>> thank you. that is my present. thank you, rick. >> let's talk some politics now because it was -- they were going to pay for the air fare to fly you out to meet with president obama and george clooney and all was to take place on george clooney's basketball court is where they set up this massive fundraising party it has now come and went, of course, it was by all accounts a huge money-raising success. $15 million was a record breaker for the president to make this amount of money. now it looks like they are saying, wait a second, maybe we should try this again. al at timing is interesting. because it happened right on the heels of this week that president obama had where he came out. he says his hand was sort of forced by joe biden and came out and said that he doesn't object to gay marriage and, in fact, he understands why people support it he has had an evolution, he said, of his opinion. then he goes out to hollywood and what turned out, what ended up happening is that they raised $15 million. some people admitted that because of the president's change in stance or at least public admission of how he felt, they opened their pocketbooks. hollywood was the perfect venue for that announcement. >> he has raised a lot of money and clearly this has excited his base. it may anger the far right. ricki martin has scheduled a fundraiser with the president on monday. also interesting the president is selling on this message, this idea of embracing gay marriage. even on their own campaign web site. you can buy some products alluding to the lgbt message. my two dads support obama. my two moms support obama. if you want to get that baby ones were. or the pink t-shirt. >> after three and a half years of the president being on the fence and saying he didn't want to say anything about gay marriage. the minute he does it, they have the merchandise ready. >> the beer could sey. the lgpt beer could sey. that's the money. >> they seized on that moment. >> the real question politically, and i don't know whether or not see it on his web site trying to raise money fundraisers. political side to everything the white house does of course, how will this play politically as we are all talking about the economy. new focus, big gallup poll out this week, the impact of the president's gay marriage stance, 60% of americans say it will make no difference to them whatsoever when they go in to actually vote where the president stands on gay marriage. the president was pretty emphatic about this being a states' rights issue. the other portion of that poll it doesn't really look like it may have much impact come time. >> that middle number is pretty big. 26% say it makes them less likely to vote for the president. that's a pretty big number. that's more than enough to sway this election if in fact it holds. but it's way out. >> i think the calculus wasn't in yet. we clearly don't know. early times. to talk about how this may energize the youth. they weren't going it turn out the way they were going to turn out in 2008. may get them excited and turn out in droves. >> that's one theory that it helps him with that demographic. the gallup folks said with the 26% that you were talking about those might have been republicans that were never going to vote for him anyway. it might not move the needle. we have another poll that's interesting. that's another gallup poll that shows how americans feel about rich people and whether or not the country has benefited from having a rich class. and what's interesting is that 63% of the respondents say yes, the country does benefit from having a rich class, only 34% say no, it doesn't. that is interestingly the exact, basically the same numbers as when they asked back in 1990. that's funny, because, you know, all of the talk, lately of whether or not with the buffet rule and with rich people and whether there is class warfare it hasn't changed the figures. >> that next poll that we put up there is more interesting to me. if you had your choice would you want to be rich or not, 63 percent said yes, they would want to be rich. 35 percent said no, they would not want to be rich. who are the 35%? >> that don't want to be rich? >> right. >> that is a stunning number. >> needless to say the president has stayed on this message of making the wealthy the successful people in this country pay their fair share. listen. >> i believe that this country succeeds when everyone gets a fair shot. when everyone does their fair share. >> we need to change our tax code so that people like me and an awful lot of members of congress, pay our fair share of taxes. >> we have got to build an economy where everyone gets a fair shot. everyone does their fair share. >> an economy where everyone has a fair shot. everybody gets a fair share. everybody is playing by the same set of rules. >> back to what i was saying. the president has been talking about that for the better part of a year now, americans basically still feel that irish, we -- the rich. we need the rich in this country. people are aspirational except for 35%. >> i don't want anything to do with money. >> here is is new rasmussen poll out this morning race poor president and who would you vote for? mitt romney now 50%, this is a pretty big poll. first time that mitt romney has polled that high in the race for the presidency. 43% now. and, of course, you may argue that now the republics have sort of coalesced around a candidate now that newt gingrich finally dropped out and you are starting to see those numbers in that directions. >> that is a bit of an outlier poll. most show right around that margin of error, neck and neck. clearly the economy is everything. none of the president's signature achievements are above 50% approval in this country. that may be some of the reasons you see all these different messages popping up from the obama campaign, trying to find something that does register well with the american people. >> interesting stuff. a lot more to talk about. feel free to weigh in with us. can you find us all on twitter. still ahead, a mainstream paper calling mitt romney a big high school bully, the facts, well, do they add up? [ flo speaking japanese ] [ shouting in japanese ] we work wherever you work. now, that's progressive. call or click today. >> alisyn: in this front page story the "the washington post" says mitt romney bullied a classmate in high school more than about 50 years ago. the republic hopeful has since offered an apology. >> i don't recall the incident myself, but i have seen the reports. and i'm not going to argue with that. there is no question but that i did some stupid things when i was in high school. obviously, if i hurt anyone by virtue of that i would be very sorry for it and apologize for it there is some questions over the timing of the story and the vetting process by the "the washington post." is this a real headline? oar hit piece. >> let's ask byron york. >> good morning. >> here is one of the curious things is that we went back and we looked at "the washington post" coverage and they never did a piece on barack obama in high school. yet, they devoted a lot of resources and time and front page space to mitt romney in high school. is this a relevant story? >> i think you have to look at proportionality. during the 2008 campaign the "the washington post" did do a very long piece about 10,000 words on obama's life in hawaii, including his time in high school there. they spent about 200 words out of those 10,000 words on the president's drug use. which he also discussed in his own memoir "dreams from my father." it wasn't the focus of the piece. go back and look at this piece, which is from 47 years ago, something that mid romney allegedly did in 1965, it's kind of the whole focus of the piece. it's the beginning, it's the end. it's the largest single part of