Earlier this week the Senate Intelligence committee to the nomination of david lally to serve as undersecretary for intelligence and analysis of the Homeland Security department. Hes a former assistant commissioner in the office of intelligence with the us customs and Border Protection. This is about an hour. I like to call the hearing to order, i like to welcome our witness today, david lally, President Trumps nomination to be the next undersecretary for intelligence and analyst of the department of Homeland Security. David, congratulations on your nomination. I like to take a moment to recognize the family contingent you have behind you today and thank your husband for his unwavering support. I think its also important to play tribute and thank your family for its honorable government service. These special agent at the fbi, your father jim glawe served in the korean war. Your brotherinlaw gerald bolinas served in desert storm and your sister doctor jane glawe works at the va and i thank all of you for your service to your country and your dedication and selfless service. Our goal in conducting this hearing is to enable the committee to consider mister glawes qualifications and to allow for a thoughtful deliberation by our members. It is already provided substantive written responses to more than 80 questions presented by the committee and its members. Today of course members will be able to ask additional questions of the nominee. David, let me warn you, when you see nobody beside mark and i, this is a good thing for a nominee. David comes to us with more than 24 years of National Security and Law Enforcement experience. He and started his career as a Houston Police officer before serving as a federal agent with the Us Postal Inspection Service and as a special agent with the fbi. In 2012 mister glawe was named the Deputy National intelligence manager of finance and transnational organized crime, before serving as chief Intelligence Officer for the United States customs and Border Protection office of intelligence. Mister glawe is supporting the National Security council as a special assistant to the president and senior director of Homeland Security. David, youve been asked to leave the department of Homeland Securitys intelligence and analysts component at a time when we are facing complex evolving and continuous threats in the homeland. The Intelligence Community is tracing threats from the state and nonstate actors to our cyber and Critical Infrastructure and we continue to debate the scope and scale of our Us Intelligence collection and legal authorities. Expect to hear a forceful advocate for the Intelligence Community on those discussions while maintaining a steadfast respect for the rule of law. As i mentioned to our nominees before this committee, i can assure you that the Senate Intelligence committee will continue to faithfully follow its charter and conduct vigorous and realtime oversight over every Intelligence Community entity. Its operations and its activities. We will ask difficult, probing questions of you and your staff and i expect honest, complete and timely responses. Tort Law Enforcement and intelligence experience prepare you well to support dhs and im hopeful you will look at the department with a fresh set of eyes and new perspective as you chart its course moving forward. I look forward to supporting your nomination and ensuring a consideration without delay. I want to thank you again for being here for your years of service to our country and i look forward to your testimony and i recognize the vicechairman for any comments you might have an image of german and welcome mister glawe and let me say i think this is the earliest Intelligence Committee meeting ive ever attended. And it shows my commitment to your appearance and the questions i have for you but because unlike the german who only lives close, i actually live back in my home state of virginia and when i was, i can assureyou when i was governor there was a lot less traffic. So congratulations on your nomination as the head of the office of intelligence and analysis. This position comes at a critical juncture between the analytic work of the Intelligence Community and information sharing role of the department of Homeland Security. Confirmed, your job will be to ensure the critical process pieces of information are delivered immediately throughout the department as opposed to your partners at federal, state and local Tribal Department agencies i believe that you have an understanding of this need , given your background at Law Enforcement and the Intelligence Community. I also appreciate the support youve received from my friend and former odi jim clapper and from Law Enforcement organizations representing the nations chiefs of police, county sheriffs and narcotics officers. Lets be clear, dhs, ina requires a strong leader. The Organizations Mission is to find engineers to evolve and mature, hence the creation of dhs over a decade ago. I remain concerned about the level of sharing with Law Enforcement. The large contracted workforce, and the whole Fusion Center concept. I have a Fusion Center in virginia. Conceptually it makes sense and im not certain its been implemented in the right way and i be thankful for your fresh fresh set of eyes to look at this. His job is never been easy and its not going to be easy going forward. If you are confirmed i will expect your full cooperation with this committee. I need an investigation into russias Cyber Attacks and interference into our president ial election and concerns about future meddling with our election and voting systems. Ive asked dhs to share with this Committee Even if we cannot reveal it publicly names of 21 states that the department testified last week against russian hackers. Ive written to and spoken with secretary kelly about this matter and as the Oversight Committee for all intelligence issues, this committee will have that information. I want to thank the chairman because this week chairman i sent a letter to all relevant state Election Officials asking that this