Less than an hour to the closing bell on wall street. Im Connell Mcshane once again in today for liz claman. Lets start the countdown. Connell the session that weve been talking about for weeks. Comey day and as we head into the final hour of trading, it looks like investors might emerge from this relatively unscathed. You track the headlines on the intraday chart on the dow today and the stock market opened the day relatively flat. The ecb, European Central bank left Interest Rates unchanged, and you can see a spike in the markets that came around 1 00 p. M. Eastern time. Jim comey was wrapping up his testimony without any major surprises, at least thats how investors saw it. Right now, though, its interesting. Weve given up those gains, lastminute surge here could put us back in place for a record run in terms of the major embassies. But at the moment, the dows down 21. Take a look at the s p 500, of course a broader measure of the stock market and also moving to the downside. All of this happening over the last half an hour or so. Its now down three and a half points and the nasdaq has been tracking into similar fashion, although its hanging onto sevenpoint lead. Financials, one of the best performing sectors today posting gains as the house nears a vote on a doddfrank repeal. The regulation there. So were looking at some of those financial stocks, whether it be jp morgan or goldman sachs, bank of america, morgan stanley. So those are stocks to watch. Another individual namemaking moves today to the market would be nordstrom, seeing its biggest gain at one point today in some eight years. Luxury retailer reportedly exploring the possibility of going private. So thats kind of a summary of where we are, and we still have some time to go. The breaking story of the day, though, of course former fbi directory james comey with his testimony in front of the senate committee. It started around 10 00 eastern time but moments ago, we heard the other side of it. President trumps personal attorney Mark Kasowitz. He had a rebuttal confirmed the president was not under investigation as part of any probe into russian interference. He also accused mr. Comey of being a leaker. Today, mr. Comey admitted that he leaked to friends of his purported memos of those privileged communications. One of which he testified was classified. Mr. Comey also testified that immediately after he was terminated, he authorized his friends to leak the content of those memos to the press in order to in mr. Comeys words quote prompt the appointment of a special counsel, closed quote. Connell that is the whit whitwhite houses response to the comey testimony. Was asked about a wide array of issues today, including his private meetings with President Trump, why he was fired, if he felt the president obstructed the investigation into mike flynn, the former National Security adviser, or more broadly into the russian hacking of the election in 2016. Another big headline from today, which did come quite early in the hearing. Mr. Comey, it turns out, does not trust this president. Here it is. The administration then chose to defame me and more importantly, the fbi by saying that the organization was in disarray, that it was poorly led. That the workforce lost confidence in its leader. Those were lies plane and simple. What was it about that meeting that led you to determine that you needed to start putting down a written record . Kay a combination of things. I think the circumstance, the subject matter, and the person i was interacting with. I was honestly concerned that he might lie about the nature of our meeting, so i thought it would be really important to document. Connell one of many wow moments today. Charlie gasparino in our newsroom. First on the case in terms of thinking behind the president s response and reported on Mark Kasowitz when he was first made the personal attorney for President Trump. We saw him speak a few moments ago. Lets start there. What do you make of his response . Ive known kasowitz for many years. Its exactly as i expected. Now, last night kasowitz was planning on taking a very more nuanced approach to th. He read the testimony from what i understand, the written stuff that comey put out last night. He thought it more or less exonerated his client. He basically said there was stuff in there about whether comey admits in the written testimony that he told President Trump that he wasnt under investigation. He basically if you read the, you know, what comey said, read what he said, it doesnt seem like hes suggesting that trump asked him to stop investigating, drop the investigation merely to, you know, he hoped that comey could let go let the flynn matter pass. So it was very what changed as i talked about last night was the testimony itself how comey would answer questions. And comey went out and basically took a sledgehammer to donald trump today. I dont think donald trump has seen Something Like that. You know, during the campaign, his opponents were hesitant to attack him that he was going to attack back. Hillary clinton, you know, was pretty tough. But i dont think faced anything like this. This guy went after him tooth and nail, called him a liar. Yes. And not only that, said he cant be trusted. Not just a liar. Hes untrust coworthy. He also didnt rule out obstruction of justice. In terms of the whole making the flynn matter go away, comey said today, which to your point is different from what we saw in the testimony is that he took at, his interpretation of that was, hey, listen i want you to stop this investigations of. Thats how he took it. Yeah. I think its going to be hard to charge a sitting president with obstruction here. Everybody i talk to, and i talk to a lot of top legal people, john coffee at columbia law school, almost impossible. And first off, you have to get in his head. I mean think about that. You need emails evidence, you need a huge you need a paper trail and some evidentiary trail, which i dont think they have. Its kind of a he said she said. I