Its been two years since the president chose him to lead the National Consumer Protection Bureau. Perhaps the republicans most hated agency, and he was finally confirmed as director today. The democrats can thank senator john mccain. He played a crucial role in the negotiations. Mr. President after a required amount of debate were going to move forward with the cordray nomination, which has been held up for some period of time. I would like to thank everybody on both sides of the aisle who have engaged in this debate and discussion. Michael what about thanking corecordray himself, who has had to put up with this foolishness. Harry reid was as effusive as harry reid can be in his praise of john mccain. Im going to tell one person and no one else how much i appreciate their advocacy here. Their persuasiveness, persistence. No one was able to break through but for him. And he does it at his own peril. Michael jay carney also applauded mccains work, but denied that the white house had any direct involvement in the deal. The white house was not involved in negotiating. The white house provided information and answered questions. When it came to working with hence, including senator mccain. What weve seen deserves credited for finding a solution here. Michael in the meantime, mcconnell kept a low profile. I think its a step in the right direction that the majority has chosen not to exercise the nuclear option. We feel good about that. I think they feel good about it. I think that crisis has been averted. We still will be dealing with controversial nominees in are a way that controversial nominees inevitably produce. A great debate. Reporter now for the latest on this story we head just outside of the senate, and we go to chris thanks for being in the war room. Its good to be with you. Reporter its sort of an unusually day. Is there any way that Mitch Mcconnell did it in a way that they wouldnt get the heat. There were a number of republicans who were talking with democrats. You have lindsey graham, john mccain, Mitch Mcconnell bob corker, there were a number of folks involved here on different parts of it. But democrats had a really good day today. This was a largely success for harry reid. The only only capitulation capitulation, the president said there would be two fresh nominees up. That was the only capitulation for democrats. But for republicans they have been very against the Consumer Finance Protection Bureau and blocked Richard Cordray from heading that bureau and because they wanted to see restructureing, and that was their only leverage, they lost that leverage today. And cordray himself, cordray a agreed that he would appear before the the aprobations committee. But these things were pretty small. Democrats had a good day today. Michael it makes me wonder what the quid pro quo was or to go any further, do you think this is informed by the case that the Supreme Court may be taking up, and the republicans doing a little bit of jockeying on that front . Certainly. The republicans made the issue that these were illegally appointed nominees, and they could not allow a vote to confirm these nominees because they couldnt shouldnt be there in the first place. That was the argument they made for Richard Cordray. They lost that on cordray but they did win it on the nrb folks. Cenk again, i dont see what their take away is just yet but i always know they have a bigger plan than just today. Bernie sanders the senator from vermont, said this today. Lets take a listen to this. This agreement today only addresses one symptom of a seriously dysfunctional senate. The United States senate in my view cannot function with any degree of the effectiveness if a super majority of 60 votes are needed to pass virtually any piece of legislation. Michael chris, you watch this body a lot closer than most americans do i want to ask you two questions ,one, how much attention is paid to Bernie Sanders says these things, and does this mean that well see further filibuster reform. Bernie sanders is always looked at as the far left. Hes a guy who always takes progressive views. Hes an independent from vermont, and he does not always necessarily line up with democrats. Which is why hes an independent. Progressive democrats would like to see filibuster reform, but that will be tough now. The filibuster reform would have been the nuclear option, and harry reid averted that. Thats what republicans were after. They did not want to see a situation where they could not block nominees. They could still move forward to block nominees. Harry reid could still threaten nuclear option. Michael yeah, it sounds about right to me. Since Brian Schweitzer said he was noting about to run. Thats another dangerous seat for democrats so theyre thinking a little further ahead. Carl levin said, quote michael so was there a better way for reid to have achieved the same thing here . Well, he would have needed the republicans to go along with him in the beginning of the year, and they did not. And the other thing reid is really grappling here is a caucus of a majority of new democrats. These are democrats who have not served in the minority. So they have an understandable frustration with the minoritys ability to block things, but theyve never had that as their only tool in their legislative toolbox, and guys like reid and levin, they were in the opposite position in 2005 under George W Bushs judicial nominee. If you remember the gang of 14, and they were making the exact same arguments then that the republicans are now. Michael that is such an astute observation. People who have never been in the minority have no idea what its