shepard: showdown with china and why when it comes to the climate conference in copenhagen, it could all come down to president obama. i'm shepard smith, the news starts now. the leader of the free world headed to the other side of the world to try to pull everyone together. >> we have now reached the critical juncture in these negotiations. shepard: but even if president obama can help make a deal on climate change, what will it actually cost? tonight, how they are putting on the price tag. plus the militants are watching us watching them. how enemy fires are plugging into our predator drones using off the shelf software. >> it's available and it's available to anyone. shepard: tonight, the new war of the machine. and, smoke under the water. why scientists say this is something no one has ever seen. [captioning made possible by fox news channel] first from fox tonight president obama headed to the climate change talks in copenhagen. he left the white house just a short time ago on the way to andrews air force base for the flight to denmark. reporters earlier questioned whether he had even bother going since there is no deal in sight. remember, world leaders have been aiming to sign an agreement by tomorrow on how to deal with greenhouse gas emissions around the world. but the talks hit serious snags. one of the greatest problems had developed between the united states and china, especially when it comes to who would monitor china's emissions. still today, signs of possible progress as secretary of state hillary clinton announced the u.s. would be willing to help work toward a 100 billion-dollar a year fund to fight climate change. >> no doubt about the commitment of the united states to reaching a successful agreement here in copenhagen. and meeting this great global challenge together. shepard: china is responding positively to that offer saying that's a good first step. and just minutes ago the white house reported that president obama will meet with the chinese premier on the sidelines of the conference tomorrow. clearly, they have a lot to talk about. major garrett with the news. he is streaming live from copenhagen tonight. major, china says it's already for some dialogue now. but does beijing seem willing to translate words into action? >> not that we have been able to detect yet, shepard. senior administration officials told fox and other reporters earlier today that on this day here in copenhagen u.s. and chinese officials closed some of the gaps on this key issue of transparency. transparency is what is china going to do and how county world outside of china measure its progress on emissions, particularly greenhouse gas emissions? china is now the leading groan house gas emitter in the world outstripping the united states and that takes some doing. and the question arose why come here at all, mr. president, if it appears that an agreement is not going to be done by the time you get here. the president due here in about seven hours. air force one is waiting for him at andrews air force base. it's now after 1:00 a.m. here. i put that very question, shepard, to david axelrod to advisor to president obama. here is what he said to fox. >> i don't think the president is giving up on aachieving something valuable in copenhagen. we are certainly going with that intent. if others don't have the same intent, then we'll make less progress. >> 193 nations are here, shepard. and if there isn't progress, those others, the white house is referring to, we don't have to search very far communist china. shepard: the money we are pledging to raise, major, where will that come from and who exactly will get it? >> this is an important topic, shepard. first of all, focus on the year. 2020, a long way from now. $100 billion a year, would that all come from the united states? absolutely not. as a matter of fact, the united states when putting that figure forward today did not say how much it would put into that till. all that it would say is that it would commit to mobilizing other nations and those with private capital to put money into that 100 billion-dollar fund. but clearly u.s. taxpayers, according to the obama administration will be put on the hook for this. senate republicans keil of arizona said not so fast. >> we are not going to permit the president or anyone else to go around making commitments to the world as to what the united states will do in the future without an appreciation of the fact that those agreements have l. have to come back to the united states senate for ratification. >> one other note, shepard, when the $100 billion was put on the table, many people here nodded but other developing countries said, you know what? it's simply not enough. another sticking point. shepard: major garrett live in friday morning in denmark. i mentioned one of the big problems is who would monitor carbon emissions? after all countries can make all the pledges they like but how does anybody enforce them? obviously if some nations cheat they could have financial advantages over those who don't cheat there are a couple of potential solutions here. number one, nasa actually had a satellite that could have monitored carbon emissions and kept everyone happy. unfortunately it crashed into the ocean on lunch. the space agency announces it could build another for for $330 million. possibility number two is a tool, a new google program called earth engine. the company just demonstrated a product in copenhagen. google reports earth engine will let countries access and measure satellite data on d force station which many scientists say is major cause of climate change. well, it's a crucial weapon in the u.s. military's arsenal. and now we're learning enemy fighters were using it for their own cause. our corporate cousins at the "wall street journal" report militants in iraq figured out how to intercept the video feeds from those unmanned predator drones using software that you could