it. it's really kind of a question of emphasis. i mean, if you -- even if you assume that everything in this mitt romney piece is accurate,' you have to think is this the biggest deal being so long ago. if this were 165 and we were talking about a news story, the equivalent age would be something that happened in 1918. it's incredibly long time ago. >> you say, assuming that it's true. at this point it's a big assumption. in fact, the main witness, or a person that discussed this bullying incident was not even there and said he hadn't even heard about this incident until a few weeks ago, is journalistically i have a big problem with it and then they double down today, one they have a piece on barack obama's wonderful warm relationship with his mother on the front page today. and they have a piece doubling down on the bullying aspect here from jonathan capehart. i read it this morning. what romney was alleged to have done was physically and emotionally violent. and while those incidents happened in the 1 1960's, they are the same kind of bullying that is happening today. this kind of is inaccurate. do you have a problem with the tactics used here. >> one of the people involved whom the post had originally said had long been bothered by this i want, again, 47 years ago, now we find out that he actually only found out about it recently. he wasn't there. he found out a few weeks ago. so that's certainly a problem with the story itself. so, you know, mitt romney has come out and said, look, i did stupid things in high school. i think the bigger question again, with it being 47 years ago. let's say this is accurate. let's say that this happened. is there a pattern of events in mitt romney's adult life that confirms this? my sense is that not only is that not true. he hasn't behaved that way as an adult but has been just the opposite. many stories of romney being rather generous and kind. a the lo of work vlving his church and people who are in trouble in his church. if you look back at this incident as somebody did in high school and say, you know, does this really show the way they live their life or was this somebody doing something stupid in high school andhey haven't done it and they are 65 years old now? >> right. byron york, you are of "the washington examiner" of course. thanks for joining us this morning. >> thank you. >> does this toddler look like a terrorist? >> this toddler? >> that's a big baby. she some somehow landed a spot on the no fly list. it got her, we will show you at some point. yanked out of a plane. how does this happen? i don't know. crazy things. we will show you the kid later. was checking up on me. i wasn't eating well. she's a dietitian, and she suggests that i try boost complete nutritional drink to help get the nutrition i was missing. now i drink it every day and i love the great taste. because they charge you for everything. as you all know, the carry-on bags already 30 to 45 bucks could go up to $100. let's break -- get through some of the other added fees. check on the bags. the boarding pass is 5 bucks. yes, even water. that's the only one to my knowledge that charges for water. the ceo says you can drink out of the tap in the bathroom. >> gross. >> water is perfectly good in the tap. here is my favorite. here is my absolute favorite line. he said, you know, the only thing that is free is ice. you can ask for a cup of ice and let it melt. >> there you go. there are ways to save on spirit airlines. >> drink out of the tap in the bathroom. i don't even want to go to the bathroom in the bathroom on the airplane it's so gross. let alone eat or drink in the bathroom. no thank you. but they also the way it's become profitable is to keep the ticket price very low. they also charge for an overhead bin as we said. the items, the boarding pass? here to weigh in is john macon, economist with the american enterprise institute. consultant with the treasury department and in d.c. peter morris is i economist and professor business maryland. good morning to both of you. >> good morning. >> good morning. >> you know all those on the left. all those in favor of dodd frank and the volcker rule, i could go on say this makes the case for dodd frank, for the volcker rule and for further regulation of the banking industry. should it, peter? >> no, i don't believe so. i don't think it's possible to regulate this kind of trading. i think the volcker rule is a bad idea. however, what i do believe is that banking, the taking of deposits and making loans should be split from these kinds of activities. it's high time we recognize, looking at the details of this case, that mr. diamond is running a casino. i don't want slot machines in my bank. so the best thing to do is to separate banking as we did before the clinton administration dimon is considered probably the best banking guy in the country. the one bank that didn't need bailout money. what does it mean when the gold standard dropped $2 billion trying to prevent massive risks? this means that j.p. more morgan like any other institution deep in the financial markets will have a difficult time hedging some of their bets, as peter suggests, if they are taking deposits from individuals, they shouldn't be linked up with that type of activity always always possible to say we are taking a risky position and that's what j.p. morgan was doing. at the were saying at the same time we are trying to hedge this. anybody who has been in the financial business knows that hedges can go bad. that's probably what happened here. and that's fine. and if you want to be an aggressive investor as j.p. morgan does. you shouldn't be be allowed to take deposits. you should be exposed to your bond holders and equity purchasers. so we need to make this distinction more clearly. so far we have seen that dodd frank as curengtsdly construct-currently constructed has done nothing to address. this we need something that goes further to break up investment banking and depository institutions. >> mr. dimon says because we are stupid doesn't mean everybody else was. people fear another lehman, the first domino in a long frightening change. is jamie correct? some people think this was all calculated and the timing all a little too convenient to try to drum up lots of money which it has done. but the fact that so many states are against it and in public polling people are against it, this is risky, is it not? >> well, it's risky. i think he is trying to throw the long ball on this one. what has he got? he can't go out there and say i'm the greatest president on economics. he is not. his economic policies have been miserable failures. >> we have a new "the washington post" poll out about the economic stimulus program and other issues of the economy. do they view it favorably? no. 4'% view favorable to unfavorable 49%. whether this energizes individuals and the opposite side of this argument where they are hurting with the youth vote, right? could this really energize the democratic base you saw mailers out of the democratic base which was asleep. now maybe they're awake. >> it may energize some aspect of the youth vote. let me tell you what it is also going to energize. there are 100 million people who identify themselves as evangelical christians. this is going to energize them. it's also going to energize a lot of people in the african-american and hispanic communities because those communities support traditional marriage by far greater margins than do people in white communities. >> would they vote against a black president? african-american? >> some of them may. i talked to dr. al vita king yesterday. dr. martin luther king's niece. she said this is having a chilling effect. will it have a substantial effect? it's not going to mean that a majority will vote for mitt romney. but he may not get the 96% and the