Not facebook. This ceo coming on exclusively, or even amazon. But sac capital, the embattled hedge fund founded by billionaire steven cohen facing no criminal charges of systematic insider trading. Allegedly generating hundreds of millions of dollars of illegal profit and to avoid losses and this allegedly over more than a decade. Widespread, systematic. You name it, they say they did it. We just got word from sac that it plans to operate as it works through these matters. Theyre still in business. They say that it never encouraged promoted or tolerated insidertrading. What were going to do is take a look at what might happen, why this matters to an individual investor is not have money with them as well as the billions of dollars in assets, with a might now flow. The impact on the entire Hedge Fund Industry and the trading industry because they own huge positions in a lot of stocks. Are very un Charlie Gasparino has been breaking news on this story well in advance of everyone else. More right now. We also have fred tecce, former prosecutor and as these cases. First we get to Charlie Gasparino on breaking news. Heres what we know. Sac is still a company, but will investors remain. A lot of people put their money out, while those keep their money in . One of the Main Investors has been skybridge capitol, a friend of mine. Runs that great conference in las vegas. We understand he is weighing whether to take his money out. What he is telling people, its his investors decision. He invests in the fund for investors. His clients will direct him on whether or not he should keep his money in sac capital. But he is telling people is that he expects his client to tell him that he has to take valleys to take his money out. That would be a fairly significant blow. Liz he has taken some out. By the way, a cnbc contributor. He has been on their lot. Youre telling me now that he may pull it all out. Its interesting. He gave an earlier interview. It did not have know at present. He basically said he hasnt decided. Of course the dozen because an investor seven told them. But he expects this is investors to tell him to remove money from the fund because it has been indicted. Reason also point out he has removed most of his money. People dont realize this. Liz was the keeping some of it and to be friends . You know, discover your basis. He has personal money in there. Personal money. He also has institutional money in there. From one eye and a stand and we should have banners that say this. Banners that say that he will basically tell people that he will learn from investors whether he should keep it and not today in the things that there will be pulling out. We should also have one that says he has removed most of his money. Now, thats an interesting thing because people thought he was in there, full monty. We dont know the exact reason. He might not have liked the investment strategy, but we know that skybridge, amid all this, has taken money out. Prosecutor. Ring in fred tecce, you know these cases inside and out. Not necessarily this one because of the details, but youre shaking your head right now. Would you think that anybody who keeps their money in is absolutely insane . I have to tell you, the first thing they teach you when you are a firstyear Law School Student is buyer beware. At this point youre on notice. This indictment is devastating. Forget the indictment, forget the criminal charges for one minute. The government filed a civil seizure action and looks to seize the entire assets of all sac companies and related companies on the grounds that since 1999 these people have been engaged in an ongoing and systemic insidertrading scheme which has resulted in all the profits. Liz in fact, let me quote the fbi. He was the one who got up next to the u. S. Attorney and said, the scale of the cheating and this is what the fbi is saying he over at sac is without precedent. Thorough action on behalf of management, not only encouraged but tolerated all the cheating. And so lets keep it. We have at coming up here is keeping his money in. What harm could come to them if they keep their money in . I have to tell you, they will offer themselves up to civil suits ultimately if it turns out that the government was right and this conviction comes through. Remember, if you read this indictment, there are eight named people in there who either agreed to plead guilty or who have been charged in those people still talking to the government. The government convicts these people and seizes assets and their investors lose money, they know where to get the check book out and hire brill big wall street law firms because theyre going to need an. Charlie gasparino, thank you for joining us. I read between the lines of this thing. I read the indictment, but i also read between the lines. It sounds like theyre lining of the case against steve talent. Am i missing something . Your not missing anything. That is what jumped out at me as well. The amount of evidence, specific evidence that they had to me was striking. Now somewhere someone made the decision not to include him in this indictment. That could have been for a lot of reasons. We dont know. We ultimately find out he was presented to the grand jury. The government may have made the decision that rather than push the case they think is not as strong as it could be, they just take the guys money away