Vehicles were related to hundreds of air bag related deaths. Peter barnes joins us with the latest developments. A watchdog group, that data shows 303 people died after air bags failed to deploy and accidents involving these two models, the cult and the i on over ten year period gm has recalled the one. 6 million of those cars and five other models ticos when the ignition switch is jostled orr the key ring carries extra weight the ignition could switch off and when that happens airbags do not work. Gee en is flashing a yellow warning light about the centers report and dennis statement it says, quote, without rigorous analysis it is pure speculation to attempt to draw any meaningful conclusions pleasing contrast research is underway at gm and the investigation of the ignition switch, the impact of the switch is on going. New documents gm submitted to the national Highway Traffic Safety Administration showed gm could have been aware of these problems as far back as 2001. Ntsa has launched a major investigation, the center for investigations as they screwed up and looked into these cobalt crashes where the air bags did not be polite but its results were inconclusive and did not warrant opening a formal investigation. The center disputes that. Gm stock was up slightly after falling 10 on this news this week. Adam thank you very much. Cheryl the third gm is hoping its 2009 bankruptcy deal might give it immunity against illegal claims to its ignition switch recall, but theres no chance of that. Commercial litigation attorney ellen kline is joining us. You say gm is liable and they should be held responsible. Is the law on your side . We have different components of that. Whether or not they are liable for injuries that arise after this ignition switch, recall or defect which plainly it can be proved they were responsible they would be and then we have are they liable in light of the bankruptcy and how does Bankruptcy Court in the 2009 bankruptcy play into this . Is the key component when we analyze how the bankruptcy is going to play in to gms liability is the evidence that suggests they may have known about this problem in 2004 and covered it up. Dont know if that has been shown conclusively but if it can be, people who before 2009, the old gm customers who were deprived of the opportunity to investigate or be aware of the fact that there was an ignition problem that could get gm on the hook as the judgment creditor and the ability to join in to the bankruptcy proceedings as us and creditors may come back and say you perpetrated a fraud on me. I shouldnt be foreclosed for now seeking my relief because you kept the information purposefully. Adam a lot of possibilities and may bes but gm stock going up because most likely that wouldnt happen in even if it did the amount of recovery for those people would be minimal since the gm responsible for the alleged coverup no longer exists. A lot of possibilities describe the legal system. The company doesnt exist for which you would recover. The new company has nothing to do with the old company. How do you ever get money . Its assets, the assets of the company that created these cars and possibly covered up, all of the personnel are still with the new gm. Was restricted and went to a bankruptcy process but the assets and presumably any residual profits from having made those cars is still with the new gm entity. Lets not forget we learned all this this week. The new entity which presumably has my of the same people, engineers, etc. Continued and information continued to not disclose this and as a consequence they will have incurred post 2009 liabilities after the bankruptcy. Cheryl lets talk about how these lawsuits could be structured . We are expecting a slew of losses as people start to realize that accident i had in 2004, my gm car, that happened to me. I am going to get a lawyer. You say this could end a multi district litigation and this would be where all the bosses across the country are put in consolidated pool. Explain what that would mean to gm if they try to defend themselves against this. Generally speaking, you recall this from the Ford Firestone rollover in the 2,000s. If there are a lot of cases that revolve around the same product defect, an automotive the effect, but they all involve different damages, some people may have been killed, some badly injured, some suffered some minor damages, theyre not a class because their damages are so disparate but they all have damages based on the same wrongful conduct or product defect. What the federal courts will sometimes do is pull all that together just for discovery purposes in what is called multi district litigation where the court will preside over depositions and discovery of information for all of these cases with some lead lawyers appointed to do it and after liability is or is not established they would go back to their home districts for adjudication on damages, that saves gm and ford 10, 14 years ago repeated the position. Adam should investors keeping an eye on expenditure from gm to settle these future cases keep in mind one of the problems is there would be insurance benefit is shown that fraud took place and there was a coverup the insurance would not cover gm, that would come out of the company itself which would investors . I would be hesitant to give any Investment Advice generally more specifically to is this. First of all we dont know conclusively what gm knew and when they knew it and if they covered it up. We dont know what the insurance policies say with respect to what the coverage would be so at this point with the information we have is too early to say anything conclusive. Cheryl if you were defending gm, what would concern you more . Punitive damages we are expecting or the government investigation that is underway right now . A government investigation is always more concerning that everything because the government has free rein to do anything. Government investigation, criminal investigation by congress if i represent gm, certainly the greatest concern that i would have and i would be telling my clients that is where you focus your attention. Cheryl it will be a long road for this company. We focus our attention to the Malaysian Airlines flight 370 mystery, the jetliner has been missing almost the weekend investigators are expanding not only their search but their theories regarding what actually might have happened. We are joined by Ashley Webster. Ashley nearly one week since Malaysia Flight 370 literally vanished. Speculation is intensifying. The plane might have been hijacked by a person or people with aviation skills, still no sign of the aircraft and a report from reuters based on analysis of radar data suggests the plane wasnt just blindly flying northwest from malaysia but was deliberately diverted citing unidentified sources the reuters story says whoever was piloting the vanished jet was following navigational wave points that would have taken the plane west toward the indian ocean. The hunt for the plane with 239 people on board has been widened west from the gulf of thailand to the indian ocean. Also to the south china sea. Meantime another possible lead, chinese researchers say they reported a, quote, seafloor event in waters around malaysia and vietnam, about an hourandahalf after the missing plane lost content. The event was recorded in an on seismic region 72 miles northwest of the last confirmed location. The reports say they could have been caused by the plane crashing into the water but no confirmation. Whats happening, they use, frequently use tax roll data to create their estimates of value.
