So Lindsey Graham agrees with you. Said he was stunned by the decision. Listen. The daca program created by president obama is illegal on its face. Assuming that daca was legal, the memo explaining why the administration wanted to resend the policy was more than adequate. I think the court was arbitrary and capricious in deciding whether or not the Trump Administration was arbitrary and capricious. Sandra he said heading into this he didnt think that the administration could lose, admitting he is eventually quite wrong. He went on to suggest the administration can fix this pretty quickly with a memo. How do you expect the white house to proceed after this decision . With the court ruled here was that the administration didnt follow what is called the administrative procedures act which is the process by which you withdraw an executive order or executive action in this case. But the problem as graham points out, the Obama Administration didnt follow the procedures implementing daca. So saying it was unlawful for trump to withdraw because he didnt follow the administrative procedures act, but the underlying order was unlawful so it doesnt make sense. So what trump has to go back and do is follow the administrative procedures act and what would be lawful. So this is part of a larger problem. It is john roberts giving the deciding vote to rewrite obamacare and make the individual mandate attacks which he said he wouldnt legislate from the bench. They were all sorts of cases that have come down where roberts is deciding outcomes and then finding a way to avoid controversial outcomes. In many justices who have the courage of their convection and that is not what we are getting from john roberts. Sandra already. What were seeing is one of the reasons why in some systems particularly the federal system, prosecutors are insulated from the political process just like judges are. They get appointed by officials who do stand for election by the federal system. In safe systems, a lot of the prosecutors are elected and what happened here is you have a prosecutor who is in a dogfight in order to survive politically, actually trailing in his bid to be reelected, beleaguered because he is under a number of different scandals in his office, discrimination complaints against him, ethics complaints against him, so he has decided very cynically, i think, to run a campaign taking the tenor of the moment and deciding basically he is going to appeal to the bolsheviks out in the streets right now and run against the police, and thats basically what hes doing. And so what he did here, which was atrocious as far as im concerned is a former prosecutors he didnt wait until the actual investigators finish their investigation because it was highly likely they would not come to the outcome that he wanted, and he got an internal investigator in his own office basically to sign off on an affidavit supporting an arrest warrant for a murder charge that can conceivably be worn out by the facts of the case here but it is what people who are demonstrating in the streets are demanding at the moment. Ed what about the question of the use of force and mr. Brooks taking that taser and then firing it at the officer . Here is the prosecutor, the d. A. Back in early june on whether tasers are lethal or not. Watch. As many of you all know under georgia law, a taser is considered as a Deadly Weapon under georgia law. Ed so thats what he said at the beginning of june and when he announced these charges, he seemed to be saying a taser was not a Deadly Weapon. How significant is that . It is significant in the sense that he cant conceivably justify both positions. He babbled at the end that the officer in this case in the middle of the melee that was going on which was completely caused by mr. Brooks, he is supposed to have in his mind counted the number of times that the taser was used during the altercation and you realize that even though this convicted violent felon who wast was stoln from the police was still shooting at him, nor any charges left in the taser and therefore it wasnt going to be a dangerous weapon against him. Its absurd, but it goes to the point that what he did here is not justifiable and the longer he talks about it, the more absurd it is going to sound. I think the most important thing is we want to have a good and safe and great officers in our Law Enforcement and qualified immunity brings that protection that officers are going to need in a certain snap decisions that have to be made, but the bigger issue here i think is that we need to get this bill onto the set of four on wednesday and if we want to have a discussion about qualified immunity and ways to improve it or get rid of it, that is where that discussion needs to be had so i hope we can do that next wednesday. Ed giving a fair chance to play this sound bite and you can respond. It does nothing on qualified immunity which shields even police who are guilty of violating the civil rights from being sued for civil damages. The republican bill does nothing to encourage independent investigations of Police Departments that are patterns and practices that violate the constitution. Ed so how do you balance making sure a bad apple doesnt get away with it while at the same time, making sure that good Police Officers, good men and women in blue can do their jobs without fear of a lawsuit . I think what you see is a lot of training