>> reporter: by the way u.s. security department officials say that no u.s. personnel were injured in that attack, that all u.s. consulate personnel have been accounted for. that again according to state department officials. as you mentioned, three people died several others were injured when that car bomb exploded outside of the u.s. consulate in erbil and at this point isis has taken responsibility for the attack. erbil is located, by the way, in a region in northern iraq largely controlled by isis. remember, mosul is just to the west of erbil and that's still controlled by isis. but kurdish security forces with help from u.s. coalition air strikes have pretty much insulated the city from isis militants. that car bomb attack in erbil was not the only one in iraq yesterday. another car bomb went off this one in baghdad. it was a massive explosion killing 30 people and wounding an estimated 150 others. you can see the damage and destruction. it was an absolutely horrific and massive explosion. all this -- and it happened in a busy market nonetheless. all this as the humanitarian crisis, we have been talking about this all week continues to the south in ramadi. thousands of people we have been seeing have been fleeing that city as isis militants have tried to move in. they're on the outskirts controlling some of the villages. those people packed up their vehicles, anything and everything that they can carry. to give some perspective about the areas that we're talking about, because it can get a little confusing, if you take a look, ramadi is located just west of baghdad in what's called anbar province. to the north is tikrit, where a major battle has been going on between iraqi forces and iranian-backed shia militia and isis for control of tikrit. above tikrit is baiji. that's where iraq's largest oil refinery is and there has been a bloody type of war for control since june between iraqi forces and isis militants. but iraqi forces at this point, according to officials, this came out today, have reportedly secured the perimeter around the oil reserve so this is a major development. general martin dempsey of course, chairman of the joint chiefs of staff, said yesterday that baiji is a quote, unquote, strategic target because controlling baiji and the oil refinery means controlling iraq's oil infrastructure to the north and to the south and if isis was to take control of that, that means isis would not only control the flow of oil but also make money a ton of revenue, off of selling that oil and of course, continuing to fund the terror group's operations. julie? >> thank you so much for that report. kelly? meantime, in afghanistan another deadly isis attack taking place there. at least 35 people are dead after a homicide bomber on a motorcycle targeted a crowd of soldiers and civilians outside of a bank in jalalabad on payday. authorities say another 125 were wounded when the terrorist drove into that group who had gathered at the bank to receive their monthly paychecks. afghan officials say isis has claimed responsibility for that attack. a positive step for the army thanks to the smaller u.s. presence in afghanistan and iraq. the army says it will now shut down 10 out of 25 warrior transition units. the facilities specialize in treating and rehabilitating soldiers injured on the battlefield and returning them to duty or easing their return to civilian life. army officials cite a much smaller number of wounded warriors returning home for the decision. we turn now to washington and the growing tension surrounding this stalled nomination process of attorney general nominee loretta lynch. her fate has rested in the hands of the senate since she was nominated in november of last year. despite pressure from the president and even some republicans, a full confirmation vote may still be weeks away. elizabeth prann joins us with more details. >> reporter: president obama making an emotional plea to senators asking for the confirmation of attorney general nominee loretta lynch. >> enough. call loretta lynch for a vote. get her confirmed. put her in place. let her do her job. this is embarrassing. >> reporter: for months, the vote has been suspended in congress after her january senate judiciary committee hearing. it's become a barringgaining chip for an unrelated issue. mitch mcconnell says it's on the docket after a vote on an anti-human trafficking bill a bill stalled by democrats who oppose anti-abortion language in the legislation. some republicans such as white house hopeful jeb bush say it's time to move on. >> look, i hope the longer it takes to confirm her, the longer eric holder stays as attorney general. look at it that way. >> reporter: a number of senate republicans do oppose her nomination. whether it be supporting the president's stance on immigration or civil asset forfeiture. >> loretta lynch confiscated over $100 million worth of people's stuff with no conviction. this shouldn't happen in america. i'm part of a movement and part of a bill that says we will reverse and turn justice back the way it should be that in our country you should be across the mediterranean. an estimated 200,000 people have arrived from libya alone just since the start of 2014. obvious frustration building in the white house over the stalled confirmation vote for the president's pick for attorney general. loretta lynch's nomination has been