this is only the first -- emphasize this is the first day of the four-day procedure to replace the cap. if it goes according to plan, b.p. officials believe the cap will contain all of the oil leaking out of that well at the bottom of the gulf of mexico. during the procedure while they exchange the cap, oil will leak from the well unchecked. estimated many as 5 million gallons. b.p. says well over 500 skimmers are in the gulf of mexico right now. 46 of the skimmers in the immediate site of the leaking well. later, they hope to have a ship called the helix producer recovering oil in that area. that is capable of recovering up to 25,000 barrels of oil a day. still, that's only a fraction of the entire estimated leak. a lot of hope on the new plan, but they're expressing cautious optimism in the obama administration. listen. >> we're reasonably confident but this is uncharted waters, no pun intended. our scientists, dr. chu and others are spending time with them around the decision to take the cap off. >> reporter: federal officials talk about the cap and enemphasize the term "contain" and not stop. it's a cap that is likely to direct the flow of oil, to ships on the surface, so while no oil may be leaking out of the containment effort, not leaking in the gulf of mexico, the oil is still flowing. as far as permanently stopping the leak, it's the process of drilling in the gulf of mexico deep beneath the ocean floor. the first is not expected to be complete until late this month, possibly the middle of next month. only then will b.p. plug the well once and for all with a combination of mud and cement. you come back to the live shot here on grand isle, you can see all of the extensive booming efforts going on here. panning over here, you can see vehicles on the beach and you crews are taking a break and expected to be here shortly to keep the oil off the beach. even after the b.p. is able to finally plug the well, scenes like this likely to be common sight in months ahead because of the oil that's already leaked in the gulf of mexico. >> maybe for months and years to come. thank you for the update. fishermen in the gulf are angry and they packed a meeting to voice their disapproval of the claims process. the attorney representing the folks says he is trying to figure out why checks from b.p. are being held up. scott mitchell is one of the fishermen and he says it's time for b.p. to pay. >> you look at -- >> talking $60 million for advertisement to talk about how good they are and stuff like that. they certainly ought to be paying us, what we deserve. >> in the meantime, the federal government insists seafood from the gulf is safe to eat. about 400 samples have been chemically tested and officials say so far none show elevated level of contaminants. an air france jet made emergency landing last night after a bomb threat was phoned in authorities. it took off from brazil and was headed to paris but was forced to head back to brazil to land. authorities are still investigating the source of the bomb threat. all 423 people on board were safely evacuated. the plane was on the same route that another air france jet was taking last june when it exploded over the coast of brazil, killing everyone on board. this afternoon, two former underdogs will battle for one of the most coveted titles. either spain or the netherlandses he be crowned at the world cup final in johannesburg, south africa. neither country won the cup before. in the 80-year history of the game, only seven nations lifted the trophy. the oracle has spoken. uraguay and claimed third place. nice job. arizona controversial immigration law set to go into effect july 29. the obama administration filed a lawsuit to stop it. today, the white house officials aren't ruling out even more lawsuits. malini wilkes is live in washington with the latest. >> reporter: on the sunday talk shows top officials defended the lawsuit filed last week against the arizona immigration law and did not rule out second lawsuit if there is evidence of racial profiling in the future. arizona law allows police to question someone's immigration status in enforcement of other laws. they argued that saying that they're allowing federal authority to determine immigration policy. if the law takes place as scheduled july 29, the attorney general says he will be watching for evidence of racial profiling. >> six months from now, year from now, we might not look at the impact of the law to see whether or not there has been racial profiling impact. if that was the case, we would have the tools and we would bring suit on that basis. >> reporter: on "fox news sunday," david axelrod defended the administration's effort to control the border and said no administration has gone after employers of illegal workers more aggressively and there is more manpower on the border, with more drones, helicopters and airplanes. republican senator jon kyl of arizona says it's still not enough. >> there have been improvements. there have been additional people sent to the border. and nobody would deny there is a federal government effort going on here. but it's not enough. because you still have about a half of a million illegal immigrants crossing the border every year. >> reporter: kyl says the federal government failed to control the border and what arizona's law tries to do is lend its law enforcement official to the effort. >> thank you very much. this is a fox news alert. colton harris moore, the so-called barefoot bandit, a u.s. teenager who allegedly stole cars, boat and an airplane. he eludded law enforcement for two years and we're told he is arrested in the bahamas. we're waiting for a press conference to begin there and peter doocy has been following the story all weekend and will update us later in the show as we keep an eye on the press conference for more details. palestinian president mahmoud abbas said there is no point in holding direct talk with israel when it comes to peace. he is refusing to return to the negotiating table until there is a freeze on settlement building in the west bank. for now they're negotiating through the u.s. envoy george mitchell who will meet with abbas later this week. the white house and netanyahu are urging direct peace talks between israelis and palestinians, some are asking is hitting the restart button viable in this particular ongoing conflict? democratic congressman brian baird travelled to gaza more than any other member of congress and joins to us share his insight. thank you for coming in. >> great to be with you. >> tell us what you hear and see on the ground in gaza. >> the immediate situation after the bombing was horrific. hospitals burned, public infrastructure destroyed. commerce has picked up but it's been the black market commerce. meeting legitimate businesses are suffocated while the underground businesses, gift to extremists are prospering. more than that, people are not allowed freedom of movement. say if you have a child with brain cancer and they need to be treated in east jerusalem in the hospital, israelis are not allowing the parents to go with the children. 