The democratic impeachment managers are fuming about the compressed schedule for the trial, where sessions could run until 1 00 or 2 00 in the morning. They described this this morning as a white house driven and rig process, with a truncated schedule to delete into the night and further conceal the president s misconduct. Thats not that south American People expect or deserve. And thats why Chuck Schumer will introduce proposals of us his own this afternoon. We hope that four brave republicans will resist mcconnells coverup. Will resist mcconnell just going along with President Trump. Good morning to you and thank you for being here. What exactly will you do in this new role . Well, it was announced last night, smitty, but really for the last few weeks ive been working with the white House Counsel helping them prepare the legal briefs that are being submitted in the trial and preparing the oral arguments that will be presented later this week. I was one of a few members that was involved in both phases of the impeachment inquiry before the House Intelligence Committee and the house Judiciary Committee. Theres a lot of information there, so im going to continue to be as much of a resource for the president s lawyers as i can be over this trial. Sandra to be clear, though, you wont have any role in speaking on the senate floor . That hasnt been finally determined yet. I think thats currently the plan. Sandra currently the plan not to . Currently the plan not to. But you never know whats going to happen during a trial. Part of the reason we are there is to hold accountable some of the house managers, in particular the lead house manager, adam schiff, and make sure the evidence is presented the way it occurred in the house. If that doesnt happen, there may be a change in the trial structure. Sandra of course, congressman, thats why theres a debate of witnesses. Democrats are making the case there was information presented after the vote happened in the house on the articles of impeachment. Whats going happen with that debate ultimately, and what is your defense to not have witnesses called . I dont think there will be any witnesses called. There isnt a witness that can be called that can fix this process. There isnt a witness on either side you can call that can inject fairness and due process into a process that had none. I think one of the things your listeners are going to hear this week is a comparison of what happened, the disparity in the way president clinton and president nixon were treated during their impeachment inquiries as opposed to President Trump the nixon and clinton lawyers were allowed to participate every single day from the beginning to the end. They were allowed to review evidence, suggest evidence, to call witnesses, and crossexamine witnesses. By comparison, President Trump during his 78day impeachment inquiry, his lawyers were forbidden from participating for the first 71 of a 78day process. Not allowed to call witnesses, crossexamine witnesses, be there for the presentation or review of evidence. That is a lack of due process and fairness that i think all senators, republican and democrat, are going to be surprised to learn. I think as a result of that they are not going to want to hear any witnesses, because the senate isnt going to be able to fix what happened in the house. Sandra i want to throw up on the screen the tweet last night after it was announced he would be a new member of the president s defense team. He said, i took the oath to defend the constitution. This impeachment is an assault on due process. Its an assault on the separation of powers. Its unconstitutional. Im grateful for the opportunity to make that clear to every american during the senate trial. For your part, you will be controlling the messaging, you will be controlling the defense of this team. How do you let your strategy . We only know what we know. What are going to be the surprises as we watch this all begin this afternoon . I think the Senate Defense team, as they prepare and present this, are going to point out the fact that, again, the irony of the House Democrats wanting to impeach a president for obstructing House Democrats in a 78day process where they forbidden from participating for the first 71 days, people are going to find it ironic that the House Democrats are wanting to impeach for obstruction of congress, a term of the founders referred to as the separation of powers. They cant make constitutional arguments because they dont have any. This impeachment fails. It feels factually, it feels legally, it feels constitutionally. This is going to be like killing a fly with a sledgehammer. The House Democrats had a weak case even on a slanted Playing Field where they made the rules, change the rules, and broke the wills their advantage. On a level Playing Field its going to get ugly. I expect a short trial, no witnesses, and early acquittal for President Trump. Sandra the minority leader Chuck Schumer took to a microphone last night to slam those rules laid out by Mitch Mcconnell. Heres the senator. Senator mcconnells resolution is a national disgrace. He is saying that he doesnt want to hear any of the existing evidence, and he doesnt want any new evidence. A trial where there is no evidence, no existing record, and no new evidence, no witnesses, no documents, that isnt a trial at all. It is a coverup. Sandra as a former prosecutor and now new member of the president s defense team, how do you counter that, congressman . Actually, i agree with Chuck Schumer that there cant be a fair trial and that there was a coverup, but not for the reasons that he thinks. The cover of happened, who everyone knows was not truthful about his contact with the whistleblower, what they dont know is that the whistleblower was not truthful under oath about his contacts with congressman schiff. And there is a transcript that reflects that. Its the inspector generals transcript. Its the only 1 out of 18 transcripts that has not been released by congressman schiff. So there is a coverup there, and that is what prevents a fair trial. If the person charged dominic in charge of the solicitation was judge, jury, prosecutor. These are adam schiffs facts. You cant leave a magic wand and inject fairness into a process that a conflicted witness controlled from beginning to end i think every senator, republican and democrat is going to come to the realization. Politico saying this morning he somebody uses power liberally, and that leaves his opponents red with anger. Chuck schumer and nancy pelosi saying that this resolution is a coverup. Its ridiculous for so many reasons. On the process level, the clinton impeachment in the late 90s, both the house of petri managers and the president s defense team used less than half of the time that this impeachment trial is allotted. 24 hours for each side to make the case. I think thats ample time. Secondly, this is the process where the house should have, before embarking on one of the most grave can dominate constitutional provisions we have come and get your ducks in a row. The reason we are talking about witnesses and that kind of thing on the front end is the house told us they couldnt wait for it, that everything had to move so quickly and get to the senate so fast because the country was in grave danger. Were now obviously rearing a different tune. Ed senator schumer disagrees with you, obviously pray lets hear from him and let you react. He calls it a disgrace. Watch. This resolution is totally departing from the clinton resolution in significant ways, despite what leader mcconnell promised. In the ways it departs, the evidence is less available, the evidence is given in the wee hours of the morning, and may never be produced at all. It is a cover up. Ed speaking specifically about the fact that the findings from the house, unlike the clinton rules, will not be automatically introduced into the senate. There has to be a separate vote on that. Why go through that hurdle . When up with evidence in there and put it on the record . They can obviously make reference to all