While it took me four months and 435 government fees to get a gun that i still cant legally take out of my home you do an fbi background check and you walk out so we have gun crime rising in d. C. And sexual assaults are up 50 from last year. Robbers with a gun and assaults with guns or absolve these gun crimes are going up. I wrote this book because these laws have been spread around the country and its not going to do anything to reduce crime or make american safer. I never owned a gun before and what inspired me was i was a victim of crime. I walked into a Home Invasion situation and thankfully i wasnt hurt but there were a bunch of men outside. The police say most lately they have done a drug deal and they were trying to get quick cash. I wasnt hurt but it woke me up to the fact that if i had surprised him enough or something at happened i was totally defenseless in my home. That is what inspired me to do it and they knew that the Supreme Court had overturned the 30year in band that i didnt realize what happened since then. What happened was the liberal city council had to technically abide by the heller decision technically but what they did is they put in place an incredibly complicated registration law and d. C. Is one of the places in the country you have to register every gun that you owned mostly chicago and new york in places like that. They do it i believe to discourage people from getting guns. Of course criminals are just off the streets so that is what they are up to. I didnt realize going into this that i would get a gun. It was a little bit hard. I ended up after i walked into the Police Station i got all the paperwork 22 pages of paperwork. I sat down to try to figure out what i had to do and it was 17 steps. 17 things you have to go through. I counted 17 and found more as it went along but some of the most ridiculous ones were a five hour class that i had to take, four hours in the classroom just to be read the laws out loud. One hour on the range which wasnt learning to shoot because thats not part of the requirement. It was just showing that you could hit the entire paper from five yards. Frankly you would have to be blind and deaf to hit a newspaper from five yards. It was not very telling. I had to take a written test, got a 20 question test. Fingerprifingerpri nted ballistics tests. It was one thing after another that i had to go to the dmv twice and anyone who has been to the dmv is itself a deterrent having to go down there. So you are getting the gun transferred so it ended up as i said it took me four months. Host well they did challenge heller the defendant in the original case that went to the Supreme Court. Challenge those prewritten rules but they were upheld in the court. What has happened since then . Guest the heller decision is being appealed. I think i was pleased to see last year through the course of my series coming out the city council moved to make the registration process a little less difficult. I counted 11 steps. Its not 17. Its 11 and obviously the leverage i had in writing the series and scaring them is this pending case. They dont want it to get back to the Supreme Court and get it knocked down again. Its a very d. C. Centric issue. They want to be a state and they know the republicans and the congress are not going to allow either of those things while they have these unconstitutional firearms laws existing. The first one out of the gate was Governor Cuomo and he pushed this through which was written by mayor bloomberg is ridiculous law saying the Maximum Capacity magazines in new york state could be seven. No one checked to find out if any guns were made with seven round magazines. They arent. It was a 1911 pistol and a couple small guns. Because of that they had to do a whole new fix in april to change that and now they are saying you can only load seven rounds. Can you imagine the criminals being like dude, you are almost as seven. You need to stop. Host you hit the nail on the hood head with the problem with so many people have with gun control issues. So many gun control laws may be wellintentioned seem to be based on the idea that the best way to reduce murders and assaults and armed robberies and other guns is to make it as difficult as possible for everybody including lawabiding citizens to own a gun. New york city has the same idea. We already criticize mayor bloomberg pushes this constantly and is now going to do it across the country. Would you agree though that first evolved the 2nd amendment protects a constitutional right . It recognized a common law right that everybody had right up to the revolution and aim to protect that and that people who see that guns can be dangerous are a menace to Public Safety have to recognize that people who take that right seriously deserve to be taken seriously. Would you also agree that gun control laws that aim to keep guns out of the hands of people who everybody agree should not have criminals and drug addicts and people like that in people with criminal records such rules are acceptable if we can never agree guest thats the whole problem here. In fact crime has decreased gun crime alone has decreased 47 since 1991. Of pass 21 years gun crimes gun murders are down 20 . All crime is down but if we are just going to talk about firearms is completely down however we have more guns in this country than we have every had in history. There are 300 million guns in this country especially in a pastor with gun sales firearms sales have gone like this