Agent peter strzok was pressed on ohr whose portfolio did not include russia and we heard more about the connections through jim jordan. Bruce ohrs wife worked for the firm for the dossier and he gave it to ohr and he gave it to the f. B. I. It is not supposed to work that way but it did. Documents shed light on steeles activities before and after the president ial election. When f. B. I. Director james comey was fired by President Trump last year, ohr wrote in his notes that steele was very concerned about comeys firing, afraid they will be exposed, bill. Among them, define reasonable doubt. What will happen today . Well break all this down with Alan Dershowitz joining us live next. If a jury has questions about what reasonable doubt is, then certainly theyre asking those questions because they are wondering whether or not there may be reasonable doubt. It is good news for the defense. Bad news for the prosecution. Sandra deliberations will resume in the Paul Manafort trial just minutes from now. The defense team feeling encouraged heading into the second day. Were still in the game was said after jurors asked for an explanation of reasonable doubt among three other questions. Lets dig into them now. Alan dershowitz is harvard law professor and author of the case against impeaching trump. He joins us now. Thank you for your time this morning, professor. First, can you let us know when you saw these four questions. Well pop them up on the screen. Is one required to file an s bar with 50 ownership in an account. Can you define a shelf company. Can you define reasonable doubt. Did these questions tell you anything . Were you able to conclude anything from these jurors questions . Yes, very much so. You can tell that the jury is seriously considering each of the specific counts. Theyre not just going in and saying do we believe gates, do we believe the accountant. They want to go through every single count. They want to know what each of the very complex elements of these crimes are. And then there is the question about reasonable doubt. That suggests that at least one of the jurors may have some questions about whether the government has satisfied its very heavy burden of proving beyond a reasonable doubt and it will also depend how the judge refines reasonable doubt. Sometimes judges make the mistake of saying its the kind of doubt that you would ordinarily allow to pause in important decisions of your life. Thats wrong because if you have a 51 doubt, if you have two possible medical procedures, one 50, the other 49, you go with the 51 likelihood of survival. But in a criminal trial 51 is not enough. You need to go to 90 . It depends how the judge instructs the jury on reasonable doubt but i dont think you can do more than read the tea leaves. Three possible outcomes. More than that. There is conviction of some but not all. Conviction of all. Acquittal on all, and then there is, of course, the possibility of a hung jury. A hung jury would be a victory for manafort and defeat for mueller. Thats also a possibility. Sandra based on what you have seen and heard so far do you think a verdict will come in today . Well, very often after you have questions from the jury, you get a verdict that day but you never know. Also juries very often like to come to verdicts before the end of the weekend so they can be home with their family over the weekend. If theyre close to a verdict and it is 3 00 on a friday afternoon, they may very well want to come to a verdict rather than have to spend the weekend deliberating or even thinking about it. So there is a strong possibility we will hear a verdict today but it is also possible they may be going through these charges so systematically that they need a couple more days. It is all speculation. Lawyers sit and speculate and bite their nails when the juries are out. Lawyers think they have clues to what the jury is thinking but often its no better than reading tea leaves. Sandra judge ellis responded on the reasonable doubt question. Only beyond all reasonable doubt, a doubt based on reason. Judge elliss response to that. The defense team thinks theyre in the game. You heard from the defense lawyer shortly after these questions came out. Because of these. Perhaps is the defense looking too much into these . Yeah, you know, the defense is in the game, no question about that. But look at the statistics. More than 92 of all cases tried in federal court, criminal cases, result in convictions. Now, not all cases are like this where theyre bringing the case in order to get manafort to sing or compose. Remember, too, even a victory here leaves him open to another trial in washington, d. C. Where he is likely to get a somewhat less sympathetic jury and judge. So the likelihood that he will end up being convicted of something is fairly high here. The real question is whether or not they will squeeze him successfully, whether or not he has anything to testify to, and whether or not he will sing or compose. Thats always the problem. Sandra what are the implications of the outcome of today and of this trial . What are the implications on the Mueller Probe, alan, and what does it mean for a possible sitdown interview between Robert Mueller and President Trump . I think this case and the trials going on give the defense team a plausible reason for postponing the decision whether to sitdown or not. If there is an acquittal it will damage the Mueller Probe. Conviction it will strengthen it. I dont think realistically too much should turn. It is easy to get a conviction in federal court for somebody who has had this kind of relationship with the truth in his economic life. Juries dont like people who wear fancy clothing, 2,000, 10,000 suits. Million dollar this and that. The jury comes in generally with the predisposition. This judge tried to right that by admonishing the prosecution over and over again you arent trying him for being rich. You arent trying him for being clever but only for crimes he has committed. So well see. It will have implications one way or another for the credibility of the Mueller Probe. Sandra professor Alan Dershowitz, thanks for your time this morning. The attorney for one of the women came to visit her client and says she does not think it is safe for her client to be released given the backlash here and online against not only the judge who ruled on the release but against the five suspects. I believe, you know, that my client shouldnt be in this jail at all but my personal belief and i really just cant understand why people would be so in some cases so threatening. Have we heard from the Manafort Defense Team yet today, peter . We have, bill. They just came by