[captioning made possible by fox news channel] captioned by the national captioning institute --www.ncicap.org-- steve: a casual friday so that could explain why eric bolling is not wearing a necktie. actually never wear as necktie. he is in for brian kilmeade starting the weekend early. >> i never wear a tie, steve. if i did, i would definitely wear that tie. gretchen: sucking up already. steve: going to be a good three hours. gretchen: start the morning off with a fox news alert because overnight u.s. marines launched an all-out assault to take down the taliban in afghanistan. it's called operation angry cobra, the first major offensive since president obama announced his new strategy. 300 marines were dropped into what the military is calling a central strategically important area in helmand province. u.s. commanders say they are trying to cut off enemy supply and communication lines to the north. this as nato warns that sending more troops to afghanistan was no silver bullet. should prepare for a lengthy struggle. a taliban detainee claiming osama bin laden is alive. he saw him apparently in afghanistan. according to the bbc, the detain knee says he met bin laden numerous times. he also claims bin laden was seen crossing the border from pakistan in january or february. the al qaeda leader is allegedly hiding out in an area with a strong taliban presence. and at this very moment an italian jury deliberating the fate of an american student accused of killing her british roommate. a stipulation in the amman do knox case could come in the next few hours. pleading her case to an italian court saying she is afraid she will be branded a murderer. she and her boyfriend are accused of murder kircher. another person has already been convicted. the officers were supposed to be manning checkpoints for the state dinner that tareq and michaele salahi attended without invitation. a mistake was made letting the couple into the event. president obama says he still has 100% confidence in the agency. the salahis were not at the hearing. lawmakers say they may still subpoena the couple. more later in the hour with judge andrew napolitano. the earn andrews peephole saga deepens as search warrants are served at the headquarters of yahoo and google. investigators want to know if the man accused of stalking the sideline reporter also posted another video on flicker account. it belongs to michael barrett who is a suspect in the andrews case. steve: yesterday at this time we told you that -- yesterday afternoon there was scheduled a press conference at 2:30 in the afternoon. this rachel uchitel. she is the one that got everything started. apparently was going to dish on the relationship between her and tiger woods. and now the confer of the "new york post" today has got a story about how why at the last minute did they pull the plug on that particular press conference. well, to this story details how aparnghtly the night before she and tiger talked on the phone. also her agents and i should say her attorney, gloria al red and his agents and his lawyers and came to a deal. and she was going to apparently according to this get a lot of money to be quiet. gretchen: tichina he probably does not want to have any more stories coming out. steve: he is buying her off according to this. gretchen: i guess so. i want to ask the judge about this white house the white house crasher party. because he has an interesting article on fox news.com. what's the difference between bribery and this? and he says that there is a distinct difference in the sense that it's not extortion in this case but why? because it's an obvious payoff -- eric: gretchen at this point who cares. two other granted. probably -- gloria al red came out in the post i never spoke to tiger before. tiger flew her over to australia during a golf tournament. if i'm tiger, out. i have her, i have her, i have her. get it over with. move on. steve: i made a whole bunch of mistakes but i'm in constant -- now aapparently there is a report out that he is in marriage counseling. there is somebody who is at his house a couple times a day now where they are doing that. on the flip side of he is buying her silence story. there is a brand new story this morning on tmz that says she is not taking any money. she walked away from it and apparently she just wants to disappear for a little while. she says it has to do with fear and secrets. she knows a lot of secrets about his marriage, about other women. at the same time, they say that she is scared for her safety, sources do, because she knows specifics. she doesn't fear tiger. she fears all the other people caught in a very large net. that goes to your point. eric: there may be more. she may be one -- there is tiger. there is the guy from bones. there is a few others. she may be at the center -- gretchen: other disturbing story other reports out now that he is in negotiations with his wife to stay in the marriage by paying her millions of dollars. to me that's the most sexist thing i have ever hard in my life. first of all i don't even believe it's true. she would walked away with gazillion ifs she divorced him. why would she accept $5 million to stay in the marriage two more years? it's a sexist play. steve: i don't know about that apparently there are people who do these reupnups. she is being offered 5-million-dollar resigning bonus. she has a reit's nup with him. gretchen: that's worse than what happened to her in this marriage, to me. steve: if you are her,. gretchen: she already h. has can a zillions. brian. eric: she could have 1506789 michael jordan situation $160 million. bottom line it's all about the money. gretchen: i would say in that situation, you know what? let's work on our marriage, forget the money. let's work on our marriage and see if we can work this thing out. money muddies the whole thing. steve: gretch, she is obviously really mad at him. gretchen: money is not going to change what he did. steve: maybe -- absolutely not. it's going to keep her around, maybe. eric: if she stays will you agree it's all about the money? gretchen: it's true. i'm saying that's what is troubling to me today that i think it's sexist. and i think that this whole thing has nothing to do with money. eric: but if she stays it's not sexist, agreed? gretchen: probably. let's take a look what the neighbor is saying because this story is going on and on. apparently the neighbor is saying that tiger was sleeping? >> was he conscious? unconscious? >> at that point he was snoring. >> he was snoring? >> he was actually snoring. >> did she say anything now. >> no. i mean at this point she was actually very quiet and kind of in shock. >> you can describe any injuries that you saw? >> just the lacerations that were on his lip. >> upper lip or bottom lip? >> i couldn't -- >> you couldn't tell. >> between the two. >> between the two? was there a lot of blood? >> not a lot, not a lot. no. >> would be like if abloody nose or something like that. >> maybe if you might have bitten your lip or something like that. nothing on his shirt. nothing on his hands. i was holding him still at one point and i didn't get any blood on me whatsoever. steve: then he goes on to say that he was absolutely snoring in the middle of the road. and also apparently we're learning that tiger's mother and mother-in-law were in the house at the time that he decided to go for that 2:30 this the -- in the morning drive. gretchen: it's all messy. let's talk about something else that is happening today two. planes around thanksgiving time approaching denver november 23, 7:00 a.m. almost collided in the air. it looked as if they had collided. one was a united express plane. one a frontier airlines plane. and what the heck happened to make this situation get this close to having that many people potentially die? steve: they