Trace Mark Meredith is live in louisville. What are you seeing out there this morning . Trace, it is much calmer this morning than what it was last night. It was chaos last night including the street im standing on now even though there were so Many Police Officers out there that didnt stop hundreds of people coming to protest. A few of those protestors decided to set things on fire. The big headline is what you were talking about. The shooting of two Police Officers a half mile from where we are. Look at this dramatic video captured by some of the body cam ras out there by the Police Department giving us a better idea what was going on. The latest update we got from police at 10 00 the officers were in stable condition and one was in surgery last night. Suspect was arrested shortly after the shooting. We have a pretty good idea of who he is and waiting to confirm with local Police Departments down here. There is somebody in custody now. We should get an update whether anybody else will be charged with the shooting. The good news is those two officers are in stable condition as they were last night. One of the other big topics weve seen here some of the protests developing. The city of louisville was much more prepared this time around than they were earlier this summer. We saw them bring in the National Guard and saw them set up barricades all over town. There is one piece of video that has gone viral in 12 hours or so posted online. Appears to show people showing up to the protests grabbing supplies and signs out of a yu haul truck. An indication that people were ready for the decision that would be coming out here with the Breonna Taylor case. As you mentioned on wednesday a grand jury deciding not to indict any of the officers who Breonna Taylors death instead one former officer being charged being indicted for firing his gun into a nearby apartment. That is not connected to taylors death specifically. The other people nearby. We should get a better idea how the family for Breonna Taylor feels about this. Their attorney said they were outraged and not the right decision on their part. As you can see down here in louisville now the streets are empty. Mostly media and a few bystanders. You know, the sad commentary of what we observed last night in louisville as well as other major metropolitan cities is the country we love imploding internally and it is a very sad state of affairs when you have two Police Officers just trying to serve and protect that were shot last night as a result of just trying to do their job. It is a very sad state of affairs. Sandra we saw reaction from the Taylor Family through their attorney ben crump. He is making the case the charges the lack of charges are outrageous and offensive and a grave injustice. Listen. 401 years we have been dealing with systematic racism and oppression that finds Police Killing us outside the courtroom and the system killing us inside the courtroom. Sandra there are those this morning who are saying that the outcome of this is very fair. The family says it is not. What does the outcome of this mean for what were seeing as far as Police Brutality across the country . Well, sandra, they are going to always be both sides of the spectrum when it comes to Police Brutality. Certainly the black community after seeing what happened to george flood down in minneapolis have some legitimacy to believe that Excessive Forces are being used against their community. On the other hand you have to be fair to Police Officers. What we know in this case is that three Police Officers were going into that premises to serve that warrant. Once they entered, they were fired upon by kenneth walker, the friend of miss taylor. Those officers legitimately had a right to return fire. Sadly, miss taylor was killed. I think, though, the attorney general, Daniel Cameron, should revisit whether the charges against officer hankinson. He is not charged with shooting miss taylor. As a matter of fact they said they believe the bullet that killed miss taylor came from the weapon of officer cosgrove. So he is charged, hankinson is charged with shooting into another property. I think that when you look at the circumstances here of an officers being shot at, officers returning fire there is a great deal of confusion. So you anticipate and expect that hankinson would have shot his weapon. I think they will have a hell of a time getting a conviction of han kin son. Sandra Daniel Cameron defending his decision. The officers statements about their announcement are corroborated by an independent witness who was near in proximity to apartment 4. In other words, the warrant was not served as a noknock warrant. Having that type of delay could cause i think very much destabilizing our country, pushing off a week before we know who the winner is. Could certainly i think lead to a lot of people questioning the final result, which i dont think is good for anyone. Trace we should note there are states that will be counting ballots six days after the election. Thats a good point. Even when the president was asked about committing to a peaceful transfer of power, he brought up again mailin balloting. Watch this. Well, i think the president feels like Many Americans that it is not going to matter. He will win on election day and serving another four years. I dont think he expects to have any type of transfer of power. I think he feels like he is in a good place, polling this week in several key battleground states like arizona and florida have the president ahead. I think he feels good about where he is now. There is concern for states who have not conducted this type of mailin voting before and having that delay i think is going to cause a lot of people to question that final result if we dont know what it is and they dont even finish or in some cases start counting some of the ballots until six days after the election takes place. Always good to have you here. You look at this number and what does it tell you . Which number are you talking about . The jobless claims . Its irrelevant to todays market is my personal opinion. 