like. Thats an important part of it. Chris, before i let you go i want to talk about a little bit of news that came out this afternoon mike enzi from wyoming said he was going to run for reelection. Moments later liz cheney said that she too, will run for the senate seat and primary mike enzi. Abc news reported that enzi was assured by liz cheney that if he were to run she would not challenge him. And then this happens. What do you make of this, and how much could it hurt the republicans. Its such a safe seat i dont think it will have a big impact over what Party Controls that seat. But within the Party Perspective this is an interesting move. The cheneys had moves from the Washington Area back to wyoming, theyre looked at as home staters. Theyre not carpet baggers but they havent been there for a long time. Theyre just getting to know the state. And to take on mike enzi who is very well liked in the state who has been known for his service might be a little bit too big. Her daughter father is dick cheney, so this will be interesting to watch. How badly does liz cheney want to beat up a mainstream republican. It really raises the question of what will mike enzi do . How badly does he want to hit back against liz cheney because he has kept his powder dry up until now. Star even on the romney Vice President short list to the subject of multiple investigations, now calls for his resignation. For months details of undisclosed gifts have mired governor mcdonnell in a scandal like an evil game show contestant. He won a 15,000 shopping spree. A 15 should 15,000 catering bill. All from jonnie williams, ceo of Star Scientific. There is more. The Washington Post revealed the governor received additional gifts totaling 145,000. Despite the mounting evidence mcdonnell claims he hasnt done anything wrong. He said, quote michael those rules require the disclosure of any gift above 50 but do in the required the disclosure to immediate family. The governors wife, sister and daughter have all benefited from these convenient rules. And the is a scandals are contagious. The titch ittim cucnelli also received gifts gifts. A new poll indicates that virginia voters may be getting used to this thing. Cuccinelli remains just five points behind Terry Mcauliffe. It appears that the virginians are not thrilled with their options to replace mcdonnell. Joining us julian walker, welcome into the war room. Thanks for having me. Michael lets start with governor mcdonnell. Hes being investigated on the federal and state levels with six months left in his term. Do you see the governor being forced to resign . Well, there are several legislators in virginia who have called for his resignation. One of them democrats. A state senator actually called for impeachment proceedings against the governor. The governor has resisted calls for his resignation and insisted he has complied with the letter of the law. Some question whether he has met the spirit of the law in terms of disclosing gifts and receiving things, but at this point there is a distinct likelihood he could ride it out if it we are to believe what he says, which is he is not going to resign. The General Assembly which they bicamera legislation control the republicans. And it would call the governor calling a special session to call impeachment proceedings. If you believe his rejections of any calls for resignation, then it is considerable that he will ride this out. At least for the remaining six months of his term. Michael i didnt realize that the hoops were so complicated. And when you hear about the fact that he thinks that hes doing just fine, and hes living within the letter of the law sort of a stand your ground way if you will, that he can do something wrong. But thats the law. Maybe the laws need to change. He said he hasnt violated any state laws. But is this a situation where they are with those state laws and can they change . Well, virginia is a very permissive state. The gift threshold for reporting is only 50. Thats only for the elected official and other Public Officials if theyre eligible for reporting. In terms of Campaign Contribution the threshold is 100. Other than that pretty much anything goes. Some people perceive virginia a wild west of political gifts. There is no upward limit. There is only the requirement that you report if you receive a 50 gift if its the Office Holder or the 100 contribution if you are the Office Seeker or the candidate. Beyond that anything goes. Michael and mcauliffe has called for a ban on gifts over 100. Just that that would be one of the issues that he is stumping on now. Do we see this as purely political oh or is there support for tightening these rules now . Well, there are a number of legislatures, both republicans and democrats who are saying the gift rules need to be revisited. As is always the case in the legislative process, you know, when you get down to the nittygritty of actually compromising that is the big challenge. You have democrats like Terry Mcauliffe the democrat for governor saying there should an flat 100 ban. And by relatives of Office Holders. The House Speaker said im open to reconsidering our gift rules but i dont know that im going to get on board with Terry Mcauliffes proposal. The last time virginia had a major ethic scandal which was in 200910, it came down to essentially the final hour of the follow up legislative session for lawmakers agree on ethics reforms. And most people will agree that what they agreed to and what they passed into law was a watered down version and didnt have much more teeth than the rules that previously existed. Michael when people are in charge of