Orders for bigticket items in the u. S. Slumped 7. 3 in july. This is the first retreat in four months. The decline came mostly on the back of fewer passenger jet orders. That is where it was focused with the airlines which plunged 56. 3 . New york city state attorney general as im sure you saw filed a lawsuit against the donald, donald trump and his forprofit Investment School charging them with making false claims and engaging in illegal business practices. The lawsuit seeks restitution of at least 40 million. Trump as legal team tells us at fox business that the ag has been trying to settle with them for months but they have rejected his proposed deal. Amgen announced a deal to bionics pharmaceuticals for roughly 10. 4 billion this is allcash deal. It values onyx at 125 a share. Bats Global Markets will merge with rival Stock Exchange company, direct edge holdings. It will unseat the nasdaq as the second largest u. S. Stock Exchange Operator by volume. According to the wall street journal the u. S. Treasury department will hit the Borrowing Limit by midoctober. It will not be able to pay all its bills soon after that. This midoctober time frame is sooner than a lot of people on capitol hill had anticipated because all the new tax revenue coming out and the sequester prevented some money from going out. After the bell starts right now. Lets get right to todays action. We have chris retzler, Needham Growth FundPortfolio Manager whose last stock pick is up 15 since you told you to buy it. Well tell what you that was. And Tim Mulholland in the pits of the cme. Tell you what is happening in the middle east, that the u. S. Might get more actively engaged in the syria. That didnt affect the markets t wasnt until the last minutes of the day that it began to shoemo men tum downwards. When secretary of state kerry had a little more aggressive words holding the sirfian government accountable that maybe hit reality. Russians want due process from the u. N. To be done and so forth. Nevertheless it is a little unsettling. Now you enter ad big geopolitical factor into the equation here. David the other thing that surprisingly did not affect the markets was the durable goods number. It was focused on airplanes, building of airplanes and those numbers came down quite a bit but are you surprised the markets didnt react to that number. The market liked it because perhaps the fed will continue this taper thing, that argument. That is probably why youre getting that reaction. Maybe counterintuitive if you will but i think that is what the reason was. David but, chris, there is only so far the fed can go in trying to turn the economy around with these low, with these low Interest Rates. Of course the Interest Rates have been ticking up. They were only down a tick today but stock prices, the key of whether they can stay ahead of what their earnings are, a lot of people thought that, think that stock prices jumped ahead of earnings. What do you think . Well, weve certainly seen tapering will haveer the last some small impact we think going into september. The washington will be coming back to work so we think that will bring in some volatility but we like to stick with our best picks out there. Good management teams and good growth stories that are out there. David what if earnings dont catch up to where the stock prices . Well, again i think, if youre with a Great Management Team they can manage through those lulls and were longer term investors. So missing a quarter we see as a great opportunity to be buying. David tim, this is kind of like a nomans land in the market right now. You know, youre up, youre down but basically you stay flat. Weve been there for a while. How much longer . It is called a grind and i think thats what youre doing grinding higher right now because conditions are such where there is money coming off the sidelines out of bonds obviously, money markets coming into stocks. Cash flows are still there the economic backdrop isnt bad. I think right now it is still the game in town. I dont say i trust the market but nevertheless i think the same thing holds true that held true the entire year right now. Were continuing to grind on those fundamentals. David let me challenge you on one thing. You say the economic backdrop looks good, looks okay is probably better way to put bit but does it really . You talk to a lot of Small Businesses. They say theyre being nickeled and dimed obviously by more taxes, regulatory costs which are tremendous burden and lack of enthusiasm by the consumer. Does the general economy look that good to you, tim . Snipe not saying that. When you look at real wages and real incomes how they have been another disappointing feature of the market. David okay. Hey, guys. Hold on one second here. Im sorry to ask you a question and break in the middle of it, tim but we have breaking news. Bill ackman, who of course has been famous for very famous short sells and long as well has decided to sell his entire interest in jcpenney. And you can see the market reacting afterhours. Jcpenney closed 13. 35. It is now trading at about 12. 