What well do is we are going to see what kind of legal remedies are available to us including, if they subpoena us, challenge the subpoena. The same reason they cant indict him constitutionally. Bill kevin corke. What do we know about that, telling mueller its essentially over . Let me just walk it back this way, bill. First of all what we know is there is a legal precedent here is what giuliani is referring to dating back to the clinton years in the white house. However, its also i think relevant to point out that has not been tested in the courts, at least constitutionally. We dont know if it will or will not happen down the line. We havent heard this specifically from the office of special counsel. We dont know if what the mayor is saying is, in fact, accurate. What we can tell you is he feels very strongly thats what he was told by the mueller team. In fact, the president is on twitter no surprise once again this morning once again making known to the American People his frustration with the special counsel. Congratulations, america, were now into the second year of the greatest witch hunt in American History. Still no collusion, no obstruction. The only collusion was done by the democrats who were unable to win an election despite spending far more money. The white house insists there wasnt collusion but it was politically orchestrated from the very beginning and they argue not only was there no crime there will most certainly will not be an indictment. One of his assistance said they were bound by Justice Department policies. The next day or the day after they clarified it for jay sekulow who was with me at the meeting. They didnt have the power to indict. Didnt have the power to indict. Now, its a big if the special counsel decides not to pursue an indictment it doesnt mean he doesnt have other remedies to consider. Some on capitol hill think the president still can be indicted. The president is not above the law and an indictment, if thats the course Robert Mueller chooses to go, i believe would be upheld by the court. Go to the United StatesSupreme Court and an issue that has never been resolved. Senator blumenthal a former state attorney general has taken the deep dive look at this. Well see how it plays out if it gets to that. Bill new revelations about a money trail involving attorney Michael Cohen, what can you add on that today . This is a complicated story. Some argue here at the white house it doesnt pass the smell test. What ive heard there is a whistleblower out there who says he became concerned about a couple of suspicious activity reports. Those are sars. You get them in banking if you make transactions that dont really seem like they would be typical. You may remember that is something that happened during the whole denny has some reports disappeared from a database and it made him concerned and we learned yesterday from the president s financial physician he repaid Michael Cohen for the Stormy Daniels payment. Listen here. Was this done a couple weeks back on the network because you knew this was coming out . Sure, absolutely. The president was aware of it and he endorsed a strategy. He is the client, after all, has tremendous judgment about things like that. I think the oge, office of government ethics agreed with us that it has been fully disclosed. It is always a good feeling when it feels like adults are participating in our government. And in this case you get the feeling that mueller and giuliani are adults and they are trying to bring this to a reasonable conclusion. Nobody is making hysterical claims, nobody is doing over the top stuff. What the Senate Intelligence committee disgeorgeed yesterday was a lot and about cohen is a lot. There is stuff here. This is not an empty hole. But what giuliani very obviously is trying to do and seems like quite effectively is negotiate in public when and if the president talks to him and how to wind down this thing. I think were getting a lot closer. Bill initial three points from giuliani. You cant indict, thats the case he is making. You can write a report and if you do well react to it but you can impeach. That lies in the house of representatives. Mueller never said he could have impeached. The executive branch cannot impeach itself. The department of justice to the white house, thats that. Obviously the rules for the Justice Department have stated for a long time the way giuliani phrased it is they dont have the power to indict but it really the answer is their policy not to indict because the remedy for president s who are corrupt is political, not judicial. That would be a matter for the congress. If they really found something important that would be the matter for the congress to resolve not for the courts to resolve. Bill you mentioned the Senate Papers that came out yesterday. Chuck grassley on the floor went after the reaction of it. Watch. So the claim that there was some secret plan to help one side or the other in the Mueller Probe is absolutely absurd. My only motivation was the same as the ranking members, transparency for the American People on this controversy. Let the people read it for themselves and draw their own conclusions. The children ages 6 months to 12 years old were punched, strangled, bitten, water boarded, scalded with hot water and shot with a cross bow and b. B. Gun allegedly by