Cenk welcome to the young turks. Great show for you, of course. The Bradley Manning tapes out. Hes on tape explaining his own case and we have those tapes for you tonight. Come on, fire. Cenk last night, there was a riot in brooklyn. Was it in any way justified . Up like a tornado just came, all them ran in here. My kid wouldnt have been outside. Cenk why were they so angry . Well talk about that, and speaking of angry another terrible injustice in a Sexual Assault case in the military. My heart is beating fast right now, i am so upset with this. Mccaskill is asking the air force to consider removing the general from his post. Cenk well tell you why. Another huge show tonight. It is go time. Theme cenk most of you know Bradley Manning is face be a Court Martial. He leaked information to wikileaks. We know that now because he has admitted some of those charges the smaller charges in his Court Martial. What we never got to hear from is Bradley Manning itself, because this trial is shrouded in secrecy ironic given the case and no video is loud. Youre not even allowed to take a picture. The freedom of the press foundation has gotten ahold of the full testimony that Brady Manning gave in court. Its over an hour long. They have the whole tapes and theyve put them up. Now, we explain in a little more detail. Thats the voice of army private Bradley Manning being heard publicly for the first time this morning. Manning recognitionly admitted he illegally gave wick key leaks hundreds of thousands of documents, as well as this video of a helicopter in iraq that mistakenly killed innocent civilians. New well show you more of the tapes. Lets bring in trevor tim the cofounder and executive director of the freedom of the press foundation who supports of course and funds independent journalism organizations and released these tapes today. Great to have you with us, trevor. Thanks for having me. Cenk first of all your decision on releasing these tapes. Could it get you in trouble . Manning is facing a Court Martial for releasing information he shouldnt have released. Well, its up in the air as to whether it was illegal to actually record this footage but, you know, obviously we had nothing to do with the recording. As far as publishing it goes, thats protected by the first amendment, just like wikileaks publishing the classified information that private first class Bradley Manning gave them is protected by the first amendment. Hopefully no repercussions will come for this for anybody in the courtroom, but as far as us go, were pretty safe in the fact that this is a newsworthy event and information that the American Public should have. Were well within our rights to publish it. Cenk certainly as you mention there, wikileaks appear to have been well within their rights, too, but a grand jury possibly has been convened in virginia. You never know what the u. S. Government does. Lets read a statement from the u. S. Army district in washington and get your reaction cenk do you think that they are concerned about a fair and impartial trial or about Something Else . Well, it seems like they are concerned about excessive secrecy. I mean, beyond not having audio for visual recordings of this trial, you know, the official transcripts are never released. The prosecutions briefs and motions never released to the public, so we cant properly analyze their legal arguments. Even the judges court orderses werent released until a group of journalist sued the court under the freedom of information act to get this information. They belatedly released a few of the court orders, you know, weeks and months after they happened and still havent released a host of others, so, you know, this trial which centers around freedom of information and government secrecy is one of the most secretive trials in the modern era itself. Cenk i want to play some more of the tapes four and get your reaction. In one of the parts that you released Bradley Manning talks about why he reds information to wikileaks in the first place. Cenk trevor now according to his own testimony and thats actually backed up by what he said when he did not realize that he was being recorded by the informant before his arrest, it matches up, he actually wanted to help the American Public engage in a debate about what we were doing in afghanistan and iraq. Now is that relevant to his trial, or will they simply, the government simply say well, i dont really care what your in tent was you released this information, and so, you know, there, of course, want as far as a life sentence for him so is it relevant . Well, obviously it absolutely should be relevant, but i guess its an open question about whether it will be relevant. Were talking about whether Bradley Mannings a whistle blower. We should remind ourselves he pled guilty to 10 charges and facing up to 20 years in jail. Its the absurd aiding the enemy charge that the government is bringing against him and the espionage charges that are so worrying here. Weve seen government report after government report leaked to the media talking