were within 200 feet separation plus about a mile away from each other. but that's just a couple of section. and so apparently what happened was air traffic controllers put then from tier jet into the same route as united express to line them up for landing. and suddenly because the air traffic controllers had given frontier pilots the wrong heading they were forcing them to make a u-turn putting them in the path of the united express. when that kind of thing happens suddenly all these bells and whistles go off in the cockpit. both pilots immediately took evasive action and steered themselves out of each other's way. eric: you have to wonder how many times this happens. this came out and air traffic controller said it's human air. nothing we can do about it. i have to think it happens every single day in major hubs. i have seen planes that look 1.7 miles away. they will cut underneath small planes. especially with the proliferation of small air. private planes. steve: there is no indication that anybody on board, aside from the pilots knew what happened. none the less the f.a.a. is doing an investigation. off to richmond, virginia, and a fellow has moved into a new house in the last year. 90-year-old retired colonel. he is amazing. there he is right there. 90 years old. he fought in three wars. world war ii, the korean conflict and vietnam. he also has a medal of honor. ever since he got out of the military, every morning he has raised an american flag in front of his house and at sun set he has brought it down. the problem was he has moved into this new neighborhood with one of those homeowners association covenants and rules and all sorts of stuff. and now he has got some problems. gretchen: complex of town houses. so apparently he applied for whatever kind of -- whatever he had to apply for to put up an american flag which on its face seems ridiculous last june. and then the board denied his q he says there has never been a day in my life or a place i have lived in my life that you couldn't fly the american flag. good point except now we live in 2009, almost 2010 where the american flag in america is under assault. eric: these ordinances are met to keep the aesthetic bought. one thing exempt from that should be the flag. steve: before he moved in, he said, look, i would like continue to stall a 21-foot flag pole in front of my house. and the homeowner's association came back and said we have got rules against that you cannot install the flag pole. we have no problem with the flag, they say. but we have a problem with the pole. he put it up none the less. he is a fighter. and now what he really needs is he needs them to grant a provision where he can keep the flag pole. eric: i think he needs judge napolitano. gretchen: we may get him on the case. the homeowner's association says: steve: i have got a message to the homeowner's association down there grant this american hero an exemption. he is a medal of honor winner. he is a special american. he has earned a flag pole in his front yard. eric: i would say he has earned it. i agree 100%. steve: i feel the same way. email us at friends@foxnews.com. gretchen: is the earth getting warmer? a scientist at the center of it all next. eric: guests on "fox & friends" ripping up aarp cards for month because they support the president's health care reform. now senator john mccain wants in on the action. we will explain. steve: it is being called climate gate controversy over leaked email that critics say the science behind global warming may have been exaggerated. next guest says these email are just the tip of the iceberg. eric: author of climate of extremes global warming science they don't want you to know and senior fellow of environmental studies at the cato institute. thanks for joining us. what exactly -- we heard about the stolen emails. >> the hacked. eric: the hacked emails. pretty telling, right, pat? >> it's very bad stuff. the stuff that's really bad is them trying to control what goes into the scientific literature. it's the cannon of science it would be somebody like say mark, john, luke. you can't put that in the bible otherwise we are not going to buy any bibles. steve: in the last 10 years we have heard through the mainstream media there are all these scientists who say that it is man that is causing this global warming. now there are these hacked emailings that show wait a minute some of these scientists who have been saying this all along have been behind the scenes do lewding to put that message out and maybe even doctoring some of the evidence. >> not even some of the scientists. some the big-name scientists were involved in trying to keep people out of the scientific literature. they would talk about if there is ever a freedom of information act request, if they ever find out that's true, i think i will destroy the file, meaning the data file that put together these global warming records. and they talk about all kinds of different things about how anybody's research who they don't agree with is not going to go into the literature. very, very bad stuff. eric: talk about what is at stake tens of billions if not hundreds of billions of dollars especially if we get a cap and trade bill down the road in the next couple of months or so. what is really at stake moneywise. >> the cap and trade is going to cost trillions and trillions of dollars. and, you know, i don't know how much this climate gate is going to influence it, but it's certainly going to probably sway a couple of people on capitol hill and the vote that would come out would be very, very close. steve: this has implications for every person on the planet. >> yes, it does. steve: extraordinarily yesterday barbara boxer is not concerned about what's in those hacked emails. she is just concerned that somebody stole them. she said you call it climate gate. i call it email theft gate. she wants the focus on finding who got the stuff. the whistle blower. >> that would be like somebody going after the person who leaked the pentagon papers. excuse me, it doesn't work that way. the information is out there. it's public. and it's very, very bad. eric: you know, when you think about a crime lab you think about contamination. a medical lab worried about contamination. going into copenhagen next week should we worry about contaminated data? >> well, the whole thing started because wouldn't let loose the climate data that made up these long-term weather records. people had been looking at them. i wrote a book about this. it looks to me that these records are being played with in a funny way. then you find email let's raise temperature 1500 dreadths of a degree to get rid of the blip cooling in the record. we going to do science that way. global policy that will effect everyone's life that way? gretchen: thank you, steve. president obama kicking off white house to main street jobs tour. today in allen town, pennsylvania. what will he need to do to get people oback to work? joining us now, two candidates for pennsylvania senate seat former chairman of the club for growth pat toomey joins us from philadelphia and joining us from washington is congressman joe sestak. good morning, gentlemen. >> good morning, gretchen is this a good thing for you in pennsylvania that president obama is coming there first. >> absolutely. any time you can have the president of the united states come to your state it's a good thing. i hope what he does is make sure that everybody knows that the great recession this past quarter with 3.5% g.d.p. growth has ended. is it still intense out there? absolutely. where do i want his focus? on small businesses. in the last recession, under george bush, 80% of all jobs were created by small business. so i hope he talks about tax incentives, tax cuts for small businesses. i hope he recognizes that in the past eight