and are bill that is very similar to what they have in the house bill for deescalation for situations where Police Officers are watching another officer he was overwhelming force to intervene weird to think you also see more body cameras, more transparency and accountability, and we also have a different approach on the registry for keeping records of certain demerits or other egregious acts by Police Officers so they dont just go from department to department. We have it kept at the local level. The house has it at the state level and the president has at the federal level but we are all trying to go for the same aim here. I am not interested in the political talking points i just heard, im interested in listening to the cries of the people who honestly and genuinely have lost trust in their ability for a Law Enforcement officers to be qualified. Ed you are absolutely right, so how do we get to the substance . There seem to be all of these sidebar debates that keep popping up. Its very important and central to this but youve seen all kinds of other back and forth that you just referred to. Banning choke holds, making lynching a federal crime, some of the things we have heard that our central legislation, how confident are you you can get a deal that is fair and equitable to Law Enforcement officers as well. I would say the justice act does essentially ban choke holds and i am all for that. The justice act also includes antilynching legislation, so we have a lot of commonality here. You want to reach a solution, go back to your studies in elementary school. You reach a compromise, and it goes to the president s desk but if we dont get it to the senate floor, if we are obstructed there for political reasons, the American People arent going to get to see the debate on the greatest abating stage in this country, the United States senate. So there is where i think we can make improvements and have amendments, have a full discussion on the sticking points. Remember, there is a lot of Common Ground here but i think if we dont act, the American People are going to be even more skeptical of our ability to get the important issues done. The congress would only determine if the statue met the requirements that the other statues had been held to. I know the president feels that when he came up with that first list in 2016, he may have been as important as anything else he did in the campaign in terms of cementing the support of social conservatives, evangelicals who provided a lot of votes for the president and the 2016 election. So to double down on that and obviously a lot of conservatives stuck with decisions they have made with republicans joining the majority in making the majority is i think a smart idea on his part to say look, if they were any vacancies, i will put more conservatives, and here is a list of the kind of people i would put on the court. Sandra very interesting analysis they are. Also interesting analysis from our own bret baier who went on with bill hemmer yesterday talking about Justice Roberts being the new swing vote. Watch. Appears to be the new swing vote, sort of like a kennedyesque vote, or such surprise some people and the critics would say it was legislating from the bench. That is where they see it, but for conservatives, they look at the judicial appointments as a key moment for the politics of 2020. Sandra it made me want to look back and do an interview i did with Supreme CourtJustice Neil Gorsuch last fall where i asked him very specifically about the balance of the court, and its interesting to look back at this moment. Lets watch together. They were some who throw the Supreme Court justices into categories as a trump person, an obama person, a conservative, liberal. Then they get very confused when it doesnt break down that way all the time. Does it break down that way at all . Sandra checks his personal beliefs at the door but was interesting to hear him talk about what is that moment where people do get confused of how the court breaks down. First of all, let me say i am very jealous that youve got to sit down with Supreme Court justice for such and i have it yet. Secondly, it is interesting because republicans have not been as good i dont know what it is but they havent been as good at putting people on the court who will follow with their views as democrats are. Democratic president s put people on the court and they tend to stick to liberal judicial philosophy that youve seen, and in this one case with neil gorsuch and on several cases with john roberts and most famously with president eisenhower back in the 50s where they put people in the court, george h. W. Bush with david souter. They put people in the court and they end up straying and moving somewhat to the left. The argument that is made by some conservatives is these justices are conservative, they get to washington, they go to dinner and cocktail parties with a lot of liberals, and they start breathing the air and drinking the water here. Whatever the reason is that you do see republican appointed justice is moving to the center and even some to the left, you dont see it with democratic appointed justices. Sandra you were hearing some of those republicans who say that they are stunned by the decision. Lindsey graham is one of those. Here he is last night. The administration can fix this pretty quickly by writing another memo, but i was stunned. I told the