>> eric: all right. the traveling continues. a lot of people have to get home. you gave us information on the delays. we'll check back with you, heather, to see what else is happening. thank you very much. >> thanks, jamie. >> jamie: okay. maria molina in the extreme weather center. it's been busy for her. i'm not sure she made it home. on top of this. this is a serious system. the doc said he could handle it but a lot of people won't be able to. concerns about heat and shovelling. in areas that hadn't seen snow in such a long time, how unusual is it? >> raleigh, north carolina, last time they had a white christmas was 1947. atlanta, georgia, 1882. we are looking at over 100 years of unusualty out of the storm system and powerful and strengthening. it is producing additional snowfall across eastern part of north carolina. we're starting to see some of that colder air move eastward, so that is changing the rain. you can see on on the salt lite radar, some of the rain changing over to snow. that is moving to the outer bank region. virginia beach, very unusual when you see snow on sandy beach. that is how unusual the storm system is. it's grazing the entire east coast here. we're seeing snow to the south of washington, d.c. also philly and new york city. not here yet, but guys, it's right outside. knocking on our door. that storm system will be bringing in a whole lot of snow. this isn't future radar. overnight tonight, 12:00 a.m. monday. we'll see snow falling from boston to new york and also in philadelphia. you can see it. very concentrated, just on the coach. as soon as you get to central pennsylvania, no snow falling out of the system. we will have lake effect snow starting to wrap around the system. as you get the moisture off the leak. by tuesday morning the storm should be out of the area but it will be windy out there, so i would not be surprised if we continue to see delays in and out of airport because of the wind. >> jamie: fantastic. we can take a look outside our building. in the studio it's balmy 70 degrees. snow has begun. >> it just got here. >> jamie: there are the snowflakes. a lot of people out and about. what we're telling you is true. be careful. as eric suggests, stay where you are and spend the day with us. maria, we'll check back with you. great job. thank you so much. >> eric: thank you, maria. in the high 70s in hawaii. that's where the first family is enjoying a quiet christmas. but also, they took part to say thanks to the marines and their families, for their service to their country. mike emanuel, live in honolulu with the president's weekend. mike, president called on miles per hours to support the troops. he and the family spent time with them. tell us about it. >> well, that's right, eric. the president and first lady casualty dressed, left the rental vacation home in hawaii and went to spend an hour with u.s. marines at the marine base near their home. marines took a break from some of their roast beef and mashed potatoes to pose for photos for the president and first lady. they asked the marines and their families about how what their christmas was like, what kind of gifts they got. who picked up babies, posed for photos. but all in all an opportunity to say thank you to the united states marines who have done a lot of heavy lifting since the 9/11 attacks. their families make a huge sacrifice as well. christmas day, the president and first lady went out there to say thank you, spend time, pose for pictures and share a little christmas joy with our men and women in uniform. >> eric: mike, the visit has become something of a tradition for them for christmas, hasn't it? >> it has. it was not a total surprise at all because this was the third christmas day in a row that the president and first lady have gone to that marine base, that particular mess hall to spend time with the u.s. marines. what is striking is how low key the president has been on this particular trip. typically we get to see him going out and doing things with his family. he really kept a low profile, only going to work out and going to the beach on the marine base. so this was an opportunity for him to emerge from what has been a low key and family operated private trip to spend a little time with the marines. third year in a row. so, you know, we'll be expecting next year on christmas day if he is here, we would expect he probably will go back and spend more quality time with the marines. eric? let me just say i got to go and call somebody to make sure they shovel my driveway, eric. >> eric: all right, mike. in hawaii, usually based by the white house in washington, d.c., where they've already been slammed with snow. good to see you. wonderful tribute also during the christmas weekend. >> thanks, buddy. stay safe in the snow. >> eric: do our best. stay home and watch fox news. >> jamie: palm trees behind you, mike. >> eric: right. >> jamie: medicare legislation that slipped under the radar is now in the open. according to a new report on january 1, the government will pay doctors who advice patients op end-of-life