Away. Do mindbody cam video showing him speaking to officers for nearly 30 minutes before that struggle. Atlanta mayor says she does not believe the use of deadly force was justified. This has been hard and it is really difficult for me to put aside my own anger. I watch the body cam video. I watched it for 30 minutes. I watched the interaction with mr. Brooks, and it broke my heart when he talked about his daughters Birthday Party that he was planning for. This is not confrontational. This was a guy that you were rooting for, and even knowing the end, just let him go. Sandra jonathans areas live in atlanta with more on that. I am standing across the street from the parking lot where Rayshard Brooks lost his life. At the height me, people are spray painting the parking lot and trying to recreate the spots where mr. Brooks lost his life and where the shooting took place. Started out as what appeared was going to be a routine stop for a suspected dui, but Police Body Cam video shows what happened next. I think youve had too much to drink to be driving this. But your hands behind your back for me. But your hands behind your back. Police cam video shows Rayshard Brooks breaking free from this Couple Holding what appears to be one of the officers tasers, seconds later, you hear three gunshots. The medical examiner has ruled Rayshard Brooks death a homicide and says two gunshot wounds to the back caused oregon failure due to blood loss. The d. A. Says they will decide midweek whether to pursue charges against police. They immediately terminate at the officer who fired the shots and placed fellow officer on administrative leave. The mayor expressed frustration over this incident and others like it. We have implicit bias training in this city. We require people to go to the National Center for civil and human rights. We have housing for our Police Officers in many of our communities in which they are serving, but yet it is not enough. On saturday, the mayor accepted the resignation of Atlanta Police chief. That night, large numbers of protesters blocked a 14 lane section of the interstate 75 known as the downtown connector and there were so many on surface streets, firefighters were unable to reach the wendys were all this took place before the restaurant was completely engulfed in a fire set by arsonists. Coming back to our live shot, you can see the gutted building behind me. Atlantas Crime Stoppers is offering a 10,000 reward for information leading to arrests and indictments in this building fire. Back to you. Sandra okay. Jonathan serrie on that this morning. More on this later this hour, will be joining to discuss how the community is dealing with this latest incident and the impact it could have on the growing push to overhaul the States Police department. Stay tuned for that. Ed meantime, President Trump back at the white house after spending the weekend in his golf club in new jersey, slamming because to defend police and insisting the protesters barricade several blocks in seattle announced to a radical left takeover of the city. Its expected to announce his own executive order. John roberts has more details. Good morning to you, should also mention the president was celebrating his birthday yesterday. We are hearing that this executive order could come out as soon as tomorrow. Its a twopronged approach, and one is to reform the use of police force on the other is to increase opportunity in communities across america. The four feature points at the president wants to zero in on our Economic Development and minority communities, confronting health care disparities, renewing calls for School Choice and encouraging Police Departments to meet standards for the use of force. President ial advisors said this executive order will be the glue to bring communities and Police Forces together. Listen here. Investing in things like all responders would allow for police to do their job but bring in social workers and experts that deal with Mental Health and deal with issues such as drug addiction or alcohol addiction or other issues like homelessness. On wednesday, we are expecting to hear what Senate Republicans are planning to do to respond to concerns raised in the wake of the george flight killing. Set under tim scott is working on apparently will include increasing police training, expanding information sharing on cases of officer involved violence and a process to remove officers with a pattern of misconduct. Thats an issue that most republicans dont like at all, to include myself. So the question is is there a path forward that we take a look at the necessity of eliminating bad behavior within our Law Enforcement community . I think we will find that. There will be some contact between the version the senate comes up with on the house has already passed on this issue of qualified immunity for police. They have said thats a red line but there may be some Common Ground on choke holds. The democrats, the president , and senator tim scott have all said may be we need to look at modifying when those can be used. President trump suggesting that in cases where its a life or death struggle, might be appropriate to use that but that will be part of the Overall Police reform in terms of the use of force. Ed john roberts, thank you. What i would like is for all police around america to get their jobs and do them the right way, the correct way. Innocent people shouldnt have to die. You can do your job at and still maintain respect for others. Basically, thats all i want and thats all i want is respect because i want justice for my brother right now. Sandra that was the brother of george floyd speaking about the movement to defund our Police Departments, all of this is democrats struggle to unify over what exactly that means weird about some embrace the term, others like Presumptive Democratic nominee joe biden said they should not be defunded, just reform. Joining us now is Fox News Sunday anger Chris Wallace and also the author of the new book countdown 1945, the extraordinary story of the atomic bomb and the 116 days that changed the world. Great to start off the brandnew week with you and you heard the words of George Floyds brother there, not calling to defund the police, which you hear growing calls for from some democrats, protesters on the street, asking for change. So are democrats getting that message . Let me say first of all about George Floyds brother and the floyd family. They have been the most dignified, the most measured people in this entire debate on either side, and i think everybody would do well to listen to them. The defund thing is certainly a call for protesters on the left wing of the Democratic Party but it isnt just joe biden. The vast majority of Democratic Leaders in this country are not supporting that. I had karen bass, the chair of the Congressional Black Caucus on Fox News Sunday yesterday, and she is talking from the house bills, they help to pass next week, they are talking about things as john roberts talked about whether or not to lift qualified immunity for Police Officers banning choke holds, things like that. They are not talking about defund police. I understand that there is something of a split in the party but i have to think the vast majority of the party doesnt want to go that far among other reasons because they know it is too far to the left, too extreme for the vast majority of voters in this country. Sandra the chairwoman of the Congressional Black Caucus, karen bass. We are finding a lot of support from Police Officers. Yesterday, i had an hourlong meeting with the paternal order of police, and they are very supportive of the idea of National Standards and significant training. You should be accredited to be a Police Officer, any profession that allows you to use lethal force there should be very significant training. Sandra the wall street journal over the weekend writing about karen bass saying these Police Protests have pushed her into the national spotlight. There she was on your show this weekend, what did you take away from that message after speaking with the paternal order of police . I think that she is very much in the moderate mainstream of the Democratic Party, further to the left and wants to do more than republicans but she is very interested in compromise. I asked her, are you willing to compromise, how confident are you that you will get a bill through the republican majority in the senate and then onto the president s desk and she said shes very confident and she also said im a legislator, she was the speaker of the house in the California Assembly so a very experienced legislator and said i understand compromise as part of it. I said are there red lines and she said yes, but im not going to tell you what they are which is what an accomplished negotiator would do. I get the sense she is pretty optimistic and after talking to her, i am pretty optimistic that they will get something through it. Itll be too much for some people and not enough for others but that is the nature of the legislative process. Sandra it was a fascinating interview and her takeaways from that were really strong. Strong. Meanwhile, talking about the far left members of Congress Still out there with the message defund the police. Ilhan omar is one of the members of congress embracing the term. Listen. You cant really reform a department that is rotten to the root. What you can do is rebuild, so this is our opportunity as a city to come together, have the conversation of what Public Safety looks like, who enforces, the most dangerous crimes that take place in our community. To make is quickly developing as a issue with those far left democrats and more moderate members of the party. Here is James Clyburn over the weekend. Nobody is going to defund the police. We can restructure the Police Forces. Restructure, reimagine policing. The police have a role to play. What weve got to do is make sure that their role is one that meets the times. One that responds to these communities that they operate in. Sandra so does joe biden have an uphill battle trying to unify his party on this issue . I really dont think so. Look, there are people on the far left of the party, the socalled squad, people like ilhan omar, but we have seen this before whether it was on the Green New Deal or medicare for all that certainly is an element of the party, but not the majority of the party, and the democrats seem to be united very much among the more moderate liberalism. Certainly liberal, certainly to the left of the republicans, but not the extreme left that you have seen among in members of the squad. When it comes down to the election and its a choice between joe biden and donald trump, do i have any doubt where ilhan omar is going to go . No. Shes going to vote for joe biden. Some people in that camp it may not vote at all, i suppose. Thats possible. But there is certainly no question that on the lot of the social issues and a lot of Economic Issues that joe biden is a lot closer to people on the far left then donald trump and the republicans are. Sandra all right. We will continue to watch all of that and continue to watch you come a show this weekend. Chris wallace, thank you. Ed nbc news facing accusations of daises mourning over a pair of tweets posted an hour apart over the weekend, one of President Trumps upcoming rally on the other on the George Floyd Protests over the weekend in new york city. Critics pointing out it was only in the tweet about the president that nbc happened to mention the health risk of large groups of people congregating during the global pandemic. Associate editor of the wall street journal on fox news contributor. Here it was within an hour with one another what seems like a clear contradiction. What is going on . I dont know. Nbc is a great news organizati organization, albeit they wish they had worn to groups that large gatherings whether its a protester rally or a biden rally though there arent any biden rallies that its a risk to go to these events. When there is a large group of people and was a virus is still very much prevalent. Is being transmitted seeing increases in transmission in utah and arizona, other places around the country. I think the message here for news organizations is to just be sure you are constantly keeping the public aware of a continuing risk of the coronavirus. Ed and for news organizations to be consistent as well as politicians like Governor Cuomo. He was quite aggressive this weekend and going after bars and restaurants in new york city out in the hamptons and long island showing large crowds going together, here is the governor on that. The leading areas in the state with violations. You increase the start of the virus in manhattan because of bars and restaurants, that everybody in