president tuesday night i dont think you can lose this one, but the politics of immigration have changed dramatically. I think the court was arbitrary and capricious. My own guess is Amy Klobuchar jumped before she was pushed that she wasnt going to get the job particularly now in this time of racial tension, she has had some problems with the Africanamerican Community in minnesota when she was a prosecutor there. My guess is she wasnt going to get the job, but its interesting that not only did she pull out of the race but further tide bidens hands by saying i think you should appoint a woman of color. Its going to become harder for joe biden not to do that. He doesnt have to, the only commitment he is made as a woman, but i think there is increasing pressure on him in these times to make it a woman of color and you begin to think who is out there that is a woman of color who would clearly and indisputably be fit to be president with a 7yearold joe biden if he is elected, the two immediately come to mind is Kamala Harris and susan rice, former National Security advisor and u. We have been safely reopening, one of the first states to start reopening so 57 days into our reopening campaign, and we feel like it is the right time to start reopening, so we are excited about the president coming and again like they said before, there is been over 1 million requests for tickets, so i think it just shows that america is ready to start getting back to normal. Also reminded oklahomans, this is the first of 100 different rallies that are going to take place between now and november election and we are getting a lot of headlines because its the first one happening in oklahoma. Ed you mention some positive statistics and we want to include those, Kellyanne Conway at the white house have also praised youre dealing with covid19 but there were other numbers im sure youre aware, daily confirm new cases the three Day Moving Average in oklahoma, 313 cases per day as of june 17th and in this quote from your Health Department from tulsa, not the state wide, potential over the top disease transmission, it is a perfect storm that we cannot afford to have. How do you respond to that . My response to those folks is when is the right time . The coronavirus is in the United States, it is in oklahoma. We have to take precautions, but we have the freedoms to stay at home, you have the freedom to come to this rally and what we are seeing in oklahoma, 75 of the new cases are all under the age of 50, and there has been three deaths in oklahoma under the age of 50 which is. 14 death rate, so again, those that are immunocompromised is really working. That is the population we are trying to protect through the nursing homes. Weve stopped visitations and those kinds of things but we have to get back into society because it is not practical to have a bunker in place for the next 24 months. Sandra there are some areas in the country who had an uptick in cases able to flatten that curve and get back to more normal times. The argument is that your state in particular are seeing the uptick now which is why the local paper headlined why here, why now, not saying not at all but another time, but the concern would be obviously all these people congregate at that rally coming in from all over the state, and then they go back home and carry it there. So why not have a mandatory mask policy for that rally . We are going to follow the president and the Vice President s lead on that. Or they will be temperature checking out the door when they come in and again, im very reluctant to mandate wearing a mask so if you feel the freedom, if you want to wear a mask among want you to do it, if you feel safer at home, we dont want you to come to that rally, but if you do feel okay, we want you to come to the rally and have a good time. We are going to be very safe, and we think its the right time and my question to all the folks that say you shouldnt have a rally, when is the right time . Do we really think that in july or august or november, coronavirus is not going to be here . Weve got to learn to deal with this. Weve got to learn to be safe, take precautions, but weve got to learn to also live our lives. Ed there was another issue that popped up as you know in the last week or so which is originally a rally was going to be tonight but since we are celebrating juneteenth, the president tweeted that out of respect for holiday, he wanted to move it back to tomorrow. There have been questions about this racial massacre as you know in tulsa in 1921 and whether tulsa is the appropriate place to have it. My question is as you move forward and we are showing historic pictures of that massacre now, what is your advice to the president to both Mark Juneteenth and note that this racial massacre happened in tulsa . He has touted low africanamerican unemployment, his outreach to africanamerican voters, what is your advice to him in terms of dealing with all of this . We are so excited that the president chose to move the rally from the 19th to the 20th out of respect for the Africanamerican Community and the 1921 race massacre that happened in tulsa is really important to her estate in our history. The president knows that and acknowledge that. We have appropriated a million and a half dollars for next years are 100 Year Anniversary of that. But oklahoma is different. We have unity. We dont have the divide that we are