because thats ultimately what theyre looking for. De think they come back at some point . One of the interesting things, the u. S. Attorney for the Southern District. You have to listen. Recently he publicly says we dont care about the statute of limitations. There are ways around that. It sounds like they are continuing to investigate and look for that smoking gun that could put this over the top. Under the law they have five years from the last overt act, the last a little thing this company did, so they have time. Dont forget, there are two guys were going to trial. If they get convicted and decided dont want to spend the rest of their life in club fed and rollover, that may be what the government needs to break the logjam. This is not over. Liz best guess on this, you have matthew marked, and steinberg. Do you think they turned . I have to tell you, there will be a lot more motivated to turn if they get convicted. There are six people that already turned. Nothing like the jury saying guilty to make you rethink your position. Liz apparently he admitted guilt. He had to. One question i do have, and we probably have to wrap this up. If they get indicted can they turn at that point . Does the government say, okay, we will give you less time in jail if you cooperate, once you are convicted . Can you turn at that point . Absolutely. The government can agree to a lower sentence. Quite frankly it is up in the bunch of times. But among the witness stand and say, these guys are convicted of insider trading. Those of the guys need to listen to. He has been bragging all kinds of news on this. Anything you get, he is gripping his cellphone. What will other investors charlie just told us about the cnbc contributor and the head of skybridge. He will ask his investors. Let me guess, they will say yes. He thinks that is investors are going to tell him to pull. Thats what he believes. Whether they will not come i cant tell you. That is the key. Whats also key, he has taken most of his money out. There is an interesting thing. What claman foxbusiness. Com just said, you open yourself up to civil suits if you dont. No, all kidding aside, i look and think when i put my clients money into something more in some money manager i take it seriously and never responsibility to really analyze what im doing prior to money going in and how that money where will allocate funds. What im hearing right now is there are allegations that have been brought against sac. If something is material that will impact their ability to do business, if there is something that changes as a result of this and absolutely and going to revisit my opinion, but right now i dont have anything other than charges have been brought against the firm, and im not taking any money at this moment the. Liz this is a massive distraction of Epic Proportions when it comes to a criminal charge. And the things that they were saying, i started writing them down as soon as the u. S. Attorney for the Southern District said criminal activity on behalf of some many. These are quotes. Personal networks of company insiders. I look at this and think to myself, who wants to touch that . Its like a scourged. Does it not become a massive distraction at the farm . And know they have 1,000 employees, many of them goodhearted people, and short. Some apparently not, according to the Southern District. Is no question about it. Im concerned about this, and if it is a distraction and we start seeing traders leave, look, an image that has been tarnished, you might see a lot of people start to leave. As you said perfectly, there are 1,000 employees. There are going to be people leaving and there will be distractions and is probably not point to be the same firm that it was over the last couple of years. Im watching that closely, but we also live in the company were allegations can be brought. Sometimes liz some of them are leaving and walking straight to jail, to prison. That is of great concern. Can i ask to have you gotten any guidance . Have you picked up the phone, talked to your guys over there . And im doing a lot of work behind the scenes, but i also dont think people are walking out the door and walking to jail. A lot of people walking out the door, opening their own shops. There are people who are staying right there. Am i concerned . Yes. Weve talked about this many times, and these new allegations and what the attorney general said is very disconcerting. But there is another side to the story. I will tell you, if you want to find this modest attorneys in the world, they live right there. I tell you, they have a good defense. Yesterday we had spirit air, theyve got a great story to tell, but you, youre adding routes, youre adding capacity, im assuming business is really good right now. Business is good, liz, thank you for noticing. One of the things about alaska, were a little smaller than most of the airlines, were about 3. 