certified no earlier than this coming friday at 5 00 p. M. The court order also requires counties with 100 or more provisional ballots flagged for registration issues to conduct a good faith review of the ballots to make sure everyone eligible to vote is counted. The judge also ordered the state to establish a hotline or website for voters to look up their provisional ballots, see if they were counted. If not, get a specific answer as to why their ballot was rejected. Her order requires each county Elections Office to publicize the way voters can check the status of those provisional ballots, sandra. Sandra how likely is this to force a runoff . Depends on who you talk to. Democrats say that as these additional provisional ballots are qualified and added to the tally, that they are actually favoring Stacey Abrams, her Campaign Still speaks optimistically forcing a december 4 runoff because Republican Brian Kemp is a fraction of a point above the threshold needed to win the election outright. The Kemp Campaign says it has done the math and even if all remaining eligible provisional and military ballots went in favor of abrams it still wouldnt be enough for a runoff. Kemp spokesman issued a statement saying its incredibly shameful that liberal lawyers are doubling down on lawsuits desperately trying to create more votes for Stacey Abrams. They dont want to win this election, theyre trying to steal it. You have the Kemp Campaign accusing abrams of trying to steal an election. They havent started the actual recount yet but getting close and confident they will. Let me take you into the tabulation room and tell you what has happened. Theyre separating that first page and they finished the election day ballots, yesterday they finished the early vote ballots, one more group to go, the mailin ballots. 189,000 left. They believe it will take most of the day and possibly into tonight. Then they will begin the tabulation of the actual recount. They say here that will take 15 hours. Thus they will meet that thursday 3 00 p. M. Deadline. One of the big developments yesterday, bill, was we were able to speak with dr. Brenda snipes, the election supervisor here and we asked her about the charges of failing to meet ballot counts and other things. Here is what she had to say. The lawsuits as they are written certainly cast dispersions on my character and i worked here for about 15 years and i have to say this is the first time that this office or i have been under such attack. So if we make mistakes, we own mistakes. Yesterday former Florida Governor jeb bush tweeting, quote, there is no question that Broward County supervisors of election snipes failed to follow the law, undermining floridians confidence in our electoral process. She should be removed from her Office Following the recounts weve seen. She is just around the corner at the canvassing board table. Well try to get more. Nationally, of course, everyone is seeing nelson and scott hammering away at each other. We expect that to continue. The big thing to watch for, bill, is if they meet that deadline on the recount on thursday, we still expect there will likely be a margin of error under 2. 25 to get us to the hand count and it gets really interesting yes. And i think she will be the leading candidate on the democrat side to be speaker. So theyve got an internal fight. There were a number of Nancy Pelosis democrat candidates who ran saying they wouldnt vote for her as speaker. That is going to be an interesting test that a lot of people will be watching in january. Will their first vote be to break the word they made to their constituents . That would be something they have to deal with. Sandra what about new leadership for House Democrats . Youve been hearing clamoring for years that their partys leadership has been the same for a long time. At the same time you dont see an emergence of anybody that has a lot of support to top el them. In the end i think nancy pelosi will be favored to stay on as speaker. I think if they move a very far left agenda in the house and theyre already talking about just harassing the president , impeachment even, that is going to be, i think, a route that the public doesnt want them to go but theyll have to make that decision. Sandra your colleague in the house on the pink wave that they see happening. Here is what she says, i think it would look ridiculous if we win back the house. We have a pink wave with women who have brought back the house. Then you are going to not elect a leader who led the way . No, that would be wrong. Obviously making the case for nancy pelosi. I just wonder based on everything that were hearing, is this a critical moment for progress for women in politics . In particular in the house . I think the real irony of this pink wave notion that theyre advancing is that they spent millions of dollars defeating a lot of republican women. We had some really great women in congress, Barbara Comstock and nancy pelosi spent over 10 million per race to defeat republican women. She wants to play the gender card here but she will spend tens of millions of dollars to defeat republican women including mimi walters in california where she tried to defeat her unsuccessfully. It is close but looks like mimi will hold out. She will spend 10 million per race to defeat a republican woman but play the gender card in her own conference so ultimately democrats will be making that decision. I think nancy pelosi is the frontrunner on their side. Sandra interesting to hear pelosi make the case if hillary had won i could have gone home. Based on everything were hearing talking 2020 do you think Hillary Clinton will make another run . Let her run, you are hearing maybe 20 potential candidates on the democrat side already. Let them all run. Ultimately donald trump, i still think has done such a great job of president and getting