care. doug mcelway is live from the d.c. bureau for this important story. i thought that was taken out of healthcare law? >> it was taken out of the healthcare but it is making a comeback. a lot of democrats thought the administration would advance the agenda through rule as-making process. now we sigh it happen. they are resurrecting the end of life planning what republicans referred to as the death panels. it's appearing in a medicare rule that will pay doctors to advice patients on end-of-life care. the rule makes reference to an advanced directive in the case where an injury or illness causes the individual to be unable to make health decisions. when similar wording appeared in the house healthcare bill, republicans complained loudly and the democrats said it was grossly unfair. it led sarah palin to coin the phrase "death panels and" and it was removed from the bill that ultimately became law. back to you in new york. >> jamie: tell us about the timing, then, about this. >> you know, congress is out of session. people are on holiday. the president obviously as we have seen in hawaii right now. the author of this rule, congressman earl bloomenhauwer urged supporters not to make this public. he said we would ask that you not broadcast this accomplishment out to any of your lists, even if they are supporters. e-mails can too easily be forwarded, he said. >> jamie: all right, doug. thank you very much for the latest on that. we'll follow it. have a good day. >> thank you. >> jamie: take care. >> eric: the family of a murdered border agent sending a strong message to the white house. 40-year-old brian terry was killed with a gun battle with suspected criminals with arizona this month. homeland security secretary janet napolitano spoke out at his funeral last week but terry's family called the comments, "empty words." >> i talked to her, yeah. >> what did you say to her? >> i asked her about, you have to wake the man up in the white house. she said he has done more in the last two years than any other president. >> eric: has the president done more in the last two years? what can we expect from the next congress on immigration? richard, democratic consultant and former advisor to president hillary's campaign. and served as campaign manager for mike huckabee's bid. chip and richard, welcome to fox news channel on snowy sunday. chip, let me start with you. congress is going to tackle first, the issue of the children of illegal immigrants? >> well, i think what is going to happen here, you saw it in the lame duck with the dream act. i don't think that's what the new congress will attack. what i hope the republicans will do is find a common ground that everybody agrees on, securing the border with an immigration part of it, national security part of it. if we can take immigration in part, we can find things that work. america is still the police that everybody wants to come to. shining city on the hill. beacon of hope. it's country that people want to break in to, not break out of. we have to make sure we do this the right way to make sure that people know this is still the country that everybody wants to be in. >> eric: we've been trying to do it the right way for years and it hasn't happened. >> the problem i think the right way is do it by pieces of what we agree on. we agree to secure the border. let's get that done first. until we secure the border, nothing else matters. if we try to to do something domestic policy, the borders are wide open for people to come across. we tried to do this in huge pieces of legislation like democrats are trying to get a pathway to citizenship for people in this country illegally already. i think the republicans just want you to enforce the laws, secure the border and let's start where we agree and move from there. >> eric: richard, how do we move from there? what do we do? >> i think democrats are actually in agreement with rupert murdock. president of news corps and the owner of fox news who says there should be a pathway to citizenship. look, chip is right. there is general agreement that in an ideal world we'd secure the border, but everybody who looks at the issues find it to be a hallow suggestion, because the resources that it would take to line people up to secure the border and put up the fences, everybody says give a 50-foot fence, they'll get a 51-foot ladder. securing the border is part of it but not the only thing. if we wait to do that, we'll wait forever. again, this has to be bipartisan. dealing with entitlements. both parties have to lock arms because it's easy to demagogue the issue. politically, republicans need to make sure that they do something that is appropriate and not just demagoguing because we saw what happened when sharron angle ran the ads that were viciously anti-hispanic. that i think as much as anything got harry reid elected. we saw the same thing with meg whitman getting tripped up over the issue. politically, it'sy. this is something to thump your chest about securing the border again. it's hallow for the fastest growing part of the u.s. electorate. >> eric: what do you suggest that the republican congress next month, plus the democratic senate and democratic president can agree on? >> i think there are a few things. i think this dream act, if it hadn't been seen as a win for obama actually is something. that is the one where again, children, imagine you're a baby being brought across the border by parents illegally. you go to college, you serve in the military. and you say that should entitle you to citizenship. you're fighting to put your life on the line for the country. that's all that president obama was saying. i bet there aren't that many republicans if you gave them truth serum wouldn't say that yes, that's a sensible outcome. looking at employers, right? their only way to employ immigrants have incentive to come across the border is if they have jobs. the only way they have jobs is if employers look the other way. so we have what is called we verify to make sure that the employers are only hiring people that are themselves legal. if the word depose out that the illegals won't be hired they won't have insensitive to come. they have been coming in fewer numbers. >> eric: chip, the dream act was defeated. what would you suggest topic number one? >> well, i think topic number one still has to be secure the borders for national security. i don't think it's as hollow as it is. we should enforce laws on the books because we're not doing that now. you are talking about the employment act. there is no punishment if you get caught. they may say send them back and come back 30 days later, but the good news for g.o.p. is we have new representatives like david rivera from miami and marco rubio from florida. jamie herrera from washington state and hispanics folks elected to the congress and g.o.p. to bring leadership to the issue. i think we start out piece by piece to do it at all one time. >> eric: you hit something on the head. brian terry, the murdered border agent. he was allegedly killed, the suspect who was part of this was deported twice. had been in the maricopa county jail and deported from arizona. so there is a prime issue there number one of where this system is failing. even though the homeland security secretary says the president has done more than any other president. do you agree with that, chip? >> i don't. i think that we have not enforced our borders. we're not enforcing our current laws on the books. like i've been on the border. it 300, 400 people they catch every night. they send them away the next day with a summons to appear in court in 30 days. let's say they don't always come back in 30 days and they are in another part of the country. we have to enforce our laws and borders and job number one for the congress. >> eric: richard, that is like fishing. catch and release. >> eric, it's undeniable, if you ask about the facts the facts are illegal immigration are down in the past year, that the resources invested in protecting the border is up. number of troops deployed on the border is up. so has the president done more, absolutely -- it's undeniable. are there horror stories like the one you reported, absolutely. they tear at your hereto strings. there is nothing you can say to the family to give them any kind of hope their loved one is gone. but that's not, there are 12 million people by most estimates who are in this country illegally. the notion that somehow or another we're supposed to wa -- murdock saying give them pathway to citizenship and notion we do nothing until the border is secured i don't think is something we believe that five or ten years from now will be appreciably different than it is today. >> eric: richard, and chip, very volatile and emotional issue. thank you for being with us with the new congress. thank you for joining us on the holiday weekend. jamie? >> jamie: right now the massive winter storm is roaring up the east coast. we're not exaggerating. take a look at new york city. moments ago, nothing. now the snow is falling. it's going to get worse. several states declaring a state of emergency. a mess on the roads, the rails, hundreds of flights grounded. more expected. coming up, we'll have the latest on airport delays and also a special that is going to tell you how to ma mover in you're traveling, and surprise for a couple who find a thief in their driveway. what happened when the 79-year-old husband came face-to-face with an intruder? it wasn't santa. >> reached for a tire aaron in the back of the car and said, "i'm going to hurt you, old man." stella: hmmm. we're getting new medicare benefits from the new healthcare law. jane: yea. most people will get free cancer screenings. and 50 percent off of brand name prescription drugs if you're in the donut hole. stella: you read my paper. jane: i went to medicare.gov. it's open enrollment, you know. so i checked out all the options and found a better plan to fit my budget. stella: well, you know what they say...knowledge... jane: knowledge is power. >> a particular thief we're going to tell you about. boy, did he pick the wrong guy to mess with. they came home to find