seeing in other states, and i wanted oklahomans to know that every black woman, children, child, matter. All lives matter to us here in oklahoma. Is kind of the oklahoma standard that we are trying to portray, so i dont think you were going to see the divisiveness that you have seen in other states where we see on television, just doesnt happen in oklahoma. Its really telling the moment because now you have major corporations even joining in the idea of celebrating juneteenth which was initially if you go back in history was jubilee day on the whole idea was it was a celebration of the end of slavery in texas but what happened and subsequently as people then began to celebrate not only in galveston which is where the Major General initially issued the announcement of the end of slavery in texas two years after president lincolns emancipation proclamation, but then it moved on to austin, to the state capital, and most of all, to houston where there is now an Emancipation Park that was the site of a huge Juneteenth Celebration in the 70s when this really took off again. Was sort of a period in the early 20th century when black americans went through the great migration moving away north and i think juneteenth really took a backseat during that period but now beginning in the 70s became a celebration of art, music, and education acknowledging and i think for a lot of black people, it is hard to talk about slavery publicly and to acknowledge your ancestors were but in combination with the Civil Rights Movement of the 60s in 70s, this was a resurgence and now it is at a peak in some ways. I think the more of the corporate america, more states in terms of official recognition even holidays are recognizing as you said there is now substantial momentum in congress to make it a national holiday. Sandra 155th anniversary today, you go back to 1865 here, sort of the timeline that you just laid out, galveston, texas, where were freed on that day delivered by Major GeneralGordon Granger in Union Soldiers over two years after the emancipation proclamation, texas the first to make the official holiday now as we know most states are holding observances. The white house has put out a statement for this day saying juneteenth reminds us of both the unimaginable injustice of slavery and the incomparable joy that must have attended emancipation. So for a lot of people across racial lines, the acknowledgment of black voice and the black experience has suddenly taken on higher significance, a higher profile in the american conversation, and a lot of things that were swept under the rug are now out in the open and when you go from the point of lets just take the nfl, Something LikePopular Culture condemning Colin Kaepernick to kneeling to now saying we were wrong, you understand there is something going on. You look at the polls and you see that acknowledgment of the black experience planned the whole notion of black lives matter has been just lifted up in the last few weeks. Juneteenth fits into that position. Saying it is about educate, but also about celebrate and then agitate. And so the educate part is to let people know this is the root of so much of the racial issue in america, no need to be ashamed of it, no need to run away from it. What you think about the idea that joe biden has been doing well in the basement as other democrats have admitted but now theyve got Rudy Giuliani involves saying lets have multiple president ial debates, may be four instead of the traditional three because they want to get joe biden on the same stage as the president. I think more is better as far as debates are concerned just from a voters perspective. The idea of having more debates is better. The president obviously thinks he is going to look better in comparison to joe biden and also start them earlier because there is so much early voting going on in this country. We are being strongly suggested that people wear them, but we also believe in peoples personal freedoms and they are allowed to choose first of all whether or not to even attend this event and then when they get inside, if they feel like they are in a safer demographic and they dont want to wear a mask, we are not going to go around and enforce it for every Single Person but obviously making them available when doing everything we can to try to help mitigate the spread if that even becomes a problem. But you contrast this rally, this one trump rally with what everyone saw happen in these protests all across this country in the cities around the country that have the highest covid rates, tulsa, oklahoma, was not one of those cities and so whenever you think about the fact that nobody had a problem with any of these rallies, by and large championing these rallies and saying got out there and protest, now all of a sudden, its a trump rally and everyone has a problem with it. The hypocrisy is very obvious to people here, i think. Sandra is a double standard that has been pointed out by many on your campaign and many within the republican party. I went to put this up on the screen, the president a short time ago. Any protesters, anarchists, agitators who are going to oklahoma, please understand you will not be treated like you have been in new york, seattle, or minneapolis. Will be a much different scene. A reacting now to the civil emergencies that the mayor of tulsa, a republican has now declared because of some warnings that he