buy for just a few dollars. >> it's actually 25.95. and you get it on the internet. it is program called sky grabber. it was a russian program that was designed to basically pirate movies and music and things like that. but it did also intercept drone feed. shepard: is this a threat? and, if so, what is the military doing about it? our national correspondent steve centanni at the pentagon tonight. iran was apparently behind this, i'm led to believe. >> in a sense that's right. iran reported the shiite insurgents who apparently tapped into this video into the transmissions from the drones and intercepted it using this computer program. now, pentagon officials stress that there was no security breach at no time was any vital information stolen or intercepted by any of these insurgents. but the fact that iran is involved raises a serious question for the future. could some other regime that has more money, has more sophisticated a bigger computer program, a more organized network have some kind of a cyber warfare impact of this type in the future? that's what the peck is worried about as well. shep? shepard: all right. if they are worried about it. what is the pentagon doing about it. >> as far as the drones operating now as you know it's a very important tool for us in the battlefield in iraq pakistan and afghanistan. they have added layers of encryption so it couldn't be intercepted by this computer program or anyone that exists right now. that doesn't guarantee one for the future. that have done that and they are constantly reassessing the vulnerability of the drones because they intend to use a lot of these things in the battlefield over there. don't want them to be vulnerable. so they are always looking at that shep. shepard: certainly very valuable especially in pakistan. >> pakistan where we have those strikes on the militants in the border regions in those tribal lands, also iraq, also afghanistan. it's the weapon of choice for the u.s. military right now because it is so agile and versatile. can fly high and oversee a battlefield, figure out where the insurgents, the suspects are. zero in on them. if they find somebody, can they actually hit them with a hell fire missile. very versatile. they're using it a lot, and they want to make sure there are no security problems with it. shepard: steve, thanks. susan powell's father says as a father he can't give up hope that she is alive. even though susan powell disappeared from her home in salt lake city suburb more than a week ago. relatives and friends held a news conference today to discuss both their effort to find susan and what they think about her husband. he is josh powell, who says the last time he saw his wife he was prepared to take the two children on a midnight camping trip a 1-year-old and 4-year-old after midnight in freezing temperatures. police have named josh powell a person of interest in this case. a family spokesperson says they, quote, know what that means and said after everything they have heard this week, it breaks their hearts. >> the fact that joshua has been named a person of interest in this case deeply saddens the family but it is not a surprise given the events and his reactions to them in the past week. we know that susan is an excellent mother and would not have tolerated her children being taken out of the home after midnight to go camping in dangerously cold conditions. shepard: the family spokesperson adding that the whole camping story was a huge red flag. "the fox report's" chief correspondent jonathan hunt has been following this one. pretty emotional news conference today. >> it was. at times susan powell's father chuck and two sisters at that news conference were in tears as shelby gifford the spokesperson paid tribute to susan powell. listen. >> susan is a mother, a daughter, an aunt, a niece, a sister, a granddaughter, a friend. she is loved by many. our primary focus as a family is to remind everybody that susan has not yet been found. >> and watching them, shep, and listening to the family spokeswoman is very hard to think that they do not fear that this case is headed for the worse case scenario, shep. shepard: where are the cops with all of this? it must be frustrating. >> i just got off the phone a few minutes ago with tom from the police he used that word. he said it is very, very frustrating. that's a quote. he said josh powell is hindering our ability to get to the bottom of this case. they clearly still want to talk to him. they heard nothing from him today. their doors they say, are open. they will go to him but right now his attorney is not allowing josh powell to talk to the cops and that is clearly a problem in this case, shep. shepard: we have heard a lot about the kids, the 1-year-old and the 4-year-old. are they with the dad still? >> that was addressed in the news conference today, actually. they apparently are spending some time with their father josh powell. they are also spending some time with his brother-in-law and his sister. interestingly, his brother-in-law is the person who reportedly told some news reporters locally today that he wouldn't be surprised, quote, if josh were arrested soon. i asked the captain mcclak lin if arrests were eminent he said i'm not going to comment on that. shepard: the owner of the cincinnati bengals football team says wide receiver chris henry was just getting his back back together when everything fell apart yesterday. new details about the bizarre incident that left the pro football player in grave condition at this time last night who died this morning. and why homicide detectives are reportedly getting involved. plus, for five years, authorities have kept a new jersey father from his son after the man's wife took the boy to brazil and would not bring her back. today the father was supposed to get his child back. they are in the cube in happier times. things did not go well today. details straight ahead from the