manhattan is going to suffer. Is not going to go back to that dark place because local government didnt do its job. Ed pleaded over the weekend as well saying dont make me come down there. He is in upstate and albany where the capital is. Dont make me come down there to clear all this out when he saw the pictures of people in bars and restaurants. I am not saying the same vigor from the governor when we see pictures of large protests weather here in manhattan, brooklyn over the weekend, why is he not being as aggressive about the protests . I think you said as much about the protests, and i think that you see leaders in various cities worried about this. We wont see the results of the protests for a couple of weeks because it takes that long for human contact to result in more cases and hospitalizations. There is no question there are two big things happening here. There was a social Movement Underway and an election underway. I think that youve heard from leaders in the community, particularly in the governor of new york who has been pretty hammered down on this issue with everybody. Is worthwhile listening to that videotape over the weekend. He does the sam going to come down there and there have been 5,000 people complaining about this to the state and something needs to be done. Of people need to abide by the law and wear masks and need to avoid large interactions where it is less than 6 feet apart. Ed because we are not seeing that social distancing in outside bars and restaurants but also no social distancing or very little in some of these pictures you are seeing at protests. Having said all of that, the Top Health Official in oklahoma this morning is quoted as saying look, love to have the president of the United States is coming saturday for the big rally. Its a great honor, but not during a global pandemic. What are the risks for the Trump Campaign as they get ready to restart these large rallies . I think it is a risk, and the Trump Campaign sees it as a risk. They are asking people to sign a waiver that they wont hold the campaign responsible if they do get sick at one of these valleys. The president doesnt like to wear a mask. Kind of unclear why, but the tone is set at leadership and you can assume a lot of people who come to the rally wont wear a mask either in right now, mask wearing is really critical. Weather at a rally or the protest, guiding an older friend of mine in his 70s whose wife is participating in the protests to be very careful that she is wearing a mask because i dont want him catching something. So i think that this is where the rally is going to be a damper effect and public administrators, mayors and cities are going to have to speak up because whoever the campaigner is, whoever is holding the rally, it is antithetical in a lot of cases to what the cities are trying to do, which is to keep people safe, keep them apart, acknowledge the fact that the virus is still very prevalent and is a big danger. Ed and make sure we are not letting our guard down collectively. Thank you for breaking all of that down. Sandra thank you. We will take a closer look at all of this with national Economic Council director larry kudlow joining us live from the white house top of the hour. Stay tuned for that. Looking forward to that and in the meantime another fox news alert, protesters and the barricaded area in downtown seattle saying they are no longer calling it the autonomous zone. That gives the wrong impression. Meanwhile the police chief of the abandoned precinct they are saying she would like to resolve the week long sit in as quickly as possible. I made on the ground is dan springer with details. Good morning. This is as it goes on more of the feel of mably and occupy wall street protest as opposed to something where there is an armed takeover of the city. The two big differences is that this is in a city, the central focus is on Police Reform vented that end, right in front of the Police Station, the east precinct which is really left quickly last monday one week ago today by the Police Department and the National Guard as they fled this area because they no longer wanted to be the flash point of these black lives matter protests that occurred every single night when they were peaceful for hours at a time and that it would grow up into this violence. But now they are calling us the Capitol Hill Community center and that is really what they want, they want this to be turned over and we can show you this is right in the middle of a neighborhood here and there was an Office Building with some retail and the bottom floor and really no retail going on. Very little commerce that i can tell as we have panned up the block, the city is helping these folks out by bringing in some portapotties and a lot of people have also brought in food, so there is plenty of food to go around. However, the big question is when is this going to end and the police chief was on this weekend and said she wants it to end but does not want this to become a flash point again. Here is what she had to say. You dont want anyone there to be harmed. We dont want this to be something that devolves into a four situations are really trying to take a methodical practical approach to reach a resolution for everyone gets out of here safely. But the chief as to other problems on her hand, one is that the morale in this department is plummeting. She has 45 officers leave the department this past week, i was told by the polices Guild President that it was due for early retirements. The other big question is what is going to happen if there is counter protest . And i have heard from some people who are proud boys, these right wing groups who are propolice. I have heard they plan on having some sort of a protest at some point possibly as early as this weekend, and then what is going to happen . They would have to commons around the area to prevent the two groups from classing dell back clashing. Its a very peaceful inside, maybe 300 people are here full time, but thousands come during the daytime, a lot of people with cameras, families coming in here looking at whats going on in here had a lot of people just sleeping. Ed a bizarre situation behind you. We will stay on top of it. Sandra President Trump set to hold his First Campaign rally on saturday in tulsa, oklahoma, the president tweeting just moments ago that almost a million tickets have already been requested. But the bank of Oklahoma Center holding a little over 19,000 seats. Lets bring in Republican NationalCommittee ChairwomanRonna Mcdaniel. Good morning, thank you for being here. What do we need to know about this . First of all, a lot of conflicting numbers. Talking about how many have registered so far for this eve event. So people go online, they request tickets through the campaign obviously, first come first serve, got a lineup i imagine but what it says is the enthusiasm for this president is through the roof and it is higher than weve ever seen. Without yesterday for his birthday when they raised 14 million online, now we are seeing it with this rally, and that is something that is being underrepresented in these polls. Joe biden does not have enthusiasm and he sits in his bunker and hides from the American Public and the second the president said im going to get out there, you see a massive request for people to come to this rally. Sandra but hold on, why accept the registrations if it is first come first serve, just over 19,000 seats available, what you plan to do with all of these people . There will be events outside, i think they are going to expand into the Convention Center for more capacity but we want everybody to be engaged and we are going to make places for them to be able to watch this historic event, see the president and its an opportunity for Trump Supporters to get together and talk about how we are going to all go out and work in november, knock on neighbors doors, how we get a lot of volunteers on lines with the great opportunity to organize the campaign as well. Sandra obviously in normal times, wouldnt get into the nittygritty about these details but this is obviously happening in covid19 times in oklahoma is is seeing an uptick in cases in the editorial newspaper is saying this morning wrong time, wrong place, please reconsider. Are there any plans to reconsider considering we are talking about now an uptick in cases not just they are but nationwide and should people wear masks that are attending the event . The difference between how republicans have been handling this and democrats as democrats are saying we are going to shut down our state, not going to allow you to make decisions for yourself and your own health, and i think we are far enough along now that people with underlying conditions are not going to go to a rally like this, people will bring masks if they feel like its nes necessa. I imagine we will hear more about that in the coming days but it is interesting to see how we werent hearing about this during the protest last week when thousands and thousands of people especially with africanamerican communities disproportionately affected by this and democrat mayors and democrat governors out there with these protesters not talking about ppe, not talking about health and safety so its funny that now we are having the trump rally and bringing people out to celebrate the nominee for their party, all of the scrutiny is coming up on this. We are going to put the health and safety of the individuals coming first and foremost and going to make sure this is a great event. Sandra to end on that note, masks are not required at the event. I am not planning the event, so we will hear from the campaign how that is going, but i think masks will be optional and people will be able to wear them if they bring them or want them. The American People can make decisions for themselves. We are all pretty informed at this point. Sandra larry kudlow, the president s Economic Advisors suggesting people should wear masks, and they have to sign a disclaimer when they do register to attend the event. I want to finish up with asking about these Campaign Fundraising numbers just out with a new record announcement, what is and what is their reaction, what is driving the surge . Yesterday was a president s birthday and also coincides with flag day and we raised between the Trump Campaign and the rnc 14 million online and just that one day, sets a new record, the highest before with 10 million. So what does that tell you . People are enthusiastic about the candidacy, just over 40 and if you were to give to this campaign, it means youre going to go out to work to reelect this president. Sandra and i get your reaction to this new polling on the historic margin now among women voters between joe biden and the president , biden pulling 50 with women to the president s 35 of . That margin seems to be widening. What is the president going to do about that . I think that is a little skewed. I would look at the metrics on these poles but of course we are looking at every situation, we see in the battleground states the president is doing very well and we have a message to take to the American People especially women because we care about the economy. We want to make sure that we have jobs that our kids are going to have jobs when they graduate from college and as you go forward and you see these job numbers, you see what the president does not justify coronavirus but also backing that with the economy and joe biden continues to sit in the basement. Its going to be very clear that donald trump is the one who built this economy up once and will be the right person to do that again. Sandra so many folks hoping we can stay open and keep those numbers down although we are starting to see an uptick in some of these states. Ronna mcdaniel, appreciate your time. Thanks for coming on. Ed in the meantime, a top atlanta official will join us live next. If we do it right, i think we can reduce the number of times that we are dealing with misconduct on the Police Departments. We dont do it right, then we will have the same situation where there is no law. We can do better than that as a nation and we will. For veterans. Va Mortgage Rates have dropped to near 50year lows. Sandra fox news alert now about the fears of a second wave of the coronavirus after her recent spike of cases in more than 20 states and now that we are well into summer weather, probably noticed where you live people are ditching face coverings in many areas as they gather at bars and restaurants and sidewalk cafes. Health officials warning this could lead to another shut down. Dr. Marc siegel is professor of medicine at the nyu Medical Center and a fox news contributor. We need you, what is going on . We heard on fox news last weekend saying the Health