We have a couple companies reporting, athenahealth. Coinstar. Begin with athenahealth. Lets start with them. This is a beat on earnings per share, ashley. 29 cents versus what the street expected, 28 cents. Revenue is a miss, 16. 6 million. The street was expecting 116. 9 million. Take a look at coinstar. This is an interesting mix here. Youve got an earnings per share breath of 93 cents when the street was expecting 73 cents. Revenue not nearly what the street was expecting. 564. 1 million. The street was expecting 580. 19 million. Liz the problem when you miss on revenue. You can engineer the eps. Squeeze out all kinds of cost savings. That is why both these names, athenahealth and coinstar selling off rather dramatically. Ashley afterhours. Lets get to todays action with Todd Horowitz in the pits of the cme. Lets get your reaction what we heard. Athenahealth and coinstar both missing on the revenue. What does that tell you . Hi, ashley, hi liz. What it tells me the stocks both anticipated, a mean that anticipated a much better number why selling off very heavily after the close the revenue miss is a bad sign for them. Coinstar was unsided. It looked to be the split decision because the charts were telling us that they couldnt figure out where it was going to go. The miss wasnt surprising. That would also look to be selling off. Liz talk about the sense in the market and certainly in the pits there about the fact that these selloffs are nothing too dramatic. In fact theyre rather shallow. Yeah. When you look whats going on the market is a in a big consolidation pattern. If we look at s p we see a solid top 1510 in the future. 1515 in the cash and solid bottom at 1490 in the future, 1494 in the cash. Right now the market is trying to make up its mind. We have a real lack of volume and lack of conviction here. The market is poised. The trend is still higher. To fight the overall trend is hard here. What you have to watch we have to wait until you get above the 1510 level to actively buy again. If you want to look short you have to wait until we break the 1490 level. That is where the market is. We went down to 1494 and went right back up. Ashley you say this market is all smoke and mirrors i guess so what because the trend has been up, up and up. What point does somebody, do the investors and markets realize, wait a minute, were living in a false world . You know as long as, as long as we have the fed, as long what they call the bernanke put the market will go higher. There is no place to go for yield if you look for yield you cant go anywhere else. You have to go to the equity market. You cant go to a bank. Bonds are offering no yield. Where are you going to go . You have to go somewhere in the equity market to get any yield on your money. Bill stone, pnc Asset Management chief investment strategist. Lance roberts ceo of street talk advisors. Bill, let me begin with you. Youre the bull. Youre positive on the u. S. Market. You dont think its overbought and due for a correction of some sort . You know, would say my horns are not as sharp as they typically are. Ive been on here a lot and been positive even while things didnt look so good. When it gets a little bit overheated i would say, yeah, im a little bit less sharp of horns. But the end result is i still think the value is there on the stock side. I would say, tilt yourself to probably a little less aggressive kind of names at the moment but for those that are still waiting on the sidelines, i dont think this should necessarily get in the way of entering into some sort of program to get involved. Liz lance, bill just use ad good word, overheated. Do you see this market is overheated . When you look at the year charts, they look fabulous certainly. But, yet it doesnt feel like it is totally overheated. Maybe im wrong. Where do you see it . Last time i was talking with you, liz, it was probably back in august. We were talking about going into the end of the year we would have a correction. That was because at that time all of our indicators on a weekly basis were extremely stretched to upside. Sentiment was extremely bullish. You have exactly the same condition now that you had going into september and that led to about a 7 correction before your next good buying opportunity came in. So my point is, i agree with your other guest here is that the equity market looks good. The trend is positive. Things are good. You have the bernanke put in here. You have 85 billion a month pushing into the markets but chasing the markets at this point is a little bit risky. I would at least use some pullbacks to add to exposure, rather than jumping in maybe right today. Ashley that brings me to bill. Bill, where are you investing . What sectors do you like and how do you prepare, how do you hedge against that risk of a bit of a pullback . Yeah i think my sectors will reflect a little bit of, you know, act little more conservative. So think about maybe health care, staples, things that obviously are needed. I think there are some Great Stories obviously. You cant say the overall sector is great. Ill highlight just two names for you. I think one is pfizer. The interesting thing about that, you get a nice yield of roughly 3 1 2 , we think there is still a new drugstorery going on there i guess i should say a emerging