Gorsuch is more sceptical of government. Being prolife, being pro gun, gun rights, i think they both set that mold. Both would allow him to say to his base, this is way promised and this is how i delivered. Working on the Third Circuit court, with the president s sister, some people think, that gives him if you will, a little bit of an advantageous. I know the president s sister. We were judges in new jersey together. A formidable woman. Personality and intellect. Lou i was on a jury in which she was the judge it was a civil case. You would have been a teenager in those days. Days. Lou i was, i assure you. Here comes the president. We are about to find out. Judge map with me throughout. Stay with us as the president approaches the podium. [applause] thank you. Thank you very much. Thank you very much, ladies and gentlemen. When Justice Scalia passed away suddenly last february, i made a promise to the American People. If i were elected president , i would find the very best judge in the country for the Supreme Court. I promised to select someone month respects our laws, and is representative of our constitution and who loves our constitution. And someone who will interpret them as written. This may be the most transparent judicial Selection Process in history. Months ago as a candidate i publicly presented a list of brilliant and accomplished people to the american electorate and pledged to make my choice from among that list. Millions of voters said this was the single most important issue to them when they voted for me for president. I am a man of my word. I will do as i say. Something that the American People have been asking for from washington for a very, very long time. [applause] thank you. Today i am keeping another promise to the American People. By nominating judge neil gorsuch of the United StatesSupreme Court to be of the United States states Supreme Court. And i would like to ask judge gorsuch and his wonderful wife louise to please step forward, please. Louise, judge . Here they come. Here they come. [applause] so was that a surprise . Was it . I have always felt after the defense our nation, the most important decision a president of the United States can make is the appointment of a Supreme Court justice. Depending on their age, a justice can be active for 50 years and his or her decisions can last a century or more and can often be permanent. I took the task of this nomination very seriously. I selected an individual whose qualities define, closely define what we are looking for. Judge gorsuch has outstanding legal skills, a brilliant mind, present discipline and has earned bipartisan support. When he was nominated to the tenth Circuit Court of appeal, he was confirmed by the senate unanimously. Also can you believe that nowadays with whats going on . [applause] does that happen anymore . I think its going to happen maybe again. Also with us tonight is maureen scalia. A woman loved by her husband and deeply respected by all. Im so happy she is with us. Where is maureen . Thank you very much. She is really the ultimate representative of the late great Justice Antonin Scalia whose image and genius was in my mind throughout the decisionmaking process. Not only are we looking at the writings of the nominee, and i studied them closely, but hes said to be among the finest, most brilliant of any judge for a long, long time. And his academic credentials, something very important to me. Education has always been a priority, are as good as i have ever seen. He received his undergraduate degree from columbia with honors. He then received his law degree from harvard, also with honors where he was a truman scholar. After harvard he received his doctorate at oxford where he attended as a marshall scholar. One of the top academic honors anywhere in the world. After law school he clerked on the Supreme Court for justices byron white and anthony kennedy. Its an extraordinary resume. As good as it gets. Judge gorsuch was born and raised in colorado. And was taught the value of independence, hard work and public service. While in law school he demonstrated a commitment to helping the less fortunate. He worked in both harvard prison Legal Assistance projects and harvard defenders program. I studied he aspect of his life. He could have had any job at any law firm for any amount of money. But what he wanted to do with his career was to be a judge to write decisions and make an impact by upholding our laws and constitution. The qualifications of judge gorsuch are beyond dispute. He is the man of our country and a man who our country really need and need badly to insure the rule of law and the rule of justice. I with like to i would like to thank senate leadership. I hope democrats and republicans can come together for once for the good of the country. Congratulations to you and your family, may god bless you, may god bless our glorious nation, judge gorsuch, the podium, sir, is yours. [applause] thank you. Mr. President , thank you very much. Mr. President , mr. Vice president , you and your team have shown me great courtesy in this process. And you entrusted me with the most solemn assignment. Standing