The wall street journal says charges have been filed against he and former business associate rick gates. As we wait to learn more many republicans say the continued leaks in the story are highly problematic. We dont know who is being charged or what they are being charged for or the time period. The only conversation ive had with Robert Mueller was stressing to him the importance of cutting out the leaks with respect to serious investigations. It is kind of ironic that the people charged with investigating the law and executing the law would violate the law and make no mistake, disclosing grand jury material is a violation of the law. As you pointed out Paul Manafort surrendered to authorities this morning. He has been a target of the Mueller Investigation. In case you dont know, manafort is a powerful lobbyist in washington other reports suggest that rick gates will also turn himself in today. The investigation, sandra, we believe is focusing on a number of suspicious wire transfers to an entity in cyprus. An indictment is just that. Prosecutors think they have a goods for a conviction. Defense attorneys get a chance to see what they have in their hands to play. If this is focused on business dealings and not the Trump Campaign specifically speculation about socalled collusion could dry up. The president hasnt made comments this morning and we havent heard from the white house despite an opportunity to get them to comment on this. The president was very busy over the weekend tweeting lots about this. He said never seen such republican anger and unity as i have concerning the lack of investigation on clinton. Fake dossier, 12 million. The uranium to russia deal, the 33,000 plus deleted emails. The comey fix and so much more. Instead they look at phony trump russia collusion which doesnt exist. Dems are using this witch hunt for but republicans are fighting back. So much guilt by democrats, clinton. The facts are pouring out. Do something. Something is certainly being done about the russia probe as it relates to that man there, Robert Mueller. Republicans as you saw trey gowdy are concerned about the consistent leaks. Earlier on fox news we had a chance to hear from Kellyanne Conway laying out the president s view even as the speculation in washington reaches a fevered pitch. The president has said from the beginning people are cooperating and that he just thinks its a hoax. The president continues to focus on what matters to people, though. Just look at last week. It was a tremendously successful week for this president. Thats why people arent focused on it and focused on mr. Muellers investigation this morning. Focused on the investigation but this is a week where the white house wants to drive the conversation in a different direction. We have taxes coming up. Talking about a foreign trip, 12 days to say nothing of the fact the president is expected to name a new fed chair as well. This is an unfortunate politically speaking circumstance and could get tougher depending where the investigation goes from here. Bill lets analyze all this now based on what we think we know. If the indictment is made official and has not been just yet, this would be the one anticipated indictment that people have thought would happen for some time. Would you agree with that . Absolutely. This was expected. I think over the past several months if you asked anybody who is following this Mueller Investigation closely, the one thing they all agreed would probably happen would be that Paul Manafort would be indicted. As a matter of fact over those months a number of people in trump world have told me they expected manafort to be indicted. So that fact is just not a surprise. Bill now as we wait on more on that, we have to figure out what he is indicted for. Now, we also have to figure out whether this happens during the time he worked for donald trump or prior to. Give us some background on what Paul Manafort did before he came into the trump world. Politically that is going to be the huge issue here. And again, the thinking was the indictment would probably cover business dealings that manafort had in ukraine and Eastern Europe 10 years ago. For quite a long while he represented the prorussian president and the thought is that these would arise somehow from that. Did he launder money he was paid . Did he not report it on his taxes . Did he fail to register as a Foreign Agent . These are all alleged crimes that if they took place, took place years before he joined the Trump Campaign and was the Trump Campaign manager in june, july and august of 2016. The question is whether anything that he is charged with today has anything to do with his time in the Trump Campaign. Bill as you are literally answering that question here is the readout we get from the f. B. I. Paul manafort, age 68, richard gates, age 45, have been indicted by a federal grand jury in the District Of Columbia dated october 27. The end of last week. The indictment contains 12 counts, conspiracy against the United States, conspiracy to launder money, unregistered agent of a foreign principle. False and misleading fara statements. False statements and failure to fire reports in foreign banks and financial accounts. The case was unsealed after the defendants surrendered themselves. There you have to brief outline