600,000 children live in gaza and they're virtually imprisoned. >> it's a delicate, sensitive situation, because israel has great concerns about their stated mission to destroy israel. it's tough when we talk about the situations impacting real families and people on the ground. this morning, benjamin netanyahu was on "fox news sunday" with chris wallace and talked about the fact he thinks now is a good time. there is an opportunity to reach out to president abbas. for some talks. but he says the president has to meet him halfway. he likened it to a trapeze artist who flies off but he has to to have somebody to catch him there. it sounds like president abbas at this point doesn't think it's a good time. >> the analogy would be pleasant if it were true. but the challenge is that israel continues to expand its occupation to palestinian territory. every day it does that, it makes viability of two-state solution more difficult. resolving this is in the fundamental national security interest of the united states of america. we have to do so in a way to show we're a fair and just arbiter. ally israel which receives billions of u.s. dollars frankly has not agreed with the fundamental national principles that you don't expand your occupation of another country and then say why don't you talk with us while we continue to expand? it would not be that difficult and israel would lose nothing if they said we'll free the settlements and that would be a sign of good face to allow abbas and the rest of the palestinian authority soto have good ground to negotiate. >> give you a chance to respond to this. benjamin netanyahu also said he put the ten-month moratorium there for the housing start, freeze on that in the west bank and he said it didn't entice in his opinion the palestinian authority to come to the table, so why should he extend it now? >> first, it wasn't real. the settlements continue to expand and in east jerusalem they tear down palestinian homes while allowing israeli settlement and expansion to continue. it's fine to say we put this on the table, but it was not real. the palestinians and the rest of the arab world -- remember, arab world has peace initiative to say we agree, 67 borders, shared capital with jerusalem and some compensation or right to return. everyone knows the latter will be negotiable but the israeli world and islamist world want to move forward with peace but you sant say we're working with you and we're taking your land. not credible. >> it will take many negotiations to solve, if ever. we will continue to watch that. thank you for sharing what you have seen on the ground, congressman. well, chris wallace's all-star line-up we mentioned included the exclusive interview with benjamin netanyahu. the "fox news sunday" anchor also sat down with david axelrod. here is a preview. you started out with one of the president top advisor david axelrod and got in the issue of the government now suing arizona over the immigration law. >> absolutely. it is interesting. he wasn't making a racial profiling case so much and the lawsuit makes no mention of that. they're focussing on the constitutional question, you can't, that the feds have supremacy when it comes to immigration policy, and as he said, and the president and holder has said you can't have a, "patchwork" of state and federal laws around the country. that's really hanging their hat on the narrow constitutional issue. part of the argument you can't argue racial profiling before the law has gone into effect and there hasn't been any real or imagined violation. >> you wanted to talk about the fact in his view the administration has done a lot to help out at the border. your other guest jon kyl may see it differently. >> in doing our research, there are cases to be made. the situation is not good. there are about a half a million illegals believed to be in arizona. and phoenix; particularly, has become the "kidnapping capital of the country," because of a lot of crime associated with the drug smuggling and human trafficking. on the other hand, so that is -- from that point of is a bad situation. no question that seizures of illicit cash, drugs, guns, all up. the number of illegals in arizona down about 22%. i suspect it has more to do with the economy and the fact that there aren't many jobs here, or as many jobs than it does with any efforts. there are two sides to the argument. and it will be fascinating to see. politically, the country by a margin of 2 to 1 overall favors the arizona law, favors the crackdown. but when it's hispanics are taken out, they oppose the law by a margin of 4 to 1. >> looking beyond the domestic issues and the big issues this week, internationally you sat down with prime minister benjamin netanyahu of israel. had a very interesting interview. you talked to him about threats from iran, whether they can be contained and about the nuclear program. he had strong words. >> he did. i asked him first of all about leon panetta, the c.i.a. director who a couple weeks ago asked about the sanctions whether they can make life difficult over the tougher sanctions but whether or not it will stop iran nuclear program, he said probably not. i asked can a nuclear iran, one that gets nuclear weapons be contained like russia was contained in the cold war? he said no, he thinks they're irrational and won't recognize mutually assured destruction, deterrents that worked in the cold war. that leaves one other option, maybe two. the military strike or the threat of a military strike. he talked about the fact that he and obama say that all options are on the table and you have to convince iran we