Hey, there is ways to make money. You said green, right . That is what you said, neil. They are still now setting up for other ways to make money. Were seeing now theyre being more tactical. Saying hey, you know what . Why dont we short a little bit as well . Betting maybe we might go down. There are other ways to make money. There is some short talk. Betting the vix, the volatility index. We havent seen much volatility lately. Now it is surging. Were seeing the vix up 6 . But big picture, the overall feeling the trend it still to the upside. Karl, seemed blasphemous, watching media and coverage that this even happened, but there was precedent in the obama white house, using irs to target conservative groups, Justice Department went after reporters including our own james rosen. Whether that directly involved the president is anyones guess. My point not as if this is a totally alien concept, but what do you think of this as an issue that will have weight Going Forward . Look, it is clear there was some intercepts of some people, somewhere in trump tower last year. A fisa court gave a, gave a warrant to do so. I would have left it there. If it turned out that the president obama was involved in it, then the Intelligence Committees in the house and senate would have discovered that. There would be a paper trail someplace. Neil would there always be though, karl . Would there be . Lets say the president wanted to go about this or they had sufficient reason to believe that an individual, in this case the next president of the United States, was in contact with russian authorities. And would that get out . In other words, would that suspicion get out . Sure. Both of these committees have the ability to issue subpoenas and compel testimony. They would follow the chain back. They would look whos name was on the order to the fisa court to tape or intercept the conversations or tap the computer of who. They would then be able to look at the people who, at the fbi who had, were behind that request. They would be able to poll this back. Im confident, particularly after the president s comments this weekend, they will be asking anyone, was somebody from the white house, you know, who told you to do this . And why . And follow that chain to wherever it leads. I dont think it will end up in the white house. My sense is this emerged. It looks like because they were monitoring a source abroad, found tapping a computer server in the trump tower around they went after that. I dont think there is any anticipation, any expectation that they were, there were wiretapping donald trump himself. They might have been tapping a computer of the they might have been tapping cell phones of others around him but not trump or hisey players. Neil all right. Now at this point it might change later today, james comey of the fbi had sort of had a rescind order against that president ial order. That the fbi, you know, look into this, and all that, he stopped it. Now, what was odd is that the bureau didnt follow up on that. That could change but what do you make of that separate issue . Well, its getting confusing, more confusing we hear bits and pieces. Neil that might not be the case. Obviously a leak from comeys office that he had asked the Justice Department to flatout say that the president s, the president s statement was inaccurate. He felt that the president s statement reflected badly on the fbi. But look, heres the deal. We have two adults in the room. One is the chairman of the Senate Intelligence committee, richard burr, of north carolina, and the other is the chair of the house Intelligence Committee, devin nunes, i think burr is likely to follow this through. He has Adult Committee in the senate. Nunes is the adult, he has truants on the committee, knows moatably the ranking democrat, but i have confidence particularly that the senate will investigate these things in an impartial way, later this year well hear from them on what we know. I thought the white house was very smart on sunday. We want the Senate Intelligence committee to look into the idea that president obama ordered this and we have nothing more to say until they finish their investigation. Smart on their part. If the Senate Intelligence Committee Comes back and says president Obamas White House played a role in getting this warrant issued to listen to, to these lines or tap into this computer, then president obamas reputation will suffer. If on the other hand there is no such evidence and this was, this request for the fisa court was generated entirely within the the fbi, then President Trump is going to look badly in this situation. I will say this. I have relative confidence in the fisa Court Operating in an entirely appropriate manner. That is not to say that somebody at the beginning of this chain might not have acted inappropriately but the fisa judges, there are seven of them. Theyre selected by the chief justice of the supreme court. They are very meticulous standards have to be met in order for these warrant to be issued. Why most of the warrants are issued because the standard is very explicit. They have to show certain findings. So there was something. There was some smoke somewhere. I dont think it had to do with trump. I dont think it had to do with the key players in the committee but i think there could have been somebody associated with the campaign. What do you think, sir . I think this new order will be a lot harder for opponents of it to defeat in court. The biggest difference, neil, this order reads like a legal brief. Normally executive orders are fairly sparse, not included legal authority. This is 12 densely packed pages that the ninth circuit demanded review first order. The ninth circuit was completely out of bounds requiring evidence. This will try to get out of ninth circuit which is most liberal in the country. Neil liberals seize on this as another muslim band. How do you counter that. The order points out that the thing about the first order as well, it refers in terms of giving preference to refugees it says that you get, preference is given to minority religions within any country. That includes countries where muslims are a minority religion. Secondly, it makes no reference the six countries are not chosen because they have majority muslim populations. It goes very specifically into listing the security concerns of those countries. Then you have many, many, dozens of other muslim nations around the world are not included. Ridiculous to call it a muslim travel ban. It is not that. Neil iraq is off the list. The whole ban itself, whatever you want to make it, sir, leading to a big selloff in travel related issues, airline issues. A lot of them had been running up ahead of this on improving economy. The fact more people travel. They can track them, listen to therapy conversations. If that foreign spy calls you up, they can get that intercepted conversation. Okay, now that is essentially i believe what happened with flynn, with general flynn, who since resigned. They intercept ad conversation that he had with somebody that was under surveillance. The difference neil already had the russian guys under surveillance anyway. Because theyre spies. That is what they do all the time. Neil right. And maybe tapped some of their phones and maybe, somehow, got a federal judge to approve neil wouldnt that be a problem for the president to make note of this . Right. Neil he would be making note his role could have been much greater than originally thought to be. Oh, yeah. They would need probable cause. Neil to go after him. I dont know exactly all the circumstances around james rosen but what they did, they didnt listen to his phone calls. They intercepted some of his conversations. Or, or, does it look like this is a case of President Trump deflecting, or at least saying if youre going to investigate my ties with the russians and peoples ties to russians you should look into the fact that the president might have all things being equal there is a very real possibility that they intercepted, not based on a directly tapping trumps phone or general flynns phone but they intercepted conversations by tapping the russians phones with trump people and, it is very possible, not saying it happened, it could happen, that they got an informant, because they do this often, whose phone is already tapped, you dont need theyre informant, you dont need the title 3 waiver all that to call up trump himself. Neil can you go around this stuff . Im authority on that because i have seen 24 because the president will do things on his own claiming National Security interests. No, not on these wiretaps. All they did was intercepted conversation between the russian who theyre supposed to track or whoever it was, and flynn. And you could have that situation with President Trump theoretically. Neil but there have been cases where the Prior Administration has targeted groups, has gone after individuals. Yeah. Neil and not had its own fingerprints. The only problem with, the way he said it, you would, you would naturally have a third party intervening, i. E. , a federal judge. There would be fingerprints. And then lots of conversations about capping the Tax Exemption for Employers Health care.