here in a house of history, acutely aware of my own imperfections. I pledge if im confirmed i will do all my powers permit to be a faithful servant of the constitution and laws of this great country. For the last decade i worked as a federal judge in a court that spans six western states serving 20 of the continental United States and 18 million people. The men and women i worked with are an inspiration to me. I watched them tend together rule of law, enforcing the promises of our constitution and living out daily their oath to admin ever justice to rich and poor alike. Following the law as i find it and without respect to their personal political beliefs. I think of them tonight. Of course the Supreme Courts work is vital not just to a region of the country, but vital to the whole. And the couldnt knew th andr constitution. The towering judges who served in this particular seat of the Supreme Court including Antonin Scalia and Robert Jackson are much in my mind at this moment. Justice scalia was a lion of the law. Agree or disagree with him, all of his colleagues on the bench share his wisdom and his humor. Like them, i miss him. I began my legal career work for byron white, the last coloradoian to serve on the Supreme Court and the only justice to lead the nfl in rushing. He was one of the most courageous men i know. When he retired he gave me the chance to work with Justice Kennedy as well. And like Justice White he taught me so much. Im forever grateful. If you ever met Justice David sentel. You will know how lucky i was to land a clerkship with him right out of school. Thank you. These judges brought me up in the law. Truly i would not be here without them. Today is as much their day as it is mine. In the baffle my professional life, i had the privilege of work as a practicing lawyer and teacher. I enjoyed wonderful colleague hospital support whose support means so much to me at this moment. As it has year in and year out. Practicing in the trial work trenches of the law. When we judges don our robes, it doesnt make us smarter, before it does serve as a reminder of whats expected of us. Impartiality, independence, cleanin. I look forwardw to speah members from both sides of the 00. Answering their questions and hearing their concerns. I consider the United States senate the greatest deliberative body in the world. And i respect the role they play in the confirmation our judges. Its for congress and not the courts to write new laws its the role of judges to apply, not alter the work of the people representatives. A judge stretching roar results he desire ofs rather than what the law demands. Im so thankful tonight for my family, my friends, and my faith. These are the things that keep me grounded at lifes peaks and sustained me in its valleys. To louise my incredible wife and companion of 20 years. My cherished daughters who are watching on tv and all my family and friends, i cannot thank you enough for your love and prayers. I could not attempt this without you. Mr. President , i am honored and i am humbled. Thank you very much. [applause] lou judge neil gorsuch, the president s choice to joint Supreme Court as the 9th justice. An extraordinariy man as the president rekowntd and you just witnessed in his simple, straightforward language which was elegant indeed. With me, judge andrew napolitano. I now were involved in the process. You counseled the president privately. Your thoughts about this judge becoming a justice of the Supreme Court. The president not only said he wanted a bright, experienced, experienced just jurist, but he wanted one most similar to Justice Scalia. An academic, interest atlantic. A wit, a person who writes with clarity but with flair and humor and shares some of the same values as Justice Scalia. Politically the democrats will have a difficult time challenging him. Look at the academic background. Ph. D from oxford as well as harvard law degree. Lou what does one do with a doctorate of philosophy from oxford if you are a lawyer. One usually teaches which judge gorsuch also does. I believe the university of colorado in the evening. Because hes judging during the day. A person against the universal accolades of his colleagues. And a opinion shares and a person who shares a healthy scepticism for the government which is something the president who nominated him also shares. And the justice whom he seeks to replace also shared. Lou millions of americans as well. Appointing him to the Supreme Court. Its a fascinating moment. With the democrats and Chuck Schumer vowing scorched earth, vowing hes going to leave this seat open in perpetuity i guess if it were up to him. And all three branches of government. How do they obviate this, how do they overkoivment an over ovd move this man into Justice Scalias seat. Thats up to the political sophistication of mitch msh mith mcconnell. What he does with the filibuster rule will be the first decision he will have to make. Lou how critical is it, we are looking at his remarkable background. Private practice, extraordinary background. Going back to his academic backgrounds. I havent seen a more impressive background, columbia, harvard