5 of the u. S. Industry, but we have fantastic people, and we do try to operate reliably, and were gratified by that recognition. Liz jd power, but youve also gotten all kinds of satisfaction reports, number one in ontime performance. The impression is, though, that Customer Satisfaction doesnt always translate to shareholder satisfaction. Over the past year, and we could show a year chart, you will see you, as in our viewers because you already know, brad this stock is up about 77 . As a ceo, what have you done to marry wall streets opinion of you and investors opinion of you along with, perhaps, the jd powers and customers who seem to be pretty happy . Yeah. You know, i think that all goes down to a longterm focus. Its easy in any particular setting to do this for customers for the short run or for employees or for shareholders, but one of the things alaskas done over three, four, five, six, seven or eight years now is sort of had a longterm orientation of what do we need to do to be a Great Company for customers, be on time, reliable, low fares, what do we need to do for our employees, and thats job security and good pay and good gain sharing with the company as well, and what do we need to do for investors, and we can talk more about that. But our plan that weve been working on is to make the company a good, Strong Company for all three of those constituent groups. Liz you missed on the bottom line on your most recent earnings reports, you matched on the revenue. Why did that happen, just so we know . Yeah. We released today the absolute level of earnings was very strong, a 13. 5 margin, 105 million profit. There was a little bit of capacity in our market that were dealing with, and then we had two or three things on the expense side that were a bit unusual liz im sorry, too much capacity . I mean, youre adding 15 new routes. Yeah. And a little bit of competition. I think overall in the industry competition is at a reasonable level, but in our market theres a bit more than the last couple of quarters. Liz you have two different kinds of aircraft that you use, boeing and bombardier out of canada. I dont know if you just saw the breaking news that air indias mishap, people were wondering what happened with the bong jet, turns boeing jet, turns out it was an oven fire. Youre sticking with boeing . I did hear your report on that air india issue and, no, were sticking with boeing. The 737 has been a fantastic airplane for us. And just as importantly, one of the things weve found is terrific is they have a a single fleet type and religious focus on efficiency at both alaska and horizons, and the efficiency gives you low cost, and low costs give you low fares, and thats what our customers talk about. Liz okay. We found this fascinating, youre now going to be using a biofuel on your routes to hawaii. We have a little fun with this because we thought what kind of pulp biofuel would you be using, pineapple . Tell us about the biofuel effort, and does it save you money . Um, i think its unlikely to save us money out of the gate. [laughter] alaskas done this once before, and were doing it again now. Basically just to demonstrate there will be a market for biofuels when those fuels are able to come to the market efficiently. Weve done it once before, and i think the cost was 15 a gallon, so it wasnt efficient at all. Liz okay. I think as many people come into the market, the prices will come down, and it will be viable. And one of the things were just trying to say to the world is when there is good product there at reasonable prices, there will be a market to buy those biofuels. Liz market for biofuels eventually. Of course, im a berkeley graduate, so im all geeked up about this one. Ive known for so long that the Business School has really been the launching pad for graduates who have gone on to be the ceos of major companies. Paul otellini of intel, novartis, adobe, i mean, its just amazing some of these names, linda lang, jack in the box. Whats in the water there . Well, thats a good question. Let me start on a more personal note, im a graduate of the school myself, and for me the experience was transformational. It is a very different kind of place, a ferment of ideas. It is, ultimately, though about three things. Its about the place, the people and the dull church the full church the place is San Francisco bay area, its about people, selecttivity of our programs, the faculty could be teaching anywhere and want to be at berkeley, and its about culture, the norms and values that define us as an institution. Thats the deep stuff. Liz you know, i know all about the culture because, obvious, ive studied of course, because ive studied this Business School so closely, and among them we put them up on the screen, because i want our viewers to know whats different about the haas school of business, question the status status quo. You also have confidence without i think in this day and age, the ceos with the tude, thats just not working. And students always, beyond yourself. What does that mean . Good question. So beyond yourself is that sense of stewardship for something larger, something beyond just you and your career. Are you there to elevate others . Are you there to elevate other things . And elevate yourself . But thats an important part of the dna of us as a Public UniversityBusiness School. Liz let me give some numbers here. You get about 3,350 plus applications, you only accept under 300, about 246. 