the economy on track. A lot of Close Senate Races where President Trump campaigned he won. Florida is a great example. You can look at so many others. Spent a lot of time in missouri and indiana flipping seats from democrat to republican. The president still draws more crowds than anybody. When President Trump went to a state to do a rally, it might have been a 15,000 seat arena there were 15,000 to 20,000 people waiting outside because theyre excited what President Trump is doing to get the economy back. Sandra what does the agenda look like . Can democrats and republicans Work Together and what does it do for the president s agenda . Time will tell what their agenda will be. If they try to go down the subpoena and impeachment route it will be to their peril. Weve laid out a path for how to get the economy back on track. Ultimately the economy is a driving issue for 10 years and its middle class hard working families that were struggling under the previous 10 years of a sluggish economy. Theyre seeing growth now and more wages, higher wages, more money in their paychecks. If they want to reverse that, if democrats want to reverse that, i think that will be the wrong path to go. I think it will hurt them ultimately. Sandra youve laid out the two cases. They could choose to work with republicans or go the investigation route. We will continue to see these as we go forward. Bill what causing these fires, sir . Whats igniting them . Well, 95 of fires are caused by people and so there is a full range but theyre being driven by the conditions. The critically dry fuels. We havent recovered from five years of drought. The vegetation is parched. Our temperatures, our average temperatures are warming. Were getting fires throughout the year even in the winter months and so across the state were just having conditions and weather patterns that are much more conducive to fire. Bill is there any evidence of arson involved here . You know, were looking at all the causes of the fires. Certainly arson is a component of the 95 of the fires that start. But there are a variety of causes, certainly these fires are under investigation and well ultimately get to the bottom of what started them. Bill you must have seen heartbreaking scenes and some stunning stories of the people who live in your community. There is no words that describe what the town of paradise looks like now. It is sobering. We talked to some victims. We toured town center. We went to the hospital. And it is a war zone. Bill wow. Chief, thank you for your time. The most recent coming from former republican governor jeb bush who tweeted yesterday that she failed to comply with florida law on multiple counts undermining floridians he said she should be removed from her office. I think the lawsuits as they are written certainly cast dispersions on my character and i worked here for about 15 years and i have to say this is the first time that this office or i have been under such attacks. In other news a judge yesterday rejected governor rick scotts lawsuit to impound all the Voting Machines at broward Elections Office while they are not being used to count ballots but ordered three deputies supplement the officer on duty as the recount gets underway. He asked the lawyers for all the candidates and respective camps to, as you say, tone down the rhetoric. The eyes of the nation are on Broward County once again. And were just beginning to understand the true magnitude of the problem with absentee votes. Saturday i was outside the election board in Broward County and had voters saying they had received absentee ballot even though they never applied for them. She mailed it in and after election day checked with the election supervisors website to find out whether or not the vote was tallied. There was no record it had been tallied. Today the miami herald that voters in some counties have contacted the paper quote detailing dozens of issues with absentee ballot from ballots not arriving or getting lost in the mail or showing on the county websites as not tabulated well after election day. Why didnt rick scott get rid of her when he was governor . Sandra here he is on brenda snipes last night. We know brenda snipes mixed illegal ballots with legal ballots. They havent let Party Officials in. The courts have said follow the law. What im trying to do is get them to do what we expect. The laws are set up to prevent fraud and for whatever reason they didnt want to do it. Well, its become partisan as so many other things have in terms of the debate. Functionally i think i agree with adrienne, you have to have votes counted. Especially you think about those military overseas voters which probably a lot will be republicans based on the broader voting trends of the military. So regardless of who comes out on top ultimately i think you do have to have the votes counted but you also need to have accountability in government. This is what we see time and time again. A lot of conservative voters would look at this and say doing what government does best, screwing up. Liberal voters say rick scott is trying to politicize the process. I actually didnt get any warning from anyone else other than my dad coming home and telling me we needed to go. So i woke up, it was 8 32 in the morning and we left our house at 8 50. It was that fast. Bill thats remarkable. How is your family doing . You mentioned your father. My family is devastated. I mean, there is just so many the house was special to us and it is hard. A house can be rebuilt but its the memorabilia that was in there that well never get back is the biggest part. My mom is just my mom is devastated. Trying to be strong for everybody. Bill where did you seek refuge now . Luckily my sister moved to chico and has an apartment. We were able to go there. Sandra have you been able to talk to other neighbors and find out