mean it and if they go nuclear we will strike them. failing that, i certainly got the sense -- he didn't say it but he is prepared to take military action or the u.s. will, but he feels diplomacy won't work and detainment won't work. it will come down to a real threat of military action, possibility the reality of it. >> it did seem like he thinks it may be a matter of time. fascinating interview and great panel as well. thank you. >> you bet. >> but in the meantime, peter doocy is live with the latest in new york. hi, peter. >> we reported yesterday that the police suspected barefoot bandit on a bohemian island. after keeping an eye on the coastline, authorities off the mainland aluthera arrested the 19-year-old fugitive colton harris moore before 9:00 as he was trying to dock a boat. he broke out of a halfway house two years ago and expected to make his way via stolen cars, boats and five planes from the home state of washington to south dakota and indiana where he allegedly stole a $650,000 aircraft he crash landed on the island in the bahamas. then he stole a power boat from marina and took it 40 miles and that's how the police were able to crack him down early this morning according to anonymous police sources. as soon as they recovered the 44-foot power boat they knew he was nearby. they tracked him down and arrested him and preparing to take him to the capital of the bahamas where he faces possible extradition to the u.s. that's where we are expecting a news conference from from the police force any minute. we did speak to a police superintendent down there who said so far, he has been cooperative and calm. that is all we know now but it should be interesting to hear how the ball caught up to illusive harris-moore. >> something tells me the movie will be made. thank you. >> yep. >> is expelling illegal [ female announcer ] together we can discover the best of what's next at aarp.org. >> shannon: west virginia governor joe manchin said he will announce intentions tomorrow, but today he is holding a news conference at boston at the national governor association meeting. we will keep an eye on that to let you know if he makes news there. a visible governor at the n.g.a. meeting, arizona governor jan brewer who was met with protest for people on both sides of the immigration debate. one side, protesters call her new immigration law racist and governor brewer a bigot. but she did have supporters there as well. the governor supported a private meeting with janet napolitano today. we'll watch that and see if news comes from the meeting as well. the mid-term elections has some looking ahead to the 2012 presidential race. julie kirtz is live to explain. >> the 20192 presidential campaign began the wake after the 2008 campaign ended. it's been below the radar for most of us, but getting more visible now. the next six months we will see the presidential campaign really kick in. it takes a long, long time to raise the millions needed to run for president. so campaigns need years really to get the organization in place to buy different time. and raise the big bucks. while he hasn't said for sure he will run but tim pawlenty returning for the first time in seven months to raise a profile in a state crucial to the presidential politics. the former actually governor and fox news contributor sarah palin launched a new online ad aimed at conservative women, called no surprise, mama grizzlies. it's all about the political power of women in 2010 but it certainly looks like what a palin ad might look like if she does run in 2012. listen. >> we are going to turn the country around no, matter what it takes to respect the will of the people. look out, washington! >> it's early but we found a poll from iowa measuring the 2012 candidates right now. they are mitt romney, sarah palin and newt gingrich. the poll of republican voters was taken in early june. again, we are more than two years out. you never know who will emerge in the coming months. looking back in 2006 for example, barack obama wasn't even included on the list of possible contenders in a similar poll of likely democratic primary voters in iowa. that's why it's so interesting. >> it is. it is never over. like you say, as soon as the last election is over they gear up for the next one. >> we love it. >> shannon: yes, we do. thank you. >> sure. ♪ ♪ >> shannon: on day 83 of the oil disaster in the gulf, b.p. engineers are optimistic that the replacement containment cap they are installing will form a new perfect seal and collect even more oil than the last one. the replacement process essentially involves removing the current containment cap that is off now. then you have robot cut the pipe, doing it today. after that a new cap will be lowered on the well head which should form a near perfect seal. of course, the ultimate solution is still the relief wells. the first of which b.p. hopes to have done by the end of this month or sometime early in august. b.p. is hoping to have the oil fully contained within days but so much of the work of the well head is weather dependent. chief meteorologist rick reichmuth is in the weather center with a look at the conditions expected in the next few days. >> i tell you what, they are taking advantage of the window of pretty calm weather across the gulf. we had hurricane alex, and then a tropical depression. it brought enough instability and wave action to cause the problems. the thunderstorms here but none will cause problem. they are taking advantage of an opportunity for the busy hurricane season we could be having. now is the chance. >> thank you for the update. conservative religious leader calling on republicans to work with president obama on comprehensive immigration reform and he says that is in accordance with the bible teaching. joining us is dr. richard lam who attended the big speech at american university and will testify in congress on wednesday about the immigration and border security. doctor, thank you for joining us. >> happy to be with you. he outlined a number of things in the speech that americans are skeptical of possibility of ever deport ing 11 million illegal immigrants and talked about a plan for them to stay here. is that the right way to go? [ male announcer ] have a heart to heart with your doctor about your risk. and about lipitor. >> shannon: b.p. is installing new cap to hope to