He was revered in the state senate. Cynthia hurd was a local librarian and lifelong member of the church. Governor nikki haley visibly distraught. We woke up today. And the heart and soul of South Carolina was broken. So we have some grieving to do, and we have some pain we have to go through. Parents are having to explain to their kid how they can make a person feel safe and thats not something we ever thought we would deal with. I think there is a tremendous sense of relief that the suspect is in custody. There was a lot of fear that night that the gunman was still on the loose. Reporter a lot of conflicting reports. But we learned he was a loner guy. He didnt have a lot of friends. He lived with his mom in a log house near the forest in a swampy area. Church with a rich history and wellknown, a prominent beloved black church and perhaps that has something to do with it. Martha he lived with his mom. In terms of the people of charleston they have not had to deal with anything like this in the past. How are they coping . I think there is a tremendous sense of unity and solidarity in the community. People are banding together across racial lines. Just have much its a tremendous loss as a community. Oddly enough it came on the eve of the 8th anniversary of a huge tragic fire that killed 9 firefighters back in 2007. The community has dealt with a lot of the tragedy and challenges in the past but that usually brought us closer together. But state are the primary criminal prosecutors and Governor Haley made it clear South Carolina is going to prosecute this case. As one who has been in South Carolina courtrooms, they are well suited to bring swift sure and complete justice in way many states around the country are not. Bill why would that be the case . Its a no nonsense he state compared to some other states. South carolina is not massachusetts. They have clear and rough criminal justice for people who behave in this fashion. They have the Death Penalty. The Death Penalty is real in South Carolina its not a phoney Death Penalty. South carolina courts are the place to bring this person to ultimate justice. There is guidelines on this at the Justice Department. One of the circumstances is when there is inpad quasi of the state law after an acquittal, for example. Thats why you saw in l. A. With the rodney king case the police were prosecuted by the fed because of an ultimate acquittal. Unless this guy is deemed insane which hes not base was plotting and premeditating this act. There will be complete justice in South Carolina. So the federal governments basis for entering into this case will not be present in this case in my opinion. Bill does that mean the department of justice does not have a role . They have a role and can do their investigation. But using traditional standard the Justice Department has used for decade, they will let the state prosecution take place first. South carolina will deal with this evil person much quicker than a federal court would. Bill you have been critical of the department of justice based on race in the past. But not in this case. If there was ever a reason to enforce federal law its in this circumstance if he escapes state justice. If you have a person who goes into a church and makes statements as he did say can he was there to target black people then killing them. I cant imagine a set of facts that more justifies federal prosecution if a state prosecution fails than this case. This is our typical civil rights case where people are being targeted because of who they are and frankly because they are worshiping god. Obviously its an incredibly tragic event and if possible our political reaction to such events make them even more tragic. Whether its a cop shooting in new york or a cop shooting, the, i think the president has moved on to gun control which is his preferred remedy. I dont think there is evidence that actually works. He has moved to what hes good at which is comforting and reflect on Something Like this. Hes not good at convincing people who disagree with him to come with him on this particular legislative plan. Martha the president himself in those comments yesterday said he doesnt think there always political solution in terms of gun control because its been tried and it doesnt move forward because there are too many people who dont want to see that happen. So why at this point is it wise to blame the gun and is there any law you can couple with that would have stopped this particular person from getting his hands on this lethal Deadly Weapon . I think what you saw was obama the leader and obama the man. Part of that in terms of being the man is the resignation and frustration they have attempted policy of many different types not just gun control that havent happened due to the partisanship and poll nicks the nation. In his term its not going to happen. In a call, something needs to be done. What he was highlighting is a fact and thats other industrialized countries we have the highest gun violence rates and are among the tops in terms of gun violence. These are people who do have guns but have much tighter restrictions on them. That is a policy. I dont know what law you are going to put in place that will prevent this scenario in this country. I think its the frequency. We are seeing in other cases there were young people or adults that got their hands on guns legally and by lawful means had them that had criminal record or unlawful situations in other countries, would have been unlawful to have a gun. Everybody sort of starts talking about that. The conversation goes there. But when you reanalyze these situations very often there isnt any law on the books that would have prevented the sea theirio. We talk about Mental Health in these scenario and that conversation always seems to disappear. Because its a difficult conversation. The fact is somewhere like connecticut where the tragedy of newtown happened there were plernty of gun laws in place and a socalled assault weapons ban in that state. Yet the plan