numbers may generally go down and the enthusiasm go down. he can't afford a loss of enthusiasm among african-american and hispanic voters. >> all right. from the 96% to the 1%. the obama campaign has put in a corner a little bit when it comes to the buffet rule and taxing the rich. then he goes out and raises 15 million in large part due to the 1%. now, half of that came from a raffle. not the rich. is there any hypocrisy in going out and saying one thing and doing another? >> it's not just that. that's resulter hypocrisy. also hypocrisy for him not just him press to say don't invoke faith as a matter of policy. then to do so, for example, as he did in the national prayer breakfast saying jesus wants us to pay for taxes or jesus who made him take this position on marriage. this is a president for whom hypocrisy is the foundation of his political platform. >> well, thinking of hypocrisy, we also want to talk to you about the possible media bias and the fact that the "the washington post" really spent a lot of resources and time looking into mid romney -- mitt romney's high school background whether or not they would have done the same nor barack obama. we will talk to you about that coming up. >> actress rosario dawson is having her voice heard. why she is saying romney can snag the latino vote. she is with us coming up on the show. i bathed it in miracles. director: sighs ] cut! sorry to interrupt. when's the show? [ flo speaking japanese ] [ shouting in japanese ] we work wherever you work. now, that's progressive. call or click today. >> former massachusetts governor mitt romney has come under attack this week for pranks that he pulled while a senior in high school, the "the washington post," printed a lengthy article friday about how romney bullied a classmate. some question the veracity of the article. and one of the sisters of one of the victims said she never heard of this incident. is this a case of media bias by the "the washington post." let's ask governor mike huckabee. so i mean i think it's interesting to read about mitt romney's, you know, antics in high school. but is it relevant? >> no, not to his being elected president. bullying is a serious issue. more today probably than ever. because it can be very harmful. i urge people to go see the movie bully the it's a powerful movie. this was something that happened fifth years ago. mitt romney says he doesn't remember. if he did it he is sorry for it it why aren't we going to apply the same standard to barack obama. he admitted in his book he was into heavy drug use, heavy use of alcohol. we don't know how he got into college. whether he did it on a foreign scholarship. we don't know what courses he took. what grades he made. i want to see those things. that worries me a whole lot more. >> because college is more relevant than high school. >> i think it certainly is if you decide was he a good student? did he make good grades? here is the big question. did he get into college by applying for scholarships based on being a foreign student? there has been speculation and he has never cleared that up by releasing those records. >> it was interesting the timing of all of, this too. and the sourcing from the "the washington post." almost seemed like it was -- wouldn't even pass the high school journal test journalism test. you have people who don't remember the incident. who weren't physically there during the time of the incident. would that pass a high school newspaper. >> no. especially when the sources that are quoted, the family of the person supposedly who was bullied said that they never heard their family member talk about. this he died in 2004, unfortunately, so he can't tell us. but his family said they don't remember it. and he he never talked about it. we can't verify it. some of the people who supposedly have been sources turns out they weren't even there. others who were there say they don't remember it quite like that. the bigger question is, in barack obama's book, dreams from my father, he talked about having shoved a little black girl. isn't that bullying? are we going to have the same investigation and go find that little girl and find out is she traumatized by it 40 years after the event? it's just the total double standard that the press applies. i'm sick of the double standard. i'm tired of their being a different set of rules applied to one party and one group of candidates as applied to the other. >> voters don't make up their minds based on them. >> no, they don't. >> this is a piece that maybe should appear in the lifestyle section. nobody is going to vote. they are smarter than that. >> the fact is they're concerned a whole lot more about what mitt romney maybe over the past 20 years of what he was auto years ago when he was in high school. i think the best statement he made was a most of us do a lot of stupid things in high school. if everyone was judged on a single incident that they did in high school, nobody could be president except maybe dave. >> slow down. >> impeccable record. >> i couldn't be on student council. >> on a much lighter note, governor, congratulations, you just had your first granddaughter. >> first granddaughter, second grand child. they gave birth this week. she has more hair than i do. i'm extremely jealous. >> that is an extensive head of hair. >> she has enough hair to get a perm and she is two days old. >> maybe you can wear that hat in the future. >> born thursday night. very proud of my daughter and son-in-law. and remarkable. and beautiful child. if i, you know, objectively humbly but accurately say so. >> that's great. >> wrapped around that. >> she already does. >> congratulations. >> thank you very much. >> watch the show tonight at 8:00 eastern time. >> coming up on the show, they are supposed to be watching the skies, air traffic controllers is one of the busiest u.s. corridors taking naps and watching movies instead. that's not apparently all they were doing. >> you have seen her in the big screen. now actress rosario dawson is tackling politics. she says mitt romney can score the latino vote. we will ask her about that. ♪ [ male announcer ] what's in your energy drink? ♪ wer surge, let it blow your mind. >> well, you know, i think there is also the conversation around immigration. although that's not the thing that's necessarily the issue that people want to be voting on in the latino community. it's the thing that's definitely kinding of swaying them where they are going to put their attention. i think obama though he has done more depooration stations in his terms than anyone before. he -- the way i think he has spoken to and spoken about and again, you are talking about american latinos, people who are legally here. they want to be talk to like they are americans. he has done a good job of that that's something for romney he is going to have to look to when he has had different opinions on the dream act. he has had different opinions going back and forth on immigration. that's an issue of trust on the votes voyeur. they want to vote on the economy but how we talk about immigration they want to hear about it is going to be really key. >> the fact that he has had a tougher stance, mitt romney has than even some of his republic opponents. he has had a tougher stance. so do hispanics, obviously the ones who live here who consider themselves american here illegally. do they like that or not like that his stance on illegal immigration. >> it depends. latinos is not a monolithic voting block. even within florida the north to the south of that say you are going to have very different voting trends within the latino community. that's going to be -- going to have to be a very broadway in which you try connect with the latino community. it's not going to be one phrase. not going to just be one sentence. it's going to take a