Joins us in moments. First we go to Shannon Bream live inside the Hart Senate Office building. Good morning. This is where the action is going to be behind me where Brett Kavanaugh is on his way to take a seat before the Senate Judiciary committee. The senators have plenty to say. A number of them before you had the name judge Brett Kavanaugh who said they would oppose any nominee coming from President Trump. They have had weeks to try to vet this person. Said havent had enough time and dock frments the democrats. Republicans say theyve been forthcoming. It comes down to today and these hearings. Democrats will do whatever it takes to oppose him. Here is what Richard Blumenthal from connecticut had to say how he wants these hearings to go. A lot at stake. He will have tough questions. Im going to be tough and asking challenging questions. I can guarantee sparks are going to fly. I hope there is as much light as heat. This is a man that folks across the board even liberals have come to his defense saying he is qualified in public and private practice and somebody who worked with ken starr on the independent counsel investigation. Worked in the white house for george w. Bush and has now 12 years on the bench. Now critics the democrats have said that means they havent gotten all the documents they want. All that time in the white house. Here is what the chairman of this Committee Chuck grassley said this morning. Its equal to or more than all five Supreme Court nominees prior to him. So weve got more documents on this person than anybody else in the history of the Supreme Court nominees. As you know, republicans hold the slightest edge here now in the senate and when they get to the floor there are two senators everyone will be watching on the gop side senators collins and murcowski want somebody who will recognize abortion rights. Theyre going to be respectful of the roe versus wade precedent. Keep an eye on them. They havent said where theyre going yet. The aba gave a unanimous well qualified rating to judge kavanaugh. Not one discenter. Schumer and leahy have said thats the gold standard. Hopefully they will cast their vote for judge kavanaugh. Shannon. Lets bring in john cornyn a member of the judiciary committee. Thank you for your time. If every republican votes for him Brett Kavanaugh is a Supreme Court justice. Do you have any reason to believe this will not happen . Well, i look at what happened with judge gorsuch. He got 54 votes in a bipartisan basis. I expect judge kavanaugh to get a similar vote. Somewhere in that same range. If thats the case murcowski and collins vote in favor . I respect their right to make that announcement themselves. Theyve been considering the nominee. Visiting with him in person. In the end i predict they will be satisfied but ill leave them up to them to make that announcement. Cory booker said something far more suggestionive. He said anyone supporting this nomination will be complicit in evil. It sounds to me like a president ial campaign in 2020. But i think there will be a contest here for the most ridiculous thing people will say about this nominee. And unfortunately that comment is really in the running to win the prize. Well see. Are you suggesting there might be a stage for your colleagues. Democrats held a press conference complaining about the lack of documents. The white house argues its turned over 400,000 documents. The man has a long career in the white house and the court in washington, d. C. Are those complaints valid or is that something we hear every time, sir . I think they know all they need to know about judge kavanaugh. And all theyve been wanting to avail themselves of. I doubt theyve looked at all those documents. This is about delaying and ultimately derailing this nominee. Ultimately i think theyre disappointed that President Trump is the one making this nomination and not president hillary clinton. I think thats what this is about. What will americans learn about Brett Kavanaugh this week . They will learn he is a decent, good man and somebody who has given his life to judging. He has a lifetime tenure job on the d. C. Circuit court of appeals and extensive record. He is somebody who calls balls and strikes and doesnt come up with his own strike zone. So i think youll learn a lot about his approach to judging and i think it will reassure a lot of people that he is a good nominee and he will make a great addition to the Supreme Court. I want to get to another topic. The president sent out a tweet yesterday about the attorney general Jeff Sessions. Here is how it reads. Two very popular congressmen were brought to a charge just before the midterms. Two easy wins now in doubt because there isnt enough time. Good job, jeff. Should the president be picking fights with his a. G. . I both the president and attorney general sessions. I wish they would work it out between themselves and not do it on social media. The attorney general is doing the job he thinks he is required to do under his oath and i think the president should keep him in place as long as the two of them can get along. Any nominee serves at the pleasure of the president but Jeff Sessions is trying to turn the department of justice and the f. B. I. Around in a way that brings it credit and i think he should be