evidence they found during the impeachment process in the house. The question is when you actually enter it into the Senate Record. There is a time for that. The point of this entire resolution with schumer is trying to blow up a staff and orderly process, do not have the senate become an absolute circus. You give both sides a chance to make the best case they can for that next phase, that second phase when the senate will have to make a bunch of decisions. To decide what questions they feel need to be resolved, what evidence should be admitted. All of those things, the senate will have a chance to grapple with. But in an orderly process so we dont just have a big top circus right from the top. Ed wright, big debate coming, as you suggest, on witnesses. Republican tim scott less that was on with my colleague Martha Maccallum suggesting its not really about getting the truth, its about politics. Watch. The whole conversation about witnesses has nothing to do with impeaching the president. It has everything to do with removing at least four senators from office who are republicans. The subplot to having witnesses before the senate has nothing to do with eliminating the case were bringing more information to the surface. Ed he is talking, as you know, about garden in colorado, thom tillis, collins, mcsally , and its about putting them on 100 right, hes got it exactly right. If it was enough for them to have this, these witnesses be part of the process to make their entire case, they would have done some of the house. But they chose not to. This entire discussion is about taking what they think are going to be difficult votes. I happen to think they will be very difficult votes. I think we will hear the president s team, for the first time, have read opportunity to defend themselves. Remember, we have not had anything but a House Democratic version of events. For the first time over the next couple of days we will be able to hear with the president s team has to say about all that. My guess is, by the middle of next week, itll be pretty clear that House Democrats made a grave error here and presuming impeachment. Ed one of the more moderate public and senators, Lamar Alexander , put out a Statement Last night that i he has an open mind but y not want more witnesses. He wants to hear the presentations. Congressman ratcliffe told sandra a little earlier hes predicting there will be no witnesses. What say you . Im just sort of confused about the hammering on the democratic side. Senatorsenator alexander has it. You shouldnt go into an impeachment process and whine about the areas you can control. As House Democrats you cant go into a Republicanled Senate and dictate the terms of events. Nancy pelosi found that out over the last couple weeks. They should be prepared to present a case, if they think they have one, for impeachment of the president of the United States. I think whats become very clear over the last few weeks as they dont have one, so they have to argue process, they have to try and because political and they have to put pressure on people like senator collins and others to try and feel political pressure. The underlying substance is not exist. Ed you know the senate well. Bottom line, are we going to see this trial ended by the end of next week . It certainly could. It also could go look, the second phase of this is not irrelevant. The questions are going to be real. They are going to have a period of time where people can ask substantive questions. By the way, thats not a onesided affair. Republicans are going to be asking questions, too. Some of which adam sugar is not going to want to hear. This could go on a little while, he could end shortly. Whatever it is, i have absolutely no doubt about the outcome based on the arguments democrats are now making. Because the pattern of spread would suggest that if it got all the way to japan and it got to thailand and he got to taiwan and he got to south korea, theres probably more cases. Heres why because the Chinese Government is confirming cases once they already have symptoms. But, ed, the virus will spread for five days before you even sick. When you get sick you get upper respiratory systems, a cough, a high fever, and he could develop pneumonia. Ed it looks like the flu. Runny nose it can be deadly because people dont have an immunity. I think youre going to see more fear and you are going to see more of this spread. Its very hard to contain it at this point. Ed, sandra, good morning to you. And about three hours they will get going on debate over the format of the trial. Cena Majority Leader Mitch Mcconnell has it so both sides will make their cases this week, and of wood and witnesses would hold until later in the trail. As resolution calls for up to 24 hours for houston kratz to lay out their case. Up to 24 hours for white House Attorneys to make their case, 16 hours for senators written questions. The resolution will be debated this afternoon by house managers and the white house team. A private session as possible if senators wish to debate the issues. House impeachment managers put out a statement saying, a white housedriven and rigged process with a truncated schedule designed to go late into the night and further conceal the president s misconduct is not with the American People expect or deserve. Heres more from one of the impeachment managers about the packed schedule. The idea that we will be arguing this in the middle of the night when most americans will be asleep shows, i think, maybe a hope that they can just get this by the American People, close it down before anyone knows its going on. I dont think thats going to work, but it looks like thats what theyre trying to do. The white house has like they were public in house numbers a service part of the president s team. It sounds like they will consult and do some outside interviews. Some familiar players from the house impeachment battle. We want to just bring the truth to the American People and when they see the truth they will know that this president not only didnt do anything wrong but certainly is doing everything right, as we see with his speech over in davos, switzerland right now. This trial will be most unusual if senators want to debate issues about the trial will be in closed session, kicking the cameras out. Ed democrats particularly upset. Democrats are upset that mcconnells rules would not allow them to immediately put the evidence into the record from the house proceedings. What is the explanation for mcconnells office about why that changed . Well, mcconnells office maintains that a lot of the stuff that was done in the house was a totally partisan process. Totally unfair to President Trump. So the bottom line is he is saying they will have the votes later on admitting certain evidence and information, but lets get to the arguments. Let senators hear from them themselves, and from the president s team, a new wrinkle to this whole thing. Weve heard plenty from the democrats in the house, we didnt get to you for the president s lawyers. As a whole new aspect of this later this week. Sandra what else can you tell us about what we are about to hear from the house impeachment managers just a few moments were now . They are planning to speak to the press. One would expect they will complain about this process, because they dont like what senator mcconnell has set up. Saying basically its unfair to them that they dont want to be arguing the merits of the case at 2 00 in the morning after bathroom breaks and dinner breaks. It could be very well that late at night. One could expect that we may get an argument to reduce some of those hours. Ed, sandra . Sandra mike emanuel, thanks. Lets begin our headliner, senator john cornyn joining us. He serves on the Judiciary Committee and he will be present for todays proceedings in the set of trial. Good morning to you, senator. Great to have you here this morning. First up we are about to hear, we are told, from the house impeachment managers. They are going to take to the microphone and talk to reporters. So what is the message