the guy robbing their home. tom approached the much younger man and a fight broke out. >> he got the better of me. i was on the bottom of the snow pile right here. i kept grabbing his legs and tripping him. then i was on top. i kept hitting him, trying to keep him occupied where my wife could successfully get the telephone and get this guy down. i was scared for his life because that kid was so much younger. he was throwing him around and along with my husband throwing the other guy around. >> jamie: we were worried, too! way to go, tom. the thief did manage to escape initially and drive away, but by the time the police showed up near the scene, he caught the crook and crashed the get-away car. >> eric: continuing to follow the massive northeast storm up the coast right now. blizzard warnings are up for new jersey, new york, parts of massachusetts. they expect up to two feet of snow to fall in some places and take a look at the south. that storm is going up the east coast. you are looking at the video we've gotten from north carolina. just one of several states that are under a state of emergency right now. unusual for the south to get hit like this. kevin holmes with our fox affiliate in north carolina. man, did you expect to be dressed like this on a sunday? >> no. this is not typical for north carolina. not by any stretch. we have had six inches and we're expecting ten inches by the time it's done. i'm 6'3" and the snow nearly comes up to my knees, and the snow is of the packing, sticking type. we are here along busy intersections. highway 64 and i-95. i-95, the traffic moving slowly. northbound, a short while ago because there was a jackknifed semi-truck. there were accidents statewide, 8 4r0 statewide. there have been 850 flights delayed. it's a busy day for the crew s as the crews are out shovelling the roads. but as soon as they do, the snowfall hits again. never ending for the crews in rocky mountain north carolina. >> eric: thank you so much. we have a preview of what we expect northeast sunday afternoon and monday. best advice is if you don't have to go out don't. stay home and enjoy the holidays. kevin holmes in north carolina. >> jamie: i don't think he's dressed warm enough to be honest. the nasty weather is making the post holiday travel difficult for east coast. if you trying to get through you know what i'm saying but you can expect blizzard conditions. up to two feet of snow. paralyzing the airports. delta airlines canceling 850 flights. could be more. continental canning at least 250. american airlines scrapping all flights through washington, baltimore and philadelphia later this afternoon. that is what they are telling us. joining me now on the phone, chris mcginnis, director of love the name, travel skills group. that is what we need. skills. if you're headed to airport or rail station, what do you need to know? >> check with the airline and get online to find out what is going on with your flight. if your flight is canceled or significantly delayed and you decide you want to bag the whole trip and you don't want to go, they will cancel the trip. the other thing they're doing is if you want to delay the trip and travel anytime between tomorrow and the 29th of december, at least that's what delta is doing right now. they will waive the change fee. they will typically charge $150 to make changes to itinerary. they're asking if you don't come to the airport at all and get online and change itinerary and you won't be assessed that fee. >> jamie: i guess you could use it to your advantage, avoid delay, but historically are airlines doing more for you since it's mother nature at fault than them, than in the past? >> they consider this an act of god. they don't feel like they have to do that much. in the past, they put people in hotels. they do it now but only for the best customers. people on the first and business class fares, that kind of thing. regular coach passenger can't expect that much out of the airline. it's not their fault. you can't blame them. in the past they would have passed out meal vouchers but they're a little less generous with that. just don't go to the airport at all if you can. stay home and change itinerary on the website. >> jamie: if you can get on. what delays are people seeing with the website access and phone center s? are they able to get through today? >> yeah, i'm on delta right now. make a change on delta.com. that is the best way. you can try to call. but have something to do if you're on hold. this affects largest airports, from baltimore and washington, to boston. blizzard conditions and that stuff. be a big mess. >> jamie: what is fascinating to me is atlanta hartsfield. not just today but yesterday. seeing snow. one of delta's biggest hubs. are the airlines reprayered for the flood of calls and retrafficking? how long will this event, snowfall, not being funny but could it lead to the new year's holiday now even with people trying to get back from europe or trying to get there? >> a lot of delays and people displayed several days. today is a busy day and next