Officials at the white house are telling him this is not a second wave, this is not a second wave, we dont know what that demarcation would be to call it a second wave. The markets were down and there is concern as we hear spikes in some states. Sandra, how are you . Good morning. Covid19 is an evolving story and here is what is important to note today. Is not a second wave. Let me explain that. Is a continuation of the first wave. I am calling it a migratory virus right now because different regions are affected than were affected before. It has seen a decrease in cases but seeing an increase in cases in the south, the southwest and in the west. In the concern from my point of view is what about hospitalizations . We are starting to see an uptick of hospitalizations especially in utah and South Carolina and arkansas, and arizona is of concern. Part of the increasing cases in these regions is because we are testing more, but that is not the whole story. A lot of people are forgetting to do the social distancing that you talked about before. Not primarily masks but staying apart. They are going outside, huddling close together, and not wearing their masks. Sandra i feel like when we talk about this, we have to say it is hard and i dont even know if its in every instance people forgetting to, but it is warm out, hard to wear those face masks everywhere you, especially children and its a difficult thing to do. But necessary as medical professionals like yourself right now. So what would that demarcation be, what would indicate a second way of the coronavirus and perhaps has to shut down the hamptons or other areas of new york where people are really gathering . I think a second wave would mean regions that already were involved like new york and new jersey had the northeast having a wave of hospitalizations that we can handle. When you look at it in terms of hospitalizations. In terms of what Governor Cuomo is saying about lockdowns, i want people out there to know that the purpose of a lockdown is if the government doesnt think you can be responsible. I was in the hamptons this past week, but i can tell you people are not paying attention. They are huddling together. The social distancing that matters but says they received 25,000 complaints in new york state about people not social distancing. This is as your previous guests said about personal responsibility. This is an enormous damage done by a lockdown, and i think weve seen it. Economic, psychological, and medical damage. We cant afford another lockdown situation. Sandra really important message. Now the kansas city president is calling for an overhaul of that citys Police Department and she joins us now by phone. Good morning and thank you for joining us. Thank you for having me. I ed i want to talk about Police Reform but i would feel remiss if i didnt ask you how was your community doing this morning . Read an oped of where you said there was nowhere left to hide from racism. How was your community doing this morning . Of course, atlanta is grieving the loss of mr. Rayshard brooks. We send our condolences to his family, particularly his children, his wife, and his friends, and so we are trying to recover from that and the protests that are going on here as a result of that and as i have been saying just a culmination of these events happening here and across the country. Ed the mayor has said the use of force was not justified after reviewing some of the videotape, the body cam footage. Can you make that same judgment this morning when we have not had a full investigation yet of what actually happened . I can just go by what i see personally there doesnt seem to be any justification for shooting someone, they were other ways to recover someone that is fleeing so that is all i would say on that for now. Ed what about the fact that he took the taser, what how does that factor into your thinking on this . They are not only instruments, so that well all be weighed as the investigation moves forward, how that played into the scenario. And we will just have to wait and see what the investigation. Ed everyone i mentioned you wrote an oped, time to review the operations of the Atlanta Police department and reflection how we recruit, train the officers by the time has come to replace fear with understanding and eradicate injustice in every corner of our society and i should add you also said while these officers in the department are not perfect, the department is filled with great human beings who daily lay of their lives on the line. How do you balance that, the approach that many could officers have with the problems you point out . How do you balance it and how do you fix it . Is a difficult balance because i do know many of the officers very personally who are the officers that we want in our community that are policing our community and creating those bonds with our community. But also know that some of the tactics that police used generally do not square with where we are now as a country and as a community. We have to refashion the way that we interact with our citizens, so the status quo on how Police Police has to change, and all of us have to go through that difficult transition of change from elected officials and our policies that we implement to buy Police Officers and the training that they have received and should receive. Should be different in how we interact and how the public acts with our Police Officers. Ed all important issues being grappled with by the president of the United States, leaders in both parties, and dealing with it on the local level and so many communities around the country. We certainly appreciate you joining us. I appreciate you having me. Ed sander . Sandra thank you. Ed fox news alert, the death of a 27yearold black man at the hands of Atlanta Police now officially ruled a homicide. The Fulton County medical examiner saying Rayshard Brooks died from two gunshot wounds in the back after running from officers after a struggle and the wendys parking lot in which he grabbed one officers taser. A new body cam footage revealing the moments that led up to the shooting. I think youve had too much to drink to be driving so put your hands behind your back for me. Hey, youre going to get tased. 63. Ed the officer who fired the shots you heard at the end has been let go pair the second officer involved now on administrative leave. The Fulton County d. A. Is looking at a possible murder charges and could make an announcement this week. Much more later this hour. But we begin with another alert now, he worries for the economy sending stocks sharply lower as you see that dow down 148 points, new concerns about a wave of covid19 cases as a country reopens. Welcome to a brandnew hour of americas newsroom. Sandra good morning to you, i am sandra smith. Investors taking a long, hard look at their expectations for our economic recovery post covid19 has several states become hot spots for the virus now with new cases spike and to record highs. Confirmed u. S. Cases now above 2 million has congress is weighing another round of financial aid. The first thing i was want to do was make sure the 3 trillion that we appropriate is actually instituted into the nation, implemented out there and we show that its working. Not all states have opened up the same as others. We should gather that data and see where we need more help in that situation. Sandra so we will see what is next with that, bring in todays headline or larry kudlow, director of the national Economic Council, good morning, always appreciate having you on. Thank you for being here. So friday morning, you set on fox news channel, and i remember it so clearly, you said no second wave, and you said it again, this is not a second wave. That obviously was important for markets and for our expectations for recovery. Since then, we have received new data points. So it up on the screen. These are the covid spikes piercing across the country now in florida specifically. In 2500 new cases reported on saturday alone, that is her new single day high. In texas, 2500 cases in a single day. Texas saw its Third Straight day of record hospitalizations and an uptick in california. Based on that new information, what can you tell us about going concerns over a second wave. I understand the growing concerns and we are going to have these concerns for a while but i have been in touch with our Health Experts, actually each of the last for five days including this morning. These are relatively small bumps. They are there, i am not denying it. That places like South Carolina, north carolina, florida and texas, some in california. Please dont forget we are testing add 100 times the rate we were a couple of months back in march, so you are bound to uncover a lot more cases. I think its very important to note with respect to the positivity and the new cases totality rates remain very low and in fact nationwide if you take a look at the case rate and you take a look at the fatality rates, they are still running basically im around zero to 1 and may be slightly higher than 1 on a one day or seven day average. I do not want to downplay or argue against the fact that its happening, but i think it is something we have to get use to you. I think it is controllable. We have better equipment, we have much more experience in handling these hot spots, small metropolitan areas. We are not intending to close down the economy. We do not believe this is a second wave. Having said all of that, let me remind one of my Favorite Health experts said weve got to have best practices with hygiene. In those localities where the guidelines are clearly wear masks, keep the social distancing and so forth, those things must be observed, so we must open the economy, but we must do it in a safe way. Ed but all the facts he lay on the table are important but the fact that sandra put on there about some spikes are important as well. How can you say again as you did a moment ago we are not shutting the economy down again. No one is wishing for this but god forbid the Health Experts go to the president and say we are fearful this is going the wrong way and there could be tens of thousands more people dying. You are saying the president still will not shut down the economy . The president is absolutely disinclined to shut down the economy as is the Vice President. I think shutting down the economy could be worse for our health than not shutting it do down. I will just tell you what the Health Experts are saying, and they do not see the degree of alarm. There is hardship every human beings value is terribly important, but when you look at the overall numbers and including the specific areas, this is not necessarily a nationwide event as i said, case rates and fatality rates nationwide are still rockbottom and have flattened. We are on it, we are watching a very carefully but that does not mean because a few places have had flareups for one reason or another that we need to shut down the economy. Sandra what is your biggest concern . We look at the stock market, a ramp back up to recent highs, it seems youve talked it off to lowes of the session today so im sure investors will be thankful for that down 438 points you saw wild ride on wall street last week, what does keep you up at night when it comes to the economy and remaining open . Americas health and safety keep me up at night as always, as an honor for me to be in this job and its been hard going but it is hard going for everybody. This economy is really coming back strong. We are going through the transition phase in may and june. We are reopening. 