coming from your party this morning as we are about to see this trial begin this afternoon . We are anxious to hear without impeachment managers have to offer. I dont think the facts are particularly disputed. One of the Big Questions is the undisputed facts rise to the level of high crime and misdemeanor under the constitution. Particularly this close to the next general election, asking 535 members of congress to reverse the decision made in 2016 to elect President Trump through this process. I think there are some real questions about the legitimacy of this whole exercise. Ed senator, in terms of democrats pushing for new witnesses, pushing for more evidence, how does that square with House Democrats telling us for some weeks now that this is an open and shut case and that they believe the president broke the law . Well, it strikes me, ed, that they are a little nervous that the partisan impeachment inquiry that is conducted by adam schi adam schiff, where the president and his lawyers were excluded from that process, that they are worried they will be able to meet that threshold that is necessary to convict the president in the senate. Thats why they are clamoring for more witnesses. But in order to accommodate the concerns, we have adopted or will adopt the same resolution that we did during the clinton impeachment, which says the question of additional witnesses beyond which the impeachment managers want to offer initially will be deferred and decided by the vote of 51 senators later, probably later this week, maybe early next week. Sandra you said you were curious, senator, to hear what impeachment managers have to say that if this afternoons trial. We will hear from them personally just a moment, but they did put out a statement this morning. I will read to you from it. If those efforts are successful this is responding to the resolution this will be the first impeachment trial in American History in which the senate did not allow the house to present its case with witnesses and documents. The mcconnell resolution goes so far as to suggest it may not even allow the evidence gathered by the house to be admitted. That is not a fair trial. In fact, it is no trial at all. They are making the case that there was evidence presented in this case after the vote in the house on those articles of impeachment. That is the reasoning for saying there needs to be more evidence and witnesses called. How do you respond to that . Well, it sounds to me that they are in a state of panic and they realize that what they did through the partisan impeachment inquiry that was rushed in order to meet the christmas deadline by nancy pelosi is not up to the standard necessary to convict and remove a president of the United States. I dont blame them for being concerned about it, because this partisan effort in the house excluded the president and his lawyers, and they are going to now have to deal with a fair process that the American People will be able to see for themselves, from gavel to gavel, whereby they will have to meet their burdens of proof to prove that this is a high crime and misdemeanor. What literally is a disputable policy difference. I think this is, obviously, in momentum occasion. A serious, somber occasion. But i dont blame them for being there was that there rushed effort toward impeachment wont meet that standard. Ed s editor, you said this a few times now this morning, that the president s lawyers were excluded from the house process. In fact, as you know, the house Judiciary Committee invited the president s legal team to mount a defense. They chose not to do so. Well, that was after the adam schiff hearings in the scif, in the bunker, that was not available to the American People or to the president s lawyers. They werent able to call witnesses, and testimony was delivered in that 1cited hearing conducted by adam schiff. It was leaked systematically to the press in order to construct a narrative. That is not a fair process where everybody gets to participate. It is not transparent, and i think now they are worried that they have to deal with that hand which they have dealt themselves. Sandra senator, fox news is reporting there is an aptitude among senators to reduce the time periods for the impeachment managers, the house managers, and the president s counsel. And this is according to one source, to the single digits, in order to speed this along. Are you part of that . Would you like to see that happen . Well, i would like to see us do our job, which is listen to the case presented, but it would not surprise me based on what we know of the facts and the lack of any real, meaningful dispute as to actually what occurred. What is disputed is the characterization or the conclusions people want to draw from those facts. But i do think this case could be fairly efficiently presented to the senate, and we could then make our decisions, apply those facts to this Legal Standard in the constitution and do that in a couple of weeks. Again, im not foreclosing the possibility that additional witnesses will be called if they request 51 senators. That right is still reserved. So really dont know how this thing will play out. Ed senator, sander mentioned a moment ago that we will hear in a few moments live from the house impeachment managers. One of the and is hakeem jeffries. He was on fox news sunday, as you probably know, and he said several times, we do not dislike a president. Do you buy that . Do you believe house impeachment managers when they say they dont dislike the president . How much his personal animus a part of this . I think personal animus is most of it. Its clear that from the time the president was inaugurated, january the 20th, 2017, that the impeachment effort was underway. And it was appointment of a special counsel, to create the mueller investigation, which ended up with no charges on collusion or obstruction. This is the next in a series of efforts to reverse the election in 2016. I think its almost complete personal animus. If we succumb to the temptation to convict and remove a president under the circumstances and with the sort of record, this will become routine. On the next time republicans have control of the house of representatives and there is a democratic president , there will be an impeachment effort. I think that would be a travesty for our country and certainly undermine the authority of the voters to choose their president s rather than members of congress. Sandra i want to play a sound of Chuck Schumer blasting Mitch Mcconnells plan last night. It is now certain that leader mcconnell is going along with President Trumps cover up, hook, line, and sinker. Mcconnell repeatedly promised the senators, the public, the press, that his rules for the trial will be the same as the rules in the clinton impeachment. Nothing could be further from the truth. Sandra how do you respond to the minority leader there, senator . Senator schumer is complaining about something which is largely of his own making. He refused to negotiate with senator mcconnell on the rules and resolutions, so that means that republicans, 53 republicans, are going to have to vote for the resolution to set the ground rules up. Senator schumer really wants to hijack the trial. As you know, senators are effectively jurors. Theres a little bit of a difference between civil and criminal cases in a court of impeachment, but our job is to listen to the case presented by the parties, by the impeachment managers, and by the president s lawyers. Not to hijack the trial and orchestrated ourselves pay thats what senator schumer wants to do, and i think it would be wrong. Ed we will talk a lot about impeachment in the days ahead. Wed be remiss to not ask about the other breaking news this morning from the Supreme Court, that they are now not going to take up this case over obamacare. The future of obamacare and the constitutionality, until after the 2020 election. Talk about the significance and how republicans are approaching the 2020 election on health care. Based on what i understand the fifth decided dominic circuit