92. Tim, sorry to change you in midsentence there, but do you think this will affect this stock tomorrow . I dont think its a big surprise actually given the fact of the events that happened over past couple weeks. I imagine you get a little bump down. Other than that i dont know that will be surprising. David yeah, by the way, we kind of knew he was going to do it. We didnt know he would dump the load at once. We thought he would do it in stages. Chris, this brings us to the idea what retail is doing. Jcpenney has a lot of issues that are unique to that company because of its problems but retailers are looking very shaky, particularly when youre looking at apparel retailers, right . Yeah, i think we ran through some difficult earnings last week. Consumers are not spending money in apparel. Probably spending with Companies Like carmax. So theyre buying bigger ticket items. You had a lot of teenage jobs that werent created this summer so going back to school was a little bit weaker. David on the other hand, health care, youre still bullish on health care . It is not going to happen but even if obamacare is repealed, it will not happen this year with a democratic president , even if that happens, more americans will be receiving some kind of health care, at least basic health care, right . One of our favorite names, weve been there for many years is express scripts. Drug delivery to the patients, the aging population. That is a very long secular theme were on. David why express scripts in particular . Express scripts is a well run Company Based in the midwest. They have mailorder. They have distribution through pharmacies. Its top of the line drug distributor. David and technology, what do you think of that sector in general . Well see something out of apple over the next couple weeks. Well see what kind of products they are bringing out. David what do you think it will be . We think it is clear a 5s, a cheaper phone. David wont be a gamechanger oror new product entirely no. No. I think that will be in the iphone 6. We want to look what happens in china, whether they have a china mobile phone. David because youre looking at apple you have a stock that relates closely to apple, ttm technologys. They do manufacturing of the printed Circuit Boards that go into a lot of phones. Were seeing hiring at their fa facilities and that is a good indication something is coming. David wall street journal how to look for stocks. Tim are you looking at european stocks at all . You know, weve been looking how they have been responding i guess given the better Economic Data but lets not forget there is a big german election coming up. Perhaps this isnt surprising coming into the german selections. Given what is going on right now maybe policymakers will stop reforms that need to be done structurally. David we have emphasize jcpenney. Put it back on the board. You have confirmed it . It has been confirmed the entire this is the largest single stakeholder jcpenney sold his entire stake. The stock is down afterhours but surprisely not down as much as it originally was. It is coming back. People are buying after hours despite a big selloff in jcpenney. Thanks to tim and chris. Well check in with you in the s p futures close. Gentlemen, thank you very much. Teslas stock rallies to alltime high but it is trading 294 times forward earnings. That is more than google, ford and exxon. Is this stock a bubble that is about to burst . We found a rare tesla bear who says yes. She will tell us why. Also drink up, jack daniels serving up a big expansion in the u. S. To flex more muscle in the International Whiskey market. Always tough to get bourbon overseas. Not tough now. David shares of jcpenney are falling though less so as Pershing Square says it will sell its entire stake. Lets head back to Lauren Simonetti on the floor of the nyse for the late e. What is going on, lauren . Jcpenney was down 1 for monday session. Afterhours we saw it plummet 5 . As you can see, it is not doing as bad as right now. The news is activist investor bill ackman says he is selling his entire 39 million shares of jcpenney stock or his companys pershing capital entire stake in that company. Earlier this year you know what happened. He was trying not only to get the ceo mike ullman out but also the chairman of jcpenney. He has been in the news a lot. Jcpenney shares are down a lot. If you look at a oneyear chart, this stock is down 45 , david. David once again, they have announced their sale. They havent actually dumped them on the market yet, right . Announced today, yeah. The underwritten offering of more than 39 million shares. David the announcement has been made. Theyre going to do it. The shares have not been dumped yet. It might have overall effect on the shares diluting the stock. Nice to see you, Lauren Simonetti. S p futures are closing in 10 seconds. Lets head down to sandy smith and Tim Mulholland on the floor. Sandy i have not seen you since you had the baby. You look magnificent. Thank you, david. I appreciate that. Great to be back. David latest on the cme as we hear the closing bell. Why was there a lateday turnaround in the market . Was not a turn around but definitely a pull downwards. I think there is a lot of ongoing talk down here about the Economic News that we keep getting out. Durable goods was horrible today. We have the new home sales last week, that was horrible but the market is trying to get past this bad news. Weve seen a lot of bad Economic News playing out in the commodities markets. Oil prices, even though were dealing with the syrian conflict, that would normally be bullish for oil, david. Oil