stalled in congress for six months. that is a record. democrats are demanding a clean vote but republicans, they've got issues which are holding them back. linking the vote to a human trafficking bill which has also been held up by a fight over abortion. so what happens and what needs to happen next to get this confirmation vote to the senate floor once and for all. penny lee is senior advisor for the public affairs firm and former senate advisor to harry reid and guy benson is political editor at townhall.com and fox news contributor. all right. first of all, let me just go to you, penny. democrats are very quick to accuse republicans of stalling this and they are pointing to the fact that we're talking about a woman an african-american, the first, who would be nominated for this position but it's not about that. there are so many larger issues right now that are holding this up. immigration, obviously, is key because the amnesty bill that president obama wants to push forward to allow illegals to stay here and work legally in this country is a huge sticking point for republicans. loretta lynch agrees with him. what is the holdup? >> the holdup is mitch mcconnell. when he ran last time he said we are going to do things differently in the senate. he criticized harry reid over and over again for quote unquote sitting on over 300 400 bills on his desk and not even allowing them to a vote. now you have a competent, capable woman who is nominated to serve as attorney general. you have five members of his own party, you have jeb bush presidential hopeful from the ying it is now time to have the vote. so you have the blockage really is in one man mitch mcconnell. he has chosen to obstruct rather than govern. >> but guy, lynch's nomination obviously linked to president obama is controversial in the fact that the executive amnesty stance remains and that is a huge problem for republicans and for many people in this country, including by the way, legal immigrants. now during her confirmation hearings loretta lynch said illegal immigrants have a right to live and work in america. is that what is holding up her nomination and not the democrats' spin on republicans holding back a woman from doing her job? >> yeah. there are lots of dynamics here. i think it is important to point out as you did that those dynamics would be exactly the same if this guy were named larry lynch and he was a white man. the politics would be exactly the same here. now, there are two separate issues when we're debating the lynch controversy. the first one is should she get an up or down vote. i believe she should. so does mitch mcconnell and the republicans. they made it very clear the moment the democrats stop filibustering a bill to stop sex trafficking, an anti-sex trafficking bill which they filibustered five times when they give up that radical endeavor, then the republicans will allow a vote on loretta lynch. i think that should happen immediately. it's pretty embarrassing frankly that it hasn't happened already. the second question is should loretta lynch be the next attorney general. i think that her resume is very impressive. i think it's clear that she is qualified to be attorney general. but as you say there were some answers that she gave in her confirmation hearings that give a lot of people pause and there's a lot of immigration politics tied up in this related to the president's unlawful power grab. so let's have a robust debate on loretta lynch. let's have an up or down vote just as soon as the senate moves forward and helps victims of sex trafficking which i think is a reasonable tradeoff. >> okay. but penny, when she finally is nominated, and this is not to discredit loretta lynch because there are several gop members that believe that she is extremely qualified for the job and they don't question her ability whatsoever. she is extremely qualified. she is a smart woman. when she steps in when it comes to sex trafficking, for example are president obama's liberal stances on immigration going to get in the way of sex trafficking? i would hope not. >> i hope not either. she said look, she has been nominated by someone and you would expect, and i'm not sure whether republicans were expecting her answers to be otherwise, but she is as you said and as guy has said, she deserves an up and down vote because she is competent because she is capable, and because the justice department needs a leader at this point. right now you have somebody with eric holder who is a little bit in the lame duck situation. the department needs a leader and a confirmed leader. mitch mcconnell has decided to stall this for six months and now he says it's the sex trafficking. next thing it will be the iran vote on sanctions. then it's probably going to be something else. it is time for this nomination to be voted on. >> vascular and finally stroke and everything else. so you are absolutely right. you don't know how much salt and calories and the fatty food and the saturated fats are in these meals. and base on this what we're finding out is high blood pressure, which 7 million americans are effected by this. it is not just elderly disease. young students and the college aged are now coming one the high blood pressure. >> and we should be sounding full alarm on this. >> this is a very important one because it is one of the few studies that correlates high blood pressure with