Director referenced has been flying around the internet since before that angry mob stormed the capitol behind me on january 6. What has National Security officials and secret service and others very concerned here in the capital is that there have been open calls to bring weapons to washington, d. C. And to state capitals for an armed protest this sunday at noon. The flyers say refuse to be silenced. This time the feds are waiting for them. Protestors who bring weapons to washington im told will be arrested just as the proud boy leader was on january 5th. Last night Vice President pence walked the line of National Guard at the capitol thanking the troops. Thank your families as well. I know you all had to mobile out to get here. Being here at the capitol, providing the level of security that will make it possible for us to have an historic transfer of power. Thousands and thousands of men and women in uniform will make it possible for us to have a safe inauguration. 21,000 National Guard have been called up for the inauguration. About 7,000 are here now. Their rules of engagement different than a week ago. Those who were part of the mob inside the capitol last week have been charged with multiple federal crimes. Weve already identified over 200 suspects so we know who you are if youre out there. And f. B. I. Agents are coming to find you. Federal authorities are preparing for the possibility of a mass casualty event just in case. If there were a major event there, this unit can do high very high level, highskilled search and rescue from confined spaces and high angle search and rescue and a biological, chemical and nuclear environment. From the ohio National Guard. What has pentagon officials and senior u. S. Military commanders very concerned is that they have seen the images of many veterans who are highly trained in military training who were part of the crowd. Some of them breached the capitol. Some charged. At least one was charged. He was a state policeman from virginia, an active duty National Guardsman. That has military officials concerned and they have put out letters to the force saying as much and calling for calm and telling members of the u. S. Military to follow the law. Back to you. California governor calls in the National Guard to help protect the State Capitol and other government buildings. Workers are installing fencing around the Capitol Building in sacramento. Crews are adding concrete barriers around the State Capitol building in new york in albany. Sandra lets bring in bill mcgurn, former speech writer to president george w. Bush and fox news contributor. Its something for all of us, for the American People to see the added security measures happening in washington just to secure the inauguration. 20,000 troops in our nations capitol. What do you think when you see that . Well, i think its a little bit sad. Its a public ceremony for the United States. It is very important so its sad to see a lot of these troops there and so forth but i think the best hope is that it is unnecessary, right . I think after the violence we saw last time the last thing we need is more violence this time and one of the problems last wednesday, i believe, was just the lack of manpower. When you are facing huge crowds it just looked like a Capitol Police did not have enough officers to discourage people from even thinking about overwhelming the barrier or something. Im hoping it is all unnecessary and well be better off. The main thing is not to allow any repeat of last week. So i think they have to do what they have to do. Sandra meanwhile Miranda Devine this morning is writing about she calls the lefts bare faced hypocrisy, bill. House democrats believe in a peaceful transition of power at least this time as opposed to 2016. They believe in walls when it comes to protecting their own place of work. They believe in bringing in the National Guard to quell civil unrest when it comes to preserving their own peace. We learn that they almost to a man and a woman suffer from an acute case of hypocriteiteis she writes. There is never any shortage of hypocrisy in our Nations Capital. She is absolutely right. It doesnt really change anything. The problem with these kind of arguments is that right now the focus has to be on peace and the flip side of that argument is that those of us who have no tolerance for anyone caught in any act of violence have to be consistent and condemn it from the trump side when we see it. But i dont think thats too hard because i dont think most Trump Supporters, the peaceful ones, have any issue with prosecuting people who broke into the capitol or broke a window or did any other violent act. So but she is absolutely right. This was not the zero tolerance idea or joe bidens idea that these are domestic terrorists because we didnt hear that language when portland or seattle was burning. We heard about a summer of love. Sandra to that focus on peace youre talking about there, dan bongino was talking about that on hannity last night. Listen. If we cant live and agree that we can dispute tax rates and healthcare policy thats fine. But there is a meeting in the middle with these both parties. We will not normalize Political Violence ever. Well have our elections and do our thing but we wont ever normalize. If we could agree on