870,000 new unemployment claims filed. Thats not whats motivating this market at this moment. Sandra, ill tell you straight. Whats motivating the market, whats motivating sellers and theyre out in force again today is the threat of election chaos that would mean a delayed and highly contested election, probably decided by the Supreme Court. Investors really dont like that. Thats the way it looks to be going at this point. There is some concern about a second stimulus or new Stimulus Program. Were probably not going to get it. Congress is wrapped up in a debate about the next nominee to the Supreme Court. That is toxic indeed. Hard to get a Stimulus Program in that kind of environment. There is also some regular profit taking. These big tech companies, for example, have gone straight up. They dominate the overall market. It was almost certain that they would come down at least a little. They are certainly down right now. Thats whats happening. Its a selloff again, sandra. Sandra interesting analysis there, stu. You cant rule out there is a lot of uncertainty building in this market. With the stimulus package as you point out. Uptick of covid in some cases of the country and abroad and the potential for more shutdowns as larry kudlow told us on this program this week. Now you have the Supreme Court vacancy. As you and i have talked about for years and years markets dont like uncertainty. When it comes to jobless claims, you have the number below that psychologically big million mark. Still 870,000 americans filing for firsttime jobless benefits. What does that tell you about where we are overall in this economic recovery as we try to claw back from this shutdown . Thats a fair question. I dont want to discount the jobless numbers entirely. What the latest numbers tell us is that the recovery, the pace of the recovery, is not as rapid and dynamic as we would like. Weve heard forecasted in the Third Quarter and were in the Third Quarter right now well have a growth rate of well over 20 compared to the second quarter. Now thats astronomical growth rate. When you look at these jobless numbers and the number of people long term unemployed runs to the millions of people, that implies that we wont have quite that 20, 25 growth rate in the Third Quarter. It is a bit of a negative but not a terrible negative. As you can see the dow at the moment is down close to 100 points. Nasdaq down 56. Anyway you slice it we have a selloff in progress. I repeat. I think its largely because of what is likely to happen, what is certain to happen with election delay and confusion. Sandra there is a lot of anticipation for that. Meanwhile when it comes to this stimulus package and the hope for one, as you know there are many struggling Americans Still out there, stuart. Leading to last friday the passing of Ruth Bader Ginsburg, the debate was heated and we all saw it going somewhere eventually. One side or another was going to give, something was going to get done. The battle in congress to replace rbg is dashing hopes for a covid19 stimulus package. So are we losing hope that something is going to get done as far as help for the American People before election day . I have larry kudlow the Top White House economist on my show in a couple of hours and ill ask him that. I just wonder if there is some way that the president can stimulate the economy, get some more spending, some new measures out there to get things going without necessarily going through congress. It looks doubtful that congress can separate out the toxic discussion of a replacement for Ruth Bader Ginsburg on the Supreme Court and a stimulus package. The two are intertwined because of this terrible relationship between the two parties in congress. So im going to ask larry kudlow, do you think the president could get something done without congress . He wants something done. I believe that larry kudlow wants some kind of targeted help for the economy. And i think most americans would like some targeted help as well. So can they do it . Can they pull it off without congress . Good question. I will ask it. Sandra final thoughts before you go. You have to get back to your show and well get back to ours. Small businesses, this is the heart of our economy, it drives the American Economy and they have struggled through this pandemic. What are you seeing and hearing about those Small Businesses being able to come back . In new york city we had more violence in the streets last night. Restaurants are barely hanging on if they havent already had to shut their doors permanently. But what are you seeing and hearing on that front as so many are struggling to survive . If you limit it to bars, restaurants, travelrelated businesses i think the outlook is grim. In the extreme. Now, they may get more government help. I dont know about that. They may get some more government help but even if they do get some more help, i think our society has changed significantly because of the virus lockdown. I dont think we are going to go back to anything like normal when it comes to eating out, having a drink in a bar, getting on a plane, getting on a cruise ship. I think times have changed and those industries, those Small Businesses in those industries are going to take a hit. It is a very sad thing. Sandra add to that so many working from home. I would be shocked if you see anybody go after her as being racist. I think they will go after her judicial philosophy just as republicans go after the judicial phil of democratic appointees. Theyll try to make the fight about the Affordable Care act. It is up for review before the Supreme Court a couple weeks after election day. And you are hearing more and more democrats out there saying look, president is trying to ram through this nominee in time for that case so that he can strip away the Affordable Care act so that he can strip away the protections on preexisting conditions in the middle of a pandemic. That will be the core democratic message. And so expect whomever the president s nominee is to really become central in that conversation over the next few weeks. We know that, right . We know that north florida is as republican as any deep south state. We know that south florida is as democratic as any northeastern state. And then in between you have the deciding part of florida, which is basically the tampa, st. Pete area and orlando area but you raise an excellent point, which is that in north florida in alabama florida, you have a pretty large city . Jacksonville and you have a pretty large city with some pretty affluent suburbs. What do we know about trump since 2016 . He has struggled with the traditional republican coalition, to say affluent suburbanites. He has done better and we expect him to do better in the rural parts or small communities of north florida places like the Florida Panhandle and the center part of north florida, we expect to see him do better there. Those voters like him. More trouble