Certain high profile democrats, to chelsea clinton, hosting rallies, a confirmation from Brett Kavanaugh will mean the end of roe versus wade and legal abortion in america. What is your response . It is one of the key issues, one of the key rights at stake. On the one hand you have the conservative base promoting Brett Kavanaugh as someone who will meet his litmus test of overturning roe versus wade but when you see the way he is being marketed to moderate republicans and moderate democrats who are pro choice they try to say he is keeping his mind open about the issue out of respect for precedent. Trump is trying to have it both ways but it cant be both ways and the issue could not be more at stake here because Justice Kennedy who judge cavanagh would replace was the fifth vote on meaningful abortion rights. Whoever takes his place will be the deciding vote on that issue. Justice kennedy was the swing vote on the court. Let me ask specifically when it comes to Brett Kavanaugh, he has not especially said he opposes abortion rights but i want to read a statement of the incentive in 2017 where he said this in regards to an undocumented immigrant seeking legal abortion. He said the government ignores its interest in favoring fetal life, protecting the best interests of a minor and refraining from facilitating abortion. With the language used in that dissent it is a reasonable conclusion he feels a particular way about legal abortion so are they right to be concerned . Absolutely. What he has written about it, the sentence you read in the opinion is very concerning, americans who support the right protected in roe versus wade. In that case the undocumented young woman met the stringent requirements of texas law to obtain an abortion. It wasnt going to cost the government anything to obtain the abortion, exercise her right to choose but Brett Kavanaugh would not have allowed her to exercise that right and that is concerning because you can overturn roe versus wade operate or got it so there is no meaningful access to the rights to abortion. A general question, a lot of people are saying, this phrase has been used a lot, it is settled law but what we know historically as many settled laws have been revisited and to your fantastic point not necessarily overturned per se on its face but redesigns to have less impact and sometimes no impact but what is your response to the notion of settled law in the United States of america . We all have to look back at the experience of neil gorsuch who said in his confirmation hearing last year that he would respect precedent but in his first year on the court he repeatedly ruled to overturn precedent including in a union case that reversed precedent since 1977, the Supreme Court has the last word on the meaning of the constitution and the meaning of the law. They really can overturn precedent if they think it is wrong. The real question for Brett Kavanaugh and what he should answer substantively is what he thinks is protected in the constitution and what equality and liberty mean in the constitution and not just get away with using a platitude of i respect law. A final question about Second Amendment rights, via gun control so we know Brett Cavanagh wrote the dissenting Dc Circuit Court opinion for precedentsetting and historic standards very, gun control, and essentially in it he said regardless of some concern about Public Safety in 2001, semi automatic rifles were protected by constitutional protection and ultimately the Supreme Court did agree that it was overturned. We are not just talking about whether he will be a conservative, we know he will but what shade of the conservative will he be . Extremely conservative . While the Supreme Court majority did agree there was an individual right to have a gun Second Amendment that he would go even further and the majority of americans agree there is a constitutional right to have a run for selfdefense in the home but they also think reasonable gun regulation can exist and from what Brett Kavanaugh has written im not sure what most people agree and what Justice Scalia would agree is reasonable gun regulation would get through. We have a decisions this week but a long time coming, going back to 2016 where 13 congressional seats and the gop got 53 of the vote but a whopping 10 of those 13 seats because of the way districts were drawn. Speak a little bit about that point and the fairness of the timing. The federal court since the 1980s, this was the republican legislatures do over. There first plan adopted in 2011 with earlier struck down. This has been struck down. It is very unlikely new districts will be in effect in 2018. It will be in effect for 2020. The two republican incumbent trump was there for have real races on their hands even with the districts, Kathy Manning from greensboro, and charlotte, dan mccready is very much in that race. The republican opponent beat the incumbent in a primary, and establishment incumbent. This is a republican who is seen as marginal in the past. Eboni to some peoples surprise even the winners of this case, the plaintiffs here tend to agree with the president. They say it would be disruptive and counterproductive to enforce the new redistricting model. Any response to that . They bring this up with less then or just about 60 days before the election. It is important to note that the plaintiff did file the brief and told the judges, the 3 panel judge that they dont want to see any effect, the panel is not bound by that. Past North Carolina, 40 seats republicans are trying to maintain to keep that majority. How do you see that playing out with how extreme the politics of not and particularly at the congressional level. At least from my perspective, the flyover states many people dont pay much attention to. We believed, more seats in the house and the economic boom that was spearheaded by donald trump with lower taxes and tariffs, less regulation continues when the economic boom is going to be here. They will not be congressman we are electing, they will be trump republicans.