years under president bush the small business administration's budget was slashed 40%. let's get the small business administration's loans increased. at affordable rates. let's guarantee them up to 98% and 90% there is a lot to be done. gretchen congressman, you are sounding like a republican with tax cuts. pat too maniy, i'm kind of surprised to hear congressman sestak saying that here is what president obama said yesterday, productivity up, markets up, but businesses are skiddish to hire. why do you think they are skiddish to hire? >> there are a number of reasons. first i'm delighted that the president is coming to allen town, pennsylvania. i hope this marks a real shift in the focus of his administration to job growth because it should be item number one. i'm glad to hear joe talk about lowering the tax burden. the problem is that much of the agenda that joe is voting for and that president obama and nancy pelosi and harry reid are promoting raises taxes. the health care bill that they have voted for and is working its way through the senate imposes direct new taxes on workers. this cap and trade legislation dramatically raises the cost of all energy use. they are proposing tax increases on income on wages on capital, on business. this is no way to go. if this is a shift and they are going to come around and realize that we shouldn't impose these new costs. we shouldn't impose new taxes we have got to get spending under control because that's really driving -- ultimately it drives all these increases. hopefully we can make progress. i hope the president will be open. gretchen: do you know about a shift in the obama administration? they are going to stop the spending programs and listen to you? >> well, this is very interesting. because pat, who i have great respect for, sounds almost like appose at a time. back in 2002. he actually let the pay as you go rules go out the window and he, with his vote, let the national debt increase from $4.5 trillion to almost $10 trillion. gretchen: let's keep it about what is happening today which is 10.2 unemployment rate. >> absolutely. without a question. 10.2. if we had not done the economic stimulus bill, and we had not done tarp, we would have been at 12% unemployment. so what we do want to do is do those tax incentives. >> there is no way to back that up, joe. >> just a moment, pat. >> what we also have to do is recognize that we have 17 million -- excuse me, 27 million americans who are under employed or unemployed. and so the state budgets this year have fallen 9% in terms of revenues. so we also want to probably infuse to the states an equivalent amount of money so that they don't lay off education people or people that they are having in their workforce just as we get the small businesses to get job growth going again. it is about job growth. buff we can have not have more hemorrhaging of jobs. gretchen: pat tomby, i have got to give you another word. >> more spending we cannot afford. this government and joe's votes have created a 1.4 trillion-dollar deficit. serious bailouts of companies that misallocate resources. this chilling effect that is affecting potential employers and actual employers by the threat of higher taxes on wages. this huge new energy cost. this is a big part of the problem. i hope the president will get off this agenda and on to one that will really limit spending and the bailouts, lower taxes and lower this deficit so that we can have private sector led growth. gretchen: no doubt this is going to be the whole topic of conversation as the two of you go head to head for that senate seat in pennsylvania. thank you both for joining me this morning. >> thanks, gretchen, thanks pat. >> thanks for having me. eric: we have the maverick, advice for aarp members. >> take your aarp card, cut it in half, and send it back. they have betrayed you. eric: that's not an aarp card. more from senator john mccain on the other side of the break. check it out, latest installments from elf yourself. we are going to show you the rest of our video. eric: happy bitter to jay we jay-z, the wrapper, he is 39 today. gretchen: half past the hour. let's give a couple quick headlines for a friday. fox news alert. nato announcing this morning that 25 countries will send a total of 7,000 troops to afghanistan next year with more to come. this as secretary of state hillary clinton continues meetings today with nato foreign ministers in brussels. she expects more allied nations to lend military, civilian and financial support in afghanistan in order for the to skied must be a true effort. grech. steve: u.s. and russia reportedly close to signing a deal on stockpile epps with. both countries are working on details. the current treaty expires today. don't expect sides to have -- both sides don't expect any security problems. russia and the u.s. are the world's two largest atomic powers. eric: they spent three days trapped in the snow after chopping down a christmas tree in the oregon mountains. the experience hasn't stopped lee to venture back for another prized tree in the wilderness. the lees rushed home safely with this year's tree in tow after their car got stuck in the snow. keith revealed christmas lifts with gifts to help anymore in trouble next year. >> i want a flare gun, a snow shovel and real shoes. >> that's your christmas list? eric eric i do weather. steve: anybody can do weather. oh, wait a minute. eric: janice dean. steve: she is the weather machine. she does a great job. let's talk a little bit about. this they were debating health care yesterday in the u.s. senate. it's interesting because the democrats have been saying we really need to pass this. in the meantime the republicans are saying you have seen all these medicare reductions that they are going to be -- they are going to cut so much out of this. well, on wednesday, the aarp wrote to the rescue of democrats and said we support all of these cuts. and we do support what's going on with the health care. well, john mccain is on the side of, wait a minute, if you are doing the did you tellcuts, thar people will wind up with benefits. fewer people who are members of aarp. so he has this message for them yesterday. >> i say shame on the aarp. i say to my friends especially those who are under medicare advantage program that 330,000 in my state who admittedly they are going to cut their medicare advantage benefits, take your aarp card, cut it in half, and send it back. they have betrayed you. steve: ouch. gretchen: a lot of people have been saying that on our show because it seems like the aarp were flip flopping on their message. they used to be opposed to cuts now they are ok. take a look at other people who have been on our show who said yeah, i just might cut up my card, too. >> give it a go and see what happens. maybe. i may have tonight up biting it apart. i guess it is laminated but here you go. >> you can cut it in how many ever pieces you like. >> cutting up his aarp right here. steve: so somewhat john mccain says as we watched some of the aarp membership card destruction on our program is cut it up and then send it back to aarp. and say, hey, you have been betrayed me. >> the issue is that medicare advantage is going to cut about 150 billion out of medicare advantage. that's the competing insurance that's the supplemental insurance that a lot of the aarp people are competing with. aarp says if you cut medicare advantage, you are going to push all those people into aarp. gretchen: the other issue is aarp is the political organization now as opposed to just looking out for the best interest of all elderly people, there are politics involved. gretchen: going to your point, eric, the cuts are clear. and, yet, the ceo of aarp sent out a letter that said most importantly the legislation does not reduce any guaranteed medicare