about their condition and whether they were able to get out or what was spared . My best friend, madison, actually. She waited to get her license until she was 18 so she still only had her permit and we went driving one day so she has only had not that much experience behind the wheel but she had to go and get her truck and pack it up and leave alone. As soon as i found out there was a fire i called her and i wanted to know if she was okay. She told me that. I just started crying. Everyone we know in paradise has had confirmation their house is gone. I have talked to nobody that has had their house survive this. Bill wow. You had some fires in that area just a year ago also and now you think about the future. Have you even stopped with your parents to think about what comes next and where you go . We genuinely do not know. People keep asking us what we need. We have no idea what were supposed to do. People have offered up their houses but we need to find, i guess, a permanent place to be staying for when things get back on, school and work and stuff. We all have jobs. My brother goes to school. We just have to be able to make things work. We dont know yet. Bill how old are you . Im 18. Bill wow. You have a lot of life ahead of you. We got this from a nurse at a hospital staying behind to evacuate patients as the camp fire closed in and was stuck in her car as she headed for safety. This is her story now. It was filling up with smoke. I didnt know what to do. I thought maybe nick would know. I called him and i just said im gonna die. This car is filling up with smoke and i think im on fire. I pulled down the fire blanket and i saw a dozer and a dozer came off to the side and started pushing the vehicles and pushing everybody out of the way that their cars were on fire and made a trail for us. We were able to turn around and get off the road and get back to the hospital and able to start treating patients. Sandra thats an incredible story. Bill think about the fire chief with us last hour. They havent had much rain since last spring and they have been in a drought now for five years. So this is just bone dry terrain in Northern California and its just paradise not to mention what were watching in malibu. Sandra some of the stories you hear how fast it came in. 18yearold girl at her home didnt have a warning. If her father hadnt come home when she did she feared the worst could have happened. Lets bring in our headline former independent counsel ken starr and author of the book contempt, a memoir of the clinton investigation. Good morning to you and thanks for being our headliner. What i think is very interesting about this whole appointment is that you have a very different opinion from our guest last hour, the former attorney general Michael Mukasey. He seemed dubious about it. Ill ask you about it after you listen. The problem here is that if it turns out that an acting attorney general is a principal officer and Matt Whitaker has not been confirmed by the senate in any position, then anything he does that could be done only by a confirmed attorney general is void. Bill you disagree with that. Tell us why. I have the greatest respect for general mukasey, i may be wrong but the way i read the vacancies act, bill and sandra, the statute passed by congress, it does give the president this interim authority to fill a vacancy with someone whom he has confidence. But legitimate questions have been raised. I think its a lawful appointment. Sandra can you explain why to those who disagree . Well, under the vacancies act the president has tremendous leeway in who he sees fit to remember, this is the executive branch. There is only one key officer in the executive branch, the constitution article 2 invests power in him. It doesnt mean its unfettered power. We understand that the rhetoric aside. Under this law passed by congress, the president enjoys an enormous amount of discretion. Theyre technical. The person must have been in place for 90 days and so forth and have a certain rating within the Civil Service system. Essentially a senior officer. But subject to those criteria, as i read the law, i think that Matt Whitaker was properly appointed. Bill he is arguing he needs Senate Approval. Youre saying exactly the opposite. Well, under the statute. There is a limit to the time in which he can serve under the statute. He cant continue to serve indefinitely. And so after a period of time under the statute his authority goes away, so to speak. The idea is lets have someone fill it while there is a Senate Confirmation process but so the office doesnt remain vacant. That havent been said ordinarily it would be the Deputy Attorney general who would step into the attorney generals shoes once Jeff Sessions goes away. Ordinarily it would be the Deputy Attorney general Rod Rosenstein. But the president saw fit to go in a different direction. Sandra there was a warning shot from adam schiff, the minority member of the intel committee, the ranking democrat there. He put this piece in the Washington Post published headline. Matthew whitaker, were watching you. He fires off a warning to the president and to whitaker should he not recuse himself, which he makes a prediction in this piece he will not. His actions will be exposed. What do you make of the politics of this moment . The politics are the politics and they can be really ugly. I saw that the Justice Department issued a Statement Last evening to the effect that the acting attorney general was consulting with the appropriate people in the Justice Department with respect to this issue of recusal. I think from everything i know about him, he has integrity. Mr. Whitaker has integrity and i know that the Justice Department process works. I served as chief of staff to the attorney general of the United States a century ago during the reagan administration. There are