and oxford. Im not easily swayed with these things. But this man has a hour house mind. You asked what a judge with a ph. D does with a ph. D. Its unusual for judges and lawyers to get a ph. D. Oaf case alley one ends up on a federal appeals court. And he would be the first on the Supreme Court, i believe, to have. Ph. D to have a ph. D in philosophy. Lou if we cant bestow a ph. D on peter barnes, great work, peter. Too cory gardner, the senator from colorado, got a front row seat. Hands off to john decker from fox news radio who is a lawyer has been around and seen these things in the past. This will be a fight. Signs was announced, my inbox on my iphone was flooded with emails from supporters and opponents. And obviously the big question is how far is Mitch Mcconnell willing to go to get this nominee across the finish line. Democrats would need 8 democratic votes to be filibustered. And right now, its not clear where those 8 democrats are. And of course as you know, harry reid back in 2013 triggered the Nuclear Option for every seat but a Supreme Court nominee. So far it sounds like Mitch Mcconnell wants to keep the filibuster. Well see how far he will be willing to go. Lou great work. Thank you very much. Peter barnes from 9 white house. Its interesting sometimes if you cant do the addition in this instance, that is, get the 60 vote, you do subtraction and get it down to a simple majority. How important is it to move him through committee and move him into confirmation . The last conversation i had with donald trump, he was the president elect. I dont think im spilling the beans. He told me he wanted his company confirmed by early april. Thats a short period of time. January is over. So thats about two months. Its very, very significant. In april the Supreme Court takes its last batch of cases for the year that it will decide by june. And he knowing that wanted his nominee on. So they are really going to try and get this done. Chuck schumer wants to delay it. He doesnt want the 9th justice to be sitting by the type the Supreme Court make these decisions. Mitch mcconnell and the Republican Forces will do their best to get it through. Lou how how long do you think e American Public can col rate this level of nasty opposition that i think is perilously close to subject version. I dont know how long the American Public will tolerate it. But i know the more they learn about this charming selfeffacing brilliant guy, the more difficult it will be for them to sustain the opposition. The opposition will come from two forces in my view. It will come from the gun control crowd and the prochoice crowd. Two crowd that are accustoms to being allied. Chuck schumer will stir the pot but i dont know how he can sustain opposition to somebody. Lou when you say opposition, opposition to what or whom . Judge gorsuch. Do you think the gun control crowd and the prochoice crowd will be opposed to him. Not because he said i want roe versus wade reversed. But he has given end case that hes on a prolife and pro gun side of things. Lou are there cases that you believe are so critical right now that this justice associate justice can decide . Already serious challenges to excessiveover reach by the epa that we have much need the fifth vote to tip the scales. And the decisions below went in favor of the epa. So Chuck Schumer delays, the epa wins because the tie goes to the lower court. Lou as always, great to have you here. We appreciate. Lou the president nominating judge neil gorsuch. A former clerk for Justice Clarence thomas and charlie hurt join me to analyze the choice and of course the dirty, nasty my business was built with passion. But i keep it growing by making every dollar count. Thats why i have the spark cash card from capital one. With it, i earn unlimited 2 cash back on all of my purchasing. And that unlimited 2 cash back from spark means thousands of dollars each year going back into my business. Which adds fuel to my bottom line. Whats in your wallet . And the wolf huffed like you do sometimes, grandpa . Well, when you have copd, it can be hard to breathe. It can be hard to get air out, which can make it hard to get air in. So i talked to my doctor. She said. Symbicort could help you breathe better, starting within 5 minutes. Symbicort doesnt replace a rescue inhaler for sudden symptoms. Symbicort helps provide significant improvement of your lung function. Symbicort is for copd, including chronic bronchitis and emphysema. It should not be taken more than twice a day. Symbicort contains formoterol. Medicines like formoterol increase the risk of death from asthma problems. Symbicort may increase your risk of lung infections, osteoporosis, and some eye problems. You should tell your doctor if you have a heart condition or high Blood Pressure before taking it. Symbicort could mean a day with better breathing. Watch out, piggies child giggles symbicort. Lou back with us is chief counsel, policy director for judicial crisis network, former Supreme Court clerk for Justice Clarence thomas, and charlie hurt. Carrie, you didnt want to difficult you will have knowledge anything before the announcement. Is judge