what's going on in our diets and also these restaurants. now we have the common society of speed and stress and we don't have time to really go out. a tremendous amount of time needs to be spend to cook and so as a result we're getting whatever we can fast. and now the amount of salt that is here it is a lot and it's too much and it causes pre hypertension in about 27% of college students. that is just ridiculous. it's setting you up for a lot of disease. and between male and female sexes, do you know who was more in trouble? >> i'm guessing the female? >> no. you're wrong. it's us. >> good try kelly. >> just trying to give men a break there. >> 49% uses have 39% women. >> how is that? a lot of men especially in college are physically active and sports and everything like that. >> they looked at the amount of food they eat, the time they are out there and eating out. and a lot of them are going out about 12 times a week. that is part of the problem. you can work out and do the exercise but you are pumping in the calories and salt. and you are going to get into the trouble. >> it's a way of socialization in america. so what are you recommending quickly. >> i think you should watch what you eat. you can go out and eat but i've always said. look at you plate. when you see multiple colors then you are in good shape. red green, yellow, and other things you are in good shape. if you see just white and black. that is a lot of carbs a lot of the rice, a lot of meat and you are in trouble. moderation is the key. you can always have some steak. in fact i'm taking my son out tonight for a steak. so i'm guilty of this. >> full disclosure. >> once in a while is fine. but in general just a balanced diet. and -- >> fish? >> fish is always a great thing. style lifestyle changes. and watch what you eat. separate from the pack and the rivalries that could be taking shape already. plus australian police making a the major terror bust. what the suspects were planning this time. >> and oil prices are still way down. but could the warmer weather also raise the cost of filling up? we'll tell you. first we begin with this. president obama keeping the door open for sanctions to be lifted immediately for iran. the president is saying he wanted to leave it up to the negotiators to do their work and steer clear of pushing to keep sanctions in place until iran made steps in the right direction following any deal. in the meantime some republicans are taking a stronger stance suggesting that if iran doesn't cave we should skip the sanctions and keep military options on. peter is live with more details. what has the reaction been to the president's comments yesterday? >> a lot of surprise here in d.c. that president obama is not ruling out just letting iran get its way and supporting the lifting of all u.n. sanctions as soon as a deal gets done if a deal gets done. i think that goal of having in reserve the possible of putting back sanctions in the event of a violation, that goal can be met. and it will require some creative negotiations by john kerry and others and i'm confident we'll be successful. >> and further more the president is zmisdismissing talk from iranian leaders who saying that americans are lying about the terms of the deal with some even going so far as to say death to america. president obama at the white house says he thinks that is just political posturing and that things will cool off at the final handshake. >> as you know so many people are concerned about hearing that chant "death to america" so whose sounding the loudest alarm about caving in? >> the loudest has to be the israelis, who as soon as a footwork was announced the russians had an announcement of their own that they are going to sell ballistic missiles to iran. >> fundamentally run, morally wrong to sell sufficient sophisticated weapons to a country like iran that supports terrorism and tries to become nuclear state. don't forget this is the most dangerous fanatical regime in the entire world. >> republican senator mark kirk adds to that that if there are no more sanctions the iranians are going to have access to billions of dollars that he says will be used to finance terror attacking. >> and as you know that is one of the major concerns out there. thank you sir. iran meanwhile is also trying to get what it wants in yemen. the president criticizing for sewing the seeds of the hatred. this as the saudi led coalition continues its aerial led campaign after iran backed rebels take over government buildings and pubbed out the country's president. one cease fire plan has already been rejected. >> and place in australia say they have arrested five teenagers on suspicion of plotting a terror attack on police. authorities nabbing the suspect this is morning in melbourne. according to investigators, they were planning to target officers at a veterans ceremony later this month. and also say they have found evidence indicating the teens who are all between the ages of 18 and 19 were inspired by isis. >> these individuals arrested today are not people of faith. they don't represent any culture. it is not an issue of how you pray or where you stabbing two police officers. now to the growing ranks of republican lawmaker vying to be the next president. today more than a dozen declared and potential gop hopefuls are gathering in new hampshire at the first in the nation leadership summit. and