processes in place and checks. Thats the role of the house of representatives and so forth. I think the process within the department with its procedures, with its integrity will then tell the tale. The other thing i want to say is Charles Grassley is chair of the Senate Judiciary committee and made it very clear he intends to use his authority and that of the United States senate to protect the Mueller Investigation. Bill maryland is going to bring a suit against whitakers appointment. Lets see where this goes if anywhere. The president you would agree has the right to appoint an attorney general. And then the process takes whatever form it takes. Yes. Bill based on what you know about whitaker why would the president choose him for this job . I think he likes him and holy spirit confidence has confidence in him. A private citizen. He served ablely in the role under general sessions. So there is no question that the president would like what then private commentator, private citizen whitaker had to say including about the Mueller Investigation. Once you take the oath to become that officer, the attorney general of the United States, the world changes and you now have a new fidelity. You are to set your personal opinions aside for one thing and to listen to law officers. You assess, not blindly follow whatever they say. But assess what the law officers in the Justice Department say. Ive had great experience in the sense of a long history of experience with the Justice Department, ethics folks. Theyre as honest as the days are long and so lets just allow this process to work. He may recuse himself. Bill he may. I guess thats the question. The driving question, should he based on the previous comments he had about special counsels oversight of the russia matter . Is that a question he will have to decide for himself . Last night as one resident here in the city slept one of 400 rock erts landed in his house and killed him instantly. The kitchen is completely destroyed. What was a solid concrete wall completely blown out and this bedroom where he died. You can see completely destroyed. Rescue crews came here looking for survivors. They found many but also found the body of the gentleman under the rubble. This is one of many buildings in israel that has been impacted by the project isles being fired from gaza. But for his part scott says he wants to insure a fair and accurate vote election. My goal is to make sure that this is done properly. Thats why ive asked to do an investigation. The attorney general demanded that happen. Ive asked the sheriffs to be vigilant. We want to make sure we have a free and fair election. Bill Griff Jenkins live in florida with more. The vote has started. The tabulation room. We were separating page one ballots before they were going to do the actual recount but the actual recount is underway for the early votes. Actually if you look at the manila envelopes on top of the machines, those are the over and under votes that have already been separated. They are being separated for the purpose of manual recount that they anticipate should the total vote count if they meet the total deadline on thursday of a recount, the under and over votes used in a manual recount if the margin is under that. 25 . Weve also got some news with regards to the supervisor of elections here, dr. Brenda snipes. Of course, we saw governor jeb bush, former Florida Governor tweeting there is no we just moments ago, our producer asked supervisor snipes to respond to the jep tweet. She says she heard that jeb wants me out but thats his opinion and he cant take she cant take a persons opinion away. Her opinion is that we have run a good Election Program for our voters during my tenure. So a count has started with the early votes. They have yet to count the day of election votes and the mailin votes. Well see if it happens before thursday. It looks like they hope to do so but the supervisor responding to a lot of accusations and a call for her removal from governor jeb bush. Weigh in on things as they stand at this moment. Were awaiting the final vote count in some of these hotly contested florida races. We are so far outside of the normal tolerances for how a race might be overturned in a recount. Were for perspective were 13,300 votes wider of a margin than ever overturned in a recount. The idea that scott would be ultimately defeated here because of the recount is not a zero probability but it is close to a zero probability. Were talking about low probability event. Whats unfortunate is the degree of vitriol, the degree of anger and baseless that is probably a mute point. Sandra im just looking at this Time Magazine headline. Here is the floridas vote counting controversy spells trouble for 2020. What are the implications for the next president ial election based on what were seeing now . It is clear the Broward County, which brow arpd and Palm Beach County are the largest troefshs of democratic voters in these counties and they also have a history of being terrible at administering elections. What jeb bush is saying after the election, it was jeb bush who appointed her to replace the last person who was catastrophically bad in making sure that elections were counted and that the results were determined without all this problem. She was an emergency pick to replace another person who had problems. And she, too, now the new governor can remove her. He can remove her for cause even before her term in office runs. The idea that florida, which was very close in 2016, that was less than a point for donald trump, we would expect it to be very close again. The idea that we could have a 2020 election hanging on florida with this sort of uncertainty. Weve already seen the allegations out there. Weve seen what has gone on. There are unhappy possibilities when you talk about an incumbent who said he wouldnt be willing to accept the outcome of an election. Sandra the sun sentinel newspaper compiled snipes history of election troubles and went on to detail broke federal law when posting 2016 primary Election Results online before polls closed. Goes on to other details including 1,000 uncounted ballots discovered a week after 2012 election. 