decided to do with that case, the case is not right. Which is typically what judges look at to see what the facts are, whether the record is complete, and they send it back to the trial judge to reevaluate based on its ruling in the fifth circuit. So i think the Supreme Court made the right decision. Theyve got other important cases to decide, and this one is ready for prime time. Ed all right. Senator john cornyn. Sandra if i could come at just one more question for you, sir. We are awaiting those house impeachment managers. They are set to speak, we are told it will be brief. All this is happening with the backdrop of the present traveling to switzerland. Hes an davos for the World Economic forum. He was asked during a bilateral meeting this morning about the impeachment trial that is about to take place back here at home. He called all a hoax, as he has so many times in the past. Put all of this in perspective, as we have the president traveling overseas and all this happening here at home in the senate. Traditionally, differences over policy have ended at the shore of the United States, and we have always supported the leader of our country in a unified effort as the United States dealing with other countries and other leaders. Apparently all of those norms have been upended now. And it is, katie, bar the door. Its unfortunate. We need to show our unities as americans in supporting our duly elected president in the policies he chooses on behalf of the American People to conduct. Obviously all of this thats happening here back door undermines his ability to do that. Sandra more questions as we wait for the child to begin, where do you stand on witnesses being called . Yes or no, that you are in favor of that . Well, i am in favor. 17 witnesses were called in the house, over 100 hours of testimony. All of that evidence will be available to the impeachment managers should they decide to offer that. Like i said, we will defer the issue of other witnesses until after both sides have made their presentation and the senators get a chance ask questions. Sandra got it. Finally, on the initial point i brought up about fox news reporting, that senators are looking to truncate the amount of time that the impeachment managers get in the white House Counsel gets, is that happening . Is an effort to do that . Im sure they would be more discussions about that. I would think the senators running for the nomination for president would like to be for february the 3rd. You might find bipartisan agreement that we ought to get this done and get it done right, but get it done as efficiently as possible. Last night we received for the first time the text of the mcconnell resolution that will govern the trial. We can see why this resolution was kept from us and from the American People. This is nothing like the process that was used in the clinton trial. To begin with and this is, i think, most indicative in the clinton trial both leadership work out a bipartisan proposal for how the child would be conducted. That obviously has not happened here. Senator mccaul did not consult at all. Senator schumer, on the context of this text, i am assuming senator schumer got to see it probably around the same time we did in the house. The reason this was kept hidden is that it does not prescribe a process for a fair trial. The American People desperately want to believe that the senate will give both the president and the house of representatives a fair trial. This resembles nothing like the clinton proceeding. For the first point in the clinton case, if we are truly following the clinton precedents, all of the documents were provided for the trial. Where the 90,000 of them. Does this resolution provide for the president to provide the documents before the trial . No, it does not. It leaves the question of whether the house will ever see these documents, whether the American People ever see these documents, to the end and only the end, with no guarantee this material will ever be shown to the house or to the American People. That is a pe profound departure from the clinton trial. Without the documents, you cant make important judgments about even which witnesses should be called or what questions should be asked of the witnesses when you do. So that is a profound departure from the clinton precedent. On the subject of witnesses, it is also a deep departure from clinton, where all of the witnesses testified before the senate trial. The issue in the clinton trial was not whether they would testify. They have testified already. They been interviewed already. Some of them, dozens of times. The question of the clip in trial, will they be recall . Will he be required to testify again . The question was answered in the affirmative. Here, though, if youre following the clinton precedent, all of these witnesses to testify and should be deposed before the trial begins. Not after the trial is over. This is not at all the model used in the clinton case, as well. This resolution even go so far, and another departure from the glisten dome i could to precedent, to say they wont even admit the evidence that was received in the house. That they are going to postpone the decision over whether it will be part of the record. Finally, they are compressing the time of the trial. Whereas the clinton trial managers had six hours a day to present over a course of days, they are no presenting that we double the amount of time each day so that the proceedings can conceivably go well into the night when, apparently, senator mcconnell hopes the American People will not be watching. This is not a process for a fair trial. This is the process where a rigged trial. This is the process if you dont want the American People to see the evidence. This is the process you use if you want to, handinhand, working in concert with the president , allow the president to continue to obstruct the congress and to deny the truth to the American People. Thankfully, however, we know the truth. The evidence is already overwhelming, and that evidence is that the president abuse the power of his office, without hundreds of millions of dollars of need for military aid from an ally at war, in order to coerce that ally into interfering in our election. And then when he was caught, obstruct of the congress to cover it up. That truth is inescapable, no matter how mcconnell wishes to structure this trial. We will be appealing to the manager we will be appealing as managers to the senate today to live up to the oath they have just taken, to do impartial justice, and to hold a fair trial. And we are happy to respond to questions. Let me add something. I just want to add that this fixation on the clinton precedent is weird. The clinton trial was conducted fairly, but distorted what happened there shouldnt make a difference. The question is, should you have a fair trial now . Any intelligent person knows that in any trial, whether its robbing a bank or subverting the constitution of the United States, the accusers in this case, the house of representatives bring in all the witnesses and all the evidence. The defenders can bring it all the evidence they want. Thats how you have a trial period to be debating, whether you should have the evidence admitted, to be debating whether you should allow witnesses, is to be debating whether you should have a coverup, by definition. There is no other way to look at it. It doesnt matter how it was done sometime ago. It was done very fairly, as it happens, sometime ago. But it doesnt matter. It cannot be used as an excuse. The only reason to oppose bringing a witness is to cover up because you are afraid of what the witness will say. The question before the senate is, do the republican senators want to be complicit in the coverup of the president . Any senator who votes to deny a witness, who votes to deny evidence, is voting to cover up the president s cards and subversion of the constitution. There is no other way about it. There is no conceivable reason to deny witnesses. To say you cant bring in the evidence. The house of representatives cannot bring