In order to grow, they need you to buy the app on the app store. The app store, not only that, but on that same day, they also, amazon got involved and amazon removed their servers. So that is really the challenge that how democrats will impeach someone when they really dont have the law on their side. What it ultimately comes down to, politics, you know, this whole second impeachment again will be about politics. You have to wonder, is that really how we are going to unify by impeaching someone when we simply dont have a lot on your side . I think that you can look at the president and what he said since the election and say, you know, im not comfortable with that red brick. It could be negligent, reckless and there are crazy people out there to do crazy things but is it intentional . Right, you can say i dont agree with how the president acted to, but should big tech censor him . Should big tech remove him from twitter . These are different opinions you can have but its not all or nothing here. But i would say in case law, there was one case that talked about someone saying take to the streets but thats not thats not incitement. Taken to the streets, pretty much democrats were saying that all summer. So if we are going to elevate what the standard is for, you know, incitement, you have to look back over the summer, was that incitement too . If that becomes the standard Going Forward, no president will be safe from this now, you know, overtly Political Tool of impeachment, which really should be a last resort for legal violation that you can absolutely prove in the senate. You know, i think it will be very similar to what we have seen before, obviously, much more abridged timeline. You will have your witnesses. You will get a vote out in the house, but by the time you get the vote out of the house and into the senate, it will be what, january 1819. It will be a day so the president elect biden will take office. They are about to create an easy pathway to simply vote on impeachment the final days of a president s term. That is not what the framers foresaw. They wanted a deliberate, not impulsive system. This is in polls buy impeachment. Even though you have leaders that say we may wait months before we give the article to the senate, they are still rushing forward with the vote . Why not have a hearing to discuss snap impeachment . There is the question of impeaching the president s first speech and qualified but he actually didnt call for insight, rioting violence. I oppose the challenge in congress and how it was said to, but in the speech, he tells his followers to proceed peacefully. People go to the capitol all the time to cheer and condemn people doing stuff inside. That doesnt mean that this was not reckless and that it was not wrong. I happen to believe it was both. The speech should not have been made. The president was saying things that were not true about Vice President pence being able to send these votes back. Many of us have been saying that for a long time. So there is plenty of ability to condemn the speech. There is even the option of censoring the president. But we shouldnt rampage through the constitution like these people did. The senate has agreed on unanimous basis not to come back into session until january 19th, the day before. So the idea to impeach the president before joe biden becomes the new president is ridiculous. It is going to look rushed. It looks like bent upon retaliation. It looks like concerned about making certain you cannot run in 2024. All of that will be problematic. I think representative cliburn is right. This is where the president wants to have the focus on him. This is sucking the oxygen out of the room for joe biden so that we are not talking today about what he wants to do in his new appointments but does nancy pelosi want to impeach the president . They do not want that to be, what the senate is spending its time on the first 100 days, hearings on confirming the cabinet and starting to move forward on his policies. If the senate is tied up in this contentious argument about should the president be impeached and not allowed to run in 2024 because of what he said which i think is reprehensible and i agree with Jonathan Turley he should not have given that speech and what happened afterwards was a result of what he said to be read but what he said was things like go in peace and let them know to cheer on the people who agree with this. But this is just a real problem, i think, for the democrats. Most important of all, it is wrong for the country. The president is disgraced, the president is discredited. He is spending two months basis to make baseless charges of widespread voter fraud and kept it up with the speech. Let him go. Let him go in silence and let the country turned the page and move on. Sandra it is a big statement, Alan Dershowitz is basically saying this isnt just dangerous for republicans. This is dangerous for both parties and a danger to the constitution. But i think dershowitz is right, speech to clear a line, and read the speech several times and its atrocious. But there are plenty of language in there, go in peace. I will lead you up there and cheer on the people who agree with us. There is plenty of material in that speech that is an adequate defense. Alan dershowitz is right you hold this president for responsible for the actions of people who went up there. They are responsible for their own actions with the president was telling them to do is what they were doing. You hold him totally responsible and you are creating a weapon that can be used in a future year against another president. And what is to be gained by this . Is it to censure him . Fine, do that. You are capable of doing that every moment but is it to keep him from running in 2024 . Right at think they will look for a few things sandra, the federal statue would apply with prohibition on encouraging or conspiring people to commit a felony but the other possibility is encouraging people to buy force prevent the execution of laws of the United States. I suspect those are two of the federal criminal statutes both the prosecutors in office as well as prosecutors, the new team to come on board after biden is inaugurated would be starting to see if they have the basis for bringing charges against the former President Trump. I think it is something has to be worried about. What the president said ended wednesday was wrong. And i suspect that what prosecutors are going to be looking at and will have to decide is number one, do they have suspicious evidence to prove to a jury beyond a reasonable doubt that either the president or others who spoke were involved in the rally were a crime . The second question, whether the best interest of the United States to actually bring a prosecution even assuming they could ultimately prove the charges at the end of the day . Sandra ian pryor joined us earlier and said this. You look at the president s speech and you know, you really dont see that. You talk about peacefully marching on the capitol, talk about cheering the senate asser tatian him but there is nothing in there that you could reasonably interpret to inciting insurrection or violence. Sandra i was curious when i was reading through the peace and politico that he cited tweets from the president in middecember. Sing statistically i may have possibly lost 2020 election, telling protesters in d. C. , be there. It will be why old spirit encouraged his supporters to stop this deal. Could some of those previous tweets before this violence actually happened come into play as well . I think they could come a sandra because what a prosecutor would do is try to tell a story and in that story, they can cast an eye back two months before the rally to show what the president said, what the president was thinking, what the president was trying to achieve. His tweets would be evidence of that. Look, the president would have defenses. He urged people to go in peace and have charges to be brought, i would suspect that is his primary line of defense. But the things prosecutors will be looking at, tweets, comments and other people in the white house, comments after the capitol stormed and how we was reacting and what was unfolding on television. All of that would be relevant and a live that would make it before the jury. Sandra consequences for the writers themselves who caused that damage and started the violence.