journalists of fox news. this is the fox report. "time" magazine named him the person of the year. the question now will ben bernanke still be around next year as fed chairman in the confirmation proceedings today. and we have an answer, at least a partial one. and his wife told him she was taking their son on a two week trip to brazil. turned out, months and then years and then they never came back. now another frustrating setback and a father's efforts to bring his child home and that's coming up. shepard: since the summer, the number of people filing claims for unemployment benefits has been falling steadily. but a reminder today these things happen in fits and starts. the labor department reports the number of newly unemployed americans filing for benefits rose last week. first-time claims up 7,000 from the week before. analysts say they were expecting a decrease. there was also a slight uptick in the total number of americans receiving unemployment benefits. the number remains just less than 5.2 million. the man in charge of america's central bank is now one step closer to a second term. the senate banking committee voted today to approve the nomination of federal reserve chairman ben bernanke. he is overseeing the fed during the worst recession since the great depression. and while many credit bernanke with helping to prevent a complete economic collapse and another great depression, others attacked him for bailing out wall street while main street america suffered record job losses. today's vote sends bernanke's nomination to a full senate vote. if is he confirmed and it's widely believe he will be, he will serve another four years. peter barnes is from the fox business network and live with us from washington tonight. peter, "time" magazine just named him person of the year. did that have an effect on this? did it sense? >> no reporters brought it up today, shepard. one opponent did bring it up. the committee voting 16-7 to approve his renomination and send it to a full senate for a vote likely in january. 12 democrats and four republicans voting yes. one democrat joining six republicans voting no. opponents angry at bernanke for the financial bubble, the financial crisis that came after it popped, including all those big bank bailouts, one critic used the "time" magazine cover against him. >> chairman bernanke may wonder if he really wants to be honored by an organization that has previously named people like joseph stalin twice, yasser arafat, adolf hitler, the allah toll -- ayatollah co-mane. putin, richard nixon twice as their person of the year. now. >> now, for the record "time" magazine says it chooses its person of the year based on the person's influence in the nation or the world for that year for better or worse, shep. shepard: back to the job as fed chairman, peter, there is not much doubt about this, he will be reconfirmed, right? >> yeah. despite the criticism, most analysts think he will be reconfirmed for a second term. bernanke has some work to do, about this christmas or next christmas? that's what one senate is asking about president obama's latest deadline for getting a health care bill passed. the nebraska democrat ben nelson says he still cannot vote for the plan as it now sands. and his no vote would be enough to sink the whole thing. jim angle on the top story at the bottom of the hour. live in washington tonight. jim, senator nelson says he has a few problems with this thing. >> you got it, shep. democratic senator ben nelson is saying he will vote with the republicans to block a final vote on the health care bill unless he sees tighter language restricting federal funds from being spent on abortions. but he told fox news radio in lincoln he has several objections and he rejected the push for a vote by christmas. >> i can't tell you >> this is a major road block for senate democratic leader harry reid, shep, who is still trying to get the necessary 60 votes. a big road block for him. shepard: he is still working behind the scenes right, jim? to come up with a manager's amendment that would list all the compromises he is making to try to get to 60 votes. >> yeah. and that's where you would see all the compromises on abortion or any other issue. that's where they would come. but republicans are questioning how the democrats can push for a vote by christmas when no one has seen what reid plans to offer. >> how in the world can anybody tell their constituents that they are for the bill or against the bill until we have had a chance to read it? >> the senate will focus on. >> it is mind boggling. >> so the senate will focus on must-do senate issues on saturday. set in motion a series of votes on health care over the following days. some of them scheduled well after midnight. republicans will try to slow things down, of course on the idea that public could get a closer look at the details before the final vote. shep? shepard: jim ingle live on capitol hill tonight. thank you. brazil's supreme court has ordered authorities to keep a 9-year-old boy from returning to his new jersey father, at least for now. the boy's brazilian mom took the child to south america on what she told them would be a two-week vacation. that was five years ago. since then, she has divorced her husband, gotten married to somebody else, and then died. yesterday a federal court in brazil ruled the boy's relatives there must return the child to his father david goldman. but today, just hours after goldman arrived in brazil to pick up his son as instructed, a judge said the court has to decide whether the 9-year-old should testify that delays things because the court schedule, we're told it won't happen until at least february. andrea day of our flag ship local station wnyw fox 5 in new york. andrea, what happens to the boy until then. >> shep, right now he have to stay in brazil with his relatives there until the courts make a decision about that testimony you were