think where this hurts the president connell politically. Heres the thing. President trump raised the issue that he had tapes of james comey. So watch out, comey, lets just say. There are no tapes, so why even bring that up . It seems like an absurd thing to bring up, particularly the president of the United States to throw that out there. And theres a lot more here. And this is a big political problem. Connell do you know what that means for markets . I know its one day down 17, who cares. But the idea that were up a little bit on the dow and we gave them up when kasowitz started speaking. Is there anything to read into that . Yeah. I think theres some marginal skittishness of it. I think what the markets are essentially saying initially is that he aint getting endited. The only way you can really get rid of him is if you impeach him, and that takes an act of congress and this congress, thats not going to happen. So what theyre essentially saying is worstcase scenario, you know, hes not going anywhere. If he does, youave pence. But i think what happened througho the days this thing isessier from a political standpoint than what initially led on. And this is a president that does stuff thats just not normal. I dont care what anybody says. You dont do what he did. Call the fbi chief in there and pull that stunt. And if you do that, you know, youre probably going to be facing months and months and months of these questions. And if that happens, your legislative agenda, which includes tax cuts, might not happen. Thats what you have markets trying to sort out. Listen, theres still a good chance youre going to get tax cuts. Congress knows they have to run next year. They have to get something done. Its imperative no matter what happens with donald trump that they get some legislative achievement and obamacare and tax cuts, reforming obamacare and getting tax reform are two of the big things. Connell thank you, charlie. The midterms will be fascinating. Lets bring in assistant bill, former fbi counterterrorism operative who, by the way, helped capture the most notorious spy in history. Theyre both here. So, bill, eric, thank you very much. Let me start with you, bill. Because charlie gasparinos point there is well taken. I think that the president , whatever you think of what happened today does have certainly some political issues on his hand. From where you sit, though, your former position in the fbi, does he have legal issues after what we heard today . Its very tough to tell at this point in time. Number one with james comey saying that he didnt tell him to stop the investigation and then jim said i cant say anything about obstruction of justice. Thats going to come with bob mullers investigation, and that is going to be an indepth investigation. What strikes me the most poignant point out of this is what jim had to say about Loretta Lynch. When she told him not to call this an investigation but to call it a matter, this was a nefarious way of her making sure that the bureau and jim comeys investigators had no way of obtaining subpoenas to subpoena people before a grand jury because youre not going to subpoena them off a the kind of moniker that she put on it has to be an investigation. So what she did was slam the door for getting to the truth because really in these investigations such as the email or the server, the only way youre going to get to the truth is get somebody subpoena before a grand jury. Yeah. To your point, that might not get as much attention today. But in the coming days and weeks, i think that probably will get or should get more attention. Because that was quite a bombshell. A separate investigation. But it was quite a bombshell that we heard from former director comey today. Eric, let me ask you it wasnt really. Doesnt give him permission to open up another case, thats the other thing. That is a good question. Thats something we will have to follow up on. Eric, whats your take on what we heard not only today but where you think this is all going now. Draw any conclusions from it . Yeah. Well, connell, one thing that really stood out to me and i think is being lost in a little bit of the attacks that are coming back and forth between trump and comey e unequically stated that it was russia who attempted to hack our election and it was the russian government behind it. So he called into question everything putin has been saying, and i was glad to hear him say that he is certain that they were attacking our election. And, look, my expertise is Cyber Security now, and i can tell you that Cyber Defense is certainly not an issue that is democrat or republican, and we all have a stake in it. Connell since you brought up this issue and thank you for doing it. Youre right. The former director did have some strong statements on it. Well listen to it and come back quickly and comment on them. Here it is. Was the russian activity in the 2016 election a oneoff proposition or is this part of a longterm strategy . Will they be be back . Oh, its a longterm practice of theirs. It stepped up a notch in a significant way in 16. Theyll be back. Theyll be back. So, h, real quick, thats what youre talking about. I have one more question for bill but thats what youre talking about; right . This is serious, obviously. Absolutely. Ive been saying for a few years now that we need to be worried about spies. We have to be concerned with Foreign Intelligence Services that are launching Cyber Attacks at us. And i dont want us to take our eyes off the ball because while were looking back, russias planning their next attack and the next one after that. We need to be looking forward and stopping them before they connell my question, bill, is this former assistant fbi director. To say you were in the same position as director comey says he was in and say that everything he has testified to is true, how do you think you would have taken this statement from the president that i quote hope you can let this go . Would you take it in a similar way as the former director