lot to really kind of convince everyone, especially along the border states to have a different issue around immigration than someone in the northern states. >> you are not just a new yorker. of course you are of hollywood as well. you live out in l.a. you also live over in london as well. curious about the response that hollywood has gotten recently. certainly in political circles. it's sort of this monday list ethic voting block in favor of president obama. he is, of course, going after the 1 percenters but then raising $15 million, george clooney party the other night is hollywood happy with president obama? helping transport the bodies. i'll while the two children were in the car. they have out of the hospital and been reunited with relatives in tennessee. guilty as the charged. jury convicting william balfour of murdering jennifer hudson's mother brother and son-in-law in 2008. she released a statement last night thanking prosecutors and extending a prayer to balfour's family. he now faces life in prison. his lawyer says he will appeal that verdict. >> and the sec opens up an investigation into jp morgan, the nation's largest bank after the firm makes a big bet overseas and loses a whopping $2 billion. regulators reportedly looking into potential civil violations of the company's accounting practices related to its trades, sources say it will likely look into the bank's past regulatory filings. this after jp morgan officials admitted to egregious mistakes on a company conference call. he has served as a symbol of hope since it was pulled from the rubble of ground zero. the 9/11 sphere is close to getting a temporary new home. officials were going to put the statue in storage while renovating the surrounding park grounds but after some major backlash they are having a change the president came out and talked about it he now believes is that there is nothing wrong with gay marriage and so hollywood appreciated that. some members of hollywood. some people said that they even opened their wallets. they have been waiting on the sidelines. some million nature were waiting on the sidelines for him to say something like that and there is this influx of money. >> some say this was core choreographed and planned and staged and the press took the bait hook, line and sinker. it's clear whatever you believe there, the president is doubling if not tribunalling down on his embrace of gay marriage. he has a fundraiser scheduled with ricky martin on monday that should race some money. selling on the very message on the interview with robin roberts. look at the new campaign merchandise available on the obama web site. yes, wonesies that say my two dads support obama or my two moms support obama. message doesn't stop there clearly these products are ready to go. >> certainly going to, you know, make the base happy about it. 26% of all gay couples who are married have children in that relationship. so maybe that's the audience there that they will react to that. and buy a onesie. gallup poll shows very little difference as to whether someone would vote reaction to it. no difference in their voting stance whether or not they are going to vote for the president or not based on his gay marriage stance. >> 60% say no difference. what's interesting is that while he does seem to be raising money as a result, because people have even testified, you know, told media outlets that, yes, they have given him money as a result of, this whether it translates to both in the ballot box, it's hard to say. less likely dave as you pointed out 26%. that's a high number. >> this election, whoever wins is going to come down to 4%, 5% percentage points this f. that number holds. any narrow margin of voters saying less likely to vote for your candidate could make the difference. there is a lot of time between now and november. so will that remain an issue? it's not yet clear. >> all right. so, yesterday, i was landing at new york city airport after taking flight across country. you can't help but wonder when you are sitting on a plane and feeling turbulence and the plane is bouncing around in the sky if everybody is doing exactly what they're supposed to be doing at that moment. you just put your trust in the air traffic controllers that they are alert, not distracted. and that they are doing their job. but, according to a whistle blower. whistle blowers have just come out with this report about what's going on at new york city airport. >> yeah, this is problematic. because we had gone through this whole rig rigamarol what air traffic controllers were doing falling asleep on the job and planes were having to land. you heard those calls coming into the tower and they weren't responding. getting out inflatable air mattresses and taking naps on the floor of the break room. >> that's what we do at the commercial break. they are also leaving before shir shifts are over in some cases. cuttersing at managers. refusing to train new controllers. total disregard, this whistle blower says, requiring them to give weather advisory to pilots. watching movies on laptops. they are online gambling. yes, as alisyn said, you would hope that they are solely focused on the incoming traffic on saving lives. or keeping people safe. the only flip side here that i might argue you need something to engage and not drift off. probably long periods of time for these folks where there is nothing happening except a slip palestinian on the radar. i'm not suggesting take a nap. >> are you saying a blip for five straight hours could be calming and maybe put it you to sleep. >> that would be the perfect thing to put me to sleep. something to engage your brain would be helpful. >> a lot of it i'm sure is tedious. moments of hair raising disasters, so, you know, what do you think? how should they be handling their long shifts when a lot of it is tedious. it's just very nerve wracking. >> a lot of my cab drivers roll down the window in the morning to stay awake. it scares me. trying to wake up. >> that's also nerve wracking. >> let's talk about this story, interesting study in which the way dads, dynamic is changing in the household now. are dads basically becoming more like mr. moms? shedding the sort of stigma not stigma but the traditional 9 to 5 job role and taking on more of the faculties and responsibilities of the mom? >> this is great. on some level it's great. obviously fathers help out more with the kids. my father i can assure you never once changed a diaper. never. >> and most of our fathers. >> obviously your generation of men are now helping out with more of the kids. the downside, if you listen to this study, is that they are less though in the provider role. they are doing less of the traditional provider role and bringing home the bacon and more of staying home and taking care of the kids. >> and in some regards they are struggling because of that role reversal. but a third of fathers with working wives routinely care for their children under the age of 15. that is up pretty significantly. up 26% in 2002. an interesting ohio state study actually showed that more paternal involvement decreased depression, substance abuse and risky behaviors all in low income fathers. it also showed an increase in physical health. for those involved with their kids more. >> that makes sense. that the one we just put up there conflict between the two income families. there is some, to your point, about maybe the friction there, more men not feeling as they can't bees bread winner in that way. >> many are getting a divorce because of that struggle. >> they feel like they can't provide and they feel somehow inadequate. >> it's complicated. gender roles changing is complicated but [ female announcer ] purina cat chow complete. always there for you. find new ways to optimizetted pto heltheir cash flow.esses so, stop