The Gop Health Care plan inching toward a vote tomorrow as the Freedom Caucus finally resists day three for judge neil gorsuch and, oh, yes, wall street reacting to it all. Lets go back now to devon nunez House Intelligence Committee chairman. See what he has to say as he leaves the white house. Listen in. I know a lot of you arent from the u. S. Congress, so i havent had a chance to brief a lot of you in the past. But just in order to keep you all fully updated on whats happening with this investigation, today i briefed the president on the concerns that i had about incidental collection and how it relates to president elect trump and his Transition Team and the concerns that i have as i said earlier. There will be more information hopefully by friday the nsa is cooperating very, very well. And lastly, ill say that the reports that i was able to see did not have anything to do with russia or the Russian Investigation or any tie to the trump team. And with that, ill take a couple of questions. Why is it appropriate for you to brief President Trump given his own associate or Campaign Associates that are part of this investigation . Because what i saw has nothing to do with russia and nothing to do with the Russian Investigation. It has everything to do with possible surveillance activities and the president needs to know that these intelligence reports are out there. And i have the duty to tell him tha im not drawing any conclusion. Im just telling the president what exists in the intelligence reports. [question off mic] it appears so. I dont want to get too much of the details but these were intelligence reports, and it brings up a lot of concerns about, you know, whether things were properly minimized or not. But i will tell you. Ive only seen some. Thats in the dozens. But i dont have we dont have the full scope of all of the intelligence reports that were produced or who ordered the unmasking of additional names. And, chairman, were hoping. Are you seeing the surveillance, if it wasnt related to russia or anything like that, are you saying that it was political surveillance . Political opponents as the president has suggested in his tweets . What i have read bothers me, and i think it should bother the president himself and his team because i dont i think some of it seems to be inappropriate. But like i said until we get all the information to the committee, its hard to its hard to really say until we see it yes, sir. We knew there was some incidental collection because Lieutenant General Michael Flynn was kind of talking. Does this go beyond that . And does this qualify to sort of wiretapping that the president is tweeting . Well, it definitely goes beyond what happened to general flynn. Now, of course we dont actually know yet what happened to general flynn. We just know his name leaked out. But we dont know how it was picked up yet. Thats one of the things we asked for in our march 15th letter was for the nsa, cia, and fbi to give us all of the unmasking that was done. And ill tell you. Nsa is being cooperative but, you know, so far the fbi has not told us whether or not theyre going to respond to our march 15th letter, which is now a couple weeks old. Again, does this seem to describe what the president was talking about . Talking about quote wiretapping, which they said was modern surveillance . What ive read seems to me to be some level of surveillance activity, perhaps legal, but i dont know that its right, and i dont know that the American People would be comfortable with what ive read. But let us get all the report reports. [question off mic] it is possible. The president said that president obama tapped his phone. No. No. No. That didnt that did not happen. Ive said this for many, many weeks, including the day after or a couple of days after in front of the press that never happened. That never happened. Did president obama order any kind of surveillance of the president . Well, we dont know who sent the tasking. If the taskings were changed of what went into these intelligence reports, but were going to try to find that out. Did the Justice Department give you the okay to talk about this . It doesnt have anything to do with this. This is information this is information that was brought to me that i thought the president needed to know about incidental collection where the president himself and others in the Trump Transition Team were clearly put into intelligence reports that ended up at this white house and across a whole bunch of other agencies. And i thought it was important for the president to know this. Thats why i reached a speaker this morning. And i came down here as soon as i could. Hold on. Yes, sir . How many people are seeing in these reports and do any of them currently work at the white house . Yeah. Well, i dont want to get into the specifics of it because, look, we only have i was only able to see a few dozen. Of which i think a lot of it does have foreign intelligence value, so lets not there were dozens of reports that i was able to see that were hoping that the nsa, fbi, cia will provide because i know they exist. I want them to provide to our committee so that all of the members have the opportunity to see what ive been shown. [question off mic. I think the president is concerned, and he should be. I think he would like to see these reports and hopefully when we get them, hopefully theyll get them to the white house also. Chairman, do you believe the president appropriately used the word wiretapping . Was it used correctly in his tweet based on the information that you have seen . Well, look, i think the wiretapping, you know, if you use it generally like the president has said, you know, he clearly, you know, we used it differently than what i think a lot of people took it, which was did obama actually wiretap, which we know didnt happen. I think the president s been pretty clear on that. But the physical act of wiretappin do you see any no. And i said that on day two after mr. Chairman, do you rule out the possibility that Senior Obama Administration officials were involved in this . No, we cannot. Given that you have said there was a fisa warrant, which have been approved by a judge, are you concerned that essentially youre saying members of the trump team were in contact with people who were