did did or different . I probably would take it the same way that the former director did. Connell okay. It walks up to the line. It doesnt say stop it but i tell you what, i would be back down writing a memo the same way the director did. Absolutely i would have recorded it within the bureau. Would i have reported it outside . Im not sure i would have at that point in time. But i want to say i absolutely agree with eric. The two major things that come out of there is the broader aspects that is the russian involvement in our democracy and also what Loretta Lynch had to say. I think those are the two major points. The rest of it is kind of theater and whatnot. But we really have to watch out for those other two points. We will follow up on both of those in the coming days. The dow and the nasdaq actually hit alltime highs earlier in the day and when they were moving higher, it was really infrastructure stocks leading that rally, and theyre still doing well. The president actually has an infrastructure summit with governors and mayors later this hour that you may not have heard much about today. Among the big winners, ak steel, stocks like that construction and engineering firms have also done well today. And the other thing as we wait for results out of the uk tonight, remember, they have their big election. What should web watching as we eventually head into the weekend . Lets get to the floor show. Traders at the New York Stock Exchange and the cme group today. Out in chicago. Teddy, to you first. Im going to ask you. I know you would anyway to be honest, twopart question. Number one, did you guys get any work done during the comey testimony . Or just glued to the Television Like the rest of us . And number two, what do you think of the market giving up gains here later in the day . Well, first of all, we multitask, connell. So we watched the markets, and we watched the tv. I think giving up the gains at the current level is really a nonevent. And one sector that you failed to mention that was acting well today have been the financials. Connell yep. Big banks in particular. They started to do better yesterday. Fed meeting next week. You know, the most difficult period for the markets are always between earnings, reporting periods. You know, we just got through may, you know, sell may and go away. May was sort of a nonevent. April was a nonevent for the markets. I think the markets continue to grind higher, and were levitating as you point out, alltime highs today. Connell yeah, it is. Theres the financials. Chris and scott, i have to do this quickly since i spent so much time blabbing about the comey testimony. First you, chris, then scott. What stands out today . Just the fact that the market doesnt seem to care. Were trading the futures market here, and you can see. I mean there wasnt been a lot of volatility. Record highs in the dow. S p and the futures making record highs. So the markets selling, and it doesnt care. And until something changes, i think were going to continue to watch u. S. Dollar. I think tonight with the brexit and all of that stuff with the election, i would be watching u. S. Dollar and see how that moves. You might get some volatility later tonight. Connell the dollars one thing. Scott, this time yesterday, we had nothing we could talk about in markets other than oil. But that really didnt do us much today. Sohat e you watching . You know what teddy said. Look at the financials, and they had a nice move today. But not only the financials, look at the small caps, the roughly. Theyre in a breakout mode here. So i keep a close eye on that. And overall Bigger Picture here, you have to look at patrol vol tilt and, you know, anybody out there thats in this marketplace and that has stayed long in this marketplace, you have to buy protection here. Governor of the people, by the people. For the people. The president will not be indicted while he is in office. While there is some merit to talking about the judicial process, the impeachment process is the process that will bring the president before the bar of justice. Not what was said at your News Conference yesterday. But what did you hear from former director comey . Some legal experts said when he was told allegedly by the president that, you know, i hope you can make this go away or something to that effect, with regard to the flynn investigation, that is different than being directed to do so, no matter how the director took it, he took that as direction but the president is said he just hoped it would bo away. A long way of me asking you how does Something Like that rise to the level of high crime and misdemeanor . It is clear he was threatening comey. Comeys testimony was that he felt threatened. Comey wanted to keep his job. I have got people who work for me, when i tell them i hope you give me a memo on that subject, expect a mem i dont expect a note that is what youre hoped, but youre my boss. Connell dont you have to get into his head in terms of intent . That is real difficult to do. I follow what youre saying. Same thing the director say, to get inside the president s head is another matter. No. There is objective standard you find in section 1512 of the u. S. Penal code. And if you use threats, with, with the intent to stop an investigation, i dont think theres any, i dont think there is any doubt that the purpose of the president s statement was to cause the director to back off of comey, to back of off flynn. Whether he is also trying to back off the collusion investigation, well have to see but connell comey said he didnt think that was happening in the broader sense. The idea as i said coming in to you impeachment is, when you stop and think about it, it is a political process. It is taken up in the house of representatives by people like you who are members of the house. Youre in the Minority Party now. The president s party. The republicans are in the majority party. Most people look at it say no way this is happening with republican control of the house. Are you