in and ask for a regions cashcor analysis and see how easy it is to get your cash flow (whistles) heading in the right direction. let's talk. >> work back. next guest along with lawmakers on both sides of the aisle say attorney general eric holder is now stonewalling congress. congressman trey gowdy serves and he joins us now. >> good morning. >> do you feel you are at the end of your rope. you tried with the gowdy amendment to try to get -- which pass the house on tuesday to cut pay to eric holder which passed. you can do anything more to get answers to holds department of justice accountable for this. >> there with unpage thing we can do. we have one major quiver, called contempt of congress, what some of several of us would like to see house leadership pursue i'm a former prosecutor who takes no delight in. this this is not a political crers to me. it's been over a year. we have a dead border patrol agent. hundreds of dead mexican citizens. i don't know the answers to the questions i'm going to get when i go to the grocery store after this interview. it's been aerie. i don't think it's too much to ask for the department of justice. not the department of politics. the department of justice to answer some pretty fundamental questions about this operation. >> is that what you want here just some basic answers because with your amendment which passed on tuesday would cut $1 million from the general administration fund thage doj cutting the pay of the attorney general himself? is that all you want is simple answers as to who is accountable and where and who knew what and when when it relates to fast and furious? >> that's it. i will do one better than that i will write out the questions that i want the answers to. the answers may exonerate or may inculpate the department of justice. they could exculpate. they could clear them. they could implicate them. i don't know. i don't know what i i don't know. i will write out the questions. answer for them truthfully. if no one has done anything wrong, i will move to something else. the only reason i moved to cut the money is because nothing else we are doing is getting their attention. i will be the first to ask that the money be restored if they will just do what an attorney general or any officer of the court ought to do which is answer legitimate questions. when you office skate and stonewall the office has obligation to provide oversight. i don't have to take his word for things. there are emails we haven't seen. 22 categories of documents we haven't seen. i don't think it's too much to ask that you turn over the documents. >> what about politics in all of this, obviously everything we know in an election year is all put through the political prism do you think eric holder is. do you think he is an liability? yes it may rise to the level where he could put the president's re-election bid in jeopardy. do you think he needs to fire him? >> well, i have said for a while now that i have lost confidence in his ability to lied the agency. and, again, it's not a political exercise to me. i hold that office in higher esteem and higher stead that than your average cabinet level position. what i said to nra news, which i think was then picked up by someone else, you know, i was asked what will it take for eric holder to be gone. i said as soon as he becomes a political liability for a president obsessed with re-election, he will be back in private practice. you know, the president has, as your last segment just proved, has shown a certain flexibility, if we will, with respect to positions. and i suspect that that includes whether or not to keep cabinet level officials lirk eric holder or stephan chu or anyone else who may jeopardize his re-election. >> trey gowdy, we appreciate you joining us this week with your amendment moving past the house. we appreciate you joining us. >> thank you. happy mother's day to all your viewers. >> thanks so much. how about a government study about the overuse of government studies? yep, they just issued a study how to do it. no we're not kidding about it your tax dollars at work straight out of the pentagon. one mother saying something about her kids would never admit but feel every day. her confessional coming up. what are moms really thinking? wer surge, let it blow your mind. airlines you will pay for. clawgd your boarding pass. and you know the carry-on bags 30 to 45 puck the. some say that will go up to $100. even water is three bucks on spirit airlines flight it is working for the bottom line. >> they even charge you for the overhead bin, i guess that is the same thing as your carry on bag. they charge you for your boarding pass. now, i thought they needed you to have a boarding pass. if you don't want me to have a boarding pass, i'm not paying the a bucks. >> i will just go on. >> i don't know what seem i'm in. i will find an empty seat. >> if they have to mcdonald's than at morton's. >> tapping into something which is interesting. if someone just want to get from point a and point b and they don't need the extra leg room and chips and peanuts and all that sort of stuff, they just want to get where they need to go maybe spirit is for you. in the piece people make the point they have flown them before that's the last time they will fly them because it was more worthwhile for them to just pay a little bit of extra money with another airline than to be nickel and dimed this way. >> by one account they lead the industry in the fewest repeat customers. that's not good news long term. >> not a good business model. is this a good business model? the federal government doing study after study. it apparently reached such a point of paperwork and questions snares they had to fill out the pentagon, the secretary at the time decided to commission a study on all of the useless studies that were being done by the government. because he thought my gosh, this is ridiculous study after study, let's do a study on it here is the what gao had to say about that study of the defense department. the defense department's approach is not fully [ flo speaking japanese ] [ shouting in japanese ] we work wherever you work. now, that's progressive. call or click today. >> welcome back. the president says it isn't what you can achieve on your own but what we can do together. >> the american story is not what you can do on your own what makes us great what we can do together. restore middle class security with you are on your own economics. it doesn't work. it never worked. >> but our next guest says the opportunity to achieve success on your own is precisely when makes america great and what is what actually makes people happy. joining joining us this morning arthur brooks the president of the american free enterprise institute. the author of the road to freedom. how to win the fight for free enterprise. a book tweeted about by karl rove just yesterday and carl is coming up on the show. good to see you, arthur. >> great to be with you guys, thanks. you lived in spain where had you a government job and you said no one there leaves these government jobs because it takes care of you for the rest of your life. you left comfort. you came here to the united states you learned all about success. >> i got married in spain. i wasn't happy. i was a government functionary. i was in the job i was going to be in for the next 40 years. it wasn't right. it wasn't what i wanted. my wife and i decided to pack up and come to the united states. we are very worried. nobody leaves these jobs because when you leave a job in spain you never have a job again. you are on the permanent doll. we left and came to the united states. within a month my wife had four job offers and things were great. i mean we were a little poor for a while, things went great for us. we reflected on that and it really changed our