information be made public. As i said last week i dont see how americans are made safer when they do not know which state election systems the russians potentially attacked and i particularly deal with this in my home state of virginia has major state elections this year. Thank you for appearing before the committee and i look forward to your testimony, thank you mister chairman. I can attest to the fact that this is the earliest he has ever been here. Id like to now recognize the chairman of the Senate Judiciary committee to introduce our nominee senator grassley. Sensor grassley, thank you senator byrd and Ranking Member warner. Before i read three or four minute statements, id like to say that im proud to be here to introduce to the committee a person whose family and he has deep roots in iowa. And im glad to be here and i think if i could probably give one sentence which would repeat something you said as you talked about him because i will be repetitive at some of the things you said that you talked about his Honorable Service within government and his Public Service wellqualified to take this position. I would emphasize that as i say that im proud to recognize david glawe as the nominee for undersecretary for intelligence and analysis at dhs. He is a dedicated Public Servant with over 20 years of National Security and Law Enforcement experience, he currently serves on the National Security council as assistant to the president and senior director for Homeland Security. Prior to this, the nominee served as chief Intelligence Officer for the us customs and border section. Mister glawe is a former Police Officer, federal agent with both the Us Postal Inspection Service and fbi. In 2007, he served in iraq and africa on a joint fbi deployment. With the department of defense, following this tour he was a Senior Advisor at the National Counterterrorism center and in 2012 the nominee was named Deputy National intelligence manager for rex, finance and transnational organized crime where he oversaw and operated the intelligence communities Data Collections and analysis. In 2014 he began serving as National Security council on that counsel as a Senior Intelligence official. Responsible for implementing the president s strategy on transnational organized crime. In 2015 mister glawe was awarded the National Intelligence superior Service Medal for his extraordinary contribution to the us Intelligence Community and our nations security. The nominee is an iowa native as i said, still has family in iowa, hes a graduate of my all a matter of the university of Northern Iowa and also a graduate of harvard university, jfk school of government. He got started in Law Enforcement and advanced his impressive career with characteristically outstanding iowa work ethic. Hes chaired with me how much these things mean to him and i appreciate his commitment to putting them to work in this new position or our nation as he has several positions in the past. Mister glawes mother nancy is someone live crosshatched with for a long time in iowa as well, im proud to say. I know shes glad to be here with the rest of her family and his friends today, to celebrate with him and support him through this process. German burke, vice chairman warner, members of thecommittee, thank you for the opportunity to appear before you today, as the president s nominee , the department of Homeland Security, im honored to be nominated by President Trump and humbled to receive the support by secretary kelly, deputy secretary do and director of National Intelligence coats. Id like to thank senator grassley, born and raised in iowa ilearned at an early age the importance of civic duty. I never dreamed that one day i had the opportunity to meet an iowa legend. Thank you and i want to thank you again sensor grassley for the heartfelt introduction into 60 years of service to the country. Next i like to take a moment to recognize my family. Im grateful for their support, sacrifice in allowing me this opportunity. With me today are the bedrock of my life. My husband and partner barry gordon and special agent at the Washington Field office. And our two wonderful children, alexis and why it. Also here is my father, jim glawe was an army veteran drafted in the korean war. My mother nancy glawe, retired garden teacher from davenport iowa. And her husband her auto godliness, and also works for the Veterans Affairs in davenport. My motherinlaw beverly, lifelong volunteer in her community in eastern minnesota. I want to recognize my deceased fatherinlaw roger borst who did retired athletic coach who was here with us in spirit. But id also like to thank my family, friends and coworkers who supported me through my life, i would not have this opportunity without them. The Mission Statement of the hs is clear and correct. We will safeguard the american people, our homeland and our values. Dhs takes a complex involving threat environments and must work across federal government in concert with our state and local territorial and private sector partners. I have over 25 years in Law Enforcement and intelligence experience and confirmed i will apply that knowledge and Lessons Learned to drive intelligence and Operational Integration and share information, deliver unique analysis, identify vulnerabilities, position resources and mitigate threats. Ina has one of the broadest intelligence communities and meeting the very demands of the challenge, if confirmed i intend to focus the analytic capacity on areas where they are positioned to add value areas like travel, cyber, marine and mediation security. Inas greatest strength without question is the people, if confirmed it will be much harder to lead the homeland intelligence professional and ina as we endeavor to rep sandra kelleys vision by meeting the needs of the customers , integrating intelligence operations and making ina divers and focused and productive environment for the workforce. In closing id like to take a moment to recognize the Important Role Congress Plays in the success of ina. I place to enable the committee to fill