their father and mother. In fact, from jail allen told one reporter, quote, i am not perfect but im not an animal. Im not a torturer or a monster. The couples 10 children are in state care. Police found them six weeks ago huddled together on the floor of the couples filthy home near San Francisco filled with rotting food, human and animal feces according to records. Interviews with the kids revealed the abuse allegations. Rogers bail was set at 500,000. Her husband 5 million. He previously served six months in jail for assaulting his wife. Court records allege allen performed most of the abuse while rogers knew about the incidents. Assisted in some herself and dissuaded the children from reporting their injuries which included broken arms. The children were homeschooled. Hamas saying that 50 of those killed during the protests on monday were members of a terror group. Were live in jerusalem with more on all this. David lee, whats happening . The tension along the israel gaza border is simmering but now appears there could be a deescalation in the level of violence because of intervention by egypt. As you mentioned in the last few hours the Israeli Military says it conducted a number of air strikes targeting hamas facilities among them a weapons warehouse and military compound as well as two other locations. The air assault was in retaliation for an earlier attack by Palestinian Militants who sprayed machine gunfire at the Israeli Border community. Despite the hail of bullets there were no injuries. In a statement the Israeli Military says it holds hamas responsible for everything that takes place within the gaza strip. Egypt which shares a border with gaza is leaning on hamas to stop the mass protests along the israel gaza border. Israeli military released a video shows palestinians attempting to cut the border fence. According to a published report today, egyptian intelligence officials told hamass top leadership in a meeting in cairo, the blood of the palestinians killed in these demonstrations is on their hands. The egyptian reportedly showed hamas leaders a video that showed hamas members paying off civilians if they agreed to approach the border fence despite warnings from israel that the consequences could be deadly. Hamas has now agreed to stop inciting violence but expected to continue and they will peak on the date of june 5th. Thats the date that the anniversary of the sixday war. As you said at the introduction hamas is now acknowledging that of the 60plus people who died during the demonstrations in the last week, 50 of them are members of its own group. And another militant organization, Islamic Jihad is saying that three of those who died were its members. So it appears now that the overwhelming majority of those who were killed were not civilians, but members of militant organizations. Were outside the gates of Windsor Castle where you are seeing the rehearsal of the Royal Wedding procession. They are leaving the gates escorted first by the cavalry. We are now waiting on the royal carriage. It will be pulled by the windsor grey horses. Here they are. They are actually white. Were learning a lot on the ground here as we watch this. This is the royal carriage as it comes through and exits the gates of the castle. This is the royal ascot carriage chosen by prince harry and his soon to be bride Meghan Markle, chosen because its a little higher up than the others of the five carriages they had to choose from. There is the cavalry and they make their long procession through the town of windsor and finish up on the long walk practice for the big day on saturday. There is so much to talk about surrounding this Royal Wedding. Everybody is talking about every detail. What we know and what we dont. Theyve been quiet. All of it was coming from gossip channels. We had an update and it was a statement directly from Meghan Markle to say she is sorry her father wont be able to come to the wedding because of his health. She has been very close to him and wishes him well and wants him to recover. I think we all knew that but it took a statement from her personally to confirm it. Sandra one very big question who will walk her down the aisle . Some people have been saying Prince Charles. I think thats unlikely. I think perhaps if it was kate it might have been Something Like that. These two have done things differently. She is such an avowed feminist she would love to have the opportunity to do something different. She wont be given away by the man, maybe by herself or her mother. Thats the obvious choice. Sandra these two are doing things in some ways similar to previous Royal Weddings but many ways theyre doing things different. For instance, theyre getting married in st. Georges chapel here in Windsor Castle and this is a smaller venue. This couple is choosing to be a bit more intimate and personal with their planning. I think it will be recognizable as a Royal Wedding. You can have the you are right. Because he is not in line to the throne and he wont be king he has the license to be different and they want to put a personal stamp on things. St. Georges chapel only holds 00 people. I think kate and william had close to 2,000. Windsor is easier to contain. Security is such a big issue for this couple particularly. They can lock it down. There will be a ring of steal around windsor. I