philosophy. what we realized what we came to understand is that the united states is really and la of earned success whereas in europe what they are seeing today the reason all this pain is going on over there because the social learned helplessness. we have to be careful or we will end up where they are today. this is the wrong path we are on. >> one of the ways you highlight this learned helplessness is that you had the same status. you could have worked as a government clerk. if you got injured, and you couldn't work anymore, for the rest of your life you would be paid your full salary. you wouldn't have to worry about anything. >> yeah, that's right. sounds great, too. but it's not. one of the things we find in a lot of the social science research and i cover this stuff in the book so that people can understand it is that if you are given something for free for the rest of your life, you become passive, you become dependent and become depressed. earned success where you work and are rewarded for your merit but you have to earn it on the basis of your hard work, defining your success however you like is the secret to' happiest life. survey after survey and study after study when people believe they are earning their success they are not dependent on someone else especially the government. they live the most fulfilled satisfied lives. they are happy. >> arthur, with the number of people on food stamps in this country exploding in recent years, is learned helplessness creeping into the united states? >> yeah. the learned helplessness system goes beyond just the basic safety net. most americans believe we need a minimal safety net the problem is when it reaches up into the middle class. the problem is when too many people are dependent on the government. today as you may or may not know, 70% of americans take more out of the tax system than they are paying into it. and about 50% of americans have no federal income tax liability. where we're becoming more and more of a nation of takers. it's not that americans want this. we are creeping down this road to serfdom. one compromise after another. we have to stand up and make the moral case for earned success. that's at the centered center of this project. this book. >> arthur brooks is the author of this new book and the president of the american enterprise institute. thanks for joining us this morning. fascinating. >> thanks, guys. >> great book. president obama cashing in on same sex marriage stance scheduling more celebrity fundraisers. is he deflect from the real issues? like the economy? we'll ask karl rove about all of that. >> and the lovely actress jane seymour is here. she is in our studios. she is going to talk mother's day with us. there she is. welcome. >> hi there. >> do we get a hug? and here she is weighing in. >> issues are american issues and the economy is incredibly important right now. for especially latinos who are really hard hit and disproportionately by the economic crisis, the the job crisis, by the housing crisis and that's what they're looking for, someone who is going to have that solution for them. >> alisyn: dawson the co-founder of the votto latino. she says she won't campaign for president obama or romney because her organization is nonpartisan. >> she went to both conventions in 2008 and she says she likes to see how it all unfolds together. let's he check with rick reichmuth ahead of the mother's day. >> rick: a the lot of people have a great day today and tomorrow as well and areas across the southeast and we're going to continue to deal with that tomorrow. so, a few problems, and light showers around the great lakes and plains done by tomorrow and northeast and mid atlantic todayen tomorrow, both looking very, very nice and this is the storm causing the problems, a slow mover. if you've got the rain it will stick with you for a while and slowly drift off to the east. it's late tomorrow and monday for the eastern seaboard. the southeast, places like atlanta, unfortunately your mother day is not going to look that great. sunny skies from san diego, and this is how much rain we'll get. two to three inches. georgia, a pretty good drought we'll get that, but cause problems for your day tomorrow. temp-wise, looking good. cooler towards the far northern plains. at least for today. it's going to move forward through much of this week, but we'll see the temps more like to monday and tuesday and tomorrow, looking like this, there's your mother's day temperatures and alisyn for you, 104, in phoenix. >> alisyn: sweet, thank you for that present, rick, we appreciate it. >> clayton: from rick, near present, because karl rove is back here, all no not on the curvy couch, at least via satellite with us, back on "fox & friends." >> alisyn: where are you been, karl? >> you know, i had to work hard to get this opportunity and i really want to thank you for it. you know, did my best job cleaning up the set and removing the debris after your show and i'm honored that as a result you give me this shot again. >> wow! >> you're welcome. >> clayton: see if you can pull it off again. >> dave: you have to earn your way back. >> let's start with politics and what happened this week. obviously, not a week that was-- well, we'll get your take on it, whether it was planned or not. some say that the president planned this thing was orchestrated playing the press like a violin, orchestrating the gay marriage announcement, first floating it by vice-president joe biden down the line from the secretary member, secretary of the cabinet members down to the the president himself. did the press fall for this? or was it this just as it seemed to play. >> no. >> clayton: that the vice-president let the cat out of the bag? >> yeah, the vice-president let the cat out of the bag, joe got over the tips of his skis as the president said. what was interesting to me after this transpired the white house leaked to the press, look, the president already changed his mind on gay marriage and was going to hold that change that opinion until much closer to the convention and when vice-president went out and said what he said and we forget that the president's close friend, the the secretary of education arty duncan compounded it and they had to make the best of a bad situation and put the president out on tuesday, to give the interview to abc, and that was promo 'd tuesday night and wednesday morning official with the complete interview. this was not planned. they had to scramble as quickly and as hard as they could to get this done. i have to tip my hat. these guys have no shame. the vice-president on sunday says i'm in favor of gay marriage on sunday and monday the white house reiterates the president is still in favor of traditional marriage and announces change in opinion on tuesday, on wednesday the obama campaign has a web ad attacking mitt romney for having the same position the president had on sunday and monday. i have to tip my hand to them. >> dave: but you say they were planning on waiting until the convention to maximize the political benefit. what is the political impact? >> i think the president gets some advantage in that he gets more money, went out of their way to say they raised several million dollars in the 24 hours following that and they hyped the fact that one out of every four, every five of their bundlers, guys and gals who raise checks are gay and to get more money from the gay community. i think from the perspective of the voters, it's net-net a loss for the president. you were probably tilting toward the president, and don't ask don't tell. directed the justice department. and saying his position was evolving and all of these people in favor of gay marriage and the particular he made to the russian prime minister, flexible after the election this was bad for him in north