and i can do this very well. You know what im trying to do. Crime gun crime is going down while gun ownership is going up. Its about 10 or 11,000 People Killed each year by gun crimes and a quarter of those are felons and criminals. Guest thats for psychologist to figure out that situation but if we are just talking about people who are murdered who are not criminals themselves, we want to work on that issue. It is decreasing. There are so many things that can be done that are already in existence that obviously like you said gun control act of 1963 says if you are a felony cant have a gun. The only way to stop these things is for enforcement of those charges. The problem with this administration is they dont see it as a priority. That disconnect is such a problem because in order to stop people from doing straw purchases there has to be a deterrent. If the girlfriend thinks how the process works the fbi does a negative denial figure something out. The girlfriend thinks she might go to jail for five years over this, they might stop her and secondly get people like that off the streets when you go after them. These are criminals. We know that so the only way to stop them is to know theres a deterrent. Host i think a lot of people on the gun gun control se of the debate would agree with you on that. After newtown the president of course reacted as many people did in the country to that horrific slaughter of innocent children. By letting or proposing a number of measures and administrative measures that he can take congressional action but he asked for and congress eventually considered on april 17 the Senate Considered a bunch of different proposals and amendments to the gun control law. They all failed. One of them was a course a bam on Dianne Feinstein had proposed a semiautomatic socalled assault rifles like the one that adam lanza the killer in the town used to the kids with. But others, there are others and one was a bipartisan measure that senators manchin and to me back toomey and schumer proposed that would make universal background checks. Another one was a proposal to criminalize straw purchasing and make it punishable by 15 years in prison. Another one was a lot against gun trafficking bringing guns against datelines across state lines. Guest these were already against the law. Host they wanted to strengthen them get all of these amendments failed to reach 60 votes which were required under the rules. Why would people who rationally support strengthening such laws oppose them would they came to a vote in the senate . What happened in newtown was you know just one of the most horrific things that it has ever in america and shattered everybody. What i find to be unfortunate is obama has had this antigun control agenda plan as has Dianne Feinstein. These legislation have been in the works and they announce them within two days of these children being killed. To me it is shameful that they use this opportunity to push a political agenda as opposed to saying this is a horrific thing that happened but there is no law that would have stopped him. No one said this law would have stopped newtown. Because it wouldnt have said they are exploiting them without saying we could stop her children from being safe at school. None of these measures could have stopped adam lanza. Guest you have got crazy people and confusion with the public and i tried to clarify that in my book. Mass shootings get Media Coverage like nothing else. Host horrifying. Guest people relate to them more than city crimes. Urban city crimes much more frequent. Host thats the problem. Guest the way politicians go after these mass crimes and the media as well the public has this misconception that Mass Shootings are the same. Congressional Research Service did a study over the past 10 years. Obviously some years unfortunately horrifically more but its about 18 people a year. One of the things i think that is important for people to know. Some of my girlfriends are terrified sending their kids to school. I would have loved the president instead of making it worse and exaggerating and making people more scared say to the country country this is almost a one off. If you are speaking to the country your children are safe. Theyre not in more danger. First of all one third of the countries Public Schools have guards so those schools have a deterrent and i can go to the movie theaters. Host maybe then you might have said and lets get together and talk about the things we might be able to agree on that could at least help make these things less one of them is tour these are things that Wayne Lapierre from the nra came out and supported after the president made his proposals. One is on guards in schools. A lot of people said thats ridiculous. Turning the schools into depositories for guns. How is that going to pay make people safe and as you said one third of all schools across the country have armed guards. Guest urban are in the 60th percentile. Wayne lapierre that budha, and people are outraged were mostly the liberal media. Host the other comment he made Wayne Lapierre was we have to do something to improve the way we detect and treat Mental Illness of the kind that clearly was behind adam lanzas actions in newtown. That actually was part of the universal background check proposal that Manchin Toomey and schumer proposed. To strengthen the validity of the states to use information for mentally ill people and make it available to the fbi for the National Check system yet that too