the evidence. There is no reason. What are they fear . Why will they bring in the witnesses . Because they are afraid of what the witnesses will say. But there is no trial in this country in which he wouldnt admit the relevant witnesses. In which its even a question. Lets go to questions. Reporter [indistinct] that will be a decision that the house should make, not that the senators should prescribe to go late into the evening. Look, there is a wealth of evidence to present here. We should have the opportunity to present the case as the house chooses to present its case, not to go late into the evening when senator mcconnell evidently hopes the public may not be watching. So we will make decisions about how long our case should go, within the rules that are prescribed. I think the question is, what is the senators interest . What is his interest in structuring the trial this way . Is this about hiding the evidence from the American People with latenight sessions . Is this about just trying to get it over with . Because that should not be the motivation here. Senator mcconnell has taken the same oath as every other senator in that chamber, and that is to do impartial justice. Not to try and skew the process in such a way where the house is not permitted to put its evidence before the American People. Reporter are you worried that all this focus on rules and process and what senator mcconnell is doing dilutes, in any way, the message you are trying to put out about what you think President Trump did . No, because this is part and parcel of an effort to cover up the president s misconduct. That was the whole object that is charged in article two of the impeachment articles. And if the senate and the Senate Leadership will not allow the house to present its case, will not allow the calling of witnesses where the presentation of documents, if senator mcconnell makes this the first impeachment trial in history without witnesses or documents, it will not prove the president innocent. It will merely prove the senate guilty of working with the president to obstruct the truth from coming out. And so i do think that, by structuring the trial this way, it furthers our case that whats going on here really is a coverup of evidence to the reagan people. Reporter what would you like to see i will ask my colleagues on that, as well. There are a number of key witnesses that we know even at the outset of the trial should be called. There are people like john bolton and people like Mick Mulvaney, people like Michael Duffy and mr. Blair, and others. But if we are proceeding in a logical fashion, if we are truly interested in a fair trial, the first step ought to be the production of the documents. Those documents will reveal precisely who the most important witnesses are. And they may be those four, and there being be others as well. Let me give an illustration of whats being hidden from the American People. We have Text Messages where highlevel people in the diplomatic corps are asking each other, are we really withholding military aid document and as we talked about last night, i think its crazy to withhold military aid to personnel to get help with the political campaign. They do with the American People to see those documents. We have seen them because cooperating witnesses to provide them. The documents like those are being withheld from the public. That is the kind of cover up that the president is engaged in and the senate should not make itself a party to that. Just to conclude in terms of witnesses, we should review the documents, the house should have the right to call witnesses. The president should have the right to call witnesses. Material witnesses, that witnesses just for the purpose of smearing his opponent. But material witnesses. Thats what makes a fair trial. Let me ask my colleagues who havent had a chance to speak they would like to add. Last question. Reporter how much is it hamstring you to not know which documents will be admitted while youre making your arrangements . Its as if you are on duty duty jury duty on the judge were to come to the court room and say, ive been talking to the defendant, and weve decm not going to let the prosecutor and cody witnesses. Im not going to let them call for any documents. Im only going to let them read from the called record in the grand jury. And even then we dont necessarily decide, you consider that as evidence. That makes it impossible to have a fair trial. Not just difficult, but impossible to have a fair trial. I think for senators who take their oath seriously and i hope and pray that they do this is not the fair trial that the American People want. Its not the fair trial the American People deserve. While all of this drama plays out back here at home, President Trump attending the World Economic forum in dumbos, switzerland moments ago we heard from the leader of the house impeachment leaders, adam schiff, and the lead manager. Ive got breaking news, we are going to go straight to Chuck Schumer now. He is stepping up to the microphone, lets listen in. Good morning, everyone. One thing before i get started on the issue at hand the Supreme Court Just Announced that it would delay ruling on the administrations lawsuit against our health care law. It is a sharp reminder to the American People that while all this important business is going on, the president and the Republican Party is trying to take away americanss health care. Woe is us if they succeed this year or next year. Now, lets get to the issue at hand. As you all know, President Trump is accused of coercing a foreign leader into interfering in our elections to benefit himself, and then doing everything in his power to cover it up. If proved, the president s actions are crimes against democracy itself. It cannot be overstated how serious this charge is. If americans start believing that foreigners can affect and elect president s or senators or governors, if foreigners can interfere in elections and determine the outcome instead of the American People determining the outcome, our democracy is vastly eroded. People will start losing faith in elections and the very wellspring and foundation of this grand and great nation that the Founding Fathers established more than 200 years ago. So, the charges, these charges we are being asked to try. For anyone who says, this is not serious, this is done all the time, no way. This president , it is abuse of power is unfortunately unique and willing to abuse his power with fewer conscious qualms and far more readily and easily than any president we have seen, and by a long shot. And the only power that the American People have when the president abuses power, other than elections, is this impeachment process. We take it very seriously. Very seriously. So, one senator and office sworn in this afternoon, the ceremonial functions at the beginning of the president ial impeachment trial will be complete. The senate must then determine the rules of the trial. The republican leader will offer an organizing resolution that outlines his plan for the rules of the trial, which was only released last night. And amazingly, waited till the very end, and now we see why. It is completely partisan. It was kept secret until the eve of the trial, and now that its finally being made public, its obvious to see why leader mcconnell was keeping it so close to his vest. Because the mcconnell rules seem to be designed by President Trump, for President Trump. Simply executed by leader mcconnell and senate republicans. It appears that leader mcconnell decided to go along with the president s desire to cover up his wrongdoing, hook, line, and sinker. It almost seems that the resolution was written in the white house, not in the senate. The mcconnell resolution is a blueprint for an impeachment trial on fastforward. It asks the senate to spend dumb experts through the trial as fast as possible, and makes getting evidence as hard as possible. The bottom line, leader mcconnell wants t of the process rushed with as little evidence as possible in the dark of nigh. He pushes the arguments