that role by keeping you fully informed and transparent on activities and developments. Mister chairman i will stop there and see the remainder of my comments for the record. Thank you for the opportunity to appear before you and i look forward to answer your questions. I think all of your family members for their Tremendous Service to the country and more importantly, to the security of this country. With that im going to turn to the vice chair for questions. Let me also recognize your family and its very impressive. I know theyve got to be all very proud of you. I want to start a couple questions in relation to our hearing last week and just kind of get your sense on this. I want to make in addition to the questions, will you commit as well to working with this committee as we go forward on our ongoing russia investigation to ensure as much access as possible that you can provide necessary materials and reports, products and other materials and make sure those are provided in this committee as quickly as possible . We understand vhs as a collaborative relationship with the states everyone to maintain that but to view the states as victims it almost feels as if the obligation of the state to come forward. We had people from indiana or wisconsin not one of them do but to have the Illinois State election official here who clearly indicated he was the victim of an attack but until the previous testimony of the dhs realize there were never told but it was russia was behind the attack like you to commit to work with us to read litigate 2016 we have to make sure the states are prepared so that can filter down to local Election Officials to take necessary precautions. Any thoughts on how to address this problem . Senator thank you for the question i appreciate the opportunity i did have testimony last week as well i share your concerns regarding the state with the russian intrusion and also understand the challenges of sharing that information regarding individual states the vulnerability i am willing to be complete the transparent to understand who has been hampered the intrusion occurred and also to work through those challenges and i concur it is not easy and the problem is increasing. Even on a confidential basis so we can figure out we are better prepared. I look forward to working with you but the concept of the Fusion Center i do wonder if there isnt a duplication and now you are many years in with this concept is it working the right way . What would you do to improve this concept . I appreciate the opportunity arose for the first ones to stand up in virginia so coming from the state and local perspective i have the needs of the state municipalities as well so to wrap my arms around that Business Structure and i am committed to work with the committee and yourself of those challenges but what i can say when meeting with those organizations we see the need for it might feet without question since there can be improvement and if confirmed by a am obligated it committed to do that as well. It all have a set of recommendations but that whole concept. Congratulations for anyone that he supports support to that continued service soy do have a broad question about cybersecurity during the debates we can have jurisdiction over the issue and that concerns about the organization of the department of farmland security since the 11 9 11 with different agencies under that umbrella of the a just but i am interested in your views of the short comings and the opportunities to deal with the cyberthreat because it seems like were doing a poor job. 84 the question that also meeting with meet privately it is a tremendous opportunity to have the Business Enterprise with that cyberthreat knows no boundaries or borders for intelligence stage actors brenda not critical at for structure. I have had initial briefings with our side posture with dhs i would like to unpack that business process but if confirmed but i will bracing a sense of urgency i have served the public in the community until the press were mitigated i have used cybernot just with teeeight teeeight just t h. As but i work with the committee if confirmed when challenged. People understand the most capable government so by default it seems like we dhs must assume that role as the intermediary intermediary in the private sector uses skepticism also to keep information confidential when theres so much at risk with the standpoint when cyberattacks that our successful become news. So we look forward to getting your recommendation we need somebody to speak with clarity about what we as policy makers need to do about this threat. I dont think were doing a very good job right now. They give mr. Glawe for being here and to your family for your service for your country but let me ask first of all, of you to tell any of your experience as a Police Officer in houston with your dedication and to work yourself through the ranks . 8q for the of question is an honor to meet u. S. But a lot of time it was virginia is a wonderful facility but as a Houston Police officer 22 years old and i was out of the academy the young this Police Officer in the department when i hit the streets i hit on their worst days of their lives when you called 911 inevitably the worst day of somebodys life. So that brought a sense of urgency and community at the time i did not understand that totality but i do now. If we must having tactical level intelligence with those policy makers to allow the appropriate decisions to be made to mitigate the threat working with a sense of Agency Working as the entry level we tended to be reactionary we try to fix that to be ahead of the threat but to posture ourselves the worstcase scenario is to called 911 the uniformed Police Officer could be the worst days. What is the biggest threat we face . Banks with a question. The illicit pathways associated with cyberis a vulnerability at all want to get ahead of the policy of what secretary kelly will set but that cyberarena the Transnational Criminal Organization for the terrorist networks or the on stage actors of the full