failed. It didnt have this universal background check and the problem with this via now i say in my book the universal background check is the assault weapons ban of this year. The assault weapons ban was created by antigun activists deliberately and we have saying people will mistakenly think when we talk about assault weapons that there are automatic weapons, machine guns. Thats exactly what he said. They will think its machine guns. The public will be confused and they think they are outlying machine guns but also wrongly think that machine guns are off this streets. In the United States all this here repeatedly that got to get weapons of war off the streets. We have to get machine guns off the streets. He said at one point those children in newtown were killed by a semiautomatic. It is incorrect. Part of why im writing this book is to get the facts out there. Machine guns are automatic guns which is to pull a trigger and many bullets come out until you are stalled or afghanistan. This our military has them in some of our police have them. For civilians they have been highly regulated. Theyre not used in crimes. Because theyre so rare they have been manufactured in 30 years and they are very expensive. We dont want felons you know frankly i dont want a criminal having a fully automatic weapon and we dont want adam lanza having a fully automatic weapon but i dont think you can afford 30,000 to get one in an atf check and a hundred dollar fee. Host that has been effective keeping that kind of weapon out of the hands of everybody, not just criminals but everybody. It was originally aimed at the criminals, the mob. They are getting them off the streets. They are getting them straw purchases. What it affects is the lawabiding and they use this gun show loophole rigmarole all the time. They have interviewed the department of justice interviews regularly people in jail and i guess they tell the truth about where they get their gun. One person say it again showed you. Host calling it a gun show loophole exists something i agree with because a the conscious there are a lot of licensed dealers. Guest i talked to the head of of the gun Show Association because atf has regulated more than normal. Its up to 90 at guns shows and that gun show loophole is another craze invented for the northeast in and places like that in places like virginia where they have gun shows all the time. People go and they know its not a hotbed of criminals running around shooting each other. To someone who doesnt know the issue and isnt familiar it does sound a little bit scary but its not a source of criminal guns. The reason that they could not get 60 votes in the senate is because the Grassley Cruz alternative as we said is a way to strengthen the straw purchasers get Mental Health records and all these kinds of things strengthen the prosecution denials and those things that are solutions where as Manchin Toomey was saying hey we live next door to each other but we are going to have to drive all the way down the street find a gun dealer to do and at the i check and frankly you now and i put this in the document in my book there was a memo written by the Justice Department. I have asked the Justice Department repeatedly who they wrote it for and where it went that they wont say. The nra got a copy of it in and it says the universal background check which is there for noaa term will not do anything to reduce crime unless you have a registration of all the guns in america and the public overwhelmingly opposes universal checks. Host i was drawn to it and i think its a good thing you did mention it in the book. It was analyzed and what universal checks can do is insufficient for ensuring the firearm owners are eligible. You can legally own a gun but then commit bank robbery or something and become an eligible if youre convicted of a crime and its not a good mechanism for checking back on people like that. It does say that most states do not have a firearm registry for ownership so consequently its hard to go back and find out if you are getting the right people if you are doing universal background checks barring the right people from guns but it doesnt anywhere say you need a federal system. Guest go down to the very bottom. Universal checks are insufficient for ensuring recovering guns the nexttolast paragraph. Recovering guns from those that become an eligible is likely effective. There is evidence for that. It says the challenge is implementing host thats it. There must be things we can agree on like improving Mental Health or to making sure that states provide the names of people who shouldnt be provided guns from dealers get into that federal fbi registry. We will never be able today progress on that and make things like new town if not impossible at least less likely to happen unless we stop calling each other names and throwing slogans at each other and i think thats all they did in the senate. It would surprise me to learn that anybody besides Manchin Toomey and schumer have actually read any of the legislation. Guest i dont think schumer did because he threw his name out at the last minute. Host he was working on a proposal like that. Guest the schumer one didnt even go to the floor and thats how rush this thing. They took a bill that they knew wouldnt be on the floor saying we are going to change it later in the committee. Host are gun politics has become really sloganeering and not an attempt to wrestle with serious issues at hand. Isnt it legitimate to want to