prices were down today. Seems like the market was focusing on the weak u. S. Economic news for the timebeing, they kind of floated higher on very, very weak volume toward the end of the session. David tim, even though you havent had a baby recently you look marvelous as well, lets talk about gold if you dont mind. Gold, there was article in market watch how gold, price of gold the fact it stablized was telling you that gold really doesnt believe that the fed will get serious about, about stopping its purchases of bond and printing more money. Do you agree with that . I think gold is saying they cant stop it. I think gold is the antipaper asset asset class if you will. I think it is, went through its big correction. Look like it stablized. Actually from a technical position looks pretty good. It is saying something about the fed and probably what they might want to do but cant really do. Sandy, were always talking about the distinction between wall street and main street. I think there is a distinction between wall street and what happens at cme in chicago where the traders seem to be a little less mystified or enthusiastic about the fed money printing than folks out on wall street are is that true . Yeah, but, wall street, traders on the floor here, theyre gearing up for what is going to be a major change in our Interest Rate policy in the united states. Weve gotten really used to at love help from the fed and there has been a constant acknowledgement, down here, david, that the stock market has been artificially propped up by all the fed intervention. David right. Once the fed gets the heck out of there, these traders want that to happen. They want the free markets to work as they should. They dont want all this government intervention. Theyre actually looking forward to it and anticipating it, not dreading it like many might think. David tim, is that true . Yeah. The taper, when you talk taper, personally not even reducing the balance sheet. It will get serious when the fed starts really reducing the balancing sheet and start tightening. They keep Interest Rates at zero. Money print something probably something were addicted to and cant get off of. Everyone knows multiple expansion is the name of the game right now. Ly lets face fact unless you get Something Like inflation out of the feds control, this tapering thing will be sell the rumor buy the news type event. David tim, good to see you. Sandy smith, so wonderful to see you again. Happy motherhood. You too, thanks, david. David the big news, shares of tesla hit alltime high. The market cap surpassing 20 billion on news teslas model s is outselling luxury sportscaster at least in california. Our next guest is a rare tesla bear who says this is a bubble getting ready to burst. Joining us lauren fix, car coach automotive analyst. Lauren, great to see you. Why are you such a part pooper on tesla . Look how they showed profit to begin with. They based paid back the government loans. This was based on politicians and to get electric companies which most failed. Elon musk and his team were very smart. They took special credits from the california special board and used credits and sold them to companies that werent able to meet those federal standards. So instead of showing 57 milliondollar loss, they showed an 11 million profit. David lauren, i agree with you 100 . I agree with you 100 it was artificial but sometimes even an artificial stimulus can get demand going. Have we reach ad point now where there are enough of these things on the road, people say gee, i like the cargoing by, even though it was phony demand, built on basis of a lot of federal credits and state credits as well maybe now it is built a demand of its own . Well, i think that, you cant deny it is a greatlooking car, number one, that is absolutely the fact, but, the fact is not too many people have 70 to 90,000 to buy a car. When you look at that market segment, it is much narrower than the average large car market where the car was sold 25 to 40,000. The market demand says a lot of people saying me too, me too. It is coollooking car. I talked to a salesperson from tesla, not disclosing who i was. What do i do to if i have a problem . Well send a technician out to you . Who pace for hotel and air fare when they try to fix my car. We have a great package. I have a home in buffalo, new york. Will you send a guy out from california to fix the problem . There are a few teslas running around town and they are totally awesome. The truth i dont think it will be stronger demand. I think it is artificial bubble. Elon musk does a great job and futuristic look way dealerships can work he can not break you there franchising laws that have been there almost 100 years. David youre a car specialist, not a stock specialist but tesla is selling 165 a share. How much do you think it is going to drop . You think by the way that even elon musk is expecting some kind of a selloff, right. He actually post ad statement over the weekend he is shock how big the stock number has been. I monitor it every day, i said when it broke 100 i still had doubts in my mind about it. I still have doubts. I think everyone is buying on it right now. I left pebble beach, everyone is buying cars. The car industry is whether collector cars or new cars. That is great for the auto industry. I dont know how long this particular stream