As for yahoo, thisll be the first Earnings Report under the new ceo and the question becomes is her turnaround plan working . As they quickly punch it up, looking into the close down slightly about half a percent. David Commodities Futures Trading Commission set to vote on new rules protecting your investment. We can use that after mf global. Well be talking to bart chilton on the regulation of how this can impact your money. Liz but first, what drove the market in a different direction today in the Data Download because most of it was down and ended to the upside. The stocks rallied with all three major indices eking out gains to and in the green. The dow rallied nearly 100 points in the last hour. Technology and materials pretty much the top performers. It was just technology, Everything Else was down. Copper hitting its lowest level in more than a month after bigger than expected drop in japan exports. The metal used in construction of power closed down nearly 1 . Natural gas falling about 4 after three straight trading days of gains, profits at the aw 2005. Northeast and midwest forecast for the week pushing press prices a bit lower. David telling us what he thinks europe is on the right track about to make a comeback. Scott at the cme, even though the market turned around, the vix was on the rise in oil was dropping. You heard some people say down there it will drop another 10 from here, is that correct . Absolutely. Looking at it from a technical standpoint. The decembers futures which started trading last week not a lot of data, but down here below 90, a pretty solid number, there is no support anywhere in the near future. All the way down to maybe 81, 80 per barrel. If oil makes a little bit of a run, touches back to the 90 level, which is pretty solid resistance right now. If it doesnt breakthrough, that is where the next leg down is 10 . The next two to three weeks excluding god for bid any geopolitical concerns or geopolitical events that may affect that. Liz anybody talking about the fed . Im not hearing about this, the first thing constantly mentioned. Zero. Talking somewhat the debate and more so the bears on monday night football tonight. Liz i can imagine, youre probably stoked about that. Everybody is making a big deal about oil. Low 89 per barrel, what does that do for equities . It is funny because coming off of friday, coming off of the october event it looks like we might have seen a little turnaround today. If Oil Continues to slide, i think this was a great buying opportunity for people to get back into the market after the drop on friday, the big reversal today and my guess is supposed earnings, this next prime earnings season the market will head higher going into the election. David expectations of earnings this quarter have been so telegraph has been down, perhaps those expectations so negative that it returns the upside will be viewed as good with go up another four or 5 from here. Totally agree. Any little drop we get like friday people will say i have got to start stepping my toes back in the marketplace. You will see it higher. David thank you. A nice little rebound. You have to look at where we have come and the Market Holding off in the last three or four days. Not that surprising, really. David i just want to put up, we can put up the numbers for yahoo, going through the numbers as you can see after hour trading is higher than where it closed. Good news coming out of yahoo. We dont want to release all the numbers. What i was saying before, it holds true here for yahoo, expectations really beaten down prior to the reporting this season, perhaps any turn to the upside will be viewed as positive, no . I agree. Especially in yahoos case to the come close to the earnings and revenue estimates to think given googles missed last week that woul to be very positive. Liz Ashley Webster has the numbers, decent move for the stock at the moment. A decent move on the etf, earnings per share, the estimates for 0. 25 a nice beat. And then the revenue side coming in 1. 2 billion. The estimates was for 1. 08 billion. Yahoo up 1611, 1612, and a little move up. We will continue to dig through the numbers, the cost per click rate, what theyre generating from their online ads and more importantly what Melissa Meyer has to think about the strategy and structure of the Company Since she has taken over the company. David remember, it was a cost per click that got google in trouble leading to tremendous downturn to the market is a little hesitant until it gets all the numbers in but i have to say go back to scott available at the cma, lets go to peter them. Scott, you are available, we saw a beat on the top and the bottom line, we still havent got the clicks numbers in yet. Once those come in, could that change the afterhours process . In the long run, no. Maybe another 0. 15, i dont see the stock regardless of what the click rate is, dont these topping 16. 5. It has been dead money for so long, the top part is really capped off in the next 20, 0. 30 or so. Liz again, were waiting for the cost per click, but also looking at the americas money that came in, pretty decent number coming through. Shares up 2. 