I have instructed secretary kerry to immediately begin discussions with cuba to reestablish diplomatic relations that have been severed since january of 1961. Going forward, the United States will reestablish an embassy in havana and high ranking officials will visit cuba. Where we can advance shared interests, we will. President obama also insisting that american citizen alan gross, who was released from a cuban prison for humanitarian reasons and not in another controversial prisoner swap like the taliban deal. President obama made the claim despite his decision to release three cuban spies who were convicted of espionage on american soil on this, the very same day. The cuban government did acknowledge the release of a cuban born american spy as well. Mr. Gross was surrounded by politicians instead of doctors as he arrived at Andrews Air Force base and he sounded very much like a man who has been isolated for five years in a communist prison cell. In my last letter to president obama, i wrote that despite my fiveyear tenure in captivity, i would not want to trade places with him and i certainly wouldnt want to trade places with him on this glorious day. Five years of isolation notwithstanding. The criticism of the president s latest unilateral action not only coming from republicans but also Top Democrats on both the House Foreign Affairs and Senate Foreign relations committees. They blasted the president for sending a weak and confusing message to our enemies around the world. It crosses our own red line once again. I hope when the new congress convenes that the new incoming chair of the Senate Foreign relations committee, bob corker of tennessee, who i have served with the last two years as i have been the chairman, will call for hearings on what is one of the most dramatic changes in u. S. Foreign policy anywhere in the world at this time. We will be taking all of this up tonight with the first cuban american elected to the u. S. Senate, senator mel martinez is here. He will be joined by the former ambassador to argentina and nicaragua, a career diplomat. And a niece of Martin Luther king is with us tonight to discuss the president s charges of racism against the entire nation. There is breaking news in the sony hacking scandal tonight. The fbi says they have found the source and will name that source. Thats coming up here tonight as well. Our first guest tonight was 15 years old when he came to this country from cuba and is part of operation pedro path, a humanitarian program that helped cuban children escape communist cuba. Joining us is mel martinez, the first cuban american to serve in the senate, also serving as secretary of housing and urban development in president george w. Bushs administration. Great to have you with us, senator. Mr. Chairman. I could go through a long list. Its great to have you here. Great to be with you tonight. Your reaction to this unilateralism again on the part of the president. Its wrong on so many levels. This was done without any consultation with the congress. It was done, just done and done. I would not agree with the prisoner swap because frankly, that is what happened in the case of alan gross. He was wrongly imprisoned. Secretary of state kerry just a few weeks ago before the Congress Said there was no equivalence between what the cuban spies have done for which they were serving convictions that involved even the death of americans, and what alan gross had done. There is no equivalence. But to do that, you could understand it, you wouldnt agree with it, but to then go ahead and give away the store, to go ahead and change dramatically u. S. Foreign policy after half a century and getting nothing in return . Thats just unthinkable. The leverage of the embargo and its not really an embargo, it was trade sanctions against cuba because we trade with cuba plenty of goods, Agricultural Products and other things, so the leverage that the remaining portions of this trade sanctions had was lost completely today by just a unilateral cave, a complete give in to the cuban government, getting totally nothing in return and not advancing the opportunity for the cuban people to live in freedom in the future. Thats the one thing that just makes me so sad, because i still have family in cuba who yearn to live in freedom and why shouldnt they . Thats the aspiration of every person. This today was made more difficult by the actions of this president. Is there an equivalency of some sort, morally, ethically, politically, between our trade with another communist nation, a huge tremendous society and economy in the peoples republic of china and that of castros cuba . A lot of people talk about that equivalence. In fact, the president mentioned that today. I really dont think that that applies. Cuba has been a thorn in the u. S. Side for so long. Its a very close neighbor. There are tremendous dangers that arrive about our neighbor being so close to us. We saw this graphically during the cuban missile crisis. When we were about to invade iraq, i was in the cabinet at that time, we had a cuban spy operating in the state department. We had to root that person out. It wasnt the state department, take that back, in the department of defense. This was a tremendous spy case. This person had been spying for cuba for over 15 to 20 years. The person is serving a prison sentence today. Cuba was communicating intelligence information because of their proximity to us to the regime of Saddam Hussein before we invaded iraq in 2003. Recently, cuba was involved in an arms trade with north korea, putting mig airplanes through the panama canal hidden under a cargo ship. This is a country still on the list of terrorist countries. I presume they will now unilaterally again take them off the list. That