spectrum of Illicit Activity were in a challenging situation with those Decision Makers said they do share that view and i will do everything to keep you informed on that. The tsa is intertwined with the duties do you have concerns of those advancements to attack any type of foreign intervention . How you build of cooperation between all of those that have the ability to fly into those facilities and the concerns they may have . Senator things for the question and if confirmed i look forward to that challenge the information sharing and a of vetting process for any country and though world but with transnational crime organizations and Foreign Intelligence Organization but back to your comment about Aviation Security with the evil the abilities vulnerable that we still view aviation as a threat to attack. A nightmare scenario is have a carrier taken out of the sky and i am committed to working toward that goal their ability with secretary kelly. Will you be asked by a the president of that is counter of that Administration Policy . Thanks for the question i will always give my honest assessment of the process. Congratulations. Good morning. I could not agree more with the cyberand the criminal organizations are look forward to working with you. But to give me your perspective that while acting under the secretary for intelligence and analysis that he withheld the report related to the president s executive order. So can you give me your perspective on what actually happened . Thanks for the opportunity to clarify. I had no involvement until the day it was releasing the report you are referencing was a compilation of information going to be used in the potential litigation for the executive order of multiple intelligence organizations. The information contained in the report, a majority place in the intelligence product that was disseminated shortly thereafter the information came out. Was there a reason . Senator it was information compiled in a declaration to be used in the executive order. On the issue of state elections infrastructure and rigid you watched those proceedings but i am concerned in regard to whether or not dhs has adopted an adequate policy for coordinating with the states. One of the concerns is estate estates dont have access to classified information. How can we give the states more information for that priority on concerns about tax . Senator thanks for the question thanks for the initial briefing on the infrastructure. If confirmed the live four to that Business Enterprise to have a sense of urgency. I come from a background in that arena throughout my entire career to disseminate intelligence to mitigate perhaps a share your concern we are now postured but we do need to identify those liabilities and how to respond. Can you give me examples of what you may begin as a remedy or what that would look like . And i appreciate your Point Solutions is not easy. Senator, i would have to take a harder look at the business sector that would be a natural touch point but i am not sure of the posture at this date especially talking with the Intelligence Community. And also 02 echo the predecessor that getting that information to the private sector is a vulnerability. I share your concerns and we will work with you through the challenges. I urge you to review the hearing we had about what may be a different approach with a vendor verses state officials who are elected or appointed to represent the state through the state governments. I did see part of that involving those legal authorities and disclosure i do agree with your frustration. If confirmed knu give this committee that commitment you will provide us with a report about your assessment will be for the 2018 election and if possible provide that for this year . Yes. There has been a lot of discussion about the future of the intelligence component of dhs how it is structured, the mission is to find what authorities to operate under and ultimately that customers. Who do you view as the core customer . Thanks for the question. I have a unique perspective with the head of intelligence the largest component of dhs in the United States. The customers are diverse because it is not necessarily either zero or with up policy makers. But we have a mandate to share information with the only ones that are mandated to do that but dhs is a powerful organization we have challenges getting information to them to the most critical components. They are the last line of defense with lawenforcement data will not cut that alone. We have to find solutions to ensure they get all the information they need for grosso im sorry my answer is not singular but dhs components with private sector we have to serve them all and if confirmed to put that Business Plan in process with a sense of urgency to understand what our customers need. What value does that bring . The commission is robust and they are dedicated to those it dhs components and information is critical dave green the intelligence briefing information along with a standalone intelligence. And also to assure they get information so that is a heavy pronged approach but to have that operation focused to make sure were reading your customers needs with a sense of urgency to have that mindset do deliver those tactical levels so they are incredibly dedicated a and i hope i have the opportunity to help with that mission. Having served in a number of different capacities and the product that comes out, the committee has been confirmed concerned about the analytic duplication that exist throughout the government. Do you share that concern and what do you see as the analytic component of dhs or should they be a customer of someone else . Thank you for the question. By as many unique position to a understand that challenge to look at the uniqueness of the organization so if confirmed to look at that business process there is not a duplication to find that business process to ensure state and local and private sector information but also the opportunity to enhance the mission to be integrated with trade and travel and aviation