that one rule everything would be peachy going forward. But we cant even agree on that. Sandra will we eventually be able to, bill . I hope so. I hope as time passes and so forth we get a little more perspective. But i do agree in addition to the violence, some of the hypocrisy were seeing from Democratic Leaders is going to lead very, very bad feelings. There seems to be an effort now not only to say i dont like anything donald trump did, i disagree with his tax cuts, his deregulation and his foreign policy, but an effort to demonize all his followers as though like the qanon is representative of the 74 million trump voters. If we continue down that path we arent going to have the healing that the president elect is right to say we need. Sandra really interesting. Her first bills in the new congress would dilute ballot integrity and make d. C. A state. To that point, bill, when you dig into that piece it is highlighting the fact that appears to be the priority for nancy pelosi and members of her own caucus rather than focusing on the problems at hand, getting people back to work and bringing an end to this pandemic causing so much struggle and pain in this country. Yeah, look. It is not surprising that a democratic leader of the house would want to expand democratic members of the house, democratic governors and senators and a democratic president but were fiddling with the rules. This is one of the areas like a lot of the people who believe that the election was stolen, im not sure theyre looking in the right place. I dont think those theories about what happened on election day. I think the bigger problem and one of the things that has eroded confidence is that we changed election days like election month and they did all sorts of things doing away with requirements to verify certain mailin ballots. A lot of this was done beforehand. And i think people need to have confidence in the system and have a system. I personally dont know if we can get the genie back in the bottle. I believe in election day that you vote unless you have a very good reason that you cant come that day. And that we should get the results as soon as possible. Hopefully that night. Tom dupree is an attorney and former Deputy Assistant attorney general. Tom, the fellow in that picture who just saw there Adam Christian johnson is his name. He has been arrested and charged with theft of Government Property, one count of violent entry and Disorderly Conduct on Capitol Grounds and charged with one count of knowingly entering or remaining in any restricted building or grounds. His lawyer has a comment on well, what appears to be photographic evidence of the crimes. Listen. That presents problems for you as a defense attorney in that you have your client in the building at the time of the breakin. I dont know how else to explain that. That would be a problem. Im not a magician. We have a photograph of our client inside the Capitol Building. Jon is this a case, tom, that screams plea agreement . Well, i think certainly to some of those lesser charges i would say yes. If your client is captured on a photograph or video being unlawfully present in the capitol it is hard to defend that. I think what well see in a lot of these cases is plea agreements some of the lesser charges such as unlawful entry. If you have cases where individuals are being charged with more serious crimes, assault and battery, sedition, there i suspect he might see Defense Attorneys try to mount a defense. Charges of that nature cant always be captured with photographs. Jon we still dont have any charges yet in the death of the Capitol Hill Police officer who apparently was hit in the head multiple times with a fire extinguisher. They are taking their time trying to nail that down and that charges like those could even carry a federal Death Penalty i suppose. They could. Certainly if you are attacking and murdering federal officers, if you are committing a murder, if a death occurs in the course of commission of a felony, all of those things potentially could be to the Death Penalty. I suspect what Law Enforcement is doing in this case they will arrest and begin prosecution against many of these individuals on the lowlevel charges such as unlawful entry and as evidence surfaces those more serious charges will later be added and prosecuted. Jon i suppose its a case where they can squeeze the people charged with lesser offenses and say to them hey, there is this guy in the shot next to you in the video next to you. We want to know who that is. Give us his name. Sandra thats exactly right, jon. This investigation is unique in the sense that you have literally thousands of people who were at the crime scene. You have an unbelievable amount of photographic evidence. Unbelievable amount of video evidence. So i think it will take some time as investigators begin protesting and looking at the videos and looking at the photographs. Talking to witnesses on the scene to try to identify the perpetrators and bring them to justice. Jon the arrests are already underway. F. B. I. Director Christopher Wray spoke about that. Listen. Our posture is aggressive. It will stay that way through the inauguration. So in that vein we and our partners have already arrested more than 100 individuals for their criminal activities in last