capture all the oil spewing in the gulf. we have more on that. >> b.p. removed the temporary cap and oil will gush freely in gulf for 48 hours as part of a process that is supposed to collect more oil on collection ships on the surface. they say the new cap could be installed as early as tomorrow. organizers of a libyan aid ship says it will bring aid to gaza despite that it will be diverted. mahmoud abbas called the direct talks with israel futile and pointless. obama administration has been pushing both leaders to resume negotiations stalled in 2008. spain and the netherlands will battle it out this afternoon for the world cup in the final game of the tournament. fans on both sides are in a frenzy, because neither team has ever won the cup. a new york lawmaker says some alcoholic energy drinks are marketed to underage drinkers and he wants the federal trade commission to investigate. democrat chuck schumer says drink like joose use colorful cans to target teenagers and tiny print to disclose the alcohol content. back to you. >> shannon: thank you. b.p. says it's making good progress on the tighter cap but 83 days and lot of people are questioning how the entire situation is being handled by b.p. and the feds. this morning on "fox news sunday," white house senior advisor david axelrod defended the administration's attempt to suspend deep water drilling. >> the president does not want to stop this drilling. he wants to make sure the catastrophe doesn't happen again. until we run through the scenario and find out what happens and what is done, including four run by b.p., it is, it's our responsibility to make sure that it's reasonably safe. >> two courts ruled against the moratorium. drilling companies argue the moratorium is too broad. government officials said friday they would announce modified deep water drilling moratorium in several days. earlier we told you how fishermen in louisiana are outraged over they say are the delayed claim payment for fox business. to be fair and balanced b.p. issued a statement and response and we want to bring it to you. they say "b.p. has not stopped payment, nor has it suspended future payment." they went on to say it overnighted 406 checks to the fishermen lawyer's office last week. fidel castro, the former leader of cuba and head of the country communist party made a rare public appearance, his first since falling ill four years ago. occasionally they released private meeting pictures but these were the first taken in public since july of 2006. they show castro visiting with workers on wednesday and they were posted on a state run media website. 2,000 veterans are tested after there was dental procedures using unsterilized equipment. patients could have been exposed to hepatitis and even hiv. now we have news employee was fired two months after voicing concerns about the sterilization process. congressman russ carnahan toured the medical center and met with veterans this week and joins to us tell us what he saw. >> thank you for having me in. >> shannon: what did you find? how could it have happened? >> this is not the fight they should fight now. they served us so well. that's why we have the hospital system set up the way it is. this is outrageous and makes your blood boil. 1821 disabled veterans got a letter in the mail saying because they had the dental procedures they were at risk of contracting hep seitz or hiv. many of them are worried. many are very angry. they deserve to take extra special care of get to the bottom of how it can happen so it can't happen again. >> what are they get something far? >> 500 have come in for testing. the local v.a. hospital is reaching out to them by phone and the care givers to get them in. they need to build confidence and that will only happen if we get veterans tested and we can dig in what happened, who is responsible. whether it's procedure or personnel or management problems. we have to get to the bottom of that from the secretary to the local administrator. they have begun to step up and address these. we will have a hearing next tuesday the 13th with chairman filmer in st. louis to have a field hearing and begin to dig in the issues and get answers. >> hopefully between the hearings and the investigation you will get the answers we need. we know it happened in many v.a. hospitals and the last those we want worried are the veterans. >> we hope and pray they'll all be well. >> congressman, thank you for sharing what you learned. >> the spy saga continues. some of the spies released are in a state of limbo. where are that? >> it's a private entity for financial transaction, electronic funds transfer within europe. they run that you are money through the organization. what has happened is after 9/11, the u.s. has gotten access to the data that swift had about transactions and we have been able to use it to track the terrorist financing. something we did quietly and successfully for a number of years. >> for a while the to have the agreement authorized or set in stone, there were fits and starting to get it done. what was it all about? >> there were. we originally had direct access and it leaked out publicly this was going on, there were concerns about privacy protection and reasonable concerns, but these were taken in account when the agreements were drafted originally and we talked about it with the european union and we reached formal agreement to allow for sharing of the terrorist financing data. the european parliament step naned said wait a second, we want to review the whole thing again. they shut off the data for five months, really. only in the past week did they give renew access on august 1. >> shannon: how critical is the relationship between us and e.u. tracking the terrorism and money attached to it? became a major campaign issue when president obama choose to sue arizona over its new law while pushing congress simultaneously to pass comprehensive immigration reform. some democrats even in arizona fear a backlash. >> my concern is that the federal government is suing the state of arizona ironically over the ability to enforce immigration laws where if the federal government had been doing its job over the years we wouldn't be in this situation in the first place. the democratic governor torial nominee. he urged the federal government to leave alone the state law which lets authorities ask for