country has changed, people have tightened their belts, christmas spending is not what it used to be. families are unemployed, the culture in congress has not changed in terms of spending. >> you bring up a great point and the final thought on this, every year with this budget they like allow like a 4 or 7% increase in the budgets, right. it's sort of built in and they never take into account what's going on in the economy at the time. it's just always built in so we need to add these things and thrown at the last minute and people want to get home to the holidays and back home to the to gather evidence that could lead to conspiracy charges against them. the latest in the case involving u.s. citizens. do we need to change the way we look for u.s. home grown radicals? author of "why you're wrong about the right". great to see you both. >> hi. >> the obama administration asserted that a domestic threat is emanating mostly from americans who are travelling overseas and being trained or radicalized in that way. does the obama administration have this right? are they correct where this home grown terrorism is coming from? >> i think the threat is everywhere. the threat is here, it's overseas, i was heartened by the president's speech in oz low he was beginning to get the idea that we need to recognize there's good and evil in the world, good is with us, evil is with them. but the threat is here, it's there, it's everywhere. we have to take the threat of islamic radicalism and terror as a serious threat to our well-being, wherever it may be, and i think that we need to continue to involve our policies. >> the other day, karl rove praised the president for his speech to oslo about terrorism. what does the president need to do here at home to make sure that this sort of thing doesn't happen. well, more speeches that happened would be job number one. enough soft language, that kind of really hawkish language i think was really good. it was bush-ion. it makes you wonder why we're considering bringing gitmo terrorists back home and were holder is going after the bush interrogation program instead of spending resources on looking forward and spending resources at home and why we're trying terrorists as common criminals here, this is the time to be looking at our policies and strengthening them, not softening them. >> let's dive in, more specific. a lot of concerns about the patriot act when it was passed, a lot by republicans, invasion of privacy. a lot of the thought though from the obama administration is perhaps that the home grown terrorists are being trained over the internet, radicalized by having connections to the middle east in some capacity. how far do we need to go to make sure we're not, you know, vad invading people's privacy. >> it's a balancing act and getting it right is the challenge and agree on the need for a bipartisan approach to fighting what is a threat to all of us. and the new york city police right here have people all over the middle east. commissioner kelly understands that this is a worldwide problem where the internet is critical, but we need human assets. so, ultimately, this isn't about politics, and it's not about pointing the finger, it's about stopping rod callism, fundamentalism and terror here and everywhere. >> how should the obama administration define the war on terror, they didn't want to call it the war on terror. if we have home grown terrorists, how do we define this. >> people like to suggest the language doesn't matter. it does, it matters to our enemies, it matters to our allies. calling terrorism or, you know, overseas contingency corporations, it's confusing and again, the kind of soft language that doesn't, it doesn't impress anyone. it doesn't square anyone, that it should scare. and it doesn't comfort anyone at home. >> a bipartisan commission, are you on board with doug? >> well, sure, you're right this isn't about politics, but at the same time, you know, it gets political sometimes. >> shouldn't. >> well, when we're talking about the bush administration and what they do. >> you were not me. >> a few years ago, that's politics, that doesn't make president of the brady campaign to prevent gun violence and larry pratt, the executive director of the gun owners of america. good morning to you, gentlemen. >> good morning. >> larry, let me start with you, members of the house homeland security committee are concerned that this makes us vulnerable to terrorists. you say we should not be so worried. why not? >> what makes us vulnerable to terrorists is the stuck on stupid gun-free zones that have turned into the mass murder zones of our country. every place we've had a mass murder has been a gun-free zone, including fort hood. all of this measure talks about is not really even enabling people to defend themselves, it simply says that in a locked bag they can carry their firearm the way they do on an airplane, what we really need to do is to pass concealed carry legislation that enables people to treat their concealed carry firearm like their driver's license, we don't have to get a new example every time we go into a new state with our driver's license and the same thing should be the case with our concealed carry permits. >> paul, needless to say this does concern you. tell us why. >> a number of concerns here. after 9/11, amtrak decided that our train system, our rail system might well be a terrorist target in in country and they changed the rules. after terrorists actually struck in train stations in madrid and then in mumbai, they make the rules more serious, they didn't want people to be able to put, checked firearms on to our trains. one of the main reasons being we don't have separate baggage compartments that are not available to the passengers like in airplanes. >> right. >> we don't have a place to check these like they're secure for our airports. i think only 30% of the amtrak stayings even have a separate area where you would check or pick up baggage. so, this is another opportunity for terrorists and since 9/11, just as we heard in the previous discussion, we ought to be concerned about doing these things. this bill passed with no hearings, this bill passed with amtrak opposed and with homeland security opposed and i think before we rush in and push more guns in more places like larry likes to do we ought to talk about what's actually going to make us safer and more secure. >> we're about out of time. i want to ask you about what paul said. the estimates are 30%, that's it, 30% of amtrak stations have the capacity it even check luggage. so isn't this a free pass to have a gun right by your side aboard an amtrak train? >> that already exists, what we should be doing is encouraging the law abiding to carry their guns with them. the criminals always have their guns no matter what the law. >> it's-- when we saw those police officers shot in washington, that wasn't a gun-free zone. more guns doesn't make us safer. we do need to look at the homeland security aspects here. >> let's disarm the police, too, is that your idea, paul? >> of course not, we need a strong police department. but when we come to guns, too often, too often people don't think about terror, you can be on the terrorist watch list and buy a gun in this country. that's how ridiculous-- >> many