80 of Small Businesses have reopened according to the chamber of commerce. Fabulous job numbers a couple of fridays ago, plus 3 million and by the by, the ppp program is directly responsible for that. People who were temporarily laid off or furloughed are going back to work. There was a great story in the wall street journal this morning about my pal who knows how strong retail sales are looking. We checked out the numbers, general merchandise sales, Department Store sales, they are all spiking up on a yearoveryear basis actually going to be higher right now. You get this from the credit card data, both credit and debit cards. The economy is coming back very strong, i think we are going to get 20 plus rates in the second half of the year, i referenced the Congressional Budget Office on this but other forecasters are saying the same thing. I see no reason with good policies we can have a big bang increase in 2021. I thought today some people, im describing the vshaped rebound, some people are calling it i shaved where it just going straight up. I dont want to get qe here, just saying as the reopening is occurring, this is like the passing of a very bad hurricane or a very bad snowstorm. Hardship, heartbreak, yes. But when it passes, people return back to their work and that is exactly whats happening now and we observe in private industry whats so important, they are testing. They are doing the temperature. We do have the equipment we didnt have any experience we didnt have and i think the economy is going to rocket higher and higher in the summer months, the Sales Numbers are one thing, going to have better jobs. Forget weekly unemployment, crucial leading indicator have fallen ten consecutive weeks. So i think we are moving forward nicely. Ed he believe the economy is going to rocket as you say in the summer months, why is the president talking about a 2 trillion stimulus on top of all of the other money weve spent and can you break down for us some talk that Infrastructure Spending could be part of that still pushing on the payroll tax cut, what can the American People expect . We are still assessing the whole situation. Everything is predecision right now. We have a lot of discussions on our Economics Team and a lot of discussion with the president just in recent weeks about all of this, and i am not going to reveal everything. He has said, the president has said that he wants the payroll tax cut. That will go very nicely with people returning to work, provides an incentive of 6. 5 higher aftertax increase. We will have a return to employment bonus. He very much is talking about investments, Capital Gains. I suppose for example you buy a business or an asset between now and the end of the year, why not exclude the Capital Gains come up with some into the economy, we are talking about expensing for new equipment, talking about deductions for restaurants or entertainment spots were sports teams. I think we all love watching on the Golf Tournament over the past few days, its a great sign of hope. As we would like to see some liability restrictions regarding covid19 issues so people are not afraid to reopen. These are all part of what he is looking at. Ed larry kudlow live at the white house. Appreciate your time, thank you. Sandraa ruling just coming ig on an lgbtq case that employees can sue for workplace virus under landmark civil rights law. Joining us now is fox news chief Legal Correspondent and anchor a fox news at night, shannon bream. We thought this may be coming and it is. What does it mean . Good morning. There are a bit of a complication this morning because everyone is trying to download this 172 page opinion from the Supreme Court at the same time and it is not fully loaded so we can tell you what we know so far and that is this is a decision authored by justice gorsuch, they have joined the more liberal wing of the court to come up with this decision saying title vii is what allows you to go in federal court and sue over employment actions does imply to and transgender employees. There has been a lot of debate and including during the argument about whether this would be an enormous upheaval in the workplace and across the nation if you changed what people argue was the definition of title vii, yes, you could sue over discrimination on the basis of meaning if you were a woman and you were passed over for a job which was as if to a man, that is discrimination on the basis of. Does that extend to transgender employees . There were two different lawsuits here. They said yes, title vii, those laws that protect against discrimination on the basis of to extend a gender identity issues and trends issues and lgbtq issues. They can now see with federal court over those specific discriminatory actions. He says this, we have a portion of that. He said there was only one word for what the court has done today and that is legislation. The document the court really says is in form of a judicial writ opinion interpreting a statute but that is what he is going by, justices kavanaugh in the decision. Historic workplace protection extended to gay and transgender employees. Is legislating from the bench, trying to get the 172 page decision, so as we get more, we will let you know. I ed normally you are out on the steps, whole new world right now. The information we need. We will get back to you. Sandra . Sandra thank you for that. Meanwhile, an Atlanta Police officer fired as the police chief resigning after the Deadly Police shooting of Rayshard Brooks, where these Rapid Response is the right move . The superintendent will be joining us next. Plus, one news outlet called over tweets that critics say flagged health risks that President Trumps rally but not at a packed protest in brooklyn. Is there a double standard here . Our panel will be here to weigh in on that straight ahead. So its funny that now we are having a trump rally and bringing people out to celebrate their nominee for their party, all the scrutiny is coming upon them. It may lead to a world of possibilities. The one thing that no one shoulshouldnt disagree with is because the value of black lives does it mean to much to officers nowadays. Ed the attorney for Rayshard Brooks family right there on his death at the hands of Atlanta Police friday night. The officer who shot brooks was then fired, the second officer involved put on administrative leave. Were these the right actions to take . Joining me now was former superintendent and chief of the boston Police Department and managing director, good morning. We have seen a lot of body cam footage, going to get us some of that in a moment, but your big picture on this case as we look at it this morning. So this is not as open shed, clearly a homicide, not as open shed where the individuals running away was an engaging him. Unfortunately, a tragedy for all involved last night, the families, the officers, the community. However, the officer, the way the use of forces based on what he is seeing. So i dont know whether we are able to get that, the gentleman taking off from a clear that had no other weapons besides the taser he took from the Police Officers belt, decisions have to be made and what i have taken that shot . No, i would not. I have another partner there, trying to get the taser, hopefully wouldnt go through my vest and my partner could protect me if i was incapacitated. But the law doesnt get to be me with the ability for 22nd in hindsight after the fact. What was going on at that time . Ed we do have some video im going to get to that might answer part of your questions you just raise but quickly, we had the president city council in atlanta moment ago and said i taser is not a Lethal Weapon. Can harm you obviously. Is it considered by Law Enforcement a Lethal Weapon or not when mr. Brooks had taken a taser, pointed at the Police Officer, is that a Lethal Weapon or not . We have seen them die as a result of the taser. Does have the ability. Also if you incapacitate a Police Officer who was armed with a firearm, that could be a Deadly Weapon and we dont know whether or not it was beforehand which would be the only item he had read that being said, there were other things that couldve happened but what happened happened and we have to let the facts play out and an investigation to see exactly what was in the mind of the officer when he fired those rounds. Ed legal help to answer a question there, the taser can be a Lethal Weapon and then you mentioned a couple of times it that have other weapons. Might be able to answer that question. You have any weapons on you or anything like that . I dont have anything on me. And i check you to make sure . I have this money, gas, that was. Is it okay if i pat you down . Just turn around and face away from me real quick. What is this . Just a bunch of money in your pocket . Just my wallet. Whats all this . Just money. How much money do you have in your pocket . A couple hundred bucks. Ed says maybe ive got a couple hundred bucks on me but no weapons and he allows them, cooperates and allows them to pat him down and apparently they did not find any other weapon. How important is that that mr. Brooks did not have any other weapons . Thats an important fact that they have to consider because it is a motivatin mitigating factot taking the shot. So all this has to be processed and identified before the termination is made whether its a criminal defense or not. Ed some of the officials citing the fact that mr. Brooks after taking the taser and pointing at Law Enforcement appear to be running away. I say appear because we are still getting the facts. How important is that . Is a suspect and his running away, is at a mitigating factor that you should not use force or what . It certainly could be in South Carolina, we saw he was running away but trying to engage the taser which looks like is different here. All of those factors have to be considered. I would help if i was in that situation, i would not have utilized lethal force but we are going to have to wait and see what happens in the officers mind and see what the rest of the investigation shows and what the evidence is before charges are made. Its a tragedy for everyone involved, the family of the deceased and the family of the officer in the community itself lost another individual in a confrontation with police and that is not helping that we need to face headon. Ed brought a lot of facts to the table as investigators may all this. We appreciate it. Sandra thank you. A fox news alert out of minneapolis as they announced the resignation from the forest. A live report, plus long voting lines in georgias primary fueling democrats fears of voting suppression in the 2020 election as joe biden goes after the president. Our gummies contain a unique botanical blend, while an optimal melatonin level means no nextday grogginess. Zzzquil pure zzzs. Naturally superior sleep. Ed at least seven minneapolis Police Officers have an elk with the force and several more reportedly in the process of resigning over what they call the lack of support both from the department and city officials. In matt finn is live in minneapolis with more details. Good morning. Minneapolis please confirm to us that several officers have liberated from the force and not clear how many more might. People seek to leave employment for a myriad of reasons on the nbd is no exceptions. We think those who are leaving for their time, commitment, and service, they have given themselves and they are appreciated. Set minneapolis Police Officers apparently feel vilified and say they can do their jobs correctly in this Political Climate and they were given clear direction and were filled by leadership. They have told fox news in recent months they do feel their hands are tied here. The Minneapolis Police chief tells fox news his officers have suffered trauma but for now, many are still showing up in as the d fun Police Movement spreads, the brother of george floyd tells fox news is neville that he does not support defunding the police. What i would like for all police around america to get their jobs and giving them the right way, the correct way. Innocent people shouldnt have to die. You can do your job and still maintain respect for others. In st. Paul, Minnesota State legislature resumed a special session today endorsing a sweeping Police Reform package. Republican and Democratic State lawmakers have different responses to Police Reform. And why. Minneapolis, the intersection has been dubbed george floyd away. The area has been barricaded in every direction, Minneapolis Police say they will not be decommissioning the memorial for any artifacts left behind in here, has also publicly apologize to any person or journalist who may have experienced Police Brutality or Excessive Force. At least one freelance photographer has now found a lawsuit claiming that an officer shot her point blank with a rubber bullet and she is left permanently blind. Ed matt finn, thank you. To my critics are now calling out nbc news over a pair of tweets sent out yesterday about an hour apart. President trumps rallies in the George Floyds protest, the first one mentioning only the enormous crowd at a brooklyn rally for black trans lives. But a tweet you now or later mentions the health risks of attending the president s upcoming in tulsa. Good morning to both of you and wonderful to have you both together. It isnt there a point to be made there . The point is it is indoors and outdoors and all your medical experts will tell you outdoors is better than indoors. Neither is ideal and that is the big distinction here. Ronna mcdaniels on earlier talking about the indoor facility they will use and talking about they will move the overflow into the Convention Center and have some outside area. They really want to be safe, then they should go to oklahoma to the university of oklahoma, huge stadium there. You stadium there. But the reason they wont move the rally which they should is because they are trying to