given the time and space to do that. To get back to the point of the hour anyway, will Brett Kavanaugh be on the bench by the first week of october . He will. Thank you, sir. John cornyn. Juan williams and cohost of the five and fox news senior judicial analyst judge andrew napolitano. Thank you for being here this morning as we wait for the beginning of this hearing. We got word that judge kavanaugh has arrived on capitol hill. Not in the room yet. Left his home a short time ago with secret service. Juan, your expectation this morning . Will he ultimately be confirmed . The odds are that he will be confirmed. The republicans have the votes and right now were locked into a very polarized process. Just last night you had documents released i think like 42,000 pages of documents. There were democrats have been asking for it. They say nobody can read that much in time for the start of the hearings. But the whole process really now boils down to no democrats voting for this nominee, all the republicans with the potential as what was pointed out earlier you have collins and murcowski looking at this issue. Because they want reassurances that kavanaugh is not going to overturn abortion rights in the country. It is really come down to that. Kavanaugh is replacing Justice Anthony kennedy who was in a powell seat. He was there for many years and then judge bork was nominated to replace powell. All the controversy and Politics Around that. Anthony kennedy comes in as a swing vote. For democrats the question is as well qualified as Brett Kavanaugh is in the aba has said he is thoroughly well qualified, is he so conservative that he would tilt this court forever and a day to the right . And lower public trust in the ability of the court to be impartial . Were expecting to hear a lot from democrats in their Opening Statements about these documents, 42,000 pages released by the white house last evening on labor day evening on the holiday evening, judge. How does this change things . This is exquisitely unfair to release that number of documents the night before the hearing starts. It is literally impossible even for a team of democratic staffers in fairness to them, to go through all of this and find what they are looking for. What are they looking for . Theyre looking for antipathy for roe versus wade expressed by Brett Kavanaugh looking in the george w. Bush white house and comments that they believe he made in writing that are in favor of torture or as the Bush Administration called it enhanced interrogation. People who are captured in the war on terror in the months and years immediately following 9 11. Why are they looking for that . Because if they can find some negative comments about roe versus wade they can try to drive a wedge between the kavanaugh nomination and two republican senators about whom weve been speaking this morning. Susan collins of maine and Lisa Murcowski of alaska. If they can find anything supportive of torture theyll try to drive a wedge between the nomination and rand paul of kentucky who is as fierce an opponent of government torture as john mccain was and who probably would change his already announced prokavanaugh stand to a neutral or negative position if these memos surface and if judge kavanaugh cannot distinguish the young judge kavanaugh from the present one. History shows these confirmation hearings rarely change any senators votes . Is this hearing any different . I dont think so. I think its a foregone conclusion that judge kavanaugh will be confirmed by the senate with every republican vote and a half dozen democratic votes, particularly those senators running for reelection in states that President Trump carried in 2016. Now, if some republicans dont vote for bret kavanaugh, then there is tremendous pressure on those democrats and juan knows this better than i, to hu the party line and follow what Chuck Schumer the Democratic Leaders wants. If every republican votes to confirm judge kavanaugh the democrats can vote their conscience. The outcome is a done deal. Some of these democrats need to say we supported this conservative judicial nominee so vote for us for reelection. Juan, your final words on the judges remarks. I dont have any point of disagreement. I would raise this point, though. In addition to abortion, in addition to torture, big issue today is judge kavanaughs stand that the president should not be under investigation and distracted while in the white house. And if thats the case you will see a lot of questions about what he believes is the case given the president is under federal investigation at this moment. Judge napolitano and juan williams. Thank you for joining us this morning. Were awaiting the high stakes hearings to begin. 8 53. Father of two. Were going to find out more on kavanaugh. The surprise announcement at the white house that was delivered in prime time. They were kept a secret until the end. One of the things he will say, a good judge must be an umpire, neutral and impartial arbiter. Im not a proprosecution or prodefense judge. Im a prolaw judge. He has arrived on capitol hill. The hearing should begin shortly. Were minutes away from the beginning of Brett Kavanaughs confirmation hearings on fox. Special coverage with bret baier and Martha Maccallum begins after the break.