of being an electric car and being this high price range without having infrastructure. You dont need brickandmortar buildings necessarily. They can partner with other highend brands with bentley and ferrari. David they may eventually be forced to. They may eventually, we have a delay here. Forgive my overtalking. They have been talking about that. I have to emphasize, 12 of luxury sportscaster are teslas or selling teslas. In june they sold 1097 units in california, more than porsche, cadillac, land rover, all of those. Theyre doing well. That is just the month of june too. David i understand. Talk about one market that is not here that may be expandable for tesla and that is china. China has, there is huge demand in china for luxury cars. What if they go to a Manufacturing Center there and sell the cars to the rich chinese . I think that would be genius of him. Now right now they are having a little issue with bringing tesla in. Theyre saying there is another company in china owns that name. I think it is a very small hurdle for him to clear. Theyre very smart over at tesla. If they can work around our federal government i am sure they can work around the Chinese Government too. It will be a matter clearing their name, that it really belongs to elon musk. I think they will sell them there they have different rules in every country and building these in other countries is very smart for him. David final question, fair share for tesla is 165. What do you think the fair share prices . Well, not being an analyst, from the stockbroker side im going to say it will go up a little more but it will not continue rising. It will have a bubble and it will eventually burst. David lauren fix, the car coach. Thank you very much. Good to see you as well. David whiskey lovers rejoice. The Company Behind jack daniels or john daniels as some call it, building the first new distillerly since prohibition they will spend 100 million. What is driving demand for its products with one of the brands top executives coming up. Forget about the taper at the fed. There could be a much bigger threat out of washington that might delay the derail the markets and hit your portfolio and make it harder for companies to do business. Details coming next. David for the First Time Since prohibition jack daniels will be building a new distellerry from the ground up on the jack daniels property in lynchburg, tennessee. The new 100 milliondollar facility will increase production to meet growing demand for this world famous his kim. Joining us, jack daniels, Senior Vice President , john haze. Congratulations. Good to see a company hiring, you will hire 90 people with the 100 milliondollar expansion. What kind of jobs will be created . Yes, really, david, jobs throughout the whole structure from the standpoint of people handling our grain as it arrives into the distillery operations and actual cooking, fermentation and filling the barrels and getting those barrels into the warehouse and shen shipping it out. It is across all the functions within our distillery operations. David weve been talking, this is earnings season. We talk a lot about companies that beat on the bottom line but dont beat on the top line. They are doing well because theyre squeezing. Youre doing well because youre beating on both the top and bottom. Your revenues are increasing. Why . Well the brand itself, if you start out in our industry were lucky to be in the distilled spirits industry which is showing growth over last three years in the 3 years. Were also in the whiskey business, and whiskey business is by far the largest in the Global Spirits industry and that is growing 4 or 5 . Then you look at american whiskey, bourbon which is outpacing the whiskey category. So were doing really, really well around the world and as is american whiskey. With us the leader were in the position to take advantage of this growth. David you mention around the world. I used to cover latin america. For the entire time there i tried to get bourbon i couldnt. This is back in 80s, early 90s. Right. David scotch is their main drink. I imagine the same is true for asia. Have you changed that already . Same thing with me. I started about 25 years ago. In my first trip to london you couldnt find a bottle of jack daniels in a pub. Now were one of the largest selling spirits in the u. K. It has been dramatic change over last 25 years. Where i started we sold four million of cases of jack daniels. Most of that was in the united states. Mostly 95 . Now were selling over 11 million cases of sway jack daniels in 150 countries, black label is the highend bourbon. Old number 7 is our flagship brand with the black label on it. That is our other story for us we have a family of brands. Gentleman jack, jack single barrel are more expensive. Both growing doubledigit growth. Our rtd business, in cans and bottles is millions of cans and bottles around the world growing five or 6 . Our newest family member, jack daniels, Tennessee Whiskey or tennessee honey is selling nearly 800,000 cases. It had not been introduced even three years ago. And one of the reasons we announced the expansion. I love jack daniels. One thing i love about it is the brand. You mentioned the brand. One of my favorite movies is scent after woman with al pacino. You should have paid him for mentioning jack daniels as many times as he did. There