immigration documents during unrelated encounters such as traffic stops. the latest poll thoughs two to one support nationwide for arizona's law. 73% of republicans back it. 57% of independents back it. even one out of three democrats. on immigration the gop accuses democrats of ignoring a border crisis and selling out national security to cynically get latino votes. liberal red meat stops short of calling republicans racist but does call gop immigration policy hostage to minorities, particularly to hispanics, the fastest growing u.s. minority. in colorado, a recent poll said 62% of colorado hispanics favor a law like arizona's. republican gop frontrunner scott mcgin nice supports it but the mayor of denver opposes it, putting himself at odds with most colorado latinos. >> until washington, d.c. realizes that they are being absolutely and totally failures at border security you can't talk about the issue of immigration reform. >> on the other hand, texas republican governor rick perry has seen his latino support plummet and a double digit lead over democratic challenger white all but vanish since the debate began. immigration is sure to be a key wedge issue. in washington, carl cameron, fox news. >> shannon: this is a fox news alert. we have been telling you about the bare foot bandit, the young man here. he is an american who has been on the run for the last couple of years from authorities. apparently crash landed a coalen plane in the bahamas a week ago. we understand he has been arrested. we are awaiting a presser from the authorities there in the bahamas and we will take you there when that happens with all the details on how they tracked him down. a new cap for the gushing oil leak has o outpaced expectations so far. jonathan serrie is live with the latest. hi, jonathan. >> hi, caroline. the officials involved with the spill tell us that more than 570 skimmers a record number are conducting oil recovery operations in the gulf of mexico. 46 of those skimmers located at the immediate site of the leaking oil well in anticipation of additional amounts of oil resulting from yesterday's removal of the cap on top of that oil well. it is estimated that as much as 5 million-gallons of oil may leak before a new better fitting cap can be installed atop the well sometime between wednesday and next weekend. but obama administration officials are voicing cautious optimism about the operation's long-term benefits. >> the hope is that we will be containing all of the oil that comes out of that well by the end of july, but it is obviously to kill the well will take a little bit longer. >> that little longer meaning late july, perhaps mid august before bp is able to finish drilling the first of two relief wells, allowing the company to plug the high pressure leak with mud and see intercept. meantime, new efforts under way to protect the coast in new orleans. a new type of boom is being deployed to protect local waterways. it alous water to pass freely but absorbs oil. microbes embedded in the boom material break down the oil. even after the oil leak is plugged scenes like the boom in the videotape and the booming operations you see behind me are likely to be common place for months because of all of the residual oil in the gulf. it is estimated as many as 172 million-gallons hey have spilled from the site so thanks, jonathan. >> certainly. arizona's controversial immigration law set to go into effect a little more than two weeks from now but the obama administration is hoping its lawsuit challenging it on legal grounds will stop it in its tracks. malini with the latest now. top officials not only defending the federal lawsuit but defending their efforts to control the border and enforce immigration laws. they said there is more manpower on the u.s. mexico border than ever before and resources like drones, helicopters and airplanes are having more success. he admits the situation in arizona is still, "not good" but says the administration is dealing with illegal immigration. >> no administration has gone after enforcement and employers the way we have who have broken the law by hiring the workers. >> the arizona immigration law allows police to question someone's immigration status during the enforcement of other laws. the white house argued having a patch work of different state laws can be counter productive to enforcement efforts but company senator jon kyl of arizona disagrees. >> it would be one thing if the federal government had controlled the border already but it hasn't and frankly what arizona is trying to do is lend its law enforcement officials to the efforts. >> senator kyl says while additionle resources have been sent to the border it is simply not enough. meantime, the attorney general ehrlich holder told cbs if the arizona law takes effect as scheduled the federal government will look for any evidence of racial profiling and hasn't ruled out another lawsuit if there is evidence of that, shannon. >> it is far from over. thank you very much. does the federal government have a case in its legal challenge? the one we got so far to the arizona law. joining us is tom dupree. he will help us break this down. great to see you today. >> thanks, shannon. grade to be here. >> shannon: the grounds that we are on right now i guess is along the lines of preemption. saying that the state has taken away authority or power that only the feds should be enforcing. how is that going to play in court? >> the government is saying that arizona has acted unconstitutionally because it enacted statutes that in the federal government, the federal immigration laws and federal enforcement policy. it is interesting because in the runup to the law suit we heard a lot of talk about the allegedly discriminatory aspect of the policy but when the government filed its lawsuit it was interesting in that the only theory they brought was the preemption theory. they didn't make allegations it would be enforced in a discriminatory way. >> the state can come forward and say you haven't been enforcing that law and maybe it is your responsibility and your authority constitutionally but if we have the huge problems at the border and we don't see any evidence that the feds are helping us, is that is good enough defense to the lawsuit. >> that is a great point and when arizona was drafting the statute they were aware of the fact that