changing the rules we all know what will happen. Is the scandal carrying over in the race to relace him . Democrats certainly hope so. To a large degree, the cuccenell cuccenelli has succeeded large consent to step away from this. They put out a mild rebuke or a mild statement distancing himself from governor mcdonnell. He didnt mention him by name, he just said this has been a painful chapter in virginia history. But mr. Cuccenelli has received gifts not to the extent of governor mcdonnell but he has received gifts. There has been a longgoing tax dispute, that has mired his office for two years until he recused himself. Mr. Cuccenelli was also a shareholder in Star Scientific before he disposed of his stock in that company. The democrats are trying to make that tie in. The cuccenelli campaign is trying very hard to step away from it. And the polls show that mr. Mcauliffe has a slight advantage, but remember the fourpoint edge that he has is still within the margin of error, so this still remains a tight race. Michael and the only ones who could blow an open net would be the democrats not knowing what to do with it. The cuccenelli is running a mcauliffe ad on their website. How dirty do we expect this to get . So far there have been a lot of sharp elbows. There have been a release of treeoffed ads between late last week and this week all going negative orders mr. Cuccenelli. Ads against mr. Cuccenelli. Democrats have gone at hit over his stand on social security, and they have gone after him on womens issues. Theyre going after him. But meanwhile while the cuccenelli campaign has not gone after Terry Mcauliffe negatively in a televised ad, they certainly have been very negative as well. Every day they come after him with things like war on coal his Business Record 37 any number of things. About the union interests, a lot of sharp elbows. This is likely going to be an expensive race, one that much of the country one that the political junkies will be transfixed by, and one that will be negative in tone. That seems to be what is happening on military Sexual Assault. Today Tea Party Darling announce announced their support for reforms to the military justice tem champions by Kristin Gillibrand of new york. Gillibrand wants to remove process of Sexual Assault report from the chain of command. They found that Sexual Assaults are almost never prosecuted. The study showed 26,000 people from sexually assaulted in the military just last year but fewer than 3300 assaults were reported and 302 cases were prosecuted. Our carefully crafted common sense proposal was written in direct response to what the victims told us, the stories that came from them, what happened to them. The fact that they didnt trust the chain of command. That they were retaliated against. That they didnt believe that justice was possible. Michael gillibrands proposal was squashed in the senate Arm Service Committee by carl levin and claire mccass gill. But she plans to take it to a full senate for a vote, and she got a boost from a pair of unlikely allies. Im concerned that victims of assault though may be deterred from reporting the assault if they have to report it to their boss. Having to go to your boss and raise the problem thatthe crime of Sexual Assault with your boss has proven, in fact to be deterring victims were reporting the crimes. Michael that was senator ted cruz, and before that rand paul. Two republicans talking about rape. But for once theyre actually talking sense. Gillibrand said that with paul and cruz on board shes ten votes away from a majority. We welcome back now Donnie Fowler to help us make sense of this. Donnie, whats going on here . I mean, whats with ted cruz jumping on board with Kristin Gillibrand. There are two things that we know ted cruz and paul rand dont like command structures. They dont listen to their leadership in the u. S. Senate. They dont listen to the leaders of the Republican Party its not a surprise that theyre not going to listen to the structure of the command in the military. There is a lot of good politicking going on by senator gillibrand in new york. Michael shes been very impressive on this issue. You say they like to buck authority, both cruz and paul. How are they going to get any other republicans to go along with them. Well, its not their job to get other republicans to go with them. This is gillibrands bill. Her struggle is not with the Republican Party, per se, but its the view of how to deal with Sexual Assaults. This is turning out not to be republican and democrat issue as much of it is a philosophy of how much you respect military command structure and how much you want to solve the assault problem. Michael she has the pentagon to go up against too. That will betive. Lets go to wyoming. There was breaking news. Alan simpson said the fact that there is a primary in wyoming is that its going to be disastrous for the g. O. P. Its going to cost them a lot of money. It will cause a lot of pain. It will cause each candidate dick cheneys daughter and the incumbent say things that are really white wing. But in the end wyoming is the smallest populous in the country, and it will take an a lot for a democrat to be elected. Michael the governor of wyoming, he raised a strong candidate statewide there is a chance if he steps. That would be good. Ive worked on two campaigns in wyoming over the last 20 years and they have some really good democrats, some who are truly good Public Servants but hes the only one that may have won in the last 20 years. Michael what does it mean if Elizabeth Cheney loses. It could mean that dick cheney may have come to an end. Michael ahead of