new drug story. The cupboard had gotten more bare for a while. They have restructuring going on. They sold a portion of their Animal Health business in talk ses successful ipo. Theyre trying to unlock value. That is good. Maybe on Consumer Staples make you like proctor gamble. You get 3 yield. The stock has gone essentially nowhere in five years. Youre just back to breaking through there. Here is what is going on. We recently got a earnings report. Looks like margins are starting to come back. Theyre starting to gain market share back in major products. We think a emerging better story, yeah. Liz lance, i would like to get the you and the names you like. While youre striking a little bit more of a bearish tone you have positive choices among them kelloggs, Johnson Johnson. You like bluechips and utilities, energy as well. When youre looking at these names and these sectors what is it about them that makes more comfortable about making money. Im not more bearish. Im cautiously optimistic. Like bill, the trend is positive. Our job as investors and particularly as Investment Managers is buy cheap and sell when things are expensive. That is how we make money, right . Liz of course. Things are very extended and stretched. I Like Companies that have more defensive in nature when the markets are overvalued on a shortterm basis because when the market corrects this is where money goes to. Money will go into places like Johnson Johnson and proctor gamble, exxonmobil. Those are companies that have good stable dividend growth, good strong Balance Sheets and theyre the ones that will pick up the cash flows as investors look for a place to hide out of high volatility areas. Totaled represented 62 of the total revenue in the Fourth Quarter of 2012. Revenue from international markets, this is what a lot of people were paying attention to, 114. 6 million, representing 38 of total revenue in the Fourth Quarter of 12. Liz . Liz yeah, thats been a huge business for them. New users, 70 International Back in q3. Looks like the trend continues there. Ashley yeah. Liz last month it was herbalife. Today its apple. Green light capitals David Einhorn, a thorn in some companys sides, going after apple today, challenging the companys proposal to remove prefered stock from the companys charter. Ashley just in the last hour apple responding to einhorn. Shibani joshi joining us now with the latest developments on this story. And the story continues and continues to heat up with apple apple doing uncharacteristic things. There have been proxy fights before. There have been issues taken to the shareholders that apple has not responded to but it chose to respond in this instance. You brought it up in the 3 00 p. M. Hour. Lets bring our viewers uptodate. In case you havent heard it, the company reminding its shareholders they have announced a plan to return 45 billion to shareholders over the last three years. The companys release also went on to say that apples Management Team and board of directors have been in active discussions about returning additional cash to shareholders. With that, one sentence, shares of apple went on the possibility we could get more money inked out. Apple goes on to say this proposal number two, which is what David Einhorn is against, actually would not deter the company or prevent the company from issuing preferred stock which is what David Einhorn wants. Essentially what theyre trying to make a distinction of, is that it is this blank shares, a blank check prefered shares which are often used as a way to prevent a poison pill, to prevent companies from taking it over, to raise a lot of money without any shareholder approval. It is a lot of power for a board of directors to have. Theyre trying to remove that from the current setup. Again big issue here is that David Einhorn says there is a lot of money sitting in the cash coffers. He wants some of it back. One company that or one entity that does not believe or will not side with him at least in the short term is call percent. This is the nations biggest Public Pension Fund calpers. 243 billion in assets. 247 million shares of apple which is twice the amount that einhorn holds. They have already said that they are going to vote in favor of this proposal, proxy item number two, which goes contrary to what David Einhorn wants. He may not get that support after all. Apple coming back, as you mention a rare thing. Liz but it is so obvious shareholders with a big voice like einhorn are getting annoyed by looking at that pile of cash and saying give me some of that. He equated 145 per share sitting there that could be accessed by shareholders that apple is preventing. The stock price went down 30 in the last six months. Shareholders are looking around. Theyre saying give it back, give it back. Liz Larry Haverty of gamco on fox business predicted this on monday. I predict a shareholder lawsuit. Boom, it happened. Ashley hes right. Weve got someone very familiar with the matter. Mark parkinson, he has a passion for the elder care profession, operating several Nursing Homes with his wife and serving as ceo and president of the American Health Care Association. You and your wife have built these into some serious business, but obviously theres a massive need. What have you seen in the past couple years since we last