prepared to make the midterm elections next year about impeachment . I dont think it should be a partisan issue, and i dont think that we will go to the people and say, this is about impeachment. Were going to talk about health care. Were going to talk about jobs, economy and the environment. But, i suspect that, while there may not be enough evidence for republicans to vote for impeachment so far, mueller is going to be producing new evidence. Connell right. That may be enough to make this a bipartisan issue. Connell go ahead, im sorry. Finish your thought. I will agree with you, that the facts that have come to light so far are enough to me to think that theres high crimes and misdemeanors but it would take additional evidence to get republican votes. Connell right. They control the house as everybody knows. You had mentioned term bipartisan, final thing for you. One of the big take ways to me at least, this does, whatever you think of the president , whatever side of the aisle you sit on, there are political risks for the president advancing his agenda, right . Particularly working with your party the democrats, you sit on the Financial Services committee as an example. We mentioned at start of the show, one of the things youre considering financial choice act, would repeal doddfrank, is there any chance, any chance of any bipartisan cooperation at this point given what weve seen on that or anything smells. The choice act is enormously long bill. It has 12 bills inside of it and i Many Democrats supported. I urged the chairman to consider those bills separately. But when you put the whole package together, create something that no democrat can vote for you get a bill that will be dead on arrival. Connell yeah. I. I suspect once this bill dies inheenat well deal with individual bills. I look forward voting for 12 bills that have been bipartisan, come before our committee. Connell well see that. That is a big risk for the president with all this going on in the background. Brad sherman california democrat. Well have republican side in a moment. Dow up almost five points. Were going back and forth in the final hour of trading. On former director comeys testimony, certainly he was quite critical of president. That might be an understatement. But did President Trump really break the law . Did he obstruct justice. It does depend some exten who you ask. We have fair and balanced coverage, you heard from the democratic side of it with congressman sherman there. We have congressman lee zelden standing by. Well i just think as were here they are about to call a vote on the house floor to overhaul doddfrank. Connl yeah. So while, you know, we all remember what happened a decade ago with the housing crash and everything that caused it, doddfrank which ended up resulting in big banks getting big every and small banks becoming fewer, perpetuating too big to fail, now you have a majority in the house and senate and republican president working to improve financial regulations to help the community banks, the credit unions, to allow Small Businesses to get access to capital, make it easier to buy a house, or a car loan. So while were here, and everyone around washington, d. C. , but also all around the country as far as media goes and people at home might be talking about director comeys testimony, the legislative agenda moves forward and today were passing the choice act. Was there anything though that you heard today as a republican makes you any less likely to support this president s agenda or any have, you know, have any doubts about doing so . As it relates to the need, essential need to reform our tax code, to improve health care in this country, to strengthen our military, take care of our veterans, all of those priorities are just as much important as they were this morning, last week, last month. So we have a president i would actually say it is an Important Message to those demoats on the other side of the aisle calling for the presidts impeachment while his hand is on the bible taking an oath. While they want to nullify last novembers election. I didnt vote for barack obama but he was my president. Donald trump is their president. If they want to work with us, there is an opportunity to help improve this country. Well do it one way or the other but nicer to have more people involved in this cause. Connell no doubt there were serious charges he levied by former fbi director james comey, calling the sitting president of the United States and Many Associates inside the white house liars. That is what he started off with today. By the end of it he seemed to be implying justice could have been obstructed. He said earlier, kind of punted on the question, said bob mueller, the special counsel, will have to decide on it. You dont think that will slow down the agenda, make any other republicans wary of supporting him . It is way too important in order to secure the country, secure our economy, we cant sit here stuck in neutral while other countries convince american jobs to move there, american companies, american liquidity. There is too much at stake. There are people right now suffering in states, people that democrats, they like to talk about the popular vote, maybe they want to look at california or new york or new jersey why they got those votes but right in the middle of america, you have people who are struggling to make ends meet. Theyre working two jobs. They care about improving trade policy. They want to not just be employed but they want to make enough in order to have a certain standard of living to put food on a table, own a home and pursue the american dream, for them we cant stop one bit. It needs to be full steam ahead. We owe it to them, that is our oath. Connell biggest story to come out of this. We talk about markets we obviously follow. Theyre relatively stable. The dow is down one. If people still think things can get done while all happening in the background, that is much different story than president and republicans completely distracted.
