Indiana is the same as arkansas same constitutional principles involved . Judge napolitano the statute is essentially the same. The lot is essentially the same meaning the law in the envy law arkansas does not prohibit discrimination in housing or public accommodation. And not if governor hutcheson plans this states will say if you do discriminate in housing or public on the basis of Sexual Orientation can you can elevate a religious reason for that you cant be sued or prosecuted. Stuart a fix for arkansas would be inclusion of the words Sexual Orientation in a protected class of people. Judge napolitano it already arkansas law already protects as does indiana what the federal law protects race gender, national origin, general greed. The Catholic Church, in the church is not a public accommodation. It is not covered by the Civil Rights Act of 64 or any of these state laws. It is one where you can walk in and require the proprietor to deliver the good or service to you. A church has certain standards before you can require the services namely acceptance of core beliefs. Appreciate it legislative leaders and how they have conducted themselves throughout this session. And including this process. As everyone knows house bill 1228 is now on my desk and it is time for me to take up look at it and make some comments and reference to it. This is a bill that in ordinary times would not be controversial but these are not ordinary times. This bill is not really complicated. The bill itself restates the standard of review for the courts to consider in determining First Amendment privileges as a way against the compelling interests of the state. Simply stated as a summary as to what the legislation does. It is a balancing test. The bill itself does not pick winners and losers. It balances two competing constitutional obligations that our Founding Fathers gave to us. But the issue has become divisive because our nation remains split on how to balance the diversity of our culture with the traditions and firmly held religious convictions. It has divided families and there is clearly a generational gap on this issue. My son seth signed petition asking me the governor to veto this bill. And he gave me permission to make that reference and it shows that families theres that generational difference of opinion on these issues so where are we now . High have asked the process of legislative leaders and members that certain changes be made. In some instances they were accommodated and changed and in other instances they said no. The balance between the executive and legislative branch i certainly respect those bodies. It has been my intention all along that house bill 1228, the religious freedom restoration act, be crafted in a way that mirrors the federal will ledges freedom restoration act. It was passed in 1993 and was signed by president clinton. I came to congress after that but sat on the judiciary the house of representatives, that considered these amendments had hearings on this federal religious freedom restoration act and so i am somewhat familiar with it and how it played out across the country. It was my intention because the federal law does not cover state causes of action that we have a similar law in arkansas but we wanted to have it crafted similar to what is at the federal level. And to do that changes need to be made. The bill that is on my desk at the present time does not precisely mirror the federal law, particularly allowing the First Amendment to be asserted in a private litigation between parties or upon the state law and those claims. I asked the changes be made in the legislation and i have asked that the leaders of the General Assembly to recall the bill so that it can be amended to reflect the terms of the federal religious freedom restoration act. In the alternative it can simply have some language changes so that the accommodations and changes can be made. Easily done by recalling the legislation or having additional legislation that would accomplish those changes. Again this is the difference between the executive branch, legislative branch we all have our responsibilities and different viewpoints. My responsibility is to speak out of my own convictions and do what i can as governor to make sure this bill reflects the values of the people of arkansas, protect those of religious conscience but also minimizes the chance of discrimination in the workplace and the public environment. Is important to recognize that the bill as currently drafted does not change who we are. It does not change the current protections against discrimination. This bill simply define the standard to determine the right balance but how do we as a state communicate to the world that to be respectful, diverse workplace, we want to be known as the state that does not discriminate but understands tolerance. That is a challenge that we face. Making this law like the federal law will aid us in that effort in communication but my original objective from the beginning. That option is that we are looking at to utilize an executive order which interestingly has not been utilized from my research from the executive branch and State Government in terms protecting against discrimination in the workplace for State Government. We are looking at an executive order stage in that communication and make it clear that arkansas wants to be a place of tolerance, we want to be a place that has the right balance between religious protections and religious freedom and nondiscrimination. Also we could be assured this will continue to be a robust debate in the future. I understand about title has been approved by the attorney general that may put on the ballot an extension of the civil rights protection to additional classes of citizens of arkansas. That debate will continue and be determined by the people of this state through legislative body or through a vote of the people. This conversation does not end. I expressed my view to the legislature and invited them to respond to the requests of the governor that changes be made in the current bill to make it reflect federal law that sets the right tone for arkansas and the future to look at additional action down the road, depending on the action the Legislature Might take. I will see the president has any comment. Stuart i think we have got the main points from that press conference and the main point is this. Governor hutchinson will amend the law. He will change the law to bring it into line with the federal law. He will introduce language into the current law which is not yet signed or he will recall the legislators to pass the new law. One of those two things will happen. He will align state law with federal law. That is his fix. Adam shapiro is here following is all the way through. Theres one more edition. He didnt take gay and lesbians. He said the legislature would bring this up or it would be on the next ballot. I dont know if they have a referendum process in arkansas or not but he said this was coming up but regards to the lining of the religious freedom restoration act with federal law, how the indiana law and arkansas law apparently differ from federal law is that they give the religious protection to corp. And allow individuals to use the law as the balance he said. When the government is not even involved. Federal law doesnt do that. We have the Supreme Court boat you dont have the individual situation. Stuart bottom line the fix. Americas nightly scoreboard. Legislature has to fix it. If you get this fixed and they bring into line with federal law will walmart be satisfied. We might look for president who loves individual liberty, not a collectivist, how about president respects the constitution, a president who understands give and take, negotiation. This president doesnt like to work within the constitutional boundaries so he is governed by edict, by executive order and to me that shows the weakness of political skill. Stuart why is he like this . Had he compromised had he reached out to the opposition, compromise on a lot of major issues he would have got far more and the policies would have been better. He seems reluctant to engage with congress and that is a personality trait getting into the nitty gritty with lawmakers and cutting deals and so forth. He seems to want to be above it all but that is what governing is about. He doesnt have a taste for that. I also argue he has been bad for the democratic party. His party lost the house in 2010. It lost the senate. In 2012. It is going to be very difficult for democrats to succeed him. In that sense i dont think he has been good for his party. Stuart seems a democrat from the senate are moving away from them rapidly. We have seen that for some time running against the president because of his popularity falling and so forth. I expect that to continue. Stuart it does look like the democrats can assemble 67 votes in the senate to override a veto from president obama on the issue of sanctions on iran. Another deal that shows his failure as a politician. This is someone who is willing to have a deal with the u. N. But not the u. S. Congress. To me that is a problem in the u. S. President and that is what we have seen from obama in these iran negotiations with the stuart i just said i would like to see a president who respects the constitution favors individual liberty, capable of negotiation, capable of reaching out to the other side. I think the republicans have a deep there are any number of republican president s, a president ial prospects who have the ability to do that. Which one is going to rise to the top .