tell us where the massacre happened, the largest racial incident of violence in our history and while donald trump moves the rally they really should move the rally to one of the larger stadiums. Thats the real point here. Sandra i think you might be making the point for those highlighting the double standard. I didnt hear you mention the lack of social distancing with those protesters which many are saying nbc left out in those tweets but your point, i will play the sound, she identifies the hypocrisy when she joined us last hour. It is interesting to see how we were in hearing about this during the protests last week when thousands and thousands of people especially with Africanamerican Community that has disproportionately affected by that and you saw democrat mayors and democratic governors out there with these protesters not talking about ppe. The far bigger hypocrisy is the sanctimonious insincere journalists and columnists who want to tell americans if they shouldnt go do their job while these journalists go do their jobs. And make a living and put money in their retirement accounts. And it is why you continue to see the trend being americans are starting to be more concerned for their Economic Security than they are worried about their health concerns. And if there is a second phase and even as we see an uptick, it is where the real issue potentially becomes because will americans be as willing to socially distance in a next phase trying to be good stewards, trying to do the right thing, but now you see so many of these regulations being so arbitrary and having no grounding insensibility or common sense, not that people didnt try to make good decisions, but now that americans are getting back out and wanting to have a job and wanting to make a living, a new breakout makes it only harder to keep social distancing happeni happening. Sandra we are talking in particular about the valleys. Everybody coming after him for holding this rally but he says hes got a million registered now wanting to get into that rally. Says theyre going to try to accommodate some outdoor space but obviously, this is going to become a thing for democrats because the president probably isnt going to stop there. That means a lot of people getting together. Go to a bigger facility. It also doesnt even want you to come. The elected officials there are experiencing the biggest spike of cases in tulsa than they have since the beginning of the pandemic. The Editorial Board says dont come, wait for another day so why are you so wedded to doing this they are and now that is the real question. Youre going to go happier rallies, have them outdoors, where masks come up but i promise you if they continue with this rally on saturday and people there indoors, they are not going to have masks on. The vast majority of people are not only outdoors, they are wearing masks. They may not be socially distance, neither was perfect but the bestcase scenario is outdoor protests and rallies. But africanamericans and their allies, people who oppose racism have decided that if you are black in this country, you are more likely to die of cobit or at the hands of Law Enforcement come as you are picking this fight now and many people are joining them and i think that speaks volumes that people are taking that risk. The best way. Sandra further details because she wasnt in charge of it, she didnt know what further details and instructions they will receive upon entering, but obviously safety precautions are being encouraged. Meanwhile, wanted to talk about Voter Suppression and im going to have you kick this off because the headline democratic fears grow over 2020 Voter Suppression, what did you see in that georgia primary that is leading to so much concern . Theres a reason georgia is under congressional investigation for the 2018 election and now it has just continued. People in georgia especially stood in line during a pandemic in 90 degrees weather and pouring rain to vote and when they got there, many of them were unable to vote because the Voting Machines didnt work and they didnt have a provisional ballot. This is not incompetence. This is now a pattern big as you can travel just outside of there and walk in and out of the voting area so unfortunately, georgia has a sad history of this and continuing it. Normally department of justice would intervene. Now theres nothing. Sandra just seconds left. Joe biden said this is his greatest concern, his single greatest concern, his words, the president is going to try to steal the election, the press secretary push back on that and called it a ridiculous proposition, go ahead and what is your response . That is the only song on their playlist. We hear this every time there was an election. The fact is, you have whether it is the secretary of state in ohio for the secretary of state in West Virginia who were doing online voting for military. They are able to track ballots. There are ways to increase voting and you are seeing it happening with republican secretary of state. And what marianne wont point out is the fact that many of these areas where voting is struggling is because it is democratic local elected officials who are running the election. Thats why they are under investigation. Sandra this is stacy abrams obviously for the possible vp, she said we should absolutely be concerned about Voter Suppression and the impact on elections, should turn that concern into action, Voter Education and advocacy campaigns in litigation. So this is becoming a bigger issue for democrats or at least they are making it so. Thank you to both of you for being here. Ed meantime, call us to defund the police going on the left. Could that become a reality . The New York Times ran an oped saying yes, we mean literally abolish the police. A closer look at that next the first coming here is the attorney for george boyds family. What we want his people from both sides of the aisle, people from communities of color to get with Law Enforcement and come up with solutions. The newday va streamline refi is the reason why. It lets you shortcut the loan process and refinance with no income verification, no appraisal, and no out of pocket costs. One call can save you 2000 every year. Call my team at newday usa right now. Unfortunately, democrats think the best thing to do i believe a greater training and Greater Transparency and greater accountability is a place to solve much of this problem. Ed House Republicans working on a bill to reform Police Departments after democrats unveiled their proposal to defund or dismantle Police Departments in some cities start taking steps to do just that. Warns of logistical and political problems. Chief Political Correspondent for the Washington Examiner in a fox news contributor. Good morning. We make some money that they said as an organizer of a criminal organization in the head of the oped is yes, we mean literally abolish the police. This after we heard from joe biden others say no no, thats not what democrats want. Is a critically or headline. When we started hearing this phrase defund the police after the George Floyd Killing in minneapolis, we heard a majority of members of the city council in minneapolis approved defunding the police and believed that men and eliminating funding the police. Said no, of course we are not going to defund the police. Joe biden said something very similar. They need to have this oped in the New York Times saying we mean literally abolish the police. Among democrats, there is a division about what defunding the police means and there were seven significant new group who actually means defund the poli police. Ed and even if you dont abolish the police literally as the oped suggested, if you defund as you see stop sonic start shifting away from if you dial 911, what happens, we read about this and this piece, what would happen when a crime is committed. We are seeing my pictures right now in atlanta, a growing group of protesters right outside the capital as you can see who are frustrated about the latest death in Police Custody of a man over the weekend, Rayshard Brooks we will monitor that. I went to quickly read your piece, there is a murder which happened 40 times in minneapolis last year and 492 times, the defund the Police Movement has grown without seriously addressing that scenario. Your thoughts. A lot of this talk comes from a 201 2017 book called the end f policing from a professor, he has been interviewed recently and has that very question, if your house is broken into, who do you call, and he did not really have an answer. His idea is if you put more money into things like drug treatment for example, fewer burglaries and then less police, kind of an idealistic notion but i dont think anybody has actually mapped out what would happen if you eliminated a Police Department and then you have the occurrence of crimes that we traditionally call the police for, Armed Robbery and burglary, et cetera. Who would respond and how they would respond. Ed in the last 30 seconds we have come a tim scott running point of the republican side saying the bill will likely come out wednesday, democrats have put their plan on the table and in 30 seconds, we do you think this is headed . They were going to be some reforms. Look what happened in minneapolis. They were people now saying those kind of Police Techniques that led to the death of george floyd should not be done, they should be outlawed. Seeing attorney general barr support that. Bipartisan support for that. Youre going to have bills that eliminate some of these Dangerous Police and on the other hand going to snack on issues like liability of people to sue the police. We will see an argument about that but agreement about some Police Techniques. Sandra new York Governor Andrew Cuomo now threatening to take action after seven business has reportedly ignored social distancing rules over the weekend. So could the big apple be in for another shut down . Moneyman Charles Payne surely has something to say about that and he will weigh in next. If you just allow the violations to continue, we would have no choice but to take state action. Mmunity, working to care for all of us. At novartis, we promise to do our part. And its testing the people on the front lines of this fight most of all. So abbott is getting new tests into their hands, delivering the critical results they need. And until this fight is over, we. Will. Never. Quit. Because they never quit. I am warning today in a nice way consequences of your actions. We have 25,000 complaints statewide. I am not going to turn a blind eye to them. We have to close, then people are going to hold you accountable. To mess that was new York Governor Andrew Cuomo threatening to halt the reopening of some parts of his state after a surge of complaints against businesses and the crowds ignoring social distancing measures over the weekend. So what would this mean for new yorks economy . With spring and Charles Payne, host of making money on fox business. First, lets see what the message. I dont see that anybody social distancing and doing their part, im going to shut it down. And andrew cuomo has treated this thing with such a ham fest from day one, i think he got drunk on the celebrity of doing his daily conferences which everyone shared initially, but a lot of mistakes on his part have been overlooked, glossed over, and i think this is another one, these Small Businesses, these restaurants and bars he is talking about hanging on by a thread, no Small Business as a group is more vulnerable to the shut down then restaurants and bars. Theyve got to compete against high unemployment and compete against two weeks worth of cash on hand and so many other issues. There are so many large swathes of the state including new york city that shouldve been included a long time ago and theres a certain amount only a certain amount that they can do for bar owners can do if people are outside in front of this place and enjoying themselves, i think this is just too much, too hamfisted. And you dont want to discourage anyone right now when we are hanging by a thread and lots of people in new york city, Small Business owners hanging by a thread. Sandra as they have been at some points of this outbreak, the mayor of new york city seem to be at odds over that message. Here is the mayor. Im sorry, its a quote. He says this. We have social distancing ambassadors out all weekend distributing masks and encouraging people to disperse after making their purchases. These businesses are allowed to be open for the governors guidelines and we dont believe imprisoning people or taking away their livelihood is the answer. So very interesting message coming from the mayor and the governor of new york as we try to see all these businesses reopen. Meanwhile