gere such the man you wanted . Absolutely. Its like hes out of central casting for who is the best person to step into Justice Scalias shoes. He has such a principled record on the bench. His academic credentials are beyond compare. And his writing style can people have said resembles Justice Scalia. Its incisive and entertaining. Lou it struck me as he spoke tonight, accepting the president s nomination, he has that eloquence of simplicity and straightforwardness. A remarkable man, whether talking about his powers of expression or his record as a jurist. I second everything carrie just said. But democrats will find some way to oppose hip. The most interesting thing about what we are seeing tonight, for going on two years now we heard conservative purists in the Republican Party talk about how dangerous donald trump is and how he will ruin the Republican Party and ruin america, and do all these things that basically jump into bed with democrats. It took donald trump to pick a guy like this. Now its up to these republicans in congress not to screw it up. It is their job to make the argument that they quite frankly had a hard time making the past couple decade. That the Supreme Court should be populated with justices who believe that the constitution says what it means and only what it means. And thats what we have with judge gorsuch. Lou some of the conservatives, knee so cons, of what you want to call them, the never trumpers, they have so much to be grateful to President Trump for. First all showing them how to win a president ial elect. And to nominate a man of this capacity, this level of achievement. I mean, i just think of the bill kristols who just destroyed themselves and their public image. And correctly so, for what they said and did. We are turning a point here, this is a white house that has the ability to change the direction of this country and the tone of this country by putting forward so many quality nominees whether the cabinet or now the Supreme Court. Oh, yeah, this nominee speaks for itself. Hes so excellent. This is the first major impact this will be trumps legacy. This is amazing that its something that happened in his second week in office. Judge gorsuch will be on the court for decades to come. You couldnt find someone with a better record to make it clear, this isnt someone who will wander to the left like so many nominees do. He has a long and steady record on the courts. He can articulate why he underthe way he has. Thats so important. This is a man of courage. He will be so excellent in that sense. Lou how will the democrats respond . We know they will fight tooth and nail for a man of his quality and achievement. Its going to be a damn shame to witness. They will do everything they to be smear his reputation. They will call into question everything they can dig up, the most mundane things they will turn into sinister stuff. They will smear this guy like you have never seen, just like they tried to do with samuel alito. Though that ultimately failed. We have a president who is not going to back down. Hes going to fight them every inch of the way. I think ultimately as he proved in the election, i think he will beat them. He on his own, strength and force of his own arguments, he will insure that judge gorsuch gets confirmed. Lou the democrats havent beaten him even once. And it would be a shock if they even tried to go to the extent you envision and i fear. Thank you both for being with us. Up next, President Trump nominating judge neil gorsuch to fill the vacancy on the Supreme Court left by the death of Antonin Scalia. The president explaining the gravity of his decision tonight. I felt after the defense our nation, the most important decision a president of the United States can make is the appointment of a Supreme Court justice. Depending on their age, a justice can be active for 50 years and his or her decisions can last a century or more and can often be permanent. This is the silverado special edition. President of the Family Research council, one of the countrys leading evangelical conservatives. Tony, good to have you with us. Ill take i wild stab eight. You are pleased. How pleads are you . Im very pleads. The president has done exactly what he said he was going to do on the campaign trail. He was going to find a judge that believes a judges role is to interprit the law, not create the law. A strict constructionist who will read the letters on the page and not try to find things within the shadows of the constitution. The writings and opinions of what the judge says, thats what he said here tonight. Lou for christians and evangelicals in particular, how important is his nomination for the cases moving to the court that are there now . I think its extremely important, and thats why this was one of the top issues evangelicals looked to when they voted for donald trump. This became a policy election in which people looked at the policies, top among those policies was how the president was going to pursue judicial nominees. He said he would pick prolife judges who were strict constructionists. And thats what we appear to have in judge gorsuch. Of course, you