into the wee hours of the night so American People wont see them. In the short, again, the mcconnell resolution will result in a rush trial with little evidence in the dead of night. If the president is so confident in his case, why wont he presented in broad daylight . If leader mcconnell and the republican senators who have said hes done nothing wrong, its perfect, why not while the sun is shining . And set it at 2 00 a. M. . It was pretty obvious. Its pretty obvious why not. On something as important as impeachment, mcconnells resolution is nothing short of a national disgrace, and it will go down in history as one of the very dark days of the senate. Not living up to its responsibility. In obeisance to the president , not to the truth. Leader mcconnell promised his trial rules, we heard this for weeks. Lets enact the same rules as the clinton trial rules. He said, we are going to get started in exactly the same way. It turns out the mcconnell rules are not even close to the clinton rules, and there are many places where that happens. Like the clinton rules, the mcconnell resolution does not admit the record of the house impeachment proceedings into evidence. So mcconnell seems to want a trial with no existing evidence and no new evidence. No evidence. We can understand why. Its because hes afraid of evidence. So is President Trump. So are the president s men. A trial with no evidence is not a trial at all. Its a cover up. Second, unlike the clinton rules, the mcconnell resolution limits presentation by the parties to 24 hours per side over only two days. Leader mcconnell wants to force the managers to make important parts of their case and the dead of night. I read the brief. Its about 45 pages. I commend each of you, its a powerful document. Very hard to rebut. In fact, the president s brief doesnt even attempt to rebut it. Next, the mcconnell resolution prohibits motions to subpoena witnesses or documents until after the senators question period. Even then, requires the senate to overcome an additional hurdle by voting to determine whether motions to subpoena witnesses and documents are in order. So weve had some senators say, well, im going to vote for mcconnells resolution, but later i might vote for witnesses and documents. Mcconnells very resolution puts many obstacles in the path of getting witnesses and documents even later. So republican senators dont fool us. Dont say you want to make it easier to vote for witnesses and documents at the end of the trial if you vote for this resolution. It makes it a lot harder. And finally, unlike the clinton rules, the mcconnell resolution allows a motion to dismiss at any time during the trial. Now, we thought that the clinton rules shouldnt apply. That they were unfair to us. Mcconnell kept hugging the legend was this his defense, but we now see that he didnt mean it. What he wanted to do was simply cover up her President Trump. So, starting this afternoon, immediately after leader mcconnell introduces his resolution, i will be offering amendments to fix its many flaws. The First Amendment i will offer will ask that the Senate Subpoena white house documents related to the charges against the president. Those documents include the records of meetings and calls between President Trump and the president of ukraine, as well as those records created or received by mr. Mulvaney, mr. Bolton, mr. Blair, and other white house personnel, about the decision to hold and release the military assistance to ukraine. It is very possible, even likely, that some of these Communications May have been with President Trump, between him and these people. That is why they are so important. No one can argue that these documents are not directly related to the charges against the president and should be reviewed by the senate. The witnesses ive requested ive gotten a lot of attention, and rightfully so. The documents are of equal importance. People should understand that the documents can shed as much light on why the aide was cut off, who did it, and how it evolved as the witnesses. And we feel very strongly that we need documents. Thats why its our first call. I will then offer a series of amendments on the documents weve requested, the witnesses we requested, and amendments to fix the most egregious departures that mcconnell made and has proposed resolution from the clinton rules. Let me be clear we have no intention to be the dilatory. There is no guarantee leader mcconnell will allow these votes to be taking place later in the trial. Now, before any resolution passes, we must do it. We feel this is an obligation we have to the constitution to outline what a fair trial would be. To not go along with the coverup, with the sham trial, and we will do it. We will do it. Right off the bat, republican senators will face a choice about getting the facts or joining leader mcconnell and President Trump in trying to cover them up. This is a historic moment. The eyes of america are watchi watching. Republican senators must rise to the occasion. Senator durbin . Youre not on here. Oh, yes. Think you, senator schumer. From the very first day of the impeachment trial we learned that senator mcconnell, for senator mcconnell, political loyalty to this president was more important than respect for the constitution, the integrity of the senate, and standards of common decency and decorum which have been prevalent in this body from its start. With this organizing resolution, outlining the course of the trial, senator mcconnell and those who enable him demonstrate the republicans believe the American People are not entitled to judge for themselves whether President Trump abuse the power of his office and obstructed this congress and the discharge of its constitutional duties. Senator mcconnell and those who enable him believe that if they hurry the proceedings, restrict the evidence, limit the witnesses, and force the whole enterprise into the midnight hour, they can conceal misconduct by the president. They believe the American People will not take notice. They are wrong. The American People are not asleep at the wheel of this democracy. They are wide awake to any senator or president who disrespects their constitutional duties or claims to be above the law. Donald john trump, the impeached president , insists he is innocent. A victim of a witch hunt. A cruel hoax. Yet, this president is unable and unwilling to produce any evidence or any witness in his own defense. Instead, america is subjected to an endless blizzard of mindless tweets from the white house, and the ravings of the president s trusted legal counsel, the former mayor of new york city. For senator mcconnell and those who enable them, this selfserving foolishness passes for a credible defense. Under the principles of american justice, of course, the accused in this case, the president cannot be compelled to testify. But the mcconnell resolution goes to the extremes of attempting to limit the house managers from introducing into evidence the documents and sworn testimony that were produced even in the house impeachment proceedings. This mcconnell resolution directly contravenes the rules followed in the clinton impeachment trial. As of this morning, a majority of americans are calling for this president to be impeached and removed from office. Even senator mcconnells loyalty to this president and his corruption of this senate trial cannot escape this stark reality. If senator mcconnell has his way, critical moments in this trial may not see the light of day. But they will not escape the light of history. Well, thank you very much. Last week my colleagues and i signed our names in the official Senate Record affirming our promise to do impartial justice. It was a sobering experience, especially since senator mcconnell has explicitly said he would do the complete opposite. He said no to impartial justice in spite of the careful and thorough investigation the house conducted, in spite of President Trumps unprecedented stonewalling, which denied Congress Access to key material witnesses and documents directly related to the