the wall street journal Editorial Board out with this piece this morning, covid impact on minority owned businesses, it talks about how the lockdowns have hit those minority owned businesses, study says 41 of black Business Owners disappeared in april. Thats pretty tough to take in. It is. This came out last week, so im glad youre bringing it up now. It is heartbreaking and it gets back to who could afford to be locked down in the cities the longest . I understand an abundance of caution, but we see who actually is getting crushed by these actions more than anyone else and for these businesses, most of them are firstgeneration, saved up for a few decades, took a shot, one of the peace of the American Dream and already tough to get in the first place but certainly now, you add on an extra layer of a lot of these protests that were allowed to turn into riots, and it is a onetwo punch. Im not sure how these folks are going to get back on their feet. All of the people from the Trump Administration that have come on my show last week, ive been asking them this and some said they are looking into it, but i am really upset with local municipalities, governors and mayors who have allowed this to go on. Sandra important to think about who gets hurt the most by these shutdowns. Gosh forbid we have to see another one. Thank you. We will be right back. One call to newday can save you 2000 a year. With newdays va streamline refi theres no income verification, no home appraisal, and no out of pocket costs. Its the quickest and easiest refi theyve ever offered. Call newday now. Ed fox news alert, any moment now we expect to hear from the widow of a man killed by police in atlanta. This is Rayshard Brooks death is ruled a homicide and waiting to hear if prosecutors will filed murder charges in the case or not. Welcome back to americas newsroom. I met henry. Sandra good morning, everyone. We will be watching that. His death sparking more protests than people now gathering outside the Georgia State capitol, the shooting sparking new calls for a nationwide Police Reform after body cam video showed a peaceful sobriety check sprinklin spiraling out o. Grab the officers taser before he was shot. Has been fired, the other now on administrative duty while the citys police chief has resigned. The mayor of atlanta last night. It has really been difficult for me to put aside my own anger and sadness during this time and really be able to articulate what our communities need to hear because the reality is what can you say . Ed Jonathan Serrie live in atlanta with more details, good morning. Good morning to you. Rayshard brooks lost his life in this restaurant parking lot that you see behind me, it has now become a temporary shrine in his memory. All started out as what appeared to be a routine traffic stop, a complaint of a car with a man sleeping in it blocking the drive through lane of this wendys, officers say that he failed a field sobriety test, but things quickly went downhill from there as you will see in this body cam video which shows what happened next. Take a look. I think youve had too much to drink to be driving. Put your hands behind your back for me. And then if we could switch over to police cam video, it shows brooks breaking free from the scuffle holding what appears to be one of the officers tasers and seconds later, you hear three gunshots. The medical examiner has ruled his death a homicide and says to go gunshot wounds to the back cause oregon failure due to blood loss. Atlanta police immediately terminate at the who fired the shots and placed fellow officer on administrative leave. The d. A. Says he hopes to decide by midweek whether to pursue criminal charges against either officer. What people are demanding is that we not create two separate Justice Systems, one for the police and one for other citizens that the Justice System has to be one system. Protesters blocked a 14 lane section of interstate 75 and 85 known as the downtown connector and they were so many protesters on surface streets in this area, firefighters were unable to reach the wendys before the restaurant was completely engulfed in a fire set by arsonists and has become back to my life seen, you can see how this business was completely gutted, they are offering 10,000 reward atlanta Crime Stoppers for information leading to the arrest and indictment of those responsible. Back to you. Ed Jonathan Serrie, thank you. Sandra we will continue watching the News Conference as well, plenty of confusion meanwhile surrounding seattle as some organizers now refer to their barricaded six block protest space for capital organized protests, meantime President Trump revving up his attacks on twitter say interesting how antifa and other far left militant groups can take over the city but these same leaders become radical when it comes to shutting down a state or city and its hardworking taxpaying citizens. Dan springer is live in seattle with more on that for us. The first name they have for this was the chaz, the capitol hill autonomous zone and some of these organizers didnt like the sound of that because it sounded like they want to secede from seattle or create their own country and so they came up with a name chop which is more of an occupation protest and that is kind of what we are seeing now, wall street protest that we saw with the 99 deal. It is calm here, the streets are pretty empty, you can see the police chief walking down there. And he said that the police chief wants to shrink the footprint here because right now, it is too sprawling and affecting too many businesses, so we might see this thing get a lot smaller but over the weekend, we have thousands of people inside this zone, lots and lots of people coming from outside of this area in different parts of seattle in the area bringing their kids and looking around, but the real question is how long with this last end to that end, the police chief wants to get back in the Police Precinct as quickly as possible and the mayor is saying talk about response times. Its taking a lot longer to get officers to different calls and the surrounding areas here and capitol hill and so she addressed that issue. We are looking at response times across the city to see where they are. We know that with these protests and demonstrations that the way they have had to implement and Deploy Police has changed significantly. You couldnt have so many people in the east precinct night after night basically protecting that precinct and respond. Meantime, down in portland, another protest last night resulted in the Thomas Jefferson statute that went outside and came down, that is the 18th straight night of protest in portland and again it ended in violence, Downtown Portland with police clashing with protesters when it got violent at the Police Station there. 12 people arrested and so the beat goes on in portland but meantime in seattle, things are calm inside chop, but there are concerns about response times for police getting different calls and so we will have to see if something changes the next couple of days. Sandra we will indeed appear ed with spring in reporter our affiliate in seattle, also hosts a political show that searches for Common Ground on key issues dividing the nation. Good morning. Good morning to you. Ed whether you said chop, chaz, not really sure where we are all headed with that but you say in times of crisis, what leaders do not say it sometimes more important than what they do say, perhaps pointing at the democratic governor jay inslee who at the beginning of this that i dont know anything about it. Some clear instances were at a time like this so much confusion that people really expect leaders to lead and to speak and you mentioned the example nearly two days have gone by since i took over six square blocks with valve and i was asked about it and said that is news to me and whether he didnt know about it or just wasnt ready to comment on it is another question and there was a city councilwoman who was a very kind person who heart is in the right place but out on the front lines back when this has been a tense situation day after day and had a protester telling police to kill themselves and didnt say anything about it and so in times like this regardless of the side at the barricade that they are on, we need to be willing to speak out about whats happening and people look to them for that leadership. Ed that is shocking, talking about a democratic councilwoman who has been at the front and center of all of this, not pushing back saying that police should commit suicide. Can the democratic governor who is ignorant at the beginning of it and a democratic mayor who has called this a block party. After the protesters calling for change realize that all of these officials are democrats . I think so and also i called out on the show sunday a republican candidate who compared the current coronavirus restrictions the state is under to the officer who pressed his knee into george whites neck suffocating him. So it is not just on the left ear, also on the right but you mention the block party and i spoke to the mayor on friday and calling it the summer of love and its actually a little bit offensive to the protesters where they are demanding real systemic change to refer to what theyre doing has a fun block party, almost trivializes what some of them are therefore in calling it a block party is a complete mischaracterization of what is going on. Ed someone at the center of this is the police chief has been trying to do her best under very difficult circumstances. Ill give you a chance to react. I was looking at the 60,000 people that were there, sign saying defund the police, stop Police Brutality, no qualified immunity and thousands of people curing those particular signs and i just realized it was a moment, an epiphany that this is a Pivotal Moment in history. We are going to move in a different direction and policing will never be the same as it was before. Ed so there she is trying to push back on the idea saying you need the police, they will be there to help you but we have to change. What are your final thoughts as we move forward . One of the interesting things people have to realize across the country of seattle has been in a formal Police Reform process for nearly a decade starting back in 2012 after some high profile incidents. Spent millions of dollars and have been working with the department of justice for nearly ten years to try to reform the seattle Police Department when it comes to issues of Excessive Force and problems with biased policing. They look at that and say working towards reform, its a very progressive city and saying 60,000 plus people who are demanding even more change from the rank and file of the department and at the end of the day, you get the leadership that you vote for and if that is what seattle voters want, that is probably what seattle voters are going to get. Ed you get the leadership you vote for. Thank you. My pleasure. Sandra russia sentencing a former u. S. Ed a resounding victory this morning after the Supreme Court ruled in the landmark civil rights law to protect gay, lesbian, and transgender people from workplace discrimination. Shannon bream has been pouring through the decision and has more details. Good morning again. Is a little bit of a challenge now because things are different in the age of covid. And there actual physical opinions, to allow the download but the bottom line has not changed. Argued there were numerous rallies advocating, really landmark historic decision, one of the newer justices to the bench, he also offered the opinion he was joined by the chief Justice John Roberts to join the more liberal wing. Thats the law that oversees discriminatory adopted broad language making it illegal for an employer to rely on an employees sex. We do not hesitate to recognize today an employer who fires an individual merely for being gay are transgender violates the law so it now extends to the Lgbtq Community in the workpla workplace. Justice alito was among those who were concerned about issues involving religious employers and noticed a number of them weighed in on this case and said briefs filed by a wide range of religious groups expressed deep concerns. They argue that religious organizations need employers who actually live the faith and compelling a religious organization to employ individuals whose conduct flouts the tenants of the base sources to create an objectionable message, say a Catholic School that hires a teacher and finds out they are breaking the tenants of the catholic faith by living with their partner outside of marriage or entering into a samesex marriage. He says that could be an issue for employers who are religious but both he and Justice Kavanaugh who also filed