7 after the bell looking at this. After google ending on positive news feed will be met with possible buying. We will wait for more details as it comes out but initially deserves to have a little pop it is heaven. David do you think you might own yahoo if the numbers are good . It is possible it would eventually come to our screening process but in general we look for companies with good fiveyear Earnings Growth and fitting the profiles. It will be a while i think before we see yahoo on that list. Liz what are some of the names on that list, what do you really like right now . Some of our biggest purchases have been in the energy area. The Drilling Company and other oil service companies. We do own google in a small amount. And several other stocks. Recently a lot of Energy Stocks have come through is very attractive. David peter is very bullish on oil, youre not, why are you not so bullish on oil . I think its in a pullback in the commodity space in general. With the economic slowdown, the demand side, if you will, you aryoureseeing the pullback in y prices and we will see supply as mentioned before but always be in the middle east and issues surrounding prices that way. Real demand side is for lower prices. Liz there is the question of risk in what is going on globally that might affect them, but the fiscal cliff, are you concerned about that at all . In the third debate tonight, politics are centerstage you talk about financials. A mitt romney would be better for the big banks. They have been strong but from a longerterm perspective, three years, five year chart, they certainly have a long ways to go given the Financial Sector in favor, Better Real Estate prices will be the real engine for the Broader Market as well. Liz wells fargo 30 over the last year. That is pretty darn good. Look at some of these names, bank of america included. Liz the s p up 30 in that time frame. In the last six months and in the last year, in line with that performance. At what point do they start to outperform . That will be interesting over the next three to six months. David the one thing that concerns a lot of folks even proromney is going on in china. Does it seem to be so intent on the populist sort of protectionist message in order to get votes in ohio that he may go overboard causes some kind of a trade war with china . Yes, it does concern me. Im optimistic it is just political rhetoric and the tone will be much more moderate should he be elected. David we will hear more about it tonight, right . Yes. David appreciate it. If you want to get defensive, theres a good way to invest your money and still get in for growth if there is a potential for a big rally. Liz a couple of bricks could fall from the wall of worry because it has been built up as the market has done quite well, held up very sill the zillions. They fought back in the last hour simply moves to the upside for the Dow Jones Industrial and s p and nasdaq looking better but lets talk about three places you feel are appropriate to hide the cash for the time being if you want to get it. Liz everybody should have an overweight in their portfolio because it is very stable. We look at the baby boom. As they get older they need more care. People get sick, based on demand. Theyre a growing sector of the market, a good place to put your money. I like eli lilly and merck. Eli lilly came up with a potential alzheimers drug. These are good baby boomer type place. They dont like to play individual like these. I like stocks up with decent dividends but you dont like the individual health care. There are ways to play with funds. These big pharma stocks in there, and medical device companies. You want to go down there, you can do the fun route but i like eli lilly and merck. Liz all pharmaceutical plays have different views. To look at those two and say they play on aging population that is now living a lot longer to those of the two names you like there. We also show consumer names, there are concerns consumer names could get hurt. These are necessities, not luxuries. Even if we see a downturn and another double dip for whatever you want to call it, you eat breakfast, you use shampoo. My shampoo budget is pretty low, but these are things that we use everyday. Liz and everybody is mainlining diet coke around here. We like General Mills and coke right now. It also have to consider some of these companies have seen outside growth. General motors and coke up 30 in the past five years. Up 15 whe you put in the divid. Roughly 3 dividend yield. Not like you cant get growth in these stocks. It is pretty impressive. Again, like for health care, the Consumer Staples played. A bunch of other stocks including retailers like walmart. The other core place consumers go out and get. Liz this is a way to get all the names under one roof, so to speak. I lovlove the title of your next thing, that is almost cash investment. Putting cash under your mattress i dont think its a wise idea. In the highyield savings accounts, 1 , get out of town, it is not worth my money. You want investment almost as safe as cash to get a decent amount of return to keep up with inflation. One good investment to look at his corporate bonds. Yields four or 5 , not a huge amount but better than you will get in treasuries or in cds. I recommend Investment Grade bonds. Corporate bond fund only Investment Grade bonds. The reason you see those returns is because these are names people trust. Companies that will pay their bills, they will not default. Almost as good as cash for the corporate bonds. The other like, if you just want to cash, you can always go with the treasury inflation protected securities play. They go up as inflation goes up so you will not get huge returns. Lets see doubledigit inflation but it is a great way to maintain your purchasing power. Shortterm securities, fiveyear maturity. If you think they will be inflation, this is a way to do that. As you can see on the screen there, still waiting on the eps. There is a lot of numbers here but not the actual nongaap eps number. It appears to be 45 cents. The estimate was 46 cents. Were already seeing some of this stock moving slightly lower in afterhours time. Looks to me like 45 cents on the eps. 3. 