2004 some 58,000 mailin ballots not delivered to voters leaving Election Officials to scramble to send new ones. The thursday deadline looms. What happens next, chris . So you see now in georgia to the north that were in the court phase, right . Were heading into this suit and well block you from closing it there and do the other thing. I want to say for republicans, the idea that a 13,607 vote advantage for rick scott would be erased in a recount is pretty preposterous. The net outcome for republicans still stands likely as plus two seats in the senate. They will get scott in there and it will happen. He will be up in washington this week doing freshman orientation with others, including Kyrsten Sinema from arizona and that will be part of the story. What we have to hope here is that we get through the remainder of this recount and that both sides can keep their heads about them and remember that there are larger considerations here than just being on tv and scoring the last dig on the other side. At last report more than 200 people were still unaccounted for and families are desperately searching for loved ones on the internet posting pictures and last known locations. In burnedout neighborhoods more than a dozen search and recovery teams are combing through the ashes looking for remains. More search teams are on the way. Nelson recusing the republican challenger of using his power as governor to undermine the voting process. What about that and where are we . Charlie spies from california. You worked for mitt romney. Where do we stand in florida as you look from your position there in california . Ive been involved in multiple recounts around the country. The key point is that even in the one recount i was involved in in Washington State with dino rossi where the results changed. They changed because it was a grand total of a little over 2,000 votes that changed. The margins that both governor elect desantis and Current Governor scott have are insurmountable. So you are seeing a lot of legal wrangling. All my friends that are lawyers in florida are going to have good christmases. But the reality is bill theyre making money. Here is the possibility now. Do you know how many ballots were cast in Broward County in 2018 . Well, youve hit upon the problem with what supervisor snipes has done and why former governor bush has said who actually appointed her in 2003, has said she needs to be removed from office. We dont know the exact universe but we do know that the deadlines have passed for ballots to be in. Bill you understand why its such a critical question, right . Because on Election Night into wednesday morning a week ago tomorrow it was 675, 695, 700, 715. The question then is where does it stop . Well bill, the good news is there are deadlines coming up. As of thursday, the automatic recount results are going to need to be submitted. The democrats mark elias, will pull out all the stops to try to get bill nelson over insurmountable hump. The only way he does that is opening up new universes of voters. Thats what the democrats are in court trying to do is change the rules to allow different groups of ballots that are already passed the deadline come in and expand the universe of possible votes. Bill should we know roughly what the answer to that question is, what the number is . Of course we should. There are 67 counties in florida and in 65 of them they got their votes in in time and able to tell us the universe of ballots out there. Only two counties, broward and Palm Beach County, couldnt get their act together and couldnt give us answers on how many actual ballots there were. But at this point once we got past saturday when the first votes were counted, we have a defined universe unless that gets changed by courts. Bill last point here doug schoen writes an opinion piece with regard to the ballot issues. The issues in Broward County dont seem to be an issue with ballot counting but human error with the actual ballot lay out. Several voters might have missed the Senate Candidates all together. It makes the case for a recount all the more important. I think the question there is whose fault is it if you design a bad ballot . Werent we there 18 years ago with the butterfly ballot in southeast florida . We were and thats an easy answer. It is supervisor snipess fault. I think we need to get past fault and look about getting a fair and just result to the election that people can have confidence in. And there is no indication that even if the ballot design was problematic that the results would come in or be changed to a level. Nelson got 69 of the vote in Broward County. Even if the undervotes came through to him on the ballots at a 69 ratio, that would not be enough votes to change the results of the election. Kile only agreed to do it until the first of the year. The governor will need to name a successor soon. Political watchers have been discussing the possibility of mcsally, the Arizona Republic writing the governor with the stroke of one pen could apply some desperately needed salt to the open gaping wound that is post election arizona. Sandra acting attorney general Matthew Whitaker facing a Court Challenge at maryland prepares to act a federal judge today for an injunction arguing the job rightfully belongs to Deputy Attorney general Rod Rosenstein. Here is former attorney general Michael Mukasey earlier on the program. The president can fill certain vacancies with the advice and consent of the senate. The oo ig is one of those. Whether somebody acting