was to do the same thing nationally which i dont think was going to solve any problems. Post Virginia Tech there was a widely agreed upon path to share Mental Health information so you could stop transfers of guns and purchases. Guess how well the state and federal governments have followed through on doing that . Not so well. They are clumsy and incompetent. I agree with Mary Katharine that Mental Health is a fundamental component of this. Obamas more important point was about partisanship and the ability to make practical things happen that do involve Mental Health as well as looking at our laws. It may be statistically it happened here more because of the kind of society we are we have a lot of different culture living here together. Though anyone is a bad thing and crime in general is not going up even in a time of economic disadvantage over the past couple years. So those are not terrible signs for america. There are reports this morning which i find really so stunning and awful that he may have told the police he thought twice about it after being in the room because the people there were so nice to him but he felt he had to carry out his mission. Talk to us we had so many discussions about race in the country over the past severaling months. Your thoughts on that . Several i think what you are capturing is a perfect example of the way there have been leaders in the black and White Community at home trying to do what they can do or what each one of us can do with regard to race relation. You had a black bible study welcome in a young outsider. I think it says a lot about Race Relations and the way people are trying in different capacitihat are you thoughts on the gun issue here . I think it is premature. I think a lot of people the nature of tragically of any tragedy and people use it to advocate that which they believe in. There are people on all sides of the debate. I dont think this is the time nor the place for that debate. We have not buried the nine folks who tragically died a little more than 24 hours ago. I served with Clementa Pinckney, he was the pastor here, i was governor for eight years and he was a state senator during that entire time period. I think it is important to pause as each individual has been doing in front of this church for us as a community to do that and friends and family who has been forever impacted to pay homage to the lives welllived but cut short in this incident. I think that is great, council. I think we need to pause and put the focus on the victims whose pictures we showed on the screen. What a smiling, bright group of people these are. It is such a loss. He has not succeeded in his mission because he didnt divide the city. People seem to be doing exactly the opposite congressman. That has been incredible. It gives you goose bumps. So the news of the hour, fox news confirm dylann roof has confessed and is being charged with nine count of murder and one count of fire arm process possession. He is in court for a bond hearing. We have a criminal defense attorney and fox news analyst here. Good morning to you. First on the charges what do we need to understand legally . There is certainly going to be swept off the Defense Attorneys are saying hold the horses. He may have confessed but we need to know the questions asked, if he was advised he could have a lawyer and if he wasnt advised the confession is out the door. We dont know if there are other factors there. We have the report he confessed. That is why when the Defense Attorneys step in he is going to have a Court Appointed tax reform, and they will take a part the confession and say if he wasnt read his rights it is out the door. He was only 21 was he told he could have an an opportunity . Frankly, when he has a bond hearing the judge is going to say he is a flight risk. He was 200something miles away from the church at the time when he was swept up and arrested. So frankly it is going to be unlikely he gets bail if he does it will be a large amount. A huge amount. I dont see that happening. What happens at the bond hearing today . What do we expect there . The judge may ask him about the specifics of the fact he pled guilty but certainly asks if he understands when he gave his confession if he was represented. They will talk about him being a flight risk. We heard from the governor how serious it is going to be taken in regard to federal and state charges. South carolina doesnt have a bias language in the state statute. What does that mean . It means there is a hate component to the murder charge. 44 of the states have a bias language where you can have circumstances in the event you can establish the murder or the crime arose out of bias. There has been evidence we have heard or allegations we made statements that were bias in nature it has been reported by some of the survivors inside the church. Will he speak at the bond hearing . Unlikely. It will only be through the attorney. Your reaction on the governor coming out saying he should die for this . I am not surprised. How incredibly tragic. These people were executed in the house of god. Whatever faith you practice these individuals were sitting there praying and he was sitting there and allegedly playing along with them and knowing in a moments notice he was going to execute all of them minus one saying i will keep you alive so you can keep talk about it. I am certain the prosecutor is going to have the Death Penalty raised. Who knows if it goes to trial. The defense attorney may come in saying we will plead guilty to the charges but you have to serve life. We had a guest on last hour who served as an attorney in charleston. He said the Justice System in is South Carolina is known to be efficient. Does that have an impact on if it stays in the states hand or federal level . There could be companion cases. The fact you were prosecutored under the state doesnt mean you cannot be prosecuted under the federal statutes as well. If it is efficient and quick they will say we cannot have a fair trial here.