39 billion on the revenue which is just about, just a slight beat on the revenue side, guys. Were seeing the stock come down a little bit in afterhours trading but now turning around. Well dig into this more. As we get more of course well bring up to date. David thank you, ashley. Liz it was just about a year ago when mf global went bankrupt leaving 1. 6 billion in Customer Fund simply missing but there a new proposal by the Commodities Futures Trading Commission that may be able to prevent problems like this occurring again. First some history here. Have you rude out the possibility of criminal behavior with Global Global . Mf global. Dave, good to be with you. Criminal behavior is department of justice. That is a, not a ruling we make. We have civil fines and penalties. David dont you join forces in terms of sharing information about these things. Youre absolutely right but i dont want to make news what the department of justice may or may not do but good try, dave. Liz he tried. Lets get to the issue at hand. Were expected to hear from your office about the new rules that would prevent money simply going off into the ether like we saw with mf global and perigrine financial. A lot of these where traders and brokers plant their money. It is shock and disgusting when you look at these innocent people who thought they were just parking their money and it was simply gone. What can you do to prevent yesterdays problem . I agree with you 100 about this. So disturbing. These are real people with their, theyre trying to make an investment in markets so there is really three things i anticipate and i hope we will do. I have called for it, on this week, later this week, thursday. One is that if you can believe it, in perigrine, which was appears to be a 200 million swindle, they were duping regulators with photoshop. So we need to have electronic access to these things, right . I mean that is just, welcome to the 21st century. Liz can you dip into their accounts peer in and see, do they really have the amount of money they say they do. That is exactly it. David liz. We should be able to do anytime we want, to make sure the money is there if it is customers money. That is the first thing. The second thing is standardized audits. Different regulators who look at these things. The National Futures association. We at the cftc look at it. The exchanges look at it. Their own auditors look at it. We need a common set of audit didding practices so things arent lost in translation. And the thing we need liquidity level alerts. When somebody starts to dip into a problem because they have been credit downgraded or something of that nature we need to be alerted. If we get to a point we think they will have real problems and lose customers money they will be mandated to move those fund to another firm. If they dont do it, then we step in, the regulators will mandate because the first thing weve got to look for, the main thing is customer money. David now, bart, you stand a pretty good chance i think of getting those three through in some form but there are two things youre getting a lot of pushback from. One is insurance fund. The question who pays their portion of that insurance is up for a lot of discussion. And then these, the question of fines, particularly related to the cheetah traders, the High Frequency traders. Saw some of the fines do nothing really. Do no serious damage to the actual traders. If you were were fine them by the second, that would really hurt them. Explain how that would work. Right. Well the bottom line is right now we have the ability, dave, to fine no goodnicks, people who violate the law, 140,000 per violation. It is pure violation. What a violation is determined by us. In this high speed world where you have the cheetahs trading in milliseconds, 1 1,000th of a second. Weve seen Companies Make and lose millions in a second. We certainly need to update our fines where they are per second, as you say. So it is a real deterrent. So far a lot of these fines have been a cost of doing business. If you make millions in a few seconds why wouldnt you risk 140,000. Those 140,000 were when times were. Liz what do you want the fine to be, bart . 140,000 per second, if they do it for 10 seconds, every second. We can lessen that, if we want but cant by law make it more than 140,000. The question how do we define a violation. Those violations were done when it was humantohuman trading. Now we have computer to computer trading. We need to update the fines. Liz finally, we promised people you would give them tips avoiding or spotting ponzi schemes. This stuff is stunning to me. The cftc rooted out 25 ponzi schemes over just the ast year. Absolutely, liz. There is only so much regulators can do. We can do the customer protection things we talked about but they need to do their own due dilligence. If somebody calls you, unsolicited, be very scared what theyre offering. If telling a special deal or only limited time offer, run for the hills. If they guarantee you they will make profits in the market, another sign this could be a big swindle. A lot of Consumer Education can take care of this go to mymoney. Gov. That is the federal government website how you avoid these sorts of things and pick up, how scam artists rip off america. We dont make any money at the consider. Ftc, by the way. Yahoo reporting a profit of 35 cents a share. Thats 10 cents better than expected. Revenue of 1. 