96 get jobs within the past, the first three months of graduating with a starting salary of 116,000, thats pretty much on par with the top schools. But the uc system itself has suffered because the state of california has suffered since the financial crisis, and they pulled millions and millions of dollars from the uc system, berkeley included. Can you continue to provide tha brilliance of berkeley at the haas school with fewer dollars . Good question. You know, there are obviously trends in Higher Education more generally. Thankfully, at the haas school of business, berkeley haas, we have a Financial Model and built it up over at least the last 20 years that is largely protecting us from that, right . These are things like executive education and other elements of our programming. Many of our degree programs, our socalled selfsupporting programs, they are at market price, and they are providing best in market services. So were protected. Liz i mentioned that your faculty is as famous as your students. Youve got janet yellen, she may be the next Federal Reserve chief, carl shapiro, counsel of economic advisers. But lets get to where the students want to work. Theyre not necessarily going into politics, theyre going into technology. Hey, push back here. Stanford acts like it owns Silicon Valley. Well, stanford is a fine university and a fine Business School, theres no question about it, you know . When we think about technology, as you mentioned, a lot of our students want to go into that, into that field. We think about its a very dynamic field be, you know that, right . Very, very high clock speed. Lots of change. Not everybody wants that work environment, but a lot of our students do. It is also the kind of industry that is wide ranging. When you start thinking about Education Technology or biotechnology or social media or i. T. , and it is also an industry where you can have a tremendous ripple effect. All of Us Use Technology so much during our lives that it has systemwide impact. And be our students want to have that. So thats partly why we see so many people coming to haas wanting to go into technology as well as consulting in other fields. Liz in other words, Silicon Valley is cal bear territory. This is one of your top devices, and in essence, just to make it simple, these devices are placed between the firewall and other servers s so they essentially manage web traffic . Yeah. The Application Delivery controller is really a platform, and over the last two years we have built more and more solutions on that platform. It optimizes traffic across servers, computer servers. Then we added, for example, Security Capabilities like a firewall. You need a firewall now if youre using products that would be a software solution, so weve added more and more solutions. Yes, we do need a data center, but the key is where we sit in the data center. We see all the traffic, and we basically can control the trosk and optimize it traffic, optimize it. So were really a gateway to the internet and to the data center and to the user. Liz okay. Thats using the application. Liz traffic has gotten thicker. Its like washington, d. C. Meets boston downtown big dig, i mean, its been horrible with mobile, data, everybody, voice, video. Everybodys using it. Please tell investors who are on the fence about you, because yearoveryear youre still down, as i understand it, about 11 . And there are people who arent quite ready to jump in on the stock. Whats coming . Whats going to be your product cycle refresh . Yeah. If an investors worried about the trend of the software solutions, you have the trend coming, are these going to be disruptive trends to others. We view it, we see the trends that are happening whether its complex security threats, whether its the cloud, whether its software solutions, we see it as a massive opportunity for us. And thats what our broader road map is aimed at doing so we can control and orchestrate applications whether youre running the application in the cloud, whether you want to have it on your mobile device and you want to protect it, whether youre in a Service Provider space or whether youre in an Enterprise Data center. Liz okay. So we feel really, really good about the overall business friends. Companies like trends. Companies like pandora, for example, the Internet Radio company, theyre supporting 62 million users and probably growing based on our scaling type of architecture. Liz wow. Okay, thats great. And you have other companies that are your customers, siemens, mlb, barnes noble, bmw. One of the things i think is fascinating and interesting to a lot of analysts, nine of them upped their price targets for your stock as soon as you came out with the earnings is that you chased the giant, the goliath of this part of the business, and that easies coe. Cisco now has a deal with one of your competitors. What next for you guys . What is the next part of the push and the part of the business you really want . Yeah. Well, if you look for the business drivers weve got going for us, security is probably number one. We now have an advanced firewall product that is significantly faster because of our architecture, additional firewalls. Also the security threats are getting more complex and more sophisticated, and you have to realize whats happening at the application level to protect the application. Thats what we focus on. Securitys one thing. Service provider business is another. Basically a tsunami of mobile traffic thats coming to them. The lte and 4g rollouts are happening. Our pipeline of business is growing really strongly. Liz okay. And then the whole architecture change thats going on with the cloud connecting to the data center, and our products acting as strategic control points in our area.