and said they think the longer the jury is in there, the better. Do you view the continued deliberation as a good sign for the defense . A great sign for the defense. The judge said this morning he is optimistic that the manafort case might end soon with a verdict. Before it does he will have a hearing about releasing some parts of the hearings that have been under seal. He said this morning, quote, everything thats been under seal with one exception will be unsealed at the end of the case. But a group of news organizations including the ap, New York Times and Washington Post just filed a motion to intervene. They want to know what has been happening out of ear shot of the press including a session earlier this week where the entire morning remains under seal. Bill any questions from jurors today at all . Not yet. But late yesterday right before they went home the jury asked the judge to redefine reasonable doubt which is key. Theyre instructed to only convict manafort if they dont have any reasonable doubt if he is guilty and to understand two terms central to the mueller teams arguments concerning Shelf Companies and Foreign Bank Account reports. Those are terms the jurors would have heard hundreds of times from the mueller team for weeks. After the full day of deliberating not everybody in the jury room knew what they meant. One thing that the jury does not have is a deadline. This judge has been riding the mueller team, he was for a week to speed things up. He told the jury before they went in for day two of deliberations they can go for as little or as long as they wants. Bill were watching that with you. You saw the live picture there. You have now with Paul Manafort, the jury is considering the case and the president basically saying its sad the prosecution was brought against this man who was a former briefly top advisor, Campaign Chairman for President Trump. How things have changed. Sandra well see what happens with that today, of course. Jurors had four questions last evening. Deliberations are underway today. Well see if there is a verdict. The president just weighing in a few moments ago on John Brennans security clearance being revoked saying he has had a tremendous response for doing that. He said he has never respected him. He went on to say what the fate of bruce ohr may be. He called him a disgrace and said he suspects his clearance will be taken away quickly. Well, a couple of things there. I thought the most interesting thing he said about john brennan somebody mentioned. Some of the people who have been objecting said it violates his freedom of speech. He said he has a bigger platform. A lot of people who didnt know who he was now know who he was and how much he liked having his voice out there. A lot of people have suggested that this president likes to create his foils. He has gone after Maxine Waters saying she is the leader of the democratic party. Now he is trying to appoint john brennan as one of the leaders of the resistance. So he takes people that he thinks are a good contrast for him and tries to anoint them as the voice of the opposition. I thought it was interesting that he would admit that when it came to john brennan. As far as bruce ohr is concerned and removing his security clearance. Last time i checked the president could fire him who is just an official at the Justice Department. Im surprised he hasnt done so. One could argue he has a legitimate reason to do so given bruce ohr and his wifes involvement. His wife was an employee of fusion gps, the company that hired Christopher Steele who wrote the dossier in the first place. I dont know why he is fooling around with a security clearance if he thinks what he did was wrong. Why not fire him . Sandra he didnt necessarily rule that out. This whole thing is a rigged witch hunt the president said a few moments ago. 12 former top intelligence officials have criticized the president for pulling brennans security clearance. Possibly bruce ohr is next. Do you suspect there may be more obamaera officials . The president has left it out there and when Sarah Sanders pulling brennans clearance she mentioned other Obama Administration officials some connected to the russia investigation, some not. The officials who came out today about a dozen former c. I. A. Directors and former defense officials, robert gates, who was the defense secretary for george w. Bush and then also for barack obama, part of that group. And in effect what they said is look, its one thing if you are trying to protect security. If the information if there was any evidence that john brennan had misused classified information. But he said this seems to be a political act, not a security act and thats what they objected to. So well see whether or not the president goes after any of those other folks. He certainly has the right to remove security clearances. But it is curious that all the people he is talking about removing their security clearances are critics of his. People that have opposed him and spoken out. None of them as much as john brennan. He has really made this a big focus of his administration and as a border state it affects us and i have appreciated the effort. Sandra when you look at the attorney general Jeff Sessions taking these steps and issuing this order to speed up the deportation of Illegal Immigrants and some critics say it goes too far, when you what do you worry about as far as unintended consequences of a move like this . You know, obviously you have to make sure these people as they go through the process are treated fairly and you want judges making good decisions. You dont want so much pressure on a judge they cant make the right decision. On the other hand, we know that this is taking too long. These other unintended consequences is you have people in the process way too long and that has an impact on their lives. So there is a balance here and hopefully we can get closer to the balance that we need to have. Sandra sounds like you like what youre seeing from this administration and november midterms coming up. He has turned into sort of a member of the resistance and the president likes having that kind of a foil. Im not confident that advances the president s cause. If brennan is to be faulted for anything, i dont think it is engendering a conspiracy against trump but failing to advocate a tough, firm, active policy against russian measures to sbhir fear why our elections. And brennan is part of the leadership that should have been saying mr. She is below jeff flake in many cases. If the president was happy i was running against jeff flake im certain he will be happy if im the pick to work for the United States in the senate.