president s actions during the house investigation, in spite of the president s continued refusal to provide any credible defense against the allegations against him, including in the trial brief we saw this weekend. And the majority leaders position has not changed despite new evidence made public in recent days, which lays out a complex web of falsehoods and corruption surrounding the president s actions in ukraine. And now, as the trial begins, as new evidence comes out, and after each of us has reaffirmed our most solemn responsibilities to our states and our country, it is clear people across the country are watching this carefully. And they are deeply concerned our president may have demanded a Foreign Government interfere in our next election to help him in his campaign. They want to know all the relevant testimony and evidence is being considered, and the senate is acting fairly rather than staging a coverup. So i would hope republican senators remember that they have a choice. I hope they choose to recognize we cannot do our job as senators to do impartial Justice Without key documents and witness testimony that is so far been hidden from the public. I hope they choose to work with democrats to make sure fairness and honesty is in this process, because that is what the people we represent deserve. And i want to make one more point the president s actions are on trial, but the United States senate is on trial, too. Ive heard many republicans say they want to trial modeled after the clinton impeachment trial. I will remind all of us that at the end of that trial no one doubted the senate had acted fairly and honorably. That is the article test before us, beginning today. To be clear, we will fail that test with dead ofnight, rushedup resolutions like the one leader mcconnell has put forward. We all need to remember the oath we took an act in ways that prove the senate and all of our Democratic Institutions are worthy of the publics trust, now and for generations to come. We all need to vote today for evidence and fairness, not a sham designed to protect and impeached president from the facts. Thank you. Think you, senator murray thank you. Mitch mcconnells resolution is appalling, and so is the defense being put forward by the white house. They dont dispute that there was a phone call with a new young leader in desperate need of support from the United States in his military efforts against russia. They dont dispute that there was a threat to withhold funding on that phone call, if, in fact, the new young leader did not do with the president wanted. They dont dispute the fact that they withheld the funds after the phone call, even though the watchdog for the congress, the general accounting office, has clearly said it is illegal, which they are not disputing either. It seems to me they are using the Mick Mulvaney defense. Yes, the president of the call. Yes, he withheld the money. The president can do whatever he wants. Get over it. No president is above the law, and thats what this trial is about. Questions on this subject . Yes . Reporter [indistinct] look, senators talk to senators all the time, and there are lots of conversations going on. Im not going to get into any individual conversations. Yes . Putter what is your plan, assuming any documents or witness testimony moves forward, if the white house asserts executive authority . Look, if the white house tries to exert executive privilege on an order that passes in a bipartisan way and is signed by the chief justice of the Supreme Court on a subpoena, i think the courts would look very favorably on that. Reporteri will not tell the t who should be his counsel but i respect very much the conflict of interest that was outlined in the letter that the house managers put together. Yes . Reporter during the trial, if you will not be able to make arguments, do you expect house managers to make arguments and you expect them to first, some of the motions or the amendments i will be making to the mcconnell resolution are pretty obvious. Three weeks ago i outlined to leader mcconnell the need for three sets of documents and four witnesses. So the Senate Managers obviously know all about them, and they are a very capable group. They have said publicly theyve been totally supportive of those things that we asked for. So i expect they will make very strong arguments. Theres a lot to say. Reporter [indistinct] its one hour per side, thats the rules. Itll be up to them if they use it all. I would hope they make strong arguments and not try to cut back. Its too important. Reporter senator romney has already said he will support any kind of changes to the resolution that would include trying to get witnesses baked in at the beginning of a trial. I have a great deal of respect for senator romney. I would urge him i hope he has carefully read the mcconnell resolution, because he has always said he thinks there should be witnesses at the end of the trial, and this makes it harder to even get those. You went already wants, im sorry. Try to share the wealth. Reporter it strikes me that House Republicans were very upset with the process, complained about it being rush rushed. We are doing our constitutional job and we are proud of the job that we are doing. It is sort of ironic, leader mcconnell, at the same moments he says the trials rush, seeks to rush the senate trial for more severely than the house trial was. Reporter on the subject of transparency, did you sign off on the rules for the press . What is your comment gnome. My comment, i want to see have the press have as much access as possible. I was not asked about them and didnt sign off on them. Yes . Reporter you to give advice to members of your carcass and how to do with the impeachment trial when in the minority . We had plenty of discussions and we go over the process, whats happening. We have a great caucus lunch every tuesday. Large numbers of members participate, and i would like to believe and i think i do that we sort of come to an amalgam. A lot of suggestions they make, we incorporate into what our caucus view and position should be. So we do it all the time. Reporter is it your position that a vote to ignore or change those rules with 67 votes no, that is governed by the rules of impeachment, which are separate from the senate rules. Nope, you went. We will have votes on the issues i mentioned, witnesses, documents, egregious rollbacks from even the clinton rules that we thought were unfair, but we are not going to try and be dilatory in at 100 amendments just to delay things. Reporter how many . Oh, your persistent [laughter] yes . Reporter [ indistinct] no, we are doing this because we think we have a constitutional duty to do it. We think that this is what the Founding Fathers looked at when they say, how do we do with the president who has abused his power, who has dramatically overreached . Who has gone off track . And they came to the conclusion, you couldnt wait four years. Thats why this is so serious, so solemn, so grave. Thats how we feel. The American Public seems to agree with us. But that is our motivation. That is why even though. Weve asked for, we dont know what theyll say. This idea that these witnesses are democratic plants . They are the president s appointees the documents are written by the president s people. Maybe they will be exculpatory or maybe they will be further incriminating. But we will rest easy if we know we have required the truth to come out. Unfortunately in the minority thats not solely up to us. We need four republicans who are willing to stand up for whats right, who are willing to stand up for what america wants and needs, and not simply bow down to the president s. Most americans with this guy is all about. Do most americans really believe he wants a fair trial . I dont think so. Thank you, everybody. Saying hes going to offer amendments to the mcconnell resolution to fix what he is calling many flaws. His first proposal to subpoena documents, which he says are directly routed to the case. Lets go to Congressional Correspondent chad pergram on capitol