they couldn't draft a law that conflicted with federal law. they went the extra mile to write it in such a way it was consistent with federal law and they made their best effort to ensure it was reenforcing federal policy rather than undercutting it. the federal government is now saying you are interfering with our enforcement policy which begs the question as to what their enforcement policy is. >> shannon: depends on the meaning of enforcement, i guess. >> exactly. >> shannon: now, the attorney general is saying there may be another lawsuit coming. they are going so see if there is any racial profiling. the legislature there was careful to word this in a way that they think blocks that. >> arizona has done a number of reasonable steps. they amended the law from the way it was initially enacted to prevent acts of discrimination or bias in the enforcement. they have been training law enforcement officers which is a critical point. you want to make sure if you are giving them this tool that they are enforcing it and even handed and constitutional ways. arizona was sensitive to the danger and they have taken steps to prevent is from materializing. >> shannon: does it go all the way to the supreme court? >> it could. it is highly topical and different courts in the country haven't always resolved the same question in the same way which is one of the things the supreme court looks for when it decides what cases it wants to review. >> shannon: it may sake some years but likely to get there. great to see you. >> thanks, shannon. >> shannon: controversy followed governor jan brewer to boston. brewer is in boston for the national governor's association meeting. igroups bussed people in to stage protests in boston. they called governor brewer a bigot and later marched to the hotel where she was attending the meeting. no word on what came out of the hearing that she had with homeland secretary janet napolitano. there were also people there to protest in support of the law. the battle for the 2012 republican nomination almost certainly already underway. some republicans look like they are laying the ground work in battleground states. julie kirtz is live in washington with more. julie, it's never over. >> an unsettlele republican field. we didn't feel really know who is running with no one saying they are in for sure. watch where politicians go, not what they say at this point. presidential campaigns need years to raise the millions needed. while he hasn't said for sure he will run, you see minnesota governor tim pawlenty returning to new hampshire for the third time in seven months as he tries to raise his profile in a state to critical to presidential politics. and former alaska governor and fox news contributor sarah palin has just launched a new online ad aimed at conservative women voters. all about the political power of women in 2010 but looks a lot like what a palin add might look like if she does run in 2012. it is early but we found a poll out of iowa measuring that state's most popular gop 2012 candidates. they are mitt romney, sarah palin and newt gingrich. it was taken in early june. we are more than two years out, you never know who will emerge in the coming months. >> the 2012 presidential campaign began the week after the 2008 campaign ended. most people just haven't seen it. it has been below the radar level. it has been fairly invisible until recently. what most people don't know yet is that within six months the 2012 pressial campaign will -- presidential campaign will be visible daily and on radar just about every day in the newspapers if not on television. >> and, of course, online. the themes emerging now from republicans who might challenge president obama are close to or inspired by the tea party movement. issues like the deficit, taxes and government spending. shashannon. >> shannon: poplar topics. thank you very much. police in the bahamas say they caught the bare foot bandit. you are looking at a replay of the press conference they just had. they have been searching for him since he allegedly crash landed a stolen plane a week ago. a senior reporter for the bahamas broadcasting network is joining us live with an update on the phone to tell us the latest. what did you learn? >> we learned today that, first of all, let me tell you that colton harris moore has been brought to the capital city of nassau and he was bare foot when arrived here just before 11:00 eastern i'm time, he was on harbor island which sits 60 miles off nassau and 200-miles from miami. the police commissioner informing reporters that harris moore is expected to appear in court later this week to answer to a number of criminal charges and as you said, he first got the attention of law enforcement here when crash landed a plane east of harbor island. we are learning more details about how police managed to arrest him. a boat chase ensued and shots fired during the chase. he was not injured, neither was any one else. we are also talking to people on the ground in harbor island and we understand from at least one local there that he actually made contact with harris moore. he mentioned to him that he actually wanted to go to cuba. we understand from that local that after harris moore was on the ground in the airport he told that person that the plane was in fact not for him. so the details of harris moore's adventure here in the bahamas continue to come out at this point. >> shannon: that is >> its goal is to pull together the data necessary to create a fuller threat picture of the cyber security threat against u.s. infrastructure so that is things like the electric grid, nuclear power plants, air traffic control systems, subway systems and things like that. >> shannon: and so much of what we do and the way that we live is connected to technology. how much are those particular groups and areas at risk because of the internet and the fact that we are so connected across the globe? >> well, these functions are highly vulnerable at this point because they were originally put together with computer control systems that were designed quite awhile ago and they weren't necessarily designed with security in mind. but increasingly as things like the electric grid has become more updated they are now being connected to the internet in ways that the designers hadn't intended and so this creates new security risks and this