rush holt frank palone, is the race over . Will he be the next senator from new jersey . I would go to vegas and put my money on it. You would be smart to put your money on it, too. Michael today the senator from massachusetts was replaced by ed markey who won the election earlier this month. Truly phenomenal guy. Massachusetts is lucky to have two truly great senators. Michael he cut in half by leaving the number of black senators right now, and if booker goes there it will double once again. Thats an interesting sub story. Lets talk about harry reid and this whole filibuster story thats going on right now. Is this too little too late, this change . These changes that hes trying to make, and are they scared of 2014. Is that why they might pull back a little bit . Its clear that most senators like the idea of being able to stop something that they think is really bad when theyre in the minority. So there is a sense that you want to preserve some form of a filibuster. The problem is that the fill muster for both parties has become commonplace and its not unusually. I give harry reid credit to be willing to fight and plead a little bit to get these nominees through. There might be some who wish he would fight as well for other nominees as well, maybe he will. Michael i dont see the republicans budging that much, and john mccain gets kudos from everybody else. Except the right wing. Michael why does he do it . Does he love missing people off . Yes. If John John Mccain would have become press, he thinks he would have become the next Teddy Roosevelt. This is part of who john mccain is. Michael i sort of see a side of john mccain that i didnt expect to see. I thought he would go against the democrats every turn, but he has gone up against the people in his party. He vacillateses between an angry old man and a charging Teddy Roosevelt and you never know each day what youre going to get. Michael in new york city, two more topics, Anthony Weiner Eliot Spitzer. If Anthony Weiner is the nominee. It would have to be a bloomberglike figure, an independent, right now hes just michael bloomberg. Maybe he has his own party coming. But there doesnt seem to be anybody in the wings in the independent or republican side for new york city that could beat him. Michael where the primary is probably the mayor. Before i he let you go, george h. W. Bush went to the white house yesterday to give his 5,000th point and the imagery of seeing president obama with former president bush and the camaraderie, what does his legacy look like now . Even Ronald Reagan looks like a liberal compared to the republicans today and to george bush jr. George h. W. Bush came to the presidency as maybe the most qualified, the longest resume of anyone to begin work. You know, it is all in historical context. If you say would you take the current tea party Republican Party or would you take george h. W. Bushs Republican Party i think most people would say lets go back to a reasonable time. Michael he gave us Clarence Thomas but also david suter. And the cap and trade for the ozone. Michael and hes being wheeled into the white house. He was the one who came up with the americans for disabilityies acts some progressive things. You might disagree with the ideology or the issues, but its impossible to say that he wasnt someone who committed his life to serving the United States. They know that im not bsing them with some hidden agenda, actually supporting one party or the other. When the democrats are wrong, they know that im going to be the first one to call them out. They can question whether im right, but i think that the audience gets that this guy, to the best of his ability, is trying to look out for us. Michael the naacp is gathering for its annual convention in florida just 30 minutes from where a jury found robertGeorge Zimmerman not guilty for murdering Trayvon Martin. There was a petition online asking the federal government to charge a civil lawsuit against zimmerman. Attorney general eric holder announced hes considering a criminal case against zimmerman. Even as this convention proceeds we are all mindful of the tragic and unnecessary shooting death last year in sanford, florida. This afternoon i want to assure you of two things. I am concerned about this case. And as we confirmed last spring the Justice Department has an open investigation into it. Michael holder went on to say that the investigation is ongoing and the Justice Department is considering all available information before proceeding. We do know that if a criminal case is brought forward the d. O. J. Will charge zimmerman under the hate crime laws enacted in 2009. To qualify as a hate crime they will have to prove two things. One, race was a factor, and two, Bodily Injury was done. Proving that race played a role in the shoot something a very high hurdle, one that the president of the naacp doesnt seem worried. Meeting with amy good man on democracy now this morning, he said this. Going to a trial where the judge blocked all discussion of racial profiling we have not talked about those young boys who lived in their neighborhood who felt targeted by him because of their color, there is a lot here. Michael he discussed quote witness nine who is zimmermans own cousin. Witness nine called the police saying that zimmerman acted out in racial prejudice and hatred. Despite the high standards, he remains confident. It does take a high bar but the reality is that a high bar can be met. Whenever criminal charge are met, it should take a high bar. Michael many dont share that confidence. Many think that high bar will be impossible to reach especially in this