about how wikileaks actually did no harm to National Supreme court and it was a little embarrassing to the government, but weve learned so much about it. You know, the information about not causing harm to National Security isnt even allowed in the trial and i think part of the reason manning made this statement is so that he could get his thoughts on the record about his in tent, how he wanted to start a domestic debate in this country about the wars, how he was horrified with what he saw in the helicopter video and dismade that the journalists killed there the parent company, reuters news agency, he wanted to get it to them. He talked about diplomacy under the cloak of secrecy. He tried to report are the to his superiors and they ignored it. He talked about how this wasnt a rash decision made at the spur of the moment, but he had come to it over weeks and weeks. He tried to go to the major papers, the New York Times and Washington Post before he went the to wikileaks. Luckily he went to wikileaks because they shared this with five or six papers at first and hundreds later. We got the full scope and idea about what this information actually told the American Public. Cenk trevor, on that note, i want to play a piece of the Bradley Manning tape, because a lot of his opponents and critics will say oh, he carelessly released these cables, including the diplomatic cables he released. His testimony indicates otherwise. Lets listen to that. Cenk trevor, explain why thats important to the audience, the care that he took in looking over the materials before he released it. Yeah, absolutely. I think critics point to the fact that there are so many documents in the Public Domain now and that he was as you said, careless but in fact he could have released even more secretive information. Daniel elseburg, the famous pentagon papers whistle blower, held up as heroes in circles talks about how Bradley Manning had access to much higher information and could have released more, and actually, he was very careful in what he did choose and choose not to release. You know i think its important to point out that, you know, we hold daniel elseburg to be this hero and he absolutely is, but the information he released was top secret and the information that Bradley Manning released, some of it was secret, much lower and some not classified at all. So hes kind of put out there by government officials as this, you know, evil person who was you know, going against the interest of the united states, and possibly aiding the enemy. Cenk right. You know, when in fact, this information, a lot of it wasnt even classified to begin with. Cenk all right. Trevor tim, thank you for joining you guess and thank you for releasing the audio. Cenk i want to make clear to the audience. I was asking questions as we always do on the show, but time for my personal commentary. Woodward sources released top secret information more classified than Bradley Manning unless the government leaked the information to bob woodward himself start arresting their other than and Court Martial if they were military and charging them with whatever it might be, unless they arrest woodward sources immediately, they should free Bradley Manning yesterday. Free him free him free him hes a classic whistle blower. He tried to tell us what our government was up to. He hoped that we would have a debate about it. Unfortunately, our politician little are not interested in that debate. Theyre interested in more secrecy and more wars, including by the way, the people who are prosecuting Bradley Manning, the Obama Administration who promised you change and gave you none of it. Now, when we come back, another injustice, Sexual Assault cases in the military. Well, we got a conviction. Didnt matter, because the general let the guy go anyway. I question now whether that unit if that man returns to, whether theres any chance a woman sexually assaulted in that unit would ever say a word. Ive actually never seen he that happen before that a convening authority would everturn a case. Coming on to me all the time now. vo she gets the comedians laughing and the thinkers thinking. Ok, so theres wiggle room in the ten commandments, thats what youre saying. You would rather deal with ahmadinejad than me. Absolutely. And so would mitt romney. vo shes joy behar. And the best part is that current will let me say anything. What the hell were they thinking . Cenk were back on the young turks. You know theres been a rash of School Assault cases and numbers keep going up in the military. There was a conviction of recently. All right, finally justice. Nope, the general presiding decided i dont care what the jury decided im going to let him go anyway. Hed been convicted of Sexual Assault, sentenced to a year in jail and dismissal from the air force. With the stroke of a pen air force lt. James wilkerson was freed from a navy before i go after four months. His conviction was tossed out. The man who freed him his Commanding Officer lt. General craig franklin. In the incident almost a year ago outside