weekends and this morning-- they're working 13 straight days, alisyn. >> well, they're promising to look at a loophole in the senate health care bill that would allow insurers to cap benefits to those who need it most, like cancer and heart patients. caroline shively joins us from washington to tell us what's going on. tell us about the loophole. sure, it's reading right now. the senate bars insurance companies from putting lifetime limits on dollars and treatment. there's a cap in there as long as it's not quote, unreasonable. the administration foreclosures decides what is unreasonable. the loophole was apparently put in behind closed doors when the bills were merged. the thinking is you need the limits to prevent the premiums from skyrocketing for all americans. the national cancer society says that insurance is there to help people when they get catastrophic illnesses, they spoke to senior white house and congressional staff and now feel this confident this loophole will be closed. people with cancer are encouraged their concerns have been heard about a provision currently in the senate health care reform bill that could subject patience it a termination of coverage for critical care. that appears to be resolved. here is a problem that may have some staying power. for medicare and medicaid services said that yesterday national health spending would actually go ununder the health care bill. the senator said from 2010 to 2019 the bill would push the cost up by 234 billion dollars more than under current law and senate majority leader harry reid says the same report would extend the medicare interests fund by nine years. dave, alisyn and clayton, back to you. my head is spinning, caroline. >> for all of you, sorry, dave, who cheered when the house of representatives took federal funding away from acorn after those surreptitious videos were reviewed. >> the pimps and the prostitutes. >> you'll recognize these. >> today you'll have something not to cheer about. >> you might be booing about this. it turns out acorn gets to keep all that federal money, federal judge ruled that it's unconstitutional when the house barred acorn from receiving federal money. here is a quote from the judge, they have been singled out by congress for punishment that directly and immediately affects their ability to continue to obtain federal funding. in the absence of an administration process adjudicating guilt. >> and the process is the contracts had been written, they were contracts in process and the contracts then need to be honored and bertha lewis of course the head of acorn had this to say. today's ruling is a victory for the constitutional rights for all americans and for the citizens who work through acorn to improve their communities and promote responsible lending and home ownership. >> basically they said that congress is not able to act as judge. jury and executioner because of separation of powers. congress can't just decide this without a trial. without acorn ever being fully adjudicated so they overstepped their bounds which means that federal dollars will still now go to acorn. >> currently, i'm just curious about the future. currently the contracts with congress, are they going to forget these things come up for vote. we'll see. >> there are lots of investigations in various states going on about acorn, start with a fox news alert. you're looking at new video of thousands of people protesting in the streets of copenhagen: copenhagen of course the site of the climate summit. protest the ordinanced around the world for a fair and binding new global deal to tackle climate change and the protests are timed to mark the halfway point of the climate summit. and another fox news alert. a senior al-qaeda operations planner has been killed in an american drone missile strike in pakistan according to u.s. counter terrorist officials. he is suspected of being involved in plotting attacks against the u.s. and europe. another developing story this morning is in iran, iran is now signaling that it will go long with the u.n. proposal to swap a 2600 pounds of its enriched uranium from nuclear fuel rods that's according to the country's foreign minister, but he adds the country will stick to its own timetable and the u.s. and allies are unlikely to accept a long drawnout exchange in stages. officials say it will allow iran too much time to enrich uranium inside the country and to possibly build a weapon. ford is teaming up with virginia tech to improve vehicle safety for pregnant women. the two are working to develop a computer model for pregnant woman for crash test simulation. the model could help safety instructors how it better impacts pregnant women and their fetuses. more than 300 unborn babies are killed in car crashes every year. two suspected drunk drivers collide on a freeway near los angeles, it's all caught on videotape. this started when one driver got into an accident and the huge impact left that car sitting duck in the middle after busy freeway. that's when the second suspected drunk driver slammed into the first car. one of the three people inside the cars was hurt and taken to the hospital. the two drivers, a man and woman were booked for driving under the influence. while whitney houston and britney spears are teammates. at my alma mater. britney spears kids out here prepared for how to talk to santa. the first thing you is say, an interesting equation in terms of how much of the year you have to be nice and how much you can be naughty, what's your formula for this? >> well, i say you have to-- and if you're nice more than 75% of the time, you're probably going to end up on santa's nice list. if not, you have a good chance of being maybe on his naughty list. >> that's doable. you know, if you can be naughty 25% of the year and still get prints, that's doable. being nice, let's talk about what you say are important factors there. define being nice. what do you have to do? >> you, i call it the wba, and that's without being asked. because parents aren't going it be that happy if they have to ask you to do everything. like, go clean your room, go do the dishes, but if you like do laundry and you clean your room and you do your chores and you'll do all that stuff without being asked, that's what's going to make the parents report you to santa in a good way. >> i hope my kids are listening right now. meanwhile, you say don't try and catch santa on christmas eve or christmas morning. isn't that part of the fun? >> well, it's actually-- it could not end up part of the fun because there's a 9.999999999 chance that you will not catch santa. and santa won't come if you're out of bed. so, santa's like, he has to get on to other houses so he might as well just say, okay, they're out of bed i'm just going to go to the next house. >> give us the drill on christmas morning, all kids are itching to get out bed. what do you suggest? >> well, i would say if you like try your best to like wait until like 6 or 7 a.m. so that you don't have that cranky of parents, if you have cranky parents, it kind of-- the fun is kind of taken out of christmas morning. >> i'm familiar with that. >> or sending the youngest one to test the waters and come up and pat daddy's head and-- >> it sounds like you're speaking from experience?