just talking about. but what even clear what kind of visitation rights he could have right now. shepard: andrea, the father has been back and forth repeatedly to get his son. >> absolutely. shepard: is there anything more he can do. >> he has been battling this for five and a half years for now always hoping to have sean back. he has appealed to world leaders. has he done everything he could. now he is stuck there we just yorkers watch. thanks. italian prime minister berlusconi headed home after shocking attack that landed him in the hospital with a broken nose and two broken teeth. the security was tight today. the 73-year-old waving to reporters. we're told he stopped at a dentist office before he headed to his villa outside millan. as you can see a large bandage covers his nose and much of his face really. it's the result of this assault at a political rally on sunday when police say a man with a history of mental illness hurled a statue et right at the prime minister's face. you can see the results. unbelievable. we're told the suspect has written an apology letter to berlusconi who is under doctor's orders to skip any public events through the holidays. more than six months after a commercial plane crash killed all 228 people on board, much of what caused air france flight 447 to slam into the atlantic ocean remains a huge mystery. that from a new report out today from investigators in france. the plane was flying from rio in brazil to paris on the first of june. it hit a severe thunderstorm as the story goes and disappeared. searchers say they found some the wreckage but never recovered the flight data and cockpit voice recorders. that, of course, hammers the efforts to find out what happened. we're told a new search for the recorders is scheduled for february. investigators reportedly saying that among other factors the plane's speed sensors may have malfunctioned and oxygen masks did not drop as they were supposed to. life jackets were still in their wrappers, indicating the crash came with little or no warning. now what is said to be the deepest underwater volcanic eruption that man has ever seen. they are stunning images from nearly 4,000 feet below the ocean's surface. a high tech robotic submarine giving scientists and all of us really a breath-taking first look way down where life still manages to exist in what seems to be a pretty toxic located about 125 miles southwest of samoa. a group of u.s. scientists back in may took a high definition camera, a submersible named jason and set out on an adventure. what they found is amazing. >> interrupting volcano, period, i think we all can say is awfully exciting. but to see finally, after all this time lava flowing on the sea floor to see the bubbles bursting in their ultimate glory. >> this looks extreme. >> really extreme. areas across the east coast are going to be pummeled. flooding in across parts of the south. record-breaking rainfalls. in fact, probably the wettest month we have ever seen in new orleans. i want to move through time, shepard. this is kind of where we are signature right now, this storm is going to punch a pack to the south by tomorrow afternoon. a severe threat across the florida peninsula. we will probably see a few tornadoes. then we start to move this storm towards the northeast. you see the snow starting to fall across the i-81 corridor in across parts of virginia. then we continue to watch this snowfall here and then here is what we always see with these nor'easters. it either continues to pull off towards the northeast and new york and boston seeing some snow this weekend. before it pulls off to sea. i'm leaning more towards that solution. probably not much snow across the big cities there. major snow, shepard, by the time this is done, some areas over 2 feet of snow back across the i-81 corridor of virginia. a lot of areas 1 to 2 feet is going to be a major disaster across this area. you have got to stay off this road. go around this road if you at all can. shepard: rick reichmuth, thanks for that they are among the very best of the best in the front lines on the war in afghanistan. and for these members of the united states army special forces, one key strategy is to engage the locals in the tough region. fox news correspondent greg palkot has been spending time with the soldiers getting a rare look at how they jail. and it's next. shepard: detainees from guantanamo bay go to trial in the united states, one judge says they may not be the most dangerous defendants in the country, far from it. recognize is the when 200 mexican november marines stormed an apartment complex just south of mexico city where several drug suspects were believed to be hiding out. that sparked a gun fight that lasted upwards of two hours and resulted in the death of the alleged kingpin on pin on the right-hand side of your screen here along with six suspected members of his drug cartel. the cartel is responsible for smuggling tons of cocaine and heroin into the united states. the man who inspired the classic mobster movie good fellas is back in trouble with the law tonight. henry hill the turn coat who he played in the film out on bail tonight. police reportedly arrested him for a drunken disturbance at a hotel near st. louis. we are told he is already on probation for two citations in california. reporter andy banker of fox affiliate ktvi in st. louis sat down with hill to talk about the famous informant's struggles and his regrets. >> i was drunk as a skunk. >> henry hill 66, still battling demons like the alcohol abuse that led to his arrest here this week. is he in town selling paintings and making personal appearances at a strip club. >> that's a rat on a rat. >> that's you? >> that's me. >> you are the rat? >> it's a self-portrait. >> he is laughing now about something he once feared would get him killed. going from mobster to mob informant, a rat. there was a time in my life gun in my mouth