doesnt mean the cubans actions dont put them in a different category from the way that china behaves towards the United States and the way that frankly, vietnam might behave towards the United States. Very different relationship. Is it your judgment as we watch a new senate led by the Republican Party come into town in january, that we are going to see an effort to roll back this president s unilateralism and his approach to even those who agree with the idea of working out a new relationship with cuba . Certainly they would not agree with this unilateral approach, waiting to the first day that congress is no longer in washington. I know, its remarkable to do it on this particular day. You know, my successor in the senate, marco rubio, has already said today they will be looking at what can be done but you know, i fear that with so many other unilateral executive actions, there really is little that can be done. You can do some things but its going to be on the margins. The boldness of this policy, the complete change, they might not fund an embassy in cuba but you have lost the moment, you have lost the opportunity for leverage, the opportunity for negotiations. We have talked about things like this in terms of quid pro quos, in terms of unilateral not unilateral but bilateral steps. We would take some steps, they would take some steps. Thats how you negotiate with a foreign country. You do some things, you ask them in good faith to do others. We ask the cuban government to do absolutely nothing. They freed i think its 53 cubans today that were in prison. They will rearrest them next week if they want to. They have complete control over the island. The cuban people are no freer today, no closer to freedom. The United States is not closer to having a reliable neighbor in cuba than we were before all of this was done. Its i think a very sad day for u. S. Foreign policy because again, it shows a very weak Foreign Policy. It is like withdrawing the Missile Defense from Eastern Europe without consultation with our allies. You know, its just not a good thing to do to show weakness in the light of a regime that continues to be on the list of terrorist states with some very unsavory characters as you pointed out in the opening of your show. As you worked in the bush administration, you served in the hemisphere, what is your judgment first on the impact that this unilateral opening that president obama has found today, what will the effect be on the rest of the hemisphere before we turn to the u. S. . Well, first of all, thank you for having me. I want to say that im very happy and we should all rejoice about the fact that alan gross is now free. He was a man who had done nothing wrong, really, except trying to help the Jewish Community in cuba and has been forced to stay five years in a cuban jail. Starting with that, we should all be happy about that. But i have been a bit disappointed about the events today. President obama said in 2008 that liberty and freedom are going to be the north star of his policy towards cuba, and today, it only seems that liberty and freedom have become an asteroid rather than the north star of his policy. And to a hemisphere that has pledged to be a democratic hemisphere and i was with secretary of state colin powell in lima, peru in 2001 when the hemisphere signed the interamerican democratic charter, i dont know. I just dont think democracy is as much of a priority now as it used to be. It is, however, moving forward at least we go to venezuela and obviously, cuba has been the beneficiary of, i will be kind, that socialist regime, but it is now on the shoals, economic shoals because of the plunging crude oil price worldwide. Is the cuban attempt here to open quote, unquote, normal relations with the United States, driven by that economic reality . Yeah, i think the cubans got three things today. They got the good seal of approval of the United States, who has decided to open an embassy. They got three spies that they had waged a Worldwide Campaign to get, School Children asking for their release, the national heroes, so they got that, and they may even get the lifting of the embargo. President obama has said congress should take a look at that. I just dont see how much the United States got a lot in return. As far as the hemisphere go ahead. Im sorry, is the president , just to put it in plain english, is this president simply flailing about for some form of legacy with his Foreign Policy adventures and unilateralism . I think there are people in the administration who have said this is the right thing to do, that the embargo hasnt worked, that its time to try Something Else. My problem is i just dont see how this Something Else gets us any closer to democracy. They say we are now going to be able to engage. Well, the cuban regime has been very clear, they are not interested in democracy. They have signed all kinds of u. N. Conventions pledging to democr democraticize. They have never done anything. They will not cede one inch when it comes to the revolution. This may turn out to be an important part of the president s legacy, one he would just as soon not have included. Lets talk about what happened over the weekend in the senate. Cruz and lee were slapped down pretty mightily by the senate on their efforts to hold the president accountable for that fiat. Your thoughts on the fact that the president has not been actually in any significant way challenged by either the house or the senate, this senate, at least, in his executive fiats. Well, i think its really a shame republicans split on that vote. A lot of folks split on sort of a technicality saying it was a constitutional point of order and the spending bill wasnt unconstitutional, per se, its the president s actions that