are competitors. I like makers mark as well. That is produced by jim beam who is a competitor of yours. Right. David are you having to take them head on . I would say were in friendly competition with jim beam as well as in our own stable at brown foreman, wood ford superb, premium bourbon. David i will have to test that excuse me, john, i will have to test that. You have to ship us, no, im kidding. So, no, we have a stable of american whiskey brands. Our founding brand, old forrester showing rebirthright now. Early times and wood ford reserve as well as full family of jack daniels. There is plenty of growth out there for our friend down in clermont. David john hayes, jack daniels senior vp. Thanks for coming in, john. Appreciate. Thank you, david. David the dog days of summer are almost over. Congress is about to return to work. Talk about a mixed blessing but lawmakers already are on a collision course. David investors and market watchers alike eagerly awaiting money and earnings from money managers. Lets head to Lauren Simonetti on floor of the new york Stock Exchange with the latest on this. Well show you a lot of companies where a lot of hedge funds and moneymakers are putting their money. Lets show you general motors. This is the fourth most popular stock among hedge funds. First is google, second aig and third is apple. 121 hedge funds have money there. The stock is down a little bit. The stock is up certainly this month. Second stock well show you, National Oil Well varco. This is Oil Equipment company. The billionaire investor has a position of one million investors. Chicago bridge and iron ore. They build energy and infrastructure. David shaws fund owns 1. 6 million shares. The fourth is verisign, this is internet registry service. Berkshire hathaway, buffetts company he increased his stake to 11 million shares in the second quarter. It is not only that, Lone Pine Capital a big shareholder as well. Those are popular names in the hedge fund world. David people are watching what they buy very carefully. Lauren, thank you very much. Sure. David while wall street traders are living easy thanks to easy money from the fed, main street businesses are having a tougher time than ever coping with a whole host of new taxes and regulations making it harder to do business in america w more grandstanding fights coming over things like debt ceiling, will washington do anything this fall to cut the cost of doing business in this country . Joining us, steve bell, senior director at bipartisan policy center. Steve, thanks for coming in. Anything serious, we need to make the cost of doing business going down. That is how main street businesses smaller and midsized dont have money for accountants and lawyers that is the only way they will be able to make it. Any serious reforms on that, coming up . Actually not if you look on the calendar, same old fight for spending bills. Not one is passed. Well have a fight over the debt ceiling that happens midoctober to early november. Many of us hope that would be a way to put together a package of regulation reforms, spending reform and a longterm debt increase but i think if you take a look at mood of people coming back our hopes may not be realistic. David why isnt the message getting through the thick heads inside the beltway . I think two reasons. Number one, 2014 is not president ial Election Year. So both parties are appealing to the bases, the people who show up in primaries frankly. There is a lot of primary challenges in both parties now, wellfunded primary challenges. That is one reason. The second reason is, it has been very difficult to get the president and the congress to really negotiate seriously. David right. You have four factions. You dont have just two now. You dont have congress and the president. Youve got two in the house, two in the senate and the president. You have a fiveway fight here. David lets take the first point you made, this is not Election Year. I would think Election Year would be more difficult there would be too much hanging in the balance to get anything substantive. I would like it think off year like 2013, they could look at Corporate Tax reduction. Everybody agrees Corporate Taxes are highest in the world. It is really hurting america. Can we at least agree to bring that down . I think there is agreement to bring it down but it wont happening this year. The outlook for tax reform is dimmest ive seen. They can do Corporate Taxes and what do you do about individual taxes . What about loopholes . All of sudden youre back into a mess. I dont think on tax reform you will get clarity. David it really ticks me off. I understand the president s side. He is one of these academics his whole life who doesnt know about Small Business. I think there were one or two real Business People in his administration but republicans theyre supposed to understand a little bit more about business than the academics in the democratic party. Why cant they at least find some way of reducing regulations that are really hurting businesses . I think one hope, let me throw out one hope. The house of representatives Republican Caucus has introduced a series of bills to reduce regulation and similar things. Those bills actually do save money according to the congressional budget office. I wouldnt be surprised to see some of those bills attached to debt ceiling in