attorney general would have to be somebody who has been confirmed. There are people available who have been confirmed. Sandra Andy Mccarthy joins us now. Is whitaker in your view a legitimate pick . I think he is a legitimate pick in terms of what his background is. He is certainly qualified for the job. There is a significant legal dispute, one side says that because he is temporary, that he is not a principal officer under the constitution, and therefore he cant take the position because he hasnt been confirmed by the senate. There is longstanding Justice Department advice for the proposition that if you are a temporary person, you are not a principal officer and therefore you dont need Senate Confirmation. It is one of these legal issues that has not been resolved. Sandra this goes to court. What happens now, maryland seeking an injunction to block this appointment . I would be surprised if maryland got the injunction because there are issues about whether they are well suited to bring the case or not. Eventually this will have to get teed up and decided. There is a chance that President Trump could supersede it simply by naming a next attorney general and perhaps doing some shifting at the Justice Department that would put whitaker in a place where his position was less contested. Sandra maryland is making the case that this position rightfully belongs to the Deputy Attorney general Rod Rosenstein. What is the case that they are making . What is the case that the state is making . That the next ranking Justice Department official in the chain of command who has gotten the advice and consent of the senate is the Deputy Attorney general. But, sandra, its one thing to say that they can say that if the Justice Department is going to take action that affects maryland, it has to be done in a constitutionally proper way they dont get to pick who the attorney general is. If the president decided to slide a u. S. Attorney in who he has appointed and who has gotten the advice and consent of the senate he could do that. If he wanted to appoint the solicitor general, he could do that. Marylands position, their strong legal position could be that whitaker is not qualified because he hasnt been confirmed. They dont get to pick who they slide in there. Sandra it makes this point interesting from the law professor at the university of texas law school. He writes an oped in the New York Times saying the president can name temporary Department Heads without Senate Confirmation is more than just a legal fine point. In many settings it can be important to the effective functioning of government. A contrary rule could cause major headaches for a new president confronted with vacancies across the senior levels of management. Contrast that with what Michael Mukasey said earlier on this program. Listen. The problem here is that if it turns out that an acting attorney general is a principal officer and Matt Whitaker hasnt been confirmed by the senate in any position, then anything he does that could be done only by a confirmed attorney general is void. There are some things that can be done by delegated to somebody else. Those things would be perfectly valid. Bill everything youre saying suggests he has a problem here. Yes. Sandra how can there be so many contrasting viewpoints . Whenever you get something thats not settled you will always have this run of unintended consequences from it. And i think even judge mukasey would say that what he is saying is there is a possibility that if his appointment if whitakers appointment were found to be void that everything he has done is null and void. Another school of thought would say look, well see what was the good faith here. Was there any real damage to anything he did . Did he take an action that somebody else wouldnt have taken . Is what he did ministerial or something that was really policy oriented . Its lawyer stuff. Sandra i want to end on this point. Ken starr wraps it up like this. I know that the Justice Department process works. I served as chief of staff to the attorney general of the United States during the reagan administration. Listen, there are processes in place and then there are checks and thats the role of the house of representatives and so forth. But i think the process within the department, with its procedures, with its integrity will then tell the tale. Sandra he made the case were just going to have to let this play out. If youre lucky enough to have ken starr as the guy who is helping the attorney general run the Justice Department, you are in a lot better shape than we may be in at the moment. Look, what he says there is a lot of wisdom. As there almost is in everything he says. It will work itself out. There are too many ways for it to be worked out properly that this will be a catastrophe. In a couple of weeks, maybe in a couple hours well be on to the next thing. Sandra for those of us who are just trying to keep track of it all right now, its tough. It is tough. Sandra you are an expert all this. All these guys are. There is a lot to understand and look back and see that Rod Rosenstein in the past is praised on the acting a. G. That brings another element to this story. Look how easy it is to be an expert in something there is no answer to, right . Any time you are dealing in uncertainty. I dont think anybody should be attacking whitaker personally or attacking his credentials, which are stellar. This is a narrow legal question about whether advice and consent applies or not. And i dont think it takes away from the fact that whatever he does he will do in good faith and try to do it in the traditions of the Justice Department and i have faith like judge starr has faith that it will be okay. Sandra were just learning that dianne feinstein, the senator, is now asking the Judiciary Committee to hold some sort of session or meeting with