are unconstitutional. I think thats splitting hairs too finely. I think the reality is we are far more united against executive amnesty than that vote suggests and i think we are going to have a chance to illustrate that early next year but certainly, im very committed to fighting, pushing back any way possible against this unconstitutional action. With your appointment to the Judiciary Committee in addition to all of your other prestigious and very Important Committee assignments, the house Judiciary Committee has reported out four bills to the house. Yes. I support those four bills. Yes. As do i. That legislation represents leadership on the part of the Republican Party on the issue of illegal immigration, Border Security. Why could that not be the initiative that republicans in the house and senate combine to drive forward as true viable, effective reform . I think it can be and im hopeful it will be early next congress. One avenue im pushing and we need to do a bunch of things at once, but one avenue im pushing is strong proenforcement legislation like that and i think we can move forward with that in the house and the senate and we should put those things on the president s desk. So thats one goal of mine. I think we need to do other things at the same time. One thing i have announced is im going to oppose this new attorney general nomination. I will be on the Judiciary Committee for the hearings to oppose it because that person would be a key person in the Obama Administration helping president obama implement his illegal, unconstitutional executive action. On loretta lynch, in opposing her, what is the practical effect . Is there sufficient objection to her to void her as the president s nominee . Well, lou, we dont know yet. I hope there is. There certainly could be if voters help us focus on this travesty of executive amnesty thats flat out unconstitutional and it would also help if we went back to the 60 vote rule for executive nominations in the new senate, but both of those things are a bit up in the air. There is no question you are one of the most talented, as well as experienced and brightest people in the senate. There are a lot of people i can point to a lot of folks who would argue with you but i appreciate your opinion. Imagine that, a politician with detractors. But your alliance with Elizabeth Warren, joining forces with her to remove the Financial Regulation rollback under doddfrank, that was an alignment that people really got their hair on fire about. Well, i know it surprised a lot of people. It really shouldnt if folks have followed my work in terms of too big to fail. For instance, i have been working with Sherrod Brown for a couple years now to try to truly end too big to fail, including by having much higher capital standards for megabanks. This was a similar related issue and i dont think the taxpayer should be basically subsidizing risky behaviors through fdic insurance. Thats what this issue is about. To put it in vastly oversimplified language, what the senator is referring to is the rollback of legislation that now permits fdic insured institutions to maintain derivative trading within their corporate structure, which means that the fdic as the senator just said will be insuring what would be risk that doddfrank did not, did not anticipate or in point of fact, tried to remove. Lou, if we had blocked the rollback, as you know, those derivatives could still happen. They just wouldnt be under the fdic insurance umbrella, wouldnt essentially be subsidized by the taxpayer in that way and so they would have been more properly priced in the market somewhere else. Senator, as you look toward the year ahead of us, you think that this is going to be a constructive, Effective Senate and house that will be able to do business with this president who has refused to compromise through the first six years . Well, first of all, moving beyond the Harry Reid Senate has got to be productive and constructive. Im celebrating this week because this is the last few days of the Harry Reid Senate in history and thats got to be positive to end that. I hope we get to a more productive place with president obama but thats largely up to him. Thats about whether he is open to real compromise working with congress. Hes speaking he says for racial minorities and he is disparaging america as racist. In the National Liberal media is listening to him without critical judgment, listening to this man who has been the recipient of just about every benefit this great nation can bestow on a citizen who begins life with so little. Mr. Obama has become, while in office, more entitled. He has become more elitist. More superior in his attitude and his tone as he obviously looks down on the rest of us lowly american citizens who were in the words of his obamacare architect, so stupid that we listened to his lies and we believed them. And now this man claims without moral authority of any kind that racism is quote, deeply rooted in our society. I would mind less that president obama thinks so little of us that if he just hadnt taken quite so much from us. In his new interview with People Magazine, mr. Obama says quote, theres no black male my age who is a professional who hasnt come out of a restaurant and is waiting for their car and somebody didnt hand them their car keys. Wow. The president has launched a crusade of ignorance against this country that has given him all that he has today. What he should in my opinion be saying is thank you, lord, thank you, america. Is mr. Obama grateful in any apparent way . No, not that i can see. He railed about having once been mistaken as a valet and as a waiter when he was wearing a tuxedo at a black tie dinner. Is then the president s top advisor also a racist . Valerie