is what the national security agency is trying to get a better handle on. >> and why is this nsa versus homeland security or another group? >> when i was talking to people during my reporting some people expressed surprise that the department of homeland security wasn't part this of but this is not their program. and presumably it is because nsa has a certain amount of expertise in the area either technical expertise or contracting because it is being done by a defense contractor and that is why nsa is honchoing this on. >> what are the groups or nations or individual hackers? i mean who should we be most worried about for these kinds of threats? >> part of the impetus is an i increasing alarm that they are seeing what they view as cyber surveillance of the electric grid or water treatment plants by people who seem to be located in china and russia. it is often very, very difficult to pin down exactly who is behind it and in past reporting i have spoken with representatives from those countries and they deny that they are involved. you kind of get in this little cat and mouse game. >> shannon: any reason that the individual consumer out there, average person should be worried about or is it one of those things that is not something that would bleed into the average person's life? >> as far as i know and a lot of the details aren't clear because this is a classified program but this is something that would be done through arrangements between nsa and corporations. i didn't see anything in my reporting that would suggest that individual citizens would be directly affected by it. it is more that your electric company might make an arrangement with the national security agency. >> shannon: interesting. thank you. >> thank you. >> shannon: earlier we showed you a little bit of a news conference going on in the bahamas updating reporters on the arrest of the so-called bare foot bandit. we have new video from the news conference so let's take a listen. >> the commissioner of police with the responsibility for corporate management and controllership of the royal bahamas police force. i'm joined by the commissioner of police mr. green slage. the deputy commissioner of police. mr. marvin dame. to mr. marvin damianos. responsibility for crime management and operations and the superintendent, the officer in charge of the center of the tactical unit. on my left is the assistant commissioner whose unit covers national policing support services. and on his left is assistant commissioner who has responsibility for policing in the islands. today as you are aware the royal bahamas police force was able to successfully place in custody mr. colton harris moore, aka the bare foot bandit. we are delighted that our commissioner of police will speak in general terms to the facts surrounding this significant arrest. >> thank you very much mr. hannah. on sunday the fourth of july, 2010, the royal bahamas police force received information from the federal bureau of investigations country attache of the u.s. embassy in nassau that a fugitive wanted by u.s. law enforcement officials had reportedly stolen an aircraft and was believed to be headed to the bahamas. acting on information, bahamian police officers commenced an extensive search of the island with a view to locating the missing aircraft and the suspect. officers subsequently received additional resources from the capital city of nassau including nan pour along -- manpower along with police k 9 units and other assets. police officers were able to locate the downed aircraft fitting the description in swampland in sandy point bahamas. the search which lasted for all but seven days came to a successful conclusion on sunday the 11th of july 2010 at harbor island, ha ba bahamas. sometime after 2:00 a.m. on the mentioned date acting on information received from members of the public the police responded to a sighting of the suspect in harbor island. the suspect in an effort to evade capture engaged local police in a high speed chase by boat in water leading -- in waters leading to royal key area. after a brief chase, the suspect was take nooen into cuy without incident. police officers were able to confiscate a firearm and other items of evidencery value. i'm pleased to say that the suspect who has been positively identified as colton harris moore, aka the bare foot bandit was flown to the capital city of nassau b bahamas under polie escort and remains in police custody. it is expectd that he will appear in court on arraignment later this week to answer to a number of criminal charges. i also wish to advise that the suspect was seen by a local doctor shortly after his arrest and he appeared to be in very good health. as this matter and others connected thereto are under active investigation we are unable to say much more at this time. not withstanding, i wish to thank the dedicated professional hard-working men and women of the royal bahamas police force in general and in particular those officers on the islands of abaco, harbor island and new providence for their outstanding efforts in capturing this elusive suspect who has been on the run for well over -- >> shannon: you have been listening in to part of the press conference from the authorities in the bahamas who finally caught up with the so-called barefoot bandit after he apparently crashed a plane there. they got word from the fbi that the fugitive could be heading to the bahamas and they have tracked him down. with the chases and boat chases and plane crashes that they heard about. they checked him with a dock or and he is in good health. a good week on wall street with the dow jones industrials gaining ground. how long might it continue. in brenda buttner joins us from new york with the numbers. great to see you. how big was last week's rally? >> well, it was quite a bounce back. especially given the very bruising performance we had at the end of the second quarter. let's take a look at some of the numbers. we saw both the dow, the s&p and the nasdaq, those are the point gains. but all of them were up some 5% in just four days. it was a holiday shortened week. so, they put in their best weekly performance in nearly a year so it was quite a rally. >> shannon: all right, so what is bringing out the bulls after a bit of a correction? >> you know, it is interesting because there was no real economic news. there