the target of a counterintelligence or some form of investigation . No. I think you would be no, this would be i think youre reading too much into that. What this is, this is normal intelligence reporting. Its normal intelligence reporting. The question is, you know, should he himself or others, should she have been put into these reports . And i dont know the answer to that yet, but were going to try to get to the bottom of it. Unmasking, not that there was this monitoring. Well, theres two issues here. Okay . Theres additional unmasking of names, which i think is totally inappropriate. But we have to get to the i dont know how many names were unmasked that i know there were additional unmasking that occurred. And then you have the issue of these of the names that were put into these intelligence reports that we have to get to the bottom of. And this is why we sent the letter two weeks ago. We need a response to it. Can i just clarify . Are you suggesting that mr. Trumps communications were in those reports first . Second, are you saying that it was going to trigger a different, separate investigation . And third, why did you not discuss this with the Ranking Member before you came to the white house . So yes. No. And im going to be meeting at some point to talk about where he goes with this investigation. But i had to brief the speaker first, and then i had to talk to the cia director, the nsa director, and im waiting to talk to the fbi director because he still has not told us how hes going to get us this information. And then i went and talked to all of you. Not you yourselves but those of you who exist over at the congress. And then i voted. And th i said i was coming here to brief the president , and ill be glad to talk to others later. Mr. Trump communication in the report, youre concerned enough about it but youre not calling for Additional Investigation . Well, we are investigating it. You just said no. No. No. Incidental well, because were already investigating. This has nothing to do with russia, and youre folding your investigation. Because it has to do with the unmasking of names and whether or not this was all gathered properly. So an Ongoing Investigation you thought it was appropriate to talk to us about it . Just remember, we have had an Ongoing Investigation into russia for a very, very long time and all their activities. So, you know, we have the scoping document of the Russian Investigation, and we will continue to investigate anything and Everything Else that might be caught up in this because clearly, we are concerned about what ends up in intelligence products, why, and whether or not there was unmasking. Mr. Chairman im going to have to get back to the capitol here. What are you communicating about or who no, i cant get into that. Sorry. Someone brought you this information very recently. Well, i can tell you this. Weve been asking for people to come forward, and it was they came through the proper channels. They had the proper clearances, and im just going to leave it at that because we have to protect people who came forward in the right manner and got the information. Im not going to say its one person. Speaker, you talked about collected incidentally but nothing to do with russia. Are you suggesting that the communications would have been collected incidentally as part of a criminal investigation . A criminal warrant . No. So how do you believe because i know i read in the dozens reports i was able to see. I was able to determine that it was it looks like it was legal collection, incidental collection that then made itself inttelligence reports. So it has to do with fisa and theres multiple numr fisa warrants that are out there. But theres nothing criminal at all involved. Okay. Guys, i have to go. Hold on. I can take one more question. Im sorry. Was it information looked at in realtime or collected, held, stored, and then allowed to be looked at later . It was fairly quickly from what ive seen. But we have to once we get the reports, then we can ask more questions of the agents that produce the reports. Legal collection, what is it that you find inappropriate about it . And are you attempting to give the president political cover for his wiretapping . Because we the reason that we do this, and we have all of these procedures in place is to protect american citizens who are incidentally collected. And so theres certain thresholds that have to be met to make it into foreign intelligence products. If Something Else happened where it appears to me like there were things that maybe they didnt meet the minimum qualifications, i dont know. But there are things to me that dont reach the level of foreign intelligence value. And if thats the case, you have to ask yourself why did those end up in reports . Just to clarify, this is not intentional spying on donald trump or anybody i have no idea. We wont know that we wont know that until we wont know that until we get to the bottom of did people ask for the unmasking of additional names within president elects Transition Team. You said legal and incidental. That doesnt sound yeah. So i would refer you to we had a similar issue with members of congress that were being picked up in incidental collection a little over a year ago. We had to spend a full year working with the dni on the proper notification for members of congress to be notified, which comes through the gang of eight. And that i would refer you to that because it looks very similar to that. But it would be the best way i can describe it. [questoff mic] im not going to get into that, but i vevery indication its clear whos in these reports. Im going to have to get going, guys. I have to get and vote. Thank you. So the plot thickens somewhat. That was congressman devon nunez, chairman of the house Intelligence Community basically saying that members of Donald Trumps Transition Team possibly including president elect trump at that time himself were under u. S. Government surveillance following the november president ial election. Now, he says it was likely legal. It was incidental collection, as he puts it. But it certainly raises all sorts of questions. He said it was not related to the fbis investigation into russias potential meddling in the election. Lets bring in fox news strategic analyst Lieutenant