percent said what they were really concerned about as they see the court is legislating. This is something that should have been led to congress and in his dissent, saying this we are judges. Not members of congress. And Alexander Hamiltons words, federal judges exercise Neither Force nor will but merely judgment. He goes on to add our role is not to make or amend the law. As written, title vii does not prohibit employment discrimination because of Sexual Orientation. Clearly, the majority did not agree with those viewpoints it is interesting in his dissent, he repeatedly talked about treating all americans equally and that this is a big win and a big day of celebration for lgbtq groups but said this is Something Congress should have handled. They have a number of times gone back to the well on this law and tried to pass additions that would make it clear it applies to the Lgbtq Community. They havent done it and both justices alito and kavanaugh stop lomax out this is something they shouldnt have been doing from the bench and should have been across the street on capitol hill. Sandra thank you ed, thank you, shannon appeared lets bring in judge andrew napolitano, who is double the breading file on fox nation. Thankfully, you are able to join us here. Pages of this decision, 63 decision dealt with three individual cases, what is your reaction . Our colleague just said very nicely articulated what is going on here in the court and basically, this is 172 pages over the meaning of the word sex. The simple word, sex mead in 1964 what it means today or is the court just to interpret the statute in accordance with the plain meaning of the word as it is understood by the public. So in 1964, no one in congress thought this applied to the Lgbtq Community. The community was not organized. He wasnt called that. Nobody thought it applied to gays and lesbians. We knew that because in 1964 when it was debating the Civil Rights Act, attempted to add protection for gays and lesbians and they defeated that. Does that mean they didnt want the protection in there where the people that wanted to add it in there wanted to add it as a poison pill so the entire statute would be defeated in 1964 . Justice gorsuch says none of that history matters. What matters is the word that congress used, and it use the word sex. When a human being is discriminated against on the basis of Sexual Orientation or attraction for behavior, that is discrimination based on sex and therefore it is prohibited. This is what we call a landmark decision because it will have a radical effect in 17 states. Why do i say 17 states . And the other states, this already is the law like in new york where we work for new jersey where we are at the moment, it already is the law under state law. But now as of 10 00 this morning, it is the law everywhere in the United States. Sandra does this open the door to a host of other challenges when it comes to discrimination talking about the landmark case . I think it probably does. The Civil Rights Act of 64 prohibits discrimination in public accommodations and in employment. So even though this decision today just involves employment, people will use the language, the rationale of the 63 of majority to make other arguments for public accommodations as well. Again, only in the 17 states, counting the district of columbia, only in the 17 states that dont have a state civil rights law that protects Sexual Orientation. That is always the fear of dissent, that we are opening up the door, that this is a slippery slope. Justice gorsuch says it in answer to that, we are ruling on the basis of the facts before us. When a new case comes to us, we will rule on that. Sandra so the courts as federal law protects those workers from discrimination and is a landmark case and we will have more continuing coverage on that but i want to first ask you before you go about the ongoing situation in this country when it comes to shut down orders. You and i have talked a lot about that. Its as if i dont see proper social distancing happening which we are seeing people congregate in the streets outside of bars and everywhere in new york, he will have to shut it down again. Here is the governor. I am warning today in a nice way consequences of your actions. We have 25,000 complaints statewide. I am not going to turn a blind eye to them. We have to close, then people are going to hold you accountable. Sandra so he is talking about having to shut down the second time as so many businesses are struggling to even make it through and many didnt even make it at all. Governor cuomo has been my friend for many years. He sounds like a grouch. I didnt hear him complaining about the demonstrations in the streets not following social distancing, only complaining when people are enjoying themselves in the bars in Lower Manhattan and on the beaches of long island this week. We have come to a point where people have had enough, where they recognize that what governors are issuing our guidelines and if they want to take the chance to live as normal human beings again, they are entitled to take that chance. I dont think you were going to see compliance and i think you were going to see police saying forget about it, more important things to worry about than he was wearing a mask and who is out on the street and who is 6 feet from the person on the sidewalk. Sandra as you know, they sent out these social distancing ambassadors they are calling them to make sure people are enforcing Good Behavior on the street, really something to watch and we will see what happens next. Judge, thank you for all of that for us. Ed meantime, a desperate search underway for an air force pilot after a fighter jet went down. Sandra fox news alert now, we are watching markets for you well off of their session lows today on growing concerns over a second wave of the coronavirus although we did have the president chief Economic Advisor larry kudlow joining us last hour. We asked him about a second wave and said we are not experiencing a second wave according to white house medical professionals, but we have seen an uptick in cases in seven states across the country, florida, arizona, and texas are among them. The dow is down 762 points so well off those lows now down 324 points. Growing fears over what would happen if we did see a continued uptick especially in a state like new york whether or not we would see another shutdown is the concern and we are watching the board for you. Ed andrew cuomo the governor of new york is starting his briefing and we will go and dip in life. Before rick went to the Court Authority and before jamie came to the governors office, they were the ones who were working very hard on making this bridge a reality together with larry schwartz, but they really did an extraordinary job and its a pleasure to be with them today as we open the pedestrian shared use path on the bridge which is going to be a big hit, big success. This bridge has energized the economy for the entire region, and i think you are going to see people coming to enjoy the bridge even more. So its a pleasure to be with all of them today. Lets talk about some of the facts before the sun melts us here today. Today is day 107 since the crisis started in new york on monday 22 since weve been dealing with the civil unrest after mr. Floyds murder. On the civil unrest, i said from day one i stand with the protesters, the outrage was right, the outrage was justified. What we do in new york is we take the outrage, and we seize the moment. Carpe momentum good is about people wanting to change. New york will be the place that actually makes the change and we passed laws that have done just that. Today, going to sign additional laws first that an officer must report a weapons charge within six hours, second Police Departments and courts must track all of the arrest data so we have all of the facts race, ethnicity. Third providing medical help to any person under arrest or in custody when they require it. The major reform that we are going through in new york that is going to be the first in the nation, and i think really show people across this country. Sandra you been listening to new York Governor Andrew Cuomo they are discussing latest developments on covid19 giving his update on the situation in his state, and he has sent a warning to continue with social distancing measures, could be another shutdown. We will continue to monitor this for you and give you updates as we get it. Ed in the meantime, north korea warning of a possible military action against south korea. The sister of dictator kim jong un threatening to abandon the 2018 Peace Agreement between the two nations. President moon jaein urging the north to stick to the deal and resume talks. General jack keane is chair of the institute of the study of war and fox news senior strategic analyst. Good morning. What are we learning from kim jong uns sister, her moves now, how concerned should we be, but what is it also telling us about this regime do you think . I think at the heart of this is really the frustration that kim jong un truly feels because the Trump Administration is using a different playbook in a Previous Administration and what i mean by that, when they have the first summit going back two years plus now, there was a thought that he would be able to get sanction relief and other kinds of Economic Relief as Previous Administrations had done for him. Largely just by showing good faith and at the second summit, good faith was shown that the first one, the second summit, with the administration wanted to see was specifics in terms of denuclearization. Show us a plan, tell us where your sites are, let us send in and put together a time schedule. None of that materialized and President Trump walked out. There has been growing frustration ever since that moment because the north koreans expected just by showing good faith they would get concessions and that hasnt materialized. Ed i thought it was interesting, former cia director and democratic and Republican Administration had criticism for President Trump on some Foreign Policy matters but what you just laid out was very important that this president tried something that neither side, neither democratic or Republican Administrations had tried. What is the next move for President Trump when we see more of this rhetoric coming from north korea . I think kim jong un or his sister will do some more posturing, but i really believe the cards that they are playing as they are uncertain as to what the november election will materialize in terms of whether they still have to deal with President Trump, whether they will deal with a successor. So i suspect we will stay stalemated as we currently are. They may fire some rockets and Mission Missiles that they will not do anything in terms of longrange missile firing that would cause President Trump to take action. Ed we appreciate your insights this morning, thank y thank you. Sandra fox news alert, the widow of the man shot and killed by police in atlanta is now speaking to Rayshard Brooks widow. Who would have gladly came and got him so he could have been with us today. The day after his murder, and her birthday dressed to go and take her skating and a look across the room and know that is never a possibility anymore breaks my heart. Me and my family are still grieving the loss of my grandmother. Not only are we hurt, we are angry. When does this stop . We are not only pleading for justice, we are pleading for change. The same one we represent and loved all our lives. We stood with the Atlanta Police department when they were just torn a buyer city, and this happen here and here we are three weeks later, those same police took a life away for my family that we will never get back. Multiple of us have been slapped or eaten since we viewed a video of a man being murdered for a phone call moments later. This entire situation, a copy of my entire family im sure for the rest of our lives. My uncle did not die in vain, his life mattered. George floyds life mattered. Michael browns life mattered. Im not only asking the city of atlanta to stand with us, asking them to seek justice for the shot, thank you. The name that may start a protest tomorrow or another day in the future, however, this may no longer has a future. He can no longer live in the present, nor planned for tomorrow. No matter what the different points of view are of his death, we must all agree to one fact. The fact that he was killed by the Atlanta Police department. The that someones cousin, brother, uncle, nephew, father, companion, and a friend is no longer in this world. The trust that we have in the police force is broken. And the only way to heal some of these wounds is through a conviction and a drastic change in the Police