they are calling out hillary clinton. carl is there with the latest. >> reporter: 21 11 canadadidates are here. there's never been any kind of gathering this big in new hampshire in the primary season like. this it's really a measure how wide open the race is. all the polls show jeb bush or scott walker are in the mid to high teens and others are in the high single digits but within five or six points so it is very close. and that's what makes this summit so important. we heard a little while ago from carly fiorina. she's very effective o at criticizing hillary clinton and she points out she's a woman running in the republican party and could potentially be facing up to hillary clinton. and she made reference to a businesswoman in texas a ceo who has suggested herself that hormones can be a problem for women in the corporate bedrooms. and carly fiorina made reference to that. watch in. >> i was asked this morning on fox news whether a woman's hormones prevented her from serving in the oval office. not that we have seen examples of a man's judgment being clouded by hormones, including in the oval office. >> a not too subtle reference to bill clinton's scandals in the white house with monica lewinsky back in the '90s. something everybody talks about in both parties. it is sometimes referenced to in the name of jeb bush, one of the republican front runner os guessing that his dynastic polls could be a drag. and we also heard from rand paul. only three republicans have already gotten into the race. paul, cruz and rubio. and in paul's case he has a difference in foreign policy in particular. he's been accused of being isolationist. he talked about that today and fired back at republicans. watch. >> the other republicans will criticize the president and hillary clinton for their foreign policy. but they would have just done the same thing just ten times over. every one of the ones who will criticize me wanted troops on the ground. our troops on the ground in libya. i think it was a mistake to be in libya. we are less safe. jihadists are a swimming pool now. it's a disaster. we should have never been there. >> this is about the third or fourth cattle call taken place between iowa, new hampshire, south carolina since the beginning of this year. in the 20u 12012 campaign with romney. he had to go through 25 debates in the year preceding the election with fellow republicans. they didn't like that so i the decided to trim it down to as few as 8 or 12. in their place will be these cattle calls. this is just going to be a stream of speeches. and you can bet we're going to have one just about every other weekend until the election. >> first it was tucker carlson this morning talking about the female ceo that made those comments about female hormones. >> right. >> but obviously they are going to take it all out of context. and i just have to set the record straight. >> i said going in this is a story that was initiate birthday awoman in texas a businesswoman a ceo who herself said that. >> right. >> sure. and mrs. fiorina has been hit with a ton of questions, arguably under the category of sexist. people ask all the time. since you are a the woman doesn't that mean you are going to be a running mate. she's already said she's interested in running for president. since you are a woman isn't that better that you could go up against hillary clinton. and some say all republicans would be better than hillary. >> we don't want those liberal skiing in the colorado rockies. let's look at the radar. into the southeast and mid atlantic on monday. far reaching system that will bring quite a bit of severe weather. overnight tonight and into tomorrow. there is the severe threat this afternoon. from texas all the way up to the central u.s. and then in towards the southeast the mississippi river valley tomorrow, enhanced risk of severe storms here, including tomorrows and into monday then the heavily plated region the southeast in the mid atlantic. you saw the rainfall, in some area, 6-10 inches plus already. that is going to cause flooding concerns as we expect more rain in these areas over the next several days. keep that in mind. the highs saturday. might want to point out here julie 77 in new york. reaching a high of 78 >> well hillary clinton is still undoubtedly the odds on favorite to capture the nomination for the democratic party. but with that said now what we're finding out is the deb bee wasserman shultz is promises we are going to have to debates. and she is going to be put on stage with democratic primary opponents including people like jim webb or martin o'malley or bernie sanders. and the only thing a this happen in this a situation like that is the hiry hillary has to prove her street cred with the left. and it could potentially damage her going into the election. >> yeah she may have some problems there. >> absolutely. and we've seen it play out this week. look where hillary's already gone. she's already tacked to the left on a bunch of issues. now supporting driver's licenses for illegal immigrants. this is a new position for her. she's changed her position on this and the is being called out on it. and also supporting -- hedging on the question of whether we should have a transpacific trade deal. meanwhile the rest of the democratic party screaming no we shouldn't. people like martin o'malley saying no we shouldn't absolutely not have