for him there. The deal for trump in jacksonville is just cut into bidens advantage a little bit. You dont have to win it or do it. You have to do about as well as you did in 2016 or get close. That will be enough. What trump needs to do in florida is maximize everything he can out of that northern half of the state. Sandra lets go back to his first stop today. Mecklenburg county, when you look at what is happening in North Carolina, joe biden has called a lid for the day. You heard the report from peter doocy. He made it a point to stop there yesterday but chris, what is happening here . What is specifically happening in charlotte and does the president have some momentum behind this area of the country . Number one it is the suburbanites that we were talking about in florida and think about North Carolina this way. Charlotte, the city which is democratic. But the suburbs, of course, are the key battleground. Mecklenburg county represents Something Like a third of all the votes, i think in North Carolina when you get down to it. There is a big Republican Center of gravity to the north up in raleigh. Thats the big republican bread basket. How trump won in North Carolina before was doing about as well as a republican should be expected to do in Metro Charlotte and raleigh but doing really well in rural areas. Places like in the southeastern part of the state with meat packing plants and poor voters and economically struggling voters. The reason its tough for trump now how do you balance those three nodes, charlotte is the right place for him to be to do that. Sandra you make the point of trump pulling off the victory in 2016. The polls did not indicate that as you very well know, chris, heading into the outcome that we eventually saw in North Carolina. Here is the real clear politics average heading into the president s visit down in florida today. Joe biden is still leading in that state. It is a small lead but it is still a lead just over 1 . And then heading back to North Carolina his first stop today still leading but just 1 2 percent thread there. Final thoughts . We expect to be two of the very closest states. Florida is always the biggest swing state. Most valuable but always tight, tight, tight. 500 or so votes in 2000. 1 point for trump in 2016. Thats how florida is evenly divided. North carolina is americas new swing state. It seems to be the litmus test or the bellwether for the rest of the country seems to be matching the race nationally. And it is super important for trump because the Trump Campaign has to expect that they will give back at least some of the votes that they got in 2016 in the upper midwest. The Kentucky Attorney general explaining that while police had a noknock warrant the investigation showed they announced themselves before entering taylors apartment. He also says the investigation found the officers acted in selfdefense when they shot taylor multiple times because taylors boyfriend fired at them first. Demonstrators quickly took to the streets in cities nationwide demanding justice for breonna. Jeff paul is live in louisville. What started as a day of marches turned into a night of chaos with many of those protests erupting into violence and in some cases vandalism and as you can see out here the National Guard standing by getting ready for what could be another night of fiery demonstrations. Things really got out of hand when reports started to surface that two officers had been shot just outside of the downtown louisville. Investigators say that those officers were responding to a call of shots being fired. And when they got on scene they were shot shortly after two of them were shot. Theyre expected to be okay. One man was arrested, Lorenzo Johnson. The police chief last night commenting about just how chaotic the situation was for those officers. Im very concerned about the safety of our officers. Weve had two officers shot tonight and it was very serious and very dangerous condition. The safety of our officers and community we serve is of utmost importance. Shortly after that announcement was made regarding the Breonna Taylor case, there was a march through downtown that for hours remained relatively peaceful. No real main interactions between police and demob straightors. Once they got close to the mayors mouse is when police started pushing them back and some people wouldnt leave. They got arrested. In total investigators saying 127 people were arrested. The attorney general here Daniel Cameron saying he can kind of understand why some people right now are disappointed with the outcome of their findings. I understand that as a black man how painful this is. And which is why it was so incredibly important to make sure that we did everything we possibly could to uncover every fact. Now again just like last night there will be a 9 00 p. M. Curfew. So far we havent seen too many people gathering at Jefferson Square park, the gathering area for people going out to demonstrate. Last nights situation could have been so much worse for our officers and for the people who were protesting when the gunfire rang out. Major Aubry Gregory who is the commander of our special Operations Division and was leading efforts on the ground last night was treated and released from University Hospital for a gunshot wound to his hip. Major gregory joined the department in february of 1999 and has done a tremendous job the past several months as one of the leaders of our protest efforts. In fact, some say he may be the bedrock of our protest efforts. Officer robinson was shot in the abdomen last night having to undergo surgery as a result of his injuries. He is in stable condition and expected to recover. He joined the department in march of 2019 and worked in our second division. Again, we are extremely fortunate these two officers will recover. At this time Lorenzo Johnson has been charged with two counts of assault. In the first degree and 14 counts of wanton endangerment all directed against Police Officers. In addition to these officers, we have reports of a Police Sergeant being injured after being struck by a protestors bat on. A sergeant who suffered a knee injury. While arresting a resisting individual and an officer who was exposed to blood and spit after a subject spit upon him during the protest. As for the events of last night several instances of unlawful behavior where Police Needed to intervene during the protest activities including damage to property, such as businesses along the road. The moving of barricades and