an effort to do what you just said. I think however it will be a very difficult fight. I think were going to see unfortunately the kind of gridlock weve had before. I think that probably gives clarity to nobody. At some point this will start hurting the economy. David by the way looking at debt limit, we have word today debt limit might be coming, that fight as soon as october. Right. David i had thought with the increase in taxes over past year, there is more money coming in and with the sequester, meaning less money going out of the government i thought that that was going to be pushed off, that moment we reach the debt limit. Apparently i was mistaken. What jack lew said or wrote in his letter is pretty much right on. Midoctober. Were saying mitt october, first week of november. It is going to be very difficult to get past november, first week of november. Even with the 50 billiondollar curb shun jack mentions in his letter i think were going to be there, finally, steve says he is always for the little guy, against the big buy. How much long every than that illusion continue . In fact big corporations are th. It is small and midsized, exactly the people he is fighting for who are being hurt in the most in his administration . I think youve got it exactly right. I dont think he ever run a Small Business or any kind of a business. I think he listens to people from big business, a lot of contributors are from there. I do not think he has an essential understanding of two or three people getting together, starting a barbershop and all of sudden leading to something that is a national chain. I think he has no idea of the challenges they face and has no sensitivity to it. David no skin in the game. Steve bell, bipartisan policy center. Steve, good to talk to you of the appreciate it. Thanks, david, appreciate it very much. David call it the u. S. Open economy. The landmark tennis tournament generates hundreds of millions of dollars in business. It serves up some of the big names and sponsorship deals. Well talk to a one of the big ones from the u. S. Open next. Hard to believe popcornmaking machines have been around, get this, 120 years ago that is when they got started. Well go live to jeff flock to get the latest on a true american icon. It is one of the Largest Sporting events for the year and a big opportunity for major sponsorship deals. One of the sponsoring companies is prince sports. This is bounced back from bankruptcy and it is hoping to serve up some buzz at this years event. Cheryl casone joins us live from the u. S. Open with more. Cheryl . David, can you imagine, you were on the brink of bankruptcy. Then in fact you filed for bankruptcy but youre not just any company when it comes to the world of tennis. Youre a tennis racketmaker, apparel maker. How to come back from bankruptcy. How to survive and come back stronger than ever. That is what this company has done. This is prince global. The ceo joins me now on here on the grounds of the u. S. Open. Mike what a story. You were telling me you were completely frustrated people think you were out of business and business is back and you really recovered since then. How did you do it . It has been a long road over the past year, cheryl. I think it all started by going back to basics. Prince is the authentic american 10 miss company, rooted out of princeton, new jersey. We went back to our roots, core consumer, average tennis player. Youre really knew to the job. Youre coming in to help the company turn around. Youre in this new role here based more in the states. What went wrong at prince . What can the rest of us learn what happened at prince . Lesson im learning we spread ourselves too thin in distribution. We went too low and wide in price and image for the brand. Were retrenching a little bit well focus on the specialty and core customers. Well rebuild as premium performance and innovator. When you look at the next six months, look at the next year where do you think you will focus your energys . American consumer . International consumer . No, no. You are international and global. The home market for prince is the united states. That is the core, core market we have to focus on. Where our biggest opportunity lies today. It is where we can regroup and rebuild our market share very aggressively. Talk to me about the business. First off, these are, we dont say sunglasses i understand. Now we say performance eyewear. Performance eyewear. Exactly right. Is this a product line that can help the company . Were focused obviously on tennis rack kest and footwear and equipment. This is been specifically designed for tennis to enhance visibility on the court, to make the ball and lines clearer. So it is just one of the product west offer that will we should say youre making the apparel as well. Right. What are the margins like for apparel these days . Pretty competitive market, isnt it . The whole industry is very competitive. Were up against big guns in nike and adidas. Were focusing on the core consumer. Mike, youre definitely out here today. The message prince is not out of business. Has to be frustrating moment as a ceo but letting everyone know youre back and will rebuild the company. Were in the business and reservicing the market the right way and were happy to enjoy tennis this week. You are working with marion bart tollly who may or may not retire.