week it's sunday and monday. so today and tomorrow since we have so many people display displayed a little wiggle room to reaccommodate folks but flight to get on the next flight out, that we did when airlines were 60-70% full. that's not the case. if you miss the flight before, the delays are getting worse because the flights are full. >> jamie: there are less flights going the places we want to go than they ever did. chris mcginnis from travel skills group. we hope the tips help you out today. take it slow. eric? >> eric: one year after the failed christmas day plane bombing are we safer in the sk sky? up next, former security expert and insider mike baker weighs in. if the patdown and body scans will work. >> eric: bottom of the hour. time for the stories, aside from the east coast blizzard we're following. tragic bus accident in egypt killed eight tourists. 21 others were injured in the crash when the bus slammed in a truck. no word where they're from. dutch police arrested 192 somali member on suspicion of planning terrorist attack. somali teens from minnesota suspected of recruiting groups to return to somalia for jihad. debris and glass to the streets. >> jamie: president obama's homeland security chief defending airport security. janet napolitano saying the t.s.a. pat-down and body scanners make the air travel safer. also dismissing a new report that claimed that major airport airports they flunk tests at 70% to fail to catch items that were banned. like weapons and such. this comes as the plane bombing attempt by umar farouk abdulmutallab. are we safer when we travel and what needs to happen to make us as safe as we can be? mike baker former cia officer and president of a firm diligence llc that's what we went, diligence. napolitano dismissing the report that pilot in san francisco takes home movie of flaws at the san francisco airport has his firearm seized, one that has been approved to carry in the cockpit. what is going on here? how do we improve security? >> terrific questions but we have the blizzard so we have to get on the road. we have overreliance on technology. there is an inability to have discussion of enhapsing security procedures through judicious use of profiling. as long as we don't have common sense approach of doing things we have reliance on technology. this is the weakest link in the technology chain, humans. there is a gap between ability of t.s.a. to operate in a different functional and efficient manner. the way perceive this, like why isn't this working? >> jamie: clearly there is profiling and we'll never get it per fect -- i hate to to ask the questions so we don't give away information. but how comfortable are you with flying right now? >> very comfortable. you keep busy living. you can't let it stop you to get on with your life. i am comfortable with the system and efforts made to try to stay ahead of the curve. but i have a healthy risk appetite. it may be different from those in the country saying i fly once a year and not comfortable with what i'm hearing. >> jamie: that is interesting. could there be extra training for t.s.a.? stay leave technology in, it's a start but beef up t.s.a. ability to look in the eye and know whether or not you have a motive to kill? >> absolutely. technology is not going to solve this problem alone. there was the protests and not just from the left who are decrying about the civil liberties. intrusion on privacy. give general public credit because they knew scanners were not used in common sense fashion. we know where the threat is coming from. it's not rocket science. we had arrest in u.k. of bangladeshi and pakistani youth. time and time again. >> jamie: not to mention home grown. >> and home grown because we know that al-qaeda is aggressive and consistent in the effort to recruit people they bring in the fold. they look at people alienated and effected. we have that effort out there. with technology and to the point of t.s.a. we have to, if we want to use judicious meth of profiling, we have to train up the personnel. >> jamie: they want to do the best they can. i'll sneak in another question. new study and homeland security committee, we're told by congressman peter king taking over as chair that will put the c.i.a., f.b.i. and the homeland security authorities together to improve communication and look at the home group radicalization. how is the communication between agencies? have we learned anything since last december 2k5 with the terror scare we had in detroit. are we any better to get the agencies to work together? we learn committees don't solve things necessarily by themselves. the communication is vastly improved where it was prior to and an after 9/11 and has been a continuual improvement. i go to the same thing, where counter terrorism effort and never going to get risk to zero. but the ability to pass intelligence from the various organizations we're improved from a year or two ago. >> jamie: that is comforting. as you travel through the airport or railways today or any day, if you see something you say something. i said it before