never so when you select someone. But all things points to this being a very good pick that donald trump made here tonight. Lou i have to say in terms of his achievement, education, potential and youth, for crying out loud. Hes the ideal just absolutely ideal candidate. But you and i both know the left will try to smear him. They will try to resist his confirmation. Why do we have to continue going through this. Do you have a panacea for what alls washington and particularly the left and the dems in this country who turned to subject version asr and obstructionism as much as opposition . We saw that on full display today where democrats refused to show up to work and come to the committees to vote on the president s cabinet picks. They will have a hard time opposing these judges. His educational background, his opinions are solid. He sees the executive branch as having its realm of authority. The courts having a limited realm of authority. And he said again tonight, and his opinions reflect this. The role of a judge is not to create law, its to interpret the law as the legislative body enacted it. Thats refreshing to see judges who are not activists. He wont be a conservative activist. He will be a man of the constitution. Which is what i believe the majority of americans want. Certainly what evangelicals want. Lou i love his expression to be humbled and honored to be a servant of the constitution. Those are lovely words. Tony perkins, we thank you for being with us tonight. Up next, judge neil gorsuch just moments ago talking about the justices he admires. The towering judges that served in this particular seat of the Supreme Court, including Antonin Scalia and Robert Jackson, are you have in my minds at this moment. Justice scalia was a lion of the law. Agree or disagree with him, all of his colleagues on the bench cherished his wisdom and his humor. Lou attorneys randy smith and Barbara Evans join us next. The east and the west are mine. The north and the south are mine. All seems beautiful to me. Lou joining me now, attorney barbara smith, she served as law clerk to Justice Samuel alito. Barbara, your reaction to this nomination. I think judge gorsuch is an incredible pick for a number of reasons some of your guests already mentioned. I think he thought deeply and hard about what the proper role of an appellate judge is. He said judges should interpret lawfs as written instead of i am posing their opinions. He is an incredible writer. No one will be able to replace Justice Scalia for his wit. But judge goarp such will come close. He will be a great addition to the court. Lou as we talked about this choice, he satisfies, it would seem the entire spectrum of the Republican Party. Your thoughts on that. He was involved in Little Sisters of the poor and hobby lobby. For religious freedoms a great pick. But in terms of deference to agencies, hes one who believe in greater individual freedoms. He just kinds of checks all the boxes. But also remember this. Democrats have 23 seats up in 2018. 23. 10 of those were won by donald trump and trump only needs 8 in order to invoke closure for a judge that was unanimously confirmed in 2006. It puts democrats in a tough find because its good for the country and has been confirmed by what he did on the bench. Lou do you expect senator schumer to genuflect and let the judge go through and be confirmed . I think there will be some camemanship. But i predict at the end of the day, heres what will happen. You will have liberal democrats like Elizabeth Warren invoke filibuster. You will have a fight about whether the Nuclear Option is on the table. But at the ends of the day they will decide its not worth it for somebody who was unanimously confirmed for those people who live in those 10 states. Its only 8 votes they need to break the filibuster. At the end of the day ets gets the thumeds up or down vote. But it wont be before they play every game they can. But in the end the numbers get to them. Lou where is the American Bar Association . Why isnt there some adult supervision of some kinds. Im sure there are some people suggests dobbs has lost his mind to think there would be adult supervision from the aba. But with our jiewrists doesnt there have to be a higher standard of decorum and conduct and politics . I think the way this process has played out can tell us how the American Public can evaluate for themselves the qualify kaightss of the nominee. You can look up the judges opinions online. You can form your tone view of whether hes right to say judges should be neutral arbiters of what the law is and not what it should be. They will have to make up their own minds on whether someone who is disqualified lou why is there not a higher standard of conduct. The fact is, they are watching the shredding of enormous talents time after time. Its an incredibly despicable process to watch. And grown men and women do it as senators with almost every nomination. Why should the American People have to put up with this level of conduct in this case in particular by the democratic party, the left of this country. You mentioned the aba, but there are folks like the federalist so