jarrett mistook four star general Peter Carelli for a waiter back in 2011. First Lady Michelle obama went on to give an example of racism in this country of her own. She recalled an incognito trip to a target department store, where a woman asked the first lady for her help. The first lady obliged and the first lady this week joined in the white houses campaign of ignorance, telling People Magazine quote, she didnt see me as the first lady. She saw me as someone who could help her. Those kinds of things happen in life so it isnt anything new. My god, the courage it must have taken, the sacrifice that she made. Arent you impressed . So why am i talking about the first lady . Why is this an issue now . But was it when the first lady first described the incident to David Letterman two years ago . She portrayed it then very differently. She said excuse me, i just have to ask you something. And i thought covers blown. She said can you reach on that shelf and hand me the detergent . I kid you not. And the only thing she said, i reached up because she was short, and i reached up, pulled it down, she said well, you didnt have to make it look so easy. That was my interaction. She should, helping other people is a blessing always. But now the politics of racial exploitation have overwhelmed this white house and much of washington, and the first lady has fallen in line with the new american narrative spun by her husbands administration. Now her story has become one of racial discrimination. Ignorance in my judgment is now on parade in washington and its time for all of us to call out our leaders for their cynical, despicable hypocritical works and unseemly conduct. No american in my judgment should fail to respond to such words from the man who says he is our leader. Maybe we are only now awakening to what this administration really is. A new wall street journal nbc poll out today finds a majority of us, 57 of americans now say Race Relations in this country are bad, compared to just 40 who say Race Relations are good. That is the lowest level in almost two decades since 1995. But perhaps most damning of all is the publics view of president obama. The poll also found 71 of those surveyed want our next president to generally take a different approach than president obama. I would also for one ask this president to apologize to the American People for his harsh, his unfair, his untrue judgments but i assure you that now, i expect nothing at all from president obama. There is racism in america and many of us have experienced it but america is not racist. The reason i really say that, lou, we have an africanamerican president , a man with brown skin, and many many caucasians voted for him. So how must they feel now to be told youre racist . Now, we voted for you, president obama, but im a racist . Thats bothering me. His attorney general retreated into the shadows for several years, now has emerged talking about racial animus as the reason that many of us criticize the policies of this president. Now people of every ethnicity are voting for a president with brown skin. So there again, i just dont believe that we are totally a racist nation. There are still pockets but we go at them. I dont i personally dont know a man or woman who i would describe as racist. Not a soul. As a matter of fact, i guess i have been very fortunate in my life never to have encountered many of those folks. Im very fortunate. I dont think that im outside the typical american experience. I had nothing as a kid. I came from a poor family. I was the beneficiary of scholarships and financial aid. Im just like bill clinton or barack obama. I came from nowhere and had nothing and got something. Well, i have been in come to jesus moments with some people if i were to name them, caucasian people, powerful people in this nation, but there was a time when there was a repentance and they would cry and say i have been racist, forgive me, my brother, forgive me, my sister, so i have experienced racism in my lifetime. But i would not, still not say that all white people are racist. When my uncle was killed i wanted to blame white people. I wanted to hate white people. You have heard me say this. My daddy said you cant hate white people. White people marched with us. White people go to jail with us. White people pray with us. White people die with us. So i was taught that by my daddy, a. D. , my uncle, m. L. America is not racist. There is racism in america. Well, it is so sweet of you to hear you say m. L. Whats really disturbing is the way they folded like a cheap suit over these threats which we now know are coming from north korea, who has made ridiculous threats before. Its wrong but you know what concerns me more, steve, is not that america is being blackmailed or extorted or run roughshod on, but the fact that we are made more vulnerable by the very people who dont have security, cybersecurity for their firm, for their company, for their intellectual property, and who then roll over as youve said like cheap suits, if i can mix a lot of metaphors there. It concerns i think most of us profoundly that the United States has known north korea is behind this hacking and has done not a damn thing about it. Are we going to see that change . Well, if i was a betting man, i would say no. I dont see this Administration Standing up and calling a spade a spade, letting them know were not going to stand for this. If it was me, i would start flooding the internet with this darn movie and let them know we are not going to put up with it. Whats probably going to happen is this administration will try and use this to get some onerous regulatory solution to try to fix the internet which wont help but will make them feel better. The fbi is supposed to be an antiterrorism