winner? plus, snakes on a plane are one thing. a snake in the pilot's lap, that's another. >> my blood pressure [inaudible] >> tonight, emergency landing thanks to a stow away reptile. but first from fox this thursday night. the attorney general of the united states today attempted to diffuse a growing backlash over the president's comments on the health care law. and he did so by offering his assurance that the obama administration does, indeed, respect the authority of the nation's courts. as you may recall, the president on monday said it would be unprecedented for the top court to overturn the law after congress had already passed it. listen. i'm confident that the supreme court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected congress. and i'm pretty confident that this court will recognize that and not take that step. >> shepard: except that that's not true. the supreme court has either fully or partially overturned congressional laws dozens of times. so a federal appeals court demanded the attorney general eric holder produce a formal clarification of the president's comments. but the white house continued to claim the president was correct, while at the same time saying that what he meant was that the courts often defer to congress on these sorts of laws, and they do. but that only made things worse. today, in a letter, holder conceded saying, quote: the long standing historical position of the united states regarding judicial review of the constitutionality of federal legislation has not changed. shannon bream on fox top story. she's live tonight in washington. shannon, this thing continues to brew and the attorney general had several lines of defense in this letter that came out today. >> he did. throughout the letter, shep, the doj repeatedly emphasized that the supreme court should defer to congress and its authority to pass laws, especially in the context of what they call the special sphere saying there is even an added level of deference talking about laws congressional under the commerce clause. if that sounds familiar of course it is. it's the heart of the argument of the president's health care law pending at the supreme court, shep. >> shepard: does this end the debate between the federal judges and the administration? >> the doj has finished homework assignment and complied with the judge's order. the debate whether the judge has sparked a public spat that's going to wrap up any time soon. that's not settled. here are two sides on that. >> he thought that president obama had said something and he could get doj to contradict it and that would embarrass the president. this is not the role that the judge should play. >> judge smith cares passionately about our constitution. important to understand he was responding to what the president began when the president took the political position that it would be unprecedented for the supreme court to strike down obama care. >> so, shep, the judge has gotten his response. we'll see what he does with it. >> shepard: shannon bream in our washington newsroom tonight. thanks very much. if somebody is spending your money in las vegas. you should probably get to be there, right? two watch committees are watching wasteful spending. the head of the agency recently resigned after news broke of an $800,000 conference in las vegas complete with a mind reader. that triggered an investigation which is now apparently expanding. the new focus, an incentive program that gave out quarter million dollars in gift cards to employees for doing good work. all this from an agency that's supposed to help other federal departments manage their resources without wasting anything. well, a 100-million-dollar mega millions ticket is still out there somewhere and we don't know who has it no clue that's what we learned from the news conference today from the director of the maryland lottery. >> we have not heard from anyone claiming that they have the ticket. we have not heard from a representative claiming that they are representing the winner of the ticket. >> shepard: now, that's kind of interesting because, remember the news conference yesterday with that mcdonald's worker. she claimed to be one of three winners of record setting jackpot. her lawyer says he hasn't seen the winning ticket. doesn't want to see it doesn't know if she even won. the chief fox report correspondent jonathan hunt is with us now. the lawyer speaking again today but doesn't really have anything to say again today. >> not much to say. but we did get more pearls of wisdom from edward smith jr. who appeared on "america live" with megyn kelly today. and had some advice for all mankind although perhaps his sweet swine pork rines hat-wearing client should pay the most attention to these words. listen. >> i hope that most of your listeners would realized how blessed they are to have children, to have family, and to have more than just money in their pockets. >> about $100 million doesn't stink either. >> oh, i would assume that for some people that might be the case, but there are more important things in this life than just having money. >> and, perhaps, just perhaps he should mention to his client that there are more important things in life than just having attention. >> shepard: wow. and today somebody stepped forward claiming to know the person who really won all the money. >> yeah. this time a woman from mississippi claimed her son in maryland is actually the winner and has the winning ticket. although like these sweet swine pork rines hat-wearing woman, she provided no evidence. in the