case. Joining us is david pakman host of the aptly named david pakman show. Welcome. Thanks. Michael would this had a different outcome if there had been a history of racial violence. I was disturbed to see that interview with juror on cnn. We went through so many potential jurors, endless minutes of questions from both sides, and that hopefully would have given us a sense that the six jurors that we ended up with were going to be unbiased. They were going to be bright, able to understand and apply the law correctly and if you saw any of that interview last night you probably got the same sense i did which is we had an incredibly biased individual who had a hard time making sense of the evidence presented it might not have made a difference. Michael you could say in the abstract that it would have made a difference, but when you get to the actual jurors and you hear what theyre saying, i agree with you i got that same sense watching last night watching juror b 37. What do you think of six people on the jury as opposed to 12 people on the jury. It seems that that would be a conversation that florida should have as well. Right, if the Death Penalty had been on the table then it would have required a 12person jury. Because it wasnt it was only six. It might seem at first glance that having 12 people might have ended up differently but remember the jury needed to be unanimous. Its not totally clear that if you had the another six people who had roughly the same ability to interpret the evidence, you could have ended up in a similar situation. Michael there is no disputing it. Its hypothetical but i think if there are more Reasonable Voice to talk b 37 out of her opinion things might have gone a little better in that jury. Will they be able to meet the high standards of the criminal eighthate crime . Do you have the same amount of confidence that ben jealous has that hate was a factor here . No, i dont. One of the biggest reasons why George Zimmerman found Trayvon Martin to be suspicious because at some other point there was a black guy in that neighborhood who supposedly broke into someones house. We can establish pretty clearly race was a factor initially in getting on zimmermans radar. Its really hard to say legally speaking that it was a hate crime, and that hate crime really was the actual shooting of Trayvon Martin. So i understand the optimism from ben jealous and others, but i dont see it as very likely. Michael its also a difficult thing for him to defend, for zimmerman to defend. Everything is ambiguous. Its almost word versus word. Do you think the doj should go forward in this criminal case against zimmerman . I dont think that they should if theyre doing it simply to send some kind of a message because we already have too many mixed messages being interpreted from this. We have conservatives, we even have George Zimmermans brother minutes after the verdict being red on piers morgan taking this verdict and saying, listen, we have a lot of questions about killing here because killing people in self defense but also killing people via abortion are wrong. Thats an example of how conservatives are taking this verdict, and trying to expand it saying that it means a ton of different stuff about conservative values. All it is is whether there was an indication if there was enough legally permissible evidence to get a guilty verdict. If there wasnt, to take that verdict to say that it means anything else is wrong. Michael i think thats really a great way of putting it. I really appreciate that observation. Part of me thinks this is an opportunity. He got a not guilty verdict. Had he gotten a guilty verdict. Had he gone to jail, this conversation would have gone to jail with him, and we would have been talking about something else. I think there is value in continuing this conversation and what the doj is doing. Now since the hate crime act was enacted in 2009 the doj has prosecuted 29 more cases than the previous lee years and charges on 78 more hate crime defendants. But president obama seems to be cautious in applying the new law. Do you think obama should back holder and bush for the federal case . I think he should if its the correct thing from the view of the Justice Department. To push for it in the vacuum of political expediency and to send a message that wouldnt increase the likelihood of the case going in the direction in favor of the prosecution at all. So if it is correct to do that, then absolutely he should back it. Michael do you think he struck the right tone so far since this happened, since the verdict . Do you think he has been in the right place on this . I think so. Going too far in one direction or another will obviously draw criticism of everything that the president does and will do, but i think he has been even, and he does seem to be deferring to those who are in the department of justice to make the decision, and hopefully he would back the decision they make. I think thats the happy medium, the right place to be. Michael very quickly david protest versus erupted coast to coast as a reaction of the verdict. Violence broke out in oakland. Do you think the prosecution of the hate case plays into it at all . Last night mark omeara was asked on the shawn Sean Hannity Show of what he thought of the violence in oakland. He said this is indicative of what is going on in this country. Its street justice and people taking things in their own hands. I dont think he realized irony. He only had zimmerman as a client because zimmerman got out of the car and did the exact same thing that hes criticizing. Michael im so glad you said that. That is so true and so obvious.