of the charges that theyre now facing. How does that fit into what were anticipating or describing now . It sounds like what i just described. Did he launder the money . Did he pay taxes on it and register . Fara is the Foreign Agent registration act. If you have to be a lobbyist with a foreign country you have to registered with the u. S. Government. If these charges are all concerning earlier times, what connection could they make, prosecutors make to the Trump Campaign . If there is no connection, could they be used to pressure manafort into giving them information about any possible wrongdoing on the Trump Campaign . The only problem is we dont know what such wrongdoing might be. Certainly manafort is now under pressure, having been indicted and prosecutors can come to him and say listen, you probably should tell us everything you know. Bill what do you know about rick gates . Who is he, what is his collection . Longtime business associate with manafort and was working in that with the ukraine and came to the Trump Campaign with manafort. Manafort was brought in in early 2016 as a delegate counter to prepare for the republican convention. After manafort left, gates went to a pro trump super pac and kept some connections with trump world although not in the white house or anything like that. Bill there was some thought that Robert Mueller would begin his list of charges against what would be considered small fish. I dont view Paul Manafort as a small fish, do you . That did not happen. There was a theory the prosecutor would start out with the small fish and indict somebody lower down the chain like carter paige or Something Like that and work his way up. Well, one thing we can say now that didnt happen. Manafort is the former chairman of the Trump Campaign. Very close to the operation, obviously. It appears that mueller has started at the top. Theyre saying if you dont keep in the deduction of state and local income taxes, my constituents will go up in taxes. Thats what peter king is saying. Governor comeau tweeted saying all new yorkers will get a tax increase because of this plan because of the elimination of this deduction. Here is where we are now. Basically republicans are caving to some of this pressure and they are now saying okay, we will keep in the plan the property deduction. Property taxes in new york are very high as well as new jersey and connecticut. So people like peter king and others in new york are saying if you dont keep something in there, then my constituents get a tax increase. It looks like theyll keep the property Tax Deduction in there. Thats a positive. They still arent moving on the state and local tax income deduction being eliminated. That is creating a fight. Sandra you interviewed House Majority leader mccarthy over the weekend. He was very revealing if some instances and others not so much. When you asked what are you going to do to win over those skeptical gop lawmakers here was his answer. I think 401ks are very important. What well find out in ours well raise the amount you can put in. The more that individuals can invest their own money the better off we are in the long term. They have more capital. Can protect themselves from the future and not looking to government. Sandra he addressed 401ks. A lot of fear what of will happen there. Did he clear things up . I dont think so. The bottom line is theyre looking to scrap together as much money as they can. If it means lowering the amount of money that we contribute taxfree to our 401ks, if they change the cap and maybe put a cap in place for the state and local deductions. If you make more than 300,000 or 400,000 you wont be able to deduct it. If you make below that number you will be able to deduct it. Maybe thats another 400 billion. We have the benefit of having you on first after this just came out. First of all, you anticipated this Paul Manafort . Yes, i didnt want to speculate because its dangerous to speculate. Over the weekend and early this morning but it is clear that Paul Manafort was very much in their cross hairs. It is clear from the Early Morning raid on his home as well as other information that the special prosecutor let slip that he was their principle target. Bill youve got it in a binder and youve already read it. Yes. Sandra what can you tell us . What do we need to know . The government has he massed a very sophisticated case against him. The case shows that he and his colleagues engaged in massive fraud these are allegations only. He is innocent until proven guilty. Massive fraud on the United States government by failing to report income and his status as a Foreign Agent. What is troublesome and news worthy is that the allegations continue to september of 2016 meaning during the time that Paul Manafort was the chair or chief executive officer, im not sure what the title was, of Donald Trumps campaign he was still, according to the government, engaged in this massive Money Laundering fraud and was serving as an agent of a foreign government. The government of the ukraine, without ever having informed the United States of america as he is the scheme is earning massive amounts of money from the ukraine controlled by the kremlin. Having that money paid to dummy offshore accounts. Having those accounts purchase real estate in the United States