protect the right of the public to live in safety with the 300 million guns we have in the country . Every gun owner guest that is why they have begun, so they are safer. Host shouldnt there be a way we can talk to each other about these things rationally and try to find Common Ground rather than say your proposal you want to ban guns and you want to take my guns away and you dont want to talk with me. Guest its only coming and want direction. If theyre coming from the Obama Bloomberg side. I think you and i would agree there are enough laws on the books that exist. Enforcing the laws the issue. We are not enforcing them correctly. Not one person ive heard this year has said here is a new law that will actually make the world and the country safer and you safer. There are already so many laws. People are not being prosecuted but i also think the push for gun control has very little to do with Public Safety because gun crime as we have discussed earlier is dramatically down and its gone down every year. Its going down so things are actually working. Why this became the number one issue of the obama demonstration this year and the number one issue of the senate and all of march and april, thats all they talked about when people are safer now than ever. Host people fall back on their core beliefs. Limburg for instance right now on is arguing that the stopandfrisk practice in the new York Police Department which he keeps saying is responsible for murders are only a quarter of what they were 20 years ago. Guest those things do work and i agree with bloomberg. Stopandfrisk if you see someone about to commit a crime find out host thats impossible that its responsible for all of that. Guest they are not down in d. C. Host they are way down from [inaudible] all throughout the country crime is down. Guest to several factors at play but the major ones are of mandatory sentencing for gun crimes the stronger prosecution, more policing on the streets. Those are the things that really get those guys off the streets and get illegal guns off the streets. Host programs like the ones you mentioned in the book like ceasefire where they have in washington and chicago and other places. This is where the police and others work with people and members of criminal gangs and people who have gone straight or serve time in prison and seeing that theyre a waste to come back and talk about young people in gangs about how distractive, selfdestructive it is to rely on guns for security and so on. Guest there are so many factors. The issue is so complicated. Its not going to boil down to one or two simple fixes. You have got they are not graduating from school in inner cities and most of these crimes are innercity crimes. Not graduating from school plus all the other things. There is a lot at play. Host most of the victims of violent gun crime are black and hispanic people in poor neighborhoods. Guest yes, absolutely. That is not what the president upon this talk about in mayor bloomberg has spent tens of thousands of dollars and theyre not seeing him representing the kids on the streets. Host i think his policy while its aims may be wellintentioned its been badly carried out by inexperienced Police Officers who offend more people with stopandfrisk then explained to them. Guest stopandfrisk is a tough issue because you have to guard between the right keeping their arms and searches and seizures versus you see a bad guy who looks like he has a gun. Things like that do help produce reduce crimes in cities but as far as just overall where you have crime going down and decreasing why is this becoming such a National Agenda . The president talked about three days ago passed more executive actions completely pointless on importing historic guns that are 50 years old and things like this. Its become such a political issue but yet when the Justice Department releases a study in may saying that crime is down so much and nonfatal shootings are down 70 and 20 years. Bloomberg is silent. In fact i called his office and i said are you guys going to release anything . I going to talk about this . They said oh they are using other weapons. And things are really much better. Host people talk of the low side to their mouse on this issue and you dont speak to for the nra and im not trying to force you to but they are constantly telling members like me that they need more money to fight off proposals that keep me from buying guns and people like me from buying guns and you need a gun because the police cant always be there and crime is still a problem. Well, it is but as you point out its a half or quarter of the problem it was 20 years ago so why keep spreading fearmongering basically . If not just to sell a gun because that is what the gun control people say the nra is doing. Guest the person who is selling the most guns in history as president obama. Host you point that out in your book. Guest some of the Public Companies and private Companies Companies Freedom Group is one of the biggest. Their sales were up 50 last year and during obamas term the Public Companies, the biggest number has been since obama announced his agenda because heres what happens. Its handguns yet obama from day one of this tragedy push through Diane Feinsteins bill putting it at 40 bus because everyone knows it has absolute nothing to do with crime. Host if they hadnt pushed for the ban on semiautomatic rifles some of these other measures might have passed. Guest nk they n to divide them up like lumping them together.