sight who go to work for judges of all stripes. I hope they keep in minds what people say about judge gorsuch given his qualifications and backgrounds and think critically Going Forward as other nominees come down the pipeline. Lou the Heritage Foundation playing a role in the list of 21 jurists to be considered by donald trump for the Supreme Court its remarkable to me with all the objections and attacks from conservatives against donald trump. He moves forward with what looks to me to be a perfect choice. He couldnt have chosen things better. Your thoughts on that. I think the aba will surprise you. I think they will conclude judge gorsuch is well qualified to be on the Supreme Court. At the end of the day, its impossible to deny his credentials. They may disagree with him philosophically. But this credentials speak for themselves. There is one thing he member of the u. S. Supreme court agree on, which is the confirmation process is broken, and this is a chance to prove it can be fixes if the democrats step up to do their job. Lou the quality of the nominee suggests this would and good time for the left to rise to higher levels of inspiration. Barbara smith, thank you so much for being with us. Randy evans thank you so much. Lou the new Supreme Court nominee says he has vital work ahead. The Supreme Courts work is vital to the country as a whole, and the continuity of our constitution, the greatest charter of human liberty the world has ever known. Lou liberty. When we say liberty, that fella comes to mind. Judge andrew napolitano, well get his assessment of what will be a difficult confirmation process for taken outstanding talent and outstanding american. Judge napolitano joins me next. And the wolf huffed and puffed. Like you do sometimes, grandpa . Well, when you have copd, it can be hard to breathe. It can be hard to get air out, which can make it hard to get air in. So i talked to my doctor. She said. Symbicort could help you breathe better, starting within 5 minutes. Lou back with me now, fox news senior judicial analyst, judge andrew napolitano. This is a fascinating homage he paid to Antonin Scalia. Im talking about judge neil gorsuch who is now the nominee to the Supreme Court. And he mentioned another jurist. He mentioned a jurist who occupied the same seat as Justice Scalia. Thats justice Robert Jackson. The most conservative democrat ever appointed to the court. He was Franklin Roosevelts attorney general when Franklin Roosevelt appointed him to the Supreme Court. He was nominated, confirmed and sworn in two weeks. Leave of absence from the Supreme Court to become the chief american prosecutor at nuremberg and returns back to the Supreme Court. He went toe to toe with people who had an education like judge gorsuch and he was just as articulate and compelling and he never went to law school. Lou it says a lot about neil gorsuch that he would have such high regard for the man who had such an extraordinary career as you outlined. This is a fascinating fella, this gorsuch. And its going to be a test for him without question. Whatever you think of donald trump lou let me clear up that mystery. I like him a lot. He did what he said hes going to do. Two week of doing what he said hes going to do. But in the last hour he picked a towering intellect who is a natural successor to Antonin Scalia, nearly as charge and selfeffacing and likeable. Lou there is such a lingering aaffects for Antonin Scalia who have a respect and fondness for him. Neil gorsuch when he is confirmed has extraordinary bar to meet. Even with all of his capacity and talent, obvious capaciti its going to be quite something when he must bring to the court. Chuck schumer already attacked him. Not a mainstream jurist and well do tall we can to stop him. Thank you, senator schumer. Bring the fight on. Lou senator schumer, ways it that trump calls him, the head clown. And he is the skunk at the party. And he is falling apart before our eyes. The mans stability is going to be in question if he keeps crying in fake tears produced. I would like to see him do it a few times. He want to delay this beyond early april because he wants the court to decide some very important cases by a 44 tie which would make the lower court cases the law of the land. Thats his shortterm goal. Lou Mitch Mcconnell, the majority leader has to say to hell with you, we have a country to run and a nation to repair. Senator shoer voted against the confirmation of elaine chao, senator mcconnells wife. Lou i have to believe for a host of reasons the majority leader might want to bring the house crashing down around schumers shoulders. In our online poll we asked you, do you agree with President Trumps executive order temporarily suspending shes a jetsetter in the golden age of travel. Pan am flight attendants were iconic. Did she fit the bill . I think she created the bill. Bringing back these from around the globe. Indonesian, african, chinese they came from everywhere. I thought she was a smuggler, which made it even more exciting. What . are they just silly trinkets. Is there a big market for beads . Theres a big market for beads. This is the real deal .