this. and runs the risk of really losing supporters of his base like unions who have been always classically supportive. and now you have some losing their minds and not sure where they fall on this. and that is not a good thing. >> in sthe waffles and people begin to say hmm, what is going on here with the clinton camp. i got to ask if some of this being pushed forward by the obama team? >> it's possible. you have joe biden of course who the obamas seemed to have a helped a tremendous amount. he's done everything the president asked for them and they don't really throw him a bone. it seems they are supporting hillary. and the certainly there is going to be a lot of democrats. whether you see them in public or in private who are going after hillary. here is the key point. when she ends up on station with an avow -- she has no other choice but to tack to the left. >> this kind of blood letting and who leaves the blood on the floor of the hillary clinton. o are does she really want to support clinton in moving forward. >> the democrats don't want to damage hillary clinton. at least the democrats who aren't running. they want to make sure democrats win. and people are going to look back and go how much did she contribute to this effort? ? so she needs to make sure in this process that the hillary doesn't get damaged. i'm not sure how she does that at this point. hillary is not satisfying left enough for many liberals running against her. and they are going to take it out an her. and she voted if for iraq war. out of all the candidates announces she is the only one. not a popular item on the left. >> and the gop contenders watching all this. what will they gain by this in seeing this happen? [ male announcer ] that's how we run, and nothing runs like a deere. ♪ ♪ parent you are going to be outraged by this next story. a nebraska judge allowing a the lawsuit go forward claiming a the 12-year-old with autism suffered mental health problems after the school put him in a 5 x 7 foot safe room without notifying the parents. the family is seeking help for the pain and as well as reimbursement for the treatment. let's get into this. the school district contends the parents didn't exhaust all remedies available to federal special education law. and the law for those at home protects governmental subdivisions from being sued for certain discretionary actions. do you believe the parents have a case? >> i do think they have a case. what is really terrific for this family is that the board of education in nebraska has actually found errors on behalf of the school district already. and that is going to be huge in court. >> let's just talk about the safe room, okay? >> yeah. >> it is 5 x 7. some of us have closets that size. a door a small window. most likely the child isn't tall enough to see out of it. it's locked. sounds more like a solitary confinement cell in a prison. >> exactly how you described it. >> just sitting on the floor. no chairs. >> he's a prisonerer. >> for teachers who don't want to do their job. and under federal law each tiled is entitled to an individual education plan iep where everybody must sit in the room and check off and be in agreement and sign off on it. the biggest thing for the school district is they never told the parent about this. >> unbelievable. and the psychological assessment on this child. bad enough he had autism, to lock a child with no furniture in a room would give any of us anxiety. how do you assess the damages now? >> you can't even imagine. ing picturing them painting a picture to the jury. it's somebody that is -- >> i cannot imagine. i do not have a child whose autistic but to think that your child is being mistreat birthdayed by a school district that you put your trust in questions how -- so many parents have such difficult time putting their children into the school testimony to bin request. what needs to happen to prevent in. >> we were talk about before it coming out here and the problem you are going to have is it's going to be experts versus experts qualifyntifying the damages. you have a jury. any parent on the jury -- >> health or not. it doesn't matter. >> every person in the country has a family member a friend a neighbor that has special needs. i think you are goix to be talking about the damages are that substantial. six figures or higher. >> there are several states that have banned any kind of safe room. i understand there are separate classrooms for childrens special needs. but a small room confined to a 5 by 7 space? >> there are over 20 states that have limited these sorts of safe rooms for regular children. and there are over 30 states that have banned it for special needs kids. but there are still a number of schools out there utilizing these and that is's the terrifying. >> the judge basically is not going to low negligence to be brought into this court. negligence. this is pure negligence on behalf of the school district is it not? >> they have already admitted it. and the report found -- >> but the government institutions are protected from negligence. >> you -- >> so how far does this go? can the children then be physically harmed? this child could have physically harmed himself. >> there are a lot of cases that has happened. >> and that school could have been responsible. >> the hope is that this case and this jouj is now shining a light so everyone is aware. so