[ bells ] the ringing of the bell signalling the joyous news. families have been keeping vigil since the early august disaster. they arrived and they bore a hole 28 inches in diameter. now specially designed cap chule will be lowered and raised through the chute. the capsule equipped with three air tanks, wireless communication and shock absorber. they will go down and assess each of the miner condition and decide the order in which each map is rescued. chel lee continues to recover from a monster earthquake that rocked the nation a month ago. they are showing resilient spirit to an immense challenge. but the latest achievement brings daunting risk. steve harrigan is following the development from the mine streaming from chile. >> reporter: it was a siren, the found that the families hear and the nation has been waiting for, for two months. it meant that the rescue workers broke through more than a half mile of rock. the escape hatch reached the miners half a mile underground since august 5. the next move is likely to test stability of the rock. if it's too weak, we have seen the steel casing going toward the mine. it will be welded together and inserted in the mine. if those are not necessary and the rock is strong enough, we could see the capsule lowered two or three days from now. the first minors could be up as early as tuesday. this will not be a quick process. we are talking 33 miners. this could be a two day rescue. still in question whether they will wait for each other here at the mine or be helicoptered to town. some saying we survived as group in the mine and want to be rescued as one. >> gregg: thank you. fox news is the election headquarters. tea party activist drumming up support in richmond, virginia. big names among the crowd of thousands. a new poll coming out who tea party people want to see as the next president. results may surprise you. julie kirtz in the d.c. bureau. >> reporter: fiscal conservative wins big at the tea party convention meeting in virginia. several thousand tea party activists gathered in virginia energized about the mid-term in 24 days. chris christie was the favorite. coming in second, sarah palin. speaker of the house newt gingrich, fox news contributor and senator demint. ron paul told fox he hasn't ruled out another white house run. this afternoon, he revved up the tea party crowd with an anti-washington rift, about controlling big government spending. >> today, though, i am pleasantly surprised to find out there are so many of you who really care. and you're sick and tired of what you have in washington, d.c. [ man ] learn more at stopmedicarefraud.gov. >> julie: brand new developments in the wake of a gunman accused of trying to carry out an elementary school massacre. police saying the 41-year-old suspect brendon o'rourke is not being cooperative with the investigation. we're told o'rourke has refused to answer questions about what exactly motivated him to open fire on a crowded schoolyard in a suburban san diego community. one neighbor saying he would scream racial epithet in his department late in the night. meanwhile students and their parents describing yesterday's terrifying ordeal. >> a girl got shot. she latched on back of my shirt. i was looking forward and running for my life. >> i was nervous when i saw the blood. i thought he was injured but he was not. >> julie: construction workers credited as heroes for taking down the suspect before he could commit further damage. >> parked on the sidewalk. he had to jump a fence. i noticed he was leaving the playground and i ran across the street to grab my truck. drive over and i hit him with my truck. >> you ran over him. >> yes, sir. >> julie: the gunman hitting only two children. six and a 7-year-old both shot in the arm. they are both expected to make full recoveries. they found propane tank and gas canister at the scene. unclear what the gunman intended to do with it. charged with attempted murder and several weapons violation. fears of a flood of toxic sludge forcing a town to be evacuated in hungary. look at what i'm talking about. this is the sludge they are fearing, seen from the aerial shots. 184 million gallons of it, in fact. spilling in the villages there and water ways after reservoir burst there this week. hungary premier urging a wall is likely to collapse and that would mean a second spill of thicker sludge. the concern is people who live nearby out of their houses. greg burke has more. >> reporter: as we thought the disaster was starting to come to an end, the hungarian prime minister saying likely a wall of the reservoir would cede. they had to evacuate 700 people. some coming to the sports center here. many of them, some spending the night. many of them coming to pick up supplies, as they stay in the homes of friends and relatives. more importantly perhaps, more than 5,000 people in a nearby town on standby to be evacuated if in fact the wall does cede. if it collapses, we'll probably see half of the