weeks siege of the capitol and continue to pursue countless other related investigations. Jon from a Law Enforcement standpoint other than the sheer numbers of the accused involved here, from a Law Enforcement standpoint is this a difficult case just because there are so many people rampaging through the capitol or does that photographic that you spoke about make the job easier . Its a bit of both. I think its more difficult in the scale of whats going on. You heard the director saying there have been hundreds of arrests, there will be many more. In that case in terms of just the sheer volume of this investigation and the prosecutions, thats difficult. On the other hand, i think from a legal perspective a lot of it will be fairly simple. If you have photographic evidence of these people in the acts of committing crimes and that defense attorney we heard from earlier said there isnt a lot you can do to defend that. I would imagine many of these charges will be settled by way of plea bargains rather than actual jury trials. Jon tom dupree. Thanks for your expertise. Sandra another busy news day this morning. Senate sources are telling fox news that documents related to john durhams investigation into the origins of the russia probe will be declassified today. Fox news is told sometime likely this afternoon we will get hundreds of pages, what is expected to be hundreds of pages of documents related to the russia gate investigation. Fox news is told theyre transcripts of depositions and interviews in the russia collusion investigation, among them debriefings that Christopher Steele who compiled that dodgy dossier on President Trump had with the f. B. I. After he was fired as an informant by the f. B. I. There are said to be connections between the initiation of that dossier and the Hillary Clinton email scandal and a lot of documents will also be related to steffen halper, the cambridge professor and f. B. I. Informant who connected with both carter page and george papadopoulos. President trump sent this tweet in october of last year saying all russia hoax scandal information was declassified by me long ago. Unfortunately for our country people have acted very slowly especially since it is perhaps the biggest political crime in the history of our country. Act. The president has long maintained that his campaign was spied on, other officials have said no, it wasnt spied on, it was appropriate surveillance. These documents may shed some light on that and may also had to the longheld belief in some circles that that dossier was part of a disinformation campaign. Of course, this is all part of the investigation thats being carried on by the special counsel john durham. Jack dorsey told his twitter employees in this leaked video that the trump ban is just the tip of the iceberg. Juan, what do you think . Well, i think they are reacting to violence. So i think when he says that, he is talking about the long ongoing debate, jon, in this country about what should be allowed, misinformation, disinformation. Do these private companies have any responsibility or are they just platforms . They make the argument they arent publishers, thats under section 230. The president saying he would like to take that away from them. That would undermine their business model. The people on the left of course are concerned about disinformation and even plotting violence. The idea that this inauguration is coming and 70 plus of americans fear there will be more violence is very real and connected to social media. Jon david, im guessing, dont know it for a fact, if you went back and scoured every twitter account ahead of the riots over the summer that there would be some advocating violence and those accounts didnt get shut down. Is there a double standard at work here . No question about it. Though, jon, this is bigger than the violence. This is almost jack dorsey screaming to president elect biden and the Democratic Congress to make them a public utility and then be in the room to set the regulations to give him the edge over any other competition that would potentially come about. This is about stifling free markets and capitalism. All of that said, this is a private business. People are not obligated to go on twitter. In fact, they just get every piece of personal information they can from their users and then sell it so that dorsey can give live a lifestyle that very few of his actual followers get to live. Jon well, and a lot of people have said over time, juan, if you dont like twitter, start a conservative social media platform of your own. Somebody came up with parler and then essentially they get shut down in the wake of the capitol hill riots. Good point, jon. So they are in court right now. For example, they have a major suit against amazon and then amazon has responded and said again that what they see is a lack of any moderate surveillance of violence and provocative statements on their site talking about civil war, whites raining down murder and devastation, calls for assassinations of people like Vice President pence, former president obama. So thats the response from amazon that this is about the violence, not about censoring anybody. It is about saying that there has to be some kind of limit if we are going to have a civil society. Jon meantime at one of