meantime, lottery officials had a few pointers for whoever does have the real ticket. listen. >> now, at this point in time, a little bit of advice to the winner. if he or she is listening, we would encourage you to sign the back of the ticket and that you safeguard it. put it in a safety deposit box in a safe somewhere that will protect the ticket. >> behind the mcflurry machine in your local mcdonald's is not considered by lottery officials as safe place. >> that's right, shep. and republics are wondering if this is really a campaign event at the white house because of that gender gap the president has already been exploiting on the campaign trail is he now bringing this official event here to the white house to help his re-election campaign? i asked jay carney today during his briefing if this is really just about policy, why doesn't the president also have a men's conference since they also have to deal with the economy? here is his response. >> well, stay tuned. that's kind of a silly question. the point is the president. -- this administration has -- this administration has engaged in a number of policy approaches designed to address women and the economy. >> jay carney saying look, the first thing the president signed into law is pay equity legislation for women. they believe the health care law obviously under review will help women in a major way with preventative care like mammograms, shep? >> shepard: mitt romney getting closer to the republic nomination here. insiders calling it inevitability. he has a problem with women voters. what's he doing? >> more than anything, deploying his wife ann a lot more. we are seeing them out on the campaign trail a lot more together. what ann romney has been telling voters is what her husband is now telling voters. while the white house may think they are going to get women voters because of i like contraception and some of mitt romney's attacks on planned parenthood for example, they believe it will instead be about pocketbook issues. listen. >> she reports to me regularly that the issue women care about most is the economy and getting good jobs for their kids. and for themselves. >> speaking of women today, mitt romney said he thinks women should be allowed to become members at augusta national where they are hosting the master's tournament this week. jay carney saying the president agrees with that as well. calista gingrich got involved as well. i'm a golfer and i would love to belong to augusta. >> shepard: ed henry on the north lawn. unemployment claims just hit another four year low. the government reports 6,000 fewer people applied for jobless benefits last week for a total of 357,000. we will find out whether that's enough to lower the unemployment rate when the jobs report for march comes out tomorrow. right now unemployment is officially at 8.3%. the fox business network's gerri willis is joining us now to talk a little bit more about this. what are we expecting in the jobs report? >> we have a big view on it economists think jobs expanded 203,000. rate stay steady at 8.3%. they could get surprise on the upside. here is why. in the last 56 weeks, we have had increases, improvement in these numbers and following weeks. they revised these numbers up over and over and over again. could be we get a surprise. one of the interesting things out for the federal reserve this week. they say the jobs are growing faster than the economy and they worry it's not sustainable. >> shepard: today is the last day of the training session. tomorrow is good friday a bank holiday. this good news sent stocks down, what? >> well, it's not about the jobs numbers. europe, you can blame europe. >> blame europe for everything. >> s&p 500 down seven tenths of a percent this week. it's spain. the country tried to float some debt and investors just weren't interested. they had to pay a ton of money for that debt. now people are worried there might be another bailout. >> shepard: worst wall street week this year. >> that's right. >> shepard: too bad. >> we will retire later, okay? >> shepard: for sure. thank you. j.c. penney reports it's laid off more than 10% of the staff. comes after the new ceo promises top to bottom revamp of the company. it will reportedly fire 300 call center workers later this year. the news drove its stock down about half a cent today. the price of a share has fallen more than $8 just since february. for the second straight day the president signed a bill with bipartisan support. the president says the so-called jobs act would give small business as boost by making it easier for them to go public. he calls it a potential economic game changer. and the house speaker john boehner agreed saying and i quote: with so many americans still asking where are the jobs? republicans will continue to find and act on areas of common ground. that would make it easier for small businesses to grow and hire new works. one man's money troubles are becoming a symbol of the whole nation's economic crisis. [shouting] [explosion] >> shepard: protesters in greece holding rallies after an elderly pharmacist killed himself outside of parliament. a suicide note reportedly said he would rather die than have to go searching through the trash for food. his death yesterday became a rallying cry against greece's tough budget cuts and layoffs. the greek government had to take drastic steps before the european union would agree to a bailout of the country. the syrian government should stop killing its own people in about a week. that's from the former united nations secretary general kofi annan.