an air base in at this timely, there was an impromptu gathering at his home. The accuser stayed behind after others left and apparently went to sleep. Wilkerson was fondling her as she slept. Cenk i dont know what happened that night but we had a trial and he was convicted. The general comes in and reverses that conviction. Anyway, the senator from missouri and a former prosecutor, and a Ranking Member of the Armed Services commit yo is mad. Heres what she said. Now my heart is beating fast right now. I am so upset about this. As we are trying to send a signal to women now the victim in this case wasnt a member of our military. I question now whether that unit that that man returns to, whether theres any chance a woman who is sexually assaulted in that unit would ever say a word. Cenk the case has gone to chuck hagel, the new secretary of defense. Hes trying to figure out whether the convening authority the general in charge has the authority a reverse a decision like this. He wrote a letter saying. Cenk that is an interesting question. To talk about weve brought in attorney susan burke. Shes joined us before. Her work was in the documentary the invisible war. Susan, great to have you back on the young turks. Thank you, thank you so much for having me. Cenk no problem with that now look, doesnt this happen in defense in civil trials, as well meaning nonmilitary trials, where a judge can look at the end and say well, you know what, the jury made a mistake here, and the defendant has rights, and im going to let him go. Well, the difference here is that the way the military structure is set up, is it takes power and places it in the hands of people that have had no Legal Training theyre not law enforcement, and they are on the operational side, they are fighting the battles. It gives them unfettered power to decide what theyre going to do. Its abused, as you can see in this case, in order to protect their own. Theres no core larry in the civilian world. In the civilian world if there was a pardon, which is what this was, pardons can only be given by governors accountable by election eggs and the president also accountable by elections. We have people not elected exercising this pardon power. Cenk let me show you numbers. 2011, 640 cases of Sexual Assault, in 2012 kneel up to 800, 30 increase. Is it just that more people are reporting the cases susan or is this a problem of accountability, that once they see that hey, you know what, im going to get, you know, off at one point or another in this process, and now we see seen a jury conviction doesnt actually get you put away, does it make people more likely to commit this kind of abuse . Well, the reality is that the people that are sexual predators, the vast majority are serial predators. They dont have one victim, both on the civilian side and the military. The reality is that in order to stop rape and Sexual Assault you have to incarcerate predators. What weve seen by the military is that they do a dismal job. They dont incarcerate predators, instead, they do as they did here, they let them go. The reason you see growing rates of Sexual Assault in the military is they are not locking these guys up. Cenk we have another story about paul ryan. Hes got a new budget. Guess what, it looks a lot like his old budget. Here he is to explain it. We dont think its fair to let critical programs like medicare go bankrupt, take more from hard working families to spend more in washington. The most important question is how we balance the budget, but why. A budget is a means to an end an end is the well being of the American People. An end is a growing economy that produces opportunity and upward mobility. Cenk whatever he says, take it and reverse it. When he says im trying to say medicare hes trying to cut medicare. Ill show you the numbers. When he says im interested in the well being of the American People he means interested in the rich American People. 4. 6 trillion in spending cuts. Where does it come from . Hes going to cut 129 billion in medicare, 757 billion from medicaid and other social programs including food stamps, 962. By that the way that 716 billion he kept saying over and over, obamas going to cut that from medicare, in this plan he also cuts it. Now the democratic plan is cutting 1. 85 trillion over 10 years, so they have a plan of their own definitely different than paul ryans plan. It also takes away tax loopholes and deduction little so that its a little fairer. I dont love either plan, and were going to talk about those plans in a second, but they are definitely very different from each other. Paul ryan takes from medicare and medicaid, and discretionary spending, in other words from you guys and what does he shift the money towards . He would bring the top bracket down from 39. 