was no big corporate news. but we are in anticipation of the big season on wall street, i know that is not the dog days of summer which we are suffering through here in new york. the real season is earnings season and it kicks off next week with alcoa. alcoa itself ahead of earnings was up 9% last week. so that was quite a jump and many people believe that we are going to see a 30% jump in profits over last year kind of across the board. that would be the best performance in more than a half century. of course, you know, we are comparing against very low numbers from last year but that is quite a bump up. the question, though, is profits are one thing and they can come from cost cutting but revenues, that is sales, that is the topline, that is what people are really going be watching. and if revenues aren't coming through then we are not likely to see much more hiring and the job market is key, it is critical not only to our economy but to the stock market as well. >> shannon: absolutely. brenda buttner, host of "bulls and bears." thank you very much for joining us. >> thank you. you may have been following all of our coverage recently about accusations of voter intimidation at polling places in the 2008 elections specifically against the new black panthers and then the department of justice decisions throwing out most of the charges, a minimal charge against a fourth person involved. alisyn camerota sat down with a filmmaker who says the new black panther case could be just the tip of the iceberg. >> buy now you are probably familiar with the story of the new black panther party engaging in voter intimidation tactics back in 2008. what if we were to tell you this was not an isolated incident and that the 2008 primary race between barack obama and hillary clinton was rife with voting in immigration violations. those are part of a new documentary called we will not be silenced 2008. gigi gaston joins us from los angeles. good morning, gigi. >> good morning. >> before we get to all of the evidence you compiled in the documentary. tell the viewers who you are. a life long democrat. you are documentary filmmaker, a quiter from a family of democrats. your grandfather in fact was a democratic governor of massachusetts so you never expected to be directing a documentary alleging basically that barack obama's campaign broke the rules, violated the rules and engaged in rampant voter intimidation tactics as well as other things. tell us why did you start investigating this? >> well, i got a phone call and, first of all, you are right, i had no idea i would ever be going down to texas to investigate anything about voter fraud. i never believed our party would do that, my party would do that and i got a phone call telling me to go down there. what i found was ten times worse than what i was told on the phone. i actually went down there to prove everyone wrong. >> let's show some of the violations you uncovered. this is a woman who volunteered for the hillary camp at the election. she says that she investigated hundreds of claims of fraud in precincts in south houston. let's listen to what she says. >> hillary obtained 51% of the votes in texas. obama obtained 47.4%. i was curious as the results came in from the precincts and caucuses did not reflect the numbers so i could see something was wrong. we laboriously went through each of the signing sheets so see if they were properly filled out and many, many, many obama people either came to the wrong precinct. did not sign in properly, did not show i.d. >> gigi, was the dnc alerted to those problems? >> the dnc was alerted. everyone was alerted. but nobody wanted to look at it. they -- this is exactly what is going on today and we have to do something about it. i made this film in 2008 and look what is happening today. it is our right as americans to be able to vote. everyone was alerted. we went to press. we went to fox. we went to cnn. nobody wanted to hear the story and i'm appreciative that you do today. >> take a look at another clip from the documentary and this is similar to what we have been seeing lately here on fox and that is the black panther episode where there was voter intimidation at the polls. the one that you captured involves black men keeping little old ladies, some of whom black themselves away from voting for hillary, again in 2008. let's take a look. >> got out of the car and there was this lady probably about 80 years old who was sort of walking slowly up the street. and as she was approaching the entranceway to go into the building one of the young men called to her, said to her if you are not voting for obama go home because you are not voting here today. >> and gigi, this one struck you because of who this woman helen who is speaking is. >> i mean this is a civil rights activist, you guys. this woman has been locked out and kept out of restaurants. she knows what this is about and for her if you go on to see the documentary you will see that many, many morefrican americans, stopped, turned and walked away. it breaks your heart. >> yet another episode was where any one who was wearing a hillary campaign button was allegedly told that they could not vote at the polling place that day. let's listen to a volunteer. >> i went standing behind the two elderly women that we brought to the caucus location and they mysteriously could not find their names in the book. the two obama supporters when they saw that the two women had hillary stickers on them, not just all the obama ones because i had given them hillary stuff they mysteriously couldn't find their names in the book. they said you must be in some other caucus. i said i'm from chicago, i came all the way out here. i no tricks like this and that was not happening for the people with the obama stickers, they were getting waved through. >> the clinton campaign at it tried to get the press' attention and tried to get the dnc attention and they couldn't. >> you are absolutely right. and nobody wants to deal with this and the fact is that we absolutely have to deal with this. i don't care what color you are, i don't care how old you are, we have got to be allowed to have our voting privilege in america and every time we don't, think of it this way, we ourall architects of your destiny. if the democratic party is an architect of its destiny what kind of building is it building right now?