benefits. it's the key word there is guaranteed. eric: sure, because that medicare advantage is supplemental to medicare. if you want the additional coverage you go to advantage. right now it is subsidized by the government. if they pull that subsidy, it's going to raise the price of medicare advantage it's going to make aarp's supplemental more competitive. gretchen: there was another organization that decided to start a senior citizen's program. you remember we had them on the show? eric: we are joined by o.j.'s long time friend and producer norman pardo. thank you. let me get this straight. you were there for the years 2000 and forward. you documented a lot of his life. some of the partying he had done. his golf, et cetera, et cetera. you are putting together a fictional representation. a fiction, a movie with o.j. as the subject? >> actually, i wasn't really filming him golfing. i was his really promoter, manager. i put him out on the road and we continue d. different events all over the united states. during the events, i filmed the events. and when first started back in 2000 or maybe a little bit before that, i was doing it as a ohio state buckeyes. i -- filming it as a hobby. not as a documentary. in 2003-2004. we started changing direction of the film and what we were going to use the tapes for. gretchen: why did you change direction of the film? >> we weren't really planning a documentary. o.j. always told people it would be comical. we during a documentary called a day in the life. or we are doing a movie called whatever. he came one a different name every time because we never really named it i just wanted people to stay off guard on what i was doing. gretchen: called suspect 3. do you actually play out a murder scene in this documentary and a robbery scene? >> in the movie itself, the movie itself was started in 2006. before o.j. ever went to vegas. the movie is based exactly on what happened in vegas. it was based on that before he ever went there. so i shut down the filming of the movie because it became surreal. because the actual movie was based on what he did in vegas. gretchen: do you think this gave him the idea to do what can he in vegas? >> well, is he that way. he acts a lot. i do. i think that this partly was my fault. because he would have ran in there and they probably would say do like you are doing in the movie over there and maybe he did. my movie was started before o.j. was ever actually in vegas. and actually documented in the magazines because they had an article about the set being built for the o.j. thriller. eric: we have to get to this. a lot of people were frankly ticked off in 2006 when juice came out as pay purview watching oj party and crazy antics. many people thought he shouldn't fame from the infamy in the nicole brown being killed. where do the proceeds of this film go? >> well, in this case, tiger woods' lawyer approached -- apparently. we don't know this. we assume it's the case, approached ms. uchitel's lawyer and said is there a way to resolve this? uchitel is not going out there sand saying i'm going to say what i believe is the truth unless you pay me. the offer was from tiger. and the payment, if there was one, was voluntary. in the letterman case it was the other way around. it was unless you pay me, i'm going to go out there. so, the demand was from the person doing the threat and there was no voluntary payment. think of it this way. if you punched me in the foz and i sued you. and we agreed that my nose was worth $500, and you paid me and i stopped the lawsuit, that's a perfectly legitimate settlement of the dispute between us. we did it properly and we did it with lawyers. question, if you do it with lawyers, does that make it legal? afghanistan. according to the bbc he claims he met bin laden numerous times. also claims bin laden was seen crossing the border from pakistan to afghanistan back in january or february. the al qaeda leader is allegedly hiding out in a taliban strong hold. officials not yet verifying the suspect's claim. three secret service members now on leave in the wage of the white house party crashing scandal. officers supposed to be manning points. mark sullivan telling the congressional hearing that a mistake was made letting the couple into the event. but president obama says he still has 100% confidence in the agency. the salahis didn't show up at the hearing. lawmakers say they may subpoena the couple. fed reserve chair ben bernanke is at least partially to blame for the high unemployment rate the banking crisis, and all the bailouts. that's according to senators who grilled him yesterday at his confirmation hearing. bernanke is up for a second term. he defended his record. some the steps we have taken like the a.i.g. episode, for example, obviously have hurt the fed a lot, politically. we know that we did at this-i think that should just be proof that we did it for the good of the country. bernanke acknowledged making mistakes but insisted without the fed things would have been worse. most experts expect bernanke to be reconfirmed. some g.m. and chrysler dealers near you could be getting a break. this after both companies say they will reconsider decisions to close thousands of delearships across the country. it's not clear how many of the 3,000 delearships involved could actually be saved. both automakers took advantage of the chapter 11 bankruptcy process this year to weed out and cut dealers they say were not making money. all although a lot of them were wereiblable ones that were cut as well. those are your headlines. steve: coming up 35 minutes from now the department of labor is going to be releasing new unemployment numbers. it is not expected to have much good news and, in fact, the president yesterday was kind of tamping down any expectation things night be getting better. currently the unemployment officially stands at 10.2%. when you factor in unloiment and underemployment, it is closer to 18%, 19%, 20%. the key as was brought up yesterday at his jobs summit, eric, is people need jobs. where are the jobs? eric: the problem is we saw two days ago a report of private companies. we saw job losses 169,000. why is that important? well, it tells you that the rate is slowing. we are still loading jobs. we also found that the small businesses, the businesses of 50 employees and below were the hardest hit. they were losing by far the most amount of jobs. gretchen: so president obama commented yesterday on what will get businesses to hire again. then you are going to hear john boehner the republican congressman from ohio have a different reaction. >> and productivity is surging. companies are reporting profits. the stock market is up. but despite the progress we have made, many businesses are skill skiddish about hiring. >> with all of the tax increases that have been proposed this year, not yet enacted. employers don't know what the effective tax rate is going to be. as a result, you can't make a decision about reinvesting in your testimony. without having some idea of what that cost is going to be. steve: so yesterday the president had his jobs summit at the white house. today is he going to take it out to coal country in allen town, pennsylvania. of course eric thinks about this kind of stuff all day every day. eric you have a three-point plan for the president to consider. eric: it's a sad day for me, steve. it's my last day at fox. the president tapped me on the shoulder and said we need to create some jobs. bowling, i need you. three suggestions, mr. president. number one, $550 billion of the 787 billion-dollar stimulus plan is unspent so far. go to recovery got.gov. you will see that number for yourself. that means a half a trillion dollars could go back to the people that would give people the americans confidence. once you get confidence, you get trust. when