whitaker and Jeff Sessions. Thats about all i can a hearing, actually, an actual hearing. Just getting details on that. What do you think if thats the case and what that means . Im sure they want to raise. From the senates percent spective that they want it understood the acting attorney general would have the Senate Approve them and more sway over the Justice Department conducts themselves r himself. Why they want both sessions and whitaker there would be to probe whatever discussions they may have had, if any, about who would control the Mueller Investigation and what expectations there were in that regard. Sandra were left wondering what that hearing might look like if that happens. Andy mccarthy, nice to have you on the program this morning. Bill high security at the federal courthouse in new york for the trial of el chapo. He pled not guilty to numerous accounts and were outside the district courthouse this morning on that story. The worlds most notorious dr ug trafficker, el chapo or shorty faces 17 federal charges for leading the Worlds LargestDrug Trafficking organization for the past 25 years. If convicted, the 61yearold man will be sentenced for life in prison. Now this trial is expected to last about four months. Expect prosecutors to tell intricate story about how he a massed 14 billion in personal wealth as a drug king pin. They said he ordered the murder of thousands and supplied meth, heroin, marijuana in the United States. The evidence includes over 300,000 documents, thousands of wiretap audio recordings, 200 metric tons of seized drugs and testimony from dozens of witnesses. One of those witnesses is his the 43yearold signed a plea deal. If he cooperates his sentence could be reduced from life in prison to as little as 10 years. El chapo escaped twice from mexican prisons. He escaped in a laundry cart and again in 2015 when he escaped through a tunnel dug into his jail cell. Back at the courthouse security is extra tight. Armored caravan is bringing him from his solitaire confinement jail cell to brooklyn twice a week. They shut down the Brooklyn Bridge to bring him here. Jury selection is happening. So many people in my community are displaced and lost homes and our Public Safety folks are out there doing our best trying to protect them. I know the Fire Department is trying to get the fire out. It is just a tough situation. Sandra the camp fire now the deadliest in the states history. We continue to look at these images coming from up and down the state just complete devastation, some of these towns. What can you tell us about butte county . Im sorry, you broke up a little bit. What can i tell you about butte county . Sandra what can you tell us about what you have seen and continue to see in butte county . So butte county everybody is affected by this. The residents of the town of paradise but not the only area affected by this. We have unincorporated areas that are affected. Weve had losses in those areas. And so this has impacted our entire county. Not only from the standpoint of the fire but people who had the evacuate and taken in by other communities. It is significant for all of us. Sandra still so many people are unaccounted for and missing. What are the efforts to search for them right now . So thats a multifaceted operation. We have detectives and law enforcement, mutual aid from throughout california. First trying to determine who is missing and unaccounted for. Part of that process also is trying to reunite those people with their loved ones that supported them. Thats incredibly difficult given the fact everybody has been displaced. When we arent successful in doing that we have to look at the possibility of those individuals perishing in the fire and then we have on that side of the operation we brought in search teams. Search and rescue teams, cadaver dogs, a whole host of resources to start going through the areas that have been burned and looking for human remains. Sandra an unbelievable effort. We cant even imagine, sheriff korey hone yeah, thank you for everything youre doing and the firefighters and First Responders and those searching for those still unaccounted for on the ground there. Bill abrupt change of plans, the conference of bishops wont take any action to address sexual abuse in the church for several months time. The head of the conference said the vatican requested the delay. Lauren green has the story. Theyll talk about it, though. After yesterdays day of discernment and prayer today the bishops got into the heart how to deal with the sexual abuse crisis. The bishops this morning heard recommendations from their National Advisory council and the National Review board. Both supporting the call for a full investigation of disgraced Cardinal Mccarrick a long term history of abusing seminarians. The bishops had planned to vote on two crucial measures, one a code of conduct for bishops and the other creating a civilianled investigative body. Aned ikt from rome some speculate from pope francis himself directed them not to take any action. The bishops were frustrated. We should not forget that the reason we want to take action is because we want to protect young people and to heal those who have been damaged. Last night Abuse Victims made their presence known Holding Signs and talking to media. Saying they are frustrated and angry the bishops appear to care more about the churchs structure than its people. We love our church. But it is not the church right now that we love. We need a lot of work and bishops, i hope this is just the beginning because we are not going away. Despite the vatican directive not to vote on the two actions, the bishops plan to debate and discuss them this afternoon, included in the proposed code of conduct, for instance, the acknowledgement that, quote, some bishops have failed to stop abuse or respond properly to such claims.