6 all the way down to 25 . Somedays getting paid, and its definitely the rich. All right. Now, reds bring in chris moodie, a political reporter. First question is how substantially different if at all is this new paul ryan plan from the old paul ryan plan from before the elections . There certainly are gate quite a few similarities. His plan would potentially balance the budget within 10 years as opposed to 30 years which were prescribed in his prefers plans. Interestingly enough, this assumes that obamacare has been repealed which is not going to happen. It was passed in 2010 and upheld by the supreme court. It also incorporates the tax increases left after the fiscal cliff negotiations to help him with that deficit reduction. The big take away is balanced budget within 10 years according to this plan. Cenk theres a couple of issues there. The obamacare savings as he calls them is 1. 8 trulyun 1. 8 trillion. What is he talks . We went over 100 times during the health care negotiations. Actually the Affordable Care act subtracts from the deficit. Where does he get this 1. 8 trillion mythical number . It subtracts because of the hefty tax increases that were in obamacare when it passed. Hes talking about the spending. The program does cost money, but they paid for it with the tax increases when they passed the bill. Hes talking about taking out the spending parts but he uses a lot of the revenue from that, and from the fiscal cliff negotiations to help them with that deficit reduction. Cenk so chris thats really interesting. Is he then saying yes im keeping all the tax increases in obamacare, im just taking away the benefits . Well, what was so interesting about it, this morning a reporter asked him when he released his budget, youre taking out obamacare but leaving tax increases from fiscal cliff. Why are you doing that . Paul ryan said law is law so were dealing in reality here, but then people are quick to point out but then again youve got obamacare out of there. Its really a fantasy budget. People have called it the unicorn budget. The reason they do these, they give both parties an opportunity to draw a line in the sand and say this is our vision for the next 10 years and hopefully well see democrats and republicans coming together in some way when the democrats release their budget tomorrow, republicans today and president obama here in a couple of weeks. Cenk chris, in his plan he lowers the tax rates for the top 39. 6 to 25 . Is there any way to interpret that other than a a giant giant, giant gift to the rich . Well, i mean, im sure, hes calling for a more fair tax code. He wants to take loopholes out of certain things, lower the rates and broaden the bases basically, the republican mantra on this. Youre seeing lower rates for quite a few different tax brackets other than just the most wealthy. Cenk all right chris moodie from yahoo, thank you so much. Really appreciate it. Thank you. Thank you for having me on. Cenk oh, no problem. So, the first question is obvious almost why in the world does this exist in the year 2013 . Well, i think that racism actually does still exist and you know in the porn business, there are some agents that are telling their girls not to work with black guys, and maybe thats because in the 1970s and 1980s and maybe in the early 1990s, it would have degraded a girls value. In 2013, i dont think thats true anymore. Maybe its an old outdated Business Model thats passed forward. Cenk you mentioned certain agencies, l. A. Direct models and only 20 of their actresses are willing to film interracial scenes. That gives you a sense that theres some fishy going on there, whether other agencies have 50 to 90 that are willing to do that. You mention degrading value that sounds harsh to me. What are they talking about when they say things like that . I think an old Business Model, the way that it was was that if a girl did interracial which in the porn business, inter racial only means black guy, white girl and if a girl did that, there was a theory that she would make less money narrow her fan base, because it was thought that men who watched this girl work with a black guy would no longer want to watch her, and this is actually untrue. I think its an outdated way of thinking. Cenk i cant believe anybody ever thought that way but obviously some people must have at some point, but today people are tracking i think i once saw her in a movie with a black guy and now im not going to watch that. Thats insane to me. Apparently theres an old guard in the adult movie industry thats sold white guys that are more conservative and misunderstand their audience. Is that whats happening . I think a lot of porn are run postally by old white men from your agencies to your companies. Its a lot of guys that have been around for quite a few years and maybe their mindset is stuck in an old way of thinking. There have been a few that have changed with the times and opened it up, but some are very stuck on this stereotype and really in porn, stereotypes sell. Theres a reason theres a huge market where youve got the big black guy and the tiny white girl. That tougher sells really well and theres a reason for that. Cenk all right. Im blown away by all of these old stereotypes and had no idea they existed. Is the old way of thinking that apparently still lingers today