organization now. It hasnt been able to do a darned thing as far as the American Public can see for years to defend the country against cyberterrorism, cyberattacks, nor has it been able to carry out at least a publicly recognized attack that would disable our enemies and those who attack this country. Are we really so impotent and so feeble . Well, hopefully on the offensive side, were not that impotent. I think u. S. Cybercommand on the military side has the capability to do offensive operations, but theyve got to wait for the president of the United States to give them the word to go, and i just dont think this president s going to do that. Then what are we to do . Where does that leave the United States . Well, each individual firm is going to have to defend its own network, and we as individuals have to take the steps to protect ourselves. Its the strangest coalition you will ever see in your life and it lasts for about 15 seconds. Talking earlier with senator david vitter, aligning himself with Elizabeth Warren on the issue of doddfrank and pulling derivatives out of the protection of doddfrank and inserting it into the insurance of fdic. Do you know theyre both right on this issue . They are absolutely both right. And the president and the house and senate are utterly wrong. Do you agree . I just did that to see if you i agree and i think its outrageous for citibank to be able to take two paragraphs and stick it in a bill. You have a 1600 page bill. Nobody knows what was in that bill. Im becoming an advocate that if you want to vote on a bill, you have to read it and sign it. And have time to read it. But you have to wait to 2015 for regular order, the hearings we dont need the 1600 page bills. We certainly dont need appropriations the last week of a long session of congress. They need to get back to basically spending money in an appropriate period where people know whats in the bills. Theres so much junk in the bills, by the time they finish there will be three rewrites. Vitter made it pretty clear. I think hes one of the smartest guys in the senate. Hes one of the most effective. He makes it pretty clear hes not going to put up with nonsense. You throw in mike lee, ted cruz, all of the others, there can be trouble brewing here. What do you think . There can be trouble. Even ted cruz joined with Elizabeth Warren over the weekend and i really think the biggest story coming out of this weekend, the biggest political story, i should say, is how Elizabeth Warren along with nancy pelosi, they locked arms on one side. The other side is basically mikulski and there is such a schism in the democratic party. Youre talking about the left side of the party. Where would Hillary Clinton fit in all of that . I think every time you mention Elizabeth Warrens name, it shows there is an alternative to Hillary Clinton. I think this, and i would let democrats slaughter each other for a year just as we are going to do. I think the critical thing here is the heavyhandedness of harry reid over the last several years. You will now in the senate have some very strong chairmen. Mitch mcconnell will not get to push them around. He will go back to the job of the leader, to move it forward. I havent agreed with mcconnell over the years on various issues but one thing you have to give the man, hes smart, hes clever and he knows what the heck hes doing. Its not a shot at mitch mcconnell. I think its very important for every senator and the Committee Chairmanships to start working again and to do things in committee so you can basically watch it and these gang of eights that run off in the back room and come out with a 1600 page bill is wrong. Do you think republicans get the fact they better be focused on the middle class this time and as ed is saying, these 1600 page bills arent going to fly anymore. They play that game, they are going to be dead in the water. The long ter the bill, the ls likely it is to help the middle class. I can promise you that. But look, the working class voters, really blue collar america, is what helped republicans win. They didnt do as well with mitt romney at the top of the ticket. Thats a big lesson for the party. You want somebody relatable and accessible, instead of parachuting in people from elsewhere and saying im one of you, they put on mom jeans im trying to think of a rust belt governor. Does one come to mind . There are several. In other words, just somebody who is relatable, who is one of them. The working class voter is the key. Take a nonrust belt governor, jeb bush. He has had, by my count, his fourth start at telling folks hes running for president. This is his fourth engagement. He had the book, he had to tear the book up basically and say lets rethink my position. What is going on with jeb bush . I think hes running. I think at this point in time, i think he went through a thoughtful process and is now crossed the rubicon as they say. Nobody is getting out. Right. No one cares whether hes going to run or not. The 20 people that are going to run, are going to run. The only one who may be badly affected is christie who was basically getting a lot of the bush money people and he still has the option to go up, raise money, run in iowa, new hampshire, south carolina. If you dont win two out of those first three, you are going to have a hard time moving the ball forward. Jerry jones box, my goodness. Governor christie, yes. Im glad hes my governor in new jersey but i have to say, new jersey voters root for three nfl teams. Jets, giants and eagles, none of which are the cowboys. People were not happy. He has a right to r he has the right to route for who he wants. It was political not smart because pennsylvania is a swing state and texas is not. Its also a great meeting market. Go eagles.