everything is in writing. so all the parents know when they get their ieps what is and what isn't allow allowable. and the judge allowing this to move forward could set the precedent not just in the state but in the country. >> you see huge figures because of the reaction people have. it's barbaric. >> i mean what kind of restraints do you think are reasonable? >> i mean -- i mean does the school district then have to come one a new plan? and what would that be? >> well a big piece of this. i think the safety room is just completely unacceptable. but a huge part of this case is there wasn't even training for the staff and how to deal with these situations. so you need the people that can intercede before it gets to the point where a child needs to be restrabd. >> how can you impleasantment when you don't have training to do it. >> teachers. that's rule one and obvious. that's all the time we have. thank you for talking to us. kelly. >> well this is a story about, not llamas, not this time around. zebras. they are on the run now. this is in brussels belgium after a trio of the creatures escaped from a ranch outside the city. stopping tourists and traffic as that they galloped along the way. took about an hour for authorities to capture the zebras and corral them and bring them them. >> gas prices ticking up a bit with summer right around the corner. why are you paying more at the pump? [♪] welcome back. let's talk about gas prices. they are going up a tick this monthed aing to month adding to the inflation. but with all of the crude oil production going on in the u.s. gas prices are still way down. roughly 33% from last year. still as the weather warms up and with that summer vacation on the horizon should we expect gas prices to rise with the temperature? dan schafer is the president and ceo of schafer asset management. he's joining us to weigh in on that. dan, that's the big question right now. typically when memorial day rolls around we start to see the gas prices go up but what does it mean this year around when we see that we have been in full production of oil, although that is declining now as well? >> it's slightly declining. >> slightly is the keyword, right? >> yes. in the spring they changed the gasoline formula. so gas prices naturally go up and then they gouge a little on the pricing. but if you look at the long-term trend of crude oil and gas globally here in the united states we have done well with production and we have lots of them in the tanks and the demand is not there. it's not just the demand in the united states, it's the global economy. china is slowing down, a major user of oil. and people just are not spending the money to the cpis, the consumer price index is not really moving. the fed can't seem to get the economy moving. and we're seeing that reflected. for crude oil to come from $100 down to 40 and $50 in such a sharp move, it's showing us signs of a very weak economy. >> and what about the fact that crude oil is also peaking? what does that say about the economy? >> production. >> production. at $100 a barrel, there's fracking drilling up in north dakota and south dakota. everybody is drilling for oil because the margins for production and the prices that they are getting is tremendous. oil companies are talking about layoffs. >> that's so surprising. i spoke to a gentleman who was in texas and he was laid off and he was working in oil. >> remember the days of 1998 when crude was $10 a barrel and all those rigs were in the moth balls and our economy was humming along. right now the workers are losing their jobs, they are becoming ghost towns and they are keeping the rigs online that produce the best. >> i want to get somewhere real quick because we only have a short amount of time. with the fact that this is going on and the fed can't find out what to do, what does it spell out for our economy? >> well, in my opinion, i think we're in the early stages or middle stages of deflationary depression where people are speaked about spooked about what is going on in the country that people can't get jobs, students can't get quality jobs and they are still living at home so the psychology has changed with the way that people spend. interest rates in the united states have been zero for many, many years. they are negative in many european countries. if i said this to you ten years ago, you would have laughed at me. that shows how weak the economy is and the federal reserve can't get the gdp up. their current prediction is .1 for the current quarter. >> meaning we have tremendous amount of work to do. >> yes. there's been a lot of damage carried over from 2008 and 2009. >> dan, thank you. >> a legal debate playing out overseas. who really owns schindler's list? we'll look at that as arthel takes over. we'll see you at 7:00 p.m. eastern. don't be late. i am totally blind. and sometimes i struggle to sleep at night, and stay awake during the day. this is called non-24. learn more by calling 844-824-2424. or visit your24info.com. hello, everybody. welcome to a brand-new hour of "america's news headquarters." i'm eric shawn. >> and i'm arthel neville. >> a pipeline goes up in flames. take a look at this. it shot a massive fountain of fire into the air. the spark that set it off. >> and one state could be on the verge of allowing concealed guns out in the open. we're going to debate the latest on gun rights. >> but