hill, whos been listening to all of this with us. Chad . Chuck schumer indicates that he is going to try and have these votes on these amendments. Let me walk you through the structure here. At 1 00 they start the trial, and thats where Senate Majority leader Mitch Mcconnell will propose his base framework for how he thinks the trial is supposed to go down. That is where the managers and President Trumps legal team will then debate this for two hours. Then you go to Chuck Schumer, and we are told he might have the universe and this is reporting that bret baier and i did earlier this morning maybe as large as two or three dozen amendments here. Thats a pretty big chunk of proposals. We then expect a debate then. And after that the senate will go into closed session will they will figure this out. Chuck schumer indicates in one of the first proposals hes going to propound here will deal with getting documents and communications with the white house which he sees a central to the case. He wouldnt say exactly how many documents, but that will be the big debate tonight. They will vote on the final proposal late tonight, guys. Sandra but he did then circle back and said he clearly laid out to mcconnell the three sets of documents and four witnesses that he was requesting. Thats right, and thats been out there for a long time. He says, look, we want to hear from Mick Mulvaney theres been a lot of criticism about Mitch Mcconnell Holding Close to his vest the proposal. Chuck schumer has done that a little bit the same token. Sandra all right, he said dont fool us and told the senators in the senate they must rise to the occasion. Some misgivings about how this may play out. I think democrats are united with the fact that we need to have witnesses, we need to have evidence. Clinton agrees that he committed 11 felonies. The issue here is there is no crime, there is no underlying crime. And the American People will adjudicate this in 11 months. I think washington is consumed with this partisan leverage game of one party hates the other, the other party hates the other back, and thats what you see in the schumer News Conference. I think thats the exact image the president wants to portray and should portray throughout the next couple weeks as impeachment drags on. Sandra its almost interesting how he has taken very few questions on impeachment, were very few questions at all, while hes been in davos. This morning he gave a powerful academic speech. Charles payne said it was the best hes delivered in his presidency. And he has had several bilateral meetings this morning, but he is somewhat quiet on impeachment back here at home. Earlier he called it a hoax, taking one question on it. Ari, so far this morning we heard from the house impeachment managers and referred from Democratic Leaders in the senate. But not a huge response from the white house so far this morning. [laughs] yeah, im not sure itll stay that way. Knowing President Trumps previous pattern, it wouldnt surprise me if he just goes after it on twitter or says something at some point later. I would advise them not to. He doesnt listen. But i just think policy and running the country is his best foot forward, and leave this washington noise and nonsense to others. Thats what impeachment has become. Its become the typical partisan games that everybodys use to and tired of. Let the president rise above. Sandra is all this is happening, you just heard Chuck Schumer, the minority leader in the senate, saying that he is going to come up with something to respond to Mitch Mcconnell and his resolution. Talking about more documents being subpoenaed, witnesses being called. What do you think we will see unfold as this resumes this afternoon, ari . I think we will continue to see the typical gamesmanship and maneuvering that washington is known for. I have a hard time seeing a principle anywhere in sight. They switch roles. The house or republicans complained bitterly about the process, now Senate Democrats in the minority are complaining bitterly about the process. The only thing that really matters is getting beyond this because its a complete waste of time. And there is a remedy in our constitutional system when people feel this deeply about something. Its called an election. Absent of crime and ive seen no crime committed by the president you saw these problems where one said the other did wrong, and the president s defender says he did right. In the course of the election with the American People decide, not elected individuals in washington, d. C. Thats why i think the senator frankly, this is a whole waste of time about rules that in the end do not matter. Nobody is going to remove the president from office other than the American People, or he will get reelected. Lets wait until november. Speed whether or not witnesses will be called, mark meadows, who has been deployed as part of the president s defense team, said this morning that responding to the allegation that no witnesses called means this is a coverup on the part of republicans. Here is mark meadows. You continue to hear a cell from Chuck Schumer, how this is a coverup, how actually things are not going the way that he wanted them to go. I can tell you, when we were in the house, it was an unfair process there. Where we are democrat senators . They were on the senate side at the senate lunch room sipping lattes, congratulating themselves on an unfair process. Sandra ari, is there any possibility that both sides can be appeased by what gets decided and how this all plays out in the senate . I dont rule that out. I dont rule out that ultimately after all this noise and maneuvering is done in the next day or two and we begin the actual impeachment trial that a small group will rise up and consent to have a following three witnesses come by. I dont think at the end of the date matters much. The outcome will be the same. If they have three witnesses who are relevant, fine. If they have no witnesses, fine. I think a small group could come to that in a few days. But first Chuck Schumer has to beat his chest and get this off of him, and act like House Republicans did. When it was in the house, we had secret hearings where republicans got to pick no witnesses and when they had republican hearings they didnt get the witnesses they wanted. They were given the witnesses the democrats told them they could have. Why is that fair, but this isnt fair . That is why when you are in the minority, you are in the minority, the majority rules. The fact is that all of those congressmen have been living and breathing impeachment for the last few months. They know the facts of the case, they know the arguments the democrats are likely to deploy. From the president s perspective, this is a talented team of knowledgeable people who can advise the lawyers behind the scenes of what types of argument they can anticipate, what facts they met want to introduce in order to rebut some of the arguments. Its really an opportunity for the white house to seize their cumulative knowledge and expertise in fashioning the president s defense. Ed that some of the messaging, the politics of all this. But the legal stakes you know better than many. The fact that Chuck Schumer is now revealing just this hour that he plans to start this trial off by starting to subpoena white house documents. What kind of delay might that lead to . To be know the white house is likely to invoke executive privilege and send us to the courts . How might this play out . I dont really see this delay in the proceedings at all. Senator mcconnell has been crisp and clear about his intent to move this thing forward. I dont think he will allow senator schumer or other democrats to derail or delay this proceeding. I think from senator schumers perspective, this is about p. R. Its about bringing the drum saying you need witnesses, this is a coverup, that sort of thing. I dont think senator schumer thinks its likely they are going to be able to get approval for witnesses at the early stage of this trial. Senator mcconnell has said this is a decision made later on.
