John kirby, state department spokesman, is briefing reporters right now on the memo, not saying much other than to say that it exists. And what is so surprising about it is 51 state Department Officials, members of the diplomatic corps, sending this memo through a back channel to the entire department and the secretary of state john kerry. Kerry was in denmark today, and reporters caught up with him, asked him about this memo which was highly critical of the u. S. And the Obama Administrations strategy in syria. And the state, the secretary of state saying he had not read it yet, but he is not dismissing its. Listen. I think its an important statement, and i respect the process very, very much. People or have a chance to talk when i get back. Reporter so this memo came through something called the dissent channel which was set up during the vietnam war to allow employees to express alternative views and perspectives on policy issues. Department watchers are calling the number of signers on this memo on syria unprecedented. It calls for judicious military strikes against the assad regime to help force a political solution, a peace settlement there in the civil war. The wall street journal reporting one line from the cable. Let me read it to you. Quote failure to stem assads flagrant abuses will only bolster the ideological appeal of such groups as daish even as they endure tactical setbacks on the battlefield. Everybody in d. C. In a dramatic advance look at these iraqi forces, they have retaken a Central Government compound in fallujah that has long been held by isis forces. But that good news comes just one day after cia director john brennan testified that americans should still expect to be attacked again by isis sympathizers. First, your thought on this state department signed by 51 internal employees about the criticism they have regarding the administration and how its handling the syrian situation. Liz, this is a shocking development. Something that is almost unheard of. And i think it reflects enormous frustration on the part of the rank and file in the state department over what some would call the fecklessness of this administration. It goes back to the days of the red line that was declared by president obama on syrias use of chemical weapons. Liz as in they cross it, well go in well go in. Liz and they crossed it, and we didnt do much. John kerry was saying were going to initiate airstrikes, and that was waved off liz will this memo change policy . Can it force anything . I think not, liz, and heres why. From all accounts, it does not describe exactly what they want to have happen. Or what the end game would be. And so there really is not a solution to the the regimes situation. They dont call for regime change apparently in the memo. And in many ways, we have crossed that bridge. The russians intervention, i think, now means that we would be in conflict with the russians in syria if we launched any kind of airstrikes against bashar. That is probably a bridge too far. Liz okay. So it was an effort, probably wont do anything at least from where you stand. And ill bring up the texts in a minute from the wife of the murderer, but i do have to ask you about this offense that the Iraqi Military managed to pull off and take back at least one headquarters that isis has long used in fallujah. Yeah. Liz this, to me, seems like really good news. I dont want to get too excited. It is good news, and i wouldnt get too excited. These were Iraqi Special forces. This was not the regular army. They are the elite, and they had american air cover to launch the attack. What we likely will see is sunni on shia violence as a consequence of this. Many of the sunnis in fallujah have been evacuated or fleeing from the violence, maybe as many as 70,000. There are shiite militias lingering around the outskirts of fallujah and anbar province. Some of them are reported to be inflicting Human Rights Violations on these fleeing sunnis. These shiites within the Iraqi Special forces as well are not necessarily going to treat the sunnis in fallujah very well. Liz look, it all looks far away on this screen in this video that were showing, but it really hits home when you see that somebody who was inspired right. Liz by isis over there here in orlando kills 49 innocents. Right. Liz and now it appears that, according to fox news, fox news has confirmed that the wife of the murderer was, indeed, texting him during this hourslong disaster, and she reportedly according to fox news, so its confirmed reportedly at one point even told him, i love you. Make no mistake about the brutal the city of these people. Weve got to be on guard every single minute. I think as john brennan has said most recently. Liz what do we do . Well, i think we have to step up the resources allocated. For example, the fbi is now short on surveillance agents and other resources. Congress needs to appropriate more money for this, and it needs to not get hung up in Second Amendment debates about the use of guns or background checks. Oh, yeah, absolutely. I think so. If you look at the last three months of trading range, the dows been at the 800point range, the s ps been about 100point range. Were right in the middle of it right now, so youve got everybody going home for the weekend. It really is going to be the coin flip between now and thursday. So all in all, the indexes are hanging in there pretty good, but you probably could get some volatility. And were locked, basically, were whipping around a 4 move. Every friday we get this number from baker hughes and they tell us, oh, how many rigs were started back up because so many of them have been idle. We saw another nine come back on line today. Its kind of a measly total,336. But stephen guilfoyle, as you look at energy names, often when the entire complex goes down, the market goes down. Today we see names, at least some of them, going slightly higher, but its not helping the markets. It is helping the energy sector. The Energy Sectors up about a percent. The measure will be up for vote by the Convention Rules committee on july 14th and 15th, just a few days before the convention formally convenes. He got