this weekend but never hurts. thank you so much. mike baker, good insight. i appreciate it. >> happy holidays. >> jamie: take care. >> eric: peace deal between israel and the palestinians far from agreement. the talks ereplaced by the rocket fire and airstrikes. now have israeli minister is warning what could happen next year if the settlement is not broken. we talk to dan gillerman who will be here right after the break. my washer had a foul odor that made the whole room stink. even my laundry started to get a funny smell. in your high-efficiency washer? joining us dan gillerman, former israeli ambassador to the united nations and a fox news contributor. ambassador, good to see you. welcome. >> thank you. happy christmas. >> eric: thank you. what is next? stalemate, seems to go nowhere. what breaks? >> what you are reporting and we're witnessing as possible problem. israelis talk too much. palestinians do. and the public debate is being a problem. this should be discreetly done, behind closed doors. all the talk is getting us nowhere. two things in life one should not do in public. make love and make peace. both cases, it ber to have the eyes slightly closed and the light slightly dimmed. the program for two yearses has been public. they made a mistake with the palestinians on a high tree and running away with the ladder. mahmoud abbas is saying why should i be more palestinian than president of united states? >> eric: some say that benjamin netanyahu, they should stop the settlement and have a freeze. >> they should freeze settlement for ten months. babies can be born in nine months. but palestinians did not come to the table. they came two weeks before the end of this and used it to leave table again. so one has to understand that the settlement is not the problem. problem is settlement. once there is a settlement, it's clear it won't be a problem. >> eric: how do we get there? it's almost within the grasp yet it's fleeting and escapes. hamas with more rockets from gaza from israel. >> this is the problem. we have spoilers and row regimes trying to spoil us. if we want peace, we need to get together and dish out settlement which everybody knows will look like. we know the time settlement is going to be similar to what president and prime minister offered up ten years ago. the process is going nowhere. get down seriously. all the talk about the palestinians declaring state, is ridiculous. they can declare but it's declaration. the state itself is never going to be viable unless it is recognized by israel and lives peacefully and in prosperity next to israel. solution is two state solution, or three state solution. what we need to do is also to get the muslim, arab world to legitimize the process and get them to do it. then we have a two state solution but 23-state solution. peace and stability and security between israel and the whole arab world, which will make the region a great place to live. >> eric: hillary clinton said they put one-year deadline on this a few months ago and the clock is ticking. sadly, do you expect this to continue on and on until there is a breakthrough? >> with all respect to secretary clinton and i think she is doing a great job and i think she wants it very badly, putting deadlines on this is another mistake. the deadline should be the day you make a deal. counting it and using a stopwatch is a mistake. even knows more or less what the borders will look like. core issues have been dealt with. all it takes a great and courageous palestinian and israeli leader. i assure you that palestinians with the present leadership will come forward and say let's go for it. they'll find government, partner to go with them a long way to solve the problem once and for all. to make the region. peaceful one. we saw on fox, bethlehem illustrate how to live together in the spirit of christmas. coming years. hope coming year will be a year where finally peace will prevail. >> eric: thoughts and prayers for millions have been on the issue. there could be middle east peace. ambassador, thank you for joining us. >> thank you. merry christmas and happy new year. >> eric: you too, sir. thank you. >> jamie: gentlemen, thank you very much. today there are new concerns raised about the security in pakistan. after a deadly homicide bombing. is that country doing enough to fight the taliban? i'm just the 800-pound gorilla in the room. don't worry. i'm here. want guaranteed income for life? axa equitable is redefining what you expect from annuities. ooh, peanuts. >> welcome back. there are new fears and growing whether pakistani forces can fight off the taliban. a female homicide bomber killing dozens of people, rare indeed, near the border. they are amending the pakistan counterinsurgency. which is it? how will it impact the war on terror? joining us is the fox news military analyst, major general bob scales. good to see you. good morning. >> good morning. >> jamie: we cringe when the violence happens, especially so close to the border because it could spill over to where the troops are. >> how serious is the event?