and then borrowing money against the real estate and not reporting that money as taxes. So you can see the money went from russia and the ukraine to offshore accounts to real estate in the u. S. To Paul Manafort. Sandra what caught my eye was the zeros. I started reading the indictment. Were just going through some of the numbers. Number 6 second page in total more than 75 million flowed through the offshore accounts and manafort laundered more than 18 million to buy property, goods and services in the United States. He was the legitimate Campaign Manager for the last popularly elected president of the ukraine, the one thats very close to the people in the kremlin. And he was paid a lot of money to do that. After that fellow was elected, manafort stayed on as an advisor. For what purpose we dont know. He was paid a lot of money, a lot more money in his role as an advisor which he funneled through the offshore accounts than he had been paid as a Campaign Manager. This will surely stir the pot of the speculators what were they paying manafort for . What kind of influence were they paying him for . It is not clear what he was paid for but that he was paid a lot of money. Richard gates. He was not involved in the campaign as far as we can tell. But was one of manaforts closest collaborators and Business Partner during this time period that goes back to 2005 and continues up to 2016. When they were lobbying to get the job in the ukraine. When they got the job in the ukraine and made all these millions and funneled through the offshore accounts and didnt report it to the i. R. S. Sandra when i ask the question what happens now ill read the last line. The case was unsealed after defendants were permitted to surrender themselves to the f. B. I. Sometime today theyll appear before a judge who is a tough cookie, the federal judge in the case. She will probably release them in their own recognizance. Prior to that theyve been booked. The charges unsealed this morning illustrate the near limitless scope of the Mueller Investigation and possibly the special counsels intention to use his ability to probe various matters as a way of developing more information on the russia collusion angle that was supposed to be his main focus. Paul manafort for a time the president s Campaign Manager last year and his associate rick gates surend derd to federal authorities this morning and due in court to enter please to a dozen charges filed by the special counsels team. The charges brought are focused on the period 2006 to 2015. Well before Paul Manafort became associated with the Trump Campaign. Sources close to the case believe the mueller team, known to employ some hardball operators as prosecutors is using the specter of prison time for alleged financial crimes committed as long as 11 years ago to compel testimony from manafort and gates that could implicate the president or other individuals in a Trump Campaign in alleged collusion with the kremlin last year. Manafort and gates funneled millions of dollars in payments into Foreign Bank Accounts the indictment reads adding they hid the existence of the Foreign Companies and Bank Accounts and reportedly to tax preparers and to the United States that they had no Foreign Bank Accounts. Manafort and gates among other things directed a campaign to lobby United States officials on behalf of the government of ukraine. The president of ukraine and ukrainian political parties. Required by law to report to United States their work and fees, manafort and gates did not do so and the indictment alleges manafort used his hidden overseas wealth to enjoy a lavish lifestyle in the United States without paying taxes on that income. These are all just charges and we await the plea from mr. Manafort and gates. I spoke friday night with manaforts attorney after cnn reported the existence of sealed indictments and the attorney told me neither he or his clients had received notice of manafort being indicted at that point. I spoke to someone this morning who spoke to manafort on saturday. He said he didnt believe he was going to be indicted. Bill surprised then . Blind sided . At a minimum didnt see it coming. Bill the fact remains as you reported friday night about cnn disclosing this report first, does that suggest another violation of law and if so, how . Well, the leaking of secret grand jury information in this case would not be so far afield as subjects of inquiry go that it would fall outside of special counsel muellers scope of investigation. Theoretically his office would be obligated to look into how cnn obtained that information. There is a precedent for this in the original special prosecution, the watergate case. Carl bernstein and bob woodward of the Washington Post team credited to unravel it. They contacted a grand juror and lied about it for decades. It was not until 2012 when a biographer of ben bradley discovered evidence of this illegal contact with a grand juror in bradleys papers when it was confirmed. Returning to the present day tom perez is responding to the indictment saying that all the charges related to their work to promote a proputin regime and the case underscores the seriousness of the investigation into Donald Trumps ties to russia. What stands out to you so far since this has all been breaking. The first thing is