amount of red sludge that had come out in the initial thing. so the damage, of course, would be terrible for the ecological damage, to field and home. the people we hope in any case would be safe. finally, the situation here is still dire. there is a lot of debate over exactly how much ecological damage is being done. up to this point it seems that the danube river, the damage is minimal. >> julie: greg burke. thank you. pakistan saying it will reopen a crucial supply route for u.s. military operations in afghanistan. supply convoys could begin moving through a key border crossing in the northwest pakistan as soon as monday. trucks on the way to pakistan pakistani-afghan border for ten days. convoys forced to use another route to pakistan leaving them vuller in to believe the attack -- vulnerable to the attack. today, nato torch ed -- they are closing the border crossing in response to nato helicopter strike. abducted british aide worker killed in a rescue attempt in afghanistan. this is a picture of linda norgrove. britain foreign secretary today saying that norgrove's captors killed her last night. it happened while nato forces were trying to free her. she was kidnapped last month in an ambush. three of her afghan colleagues also taken. they were released after. massachusetts senator scott brown stuns the political world when he won the late ted kennedy senate seat. today, brown was back on the campaign trail. hoping to help out first-time candidate in a traditionally blue state. we'll tell you who. politicians looking for a new way to get voters' attention. why the key to success may be at their fingertips. [ male announcer ] we understand.® you need a partner who can help you go global. fedex. >> julie: this is the "fox report" h.d. hello, everyone. i'm julie banderas. news tonight, cops in washington state investigators an alleged sex assault scheme. 12 young people, mainly women, rushed to a hospital after they attended a house party. cops believe somebody may have spiked their drinks. they discovered a man assaulting a young woman who had been drugged. more as we get it. just breaking out of chile tonight, official is saying the rescue of 33 miners trapped deep underground in a collapsed mind would begin wednesday. massive drilling a rescue tunnel today. and crews will lower down a special tube to carry each minors to the surface one-by-one. there is concern tonight a massive spill of toxic sludge in hungary is going to get worse. wall near industrial plant at the site of the spill is cracking. many fear it could soon collapse releasing another wave of toxic chemicals. the spill has killed seven people. it's devastated several towns and local waterways. well, it may be good for some financially troubled homeowners in the short-term. the question is whether or not it will ultimately benefit the economy and the american taxpayer in the long-term. this is after the country's biggest bank make a monumental decision that is expected to have a major ripple effect. bank of america freezing foreclosure sales in all 50 states. the company saying it will review the accuracy of the documents in the wake of a scandal over the tactics used by some of america's biggest lenders. the tactics calling in to question the legality of forcing people from their homes. caroline shively has the latest from washington. >> reporter: julie, to start it off as banking paperwork scandal and whipped up to a crisis. bank of america is the first big name to shut down foreclosures in all 50 states, but they are one of five to do it in half the country. gmac and jp morgan chase, pnc and liton loan servicing closed foreclosures across the country. i doesn't mean that the homes shouldn't have faced foreclosure but the paperwork may not have been in order. they are using a bank employee that signed paperwork saying i reviewed what is in here and it's true, but they never opened the foreclosure file. some employees signing thousands of documents a month. bank of america said it would take weeks to check their book. >> there are technical issues. checking the homework and making sure we get it right. as soon as we, do we will continue the process. >> reporter: if you are facing foreclosure in the short-term, it could give you time to save money, it could stabilize the housing crisis nationwide since the cheap homes wouldn't flood the market. looking at the long-term, though, the housing market pulled the u.s. after the past seven recessions. this could delay the housing recovery for another few years. >> julie: 6,000 members of the air force are in iraq. while the end of the combat mission was august 31, the air force says the work hasn't slowed down at all. in some cases they are busier. malini wilkes is in baghdad to tell us why. >> julie, 6,000 members of the u.s. air force are among the 50,000 u.s. troops remaining here in iraq. the air force says the pace of their work has not slowed since the official end of the combat mission on august 31.