wasnt prepared for that last night and this morning the town of windsor. The support and the way the people here have truly embraced Meghan Markle. Someone who is very much she is different from what we have seen from royal brides past. I think thats why we love her. The royal family desperately needs to stay relevant to people in this country. Especially at the moment with brexit and all this thing going on. Were a little unsettled and we need some consistency, which they provide but it wont work if theyre seen as out of touch with the rest of us. Meghan markle is what britain looks like these days. Now im seeing in the royal family who looks like me and im more interested. We love prince harry. There was a survey he ties with the queen as the most popular member of the royal family. Weve seen him go through so much. Losing his mother, he lost himself, a period of chaos as he describes it. He grew up into this lovely young man and we all just wanted him to find a lovely woman. But you do notice the popularity of the royal family. You tell me but as far as history is concerned it seems rather high. Were at 70 popularity at the moment which is riding high. Whats wrong with that is this investigation from the mueller team has spent millions of taxpayer dollars to already demonstrate what the president and i have said from the very beginning. There is no collusion, there was no cooperation, there was no coordination between the Trump Campaign and the outside entity and not fair to continue to spend taxpayer money. What is fair, though, put a definitive end date on it. It has been a year. And we dont know when this investigation will wrap up or when the report will be written and submitted to the department of justice and congress for their review. But that has to happen soon because if it doesnt, you cant just give a blank check to somebody and let them continue investigating something and let it go off in a million different tangents. It cant happen. Bill do you think giulianis presence has crystallized . He is a force of nature. I thif think he is a very aggressive attorney. He ran the Criminal Division of the Justice Department before he was a u. S. Attorney. He understands the system. What he is saying is look, what information do you think you are going to ascertain by sitting down with the president . Mayor giuliani has talked about this and i believe the mueller team has agreed a sitting president cannot be indicted. Thats a memorandum that goes back from the Justice Department from 1999 during the bill Clinton Monica lewinsky scandal. We know there is no indictment. The president didnt do anything. The most important thing now is end this investigation and let the American People move on because there was no collusion or coordination between the campaign. Bill i think your observation of what giulianis strategy is is spot on. He is saying if you subpoena a sitting president well fight it all the way to the Supreme Court and win because we have the votes 54 minimum. Thats the case he is making publicly. The interview with sean hannity three weeks was no accident. He wanted to take on the mueller matter. He wanted to put the Stormy Daniels matter out there and address that. They knew the disclosure was coming a couple weeks after that. This was the strategy over the past month. On the disclosure of Stormy Daniels this is what he said last night. The oge, office of government ethics, basically agreed with us that it has been fully disclosed. I have a little disagreement with them, a petty one. I dont believe it had to be disclosed at all because i think it was an expense he reimbursed. I dont agree its a liability because i know the nature of it. It doesnt matter at this point. The Inspector Generals report was expected in january but sources familiar with the investigation tell fox news it was extended as new witnesses came forward and new leads were pursued. The investigation, which began with bipartisan support in january of 2017 took on allegations the f. B. I. , Justice Department deviated from Standard Practice and law in the clinton email investigation. This came to include senior f. B. I. Executive leadership since more than a half dozen Senior Bureau officials have resigned, reassigned or fired. They looked at Loretta Lynch who refused to answer foxs questions recently when on capitol hill after a former f. B. I. Director james comey testified that her meeting with bill clinton in the summer of 2016 and that was just before Hillary Clintons f. B. I. Interview, was a game changer. What we understand at this time is that officials are looking at the draft. They are making issues with the classified information what will be released to the public and there is a step in this process where the individuals who were interviewed and who are the subject of the investigation get a chance to respond. If you remember with the f. B. I. Deputy director Andrew Mccabe when he was terminated in the footnotes of that document was his response to the allegations he said in that particular instance he felt that director comey was not necessarily forthcoming because he believed director comey was also the subject of a leak investigation. Bill so this will be very interesting, catherine. What are we learning from the transcript from yesterday. The trump tower meeting in 2016, Senate Committee