you get trust, people will hire again. that's one. number two, renew the bush tax cuts. they are set to expire in about a year from right now. people are nervous. i'm talking confidence from anyone who owns a small business to a small employer to a medium sized employer. you renew those bush tax cuts again. you will start to hire. get the picture here so far. two suggestions to help hiring. and number three, for me a very, very big one. a lot of things. we talked to a lot of small business owners and they say one of the biggest expenses to them is health care. that's on their mind. front and center with the health care bill they expect their taxes to go up to pay for the health care bill. we can't afford it. and cap and trade number two, that would cost businesses a lot of money as well. drop cap and trade. drop health care. we can't afford both let alone one. both doesn't matter get rid of them. gretchen: chances of them listening to you eric bolling? >> zero. steve: they listen to you. will they do it? >> i will be back in a week. steve: come on back to the curvy couch. let's talk about something else we were talking about with pat michaels from the cato institute a half an hour ago. that is the so-called climate gate scandal where somebody, presumably a whistle blower hacked into one of the computers that has got all these email and data about global warming. and the research that the world community has been doing over the last number of 10 or 20 years or something like that. all the numbers and stuff like that. as it turns out, it looks as if there is a concerted effort on the part of some of these global warming activists who say we have got to stop burning fossil fuel to essentially doctor the information to make their case even though there is some evidence out there that flies in the face of what they are saying. gretchen: they called it research tricks. the pressing date tax squelching voices of dissent. those are charges the guy in charge of that et stepped down. here is what one of our guests had to say about it. >> some of the very very big named scientists were involved in trying to keep people out of the sign scientific literature. they would talk about if there is ever a freedom of information act request, if they ever find out that's true, i think i will destroy the file, meaning the data file that put together these global warming records. and they talk about all kinds of different things about how anybody's research who they don't agree with is not going to go on the literature. very, very bad stuff. gretchen: it's interesting because we have come so far along the road about believing in global warming. the media really jumped on board with this about 10 years ago. if you talk to the younger generation, they know all about what it means to be green. so could this all change now? we have got this climate summit coming up in copenhagen on monday. eric: keykioto expires. a lot of big money commitments. the u.s. should pony up 10, $20 billion to help developing nation develop cleaner fuels. this is bad idea. if nothing else, this should be a signal to obama who is going to thereby next week, hey, we are going to wait here. we are north going to sign any treaty right now. we are not sure exactly whether we have global warming, global cooling, climate change. listen, you know where i stand on this. i think we warm and we cool. it's the flow. steve: cycles. that's what a lot of meteorologists and climatologists think. meanwhile, what do you think? did scientists actually falsify stuff? let's go ahead and take a look. did scientists falsify research to support their observe theories on global warming? this is a brand new rasmussen poll. about 60% say somewhat likely. 3 a% very likely. 26% say not very likely. gretchen: in the spirit of firness i believe that question was asked before these emails were revealed. that poll number may actually be different now. eric: substantially higher? a lot of people who put him in the white house said, what are you doing here? his base is hacked off. >> yes. and this deadline is not doing it for them. i think that as we saw in the clip, this -- there is a lot of wiggle room. there should be. the president needs to make decisions and right choice. this is not something that is being done to keep the base happy. they are upset about this. they are not buying it. steve: colonel hunt, when you look at the numbers up at west point he announced 30,000. as you point out; he put more men and women on the ground there a while back. >> he put 20,000 marines there a month. he has also got crystal behind him and good generals on the ground. i think it's about right to get the job finally done over there. steve: we had admirable mullen, the chairman of the joint chiefs on this program yesterday. it's not a withdrawal date. it's a point of transition. we have pencilled that in where we are going to look at it at that point in july and decide whether or not things are going right. the strategy is working out. if it's not working out, is he going to say ok, let's go? >> i don't think so. we also had a point of withdrawal in the iraq war. had success in helmand province and the bush administration signed it with president of iraq and that seemed to work out. the date i think people are fixating for different reasons. not necessarily a bad thing. >> i disagree. and i rarely disagree with colonel hunt on anything. but i think it was a very political thing that he tried to do. i think he was trying to appease his base. i think lincoln is right. it didn't do the trick. getting up and giving a speech, he didn't mention the word victory in that speech. it was really all about i'm doing this but i really am a little uncomfortable. steve: he is out to win? >> he better be out to win. he has staked his reputation on that. democrats keep from looking like the antiwar party. steve: lincoln, there have been some who have made a big deal. 5,000 word speech and not once did he mention the word win. >> well, i think that's less of an issue. the more thing i'm concerned about he has backed himself into a corner. he does want to win or succeed betweens on what verb you want to use. the deadline time line makes that difficult. let's say we are in march of 2011. there is two scenarios, things are going very well. how can you get out now? >> well, i don't think any moment we can say at this time. things have gone pretty slowly. they have actually expected a much longer wait. there had been some question that the jury would ask for a little information. we can probably expect a verdict today. we will see what happens. amanda knox said yesterday she didn't want to be considered a killer. that she had this mask forced upon her. she was afraid about that. she will find out if the jury does think she is a killer. she came today arriving in the courtroom dressed just like she had been yesterday. she actually arrived in the same van as her former boyfriend. both of them charged with murder and sexual assault in the death of meredith kircher. that was amanda's british roommate here in perugia. both of them on a study abroad program. this is a very popular town for that. this trial with has been going on since january. it looks like we are at the end of it finally, guys, amanda knox's parents have followed this trial pretty closely spending a lot of money to come over here. we understand they are in perugia. they will be there for the verdict. a lot of emotion on both sides of the aisle here today. guys? >> they did. well, as i said, dana, he is always on his iphone. we teays him about that quite a bit. it was no surprise. it was a surprise that people didn't know it was going to happen but everyone had expected it from dana. and tracy responded well. so i think that's the key. she was a good sport about it. and, of course, joined right