Colonel ralph peters who joins us now with more. Well get to the london terror attack today in just a moment. But this is interesting stuff, ralph. What was your whats your first initial reaction . My first initial reaction was a congressman has no sense of irony. He has spent weeks attacking others for leaking information, and he today for what i believe is political leaked information on what he said legal. Thats generally not made available to the public. He may have compromised a very important investigation or investigations. I mean, to me, this guy he loves the spotlight, and he was trying in a very partisan way to divert attention from the emptiness of the president s tweets and from the real issues with russia as we saw came up again today with more revelations about Paul Manaforts past. So the problem here is partisanship on both sides and if congressman nunez doesnt like leaks, i suggest he stop leaking. Ashley so what role did president obama play in this . Because we know President Trump made claims that has been proven not true. But president obama was president during this time. Would he not have to okay the intelligence . No. Absolutely not. If a fisa Court Approves it, thats it. If its a criminal investigation, he probably wasnt. But we dont know. But contrary to what you heard, ashley, i think you understand this. The president of the United States cannot arbitrarily order a wiretap or any other type of surveillance on a u. S. Citizen or legal resident of the United States. It doesnt work like that. We are a rule of law country, despite the madcap howling were hearing from both sides of the aisle. Ashley but he did talk about the inappropriate unmasking of names. And this information was spread throughout the Intelligence Community, which he says is just not right. Well, hes not the judge of that. The courts would be the judge of that and the intelligence professionals. Having spent my career in military intelligence, i can tell you we have extremely strict rules forbidding us to use. If you accidentally in a foreign operation, accidentally include a name of an american citizen, the whistle drill you have to go through to correct that and make amens is just really intense. The American People are protected, and i think, you know, congressman nunez was we say in the military hes selling wolf tickets. He was throwing out all of these innuendoes about, oh, names are unmasked. I cant tell you who they are. Ashley right. Theyre spread around but i cant tell you who they are. Hes doing a shabby leak. I want to get to the bottom of the russia issue. I want our president to succeed. I want our country to do well. T this is politicking. Pure. Ashley apparently the president was just asked about this. Were going to have a tape of his response very shortly. But i want to switch gears here, colonel, if we can, and talk about the events that unfolded this afternoon in london. Dreadful. Four people dead, including a Police Officer. The suspect himself killed not before he mode down innocent people on Westminster Bridge. We know this can happen at any time. But what was your response to this . Do you think anything in particular triggered this . Well, we dont know, and we still need to get details about it looks like it follows the pattern of islamic terror attacks using trucks or vehicles in berlin and elsewhere. But we still dont know was it native born, immigrant, claiming refugee status, was he some white punk who converted to islam in jail . Or was it just a crazy guy . So lets wait for information on that. But what we do know is this that we live in free societies. We want to continue to enjoy our freedoms. So although our intelligence and security and Law Enforcement services do an excellent job. Lets not lose sight of that of finding complex plots and stop them, you cant stop everything. And while weve spent north of a trillion dollars on security here in the United States both public and private sector since 9 11, the terrorists are ingenious in finding ways to exploit. We want to fix this. We dont want this to happen again. Its going to happen again because in a free society, we cant just stop all the traffic around Westminster Bridge. We cant close down midmanhattan. So ashley what struck me about this to your point is all it was was a car and a knife. Maybe a couple of knifes to bring Central London parliament and ten downing street on lock down all with just a car and a knife. Ashley yeah, and of course a very symbolic target to hit Westminster Bridge white by the houses of parliament. So all the shots, you have parliament in the background. So they choose symbols. And certainly when we take down isis, and we will destroy the caliphate in the coming months, it wont stop all the acts of terror because the important thing look, islam today is a troubled religion, deep structural problems. The islamists within that religion, the violent terrorists are doing damage to the entire world, including the muslim world. But at the end of the day with these terrorists, people do Something Like the act committed today on Westminster Bridge, its not the ideology, its about them. Their psychology. Their needs to believe that theres a satan out there somewhere that destroyed their lives. And so at the end of the day, although religion is certainly a factor in islamist terrorism, im not suggesting its not. Were dealing with a terrorist brilliant exploitation of young men, and they know how to identify them. And unless we are able to accept the fact that in surveillance means and investigations, there will be some injustice to individuals for the protection of the greater mass of the citizenry. Youre not going to get any farther than we are today. Ashley very well put and, again, again, four People Killed in that attack today. 