that this indictment, these charges against Paul Manafort and rick gates suggest that bob mueller has even bigger fish that he is hoping to catch here. These read and sound like charges the government has manafort and gates dead to rights on but they are looking possibly to flip Paul Manafort or rick gates in some bigger case that has to do more directly with possible russia collusion with Trump Associates or Trump Campaign associates. So that is the first thing that sticks out. They dont have a direct connection, these charges, with that case. I suppose its possible that mueller is going scatter shod here. This doesnt jive with his reputation in washington, which is someone who is very much a straight shooter who is going to bring charges very limited based on the facts that he has and the charge that he has. So i think this is the beginning of the story not necessarily the end of it. Sandra there is an important distinction to make as we continue to learn the details of all this and the charges involved. No links to trump, no links to 2016 election or collusion. As people try to wrap their minds around what we are learning and hearing coming out of this right now, what does it mean . What does it mean for the trump agenda . Well, maybe no direct connections but remember, these the timeline of which these charges are looking at and the investigation was looking at goes into past manaforts time working as the Campaign Chair. It is important to remember the nature of his employment. Manaforts employment with the Trump Campaign. He wasnt taking a salary. We know he was in a lot of debt. In fact, he was simply trying to curry favor, one report had, with pro putin allies in the ukraine. He was trying to make connections between Trump Campaign officials and russians. I think there is there are some Big Questions raised about what exactly his role was in the campaign that may not have directly to do with these specific charges. Much of what happened, happened long before he was with the Trump Campaign and underscores one more thing, which is that the president took on Paul Manafort when a lot of people in this town and a lot of people in the broader political world knew this about Paul Manafort. He had these sketchy connections. This sort of sketchy career lobbying for foreign governments. It really wasnt until reports came out about these that the Trump Campaign cut him loose. Sandra before this news broke we played that clip of Kellyanne Conway saying the russia investigation is a waste of time, she said. I want to show you what Michael Goodwin from the New York Post wrote in the New York Post this morning. Any honest probe must examine the obama house and justice department. Mueller served under president obama and cannot be expected to investigate his former colleagues and bosses. His piece was titled, Robert Mueller should resign. Yeah. There has been a lot of calls for this. I dont know. I find the argument pretty weak. Bob mueller is a republican appointed by george w. Bush, kept on during the obama administration. F. B. I. Directors have generally been independent of the administrations they work for. All these questions coming out of this uranium one case. I think that people are jumping to conclusions and suggesting that the f. B. I. s decision not to recommend bribery charges in that case, we dont have time to go into the details, means that somehow he is mueller is compromised. I dont think there has been any evidence. It is basically a bunch of jumping to conclusions here. Mueller has a good reputation in washington as being somebody who is a straight shooter and follows the facts. It is certainly possible that he is sort of overshooting here with these indictments but there has been no evidence of that. And you are hearing from a lot of elected republicans that mueller should be allowed to continue his investigation and see where the facts go. That is where paul ryan was a few months ago when asked about this. Sandra it brings out the important question as to what happens next. Yeah. Look, i think that there are there are these rumblings trying to get bob mueller to resign. There is always the possibility the president or the Deputy Attorney general could fire bob mueller if they think he is going out of the scope of his investigation. Im told that the department of justice and the Deputy Attorney general, who remember, Rod Rosenstein is in charge of this. He hasnt discussed at all the idea of firing or asking bob mueller to leave. So the question would be then in President Trumps hands if thats something he chooses to do. Otherwise i think the Investigation Continues and as i said at the beginning, this is something that seems like the beginning of something, not necessarily the end of muellers investigation. Sandra well continue to see how the white house and president respond to all this. This coming out at the very beginning of what is going to be a very big week for this white house, of course, the big gop tax plan set to be unveiled on wednesday. They are hashing out the details now. You wonder how this clouds the agenda. How this gets in the way of all these important things getting done. Thats right. Thats a frustration thats felt on capitol hill and the white house as well. Remember, lets go back to the frustration the president had