released that yesterday. The latest information we have is really a reaction from the republican chairman of the Senate JudiciaryCommittee Chuck grassley and took to the senate floor late yesterday and pushed back against critic saying the documents released did not have the backing of democrats. Now as to the trump tower meeting, congress has learned as much as we are likely to learn unless some new information comes to light. And that may happen. We have to be ready for it if it does. Other committees, the press, and the special counsel are all over this as well. The things we learned from the transcripts about the june 2016 trump tower meeting is that donald trump junior testified to the Senate Judiciary committee in a closed session he did keep his dad in the dark about the meeting when the russians claimed to have potentially negative information on then opponent Hillary Clinton. Congressional investigators asked about a number of issues, including questions for this man, rob goldstone. He said in his testimony that the meeting almost didnt happen because he said it was really kind of a confusing, chaotic situation with the russians saying i am a music publicist, not someone who knows a lot about politics. What do you make of where things are today . I think over the last year weve discovered that there collusion, but the collusion clearly has more to do with the f. B. I. Potentially having an informant spy in a campaign for president by donald trump. Obviously comey being compromised in many ways, including his breaking the law by leaving government with these notes. What weve discovered really is after a year of looking for some wrongdoing by the Trump Campaign, they havent found it and yet they arent looking at the very blatant wrongdoing by the f. B. I. Leading up to that, including the very premise of this investigation being nothing more than a dirty trick operation out of Hillary Clinton and the dnc. Thats what we now know. It is time to have an investigation of the underpinnings of this investigation. Obviously i join with Rudy Giuliani in saying that after a year they ought to print what they have and if they have nothing, admit it. Sandra interesting. And you just heard Rudy Giuliani, his thoughts on the matter, and that he believes that james comey engineered the whole thing and you said the case is essentially over. They are just in denial. If there were a crime here in a year they would have found it and proved it. What theyve proven is they can trick people saying things and being untruthful and theyve done it time and time again and running up the score on people who make false statements about unrelated activities going back even into 2005. Look, i was supportive of a special prosecutor, special counsel and supportive that we should have it. Im not supportive that what we need is a select committee in congress to find out just how deep and dirty the f. B. I. And department of justice was in the eight years leading up to this administration. It is pretty darn clear that the f. B. I. Thats what judge ellis in virginia is questioning and rightfully so. One of the thing that senator burr asked me is how did the Intelligence Community belaifsh on the threat of russian interfere answer. Did they do a good job of advising president obama. By and large they produced accurate information. Something that not entirely unprecedented, russia has meddled in other elections and propaganda isnt new but they went to a new level last year to throw instability and chaos in our society but they have may have grown for the preference to the president. He didnt win because of the russians. Bill did you talk about the dossier or what some republicans believe kicked the whole thing off . Some of that remains classified and will be in our final report and again thats one of the challenges of dealing with this stuff is there are things at this point we cant openly discuss. Well, satisfied that the intelligence agencies identified russian interference and began to address it and so our focus is very different from what mueller is doing. Mueller is a criminal investigation. Ours is oversight over the Intelligence Community and trying to prepare our country for future efforts by russia, by china, by anybody to mess around in our elections. So again thats one of the things that our job and it is different from muellers. Bill james comey was not there. Did that bother you . Well, im not i dont know why he wasnt part of it. He is a Counter Intelligence role. Weve had him in before and i imagine if we need him well have him back again. He has been interviewed and testified a couple of times. We have a lot of information from him already and that will also be part of it. Bill do you think there was collusion during this election or not . Ive said this in the past and said it again. Weve seen no evidence of that to this point. There will be a final report issued and what were looking at now and ill let the report speak for itself. Theyre finding people they believe the media will turn into sympathetic victims and putting them out there to be hurt. Theyve done this over again and many in the media fall for it. We make calls to other countries to embassies abroad. Imagine if zte or wawa controls the infrastructure in a country like that and hearing what our government is doing and stealing secrets.