in with him. so, it was a fun time. we were kind of boring at our wedding. but they made it a fun one. steve: ok. so, dana, when i saw that video yesterday, i tout to myself now that's one of those guys who just is always twittering or tweeting or facebooking or something like that. >> i probably do more than he does. steve: really? >> yeah. >> we definitely both facebook, we both twitter. but not that much. we do have family scattered around the country and we use facebook a lot to communicate with them. since a lot of them were there, it certainly added to the whole sarcasm tongue in cheek thing making fun of people who do facebook. steve: were you changing your relationship status on facebook? gretchen: i loved them. ♪ gretchen: welcome back. faced with the highest unemployment in 26 years. president obama claims his stimulus package is creating or saving jobs. but, is his jobs summit the latest distraction from what some say are the failures of his administration? well, let's ask chairman of the republican national committee michael steele who i know disagrees with the president on this whole situation. so great to have you in the studio, by the way. >> good to be here, absolutely. gretchen: let's talk about this jobs summit because i know you were criticizing this as a pr stunt, this is the problem i have with it if you come into office saying the most important thing is to get the economy going, why don't you start with the one engine that will do that and that's small business? here we are 11 months into the administration, you are going to have a summit to talk about jobs creations after you have gone from 8% to now 10% unemployment? this is a summit that should have happened the second day he was in office. if you were serious about job creation. now, this is more of a pr opportunity now because the numbers have not moved. the jobs report is going to come out and show it's either still at 10.2 or gone up to 10.3. that's not the administration the administration thought we should be headed right now. >> president obama starts the white house to main street program. going to start in allen town, pennsylvania. he is going to talk about job creation. gretchen: he has hingted that he might have tax cuts for small businesses. do you take him at his word that he might actually do what some way would be republican move? >> ok. you are going to do tax cuts, that's great, mr. president. why don't we start by making the bush tax cuts permanent. the ones already in place. the ones that expire in about a year and a half. how can you talk about tax cuts when everything in your health care bill raises taxes on small business owners and makes it more difficult for them to be incentivised to go into the market place there are things that this administration says and then there is things that this administration does. i'm looking at what it is doing and what it has done. and all of that tells me they are not serious about job creation and tax cuts and creating those incentives because you are putting in place a cap and tax program. have you got a card check program. have you got a health care program, and you have taken over large sectors of our economy, banks, and the like that have the ability to stimulate small businesses. so, why don't you free up that capital and that credit by creating a panel of small business owners to go out there and do the things that they normally do to grow us out of a recession. gretchen: there would be a dichotomy in the message. because a lot of the president's plans right now talk about increasing spending. if he were to come out and talk about tax breaks for small businesses, people like you would jump right on that. >> exactly. increasing spending. now you are going to talk about tax cuts. gee, that's what you told us was creation deficit. oh, guess what, that's what we are doing. the reality of it is you need to cut the spending. you need to free up the marketplace by inserenity advising small businesses through tax cuts, keeping tax cuts already in place in place. drop the capital gains tax. let's lower unemployment tax. there are a lot of things this administration could be doing right now. gretchen: michael, on a scale of 1 to 10 the chances that those things are going to happen. >> zero. gretchen: have a fabulous weekend. good to see you here. >> great to see you. gretchen: two planes came so close together they actually merged on the radar how could that happen? no. they ask the wife. did you hit him with the golf club? yes. that's all it takes, that kind of perjury trap so that never should have happened. in terms of why the purported mistress canceled the press conference, i don't think it was anything so crude as tiger or his representative. steve: you don't think it was a shakedown. >> you wouldn't do it that way. you would do it far more subtle. tiger's representative would say to rachel i want to buy the rights to your life story. in other words, now i have exclusive rights to anything of all of sins, transgressions, your blessed events, whatever it is, now i own your story and you now have a contract turley obligation to remain silent. i think that's much more likely than either she says give me a million dollars or i will talk or tiger saying i will give you $5 if you don't talk. high stakes finance. this is big business. this is now a corporatization of all the sin in the book. gretchen: no matter -- whatever the words were, it's the same thing. she is going to be paid money. let me ask you though about the prenup with the wife. if it's true this part of the story is troubling to me today. apparently reports are saying and, again, i don't know if they are true or not, that tiger woods' wife has been offered more money to stay in the marriage. she doesn't need more money. shouldn't they just sit down and figure out whether or not they actually want to be married to each other first? >> isn't it ironic when you look at how beautiful this woman is compared to the so-called nightclub v.i.p. hostesses which is kind of like a legalized prostitution most often at the celebrity level. in terms of the renup why not. most prenups in a case like this where you have uneven relationship as post prenups have, you have a big super star and a nobody. however gorgeous she is basically. so what the prenup does is protect the somebody's fortune from the nobody. and i don't mean in any ways to regard her character as being less than his or anything. it's just their commercial value. he has a prenup to protect his fortune. he gives her the contract states you get $5 million. or you get $10 million if you stay a years. $15 million if you get children. >> it's all spelled out. >> all spelled out. nothing in a pre-up in, particularly one negotiated by the powerful figure that says if you cheat i get more money. that doesn't happen. eric: why even renegotiate the original agreement? >> michael douglas was a notorious cheater with a background not unlike mine back in the day. he marries catherine zeta zones much younger than myself as my wife is they negotiate a cheaters clause. in other words, if michael douglas after signing this contract marrying catherine zeta jones was to revert to his old habits. catherine has the option of divorce but also she gets a huge cash payout. i will bet you dollars to donuts she did not -- woods did not have that clause in their prenup. they are taking advantage of temporary leverage of tiger being embattled and him needing her to stand by his side to renegotiate the contract they had. eric: why does he need her. >> what if he loves her. he is the mother of her children. steve: he should have thought about that. >> men, don't. please. have you ever watched entourage. there are these celebrities have enablers surrounding them. -- semi pros. gretchen: she is also a gazillion narrow. >> why? gretchen: according to the prenup details that we have seen. why would she say yeah, i will take more money? that cheapens her side of the argument. >> well, you are talking morality and i think that that's a much different debate that we can have. tiger woods is worth over a billion dollars. there is no way on god's green earth that her prenup is giving her half of that. which is what the presumption would get half in most states the wife gets half in divorce. no way prenup gives her half. less than half. it's in her best interest to negotiate up to that 50% to. steve: to stick around. gretchen: what's the difference between 100 million and 300 million? >> there is a big difference. steve: or 20 million? eric: i'm still trying to figure out why has to do this geraldo? i understand why she wants to? steve: why does she want to renegotiate? >> take me to court. you said there is no grounds. >> with all due respect. i love my wife and nine years i have today towed the line. there are present of people in this land who want the image of being married without the responsibilities of being monogamous. that's not a news headline, that's the fact. eric: the image of being married guy best father? steve: toast. >> i believe the problem with tiger woods' situation now is you don't know how far his handlers enabled him. three women on the table now. what if it's 30? what if one of them is underage? what if one of them is married -- the serial revelations will continue to tarnish him. if he wins the u.s. open next year, people will be remembering that green jacket, not the -- steve: all right. -- ladies. let's talk a little bit about an incident just before thanksgiving. >> hopefully they are all ladies. gretchen: geraldo? steve: just at the last second he throws that in there. a couple days before thanksgiving, there is a report that apparently air traffic controllers accidentally essentially put two airplanes in the same approach and here we have got it was a frontier, it was a united express, i think. they were on the same thing. at the last second the air traffic controller told the top plane to make a u-turn and essentially drive within 200 feet horizontally of the other plane. and this is just one of those scary things. i wonder how often this happens. >> remember when my helicopter pilot got killed here at teterboro a few months back because the air traffic controller was talking love talk on the phone with his girlfriend at that time. you have a situation where since the strike of 1981 remember that during the reagan administration? gretchen is too young. gretchen: i remember it? >> i don't think the air traffic controllers have recovered from that strike. there were only 11,000 of them. they have say you can use twice as many. they get stressed out. work too many hours. make human errors. clearly this was a person who made a grievous error. the difference between this guy making an error and me at my desk putting a -- on a verb directly people can die. this is clear this is a stressed system. it's been stressed since 19 1. never recovered from the strike of the reagan administration and how they broke that union. and i think that when you go up there, it is, to a certain extent, still a crap shoot. eric: do we know that irtraffic controllers are allowed to have cell phones in the tower? you see people texting driving. >> excellent idea to ban them. clearly at teterboro the guy was on the phone. i'm not sure if it was the cell phone or land line. steve: it was not official business. >> it was clearly not official business. kind of business where you should make a very strict penalties if they do -- gretchen: you are talking about life and death. geraldo at large catch it on saturday and sunday night. come up on our show, what would you do if you were mad at your town? >> screwed by the town of carry, nc. steve: that's pretty strong. how does the town of carry feel about that? >> i got their attention -- i couldn't get their attention at all so i painted a sign on my house. i told them i was going to put the sign up there if they didn't do something. and they didn't do anything. so, i put it up. i finally got their attention. steve: yeah. so, mark, does it have to do -- the town is talking about imposing a fine on your client. mark, does it have to do with the fact that the message is what it is or is it that old sign order ordinance? they have got how big a sign can be. >> it's our argument base on content. it had said support the troops. we doubt they would have taken this action. the town intends it's a neutral sign ordinance and would have thean action no matter. what even if that's true the wall sign that mr. bowden has only two square feet about this big which you can't see from the road. we are arguing even if it's a a neutral ordinance still unconstitutional. gretchen: isn't the real issue for both of you that your house was damaged or your property was damaged? shouldn't you be fighting for the town to fix that? >> well, all they want to do is get the sign down. nothing has been mentioned about fixing my house or anything. gretchen: do you care about that? do you want your house fixed or is it more important to have your sign up. >> it doesn't look like either one is going to work, they didn't even know me until i put the sign up. steve: yeah. >> now i have their attention. steve: mark, what exactly what happened to the house that his, you know, brought this action? >> well, there was originally a road widening, then they increased the road and it raised it by about 6 feet and according to mr. bowden that's created some flooding. if you look in his basement there is feet and feet of water. and, like he said, he put the sign up, and that's what got the attention. so the sign is working. that's what the first amendment does. it shows that this is why you put a sign up. steve: of course now that the town is talking about slapping with you a fine, that hasn't started yet, thankfully. keep us posted guys, thank you very much. >> thank you. gretchen: is nasa in on the climate gate scandal? >> all right. tiger woods alleged affair may cost him big according to the daily beast. woods is paying his wife $5 million as a down payment to stay with him and renegotiating their prenuptial agreement for a huge payout if they stay together for another seven years. that's a big if. so can prenups be renegotiated? we are joined now by divorce attorney vickie ziegler. we have been hearing a lot about it. i talked to geraldo, i'm still trying to figure out, you know, there has to be something in it for both. i understand what's in it for elin woods, she wants more money. what's in it for tiger. >> i think it's about his p.r. image. at this point you want to make him look like the family man. is he going to do the right thing. do whatever it takes financially to make sure he she stays with him, stands by him and doesn't talk. there will definitely be a nondisclosure signed here which says i can't speak to nobody, no books, no media and see if we can keep this unit moving forward. eric: the bottom line is, you know, if wheaferg we heard is $20 million under the current prenup. sounds like a lot of money to be paid when we have already found out advertisers said you know what? it's a private matter. nike said there is not going to move away unless there is more to the story. >> let's go ba be to the first part of the question in 2004, 350 million. to give somebody 20 million for a 10 year marriage. he could be upwards of 5 or 600 million. eric: do you defend the divorcer or the divorceee because people would say hey, she signed the contract. she knew he was one of the world's best golfers at the time if not the best. she knew there was going to be a the love money. she signed it she will take 20. >> i think what tiger did is reprehensible. absolutely. we