spoke with you when it comes to demand and need . Well, youre right, theres a huge need. You know, just indicated the number of people over 65 is doubling to over 90 Million People over the next 20 or 30 years. The need for elder care continues to expand dramatically. The challenge that we have in this country, though, is how are we going to pay for it. At the very time that we have all these boomers turning 65 and the greatest generation in their 80s right now, the countrys never really been in a worse position to pay for that care. So thats the challenge that we face. Ashley im fascinated by this doubling of the age, you know, the age 65 and older. That, to me, sounds like its going to have tremendous strain on the system already in place. Can the infrastructure be put in place ahead of time, or are we just going to deal with Serious Problems . It is a huge strain, but we need to, first of all, step back and say isnt it great . We have dramatically expanded Life Expectancy in this country. People are living longer, and theyre living a Higher Quality of life in their older years. Ashley yeah. But its a real challenge. Because the issue of how were going to pay for it comes up. The first thing we have to look at is the governments going to have to get serious about entitlement reform. The cost figures just dont hold up. These programs were developed with age Eligibility Criteria 30 and 40 years ago, were living longer now. We really need to look at that. The second thing we need to do is look at the companies and Business Opportunities that are out there. You just had the ceo of athenahealth on, that niche of care, of company is really helping improve taking cost out of the systems and keeping quality up. Ashley right. We also think theres a tremendous opportunity in our sec or to have. Alternatives to hospital stays whether theyre Nursing Homes, assisted living facilities or home health are a way to take care of people in a cheaper way, hopefully in a quality way. Liz but it all does come down to money. And what we have seen especially since the payroll tax cut was eliminated, people are now poaching their 401 k s, mark, just to pay for basic needs that they have, and then youve got the Sandwich Generation which is sort of straddling that that they need to pay for either their parents or themselves. Youre right. It is a really tough time right now. Folks that have resources are spending them on their kids going through college, trying to take care of mom and dad at the same time liz because mom and dad are living longer. Yeah. So its a great thing, but its also a very challenging thing. Liz have you had the president s ear on this . I think the president understands at least on the cost side that whether its hospitals, nursing home, docs, we have to lower the cost of health care. The cost will keep going up, but it cant keep going up at a higher rate than inflation. So, again, its a tremendous entrepreneurial opportunity because companies that can figure out a way to help lower costs are going to do well, which is why you see these Software Companies booming. Liz ashley and i were talking about what a change in washington since you left the governorship as a democrat. You crossed the aisle many times to work with your republican brethren. You dont see that anymore. Whats going on . The middle has disappeared. Twenty years ago there were a hundred swing districts out of 435, so those were people who had to work with both sides of the aisle. There are now only 35 swing districts, so republicans have become more conservative, democrats have become more liberal. Its created some real problems. Liz good to have you. Reporter or this is also, guys, the latest marriage or i should say the spawn of the marriage between chrysler and fiat. Tell me why. These are on fiat ducato. These are platform vehicles, and theyve been redesigned and reengineered to fit the north American Market with a stiffer suspension is and a few other things like gps and Wifi Technology to fit what the needs are for the american buyer. He will have another chance at parole. Seen here back in 2008 with me where i interviewed him in prison. Hes serving 825 years for grand larceny. Back in april he was denied parole. His lawyers said, wait a minute . They in essence said hes a threat to society. Today a judge reversed that decision saying there were no details involved as to why kozlowskis release would undermine Public Safety today. Hes been a model prisoner, all of that stuff. This clears the way for a new hearing possibly as soon as next month. Kozlowskis attorney, alan lewis, sent a statement over to fox business saying, quote liz as you know, kozlowski was sentenced, hes been serving more than some murderers in that same prison for stealing from his company. But we should also point out he has paid back more than 90 million in fines and has already served many, many years. So its just an interesting thing ashley very interesting. Liz hell be able to get another shot as soon as possibly next month at parole. Ashley continue to follow that too. I cant believe its been that long ago since we spoke with him in prison. Liz yeah, exactly. 2008. Murderers in that same prison have come and gone, so you decide, right . Ashley sometimes the Justice System is crazy. All right, listen to this.