has received saying i have received information from the tulsa Police Department and other Law Enforcement agencies that show individuals from organized groups who have been involved in violent behavior of planning to travel for purposes of causing unrest in and around the rally. That is the mayor of tulsa. What is your message, what is the Campaign Message to any of those agitators who may be planning to descend on tulsa ahead of this rally . I think it is such a shame that anyone would hijack anything. You saw how these agitators hijacked the precivil protest and then turn them into riots and then burning down buildings and destroying Small Businesses and it devolved into violence very quickly. Trump supporters are by and large very peaceful people, welcoming everyone to a trump rally. They want everyone to experience this president as they see him and as they know him. Never had issues at a trump rally and i would think of these people showed up, they would be shocked by how welcomed they would be if they wanted to come in peacefully and see the president s rally. It is a shame anybody would ever consider doing this just to cause chaos and destruction and violence, but stay home. We dont need you there. We have long had a conversation about President Trump and women, and you look at whats happening in the latest fox news polling, it does show the choice for president is voting today among women goes to joe biden pulling 52 and our latest poll the President Trump 33 . In what is the president doing to try to win over the female vote and in some cases when it back . I have always told you as well that i dont think those holes accurately reflect how people really feel across this country. We know they werent right in 2016. I think they are even more incorrect now. That said, whenever i think moms out there see the violence in all of these democrat run cities that have been allowed to happen, the way that the defund the Police Movement has taken a hold of so many of our great cities in this nation, it is very frightening. I have two kids, and i would be terrified to live in a city or in a country that would have a Defunded Police force were you didnt have law and order in this president has always stood up for law and order and its something that he stands strong with now. They want to see these dreamers stay in america. What is your recommendation to the president . What i would say to them is they want to keep Daca Recipients and that kind of status, they need to do with the right way, they need to run it through congress and have it debated as opposed to what president obama did just creating new law in complete violation of a federal statute that did not allow these people lawful status and especially giving them federal benefits that have never been voted on. Ed but in the absence of congress doing anything, you have some of these Doctorate Recipients here in your state of texas, some of them served our country in uniform, so how do you deal with that and treat them properly as human beings even as congress has dropped the ball and hasnt passed comprehensive Immigration Reform to deal with a whole host of issues including Daca Recipients . We have laws in this country that matter, a constitution that tells us how they will be passed. The president cant just make up laws. I think social Media Companies have now amassed more control over more speech than any other entity in history, and theyve made a big bet that they can get away with exercising that power in a biased way for two reasons. One, if they cozy up to leftleaning causes, progressives wont take action and making a bet that republicans will simply sit on their hands and do nothing. I think those days are over. We are seeing bipartisan consensus to take action whether from an antitrust perspective, or reforming this piece of legislation known as section 230. Sandra they say it was a form of hate speech. Our policy prohibits using a band hate group symbol to identify Political Prisoners without the contact that condemns or discusses the symbol. So in their own words, they say there needs to be context when Something Like that is visible. From my understanding, this was an antifa symbol that the campaign put up and i think this goes to a broader issue which is you have all sorts of World Leaders using these platforms whether it is Chinese Communist propaganda, and it seems like these platforms are narrowly focused on taking action against President Trump. And i think this goes to a broader concern, after the 2016 election have decided to go after social Media Companies for their crime of staying neutral in the 2016 election and they have been working the rest of those companies dont stay on the sidelines when it comes to 2020. I think that strengthens the resolve across the board and this isnt a partisan issue. He have candidate joe biden who said it is time to take action and he has called for revoking the section 230 which is this unique Liability Protection that these platforms enjoy. When it was first adopted, this was a shield to frivolous litigation and at what we are seeing a social media weaponizing section 230 using it as a sword to carry out their own partisan political agenda. In these entities get ther to he their own political views and what they dont get to do was run roughshod over their own terms of service to go after politicians on the left of the right that they dont like.