Department. But honestly, true justice will never prevail because we will never be able to bring back Rayshard Brooks. He will no longer be able to return to this world, nor to his family. However, again, if we stand together and unite as one, they will be no more cases similar to rayshards. How many more protests will it take . To ensure that the next victim is it your cousin, your brother, your uncle, your nephew, your friend, or your companion. So that we can finally end the suffering of police Excessive Force. We are tired. We are tired. And we are frustrated. And most importantly, we are heartbroken. So we need justice for Rayshard Brooks. This is mr. Brooks cousin. Will try to make this brief, but clear. First and foremost, we want to say we want to show our appreciation and thanks to everybody and that been out here supporting us and helping us, and we encourage you to continue to do so, and a lot of people know me as that, a lot of celebrities trying to reach out and try to find a family, i am the family. And if you try to help, reach out to me so we try to make sure my cousin and his wife and his kids are taken care of. You can help financially, then just keep up with your voice. But again, i want to just tell you that we appreciate all the help, we appreciate your voices around the nation. We thank you. I am attorney chris stewart, and i tried to figure out a way to encompass everything that is going on and get rid of the division of one side versus the other and get the whole country to understand what is going on. The first thing that came to mind is what we all just went through with the coronavirus outbreak. We all sheltered in place for months, losing our minds. And then we started seeing on the news, large amounts of white americans demanding change, coming out and rallying in the streets, protesting and making their governments change laws so that we can start getting back to a regular life. And watching tv and watching the so many of our White Brothers and sisters out there rallying, protesting because they thought something was wrong with the current state of laws and their city or state, they didnt have a problem with it. That is their right as americans to demand change, to demand laws change. So why is this so offensive or painful or offputting when africanamerican stepped forward to demand change against Police Brutality . My is it so wrong when we are protesting in the streets when we see something wrong with police abuse . It is our godgiven and an american right also. So it is a thing of unity when you see both sides of it. You have to support and vocalize your rights as we did, and we watched on tv and as people are doing in the streets now. Demanding changes in laws. In policies, and accountabilities. In the value of life where a man that was running away doesnt get shot twice in the back. And now there was a question of what is it or should he have used that force. Let me tell you and show you why shooting in a crowded parking lot is so reckless. And so unnecessary of what he did. I witnessed today sent as his vehicle, which was hit by one of those bullets. While he and his kids were in the car. A couple of feet up, and we wouldve had another loss of life. So try to justify the actions of shooting at mr. Brooks as hes running away in a crowded wendys parking lot when you could have easily cashed in later for what started off as a very nonconfrontational situation. Cant be justified. They cannot be justified. Otherwise, we are going to continue to lose lives from stray bullets shooting at someone that should have never been shot at. And people ask how could this have ended . It could have been it couldve also ended here. I can walk. My sisters house is right here. This is how this could have ended. They didnt have to go to that level, and that is what we are saying in america with policing is this type of empathy is gone. The courtesy of an officer was that mikey was called there because mr. Brooks had been swerving and was a danger to society. The first call was because the man was asleep. Where is the empathy and just letting him walk home . Thats what policing is supposed to be no matter what color you are. But thats broken, thats gone, we dont see that we definitely dont see it in africanamerican communities of just like the protest before, thats what we are demanding, not just laws and policy changes but a mental change in police. Which is missing. So we do want everybody support, looking forward to the das findings in this situation, and the only thing that we can ask for is some semblance of an idea of justice because there is no definition anymore of what it is. But what we know right now is that a mans life is taken when it should never have happened. Right now, we want to introduce everyone to tamika, who many of you have met and the kids, blessing and dream. Blessing, it was her eighth birthday when her father died. She had her Birthday Party on the same exact day that they found out that their father was killed. She had her birthday address on has all of you have heard, cupcakes and friends over. She was supposed to go skating with her dad and that didnt happen of course. Also, who is 13 is his stepson and took care of him as well. And tamika, if you want to say a few words. I just want to thank everybody for all the protest, love and support that you guys have done. Words cant explain how thankful i am for everything even though i cant bring my husband back, i know he was smiling because his name will forever be remembered. There is no justice that can ever make me feel happy about whats been done. I can never get my husband back. I can never get my best friend. I can never tell my daughter hes coming to take you skating or to swimming lessons. So this is going to be a long time before i heal. Its going to be a long time before this family heals. Like i said, i am just thankful for everything that everyone is out there doing, and i just ask that if you could just keep it as a peaceful protest, that would be wonderful because i want to keep his name positive and great. Lastly, we do want to acknowledge and thank tyler perry who we spoke with the will be taking care of the funeral for the family, and it is support like that and to people who are actually in this community that love the community that want healing and families like this to never have to go through Something Like this. To step forward, and we want to thank him for such a generous move. Three brief questions. Did rayshard ever discuss what was going on, the previous shootings that had happened, any conversations . We watched it. I dont ever want that to be you or he was always like no, its going to change, its going to change. We try to stay positive about everything. But we have our incidents where we have had Police Officers like that. It is really crazy. I fear every day, my children go out, my family members go out, i am scared because i dont know what to say and this is really startling but i dont even know if theyre going to come home. It goes to a point of people asking why would he resist when they were trying to put him in handcuffs. Well, they put george floyd in handcuffs and he was subsequently killed so just getting put in handcuffs if you are africanamerican doesnt mean youre going to get nicely taken to the back of the police car. So especially watching this video over and over again, his reaction may have been i am not getting put in handcuffs. So we cant just toss it out because he resisted. George floyd didnt, and ended the same way. This is something that is not new, just with george floyd. All of us, i know every black man standing behind me and woman, we have all been dealing with this from birth, so that is a trauma that is deep, it is not something that just started two months ago. I still today dress like i dressed, do what i do and still feel nervous around police, and that shouldnt be the case. So if you feel that way, and then you see all of these things happening, of course youre going to feel some kind of way when police come up to you and you are somewhere where you are not in a perfect state of mind at that point in time. [indistinct question] and you talk about that moment and what it feels like now with the position you took before . It makes you eat your words. I love atlanta. My family loves atlanta, and when they were busting out the window, we were like why are they doing this to our city . Burning at police cars, this doesnt happen in our city. And not only does it happen in our city, it happens in cities everywhere. Can you talk a little bit more about what he liked to do . Who wants to talk about it . Rayshard is my first cousin. These people you see behind you are his sisters, his brothers, his nieces and nephew, his first cousin. A week and a half ago, he and his older brother were playing chess. And he just popped up. And i said are you good . And said yes. I came because i needed to see my wife and my baby. My daughters birthday. I said are you staying out of trouble . And i said im all right, im all right. We shared a few drinks, a few laughs, big brother gave him a few dollars. He was always happy. Because he was in that of dude. So do you people that are looking around the world and you have your feelings before it happened to us, i could only guess at what you felt, but now i understand. Life shouldnt be this complicated. Life shouldnt be where we have to feel some type of way if we see police or somebody of a different color. I didnt come out here to talk to the media. I came to love my people. If you ask how this black man was, look at the children, that in essence, that joy, that pureness of soul and you had a glimpse of what we lost. You have a glimpse of what it feels like. Because tomorrow we are going to have to deal with this again. Were going to have to say the next year and if we can say we love you enough, weve got to apologize for not telling him that we loved him that much. Ive got to go. Ive got to go. You took my cousin from me. Im not really sure what else America Needs to see. The family will probably be back you in a few months with another case sandra a very emotional News Conference putting out there in atlanta after Rayshard Brooks was stopped by two police. He was shot twice in the back. It was ultimately ruled a homicide by the Coroners Office there. His family responding, his widow, tomika miller, along with other family members. A nice pleading for change, his cousins calling for a conviction, and drastic change on the part of the Police Department. His children, his stepson, present. It was a very emotional News Conference for obvious reasons, where the family ultimately walked away from the microphones as we all watched together. Ed there were so many moments, sandra. Including at the end, with the attorney for the family said, im not sure what else America Needs to see, referring clearly to the emotion that was pouring out. You see Rayshard Brooks right there in that photo. His first cousin describing a chess game they just had a few days back, where the family was laughing, thinking everything was fine, urging everyone to hug relatives and say, i love you, because you dont know when youre going to lose them. That first cousin saying life should not be this complicated. You can see the raw emotion, as you mentioned. Its also important to note that the widow, tomika miller, made clear she said, i want the protests to be peaceful, she said. I want to keep his name positive and right. We for the same thing from George Floyds family, as well, sandra. Sandra the family saying, we are tired, we are frustrated, we are heartbroken. Calling for action. This was the video release of that moment where the two Police Officers stopped him in the parking lot at that wendys. Lets watch. Speak up your hands behind your back for me put your hands behind your back. Ed youre right. Sandra they administered its hard to watch, but like so many of these instances, there is video. We can all watch what played out there. As we know, the police who shot has been fired. Ed the District Attorney has to make a decision, we believe its coming by the middle of the week. Some of the estimates of whether or not the Police Officer who fired the two shots, who hit Rayshard Brooks in the back, is going to be charged with murder or not. Thats the first thing. Also, remember what one of the family members said in terms of the resisting arrest parts. When people are saying, well, if he had just stayed in the handcuffs he would have been fine, he said, we watched rapid to george floyd. He went into handcuffs and was killed. Theres a lot of raw emotion. We cant get out of the facts of the investigation and see where it all goes. The eight you have to feel for the family there ed, great to be with you this morning.