barriers, restricting traffic and damage to a public works vehicle that was blocking the roadway. Due to the fires being set at the courthouse and along Jefferson Square park we needed to declare an Unlawful Assembly in the area just after 8 00 p. M. Prior to the curfew taking place. We made several clear announcements to disperse prior to Police Moving in to clear the park. Throughout the night, we made 127 arrests in various locations including the high land and downtown that were protest related. As the night went on there were several instances of looting outside the downtown area. We had reports of 16 incidents of looting throughout the evening in our first, second, third, sixth and seventh divisions. Areas include broadway, creston, outer loop. As a reminder the curfew remains in effect tonight and tomorrow from 9 00 p. M. To 6 30 a. M. And we encourage everyone to be lawful and peaceful as they go through their protest activities. I think well have a situation where Law Enforcement was prepared and more importantly that the government was engaged on the thought they will allow for peaceful protests but not going to tolerate or at least do everything they can to suppress Violent Crime or violent property crime even. So i suspect emotions are running high, but this government seems to be pretty attune to shutting it down in a proper way and letting it run its course and deescalating things over coming days. Sandra the country has had some time now since all this played out yesterday afternoon, jim, to decide whether or not they think the outcome was fair and whether justice was served. Breonna taylors family has put out a statement and we heard from their lawyer saying they dont believe that to be the case. Hence some of the protests and the unrest that we saw across the country. What was your assessment of the outcome of this case . Well my assessment starts with the attorney general cameron from kentucky. I think he was the man for the moment. I think that he said some very powerful and important things that need to be said and really the takeaway from his press conference and perspective on the charging decision was that we have to have if we are going to have justice it has to be individual justice and based on a dispassionate look at evidence and application of the law. And thats what i think seems to have happened here. We dont know all the facts yet but we know the process was followed and the attorney general at least is vowing for the thought that everything was presented to the grand jury including legal instruction and he took ownership over that process and said they made an individualized determination even if this officer didnt directly cause the death of breonna he should be held accountable with the recklessness of this search warrant. A jury will someday hear all the facts including the fact this woman was killed and maybe misdeeds by the Police Officer as a whole and this particular officer. I would like to see some criminal justice shouldnt be a Geiger Counter that measures how much we feel or how emotional we feel about a terrible tragedy. Sandra wall street journal wrote a similar sentiment defending the decision of a. G. Cameron. Here is the Kentucky Attorney general. Listen. I think the more pertinent question is what was the evidence provided to the grand jury . What was sufficient for their purposes . They got to hear and listen to all the testimony and made the determination that detective hankinson was the one that needed to be indicted. Sandra what did you think about the a. G. Saying i think the more pertinent question is what was the evidence provided to the grand jury, jim . The grand jury process is maddening from the outside. It is a secret proceeding and you have to take it on faith sometimes whether the prosecutor is firing straight. I think he is. I think he made a conscious decision to be very come prehenceive and they followed his recommendation. The ultimately the grand jury agreed and made this decision. We wont be privy to the whole process of what happens but i think it strikes me as a situation where he is not hiding behind a grand jury where it was a sixmonth investigation with a full presentation and they looked at it dispassionately which is what we want. Sandra there is a video circulating from the ground if louisville last night a u haul that pulled up. Protestors grabbed signs, shields and other supplies out of that u haul truck. You can watch it happen in the video. Some of the signs had antipolice slogans abolish the police and that video shows can you tell us what you thought when you saw that, jim . I kind of got me back on my soapbox here in terms of what needs to happen from d. O. J. There are professional protestors making the rounds. Youll see the same man buns and skinny jeans in seattle that youll see in louisville not exclusively but a lot of professional protestors running around and why look at the financing and the ownership of these groups and how they are leading their people from city to city to cause violence and disrupt the safety of the cities. I think there is room for a big federal investigation that ties into that type of conduct of arming protestors and having international or interstate commerce effect by it. If that is the legal standard, then what about the fact that the young man walker had a lethally obtained firearm and the fact that and he didnt hear the cops and the cops said they said that they announced themselves. So a lot of back and forth on that issue. Did he have a right to be there and they obtained a warrant to search the place and all the stuff they were looking for from the drugs, illegal guns, money was not there. So a lot of questions for people. I think we only get those answers through getting a grand jury report. Also we want to protect the people on the grand youree but we want to get all the information out there in the public so we need to see what we can do to change different laws to protect officers as well as citizens. Trace people are frustrated that a lot of the grand jury information is secret. I want to put you on the screen. The New York Times did a look at Police Departments. Are they as diverse as they should be . This is compared from 2007 to 2016. 332 less diverse, 135 more diverse. We have 30 seconds, lawrence. We appear to be going in the wrong direction. I dont even think the problem is diversity in the Police Department. It is a matter of what does the state have the authority to do and what they dont have the authority to do.