09 billion also just topping the estimates. Federal regulators meantime hit david lehrner associates with 14 million in sanctions for unfair practices over a nontraded Real Estate Investment trust and charging customers excessive markups on other investments. The firms founder and ceo, david lehrner, has been fined 250,000 and suspended from the securities industry for one year. And nissan recalling nearly 14,000 select 2012 and 2013 altimas. The nhtsa said the certain bolts in the vehicle may have not have been properly torqued david a lot of businesses were hit hard during the recession but we found a company that actually turned the recession into an opportunity, by hiring laid off talent and by locking in some cheaper advertising budgets and it all paid off. Joining me now is the ceo of lightway foods. Congratulations. I love stories you roo fuse to admit there is recession. You find opportunities within that. Of course one of those opportunities is a good talent pool, right . Thats right. Yeah. Im forever optimist and we really, you know looked at the trend reports in our sales figures and we saw that there was no slowdown for Lifeway Foods and seas. We started to increase our hiring. We were really lucky, a lot of people that would normally never apply to lifeway and looking only at fortune 500 or fortune 1,000 companies were open to working for a smaller entrepreneural company like lifeway. It really worked to our benefit. In addition to increasing our talent pool we also were able to take advantage of some really great deals in marketing and advertising. David yeah. When other people really werent doing it. Another thing. David julie, that was that a matter of locking in, when advertising rates came down as a result of the recession is that when you locked in some of these advertising deals . Yeah, that is exactly what happened. They were almost giving it away because nobody was doing it. That was the first thing that went on budgets was advertising and marketing. So we were able to really use that to our benefit. The other thing is, that we were really early adapters into social media and social networking. We even had a myspace page. That is how early we were. So that, and that, you know, and especially at that time was a fraction of the cost. So we really were able to build this great evangelical Community Within that space. David you know, it doee go with the territory. We were talking to john mackey not long ago from whole foods. His whole focus on nature foods it is tied into the internet. It is a perfect opportunity for that. Absolutely because those people are really engaged in what theyre eating. Theyre really interested in learning about foods, ingredients, brands. There is really like, it is a really natural place for us to be with consumers likeminded. And just empower people to make healthier lifestyle and health choices. David by the way, forgive me, julie, were looking at your product who dont know what it is the kiefer probiotic. There certain things, julie to avoid when youre in recession. One thing the fed is pumping more money to get us out of this slowdown. Inflation, particularly of commodities has gone up. Hasnt that hurt you . Milk prices actually this year were relatively low and, you know, we have a little bit of price elasticity within that space. Were 97 of the kiefer industry is dominated by lightway foods. Consumers are trading to Grocery Store visits. They want access to healthier foods and want better for you quality foods. That worked in your benefit. When we know a third of the u. S. Population is obese and that were really facing a major obesity and diabetes crisis, and it is really resulting out of our lifestyle, out of the foods that we eat, out of our inactivity and. David you start them young. Were seeing hear some products of some oriented towards younger audience. We have to go, julie. I have just to focus on one other element you had to deal with. Not only recession but your dad died and you took over the company at the age of 27. I think you were one of the youngest ceos in the country. Yeah. David what was that like . Well, it was a really difficult thing to navigate. Just like in the recession, and, my dad died in 2002. Thats when my brother and i took over the business. You know went through, a really difficult time but, we, thought that, and said, every day failure is not an option and we will succeed. And that is something that my dad always told us. And, you know, i dealt with the recession just like i dealt with my fathers death. Just, my chin held high and persevered through all the tough times. We adapted by innovating and changing up the product and, you know, creating some products that were really necessary in the marketplace that is something, that any company can do in a time of recession, change it up. Get, you know, create some products that people really want and fill a niche. David youre an inspiration, julie, you really are. Thank you. David congratulations on your work. Dry weather seems to help pumpkins quite a bit. Definitely holds disease pressure down. It is rot. It is mildew. Tell you they proliferated with a variety of different kind of pumpkins this year. This is something called a full moon pumpkins. These are white pumpkins. If you look over there, you see other pumpkins. All sorts of different colors. This really helped you this year. Absolutely. Hard to explain but this is one crop that is pretty drought resistant. Yeah, i guess you could say that. They fare a lot better in dry years. Wet feet doesnt work out for the pumpkin seems like.