to some degree, what was an actress supposed to do to mamies the amount of money she would make in an industry, what movies or steps would she have to go through in what order . In an old Business Model a girl would come in, start doing maybe solo, work her way up to doing girlgirl scenes. From there, she would start doing nonblack boygirl scenes and graduate to doing interracial or annal scenes. Therefore, she would maximize her career around as the screens progress get paid more and more per scene as she climbs that ladder. Cenk did that exist that people used to do that in the old days, thats how you would maximize your career. Yes that absolutely did exist. There were hundreds of Porn Companies. You know back in 2000, in the 1990s even, now there arent quite as many Porn Companies and there is a bigger demand on the internet, so girls go through that career arc in the first three months of their career if they go through that at all. Cenk theyre months is quite a career arc. How is the dynamics, obviously on the financial side of the industry changed so that you now get rewarded for speeding that process up, so whats changed in that sense . The internet has changed porn considerably. It used to be that Porn Companies were based on a d. V. D. Model and now learned to ever websites and website subscriptions. Porn companies have to figure out how to compete with people who really want to watch porn and download it for free. How do you get somebody to pay for what theyre getting for free. Cenk theyre saying lets just skip to the end right away, because all this teasing through your career arc et cetera is nonsense in old school. You mentioned that somebody said to you the number one reason that i hear and that doesnt mean its true is that my family wouldnt like me doing it, thats one of the reasons that the women dont do it. Can that possibly be true, that your family is like oh, youre in pornography terrific, interracial part, im shocked and chagrined. Thats true. Ive met some of the girls on set who are so afraid that their family would find out that they worked with a black guy. For some reason, they felt safer if their family discovered they did porn, but didnt do black guys. You think about somewhere some of the girls are from, some of of the states in the u. S. Still have less than 2 of an africanamerican population. It could be that the places they grow up in, theyre culturally very different and they come to l. A. And its an eyeopener. You get a sense of why congressmen and senators are cozy with groups like this, did you know that the average winning house seat costs 1,689,580 to win. If you got 1. 7 million, you might be a congressman. If you cant raise that much money, sad day for you. Nearly 10. 5 million in order to win a senate seat. How are you going to raise that kind of money . Youre going to go to multinational corporations, even if they pollute the environment as they pretend to be green. Daniel newman says that is absolutely right. That brings us back to our socalled conservation group. They have love live videos like this on their website. One of the i. C. C. F. s initiatives has been the formation of the conservation council, one of units n. G. O. s, corporations and government leaders dedicated to Natural Resource sustainability. What makes this synergy unique is everyone participating has the opportunity to suggest causes or courses of action. Cenk that sounds lovely, having synergies. Who are they putting together with the politicians . Mother jones investigated and found out cenk i think were on to something here. Lets bring in mother jones reporter corbin hiar who wrote about this. Thank you for joining us. Thank you for having me. Cenk lets talk about whos part of this council. Its not just republicans right . Its across the board. Thats correct. Its one of the largest bipartisan talk cusses in congress. Cenk now, you would think that if its about conservation that most of the people in the caucus would vote in environmentally conscious ways. Do they . Short answer, no. We have a companion post to my piece, which highlights a recent bill that was focused on coal, and the voting record of the caucus was only slightly better than the rest of congress. Weve also in reporting the piece uncovered instances where they, the members of the congress were actively working against the supposed aims of the conservation foundation, you know opposing bills that would block poaching, which is a stated goal of the foundation. Cenk curious. I want to show the audience a chart here. It shows you how the voting record of these guys that are as part of the politicians that are part of this group. For example senator john mccain, on the left there, you see the zero to 20, 100 gives you a great environmental record. On the righthand side, some members of the caucus are actually people voting great on environmental issues. The larger numbers on the left, 020 meaning they are absolutely failures, senator john mccain is partly of this. He has got to zero ratel. 