carolina, pennsylvania, ohio socialry conservative blue collar democrats otherwise might have give him a chance i expect are going to close their mind. north carolina, voted 61-39 in favor of traditional marriage, a state he cared by 14,000 votes, 0.32% of the vote. i don't think he's going to be carrying north carolina. >> alisyn: it may not help him at the ballot box, but as you talked about with money, it does seem to have somehow tipped the scales, particularly in hollywood. you know, this -- he just happened to have this george clooney event the night after all of the news hit the press about it and he raised 15 million dollars there. >> no, he did not raise 15 million dollars. this is the hype machine going again. there were 140 people at that event, they could give $40,000, about 5.6, round it up and call it 6 million dollars. >> where are we getting our figures from? >> the rest-- well, the rest of the money they claimed they raised as a result of that event is all of the internet contributions that they've received for some unspecified period of time before the event. weeks, perhaps even months before the event. because what they said is you know, sent out internet fund raising appeals, saying, you know, stop mitt romney, stop the extremists, blah, blah, oh, incidentally if you send money, if you send $3, we will put your name in the hopper to be drawn to be a guest at the george clooney fundraiser and two women from the east coast, who were-- whose names were drawn out of the hat and that's how they're claiming that this was a quote 15 million dollar fundraiser, but in reality it was 140 people at $40 each work the math just under 6 million dollars the rest is hype. again, trying to, you know, make the best of a bad situation, you know, they were forced into doing this before they wanted to do it. think ow politically calculated that was. the president changes his mind how long ago he changed his mind and hold it until july or august before the democratic convention in the first week in september and make a big deal in the fall. how politically calculating is that? i mean, that's not true leadership. if you change your mind announce it, don't change your mind and say how can i maximize this by holding it four or five month. gee-whiz, this is really, really calculating. >> clayton: before we carry you over and have another discussion. for republicans, the newspaper report, difficult response for republicans in the gay marriage issue. a lot of the large republican supporters, supporting gay marriage and amendments and so forth and the republican response is kind of sensitive. ed gillespie describes it a sensitive issue. is it difficult issue for republicans? >> no, i think that mitt romney hit it right. look, i'm in favor of traditional marriage and i strongly believe in the marriage is between one man and one woman. and a major issue in this campaign is the economy. and look, i think president obama would welcome a long discussion about gay marriage, even if he knew, even if he was willing to acknowledge that it's hurting him in some of the socially conservative places and look, the number one issue is the economy. and any discussion of the economy tends to hurt the president more than the discussion of virtually any other issue. he's got a lousy record on jobs, worst recovery since the depression and one out of every six americans is unemployed. you know, working part-time and desperately seeking part-time work and given up working altogether. last month, we had 115,000 jobs and three times as many people got so discouraged they dropped out of work force, if we had the average rekiefer, we'd have about $4500 more per captive, grosse pointe woods and we'd have 13 million more people working if we had the average post world war ii recovery. so, the president welcomes the conversation about anything, anything, absolutely anything, but the economy. he loves-- he'd love to be talking about t the-- anything about economy, debt and affordable care act. >> and that washington post column is what we're going to talk about when we come back because the post called mitt romney a big high school bully and the facts some argue don't add up. is this another media hit job? that's not possible. >> it was the whole newspaper except for the classified. >> alisyn: and let's bring back in karl rove to talk about whether or not this was a case of media bias. karl, we know that "the washington post" never specifically looked at barack obama's high school experience. they did look at the book, the autobiography that he wrote he where he talked about his background. what do you think of this look at mitt romney's high school experience. >> first of all, this is a sad day for american journalism, talking about high school pranks that may or may not have taken place over 40-some odd years ago. i thought the family of the supposed victim, they knew nothing about this and they said, they were saddened that their brother and son had been used for political football and they would have nothing more to say about it and i frankly think that america should have nothing more to say about this. if "the washington post" thinks a very, very, very long piece about what mitt romney may have done in high school in cranbrook outside of detroit, over 40 years ago is important for us to understand, then let's go and examine the 25 years ago when president obama was in high school, and in his autobiography admits using drugs, so what kind. does "the washington post" want to write a very, very, very long stories on what drugs did he use, when did he use them, with whom did he use them, did he give them to others, how did he procure his drugs. this is important to make a decision let's have an equal balance. look, this is a sad commentary for a once great newspaper. >> clayton: i'm glad you bring that up. maybe that's the larger discussion of the state of american journalism and perhaps the newspaper, the home of woodward and bernstein for crying out loud, and wouldn't pass muster, and multiple sources on apparently sources who weren't even there. >> well, they've characterized him incorrectly, that the individual incorrectly as a day student, not a boarder. and look, and again, i thought the family had a very classy response to it, which was to say, you know, our now departed brother and son is being used as a political talking point and we don't like it, and you know, we were not aware of this, and he would have been furious if he were alive today, that the story was printed and this is the last we're going to say on it and i frankly think the american people feel the same way. this is the last we need to hear on it. >> clayton: and the-- >> let me say one thing, the president wants this kind of discussion and team obama wants this to be off on anything, but the big issue, they want, they'd love it when the media gets off on the little sort of, you know, 40-some odd years ago, mitt romney was a prankster, can we trust this man in the oval office? come on, please! >> this is exactly what they want the discussion to be, rather than what are we going to do to get our economy back again and huge deficits under control. is the obamacare, or the health care for all americans. >> and the suggestion that once a bully always a bully and to suggest that he's a bully in politics. if they didn't run away, they have he' doubled or tripled down in the last 24 hours. >> with editorial comment masquerading as factual journalism, a sad, sad day. >> clayton: i think it's safe to say that karl earned his spot back. >> alisyn: if he clears off the couch. >> i'll be there with my janitorial outfit right after the show. >> clayton: thanks so much. they promised extreme weight loss and instead all patients lost were their lives. the detail of the lap band surgery coming up. don't want to mace it. >> dave: are american taxes too high? [ male announcer ] you plant. you mow. you grow. you dream. meet the new definition of durability: the john deere select series. with endless possibilities, what will you create? ♪ dreaming of great savings? get them during our green tag event. visit johndeere.com/greentag for details. >> they made millions of dollars off people looking to lose weight, but instead, five patients lost their lives. the two brothers behind the popular 1-800-get-thin clinic are saying letting patients die on their watch. lap band surgery and they claim they're not at fault that the patients had other illnesses that led to their death. >> and joining us is our own doctor. dr. mark siegel. we want to bring in john walker one of the lawyers suing. >> good morning. >> alisyn: mr. walker, let me start with you. what is your lawsuit charging against both of the doctors? they say that surgery is risky, sometimes it's unfortunate, but patients die. >> well, i understand that, but the problem here has-- is with the medical care and follow-up care as well. and talk about layer a first. laura had her liver lacerated during the the surgery and let go home without telling any members of the family that her liver had been lacerated. it wasn't admitted to the hospital and despite the fact across the street was emergency room and she presented herself to the emergency room two days later and she died three days after that, five days after surgery, theede 3.2 liters of bloody fluid in her abdomen and autopsy report indicated the cause of death associated with the the lacerated liver that caused a bleeding and infection that eventually brought her to death. >> alisyn: let me bring in dr. siegel. is it this lap band surgery usually a risky surgery. >> absolutely not. depends who is doing the surgery. 15 minutes to an hour, it's not totally safe, after care, but the chances of lacerating a liver or intestine is almost impossible unless the surgeon doing it is i am competent and the other, the procedures are overdone and issue of heavy marketing going on and health and human services looking into it. a study showed in half the cases there's no long-term weight loss and again, long-term complication risks of 40%, but not this kind of complication. this kind of complication is almost unheard of if a competent surgeon is doing the proceed. >> and what have you learned about the doctors, are they performing the operations? >> no, they're doing the business, we're here in los angeles swamped with the get thin billboards until recently the f.d.a. stepped in and pulled them down. they're in a heavy marketing campaign and this is just kind of like, almost like drive through surgery and stacking the people up and doing as many as they possibly can. unfortunate, pelote of people problems as a result of that, and difference between that competent surgery, these are just marketing people. >> alisyn: scary. dr. siegel. for people for whom diet and going to the gym hasn't worked, the lap band surgery, my impression was that it does help people stave off obesity and to turn their life around. what would you tell your patients after this story breaks whether or not they should get it. >> you know, alisyn, made that point it's supposed to be relatively safe and done through a scope and in competent hands it's safe. if all failed if you can't exercise, not losing weight through other means and morbidly obese, i worried about diabetes, high blood pressure, stroke, and i sometimes turn to this, no other choice. it needs to be in the arsenal at the end of the line if nothing else works and i don't want people out there to be afraid of the procedure. if it's done properly through a scope, it's safe. >> alisyn: it does have long-term benefits. in 50% of cases long-term benefits, again, no cure-all and people need to know what they're getting into and have to find a surgeon with a lot of experience in this and knows what they're doing. >> alisyn: we did reach out to the omedi brothers and got no response. please give us informed about your lawsuit. >> and dr. siegel is 100% correct about what he's said. >> alisyn: if you feel like someone is watching you, maybe they are. why a top cia official says there are more spies in the u.s. than ever before. they're supposed to be keeping you safe in the skies, but apparently watching movies instead. and air traffic contollers are going out of control. and home depot is here with garden inspired gifts for mom tomorrow. stick around and see how it's done. ♪ ♪ i'm picking up good vibrations ♪ ♪ she's giving me excitation ♪ ♪ lookin' good, flo! feelin' good! feelin' real good! now lawmakers on capitol hill and calling for more regulation on the big banks? is that what we need, more regulation. a former trader at lehman brothers left before and failed and got out at a good time and the book, a colassel failure, inside story of the collapse of lehman brothers. nice to see you. >> great to be here. >> clayton: so the question, some are calling as a result of the jp morgan chase 2 billion dollar bet gone bad. we need more regulation, more regulation so something like this doesn't happen again. what do you say? >> well, you know, the bankruptcy of lehman brothers was very devastating to the global economy, but you have to remember, jamie dimon, the last 60 years, is the best risk manager as a ceo, and he's entitled to a bad quarter and the banks are more regulated today than they were in 2007. i think that's the ultimate take away for me right now. >> clayton: let's listen to what jamie dimon says in an intersue tomorrow. and talks at length about this risk, take a listen. >> if the average american has the right to say that the institutions of america let me down and that's true, if the average american says that's predominantly washington and wall street poorly defined. that's, true, i blame both. the policies and procedures, i think when you go beyond that and start to blame every single banker and politician, that's not true. a lot of banks, not all banks needed to be bailed out and a lot of things like bear-stearns, and wells fargo he bought wachovia, and everything helped, financing cities, states, hospitals. so that should be recognized, too. >> clayton: is this a reason to bust up big banks? you argue in part that this issue that jamie dimon is dealing with is a product of big regulation. >> yes, nobody has been tougher on the bad guys than me. i wrote the definitive work on lehman brothers and i'm here to tell you if you can picture in your mind in 2007, picture like 18 people sitting at a table and now picture today maybe five or six at the same table. essentially, regulation, basel 2, 3, making the basics reduce leverage is good. but that means that less banks in the world have big balance sheets to do certain types of trades. so, essentially the players at the table are fewer and they're holding more chips than they were in '07. >> clayton: why is that a bad thing? you can hear americans waking up this morning and flipping on the tv i'm not the wall street type, but these are the guys that got us into the mess. right. >> sure. >> clayton: and largely were betting on the bad practices as related to the the mortgage-backed securities and random shady things and now we're left holding the bag right now, and is regulation the answer or is something else needed to be done? >> right now, i mean, i was in wall street, 2004 through 2008 right here in new york, and he went on the the lecture tour and i'm back on wall street now, it's like night and day, the regulations are at least double, triple what they were. so, we have more regulation today. i think that there's a lot of pain and i just don't want to see an overreaction at this time. >> clayton: is the regulation now hindering wall street's ability to make america stronger?
