in return for the senate to be able to go into session and vote on that legislation which would extremely limit collective bargaining for state employee unions. over the phone, democratic state senator dismissed the suggestion of a split. he is saying, i just checked into another hotel for the weekend. we met this morning, there is no split. no split. >> now we just got a hold of copies of the 13 state employee unions notifying that layoffs are coming. as for the individual notices, as of this afternoon, fox news was told that those layoff notices hadn't gone in the mail yet. no explanation yet at this hour. >> brett: those missing democrats are facing a number of penalties when they return to wisconsin. possible consequences of their life on the lamb. >> reporter: for 15 days, the 14 state senators have been camped out across state lines. so far neither time nor fines, nor legal threats, nor the state constitution has broen brought them back. the constitution reads in part, each house may compel the attendants of absent members in such manner and such penalties as each house may provide. the latest attempt to compel the wayward democrats a resolution to hold them in contempt. >> by the powers granted by our constitution we are going to officially find them in contempt of the senate. this gives the senate the authority per the constitution to compel attendance of absent members by taking them into custody. >> reporter: but the revolution resolution is not binding because the targets are across the border. if they were to return, head of the police association doubts had he can detained. quote, i don't see how any individual law enforcement or otherwise has the authority to dwayne another individual if there is no probable cause that he committed any crime. other opponents say it's out of hand. >> they don't like the tools that the law and constitution provide so they are making up their own fake law to do something with the constitution and statutes prohibit. >> reporter: fine being imposed is $100 per day. direct deposit of paychecks have been stopped and have to show up in person to get paid. this kind of legislative protest is nothing new. they did it in 2003 over a fierce battle in redistricting. they fled to oklahoma. >> but nothing tops the case of bob pack wood who was arrested and carried feet first into the senate chambers by police. in that case where the u.s. constitution prevailed, there were no state borders for him to hide behind. >> brett: florida supreme court upheld republican governor's scott's decision to reject federal funding for a high speed rail project. the plan would have left taxpayers liable for billions in cost overruns. transportation department says it's evaluating option forgiving the $2.5 billion to other states. president obama is attending a pair of fund-raisers in miami. mike emanuel tells us more. >> reporter: president obama joined former governor jeb bush to put the spotlight on education reform. miami central high school is considered a poster child for fixing schools. >> for outstanding teachers and principals, a common mission, a culture of high expectations, that is what it takes to turn a school around. >> reporter: they give jeb bush for his reform efforts including public and private school choice greater trans and accountability and better pay for better teachers. but in difficult fiscal times, the new governor rick scott showing shown here greeting the president here today, is losing more than a billion dollars in federal stimulus funding and asking for a 5 percent go pension cut. he explained his philosophy. >> we kept the funding, we would continue that. it's making sure we measure the effectiveness. best teachers get paid the best. >> reporter: and republican lawmakers have proposed legislation that would affectively wipe out collective bargaining for government employees. ending automatic dues reduction and forbid using dues for certain activity. requiring recertification for any member by half the employees by july 1st and making it easier for public employees for decertification. that may be a future battleground for unions and workers. >> labor has been supportive of obama he has clashed with teachers unions for endorsing the mass firing of teachers. now appearing with the conservative republican former governor who fought the teachers unions as part of reform makes some local union members uneasy. >> we were made to len of it. i'm sure no parents or teacher in florida can understand it. >> jeb bush is still popular with many others in florida. some republicans believe the appearance today by the president was designed to reach out to independent voters next year realizing the labor vote will still be with the president in 2012. >> brett: senate democrats have introduced their own version of the budget to fund the government for the rest of the fiscal year. carl cameron reports how it was received. >> the latest proposal is unep acceptable. >> reporter: it took them less 24 hours after joe biden proposed a $6.5 billion cut as counter proposal to the bill cutting $61 billion. >> i think what the white house is proposing is one more to maintain the status quo to give the appearance of action where there is none. >> reporter: the leader wants proposals by next tuesday fully aware they will be defeated and chew up more time. >> we won't reach the president's desk so we'll be back to square one without a budget. >> reporter: democrats continue to claim it cuts $41 billion, as a result that has already been saved this year. but the fact checker column said when democrats say they are meeting republicans halfway, they are talking about cuts of 2011 budget. democrats are being disingenuous that they have worked hard to reduce spending or to reach out to republicans. the gop proposed $61 billion spending cut amounts to small amount of the projected spending. it's less than half% 1 percent which made up of entitlement costs. republicans have repeatedly said they will tackle entitlements this year. it's incumbent for republicans to understand the problem. most american boehner said don't have a clue. >> i will do everything that i can in getting my legislative body, not to weaken social security. >> they said no reforms would occur without presidential leadership. but president obama has almost ignored the problem. >> so all the partisanship and gridlock over cuts so small compared to the overall problem, it will hardly make a difference. >> brett: one democrat >> what lew said ten years ago is true. the social security trust fund is a fiction. it's a fraud. it doesn't exist. it's a box in west virginia with a bunch of pieces of paper. when you have fica have taken out of paychecks it doesn't end up in the box. it goes to the treasury which spends it. it's been spent for the last 50 years. it no longer exists and when you and i retire is not going to be out of box, it will be from workers of that era who will be paying in. there is no fund. the system is pay as you go system. to pretend that these i.o.u.s is going to take care of social security for the next 26 years is simply a fraud. if the administration is taking