with attorney general sessions. He believes the president believes that sessions recusal has led to all of this. Has thrown off the president s agenda, has caused all this investigation to be ongoing. And he has been angry. It has been reported that he has been angry with Jeff Sessions even considered firing him, asked him to resign. Bill, from everything ive seen and read there is nothing in the indictments that in any way involves the campaign in any way involves President Trump or anyone at all as far as the campaign itself. It goes back five or six years, predates the campaign entirely and probably predates Paul Manafort meeting donald trump. It was wrong over the weekend talking about who could be indicted. Pictures of all the people in the administration and the trump family. I felt all along this had somebody had to involve incidents that had nothing to do with the campaign. I assumed it would be Paul Manafort. I have no idea about guilt or innocence. I know the only evidence that seems to have come out from reading about it in the past has been involving Paul Manafort and his lobbying activities. Nothing to do with the campaign. Bill what does that mean, then . Are you suggesting the white house is off the hook, sir . No, the investigation still has to go forward. What im saying from what ive seen so far there is no evidence at all linking the Trump Campaign to russia, russian influence or collusion. The New York Times will say thus far there is no evidence of collusion. Thats the reality. This investigation has been going on for over a year. Director comey started it back in september or october of 2016 before the president ial campaign was over. Weve gone through all the different iterations whether it involves the f. B. I. , the justice department, special prosecutor, also three committees in the congress and so far im not aware of any evidence at all that has come out in any way linking the Trump Campaign to russia, russian interests or russian influence. Bill okay. Another question on that. You have been in on some of these interviews, right . Yes. Bill what can you share with us about the line of questioning and how it enables you to make a statement that you just made there . I cant tell you what goes on in the interviews other than to say i have not heard any evidence at all what would in any way involve the Trump Campaign as far as any kind of russian collusion. There has been nothing at all. That i think is also what i hear coming from the senators when they talk about it and again from if you even read media accounts. If you dig into it thats also what you are hearing from the media from their sources. So im not aware of any i cant go into any testimony that was offered other than to say ive seen nothing at all indicating any collusion. Bill a tweet from trump at the white house. My concern is coming from the part of the country that i do that the way the language was originally discussed as far as taking away the property Tax Deduction and income Tax Deduction. That would in effect end of raising taxes on people in my district. In fairness kevin brady and others are working to get rid of that. My concern is there would be a tax increase for my district. Sandra the corruption trial of new jersey senator bob menendez resuming as the defense seeks a mistrial claiming the judge is biased. David lee miller is live in federal court in newark, new jersey. This now day 27 for new jersey democratic senator Robert Menendez facing bribery charges. He entered the courthouse a little more than an hour ago. He brushed aside reporters questions well see what happens today. As you mentioned, the defense has filed a motion for a mistrial as well as a number of other briefs. Defense contending they arent being fairly treated by the judge. In addition to the motion for a mistrial they are also asking the judge to reconsider a number of items he refused to admit in evidence and also calling for acquittal on a number of charges that deal with Campaign Contributions that the prosecution contends were part of the bribery scheme. The defense says they dont meet the legal threshold that they are required to do in order to be illegal. One of the motions, a 45page motion for a mistrial says in part the court has denied the defendants fair and meaningful opportunities to present a complete defense to the prosecutions case buyer ownously preventing the defendants from introducing add miss able evidence and testimony. The prosecution addressing the motion for a mistrial said the defense wants to confuse and distract the jury. They say the defendants are unwilling to accept responsibility for their own conduct. The judge says he will rule on the motion for a mistrial at 10 minutes to the hour. Thats when court is going to reconvene. The hearings about the mistrial, by the way, were done with the jury not present in the courtroom. Sandra, it is extremely unlikely this based on the judges earlier remarks last week, that he will grant this motion. And when this ruling takes place, the trial will resume. But so what they have done, i think in this context is say look, you know, taking a knee is part of the protest protest right now. And so we want to stand up for what we see as social injustice by disrespecting by the owner by taking a knee. Its a little confusing.