is a real opportunity to facilitate that mission and then carved out something we dont need but to make sure we are efficient use those tax payer dollars and mitigating the bright threat. But with your agency going over the next 10 years , led to uc do you see more Government Employees that are contractors with the skills that you need to attract . Senator, thank you for the question but i believe the work force a continuing work force with the knowledge coming up from the our ranks and also to maintain an employee Business Environment that is critical. I have seen the committees past reports to reduce contractors and i am committed we will continue to have a government work force to maintain quality employees at the entrylevel and career professionals through the executive ranks. I would like to conduct continue that if confirmed. In your view is there any overlap with the dhs and fbi efforts to counter violent extremist as others have expressed . Senator, thank you for the question. I think there is potential overlap but those Business Solutions and partnerships with the fbi i know them well. I grew up with them through the Management Change but the uniqueness to incorporate suspicious activity to participate as an local or private sector where the of the fbi is case driven but dhs ina but my job is to ensure the information in the intelligence is shared on the cyberintelligence that we have an opportunity with fbi a. M. Local partners for that. Ina is such a small piece of the dhs you have any concerns what is relative to what ina could be . Id the acquittal cool thing is to scope the mission with the midlevel and entrylevel managers to understand directly to focus on the of a mission to keep the homeless and the state. We cannot believe is be everything to everyone so in my opinion if confirmed that will be the critical aspects of ina to do the Mission Oriented integrated approach to make sure ina is a full partner in the enterprise versus just the agency you turn to when there is no blame. I appreciate your comments. I want to followup because i was surprised last week with the association of the secretaries of state who basically viewed the designation of our electoral system as Critical Infrastructure, she felt that was a burden rather than the asset. Im sure not sure this falls within your purview but something is wrong with this system if we have information and we feel the top state Election Officials are not cleared with the security clearance level to be debriefed on the information. I feel we dodged a bullet in 2016 because no systems were penetrated to that level but we have heard that the russians will be back and i would hope we get to a point where that designated kroll infrastructure you think that is a net positive and dhs was providing both asset support and information sharing in a way to make sure that of most critical component of the democratic process. I hope you see through that is a new area. And we had to comments from dhs last week but we have to get to this there is a sense of urgency immediately. Thanks for your service touche a country and your family. What have we learned since 9 11 . By industry and we had a lot of chatter but itll think anybody was coordinated or talkies that everybody was concerned so it your evaluation, what do you think we have learned or should have to make sure that does not repeat itself . Because you will share this all the way down to the level that you started now youre at the top of the food chain and know what it is like. I have read all the reports on the 11 9 11. I have thought about this for many years coming up through the entry level and serving with the intelligence and operational squads and teams i have learned the of mission and integrated focused approach. To empower those lower level staff with that operational mindset that of threats must be mitigated you dont go home until they are mitigated and share intelligence do everything you can and when you recognize that raise those vulnerabilities immediately. I was fortunate early enough to have been the threat at the entrylevel with some incredible leaders that i work for to mitigate that and also the intelligence organizations every day i go to work is for those mitigated threats so clear and direct information lines anything we need to changes changed together as a team. It doesnt matter what side. I will be committed to that if confirmed. As you know, theres a great likelihood that we will adjourn for the fourth of july week tomorrow. I can assure you if theres a way to get this process moving before reall believe well try o that. Mark and i will talk to if not well do it as quickly as we get back there its my hope we can get you permanently placed no later than the july timeframe. My one reminder to you is that dhs has many bosses from the standpoint of policy. You have one com, and its this committee. And the intelligence that you process through the ina is of great interest to us. I want to go back to this duplication thing just very briefly because having served in the multiple capacities that you have, i think you can understand my frustration. When i said that in the morning and they go to my intelligence reports from overnight and i find a report that i read from five different areas and at the bottom of it the course source was the same product. It really makes me wonder why we need to know five different interpretations of the same core product. And if that core product is important as i think it is, why isnt everybody turning to them versus trying to recreate the wheel with every turn. So i hope you will remember that as you serve out his term at ina, because of really think weve got to refine what we do and how we do it from an intelligence standpoint. The rest of the world is changing and they dont have the rules and they dont have the history to encumber like we do in the United States. With that figure out how to get a history out of the way but the rules are going to stay. We will be very aggressive from the standpoint of our oversight of you and of the organization.