that line, what it means is it's going to demagogue social security, it's going to have the republicans proposal real cuts, real reform as was recommended by the president's own commission on debt and the democrats are going to attack and take it to the election in 2012. it is cynical and scandalous. >> brett: house speaker boehner that paul ryan is going to to come out of the budget committee in the house that deals with long term social security and medicare. >> i mean, this is a little surprising considering they have been dancing around the issue. they know they are going to get demagogue and attacked. on the social security issue, liberal blogs they have been making this argument for a long time. there is no reason to cut social security. that we're fine and it doesn't affect the deficit. there is no problem basically that can't be fixed. the white house has come out and said and made it very clear they are not interested in touching social security in any way shape or form. i think it be interesting to see what happens. it doesn't seem to be any middle ground here. >> brett: a group of senators that are dealing with the big picture items, chris, that come out of the president's bipartisan debt commission, they are trying to put something together, the republicans including senator tom coburn, social security is not there that there is no deal. >> if i was good as charles in math, i wouldn't be in the business but poll winners says there is a winner in here for republicans and democrats on the issue. on the senate you talk to coburn. they are adamant about it. a lot of republicans are scared because coburn and these other guys that you mentioned are adamant about including social security in all of this. if you look at the "wall street journal" poll that was out this week, when you get down to the real number, the real question about the increasing the age to 69 over the next 64 years as the budget commission proposed, that is 56% support. that is pretty good number for an issue that hasn't been discussed. so i think it is true that democrats will likely demagogue this issue. president obama could shock the nation and do something different but they may be facing an uphill climb. >> brett: that is important. it is not affecting folks that get benefits. we're talking about my four-year-old that would have a different age to retirement. that point that gets lost. >> if you just ask people, what about cutting medicare, heck, no. but people are smart enough to figure it out and republicans lay it out the right way, they can probably find some support. >> the other thing, there are actually democrats who don't hold the view there is no problem with social security. and you speak to people who are in think tanks and people that work on the issues, that is ludicrous that people that know the issues. there are other people, but it's the question that the white house is clear they are not. >> brett: we heard for so long, touching skobl and medicare, is there a new third rail of politics that you ignore the cliff that is coming on the financial situation? >> first i would like to say, god bless judge vinson for writing readable orders. he is funny writer and i wanted to thank him that. what is significant here, judge said, okay, mr. president, you get debated got a week to appeal. for one week i'm not going tell the states of this union they can't enforce your law but after that i am tell them to go ahead. >> what is significant here that the administration was anxious enough about this to seek clarification from judge vinson because what is going on in texas, alaska and multitude of states, governors are looking because of doubt, president back loaded it to 2014 so he could get re-elected before the law went into effect. that uncertainty is inviting states to do mischief. >> brett: is this going to be fast tracked to the supreme court? >> i wish it would be. it's clear. the supreme court needs to weigh in this. it's 3-2, saying it's constitutional and shocker of all shockers it was partisan to democrats. it is constitutional. so the white house is overreaching in judicial activism and we have political back and forth. until the supreme court weighs in. this is first judge to throw out the entire thing and basically try to stop everything in their tracks, but until the supreme court weighs we're not going to know. >> vinson is trying to speed it up. the administration is dragging its feet, you better file in a week otherwise i tell the states you don't have to enforce the law. the problem is he may have authority over the administration but he has no authority over the higher courts and that is where it will slow down. slow down in the appeals court and supreme court. they are no mood to fast track this. i would bet this is not going to be a decided by the supreme court until the end of next year at the earliest. >> brett: i want to turn to pakistan. after assassination of another official there. in pakistan based on his christian beliefs. plus, we have the c.i.a. officer who still being held by the pakistanis, not being released. this is situation that is developing quickly and it's not looking good. >> consider this. the funeral at the assassination of a minister in the government the only attendee from the government is the prime minister. no other high level men's of government and not the president. imagine if a cabinet official were assassinated in this country, you would have everybody out there. that is an indication and remember the assassin of the governor a few weeks ago that supported minority rights, the assassination was hailed by large number of pakistanis including judges and law students gives you an indication of how the country is slipping into islamism or chaos. the army at some point is going to step in and take over for that reason. i don't this think there is any way out. >> i do think people have been talking about, another big uprising and overthrow the government. i don't think that is the case but what charles says is right. it's definitely moving in that direction. the question is what can the united states be doing. there is not a lot you can do. it's in the hands of pakistanis who have been ignoring islamic radicalism and allowed to it continue to grow to the point you have two moderate members shot down in cold blood. >> brett: and nuclear armed country. >> 170 million people, most important ally in the war in afghanistan and most important ally in the war on terrorism in which you have a country the penalty for preaching the gospel of christianity is death. we have a serious problem in pakistan. the president there looks like he has lost control of his government. >> brett: next week, we'll bring you reports from afghanistan and get a progress report from the man in charge on the ground. i'll be talking to david petraeus in his only tv interview before he testifies to o capitol hill. we'll take you remote villages and get a firsthand look at u.s. efforts to train afghan security forces. i'll be reporting and anchoring from afghanistan on monday and more throughout the week. that is it for the panel. stay tuned for a spelling emergency.