approved for white house wall to be lifted from 7 feet to 11 feet, 7 inches. Now, supposedldly, its a whiz bang wall. Mr. President , if walls dont work, why the heck are you building a new one around the white house in. Liz governor huckabee, surely youre not, surely youre not comparing a security wall around the white house to protect any president who stays there with this idea of a wall with that certainly listen, we may very well need it, but it offends a lot of hispanics who live in this nation who feel that the message of the way it is given makes them feel like theyre you should attack here in this country. No, its not about keeping people out who are hispanic, its about keeping people out who might come to this country to do harm. And we know now that there are people who are affiliated with isis who see this as a rich environment to get to america without having to go through the oldfashioned way of applying for a visa or a permit. So its not an antihispanic wall. I just got back from israel yesterday. Ive been there dozens and dozens of time, ive flown a helicopter the entire length of the wall. I think the difficult thing for marco is that he was so adamant about saying no matter how it turned out, he was either going to be president or a private citizen come january. At issue is control of the media giant, and its current ceo, Philippe Dauman, is pushed out by Sumner Redstone, the man at the top, there have been other names that have been floated as possible replacements. These guys dont want it. We can put them up on the screen. Charlie and i have already eliminated the possibilities for most of these people, jeffrey catsen burg, dreamworks. Hes not going to do it. Chase kerry, executive vice chair of 21st century fox. The decision may come down to a man whose name has not been put out there yet, tom dooley. Now, dooleys been involved with viacom since 1980, but he is a very close confidant of Philippe Dauman. Interestingingly, he was not one of the names Sumner Redstone tried to boot off the viacom board yesterday. So what are you saying this really means, liz . Well, you know, back in march he resigned his contract, and in that contract it indicated and it may very well affect whats happening now was a provisioning that possibly provision that possibly makes him one of the most expensive line items in the history of contracts. If dooley doesnt get the ceo nod or if the board is changed, he can decide to depart, and he gets a 60 million plus payout. I called a Viacom Company spokesperson who told me, quote it is factual that tom dooleys contract would pay out 60 plus emergencies but should the courts decide it was fair to alter the board, dooley can walk and get paid out. Lets bring in Charlie Gasparino on the possibility of any of that. I think its very possible. We should point out two things that im hearing, then i want to show you a really interesting chart, particularly if youre a viacom shareholder or if its any any portfolio that you have. Philippe dauman, i think, is gone no matter what. I talked to his loyalists on the board, i think hes out. Hes damaged goods. A lot of bad stuff. Liz a lot of money. Hes out no matter what. Now, with that being said, look at this chart. This is how much if dauman goes, if dooley goes dooley eventually goes, and how much Legal Expenses were talking here given the fact that sumner is suing them, theyre suing sumner meaning the board and fred soler know and the current management in delaware court, and the likelihood that both dauman and dooley are likely to leave, think about how much money this is going to cost the shareholders. 95 million for dauman, 63 million for dooley. And here is where it gets interesting depending on how long this thing lasts. If its a protracted legal struggle and then they leave, Legal Expenses between 340 million. You are talking this whole thing, and were being, i think, conservative herere is going to cost the viacom bottom line 200 million. Now, we are talking some this is simple math. The Legal Expenses is something that weve been bouncing off, my producer and i, brian schwartzman, bounds off experts can be bouncing off experts. As you know, corporate lawyers are extremely expensive. These guys are, like, they rack up the fees. Were talking about a 200 million line item, maybe thats why the stock is down a little bit today. Liz yeah. And also, charlie, can i just jump in here . When youre looking at all of that money, youre also looking at a highly litigious family, the redstones. My sources were telling me there was a court hearing, 22 lawyers representing various members trusts. Liz of the Sumner Redstone family. Some dont like him, some dont like his daughter. 22 lawyers. Heres why. Remember, he controls cbs and viacom via something called national amusements. The ownership is carved out into a family trust. And to him. He owns 80 of it, then some of it goes to his wife excuse me, to his daughter, and then rest of it to various members, various parts of the family that are part of the trust. And the trust, essentially, controls all that even though hes the main guy. So thats why him, you know, calling the shots is so important. Liz the question of his competency is still out there. Thats what fred salerno and Philippe Dauman are saying right now. He is not competent to make the calls. Hes not meeting with us. Liz thats the biggest red flag, dont you think . None of the Board Members this is weird, folks. If you are running a company and youre on a board, you get to meet the chairman on occasion. Or the owner, or the guy, the guy that calls the shots. Now, im going to say this, i know fred salerno a long time. Hes been on a lot of boards, longtime fixture in corporate, in new York Financial circles. He doesnt need this job. He doesnt need this insanity. Hes not getting paid enough for this. Hes made his money. Im just telling you that, you know, for him he wants dauman in there ill wrap in a second, just want to make this point. For one reason and one reason only, he thinks the sale of paramount is going to add shareholder value, value, and hs the company is better smaller, thats why he wants to keep dauman.