16 tore inhauf is in the group and the list goes on and on. Corbin what is the scam being played here . Why do these politicians participate in it, and most importantly, why do the environmental grooms that are actually part of this organization participate in it, because youve got people like the World Wildlife fund or organizations that are very legitimate groups participating in this. What is going on there . That is what initially attracted me to this story is finding out what each group got from it. With the congressmen, theres opportunities raise money from these corporations. Theres also an opportunity for james inhauf to look green. He can pose with cheetahs in africa. For the businesses, they get the opportunity, you know, exxon mobil gets the opportunity to hang out with the Nature Conservancy and show that its not really as bad as it may seem and with environmental groups and there are four most prominently involved, the Nature Conservancy, conservation international, the Wildlife Conservation society and World Wildlife fund, and these are massive, massive conservation groups the Nature Conservancy budget for the most recent year that full figures were available is close to a billion dollars. That money is not coming from small donors. Its as important for these groups to have time with members of the congress, and with corporations so that they can then get grants to Fund Conservation abroad. Cenk right see thats the really scary part. The groups that you think you can trust are also getting money from this operation here and thats scary. Another shooting in new york and brooklyn specifically, kimani gray a 16yearold was shot. Cops say he had a gun and thats why they shot him. There was a vigil for him in brooklyn. It did not go way by most accounts, turned you into a riot. Heres a local report. This was supposed to be a peaceful vigil in memory of 16yearold as i kimani gray who died when he allegedly pulled a loaded begun on police. His family insists he didnt have a gun and police made a mistake. They were Undercover Police officers the discrepancy is whether the cops identified themselves as police. Some say they just said freeze, freeze, freeze and kimani went to his waistband, the police thought there was a gun. There was a gun supposedly found at the scene a 38 caliber near his body after the young man was shot 16 times. I think there definitely needs to be a thorough investigation. I would hope we get an independent investigation, not just the Police Investigating themselves, because theres a lot of gray area exactly what happened saturday night. Cenk a lot of people say wait, the cops say he pulled a gun there was a gun there why is the community so upset . This raises a much bigger question. I went to brooklyn last night. I think the abc report is exaggeration and overstatement of what exactly happen to call them thugs. It is disrespect have to the young people peacefully protesting. There were a lot of young people exercising their right to protest and assemble against the police they think is responsible for killing their friend. There are a few who were unruly, but the overwhelming majority of the young folks out there last night were peacefully protesting the death of can kimani. This raises the question of just the complete did he say makes of the relationship between the police and community. There is just no trust as these programs are stop and frisk across new york, that just antagonize young people, there is growing anger and tension between Police Departments not just in new york city, but across the country and in black and brown communities when Something Like this hams where two Police Officers kill and shoot a 16yearold boy and there is discrepancy over what happened on that evening that tension just hit the street last night and folks want answers. Cenk michael we talked you a lot about the discrepancy between the ethnic population of new york and who gets stopped and frisked. Blacks and latinos get stopped and frisked in disproportionate numbers in new york. Is that what had the anger in the streets is really about as opposed to this particular case . I think again we need an investigation to find what happened but if these two Police Officers were invoking their stop and frisk rights to go up and stop these young men on the Street Corner in brooklyn and it led to a confrontation that ultimately led to the death of a 16yearold young boy i think that anger has festered for far too long. We had 21 Police Shootings Police Deaths with the nypd of people in this city, up 70 from the year prior so there is absolutely a friction between young black men and brown men latinos in this city and the police democratic, and i think last night after their buddy was killed and shot, 11 times they hit the street and said enough, weve had enough of you guys harassing us, and whether or not kimani had a gun well find out if that if he did thats a problem. Even if he had a gun it doesnt necessarily war rant 11 times being shot, unless the Police Officers really feel threatened and thats where we need an investigation.