20 injured. Many of those on Westminster Bridge. Half an hour ago chairman of the House Intelligence Committee, congressman devin nunes basically visiting with the president today, look he has seen dozens of reports that donald Trump Transition Team was being surveiled. He says, look, possibly the president elect him seven at the time. This was under government surveillance. Looks like it was all legally collected but essentially a lot of information nunes says on the president and his transition too many what they were doing. He believes it is legal but told the president about it anyway. As that issue plays out, were less than 24 hours, heated already is, showdown over the gop headlight care replacement bill for obamacare. Members of the Freedom Caucus continue to threaten its passage. The Speaker Paul Ryan says now or never. That the house must pass the bill tomorrow. President trump is issuing a stern warning to republican these could lose their seats in 2018 if they fail to approve the new health plan. Not between a showdown between the Republican Leadership and conservative members within the republican party. Earlier here in the white house, seancer said there is plan a and there is plan a. There is no plan at the moment. This is the moment to replace and repeal obamacare. Much the same talk youre hearing on the hill with house Speaker Paul Ryan. It centers around the conservative house Freedom Caucus. The main number is 21. If 21 republicans vote no essentially kills the American Health care act. Paul ryan said the recruitment effort so far are successful. Listen. Were getting a lot of Freedom Caucus members to support the bill. Weve been adding Freedom Caucus votes to the bill all week. Members promised they would repeal and replace this disasterous, collapsing law. That is what were intent on doing. Reporter when you talk to the Freedom Caucus members themselves they say that is not the case. In fact it is believed as many as two dozen as it stands at this current moment would be voting no on the bill tomorrow. The head of that group is congressman mark meadows from north carolina. They dont have the votes to pass this tomorrow. We believe that they need to start over and do a bill that actually reduces premiums. We had a great meeting with the vice president. Theyre fully engaged. The i can say this at this particular point, we need changes to the underlying bill before we vote on it in the house. Reporter ashley, one of the whips, basically people that go around and try to count the votes of all hundreds of members of congress was here at the white house earlier today and described President Trump as the closer in all of this. I asked sean spicer the White House Press secretary, is that a label the white house embraces at this point . They say absolutely of the president here is the closer. Well see tomorrow if that is indeed the case. Ashley yeah, he will have to prove it, isnt he . Blake burman, thank you very much. It is coming down to the wire but the house may not be the problem. As it currently stand the bill dead on arrival in the senate. Im joined by republican senator from ohio, rob portman. Senator, thank you for joining us. Can you go over there and knock some of these house bop members heads together, come on, get on the same page . We are getting down to the wire. It will probably come down to the wire. Can the house get this thing done . Actually i think they can. There is an overwhelming sense among republicans that the status quo is not acceptable and it needs to be replaced but obviously the question is how. And i think the house ultimately will probably gets the votes. It comes over here to the senate. There will be changes made in the senate. There is discussion taking house provisions met as a placeholder and filling those out further, particularly helping those who are currently getting a tax credit between 50 and 64, maybe not adequate one. Some of the house funding they have put in the bill could be used for that. A concern i have on this issue of heroin Prescription Drug fentanyl, opioid issue. Turns out folks who are on expanded medicaid and for that matter traditional medicaid, theyre needed, their Substance Abuse treatment is currently being paid under medicaid and expanded medicaid, to an extent frankly that is very concerning if it is not handled right. There are ways to get there. Im ultimately optimistic we will get there but it may take a little while. Ashley as always the devil is in the details, senator, but do you i the gop, Freedom Caucus on the house side, is anyone in the gop willing to walk away from this whole thing and leave obamacare in place . That would be a bad thing for the people i represent in ohio. Weve seen our premiums spike. 91 in the individual market last four years. 82 for small businesses. Doubledigit increases for this next year. It is not sustainable. You have the situation of the market not working where you have Insurance Companies pulling out of these exchange to the point now, all of sudden in ohio, a third of our counties have only one insurer which is not choice or competition. Something has to be done. By the way if Hillary Clinton had been elected as president and Democrat Senate elected we would face the same problems. It is collapsing of its own weight. So there have to be reforms. Ashley youre a Senate Finance committee member. Youre a former director of the omb. Senator, i want a tax cut and i want it now, but so many people say that. Should we have not done tax cuts first and then deal with the quagmire that is obamacare and its replacement after the tax cuts . Is that 20 20 hindsight. That is more 20 20. Tax reform is challenging and there are winners and losers in any tax reform. What a great opportunity. Our code is in bad shape, anything we do to make it more efficient, take away some disincentives to invest, save and jobs will be helpful for the economy im excited about that we have the opportunity to deal with a current structure where we send jobs and investment overseas. We make the United States a mag in the for more investment and jobs here. We can simplify the code in ways everybody benefits from. The only people might not like it are the tax lawyers. Otherhan that get compliance is good thing. That will probably be done after health care. Probably a late spring, summer project. Maybe into the fall. Ultimately we get to a solution. I hope we get to one with a result more sustainable over time. That gets the rates down but insures were not leaving people behind. Were not pulling rug out from under people that need the care. Particularly the crisis with the opioids. My home state of ohio is hit hard. We rely on expanded medicaid for that treatment. There are ways to be sure that can be fixed. It is not really in my view part of the core of obamacare.