the nations most prestigious universities and confers of legal degrees, harvard there is a student petition going around that seeks to strip harvard degrees from President Trump supporters, people like kayleigh mcenany, his public white house spokesperson and ted cruz, texas senator and dan crenshaw, the texas representative. A bunch of Harvard Students passing around a petition asking their harvard degrees be revoked. David avella, your thoughts . I dont know about juan but if students got to pick whether you got a degree or not, my approach at Shepherd University would have been dramatically different. If they revoke peoples degrees will they also give them their money back for what they paid to earn that degree . This is just a continuation of the New York Times is now allowing the millennial staff to decide who gets to write opeds and who doesnt. Now harvard wants the students to get Harvard Students want to get to decide whether they get a degree whether they pay for it or not. Jon i had to read the Scarlet Letter when i was in high school and there are comparisons here that come to mind. I wonder if these Harvard Students ever had to read that book . I read that one and i like davids joke. I think that what we have here, though, is a situation where, you know, were in a moment in history, you know, and i think lots of people are very, very distressed and upset that there was such misinformation. People told the election was stolen despite the fact there was no evidence, despite the courts, the attorney general, the Cyber Command thing, no evidence of any fraud in this election. And then people were saying who perpetrated this and who in congress was willing to vote to block certification of bidens election. I think you are seeing those repercussions. I understand why conservatives might say dont silence conservatives, it is like the Scarlet Letter. But in this moment people are saying this was outrageous. More scaledback version of his original proposal. Lets be clear this is not a universal basic income plan. So yangs basic income plan actually will only include 500,000 of the citys poorest residents. He wants to give them 2,000 to 5,000 a year. Only 166 a month per person. That is going to cost a pretty penny, about a billion dollars a year for the city. So how will he pay for it . His camp has mentioned leaning on philanthropic groups but we dont know details. New york city is facing a nearly 4 billion deficit and some experts think yang really needs to fix the citys finances beforehanding out cash. New york cant print money. The federal government can and has in 2020 to build a pay for stimulus checks. New york city right now, though, is already a welfare state with a police force and what andrew yang is proposing is just another expenditure on top of an already bloated budget. Yang is also facing a very crowded race with less than six months away from the primary. Sandra 14 top members of the ms13 gang charged with terrorist offenses in the u. S. The Justice Department announced the charges yesterday. According to a federal indictment imprisoned gang leaders continued to run ms13 from behind bars and ordering hits on people. Certainly the democrats are not concerned at this moment, about paying for it. Remember, this is a response to the virus, a response to a clear emergency, and they dont care about how much theyve got to borrow and spend. They just want to get out of this thing. I might add weve not yet gotten the tax side of the Stimulus Program. That is to come. The tax side of it will be raising taxes here and there in just about everywhere. That will be paying for this program. But the bottom line right now is that the government is going to borrow much of this money. 1. 9 trillion now. More stimulus to come. Theyll borrow most of it. They wont get much from raising taxes. Sandra as we go through more of the details he is laying out in this plan, stuart. 1400 stimulus check. 15 an hour minimum wage. Calling for 400 billion to viet covid. 450 billion to territorial states and governments. You weigh that out there and what stands out in particular the 15 minimum wage call that he is making. A lot of this was the central these were central points to Bernie Sanders president ial campaign. Yes. I think that the 15 an hour minimum wage at the federal level is probably one of the easier things to get past a narrowly divided senate. It is politically popular. If you can go back to your constituents and say i got you a raise, got everybody a raise. Up to 15 an hour shortly thats politically attractive. I suspect that 15 an hour will be one of the easier parts of this Stimulus Program to get passed. As for the 350 almost 400 billion thats going to the states for aid to them, that might be more difficult. Republicans do not want to see democratrun states like new york, new jersey, illinois, california, they dont want to see taxpayers in florida and texas bail out the badlyrun democrat states which ive mentioned. So that might be more difficult to get through. But he will get something, at least a large chunk of this 1. 