don't know if they still love each other or not. at the end of the day, as long as tiger is willing to renup, renegotiate and give her more money, that's the end of the deal. that's really about the children. keep the family unit together. these people are absolutely embarrassed. at the end of the day the scandal could be growing and mushrooming. we don't know one, two, three, five women. >> we will talk about that. cockroach theory. is it 3? is it 5? what do you think? >> purely speculation i would think there is probably 3 to 5 out there in the woodwork. everyone wants to make a dime off tiger. because he has been so scandalous and made mistakes? white house security. a lot of openings there. steve: this is a fox news alert. and there is some good news this morning. apparently this is -- you are about to hear the smallest job loss number in a very rng time. according to the department of labor, 11,000 american workers lost their job. it's terrible news for those 11,000, eric bolling from the fox business network but, none the less, for the last, what, year and something we have been talking about hundreds and hundreds of thousands. >> and january and february we almost had 800,000 job losses for the month. analysts were looking for about 120,000 job losses. we have lost 11. that's the good news. the bad news is see there at the bottom of the screen right there, november unemployment still stays at 10%. you are talking probably in the naked of 14 million people still out of work. gretchen: it went down from 10.2%. let's deal in chris wallace from washington to get his thoughts on this breaking news as it just comes in? >> eric is exactly right and knows more about it than what i do. the estimates have been 125,000 jobs loss. that's obviously no solace to those people that lost their job. it's a strategy for them. the fact that we lost that number of jobs is really an indication o-that the economic decline is slowing down. there had been some people here in washington that have predicted -- that do predict that, in fact, in december we will see positive job grote. and, again, you know it's still going to be tough on the millions that run employed and politically tough on democrats. if we begin to see positive job growth. that's a very positive message that the president and you can be sure that he will be emphasizing that when he goes out on jobs tour today in pennsylvania. steve: absolutely. chris, you saw the item in the "new york times" about a week or two, three weeks ago where they talked about underemployment and unemployment it's close to 18%, 19%, something like that. so many people are so fingerhut straighted there is no jonts they gave up or their benefits have run out so they are not reflected of in these numbers. that's correct. nerms of it elm who have given up and want to work much more hours than they are, having said that you have have got to work somewhere. >> when you talk about where half a million part-time wereed whoing their jobs and noun now gown to 11,000. that's a positive trend and you have to analyze it this way? eric: the dow is up about 113 points in less than four minutes. about four minutes since the number was released. chris, touch on that for a second. obama is going through pennsylvania on this main street job tour is this going to be the theme of the tour all day today? >> yes and. no obviously he is on the one hand say things are looking up. that we are doing better. on the other hand, we know -- we understand there are an awful lot of people unemployed and economy shaky and we have got to do more. what was really interesting, eric, about the jobs summit yesterday in washington was the president acknowledging that the government can't spend its way out of this recession and out of, you know, the jobs situation. i think you are going to see a much smaller, you know, it won't even be called a second stimulus but a much smaller more targeted series of jobs, programs but, you know, look, it's better to have good news today than bad news, think of what this would be if we were talking about another half million jobs and unemployment had gone to 10.5%? gretchen: no doubt. let's talk about something else we know something about since you are headquartered in washington where this happened and that's the gate crasher story. three secret service employees now have been put on at least temporary leave. i think they will still be paid but they could ultimately be fired. at the same time, the social director desiree rogers is not going to be called to testify, at least for now, unless she is subpoenaed. right? >> well, i think even if he is subpoenaed the white house says that they are going to invoke executive privilege. white house aides and we have seen this in every administration generally do not come down and talk to congress in the idea of separation of powers. in the end i think k. save the social secretary would have done more. ultimately the responsibility of the seat service. the secret service did have a lirs. >> hue hard is it to look at the list to say they aren't the list or not on the list. a social secretary as he'll he will many the odd thing about this because we all go to white house christmas parties if the past, i go to the check point crot service agent says hi, how are you. it f. they look at the listened you are if the on it they will let you go. gretchen: that's why this is so startling that this could actually happen. do you believe that the secret service should be penalized and the couple should be penalized? eric: that researcher chris horner, a senior fellow with the competitive enterprise institute and author of "red hot lies." thank you for joining us. give us your two cents. is any -- can we rely on any of this data anymore after what we have heard from the emails, et cetera? what can we trust now? >> probably just the satellite data which goes back 30 years, which was put up in place at great expense to you and me to response to the claimed consensus over man made global cooling. you can look at the satellite data. what nasa has has been doing seem sin larr to what is exposed in the u.k. when i first issued in free come of information act request. steven mcintyre saw nasa his taker about temperatures even in fact they were not going up. anyone with a pulse knows they have been going down. so he notified nasa. they corrected their temperature data for the u.s. without issuing a press release for once. and then a few days later went back in and refudged the numbers. so what we have been seeking is the underlying data, the computer code, annotations to the code. what are they using to constantly change historical data. what is was their inturning discussion about uh-o. nasa has been remarkably not forth coming. vitter and inhofe from louisiana and oklahoma sent a letter to the nasa inspector general saying guard these documents. don't destroy anything. don't be too british on this as they were caught doing. let's see what really went on. gretchen inspector general supposed to oversee. let's take a look at some of this data that you say has changed at nasa. 1998 was the hottest year in its record for the contiguous 48 states. is that true or did that change? >> they changed hottest -- they have changed the top three. well the entire ranking several times. so, their defense now, let's just resolve where we are now. they are claiming well, whatever rns it's just within a few hundredths of a degree to the 1930s. ok you proved too much. you are telling us now it's as hot as it was in the 193 0s. great. i fail to see the alarm. the trend is going down. what happened gretchen is they were adding different stations. they have been backing out high appear at this throughout record temperatures. hanging over a barbecue gill. gretchen: wife would nasa be involved in this whole media storm?