9 trillion program will go ahead. Sandra fair enough. And at least 100 other people that authorities are looking for. How long would you expect it will take to figure out who was involved and start the justice process . This could take months. I look at this as three categories. First you have the people that are in the capitol, right . Those people to the extent they have been arrested and charged with knowingly entering into restricted building or grounds, lawful authority, violent entry, Disorderly Conduct on the capitol. Beyond that the people that can be charged for attempted acts. Those will be harder to catch. They werent in the Capitol Grounds. You dont necessarily have good video of them to positively i. D. Them. You have to go after them as well. Then the question of conspiracy. Are there individuals that helped put this thing together that may not have been on the Capitol Grounds that may not have been in the protest and finally i guess accessories. People that helped the folks that got to the Capitol Grounds but werent there. You could charge them with conspiracy as well. They could be accessory before the fact as well. Hundreds if not thousands of people to look to that youll have to go through social media and emails. You will have to work your way up or down the ladder based on the folks that you have in custody right now to find out who else was involved. But now we have to move on and do it in the right way and that will require resources which will require legislation. How it will be done effectively well know more about. I have some idea about it because weve made suggestions in that regard but i think that the message of last night and later today from the Vice President will be a message of hope to encourage people to again when they are is appropriate for them to receive the vaccine to do so. As was said and as will be said it is not just about the vaccine, it is about testing and distancing and all the rest as we go forward so that we can crush the virus, which is what we must do, crush the virus so we can open our schools and our businesses, honor our heroes who were on the front line of this, our healthcare workers, our police and fire and first responders, transportation, sanitation, food workers, teachers, our teachers, our teachers and put money in the pockets of the American People so that the lives and the livelihood of the American People are addressed. In terms of the timing as i mentioned one week ago on january 6th there was an active insurrection perpetrated on the capitol of the United States incentivized by the president of the United States. One week later, wednesday to wednesday, that president was impeached in a bipartisan way by the house of representatives. So urgent was the matter. They are now working on taking this to trial and youll be the first to know when we announce that we are going over there. Yes, maam. A number of House Democrats mentioned a couple of investigations going on. The number of House Democrats have signed a letter asking about looking into gop members who may have [inaudible question]. What would you like to see done in that investigation . Is there a timeline or any action that may be taken toward members who did bring public groups into the capitol before january 6 . When we are talking about security we have to talk about truth and trust. In order to serve here with each other we must trust that people have respect for their oath of office, respect for this institution. We must trust each other. Respecting the people who sent us here. We must also have the truth and that will be looked into. If in fact it is found that members of congress were accomplices to this insurrection, if they aided and abetted the crime, there may have to be actions taken beyond the congress and in terms of prosecution for that. Yes, sir. We all are seeing Extraordinary Security measures now in place here in the capitol and throughout much of the district. Im wondering your level of comfort about that inauguration . Let me just say thank you for the question. As a member of the committee that prepares for the inauguration, for a long time now, weeks, it has been determined that we would have a very small inauguration because of covid. That in order to have the distancing and the rest on the platform and then some people down below, it would be necessary to limit it. I dont know if they have publicly released the numbers. I wont, but a very small number of people. A tiny percentage of the people participated before. Most disappointing because obviously were excited about nominating a new president of the United States, but not at the risk of Peoples Health and wellbeing and indeed their lives. So this is always going to be small. Now with the insurrection of last week it is necessitated by security to have more security but hasnt changed the nature of the swearing in. I think it is important for people to know that. This is not a concession to the terrorists, its a recognition of the danger of covid. We all want to be sure that the requests that are made by the Capitol Police are being honored by those who are in a position to meet the needs. What can we expect that to be open for us and will it be when the pandemic ends and when do you see that happening as far as it wont be one minute before it is safe to do so from a covid and security standpoint or one minute later than that. But again the investigation will tell us what we need to know to have truth that we can trust the system that we have here. And it is so sad.
